DIRECTIVE
ON THE REFORM OF MANAGEMENT ORGANIZATION OF STATE FOREST ENTERPRISES (SFEs)
In order for state forest enterprises to truly serve as the backbone in forestry business, the Ministry issues several important contents that need to be implemented immediately as follows:
1- Reorganize the distribution of state forest enterprises:
+ At each province, it is necessary to base on the current forest capital and land, population distribution to allocate land and forests in conjunction with reorganizing the distribution of state forest enterprises according to the following directions:
+ In densely populated areas: Promote the immediate allocation of land and forests directly to farming households and forestry workers' households, and create all conditions for these households to reasonably manage and utilize the allocated forest and forestry land. Do not arrange state forest enterprises in these areas but instead transform them into service units at both ends to facilitate the people's forestry business.
+ In sparsely populated areas with underdeveloped infrastructure:
It is necessary to promptly arrange and consolidate state forest enterprises to act as the backbone, supporting the people in managing and utilizing forest and forestry land according to the national planning and policies. Depending on the location and production plan of each sub-region, clearly define the business plans and specific tasks of the state forest enterprises arranged in these sub-regions.
+ In production forest areas where it is not yet possible to arrange state forest enterprises: It is necessary to close the forests, establish strict state management regulations to enclose and protect the forests, prohibiting any exploitation and destruction activities (managing like reserved forest resources).
The arrangement of state forest enterprises needs to be carried out together with the arrangement of management boards for special-use forests and protective forests in each province to ensure that by the end of 1992, organizations capable of managing all types of forests within the provincial territory will be fully established.
2- Review the forest fund and forestry land fund of state forest enterprises to allocate and lease to member households and organizations, and assign specific individuals to manage small forest zones:
To strengthen the management, protection, and effective operation of the land already allocated to state forest enterprises, the following actions must be taken immediately:
+ Review and report specifically to local authorities the types of agricultural land and other lands currently within the total natural area planned for state forest enterprises (such as residential land, pond and lake land, other land, fixed shifting cultivation land, construction land, farmers' forest garden land, etc.) so that local authorities can proceed with procedures to transfer these lands to residents within the state forest enterprise territory according to the law.
- For forests and forestry land that state forest enterprises have received to directly manage and operate, they must also organize specifically on-site according to the forest zoning plan and lease to member households of the state forest enterprise to manage, protect, and develop forest capital according to the contract signed between the state forest enterprise and the member household.
3- Organize for state forest enterprises to fulfill their function of providing services to the people engaged in forestry work and to manage investment projects, construction, and socio-economic development in the region.
+ State forest enterprises must organize forces to provide the following types of services:
- Supplying seedlings, saplings, technical materials.
- Providing and supporting capital.
- Transferring and popularizing technology down to individual farming households.
- Selling products.
The service targets are member households of state forest enterprises and farming households engaged in forestry business in the district (if there is a need).
+ State forest enterprises must investigate natural and socio-economic conditions to develop investment projects aimed at managing, protecting, and developing forests, building infrastructure, implementing the campaign of permanent settlement on the total natural area planned for the state forest enterprise's operations. After the project is approved, the state forest enterprise will arrange forces to fully perform the role of the main investor of the approved project.
During the transition to a market economy with state regulation, state forest enterprises must reorganize their business and production to achieve the fundamental task of: Managing, protecting, using, and developing forest capital, combined agricultural and forestry production, and contributing to the stability and development of the socio-economic situation in the operational area.
4- Implementation of the directive:
The implementation of this directive must be closely linked to the implementation of the Forest Protection and Development Law and Decree No. 388-HĐBT dated November 20, 1991 of the Council of Ministers, which has been guided by the Ministry of Forestry.
Management agencies of state forest enterprises and state management agencies regarding state forest enterprises at the provincial level, based on the main contents of this Directive, should review and plan to reorganize all state forest enterprises under their management, striving to shape the number and system of state forest enterprises arranged in the provinces by the end of 1992. On this basis, develop investment projects and production and business plans for 1993 and subsequent years in accordance with the reform content of this Directive.
