CIRCULAR
REGULATION relating to the model; principles for using uniforms; principles for issuance,
use of the Enforcement Officer Card

Pursuant to Resolution No. 36/2012/QH13 dated November 23, 2012 of the XIIIth National Assembly on continuing the pilot implementation of the Enforcement Officer system;
Pursuant to Decree No. 61/2009/NĐ-CP dated July 24, 2009; Decree No. 135/2013/NĐ-CP dated October 18, 2013 of the Government amending and supplementing the name and some provisions of Decree No. 61/2009/NĐ-CP dated July 24, 2009 on the organization and operation of the Enforcement Officer pilot program in Ho Chi Minh City;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
At the proposal of the Director General of the Civil Execution Department,
The Minister of Justice issues this Circular stipulating the model; principles for using uniforms; principles for issuance, use of the Enforcement Officer Card.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the model; principles for using uniforms; principles for issuance, use of the Enforcement Officer Card.
Article 2. Applicability
This Circular applies to Enforcement Officers, Enforcement Officer Clerks, Enforcement Officer Offices; relevant agencies, organizations, and individuals in the implementation of the pilot Enforcement Officer system.
Article 3. General Principles
1. Enforcement Officers and Enforcement Officer Clerks working at the Enforcement Officer Office's headquarters and when practicing outside the office must wear Enforcement Officer uniforms. Enforcement Officers must use the Card when practicing.
2. The issuance; use of uniforms, Enforcement Officer Cards must be in accordance with the purpose, target, and regulations set forth by law.
3. Strictly prohibited from using uniforms, Enforcement Officer Cards to commit illegal acts.
Chapter II
MODEL AND COLOR OF ENFORCEMENT OFFICER UNIFORMS
Article 4. On Uniforms
1. The uniforms specified in this Circular include: winter clothing, overcoat, short-sleeved spring and summer clothing, long-sleeved shirt, short skirt, leather belt, leather shoes, socks, tie, soft hat, collar tab, badge, logo.
The detailed model of the Enforcement Officer uniform is illustrated by images in the Appendix attached hereto.
2. The material of the uniforms must ensure beauty and quality.
Article 5. Male Uniforms
1. Outerwear for autumn-winter
a) Color: Black-blue fabric;
b) Material: Gabardine wool or equivalent;
c) Style: A double-breasted coat with four patch pockets (two chest pockets, two lower pockets), winged pocket flaps, with a raised seam in the middle of each pocket; V-shaped collar; single row of buttons on the chest, four plastic buttons matching the color of the coat; shoulder pads and shoulder straps made of foam; straight sleeves without slits; square hem; back slit; full lining on the front body, partial lining on the back body, all matching the main fabric color; all collars, necklines, lapels, pockets, and cuffs are sewn with two rows of stitching.
2. Pants
a) Color: Same as the outer winter jacket, suitable for all seasons of spring, summer, autumn, and winter;
b) Material: Same as the outer winter jacket;
c) Style: Tailored like a men's suit, with two side pockets; diagonal side pockets, zipper closure matching the fabric color, inside the waistband has a plastic button, the center of the waistband has a stainless steel hook; the waistband has six evenly distributed elastic bands on both sides; the back of the pants has one rear pocket, without a flap; the inner lining matches the main fabric color.
3. Long-sleeved shirt
a) Color: White fabric;
b) Material: Pevi 7288 fabric or equivalent;
c) Style: Long-sleeved standing-collar shirt; lapel collar folded inward; cuffs have pleats and two buttons to adjust sleeve width, plastic buttons matching the shirt color; one pocket above the left chest, rounded bottom pocket, with a 3cm stitched edge; straight hem.
4. Short-Sleeved Spring-Summer Jacket
a) Color: Dark blue fabric;
b) Material: Pevi 7288 fabric or equivalent;
c) Style: Standing-collar shirt with a placket, short-sleeved; lapel collar and cuffs; single row of white plastic buttons; two chest pockets with winged flaps, with a raised seam in the middle of each pocket; back yoke; all collars, hems, cuffs, and pocket edges are sewn with two rows of stitching.
5. Overcoat
a) Color: Black-blue;
b) Material: Gabardine wool or equivalent;
c) Style: Single-breasted coat with three hidden buttons, plastic buttons matching the fabric color, V-shaped collar (recessed lapel, protruding collar); back slit; inner lining with a pocket, outer with a drawstring; diagonal side pockets; pointed cuffs with one plastic button matching the color; raised seams 0.8 cm wide, entire body lined with haircloth, matching inner lining, shoulder pads made of foam;
d) For southern provinces, due to weather conditions and within the budget allocated by the Enforcement Officer Office for making uniforms, the Head of the Enforcement Officer Office shall consider and decide to convert one overcoat into two spring and summer coats to suit local weather conditions.
Article 6. Women's Uniforms
1. Outerwear for autumn-winter
a) Color: Black-blue fabric;
b) Material: Gabardine wool or equivalent;
c) Style: A women's blazer with two outside pockets at the bottom, batwing pocket flaps, two front and back darts; V-neck, single row of four matching plastic buttons on the chest; shoulder pads; straight sleeves without slits; square hem; back slit; full lining on the front body, partial lining on the back body matching the main fabric color; all lapels, collars, plackets, pockets, and cuffs have double stitching.
2. Pants and Skirts
a) Color: Matching the outer winter jacket; pants suitable for spring, summer, autumn, and winter; skirts for spring and summer.
b) Material: Same material as the outer winter jacket.
c) Style: European-style women's pants with hidden pleats, two diagonal side pockets; zipper fly with a button and hook at the waistband; six evenly distributed darts; back pocket with no flap; pencil skirt to knee length with a back slit, two front pockets.
3. Long-sleeved shirt
a) Color: White fabric;
b) Material: Pevi 7288 fabric or equivalent;
c) Style: Collar stand-up (buttoned); lapel turned inward; white plastic buttons matching the fabric color; straight hem; two front darts from hem to chest, back darts from hem; sleeve cuffs with two buttons.
4. Short-Sleeved Spring-Summer Jacket
a) Color: Dark blue fabric;
b) Material: Pevi 7288 fabric or equivalent;
c) Style: Stand-up collar (buttoned), short or long sleeves; lapel turned outward; single row of white plastic buttons; two chest pockets with batwing flaps, ribbed center seam; two front darts from hem to chest, back darts from hem; entire collar and hem straight; cuffs, lapel, and pocket flaps have double stitching.
5. Overcoat
a) Color: Black-blue;
b) Material: Gabardine wool or equivalent;
c) Style: Straight-buttoned jacket with three hidden buttons, matching plastic buttons, K-shaped lapel (lapel inset, collar protruding); back slit; exterior belt; diagonal pockets; pointed sleeve tabs with one matching button; raised seams 0.8 cm wide; entire body lined with matching fabric, shoulder pads made of foam.
d) For southern provinces, due to weather conditions and within the budget allocated by the Enforcement Officer Office for making uniforms, the Head of the Enforcement Officer Office shall consider and decide to convert one overcoat into two spring and summer coats to suit local weather conditions.
Article 7. Other Uniforms Commonly Equipped for Both Men and Women
1. Emblem: Attached to the front of the hat and above the right arm of the winter and spring-summer jackets, sized appropriately for the garment.
The Notary Public emblem is oval-shaped, measuring 6 cm in length from top edge to bottom point, 4 cm in width; red and white border, light blue background; top edge wavy like bird wings, bottom edge tapering to a point, with three white and red curves above the bottom edge and a yellow gear symbol; center repeats a smaller emblem on a red background with "NOTARY PUBLIC" in yellow; two balanced golden ears of wheat placed on either side.
2. Nameplate: Rectangular nameplate made of metal with a glossy plastic coating; nine dragon blue background; dimensions 80 mm long, 20 mm wide; outer border 1.5 mm wide; vertically centered is the Notary Public Office name, below is the surname; last line indicates title (Notary Public or Clerk).
The nameplate is worn on the left chest during practice.
3. Tie: Black-blue, Gabardine wool or equivalent, moderate length and width; pre-tied with a zipper closure and automatic lock.
4. Men's Soft Cap
a) Color: Black-blue;
b) Material: Gabardine wool or equivalent;
c) Style: Korean-style soft cap with detachable brim, oval crown according to head measurement, 1.2 cm wide ribbon at the ends of the brim with two covered buttons; each side of the cap has three air vents; logo attached to the front; inner lining matches the main fabric color.
5. Women's Soft Cap
a) Color: Black-blue;
b) Material: Gabardine wool or equivalent;
c) Style: Integrated brim, two-thirds of the rear folds up along the cap, one-third of the front forms the shape; oval crown according to head measurement, dome height 7 cm, top dome with light nine-dragon blue fabric (similar to cap color) 3 cm high; logo attached to the front; inner lining matches the main fabric color.
6. Belt: Metal rectangular buckle, dark leather strap.
7. Leather Shoes: Leather material, black, lace-up, low-cut (for men); leather material, black, low-cut, slip-on (for women).
8. Socks: White, knitted elastic material.
Article 8. Management of Uniforms for Notaries Public
1. Notaries Public and Business Secretaries, when being issued uniforms for Notaries Public, must have the responsibility to carefully preserve and maintain them.
2. Strictly prohibited from lending, borrowing, exchanging, or selling uniforms for Notaries Public to persons who are not Notaries Public or Business Secretaries. When Notaries Public or Business Secretaries cease their work or are relieved of their duties, the Head of the Notary Public Office shall be responsible for recovering the uniforms for Notaries Public.
Article 9. Funding for Implementation
The cost of making, issuing uniforms for Notaries Public and Business Secretaries shall be guaranteed by the Notary Public Office. The Notary Public Office shall report on the issuance of uniforms to the Department of Justice of the province or centrally administered city where the Notary Public Office is located.
Chapter III
SAMPLES, PRINCIPLES OF ISSUE AND USE OF NOTARY PUBLIC CARDS
Article 10. Notary Public Card
The Notary Public Card is issued to Notaries Public for use and presentation when practicing according to the law. The Notary Public Card is a type of document certifying the image, name, date of birth, and workplace of the Notary Public.
Article 11. Sample of Notary Public Card
The Notary Public Card has an outer cover with a burnt red color, width of 9.5 cm, length of 14.0 cm (folded in two), consisting of a front cover page, a back cover page, and two inner pages:
a) The front cover page (page 1) at the very top has the phrase "SOCIALIST REPUBLIC OF VIETNAM", below it is the National Emblem of the Socialist Republic of Vietnam, under the National Emblem is the phrase "NOTARY PUBLIC CARD", in the lower left corner there are two diagonal gold lines (one small and one large) extending to the upper corner of the back cover page;
b) Pages 2 and 3 of the Card have floral patterns and the National Emblem of the Socialist Republic of Vietnam printed faintly as a background;
c) On page 2, at the very top center, there is the phrase "MINISTRY OF JUSTICE", below it is the symbol of the Justice Sector, followed by a photograph of the Notary Public size 3x4 with a raised seal at the bottom right corner, below the photograph is the card number;
d) Page 3 contains:

e) The back cover page (page 4) includes the content of Clause 1, Article 4 of Decree No. 61/2009/NĐ-CP dated July 24, 2009 of the Government regarding the organization and operation of Notaries Public piloted in Ho Chi Minh City, specifically as follows:

"State agencies, political organizations, political-social organizations, social organizations, social-professional organizations, economic organizations, people's armed forces within the scope of their tasks and powers, and individuals are responsible for implementing the requests of Notaries Public in accordance with the law." Article 12. Management and Use of Notary Public Cards
When receiving a Notary Public Card, Notaries Public must have the responsibility to carefully preserve and maintain it. Strictly prohibited from lending, borrowing, exchanging, selling, erasing, modifying, using the Card for personal purposes; using another person's Card or lending the Card to others for use. In case of loss, the Notary Public must report to the police agency and the Department of Justice where the Notary Public Office is located to handle according to their authority.
Article 13. Issuance and Recovery of Notary Public Cards
1. Issuance of Notary Public Cards
After obtaining the registration certificate for operations, the Head of the Notary Public Office shall submit a letter and accompanying documents to the Department of Justice of the province or centrally administered city where the Notary Public Office is located, requesting issuance of Cards for Notaries Public working at the Office.
The application for issuance of the Card includes: A request for issuance of the Card from the Head of the Notary Public Office; An application for issuance of the Card from the Notary Public, a brief resume, a copy of the appointment decision for the Notary Public, five 3x4 color photographs; The registration certificate for operations of the Notary Public Office; documents proving that they do not concurrently practice Notarization, Lawyer, or other jobs as prescribed by law.
Within five days, the Department of Justice shall be responsible for reviewing and submitting to the Minister of Justice for issuance of Cards to those who meet the conditions.
Within ten days from the date of receipt of the application and documents from the Department of Justice, the Minister of Justice shall review and decide on the issuance of Notary Public Cards.
2. Reissuance of Notary Public Cards
In cases where the Notary Public Card is damaged or lost due to objective reasons, the Notary Public Office shall request the Department of Justice to process the reissuance of the Card to the Minister of Justice.
The application for reissuance of the Card includes: A request and confirmation from the Head of the Notary Public Office about the loss of the Card or damage to the Card; An application for reissuance of the Card, five 3x4 color photographs; if the Card is damaged, the old Card should be submitted along with the application.
Within five days, the Department of Justice shall be responsible for reviewing and submitting to the Minister of Justice for reissuance of the Card.
Within ten days from the date of receipt of the application and documents from the Department of Justice, the Minister of Justice shall review and decide on the reissuance of Notary Public Cards.
3. Recovery of Notary Public Cards
When Notaries Public no longer work at the Notary Public Office or are relieved of their duties, they must return the Card to the Notary Public Office or to the Department of Justice of the province or centrally administered city where the Notary Public Office is located.
The Director of the Department of Justice of the province or centrally administered city where the Notary Public Office is located shall be responsible for handing over and reporting to the Ministry of Justice for recovery and corner-cutting of the Card.
The Head of the Notary Public Office shall post a notice of recovery of the Card at the office premises of the Notary Public Office so that organizations and individuals are aware.
Article 14. Implementation Costs
The cost of printing and issuing Notary Public Cards shall be guaranteed by the Ministry of Justice in accordance with current laws.
Chapter IV
IMPLEMENTING PROVISIONS
Article 15. Effective Date
This Circular takes effect from June 10, 2014.
Article 16. Implementation Organization
1. Directors of the Departments of Justice of provinces and centrally administered cities where the Notary Public system is piloted, Heads of Notary Public Offices, and related agencies, organizations, and individuals shall be responsible for implementing this Circular.
2. The Civil Enforcement General Department under the Ministry of Justice shall be responsible for assisting the Minister of Justice in monitoring, urging, and inspecting the implementation of this Circular.
3. During the implementation, if there are difficulties, related agencies, organizations, and individuals shall promptly report to the Ministry of Justice for appropriate resolution./.
