Regulations on issuing press releases regarding regulatory legal documents
issued by the Government and the Prime Minister

Based on the Law on Enacting Regulatory Legal Documents 2008;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Pursuant to Decision No. 25/2013/QĐ-TTg dated May 4, 2013, promulgating the Press Speaking and Information Provision Regulation by the Government Prime Minister;
Considering the proposal of the Director of the Ministry of Justice's Office,
The Minister of Justice issues this Circular to stipulate the procedures for issuing press releases regarding regulatory legal documents enacted by the Government and the Prime Minister.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates the procedures for issuing press releases regarding regulatory legal documents enacted by the Government and the Prime Minister (hereinafter referred to as press releases) according to Clause 2 and Clause 3 of Article 12 of the Law on Popularizing and Promoting Legal Awareness 2012, except for regulatory legal documents containing state secrets.
Article 2. This Circular applies to ministries, ministerial-level agencies, and government agencies primarily drafting regulatory legal documents enacted by the Government and the Prime Minister (hereinafter referred to as the primary drafting agency).
Article 2. Provision of information for constructing press releases
Clause 1. The primary drafting agency shall be responsible for providing information to the Ministry of Justice about regulatory legal documents of the Government and the Prime Minister that it primarily drafts to serve the construction of press releases.
Clause 2. The information shall clearly specify the name of the document, date of issuance; issuing authority; effective date; necessity, purpose of issuance, and main content of the regulatory legal document according to the model issued together with this Circular.
Clause 3. Within five working days from the date the regulatory legal document of the Government and the Prime Minister is signed and issued, the primary drafting agency shall be responsible for sending the information specified in Clause 2 of this Article to the Ministry of Justice via official letter and email.
Article 3. Construction of press releases
Based on the information about regulatory legal documents provided by the primary drafting agency, the Ministry of Justice shall be responsible for compiling and editing the content, constructing press releases.
Article 4. Time for issuing press releases
Clause 1. At the latest by the 10th day of each month, the Ministry of Justice shall issue press releases for regulatory legal documents enacted by the Government and the Prime Minister in the previous month, except in cases stipulated in Clause 2 of this Article.
Clause 2. For regulatory legal documents enacted by the Government and the Prime Minister which take effect from the date of signing, the Ministry of Justice shall issue press releases within two working days from the date of receiving the information provided by the primary drafting agency.
Article 5. Publication of press releases
Clause 1. The Ministry of Justice shall publish press releases on its official website and the Vietnam Law News online immediately after signing and issuing them.
Clause 2. The Government Office shall publish press releases on the Government Portal and the Government Online Newspaper immediately upon receipt of the press releases sent by the Ministry of Justice.
Article 6. Responsibilities in coordinating the issuance of press releases
Clause 1. The Ministry of Justice shall be responsible for the content of press releases; lead and coordinate with the Government Office and primary drafting agencies to monitor the implementation of press release issuance; resolve issues arising during the process of issuing press releases; ensure close, regular, and effective coordination among relevant agencies and units in implementing press release issuance.
Clause 2. The primary drafting agency shall be responsible for providing information for constructing press releases in accordance with Clause 2 and Clause 3 of Article 2 of this Circular and shall be accountable for the content of the regulatory legal document information provided to the Ministry of Justice.
Clause 3. In case press releases already issued contain errors in content, the Ministry of Justice shall issue corrective documents immediately upon discovery of the errors. Corrective documents shall be published on online newspapers and portals in accordance with Article 5 of this Circular.
Article 7. Implementation Provisions
Article 1. This Circular takes effect from September 23, 2013.
Article 2. During the implementation of this Circular, if there are any difficulties, relevant agencies and units shall report to the Ministry of Justice for study and resolution./.
