Joint Circular No. 121/2010/TTLT-BTC-BLDTBXH guiding the support regime for individuals after drug rehabilitation at their place of residence and Drug Rehabilitation Management Centers. This document specifies forms of support, funding levels, responsibilities of individuals after drug rehabilitation, and implementing agencies.

JOINT CIRCULAR

Guidelines for support for individuals after drug rehabilitation at their place of residence; contribution and support system for individuals after drug rehabilitation at the Post-Rehabilitation Management Center.

Pursuant to Decree No. 94/2009/NĐ-CP dated October 26, 2009 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Drugs regarding post-rehabilitation management.

The Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs provide guidelines for support for individuals after drug rehabilitation at their place of residence; contribution and support system for individuals after drug rehabilitation at the Post-Rehabilitation Management Center (hereinafter referred to as the Center) as follows:

Article 1. Scope and Applicability

1. Individuals who have completed the drug rehabilitation period at the Drug Rehabilitation - Education - Social Work Center shall be subject to post-rehabilitation management at their place of residence.

2. Individuals who have completed the drug rehabilitation period at the Drug Rehabilitation - Education - Social Work Center shall be subject to post-rehabilitation management at the Center.

Article 2. Support System for Individuals After Drug Rehabilitation Subject to Post-Rehabilitation Management at Their Place of Residence

1. Counseling Support:

- Individuals after drug rehabilitation at their place of residence are provided free counseling on psychological and social issues related to drug prevention and control, and community reintegration.

- Expenses for counseling by individuals directly assigned by the Chairman of the People's Committee of communes, wards, towns (hereinafter referred to as the commune level) to manage post-rehabilitation for drug users (as stipulated in Article 9 of Decree No. 94/2009/NĐ-CP) shall be supported as follows:

+ VND 20,000 per counseling session per individual after drug rehabilitation;

+ VND 30,000 per counseling session per group of individuals after drug rehabilitation (two or more persons).

2. Vocational Training Support:

If individuals after drug rehabilitation wish to learn a trade, they may be considered for one-time vocational training support funding at the primary level by the Chairman of the People's Committee at the commune level: VND 1,000,000 per person per training course.

Based on the request for vocational training funding support from individuals after drug rehabilitation and the receipt of training fees from the vocational training institution, the Chairman of the People's Committee at the commune level will consider providing vocational training funding support to individuals after drug rehabilitation.

3. The support levels specified in this Article are minimum levels; depending on specific conditions, the People's Committee at the commune level may decide on higher support levels to facilitate stable employment and income for individuals after drug rehabilitation.

Article 3. Contribution System for Individuals After Drug Rehabilitation Subject to Post-Rehabilitation Management at the Center

1. Individuals after drug rehabilitation subject to post-rehabilitation management at the Center or their relatives are responsible for contributing the following expenses (except those exempted or reduced according to Clause 2, Article 4 of this Circular):

a) Food expenses;

b) Cultural and sports living expenses;

c) Educational and vocational training expenses (if the individual requests);

d) Medical examination and treatment expenses;

đ) Necessary personal living supplies purchase expenses.

2. The Department of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Department of Finance to submit to the People's Committee of the province for consideration and decision on contribution levels based on the principle of ensuring sufficient funds for the aforementioned items.

Article 4. Support regime for individuals after drug rehabilitation applying post-rehabilitation management measures at the Center

1. Individuals after drug rehabilitation applying post-rehabilitation management measures at the Center shall be supported with part of their food expenses, medical examination and treatment costs, vocational training costs, necessary personal item expenses, and other expenses as follows:

a) Food expenses: VND 360,000/person/month during the period of implementing the decision to apply post-rehabilitation management measures at the Center;

b) Ordinary medical examination and treatment costs: VND 30,000/person/month;

c) In case individuals after drug rehabilitation suffer from severe illness or serious diseases that exceed the treatment capacity of the Center and need to be transferred to state hospitals for treatment, the medical examination and treatment costs during hospitalization shall be borne by the individual or their family; if the Center has temporarily paid these costs, the Center shall request the individual or their family to reimburse them. For individuals from poor households, policy families according to the Ordinance on Preferential Treatment for Persons Contributing to the Revolution, and minors, the Center will fully support all medical examination and treatment costs. For individuals from near-poor households, the Center will support 50% of medical examination and treatment costs. In cases where individuals have valid health insurance cards, they will be examined and treated according to the provisions of the Health Insurance Law and related guiding documents.

d) Necessary personal living item purchase costs: VND 300,000/person/year;

đ) Cultural and sports activities: VND 50,000/person/year;

e) Vocational training:

- For individuals applying post-rehabilitation management measures at the Center for the first time, who have not yet received vocational training and wish to learn a trade, they will be supported with the cost of primary vocational training: VND 1,000,000/person; those applying post-rehabilitation management measures at the Center for the second time or more will not be supported with vocational training costs.

- Form of support: The budget for supporting vocational training costs will be arranged annually by the Center according to the current State Budget Law:

+ In cases where individuals after drug rehabilitation study trades organized directly by the Center, the Center can allocate funds for: opening and closing ceremonies, issuing vocational certificates; purchasing textbooks and training materials; paying lecturers' fees for theoretical and practical guidance; supporting raw materials for training; revising and compiling training programs and materials (if necessary).

+ In cases where individuals after drug rehabilitation study trades outside the Center, the Center will consider providing short-term vocational training cost support to individuals who pay appropriate tuition fees based on each trade.

Based on the level and ability of individuals after drug rehabilitation, the material conditions of the Center, and actual circumstances, the Director of the Center will decide on the appropriate form of vocational training.

g) Living electricity and water costs: VND 50,000/person/month;

h) Female hygiene expenses: VND 20,000/person/month;

i) Food allowance and transportation expenses: After completing the decision to apply post-rehabilitation management measures at the Center, individuals after drug rehabilitation return to the community; in cases where the family is in difficult circumstances or the individual does not have income from labor results at the Center and the residential address is clearly defined, upon returning to the residence, they will be provided with the following allowances:

- Food allowance is VND 25,000/person/day during travel days, with a maximum of no more than 5 days;

- Transportation expenses according to public transport prices.

k) Funeral expenses: If individuals after drug rehabilitation die while implementing the decision to apply post-rehabilitation management measures at the Center without relatives or if relatives cannot arrive in time, the Center is responsible for funeral arrangements. The funeral expense amount is VND 3,000,000/person. In cases requiring forensic examination to confirm the cause of death, the Center will pay forensic examination costs according to current state regulations.

l) For individuals after drug rehabilitation infected with HIV/AIDS at the Center, additional medication costs, costs for purchasing items to prevent HIV transmission, and other supportive costs (excluding food and ordinary medical treatment costs) will be provided according to Decision No. 96/2007/QĐ-TTg dated June 28, 2007 of the Prime Minister regarding the management, care, counseling, and treatment of HIV-infected individuals and prevention of HIV transmission at educational institutions, correctional schools, healthcare facilities, social welfare centers, prisons, detention centers, and related guiding documents.

2. Exemption and reduction of food and post-rehabilitation management costs at the Center:

a) Exempted objects: Individuals after drug rehabilitation applying post-rehabilitation management measures at the Center will be exempted from food expenses, medical examination and treatment costs, and other management costs during the implementation of the decision at the Center under the following circumstances:

- Individuals from poor households, policy families according to the Ordinance on Preferential Treatment for Persons Contributing to the Revolution;

- Minors and individuals without a fixed place of residence.

- Individuals in the final stage of AIDS.

b) Reduced objects: Individuals from near-poor households will have 50% of their food, medical examination, and treatment costs, and other management costs reduced during the implementation of the decision at the Center.

3. The levels of assistance stipulated in this Article are the minimum levels; depending on specific local conditions, the Department of Labor, Invalids, and Social Affairs will coordinate with the Department of Finance to report to the Provincial People's Committee for consideration and decision on appropriate funding levels.

Article 5. Job-seeking support regime

1. Persons who have completed drug rehabilitation shall be provided with free job counseling and job placement services in accordance with Circular Joint No. 95/2007/TTLT/BTC-BLDTBXH dated August 7, 2007, issued by the Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs, regarding job placement fees.

2. A job-seeking support amount of VND 1,000,000 per person shall be provided to persons who have completed drug rehabilitation and are subject to post-rehabilitation management measures at their place of residence, as well as those who have completed their post-rehabilitation management measures at the center and returned to their localities with significant progress, a commitment not to reoffend, and no employment; individuals and families who belong to poor households or policy families under the Law on Preferential Treatment for Persons Contributing to the Revolution.

Based on the application for job-seeking financial support submitted by persons who have completed drug rehabilitation, the Chairman of the People's Committee of the commune where the individual resides shall consider and provide assistance to help them create employment and stabilize their lives.

Article 6. Funding for Implementation

1. The funds for implementing support, subsidies, and fee reductions for the subjects specified in this Circular shall be guaranteed from the social security budget of the local government and the central government's targeted supplementary budget for the local government through the National Target Program on Drug Prevention and Control. The establishment, consolidation, allocation, settlement, and finalization of these funds shall be carried out in accordance with the regulations stipulated in this Circular and the State Budget Law and other guiding documents.

2. The funds for implementing the support regime for persons who have completed drug rehabilitation and are subject to post-rehabilitation management measures at their place of residence, as well as the job-seeking support regime for persons who have completed drug rehabilitation as stipulated in Article 5, shall be allocated within the social security budget of the commune, ward, or town.

3. The funds for implementing the support regime for persons who have completed drug rehabilitation and are subject to post-rehabilitation management measures at the center, as stipulated in Article 4, shall be allocated within the social security budget of the center.

Article 7. Effective Date

1. This Circular shall take effect 45 days from the date of signature.

2. Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance for resolution./.
