ON CRITERIA FOR SELECTING AND RECOGNIZING PERSONS OF REPUTATION AMONG ETHNIC MINORITY GROUPS AND POLICIES FOR SUCH PERSONS
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on ethnic affairs;
Pursuant to Resolution No. 106/NQ-CP dated October 10, 2017 of the Government on the regular meeting of the Government in September 2017;
At the proposal of the Minister, Head of the Committee for Ethnic Minorities;
The Prime Minister issues this Decision on criteria for selecting and recognizing persons of reputation among ethnic minority groups and policies for such persons.
Article 1. Scope of Regulation
This Decision stipulates criteria for selecting and recognizing persons of reputation among ethnic minority groups and policies for such persons throughout the country.
Article 2. Applicability
1. Persons of reputation among ethnic minority groups (hereinafter referred to as persons of reputation).
2. Agencies, organizations, and individuals involved in managing and implementing policies for persons of reputation.
Article 3. Principles of Implementation
1. Persons of reputation shall be selected from villages, hamlets, neighborhoods, and equivalent units (referred to collectively as villages).
2. Policies shall be implemented directly for persons of reputation, ensuring transparency, fairness, correct target groups, and appropriate benefits.
3. Persons of reputation shall be directly managed by localities, assigned, and delegated to implement policies and mobilize their roles in promoting unity and cultural preservation within their communities.
4. In cases where a person of reputation qualifies for multiple support policies with similar characteristics, they shall only benefit from the policy with the highest level of support.
Article 4. Criteria, Objectives, and Conditions for Selecting Persons of Reputation
1. Criteria for Selecting Persons of Reputation
a) Being a Vietnamese citizen, regardless of ethnicity, residing legally in Vietnam;
b) Demonstrating exemplary compliance with Party guidelines, State policies and laws, and local regulations by themselves and their families;
c) Being a distinguished individual who has made significant contributions to patriotic campaigns, poverty reduction, security maintenance, cultural preservation, and ethnic unity;
đ) Having the ability to unite and gather ethnic minority groups within a certain area through speech and actions, gaining trust and following from the local populace.
2. Target Groups for Selection
Persons of reputation shall be selected from the following categories:
a) Civil servants, public officials, and military personnel as prescribed by current laws who have long-term service records and have contributed significantly to the nation and have retired;
b) Village elders, village chiefs, clan leaders, or individuals frequently invited by ethnic minority groups to perform rituals for families, clans, and villages;
c) Religious figures in regions with ethnic minorities (Buddhism, Islam, Protestantism, Catholicism, etc.);
d) Intellectuals, businesspeople, educators, skilled healers, or individuals with economic means who assist and are trusted by the local populace.
a) Each village in ethnic minority areas must have at least one-third of households or population members from ethnic minorities elect one person of reputation;
b) In cases where villages do not meet the conditions specified in point a Clause 3 of this Article or have multiple ethnic groups cohabiting, the number of persons of reputation to be elected shall be determined based on actual circumstances and recommendations from the Chairman of the People's Committee of the district and the Chairman of the People's Committee of the province, but the total number of persons of reputation elected shall not exceed the total number of villages in ethnic minority areas within the province.
Article 5. Treatment and policies for persons of prestige
1. Provision of Information
a) Periodically or unexpectedly, persons of prestige shall be informed about new policies, guidelines of the Party, laws and regulations of the State; economic and social development situations and tasks; national defense, security, and public order; and results of ongoing programs, projects, and ethnic policies at the local level.
b) Persons of prestige shall be provided free of charge: one copy of the "Dân tộc và Phát triển" newspaper issued by the Committee for Ethnic Minorities Affairs; one copy of the provincial newspaper or other suitable information forms chosen by the locality.
c) Persons of prestige shall be trained and educated on legal knowledge, national defense, security, ethnic policies, and skills in mediation, propaganda, and mobilizing the masses.
2. Material support and spiritual encouragement
In accordance with the management hierarchy for implementing policies, persons of prestige shall be entitled to:
b) Visits and assistance when persons of prestige fall ill, not exceeding one time per year. The expenditure limit is no more than 3,000,000 VND per person per year at the central level; no more than 1,500,000 VND per person per year at the provincial level; and no more than 800,000 VND per person per year at the district level;
c) Visits and assistance to households of persons of prestige facing difficulties due to natural disasters or fires. The expenditure limit is no more than 2,000,000 VND per household per year at the central level; no more than 1,000,000 VND per household per year at the provincial level; and no more than 500,000 VND per household per year at the district level;
d) Condolences and encouragement when persons of prestige or their family members (father, mother, spouse, children) pass away. The expenditure limit is no more than 2,000,000 VND per case at the central level; no more than 1,000,000 VND per case at the provincial level; and no more than 500,000 VND per case at the district level;
Persons of prestige who achieve outstanding results in labor production, economic and social development, national defense, public order, preserving cultural identity, and ethnic unity shall be recognized and awarded according to the provisions of the Law on Encouragement and Rewards and current guiding documents on encouragement and rewards.
4. Delegations of persons of prestige organized by localities to visit and work at Party, National Assembly, State, and All-Vietnam Association for the Propagation of the Fatherland's Unity offices at the central and local levels shall be received and presented with souvenirs. The expenditure limit for presenting souvenirs is no more than 500,000 VND per delegate; reception expenses shall be carried out according to current regulations on domestic guest reception expense regimes.
1. Recognition of persons of prestige
Persons of prestige shall be selected and recognized every five years, conducted in the fourth quarter and completed before December 15 of the selection year, following the procedures below:
a) The village head shall convene a village meeting (with participation of at least two-thirds of the households in the village) to disseminate the main contents of the policy, criteria, and conditions for selecting persons of prestige as stipulated in Clause 3, Article 4 of this Decision, and nominate persons of prestige (using Model No. 01 attached to this Decision) to send to the village mass organization work committee head.
The village mass organization work committee head shall convene a joint meeting (with participation of representatives from the Party branch, administrative authorities, mass organizations, and villagers' households in the village), compile a list of proposed persons of prestige to submit to the People's Committee of the commune (one set of files including: the proposal letter and the minutes of the joint meeting using Model No. 02 attached to this Decision);
b) Within five working days from the date of receiving complete and valid files from the village, the People's Committee of the commune shall consolidate, inspect, and prepare a file (one set including: the proposal letter along with the list and the minutes using Model No. 03 attached to this Decision) to send to the People's Committee of the district;
c) Within five working days from the date of receiving complete and valid files from the communes, the People's Committee of the district shall consolidate, inspect, and prepare a file (one set including: the proposal letter, the list using Model No. 04 attached to this Decision, and a summary of the proposal files from the communes) to send to the provincial ethnic affairs agency;
d) Within five working days from the date of receiving complete and valid files from the districts, the provincial ethnic affairs agency shall consolidate, coordinate with the provincial public security agency, the provincial All-Vietnam Association for the Propagation of the Fatherland's Unity, and related functional agencies to complete the file (one set including: the report, the list of proposed persons of prestige using Model No. 04 attached to this Decision, and a summary of the proposal files from the districts), to submit to the Chairman of the Provincial People's Committee for approval of the list of persons of prestige in the province.
2. Supplementing persons of prestige
a) Annually, the Chairman of the Provincial People's Committee shall consider and decide to supplement persons of prestige based on the proposal of the Chairman of the District People's Committee for the following cases:
- To replace those specified in point a, Clause 3, Article 3 of this Decision.
- Areas without persons of prestige and meeting the conditions stipulated in Clause 3, Article 4 of this Decision.
b) The procedure for supplementing persons of prestige shall be carried out in accordance with the provisions of Clause 1 of this Article.
3. Removing persons of prestige from the list
a) Cases of removing persons of prestige from the list:
- The person of prestige has passed away.
- The person of prestige has moved to live elsewhere or due to poor health, voluntarily requests to be removed from the list of persons of prestige (using Model No. 05 attached to this Decision).
- The person of prestige violates the law.
- The person of prestige loses civil capacity according to current laws.
- The person of prestige loses prestige and does not meet the criteria stipulated in Clause 1, Article 4 of this Decision.
b) Procedure for removing persons of prestige from the list:
- When the cases specified in point a Clause 3 of this Article occur, the Chairman of the Village Mass Organization Work Board shall convene a joint meeting (with the participation of representatives from the Party Cell, local administration, Village Mass Organization Work Board, mass organizations, and representatives of households in the village), establish a proposal to remove from the list of persons of trust, and submit it to the People's Committee of the commune (one set including: the proposal document, minutes of the meeting according to Form No. 06 attached to this Decision, and related documents).
- Within five working days from the date of receipt of the village's proposal document, the People's Committee of the commune shall examine and establish a file (one set including: the proposal document, minutes according to Form No. 07 attached to this Decision, and related documents) and submit it to the People's Committee of the district.
- Within five working days from the date of receipt of the complete and valid file from the commune, the People's Committee of the district shall consolidate, examine, and establish a file (one set including: the proposal document accompanied by a list and a summary of the proposal files from the commune) and submit it for approval by the Chairman of the People's Committee of the district to the provincial ethnic affairs agency.
- Within five working days from the date of receipt of the complete and valid file from the district, the provincial ethnic affairs agency shall consolidate, coordinate with the provincial public security agency, the Provincial United Front Federation, and relevant functional agencies to complete the file (one set including: the report accompanied by the list of proposals for removal from the list of persons of trust and a summary of the proposal files from the districts) and submit it for decision by the Chairman of the People's Committee of the province to remove from the list of persons of trust within the provincial territory.
Article 7. Funding for policy implementation
1. The funding for policies towards persons of trust shall be guaranteed by the state budget.
a) Allocate funds in the annual budget of the Ethnic Affairs Committee and relevant central agencies to implement activities as prescribed in Article 8 of this Decision;
b) Support funds for difficult areas that have not yet achieved budget self-sufficiency under the mechanism stipulated in Decision No. 579/QĐ-TTg dated April 28, 2017.
3. Local Budget
a) Allocate and balance funds in the annual budget of provinces and cities according to the分级预算规定，以实施本决定规定的其他制度和政策以及地方的管理和组织实施工作；
b) Based on the content of the policies stipulated in this Decision, localities may provide support and create conditions for persons of trust to carry out assigned tasks in accordance with the actual conditions of their locality.
4. The preparation, execution, and settlement of the budget for implementing the policies stipulated in this Decision shall be carried out in accordance with the provisions of the State Budget Law and related guiding documents.
Article 8. Implementation organization
1. The Ethnic Affairs Committee shall take the lead and coordinate with relevant ministries, sectors, and agencies:
a) Guide, urge, inspect, summarize, evaluate, and report on the results of implementing this Decision;
c) Organize receptions, visits, exchanges, meetings, seminars, roundtable discussions, experience sharing, commendation, and awards for outstanding persons of trust in ethnic minority regions across the country.
2. The Ministry of Finance shall guide the financial management mechanisms for using funds to implement the policies stipulated in this Decision; allocate funds to implement the policies stipulated in Clause 2, Article 7 of this Decision.
3. The Ministry of Public Security and the Ministry of National Defense shall take the lead and coordinate with the Ethnic Affairs Committee to implement the policies stipulated in this Decision for persons of trust who are assigned management responsibilities.
4. The Ministry of Information and Communications shall take the lead and coordinate with the Ethnic Affairs Committee, relevant ministries, sectors, and localities to direct news agencies, press, and grassroots information systems to strengthen information dissemination and propaganda on policy implementation and mobilization efforts to leverage the role of persons of trust in diverse and appropriate forms for ethnic minorities.
5. Relevant ministries and sectors shall, according to their functions and assigned tasks, be responsible for coordinating with the Ethnic Affairs Committee to guide, urge, inspect, and support localities in effectively implementing the policies stipulated in this Decision.
6. Request the Vietnam Fatherland Front Central Committee and its member organizations to direct levels along the vertical line to coordinate in implementation and participate in supervising policy implementation as prescribed.
7. Provincial People's Committees
a) Shall bear full responsibility for establishing lists,分级管理，分级负责执行政策和动员、发挥信任人士作用的工作；
b) Entrust the provincial ethnic affairs agency as the permanent body assisting the provincial People's Committee to direct, guide, and implement this Decision;
c) Direct relevant local functional agencies to regularly inspect and supervise to ensure correct implementation of policies, timely and accurately; periodically summarize, evaluate, and report on the results of policy implementation to the Ethnic Affairs Committee for consolidation and reporting.
Article 9. Transitional Provisions
In 2018, localities shall review the current list of people with prestige, unify the beneficiary subjects, and approve a list of people with prestige within their province according to Clause 1 of Article 6 of this Decision. Subsequent years shall be implemented in accordance with Article 6 of this Decision.
Article 10. Implementation Provisions
1. This Decision takes effect from April 24, 2018.
2. This Decision replaces the following documents and Articles and Clauses within related documents: Decision No. 18/2011/QĐ-TTg dated March 18, 2011 of the Prime Minister on policies for people with prestige among ethnic minority groups; Decision No. 56/2013/QĐ-TTg dated October 7, 2013 of the Prime Minister on amending and supplementing certain Articles of Decision No. 18/2011/QĐ-TTg dated March 18, 2011 of the Prime Minister; Point a of Clause 4 of Article 1 of Decision No. 2561/QĐ-TTg dated December 31, 2016 of the Prime Minister approving the Project "Strengthening the role of people with prestige in ethnic minority areas"; Circular Joint No. 01/2014/TTLT-UBDT-BTC dated January 10, 2014 of the Committee for Ethnic Minorities and the Ministry of Finance detailing and guiding the implementation of policies for people with prestige among ethnic minority groups; Section I (identifying people with prestige in ethnic minorities) and Clause 1 of Section II (establishing a list of people with prestige) of Guidance No. 04/HD-BCA(A11) dated March 16, 2009 of the Ministry of Public Security guiding the implementation of Directive No. 06/2008/CT-TTg dated February 1, 2008 of the Prime Minister on leveraging the role of people with prestige among ethnic minority groups in the cause of building and defending the country.
3. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./

Note: - In the event of the death of an influential person: no joint meeting will be organized. The village chief shall prepare a proposal to remove from the list of influential persons and send it to the People's Committee of the commune;
- In cases where an influential person voluntarily requests to withdraw from the list, a formal letter must be submitted according to Model No. 04 attached to this Decision;
- Representatives of households in the village who do not participate in voting but join the vote-counting team to oversee the voting results for removing influential persons from the village list.
