Pursuant to the Library Law on November 21, 2019;

Pursuant to Decree No. 93/2020/NĐ-CP dated August 18, 2020 of the Government detailing certain provisions of the Law on Libraries;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or tendering for the provision of products and public services using state budget funds from regular expenditure;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;

Pursuant to Decree No. 01/2023/NĐ-CP dated January 16, 2023 of the Government providing for the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Library Department;

The Minister of Culture, Sports and Tourism promulgates this Circular regulating economic and technical norms for services related to collecting, preserving, and promoting the value of ancient, rare, and valuable document collections with special historical, cultural, and scientific value.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates economic and technical norms for services related to collecting, preserving, and promoting the value of ancient, rare, and valuable document collections with special historical, cultural, and scientific value (hereinafter referred to as special documents) in library activities funded by the state budget.

a) Public libraries as stipulated in point a, Clause 2, Article 9 of the Law on Libraries that use the state budget to provide services for collecting, preserving, and promoting the value of special documents according to library business procedures (hereinafter referred to as public service services);

b) Other agencies and organizations that use the state budget to provide public service services as prescribed;

c) Agencies, organizations, and individuals managing or involved in the implementation of public service services funded by the state budget;

d) Encouraging libraries and non-public agencies and organizations to implement public service services without using the state budget to apply the economic and technical norms set forth in this Circular.

Article 2. General Provisions on Economic and Technical Standards

Article 2. The economic and technical norms in this Circular are the maximum levels, ensuring the accurate calculation of labor costs, machinery and equipment costs, and material costs directly required to complete the provision of public service services.

Article 3. The economic and technical norms in this Circular serve as the basis for relevant agencies and organizations to determine unit prices and service fees for public service services funded by the state budget when placing orders in accordance with Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or tendering for the provision of products and public services using state budget funds from regular expenditure.

Article 4. The job titles within the labor cost component in the norm tables are determined based on the following principles:

a) Job titles within the labor cost component of the norm table are determined according to the provisions of Circular No. 02/2022/TT-BVHTTDL dated July 1, 2022 of the Minister of Culture, Sports and Tourism on job title codes, standards, and salary scales for library professionals, and Circular No. 10/2023/TT-BVHTTDL dated August 9, 2023 of the Minister of Culture, Sports and Tourism guiding positions, leadership and management job titles, and professional job title structures in public service units under the cultural, sports, and tourism sector.

b) In cases where job titles within the labor cost component are not included in Circular No. 02/2022/TT-BVHTTDL or Circular No. 10/2023/TT-BVHTTDL, they shall be applied according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, and employees and armed forces personnel, Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing some articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, and employees and armed forces personnel, Decree No. 111/2022/NĐ-CP dated December 30, 2022 of the Government on contracts for certain types of work in administrative agencies and public service units, or equivalent conversion based on approved job positions.

c) In cases where the rank and grade of job titles actually differ from those specified in the appendices issued with this Circular, the competent management agency or organization of the library or service provider (hereinafter referred to as the library) shall consider and decide on applying the actual rank and grade of job titles and calculate the cost based on actual conditions to ensure labor costs do not exceed the total labor cost norm for corresponding services.

Article 5. Other expenses serving the provision of public service services shall be handled as follows:

a) For expenses such as purchasing copyright, translating documents, electricity, transaction phone charges, travel expenses, using infrastructure and information technology facilities, library management software, specialized machines and equipment, office supplies, common management and professional activity expenses, and other incidental expenses, libraries and organizations shall apply the levels established by competent state authorities or prepare separate budgets for additional processes outside these norms to submit for approval according to state budget laws.

b) For hiring consulting experts, it shall be carried out according to Circular No. 02/2015/TT-BLĐTBXH dated January 12, 2015 of the Minister of Labor, Invalids, and Social Affairs on salary levels for domestic consulting experts as the basis for estimating tender packages for consulting services under time-based contracts using state funds.

c) For documents requiring authentication to determine artifacts and antiques, economic and technical norms shall be calculated according to legal regulations on economic and technical norms for artifact and antique authentication services.

d) For actual expenses and other rental and purchase services, they shall be implemented according to state budget laws. If the service payment falls within the mandatory tender threshold, it shall be carried out according to tender laws.

Article 3. Content and structure of economic and technical norms

1. The content of economic and technical norms includes:

a) Direct labor cost: refers to the necessary direct and indirect labor time of average skill levels required to complete the provision of a service. The level of direct labor cost is the time spent on each stage of the public service, measured in workdays (each workday corresponding to 01 working day (08 hours) of labor as stipulated in Article 105 of the Labor Code). The level of indirect labor cost is calculated at a ratio of 15% of the total direct labor cost.

b) Machine and equipment usage cost: refers to the necessary usage time of each type of machine and equipment required to complete the provision of public services. The level of cost in the standard is calculated in terms of machine usage shifts, with each shift corresponding to 01 working day (08 hours) of depreciation time for machines as stipulated in Article 105 of the Labor Code.

c) Material usage cost: refers to the specific quantity of various materials actually and necessarily used to provide public services. The level of cost in the standard is calculated based on the specific quantity of each type of material. The level of auxiliary material cost is calculated at 10% of the total value of material usage costs within the same standard table.

2. The structure of economic and technical norms includes:

a) Name of the norm;

b) Description of work content: the main work stages to implement the provision of public services;

c) Norm table, including:

- Labor cost standard: position and skill level, unit of measurement for labor cost, labor cost standard value;

- Machinery and equipment usage consumption cost norm: name of machinery or equipment, unit of measurement for consumption cost, normative consumption cost value;

- Material usage cost standard: name and specifications of materials, unit of measurement for material cost, material cost standard value;

- Standard value: is the numerical value of actual time spent on labor cost, machine and equipment usage cost, and material usage cost during the process of providing public services.

- Notes: are instructions on how to calculate standards under different technical conditions (if any) or to complete a workload different from the unit of measurement in the Standard Table.

Article 4. Economic and technical standards for special document collection services

1. Special document collection services are implemented through one or more of the following forms:

a) Collection from the community.

b) Purchase from organizations or individuals.

c) Acceptance of gifts, donations, or transfers from organizations or individuals.

d) Exchange between libraries, between libraries and agencies, organizations, or individuals.

đ) Other collection methods.

2. The economic and technical standards for special document collection services are detailed in Appendix No. 01 attached hereto.

Article 5. Economic and technical standards for special document preservation services

1. Special document preservation services are implemented through the following forms:

a) Preventive preservation.

b) Restorative preservation.

c) Document format conversion.

2. The economic and technical standards for special document preservation services are detailed in Appendix No. 02 attached hereto.

Article 6. Economic and technical standards for special document utilization services

1. Special document utilization services are implemented through one or more of the following forms:

a) Digitization or creation of copies in accordance with library regulations.

b) Creation of Vietnamese language versions of documents based on translation principles for documents in Chinese characters, Nom characters, Han-Nom characters, and other scripts.

2. The economic and technical standards for special document utilization services are detailed in Appendix No. 03 attached hereto.

Article 7. Implementation Organization

1. Based on the economic and technical standards prescribed in this Circular, ministries, sectors, central agencies, and related agencies shall consider and decide to apply specific economic and technical standards suitable for the conditions of public service units under their management.

2. Libraries and agencies using state budget funds to implement public service provision related to these standards shall base their decisions on practical conditions and propose to competent authorities for consideration and decision on the application of specific standards.

Article 8. Effective Date

1. This Circular takes effect from January 5, 2025.

In case the legal regulations cited for application in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued amended, supplemented, or replacement regulations.

3. During implementation, if issues arise, agencies, organizations, and individuals should report them to the Ministry of Culture, Sports and Tourism (through the Library Department) for examination and resolution./.
