THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the tasks, powers, and state management responsibilities of Ministries and ministerial-level agencies;

Considering the proposal of the Director General of the General Post Office Department and the Minister, Head of the Civil Service Committee of the Government,

DECREE:

Article 1. The General Post Office Department is an agency under the Government performing the function of state management over postal and telecommunications services and radio frequency spectrum nationwide.

Article 2. The General Post Office Department performs the tasks, powers, and state management responsibilities of an agency under the Government as prescribed in Article 21 of Decree No. 15/CP dated March 2, 1993 of the Government and the specific tasks and powers set forth below:

1. Regarding legal documents:

a. Submit to the Government draft laws, ordinances, regulatory documents, and policies on postal and telecommunications services and radio frequencies.

Issue decisions, directives, and circulars within its authority to guide, direct, and inspect the implementation of laws and regulations issued by the Government concerning postal and telecommunications services and radio frequencies.

b. Issue standards, norms, rules, economic and technical quotas, and technological standards for postal and telecommunications networks, services, and equipment (including individual devices and imported synchronous equipment) and for the management of radio transmitters and frequencies within its authority.

2. Regarding planning, economy:

a. Submit to the Government strategies, plans, and projects for comprehensive development of the postal and telecommunications industry and radio frequencies nationwide, and guide and inspect their implementation after approval by the Government; participate in the review of parts related to postal and telecommunications services in regional and provincial socio-economic development plans and territorial plans.

b. Manage state investment and construction in the postal and telecommunications sector, participate in the review of joint venture projects with foreign countries related to the postal and telecommunications field as prescribed by the Government.

c. Submit to the Government for issuance or issue within its authority frameworks and rates for postal and telecommunications services, service rates for postal and telecommunications services between enterprises providing such services, and payment rates for postal and telecommunications services between enterprises providing such services. Participate in discussions with relevant sectors regarding fees and charges for postal and telecommunications services and radio frequencies.

d. Submit to the Government policies to encourage, subsidize, regulate, protect, and support enterprises providing postal and telecommunications services serving the Party, State, national defense, security, and public welfare activities.

3. Regarding technology and operations:

a. Issue and revoke licenses and certificates as prescribed by the Government, including:

Business operation licenses for enterprises providing postal and telecommunications services, production of radio transmitters and electronic switchboards, and agents providing postal services for foreign organizations.

Licenses to establish postal and telecommunications networks (including public and dedicated networks), and use broadcasting equipment and radio frequencies.

Licenses for importing and exporting postal stamps.

Participate in discussions with the Ministry of Construction regarding the issuance and revocation of construction and consulting licenses for postal and telecommunications works. Issue and revoke installation, inspection, and calibration licenses for postal equipment.

The Director General of the General Post Office Department decides on the issuance and revocation of other types of licenses and certificates in the postal and telecommunications sector as prescribed by the Government.

b. Determine numbering plans for telecommunications networks.

c. Decide on the opening and closing of inter-provincial and international telecommunications links and international mail routes as prescribed by the Government.

d. Manage the operation of the national trunk telecommunications system. Prescribe the connection of dedicated telecommunications networks and commercial service networks, signal transmission for broadcasting and television, remote education, and other services to the national trunk telecommunications system.

e. Decide on the mobilization of postal and telecommunications networks and equipment for emergency use upon authorization from the Government.

g. Decide and announce the opening and closing of domestic and international postal and telecommunications services, including the establishment of computer information through public telecommunications networks, the opening and closing of foreign exchange post offices, customs post offices, public and dedicated coastal radio stations according to the Government's regulations.

h. Issue regulations on postal and telecommunications service agency and newspaper distribution.

i. Decide on the printing and issuance of postal stamps.

k. Submit to the Government policies and plans for the development of science and technology in postal and telecommunications and radio frequencies; manage scientific research and technological projects on postal and telecommunications and radio frequencies.

l. Manage and inspect the quality of industrial products and postal and telecommunications services as prescribed by the Government.

m. Guide and inspect the operation of associations and non-governmental organizations in the postal and telecommunications and radio frequency sectors to comply with the law.

n. Serve as the permanent body of the Radio Frequency Management Board, with the Director General of the General Post Office Department holding the position of Chairman of the Radio Frequency Management Board.

o. Resolve disputes over postal and telecommunications networks and services and radio frequencies as prescribed by the Government.

4. Regarding international relations:

a. Submit to the Government for approval the signing, ratification, accession to international treaties on postal and telecommunications and radio frequencies, and international cooperation in postal and telecommunications and radio frequencies. Sign international treaties on postal and telecommunications and radio frequencies on behalf of the Government pursuant to the Government's authorization.

Organize the implementation of international treaties on postal and telecommunications and radio frequencies that Vietnam has signed and joined.

b. Guide and inspect Vietnamese postal and telecommunications enterprises in the implementation of international treaties on postal and telecommunications, and the operation of Vietnamese postal and telecommunications enterprises in international postal and telecommunications organizations.

c. Submit to the Government solutions for protecting national sovereignty and interests regarding postal and telecommunications services and radio frequency spectrum; organize the implementation of related tasks when assigned by the Government.

d. Direct the implementation of international programs and projects funded for postal and telecommunications services and radio frequency spectrum in accordance with the Government's regulations.

e. Organize and participate in international conferences and seminars on postal and telecommunications services and radio frequency spectrum within the authority and under the delegation of the Government.

5. On organization and staff:

a. Submit to the Government decisions on organizational systems, positions, standards for civil servants and employees in postal and telecommunications services and radio frequency spectrum. Organize and guide the implementation after approval.

b. Manage organizational work, civil servants, employees, and training and development of civil servants and employees in postal and telecommunications services and radio frequency spectrum according to the Government's regulations.

6. On inspection and supervision:

Organize and direct specialized inspection work in postal and telecommunications services and radio frequency spectrum, handle administrative violations according to the law.

Inspect and supervise compliance with laws, policies, and regulations of the General Post Office concerning state management over postal and telecommunications services and radio frequency spectrum nationwide.

Control the use of broadcasting equipment and radio frequency spectrum, handle interference according to the law.

Resolve complaints and reports from domestic and foreign organizations and individuals regarding postal and telecommunications activities within the jurisdiction.

7. Implement state management functions over postal and telecommunications enterprises and some rights of state ownership over state-owned enterprises in postal and telecommunications services according to the Government's regulations.

Article 3. The Director of the General Post Office Administration is responsible to the Prime Minister for all work of the Administration. Deputy Directors are responsible to the Director for tasks assigned by the Director. The Director and Deputy Directors are appointed by the Prime Minister.

Article 4. The organizational structure of the General Post Office Administration includes:

1. Organizations assisting the Director in performing state management functions:

Office,

Policy Department,

Economic Planning Department,

Science, Technology and International Cooperation Department,

Organization and Cadre Department,

Postal Inspection,

Radio Frequency Management Bureau,

Regional Postal Bureaus:

Regional Postal Bureau II (located in Ho Chi Minh City),

Regional Postal Bureau III (located in Da Nang City, Quang Nam - Da Nang Province),

2. Business organizations (with revenue):

Information and Publishing Center.

The Director of the General Post Office Administration shall specify the tasks and detailed organizational structures of the above units and determine their staffing within the total staffing quota allocated by the Government.

Article 5. This Decree takes effect from the date of issuance.

Abolish Decree No. 28/CP dated May 24, 1993 of the Government and other previous provisions on the tasks and organizational structure of the General Post Office Administration that conflict with this Decree.

Article 6. The Director of the General Post Office Administration, Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
