Circular No. 26/2024/TT-BCA dated June 21, 2024, issued by the Minister of Public Security on statistics, compile, construct, manage, exploit and use databases on road traffic accidents, railway traffic accidents, inland waterway traffic accidents, which takes effect from August 15, 2024, amended and supplemented by:

Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security to amend and supplement certain articles of circulars regulating traffic order and safety on roads, railways, and inland waterways, which takes effect from March 1, 2025.

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to the Law Amending and Supplementing Certain Articles and the National Statistical Indicator Catalogue of the Law on Statistics dated November 12, 2021;

Pursuant to the Penal Code dated November 27, 2015;

Pursuant to the Law Amending and Supplementing Certain Articles of the Penal Code dated June 20, 2017;

Pursuant to the Railway Law dated June 16, 2017;

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;

Pursuant to the Law on Road Traffic dated November 13, 2008;

Pursuant to Decree No. 94/2022/NĐ-CP dated November 7, 2022, issued by the Government on the content of statistical indicators belonging to the national statistical indicator system and the process of compiling gross domestic product indicators, provincial gross domestic product indicators, and centrally governed city gross domestic product indicators;

Pursuant to Decree No. 60/2018/NĐ-CP dated April 20, 2018, issued by the Government on detailed contents of the national-level statistical reporting system;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps,

The Minister of Public Security issues this Circular on statistics, compile, construct, manage, exploit and use databases on road traffic accidents, railway traffic accidents, and inland waterway traffic accidents.[1]

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the statistical indicators, compile, construct, manage, exploit and use databases on road traffic accidents, railway traffic accidents, and inland waterway traffic accidents (hereinafter referred to collectively as traffic accidents). (hereinafter referred to collectively as traffic accidents).

Article 2. Applicability

This Circular applies to public security units at all levels, relevant agencies, organizations, and individuals involved in the statistics, compile, construct, manage, exploit and use databases on traffic accidents.

Article 3. Explanation of Terms

1. Persons killed in road traffic accidents, railway traffic accidents, and inland waterway traffic accidents are the total number of persons who died due to traffic accidents.

2. Persons missing in road traffic accidents, railway traffic accidents, and inland waterway traffic accidents are those who were victims in traffic accidents but whose whereabouts could not be found at the time of statistics and for whom there was no verified information about their survival or death.

3. Persons injured in road traffic accidents, railway traffic accidents, and inland waterway traffic accidents are those who suffered physical and mental injuries directly caused by traffic accidents, affecting their normal life.

4. Property damage in road traffic accidents, railway traffic accidents, and inland waterway traffic accidents includes losses to vehicles, goods carried on vehicles, transportation infrastructure, and other losses outside human lives and health converted into monetary value, directly caused by traffic accidents.

Article 4. Principles for Statistics, Aggregation, and Construction of Traffic Accident Database

1. Ensure objectivity, honesty, accuracy, completeness, timeliness, in accordance with the investigation, verification, and resolution progress of traffic accidents and other business requirements.

2. Unify statistical indicators and statistical forms; include analysis and comparison.

3. Avoid duplication and overlap between statistical information; all mandatory fields must be fully recorded according to the traffic accident report form prescribed in Clause 1, Article 27 of this Circular..

4. A single or multiple consecutive collisions involving traffic participants at a specific location shall be considered one traffic accident. A traffic accident may involve one or more traffic participants.

5. The number of fatalities in a traffic accident includes those who die and those injured by the traffic accident leading to death within seven days from the date of the traffic accident; in cases where injuries caused by the traffic accident lead to death outside the seven-day period from the date of the traffic accident and there is a forensic medical conclusion from a public judicial appraisal organization, supplementary statistics shall be made.

6. The number of injured persons in a traffic accident includes those who require treatment and have medical records from healthcare facilities.

7. In cases where previously reported traffic accident data contains errors or additional incidents, deaths, or injuries occur outside the reporting period, supplementary statistics shall be made and the reasons for adjustments and supplements clearly explained. Provincial Public Security Departments shall aggregate and report to the Ministry of Public Security (through the Traffic Police Corps).

8. Do not infringe upon national interests, rights, and legitimate benefits of agencies, organizations, and individuals.

Article 5. Classification of Traffic Accidents

Based on the severity of consequences in terms of human casualties and property damage, traffic accidents are classified into particularly serious traffic accidents, very serious traffic accidents, serious traffic accidents, less serious traffic accidents, and traffic collisions.

1. Particularly serious traffic accidents fall under one of the following circumstances:

a) Causing the death of three or more people;

b) Causing injuries or harm to health of three or more people, with the total percentage of bodily injury of these individuals being 201% or more;

c) Causing property damage of 1,500,000,000 VND or more.

2. Very serious traffic accidents fall under one of the following circumstances:

a) Causing the death of two people;

b) Causing injuries or harm to health of two or more people, with the total percentage of bodily injury of these individuals being from 122% to 200%;

c) Causing property damage of 500,000,000 VND to less than 1,500,000,000 VND.

3. Serious traffic accidents fall under one of the following circumstances:

a) Causing the death of one person;

b) Causing injuries or harm to health of one person with a percentage of bodily injury of 61% or more;

c) Causing injuries or harm to health of two or more people, with the total percentage of bodily injury of these individuals being from 61% to 121%;

d) Causing property damage of 100,000,000 VND to less than 500,000,000 VND.

4. Less serious traffic accidents fall under one of the following circumstances:

a) Causing injuries or harm to health of one person with a percentage of disability from 11% to less than 61%;

b) Causing injuries or harm to health of two or more people, with the total percentage of disability of these individuals being from 11% to less than 61%;

c) Causing property damage of 10,000,000 VND to less than 100,000,000 VND.

5. Traffic collisions are traffic accidents causing consequences below the level specified in Clause 4 of this Article.

6. Determining the percentage of disability of persons injured in traffic accidents shall be carried out in accordance with Circular No. 22/2019/TT-BYT dated August 28, 2019 issued by the Minister of Health regarding the percentage of bodily injury used in forensic medical examinations and forensic psychiatric examinations.

7. Determining property damage caused by traffic accidents shall be based on conclusions of asset damage valuation or appraisal certificates or other documents proving property damage.

Chapter II. STATISTICAL INDICATORS AND AGGREGATION OF NATIONAL LEVEL TRAFFIC ACCIDENTS NATIONAL LEVEL

Article 6. Group of general traffic accident statistical indicators

1. Number of incidents, number of deaths, number of injuries.

2. Road safety coefficient

a) Road safety coefficient per 100,000 population (persons);

b) Road safety coefficient per 10,000 vehicles (cars and motorcycles);

c) Road safety coefficient per 1 kilometer (km) of road.

Article 7. National-level statistical indicator form

The national-level statistical indicator form is established according to Form No. 002.H/BCB-CA issued together with Decree No. 60/2018/NĐ-CP dated April 20, 2018 of the Government detailing the contents of the national-level statistical reporting system.

Chapter III. TRAFFIC ACCIDENT STATISTICAL INDICATORS AND COMPREHENSIVE AGGREGATION BY THE PEOPLE'S PUBLIC SECURITY SERVICE

Section 1. GROUP OF TRAFFIC ACCIDENT STATISTICAL INDICATORS AND COMPREHENSIVE AGGREGATION

Article 8. Group of statistical indicators on the consequences of traffic accidents

The consequences of traffic accidents in all three areas of transportation (road, rail, inland waterway) and individually for each area include the following statistical indicators:

1. Number of incidents, number of deaths, number of injuries by gender (male, female). This indicator is compiled as per the general group of indicators prescribed in Clause 1, Article 6 of this Circular;

2. Number of missing persons by gender (male, female);

3. Consequences of property damage;

4. Classification of traffic accidents as provided in Article 5 of this Circular;

5. Traffic accidents involving foreigners including: number of incidents; number of deaths, missing persons, injuries by gender (male, female); number of foreigners involved; number of individuals with diplomatic status; number of incidents caused by foreigners.

Article 9. Group of statistical indicators on time, administrative boundaries, weather, climate, hydrology

1. Time of occurrence of traffic accidents: hour, minute; day of the week; date, month, year.

2. Administrative boundary: village, residential ward (or equivalent administrative unit below commune level); commune, ward, town; district, city district, provincial city, city under central municipality; province, centrally governed municipality.

3. Weather, climate, hydrology: sunny, rainy, fog, typhoon, flood, landslide, storm, tide, icy or snowy roads or other forms of weather, climate, hydrology.

Article 10. Group of statistical indicators on investigation and resolution of traffic accidents

1. Traffic accidents investigated, resolved by Traffic Police

a) Handling unit: Traffic Police Corps; Provincial Traffic Police Department;[2]

b) Total number of traffic accidents received and resolved within jurisdiction;

c) Total number of initial investigations and resolutions;

d) Number of administrative cases handled: number of cases; number of decisions imposing administrative penalties, amount of fines, number of cases where driving licenses, certificates of seafarer competency, and vehicle operator certificates were revoked (duration of revocation); number of vehicles currently impounded; agencies and organizations subject to administrative penalties;

đ) Number of cases identified with criminal signs, transferred to the Investigation Agency of the Public Security Force (reason);

e) Number of cases issuing decisions to initiate criminal proceedings, transferred to the Investigation Agency of the Public Security Force (reason);

g) Number of cases identified with criminal signs, transferred to the Investigation Agency in the People's Army (reason);

h) Number of administrative cases handled by the Investigation Agency of the Public Security Force, the Investigation Agency in the People's Army transferred to Traffic Police (number of cases, number of decisions imposing administrative penalties, amount of fines, number of cases where driving licenses, certificates of seafarer competency, and vehicle operator certificates were revoked (duration of revocation), number of vehicles currently impounded; agencies and organizations subject to administrative penalties);

i) Number of cases not handled administratively, file retained (reason).

2. Traffic accidents handled by the Investigation Agency of the Public Security Force upon reports of crimes, information about crimes, and requests for prosecution

a) Handling unit: Investigation Agency of the Public Security Force;

b) Total number of reports of traffic accidents received and resolved within jurisdiction;

c) Total number of inspections and verifications based on reports of crimes, information about crimes, and requests for prosecution;

d) Number of cases issuing decisions not to initiate criminal proceedings: total number of cases; number of cases transferred to Traffic Police for administrative handling (reason); number of cases not handled administratively, file retained (reason);

đ) Number of cases issuing decisions to initiate criminal proceedings (reason);

e) Number of cases transferred to the Investigation Agency in the People's Army;

g) Number of cases issuing decisions to temporarily suspend the investigation of reports of crimes, information about crimes, and requests for prosecution (reason);

h) Number of cases issuing decisions to resume the investigation of reports of crimes, information about crimes, and requests for prosecution (reason);

i) Number of cases currently being inspected and verified based on reports of crimes, information about crimes, and requests for prosecution.

3. Traffic accidents handled by the Investigation Agency of the Public Security Force when initiating criminal cases, indicting suspects

a) Handling unit: Investigation Agency of the Public Security Force;

b) Total number of cases issuing decisions to initiate criminal proceedings (including cases initiated by Traffic Police, cases initiated by the Investigation Agency of the Public Security Force based on reports of crimes, information about crimes, and requests for prosecution, and cases initiated without reports of crimes, information about crimes, and requests for prosecution), number of suspects indicted; indictment under which article of the Criminal Code;

c) Number of cases issuing decisions to temporarily suspend the investigation (reason), number of suspects;

d) Number of cases issuing decisions to terminate the investigation (reason), number of suspects;

đ) Number of cases transferred to the Investigation Agency in the People's Army, number of suspects;

e) Number of cases issuing decisions to resume the investigation (reason), number of suspects;

g) Number of cases issuing investigative conclusions, transferred to the Prosecution Office for prosecution, number of suspects;

h) Number of ongoing investigations;

i) Number of cases providing Notification of Investigation Results, Verification, and Resolution of Traffic Accidents or Notification of Investigative Conclusions Resolving Traffic Accidents to insurance companies.

Mục 2. STATISTICAL INDICATORS ON TRAFFIC ACCIDENTS ON ROADWAYS

Article 11. GROUP OF STATISTICAL INDICATORS ON ROADWAY INFRASTRUCTURE

1. LOCATION OF THE TRAFFIC ACCIDENT: determine km (if the road has km markers); house number (if there are no km markers but the house number can be identified); utility pole, traffic signpost... name of the roadway; coordinates (longitude, latitude, if there are no km markers and house numbers or when there are sufficient conditions for equipment to determine coordinates then combine both coordinates and km, house numbers).

2. ROAD NETWORK: expressway, national highway, provincial road, district road, commune road, urban road, dedicated road.

3. ROADS PASSED THROUGH: densely populated area, outside densely populated area, rural area, mountainous area, key economic zone, and other areas.

4. ROAD INFRASTRUCTURE

a) TYPE OF ROAD: one-way road, two-way road, dual carriageway with median strip; maximum permitted speed, minimum permitted speed of the road (if applicable);

b) ROAD MARKINGS: traffic control signals; traffic lights, signs, lane markings, guardrails or barriers, fences; public lighting;

c) ROAD SHAPE: straight, curve, hill, tunnel, bridge, ferry, other;

d) ROAD SURFACE TYPE: concrete, asphalt, dirt, gravel, other;

đ) LANES: road without lane division, road with one lane in the direction of vehicle travel, and road with multiple lanes in the direction of vehicle travel;

e) ROAD WIDTH: full width of the road, width in the direction of vehicle travel, lane width measured in meters (m);

g) CONDITION OF THE ROAD SURFACE: smooth, uneven, dry, wet, slippery, muddy, flooded, under repair, other;

h) INTERSECTION: three-way intersection, four-way intersection, five-way intersection, six-way intersection or more, roundabout, opening of the median strip, other level intersections;

i) CONDITION OF THE ROADWAY SAFETY CLEARANCE.

Article 12. GROUP OF STATISTICAL INDICATORS ON ROADWAY VEHICLES

The group of statistical indicators on roadway vehicles includes both the vehicles causing and those involved in the traffic accident.

1. VEHICLE TYPE

a) MOTOR VEHICLES: automobiles; tractors; trailers or semi-trailers pulled by automobiles or tractors; two-wheeled motorcycles; three-wheeled motorcycles; motorbikes (including electric motorcycles) and similar types of vehicles;

b) NON-MOTOR VEHICLES: bicycles (including bicycle motors, electric bicycles), pedicabs, wheelchairs for disabled persons, animal-drawn carts and similar types of vehicles;

c) SPECIAL PURPOSE VEHICLES: construction vehicles, agricultural and forestry vehicles, and other special purpose vehicles used for defense and security purposes that participate in roadway traffic.

2. VEHICLE CONDITIONS PRIOR TO THE OCCURRENCE OF THE TRAFFIC ACCIDENT

a) REGISTRATION: registered or not, registration certificate number, license plate number, license plate color, brand, model, owner's name (individual or organization), registered address;

b) TECHNICAL SAFETY INSPECTION AND ENVIRONMENTAL PROTECTION: inspected or not, inspection certificate number, inspecting entity, validity period, inspection cycle, year of manufacture, mileage on the odometer;

c) COMPULSORY CIVIL LIABILITY INSURANCE FOR MOTOR VEHICLES: insured or not, insurance certificate number, insurance term;

d) NUMBER OF PASSENGERS AND CARGO ON THE VEHICLE (IF ANY): type of cargo, quantity, dimensions;

đ) TECHNICAL SAFETY CONDITION OF THE VEHICLE (steering system, braking system, power transmission system, electrical system, lighting, signaling devices, and other safety equipment) whether regularly maintained and repaired or not.

3. VEHICLE CONDITION AFTER THE TRAFFIC ACCIDENT: able to move or not; number of airbags deployed; fire, explosion.

Article 13. Group of statistical indicators for information on vehicle drivers, pedestrians, and accident victims

1. Information on road traffic vehicle drivers

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

b) Driver's license, certificate of traffic law knowledge training, certificate of specialized vehicle operation (number, category, validity period, year issued); training location; examination location; issuing location;

c) In case of a traffic accident, whether the road traffic vehicle driver has alcohol, drugs, or other prohibited stimulants in their blood or breath; wearing seat belts (for cars); wearing helmets (for motorcycles, motorbikes, bicycles); using handheld devices such as mobile phones or other electronic devices; or other cases causing distraction; being the cause of the accident;

d) After a road traffic accident, the vehicle driver stays at the scene, leaves the scene, or flees from the scene.

2. Information on pedestrians

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

b) Crossing the road at places with or without pedestrian crossing markings, walking on sidewalks, entering pedestrian-prohibited roads, walking on lanes designated for vehicles, using alcohol, beer, drugs, or other prohibited stimulants, using handheld devices such as mobile phones or other electronic devices; or other cases causing distraction.

3. Information on accident victims includes

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

b) The person driving the vehicle; passengers or service staff on the vehicle, pedestrians, or other related persons who died or were injured (percentage of bodily injury) in the road traffic accident.

Article 14. Group of statistical indicators for types of road traffic accidents

1. Vehicle collision with another vehicle: same direction, opposite direction, right-side collision, left-side collision, multiple vehicle collision.

2. Vehicle collision with a pedestrian.

3. Vehicle collision with other obstacles.

4. Self-inflicted accident.

Article 15. Group of statistical indicators for the development and causes, conditions leading to road traffic accidents

1. Development of road traffic accidents.

2. Causes and conditions leading to road traffic accidents

a) Human factors: pedestrians; road traffic vehicle drivers violating traffic rules or conditions for vehicle drivers; traffic controllers; managers and users of road traffic vehicles; violators of traffic safety zone regulations;

b) Road traffic vehicles not meeting technical safety standards or expired inspection periods;

c) Road infrastructure damaged or failing to meet technical safety standards;

d) Other causes and conditions (if any).

Article 16. Group of statistical indicators for road traffic safety coefficients

1. Road traffic safety coefficient per 100,000 people: number of accidents, number of deaths, number of injuries caused by traffic accidents per 100,000 people

a) Number of traffic accidents per 100,000 people (abbreviated as HSDSV);

b) Number of deaths per 100,000 people (abbreviated as HSDSC);

c) Number of injuries per 100,000 people (abbreviated as HSDSBT).

2. Road traffic safety coefficient per 10,000 vehicles (cars and motorcycles): number of accidents, number of deaths, number of injuries caused by traffic accidents per 10,000 vehicles

a) Number of traffic accidents per 10,000 vehicles (abbreviated as HSPTV);

b) Number of deaths per 10,000 vehicles (abbreviated as HSPTC);

c) Number of injuries per 10,000 vehicles (abbreviated as HSPTBT).

3. Road traffic safety coefficient per 1 km of road: number of accidents, number of deaths, number of injuries caused by traffic accidents per 1 km of road

a) Number of traffic accidents per 1 km of road (abbreviated as HSĐV);

b) Number of deaths per 1 km of road (abbreviated as HSĐC);

c) Number of injuries per 1 km of road (abbreviated as HSĐBT).

4. Road traffic safety coefficient per 1,000,000 vehicle trips on 1 km of road: number of accidents, number of deaths, number of injuries caused by traffic accidents per 1,000,000 vehicle trips on 1 km of road (for sections or routes with vehicle traffic volume)

a) Number of traffic accidents per 1,000,000 vehicle trips on 1 km of road (abbreviated as HSLLV);

b) Number of deaths per 1,000,000 vehicle trips on 1 km of road (abbreviated as HSLLC);

c) Number of injuries per 1,000,000 vehicle trips on 1 km of road (abbreviated as HSLLBT).

Calculation formulas for the above coefficients are stipulated in the Appendix attached to this Circular.

Mục 3. STATISTICAL INDICATORS ON RAILWAY TRAFFIC ACCIDENTS

Article 17. Group of statistical indicators on railway traffic infrastructure and road traffic infrastructure where railway traffic accidents occur

1. Location where the traffic accident occurs: km; coordinates (longitude, latitude) if there is no km or when there are sufficient conditions for coordinate determination equipment, then both coordinates and km should be combined; name of the railway line.

2. Railway: national railway, dedicated railway, urban railway (subway, surface railway, elevated railway, single-track automatic guided railway, and tramway).

3. Area: bridge, culvert, tunnel, section, interzone, zone, station, depot (place where trains are assembled for maintenance, repair, and other technical operations).

4. Level crossings between roads and railways: manned level crossing; level crossing with automatic warning system; level crossing with signboard warning system; and open pedestrian path.

5. Road traffic infrastructure where railway traffic accidents occur: statistics and compilation of road traffic infrastructure indicators as prescribed in Article 11 of this Circular.

Article 18. Group of statistical indicators on railway transportation vehicles and road transportation vehicles

The group of statistical indicators on railway transportation vehicles and road transportation vehicles includes both the vehicles causing the accident and those related to the railway traffic accident.

1. Group of statistical indicators on railway transportation vehicles, including: locomotive, carriage, specialized moving equipment on railway tracks

a) Train composed of locomotive and carriages or single locomotive run, powered carriage, specialized moving equipment on railway tracks with power;

b) Specialized equipment is equipment used for maintenance, upkeep, repair, construction of railway works, rescue, and other specialized functions moving on railway tracks.

2. Condition of the vehicle before the railway traffic accident occurred

a) Vehicle registration: registered or not, registration certificate number, license plate number, brand, model number, owner's name (individual or organization), registered address;

b) TECHNICAL SAFETY INSPECTION AND ENVIRONMENTAL PROTECTION: inspected or not, inspection certificate number, inspecting entity, validity period, inspection cycle, year of manufacture, mileage on the odometer;

c) Compulsory civil liability insurance of the vehicle owner (if applicable): insured or not, insurance certificate number, insurance period;

d) Cargo carried on the vehicle (if any): type of cargo, quantity, size;

đ) Technical safety condition of the vehicle (steering system, braking system, power transmission system, electrical system, lighting, signaling, and other safety equipment) has been maintained and repaired according to schedule or not.

3. Condition of the vehicle after the railway traffic accident: still controllable for movement, uncontrollable for movement; burned, exploded.

4. Group of statistical indicators on road transportation vehicles: statistics and compilation of road transportation vehicle indicators as prescribed in Article 12. This Circular.

Article 19. Group of statistical indicators on information about road transportation vehicle drivers, pedestrians, railway staff directly serving train operation, and victims

1. Information about road transportation vehicle drivers, pedestrians as prescribed in Clause 1, 2 Article 13 of this Circular.

2. Information about railway staff directly serving train operation

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

b) Railway staff directly serving train operation include: train conductor; driver, assistant driver; train dispatcher on route, train dispatcher at station; station duty officer; train formation supervisor; coupling staff; track, bridge, tunnel patrol staff; tunnel guard; level crossing guard, common bridge guard; other positions suitable for each type of railway;

c) Railway staff directly serving train operation have or not: professional qualification certificates in accordance with their position as prescribed by law; For drivers, whether they have a driving license and whether it is appropriate; certification of meeting professional and health requirements periodically (annually) as prescribed;

d) Number, category, validity, training location, issuance of professional qualification certificates of railway staff; examination location for issuing driving licenses and year of issuance;

đ) When a traffic accident occurs, railway staff directly serving train operation while on duty have or not: alcohol or other prohibited stimulants in blood or breath; strict adherence to train operation command orders; performance of duties according to their position, technical rank standards, and national technical standards for railways;

e) After the railway traffic accident, railway staff directly serving train operation: remain at the scene, leave the scene, flee from the scene.

3. Information about victims includes:

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

b) Railway staff directly serving train operation; passengers on the train; people on road transportation vehicles (drivers, service staff, passengers), pedestrians, other related persons who died or were injured (percentage of bodily injury) in the railway traffic accident.

Article 20. Group of indicators regarding the form of railway traffic accidents

1. Railway transport vehicles colliding with other railway transport vehicles: same direction, opposite direction, side collision on the right, side collision on the left.

2. Railway transport vehicles with road transport vehicles: same direction, opposite direction, side collision on the right, side collision on the left.

3. Railway transport vehicles with persons: persons walking along the railway tracks or crossing the railway tracks; persons standing, lying down, sitting on the railway tracks or engaging in other activities on the railway tracks.

4. Railway transport vehicles with other obstacles.

5. Railway transport vehicles causing accidents themselves: derailment, overturning, fire, explosion, and technical malfunctions of railway transport vehicles.

Article 21. Group of statistical indicators regarding the development and causes of railway traffic accidents

1. Development of railway traffic accidents.

2. Causes and conditions for the occurrence of railway traffic accidents

a) Due to railway staff directly serving train operations or road transport vehicle drivers violating regulations on signals, traffic rules, and ensuring order and safety in railway transportation, or violating regulations on train driving licenses, certificates, and qualifications appropriate to their positions as prescribed;

b) Due to other persons walking, standing, lying down, or sitting on the railway tracks or engaging in other activities on the roof of carriages, locomotives, steps of carriages, or between carriages and locomotives; clinging to carriages or locomotives, standing or sitting on both sides of carriages or locomotives, or opening doors to get on or off trains while extending heads, hands, feet, or objects outside carriage walls when the train is moving;

c) Due to railway transport vehicles not meeting safety technical requirements;

d) Due to railway infrastructure not meeting safety requirements for train operation;

đ) Other causes and conditions.

Section 4. STATISTICAL INDICATORS REGARDING INLAND WATERWAY TRAFFIC ACCIDENTS

Article 22. Group of statistical indicators regarding inland waterways

1. Location where the inland waterway traffic accident occurred: km (if applicable); coordinates (longitude, latitude); name of the inland waterway route.

2. Occurrence location: channel, harbor, structures for transporting vessels over dams, waterfalls on rivers, canals, creeks, channels on lakes, ponds, swamps, coves, bays, coastal areas, islands, connecting islands within inland waters, unorganized and unexploited waters.

3. Name of the inland waterway: national inland waterway, local inland waterway, specialized inland waterway, unorganized and unexploited waters (based on administrative boundaries).

4. Characteristics and forms of the location where the traffic accident occurred: straight channel, curved channel, sharp bend, three-way intersection, four-way intersection, intersections from five-way and above, narrow channel, shallow channel, obstacles, waterway structures, unstable current, and other characteristics and forms.

Article 23. Group of statistical indicators regarding inland waterway transport vehicles

The group of indicators regarding inland waterway transport vehicles includes both the vehicles causing the accident and those involved in the accident.

1. Types of vehicles

a) Vehicles with VR-SB class;

b) Non-motorized vehicles with total load capacity over 15 tons (for cargo or passengers), motorized vehicles with main engine power over 15 horsepower (for cargo or passengers), vehicles with passenger capacity over 12 people (with or without engines);

c) Motorized vehicles with main engine power from 5 to 15 horsepower (for cargo or passengers) or with passenger capacity from 5 to 12 people;

d) Non-motorized vehicles with total load capacity from 1 to 15 tons (for cargo or passengers) or with passenger capacity from 5 to 12 people;

đ) Motorized vehicles with main engine power under 5 horsepower or with passenger capacity under 5 people;

e) Primitive vehicles with total load capacity under 1 ton or with passenger capacity under 5 people;

g) Rafts or other floating structures;

h) Military and security service vehicles;

i) Sports and recreational boats and vessels;

k) Seagoing vessels, fishing vessels, marine fisheries service vessels.

2. Conditions of the vehicles before the traffic accident occurred

a) Vehicle registration (if applicable): registered or not, registration certificate number, registration plate number, brand, model number, owner's name (individual or organization), registered address;

b) Safety technical inspection and environmental protection inspection (if applicable): conducted or not, inspection certificate number, inspecting unit, validity period of inspection, inspection cycle, year of manufacture, operational time (if applicable);

c) Compulsory civil liability insurance of the vehicle owner (if applicable): insured or not, insurance certificate number, insurance period;

d) Actual number of passengers carried on the vehicle; cargo carried on the vehicle (if applicable), type of cargo, quantity, dimensions;

đ) Whether the safety technical condition of the vehicle (steering system, power transmission system, electrical system, lighting, signaling, and other safety equipment) has been maintained and repaired according to schedule.

3. Condition of the vehicles after the inland waterway traffic accident occurred: vehicle still movable, vehicle lost control, vehicle sunk; caught fire, exploded.

Article 24. Group of statistical indicators for information on seafarers, drivers of vehicles, and victims

1. Information on seafarers

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

b) Seafarer positions on vessels: captain, chief mate, chief engineer, second engineer, able seaman, engine room rating;

c) Whether seafarers have certificates of professional competence and qualifications corresponding to their positions and types of vessels as prescribed by law;

d) Number, category, validity period, place of training, and issuance of certificates of professional competence and qualifications of seafarers;

đ) In case of accidents: whether seafarers or drivers working on the vessel had alcohol levels exceeding the prescribed limit in their blood or breath, or were using other prohibited stimulants;

e) After inland waterway traffic accidents, seafarers: remained at the scene, left the scene, or fled from the scene.

2. Drivers of vehicles

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

 b) Whether they have certificates of professional competence for captains as prescribed;

c) After inland waterway traffic accidents, drivers: remained at the scene, left the scene, or fled from the scene.

3. Information on victims

a) Full name, date of birth, personal identification number or passport or international travel document (applicable to foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available);

b) Whether they are seafarers, drivers, persons on board (crew members and passengers), swimmers, or related individuals who died, went missing, or sustained injuries (percentage of bodily injury) in the accident.

Article 25. Group of statistical indicators for forms of inland waterway traffic accidents

1. Collisions between vessels: when traveling towards each other, when crossing paths, when avoiding each other, when overtaking, when changing direction to the right, when changing direction to the left, when the vessel loses control, when the vessel is moored.

2. Vehicle collision with a pedestrian.

3. Collisions between vessels and structures or obstacles.

4. Self-inflicted accidents by vessels.

Article 26. Group of statistical indicators for the course of events and causes, conditions leading to inland waterway traffic accidents

1. Course of inland waterway traffic accidents.

2. Causes and conditions leading to inland waterway traffic accidents

a) Due to seafarers and drivers violating traffic rules, regulations on signals of vessels, transportation regulations for watercraft, or conditions for seafarers and drivers; due to people, animals, or aquatic life activities;

b) Due to vessels not meeting safety technical requirements;

c) Due to inadequate safety of inland waterway traffic infrastructure;

d) Due to natural conditions, weather, climate, hydrology: rain, typhoons, fog, floods, strong waves, strong winds, whirlwinds, tides, eddies, strong currents, and other natural conditions.

đ) Other causes and conditions.

Section 5. SAMPLE REPORT FORMS FOR STATISTICAL INDICATORS OF THE PUBLIC SECURITY POLICE

Article 27. Sample report forms

1. Accident report form

During the investigation, verification, and resolution of traffic accidents, traffic police at all levels must establish accident report forms for accidents occurring along the routes assigned for patrol, supervision, and violation handling, and be responsible for the accuracy, completeness, and timeliness of the accident information in the accident report forms issued pursuant to this Circular. The accident report forms include:

a) Road traffic accident report form (Form No. 01/BCVĐB);

b) Railway traffic accident report form (Form No. 02/BCVĐS);

c) Inland waterway traffic accident report form (Form No. 03/BCVĐT).

2. Statistical and consolidated accident report forms

When reporting statistics and consolidating traffic accident situations periodically or within a specific time frame, the following forms shall be used:

a) General traffic accident statistical and consolidated report form (Form No. 04/TKĐC);

b) Road traffic accident statistical and consolidated report form (Form No. 05/TKĐB);

c) Railway traffic accident statistical and consolidated report form (Form No. 06/TKĐS);

d) Inland waterway traffic accident statistical and consolidated report form (Form No. 07/TKĐT).

3. The report forms specified in Clause 1 and Clause 2 of this Article are established on the traffic accident database software system.

Chapter IV. CONSTRUCTION, MANAGEMENT, EXPLOITATION, AND USE OF TRAFFIC ACCIDENT DATABASE

Article 28. Construction of Traffic Accident Database

1. Traffic Accident Database is a system of information and documents on traffic accidents that is built, collected, processed, stored, managed, exploited, and utilized through electronic networks or other data storage devices listed in the Ministry of Public Security's directory.

2. The Traffic Accident Database shall be constructed and centrally retained at the Data Center of the Traffic Police Department.

3. Construction of the Traffic Accident Database includes the following activities:

a) Equipping necessary equipment;

b) Upgrading network infrastructure;

c) Organizing the Database; developing software for the Traffic Accident Database;

d) Storing, backing up, synchronizing the system, recovering data; ensuring security and safety of information within the Database;

đ) Training and enhancing staff managing and operating the Database;

e) Operating, adjusting, maintaining, and servicing the Database;

g) Other activities as prescribed by law.

Article 29. Management, Exploitation, and Use of the Traffic Accident Database

1. All data and information on traffic accidents must be fully, timely, and accurately collected and updated into the Traffic Accident Database.

2. Information in the Traffic Accident Database includes statistical information as stipulated in Chapters II and III of this Circular.

3. The Traffic Accident Database shall be connected and shared with the Registration and Management Database of Vehicles, the Administrative Violation Processing Database of Traffic Police, the National Population Database, and other databases as decided by the Minister of Public Security.

4. The Traffic Accident Database shall be exploited[3] at provincial-level public security agencies and the Traffic Police Department.

Other agencies, organizations, and individuals may exploit and use information in the Traffic Accident Database upon proposal from the Traffic Police Department and approval by the leadership of the Ministry of Public Security.

Article 30. Responsibilities of Traffic Police Officers and Local Public Security Agencies in Managing, Exploiting, and Using the Traffic Accident Database

1. Responsibilities of Traffic Police Officers

a) Immediately enter initial information of traffic accidents determined into the Traffic Accident Database within twelve hours from receiving reports of traffic accidents; bear responsibility for the accuracy, completeness, and timeliness of traffic accident information; if violated, they will be handled according to regulations depending on the nature and severity; simultaneously make preliminary determinations about the causes of traffic accidents;

b) Continue collecting and entering traffic accident information into the Traffic Accident Database according to the progress of investigation and resolution of traffic accidents, ensuring the accuracy and timeliness of traffic accident information;

c) Within seven days from the end of the investigation, verification, and resolution of traffic accidents, officers must complete the entry of full information on traffic accidents into the Traffic Accident Database, and at the same time, complete the accident report form for approval by authorized leaders;

d) Exploit and use data in the Traffic Accident Database according to the division of labor by unit leaders and bear responsibility for the accuracy of their data exploitation results.

3. Responsibilities of Provincial-level Public Security Agencies

a) Implement the Traffic Accident Database in the provincial area according to the guidance of the Traffic Police Department;

b) Organize the collection, processing, and updating of information and documents into the Traffic Accident Database;

c) Direct officers to promptly update traffic accident information occurring on patrol routes under the Provincial Traffic Police Department into the Traffic Accident Database, ensuring compliance with the investigation and resolution schedule;

d) Statistical and aggregated data on traffic accidents shall be cross-referenced and reviewed against figures from the People's Procuracy and Health Authority at the provincial level;

đ) Exploit and bear responsibility for using traffic accident information within the provincial area under their management;

e) Maintain computers and accompanying auxiliary equipment to ensure smooth operation of the Traffic Accident Database within the provincial area under their management;

g)[5] (Repealed)

4. Responsibilities of the Traffic Police Department

a) Direct officers to promptly update traffic accident information occurring on expressways patrolled and supervised by the Traffic Police Department into the Traffic Accident Database, ensuring compliance with the investigation and resolution schedule;

b) Standardize reporting forms for statistical and aggregated traffic accidents;

c) Implement the Traffic Accident Database nationwide;

d) Organize the installation of Traffic Accident Database software; organize training for Traffic Police officers to implement the Traffic Accident Database program;

đ) Build a national data center to store and process traffic accident information; implement projects and programs related to the Traffic Accident Database;

e) Manage, exploit, use, and ensure technical support for the operation of the Traffic Accident Database;

g) Coordinate with the Ministry of Public Security's Office to publish annual statistical yearbooks on traffic accidents; statistical and aggregated data on traffic accidents shall be cross-referenced with figures from the Supreme People's Procuracy and the Ministry of Health;

h) Assist the Minister of Public Security in directing, guiding, inspecting, and urging local public security agencies to construct the Traffic Accident Database.

5. Responsibilities of Investigation Agencies of the People's Public Security

Timely provide traffic accident information to Traffic Police during the investigation and resolution process as stipulated in Articles 8, 10, and 12 of Circular No. 62/2020/TT-BCA dated June 19, 2020, issued by the Minister of Public Security regarding the allocation of responsibilities and coordination in traffic accident investigation and resolution work by the People's Public Security force.

6. The Director of the Provincial Police, the Head of the Traffic Police Department, the Heads of all levels of Public Security Organs, and traffic accident statisticians shall be responsible for the accuracy of traffic accident statistics.

Chapter V. IMPLEMENTING PROVISIONS [6]

Article 31. Effective Date

1. This Circular takes effect from August 15, 2024.

2. Circular No. 58/2009/TT-BCA (C11) dated October 28, 2009, issued by the Minister of Public Security, which stipulates and guides the statistical compilation, data aggregation, and database construction on road traffic accidents, shall cease to be effective from the date this Circular takes effect.

3. Any laws, regulations, articles, or clauses cited in this Circular that are amended, supplemented, or replaced shall have their referenced content adjusted and implemented according to the amended, supplemented, or replaced laws, regulations, articles, or clauses.

Article 32. Responsibility for Implementation

1. The heads of units under the Ministry of Public Security and the Directors of Public Security in provinces and centrally-administered cities within their respective functions and duties shall be responsible for organizing the implementation of this Circular.

2. The General Traffic Police Department shall take the lead and coordinate with the Ministry of Public Security's Office to develop the content, program, and organize training sessions as prescribed; provide guidance, inspection, supervision, and implementation of this Circular; and organize interim and final reviews as prescribed.

During the implementation of this Circular, if there are difficulties or obstacles, local public security units shall report to the Ministry of Public Security (through the General Traffic Police Department) for timely guidance../.

Pursuant to the Railway Law dated June 16, 2017;

BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;

Pursuant to Decree No. 02/2025/NĐ-CP dated February 18, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

The Minister of Public Security hereby promulgates the Circular amending and supplementing certain provisions of circulars regulating road traffic order and safety, railway traffic, and inland waterway traffic.

[2] The phrase “The term "Traffic Police and Order Police Team at the County-level Public Security" is abolished pursuant to point a, Clause 1, Article 4 of Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security to amend and supplement certain provisions of various circulars regulating traffic order and safety on roads, railways, and inland waterways, which takes effect from March 1, 2025.

[3] The phrase "used at the County-level Public Security" is abolished pursuant to point b, Clause 1, Article 4 of Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security to amend and supplement certain articles of circulars regulating traffic order and safety on roads, railways, and inland waterways, which takes effect from March 1, 2025.
