Band Planning for the Frequency Bands 1920-1980 MHz and 2110-2170 MHz for the IMT Mobile Communication System in Vietnam

Pursuant to the Radio Frequency Law dated November 23, 2009; the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law dated November 9, 2022;

Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Plan; Decision No. 38/2021/QĐ-TTg dated December 29, 2021 of the Prime Minister amending and supplementing certain articles of Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Plan;

At the proposal of the Director of the Radio Frequency Management Department,

The Minister of Information and Communications issues this Circular on Band Planning for the Frequency Bands 1920-1980 MHz and 2110-2170 MHz for the IMT Mobile Communication System in Vietnam.

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular plans the frequency bands 1920-1980 MHz and 2110-2170 MHz for deploying mobile communication systems according to the IMT standard (including IMT-2000, IMT-Advanced, IMT-2020, and subsequent versions, as defined by the International Telecommunication Union - ITU).

This Circular applies to organizations and individuals participating in managing and using radio frequencies; organizations and individuals producing, importing, and trading radio equipment for use in Vietnam.

Article 2. Content of Planning

1. The frequency bands 1920-1980 MHz and 2110-2170 MHz are planned for deploying mobile communication systems according to the IMT standard as follows:

1920     1935     1950     1965     1980     2110     2125     2140     2155     2170 MHz

a) The frequency band 1920-1980 MHz is allocated for the uplink band, divided into four blocks B₁, B₂, B₃, B₄ each with a width of 15 MHz;

b) The frequency band 2110-2170 MHz is allocated for the downlink band, divided into four blocks B1', B2', B3', B4' each with a width of 15 MHz;

c) The maximum total bandwidth that an organization may be licensed to use within the frequency bands 1920-1980 MHz and 2110-2170 MHz is 2x15 MHz using frequency division duplex (FDD) transmission mode, except in cases where licenses are granted for reuse of frequency bands under Article 4, Clause 4 of Law No. 09/2022/QH15 dated November 9, 2022 of the National Assembly amending and supplementing certain provisions of the Radio Frequency Law.

2. The frequency bands 1920-1980 MHz and 2110-2170 MHz shall be used to deploy mobile communication systems according to the IMT-2000 standard and subsequent versions until September 14, 2028. From September 15, 2028, these frequency bands shall be used to deploy mobile communication systems according to the IMT-Advanced standard and subsequent versions.

3. Organizations licensed to use the frequency bands within 1920-1980 MHz and 2110-2170 MHz shall cooperate with each other to prevent harmful interference.

Article 3. Implementation Provisions

1. This Circular takes effect from November 27, 2003

2. Decision No. 03/2005/QĐ-BBCVT dated January 17, 2005 of the Minister of Posts and Telecommunications approving the band planning for the IMT-2000 mobile communication system in Vietnam until 2015 in the frequency range 1900-2200 MHz ceases to be effective from the date this Circular takes effect.

3. Abolish Clause 2.3.4, Article 1 and related provisions concerning the frequency bands 1920-1980 MHz and 2110-2170 MHz in Decision No. 25/2008/QĐ-BTTTT dated April 16, 2008 of the Minister of Information and Communications approving the band planning for cellular mobile communication systems in Vietnam in the frequency ranges 821-960 MHz and 1710-2200 MHz.

4. Abolish Clause 3, Article 2 and related provisions concerning the frequency bands 1920-1980 MHz, 2110-2170 MHz in Circular No. 04/2017/TT-BTTTT dated April 24, 2017 of the Minister of Information and Communications on implementing the IMT mobile communication system on the frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz, 1805-1880 MHz, 1920-1980 MHz, 2110-2170 MHz.

5. The Head of the Office, the Director of the Radio Frequency Management Department, Heads of agencies and units under the Ministry of Information and Communications, and relevant organizations and individuals are responsible for enforcing this Circular.

6. In the course of implementation, if there are difficulties or obstacles, please promptly report to the Ministry of Information and Communications (Radio Frequency Management Department) for consideration and resolution./.
