Regulations on the organization and operation of national defense education centers and security; linking national defense and security education

of colleges and higher education institutions; Based on the Law on National Defense Education and Security dated June 19, 2013;specialized agency under the People's Committee of the province/city.

Pursuant to DecreeNo. Decision No. 161/QĐ-TTg dated January 30, 2015 of the Prime Minister approving the planning of national defense and security education centers for the period of 2015-2020 and subsequent years;June 2024;The Ministers of the Ministry of National Defense, the Ministry of Education and Training, and the Ministry of Labor, Invalids and Social Affairs issue this Joint Circular to regulate the organization and operation of national defense and security education centers; linking national defense and security education of colleges and higher education institutions.

1. This Joint Circular regulates the organization and operation of national defense and security education centers (hereinafter referred to as centers); linking national defense and security education of colleges and higher education institutions.u2. This Joint Circular applies to universities, academies, regional universities, national universities (hereinafter referred to as higher education institutions); colleges; military schools with centers; relevant agencies, organizations, and individuals.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. Implementing fully and accurately the content and program of GDQPAN and ensuring quality and effectiveness.

2. Adhering to centralized and unified guidance from competent authorities.

Article 2. Position and Functions of the Center

3. Promoting responsibility and ensuring harmonious benefits among parties according to the law.

ESTABLISHMENT AND ORGANIZATION OF NATIONAL DEFENSE AND SECURITY EDUCATION CENTERS

1. Adhere strictly to the Party's and State's policies, laws, directives; operate under the leadership of the Party committee and organizational bodies, and the management and administration of the director or principal of the school.

2. Closely integrate national defense and security education (hereinafter referred to as "GDQPAN") with political ideological education, legal dissemination and education, and comprehensive strong center construction.

3. Provide all-round education with emphasis on key areas, using appropriate forms for each target group; combine theoretical knowledge with practical experience, and link theory with practice.

Article 4. Purpose of linking national defense and security education

To implement the GDQPAN program, recognize learning outcomes, and issue GDQPAN certificates. Mobilize the capabilities of GDQPAN centers to organize GDQPAN for students; support schools that lack the conditions to implement the GDQPAN program.

Article 5. Principles of linking national defense and security education

1. Fully and accurately implement the content and curriculum of GDQPAN, ensuring quality and effectiveness.

2. Comply with centralized and unified guidance from competent authorities.

3. Fulfill responsibilities and ensure harmonious interests among parties in accordance with the law.

Chapter II

ESTABLISHMENT AND ORGANIZATION OF NATIONAL DEFENSE AND SECURITY EDUCATION CENTERS

Article 6. Conditions and Authority for Establishing Centers

1. Conditions for Establishment: Implemented according to Clause 2, Article 1 of Decision No. 161/QĐ-TTg dated January 30, 2015 of the Prime Minister approving the planning of the system of national defense and security education centers for the period of 2015-2020 and subsequent years (hereinafter referred to as Decision No. 161/QĐ-TTg). The Prime Minister approves the planning of the national defense and security education center system for the period 2015-2020 and subsequent years (hereinafter referred to as Decision No. 161/QD-TTg).

2. Authority for Establishment

a) The Minister of National Defense decides on the establishment of centers under military schools;

b) The Minister of Education and Training decides on the establishment of centers under colleges and higher education institutions; the Ministers of Industry and Trade; Transport; Culture, Sports and Tourism implement according to Point a, Clause 7, Article 2 of Decision No. 161/QĐ-TTg;

c) The Chairman of the People's Committee of provinces and centrally governed cities (hereinafter collectively referred to as provincial level) implement according to Point a, Clause 8, Article 2 of Decision No. 161/QĐ-TTg.

Article 7. Documents, Procedures, and Formalities for Establishing Centers for National Defense and Security Education

1. Documents for Establishment

a) A proposal for establishing the center;

b) A project for establishing the center including the following main contents: Name of the center; location of the center; necessity and legal basis for establishing the center; objectives, functions, tasks, and organizational structure of the center; regulations and necessary conditions for the center to operate.

2. Procedures and Formalities for Establishment

a) Military schools, colleges, and higher education institutions proposing to establish centers, prepare documents according to Clause 1 of this Article and submit two sets of documents to the competent authority for review.

b) Within thirty working days from the date of receipt of the proposal for establishing the center, the leading reviewing agency completes the documents and procedures to submit to the competent authority for examination and decision on establishing the center. In cases where the conditions for establishing the center are not met, the competent authority responds in writing and specifies the reasons.

Article 8. Principles for Naming and Renaming Centers

1. The name of the center for national defense and security education recorded in the establishment decision includes the components: Center for National Defense and Security Education plus the name of the school.

2. The authority issuing the establishment decision has the authority to decide on renaming the center. Military schools, colleges, and higher education institutions with centers submit a proposal for renaming the center to the competent authority for examination and decision.

Article 9. Tasks and Authorities of Centers

1. Cooperate with colleges, higher education institutions, agencies, and related organizations to develop cooperation plans, implementation plans for national defense and security education courses (shortened as BDKTQPAN), and national defense and security knowledge training programs.

2. Issue internal regulations and operational rules of the center.

3. Organize management, study, training, and centralized living activities at the center according to military lifestyle for students and BDKTQPAN training participants.

4. Organize scientific research, participate in compiling textbooks, teaching materials on national defense and security education.

5. Provide professional and vocational training for lecturers, teachers, managers; organize national defense and security education competitions and sports events.

6. Ensure benefits and policies for staff, lecturers, teachers, speakers, employees, students, BDKTQPAN training participants, and workers of the center.

7. Announce academic and training results of students and BDKTQPAN training participants to linked units and related organizations; issue national defense and security education certificates to students and certificates of completion of the BDKTQPAN training program to training participants at the center.

8. Implement reporting systems, mid-term reviews, final summaries, commendations, and handling violations within their authority.

9. Perform other tasks as prescribed by law;

Article 10. Organization and operation of the center

1. The organizational structure of the center under the military school (operating on a part-time basis) includes:

a) Board of directors: Director and deputy directors;

b) Departments of the school according to their functions and tasks to ensure the operation of the center;

c) Student management unit organization and the BDKTQPAN target group:

- A company not exceeding 120 people, organized into platoons;

- A platoon not exceeding 40 people, organized into squads;

- A squad not exceeding 12 people;

- The company commander is concurrently held by officers, lecturers, or teachers within the establishment of the school; the deputy company commander, platoon leader, and squad leader are decided by the center director.

d) Party organizations and mass organizations.

2. Center under college or higher education institution

a) Board of directors

- For centers under the National University, it consists of a director and deputy directors; the center director is concurrently held by a deputy director of the National University; the deputy director of the center is decided by the National University director; the deputy director for training at the center is held by a military officer on secondment.

- For centers under regional universities, universities, or colleges, it consists of a director and deputy directors; the center director is concurrently held by the director of the regional university or the rector of the university or college; the deputy director of the center is decided by the director of the regional university or the rector of the university or college; the deputy director for training at the center is held by a military officer on secondment.

b) Departments

- For centers with a scale of 15,000 students or more per year: Organize the Scientific Council and Training Council; the Commendation Council; departments (offices): Student Management and Training, Administrative and Organizational Affairs, Logistics, Finance, Technical Services, Inspection, Legal Affairs, and political and military departments.

- For centers with a scale below 15,000 students per year: Organize the Scientific Council and Training Council; the Commendation Council; departments (offices) for Training, Student Management, Administrative and Organizational Affairs, Logistics, Finance, Technical Services, and political and military departments.

- The departments specified in this point are decided by the center director or proposed to the competent authority for decision.

c) Unit organization and student management staff, BDKTQPAN target group

- A company not exceeding 120 people, organized into platoons;

- A platoon not exceeding 40 people, organized into squads;

- A squad not exceeding 12 people;

- The company commander is concurrently held by officers or lecturers within the center's establishment; the deputy company commander, platoon leader, and squad leader are decided by the center director.

d) Party organizations and mass organizations.

Article 11. Center Director

1. Is the person managing and operating the center, responsible before the superior management agency and the law for all activities of the center; has good moral qualities, management skills, and knowledge about national defense and security education; is the account holder of the center. In which:

a) The center director under the military school is the highest commander of the center, responsible before the law, the party committee, the superior commander, and the superior political commissar regarding the implementation of the center's mission;

b) The center director under the college or higher education institution is the head of the center, responsible before the law, superiors, the party committee, the director or rector of the college or higher education institution regarding the implementation of the center's mission.

2. Appointment and removal of the center director for national defense and security education shall be carried out in accordance with the provisions of the law.

3. Duties of the center director

a) Develop plans, organize the implementation of educational and training plans, and implement reporting systems as prescribed;

b) Manage, utilize, and build a cadre of officials, employees, lecturers, teachers, staff, and workers to meet the development requirements of the center;

c) Care for improving and enhancing the material and spiritual life of officials, employees, lecturers, teachers, staff, and workers, and ensure the rights of students studying at the center;

d) Manage physical facilities, teaching equipment, and assets of the center; manage finances in accordance with the State Budget Law.

4. Powers of the Center Director

a) Sign training contracts with partner units;

b) Approve annual teaching plans;

c) Appoint and remove positions within his/her authority;

d) Sign labor contracts for work at the center in accordance with the law;

đ) Decide on income and expenditure in accordance with Articles 28, 29, and 30 of this Circular;

e) Decide on commendations and disciplinary actions as prescribed;

g) Recognize academic results, sign certificates of national defense and security education for students; issue certificates of completion of national defense and security knowledge training programs in accordance with Clause 2, Article 5 of Government Decree No. 13/2014/NĐ-CP dated February 25, 2014 detailing and providing implementation measures for the Law on National Defense and Security Education (Decree No. 13/2014/NĐ-CP).

Article 12. Deputy Director of the center

1. Is an assistant to the director and is responsible to the director for the tasks assigned.

2. The appointment and removal of deputy directors shall be carried out in accordance with the provisions of the law.

Article 13. Scientific Council and Training Board

1. Is an advisory body to the director on the content, training programs, plans, and organizational implementation solutions for the mission of National Defense and Security Education and Training (GDQPAN) for students and Officers' Security and Defense Training (BDKTQPAN). The Scientific Council and Training Board is established by the center's director and operates according to the internal regulations and rules of the center.

2. The center's director serves as the chairman of the Scientific Council and Training Board. The Scientific Council and Training Board consists of members including the director, deputy directors, heads of functional departments, department heads or subject heads, lecturers, teachers, and experienced management staff.

3. Performs other tasks as prescribed by law.

Article 14. Competition and Reward Council

1. The Competition and Reward Council operates in accordance with the provisions of the law; collaborates with mass organizations to advise the Party Committee and the Center's Management Board on competition and reward work at the center.

2. Selects groups and individuals with outstanding achievements in study, training, and scientific research to recommend for rewards to competent authorities.

3. Performs other tasks assigned by competent authorities.

Article 15. Training Department, Student Management, and Targeted Training Unit

1. Position: A functional agency assisting the center director in directing and organizing the implementation of educational work, student management, and targeted training for BDKTQPAN subjects.

2. Tasks:

a) Leads and coordinates with the center's functional agencies, associated units, and related organizations to develop annual course plans for GDQPAN and training plans for each BDKTQPAN session, submitting them for approval by competent authorities and organizing their implementation.

b) Assists the center director in drafting cooperation contracts; organizes the reception and handover of students and BDKTQPAN targets between the center and associated units, agencies, and organizations; provides associated schools, agencies, and organizations with teaching schedules for each course and student records.

c) Assists the center director in managing and organizing platoons, companies, and battalions; coordinates with center agencies in implementing these activities.

d) Develops teaching schedules, arranges lecture halls, classrooms, training fields, shooting ranges, extracurricular activities, and field trips for students and BDKTQPAN targets.

đ) Develops plans and ensures material resources, teaching equipment, and guest lecturer contracts for each training session and academic year.

e) Inspects and urges the implementation of teaching and training plans, manages and stores student and BDKTQPAN target academic records as prescribed.

g) Advises the director on inspection, audit, interim review, final assessment, reward, and disciplinary actions within their authority.

Article 16. Administrative and Organizational Department

1. Position: A functional agency assisting the center's management board in administrative, organizational, and documentation work.

2. Tasks:

a) Assists the director in ensuring benefits and policies for staff, faculty, speakers, employees, students, BDKTQPAN targets, and workers.

b) Implements military residence, guard duty, participates in building clean and strong areas, safety measures; develops security plans for the center, fire prevention, disaster, and natural disaster prevention.

c) Implements inspection and urging systems as prescribed and performs other tasks assigned by competent authorities.

Article 17. Logistics, Finance, and Engineering Department

1. Position: It is the functional agency assisting the director in directing, organizing, and implementing logistics, financial, and engineering work.

2. Tasks:

a) Develop plans for procurement organization, ensuring material infrastructure, logistics, and engineering for the center. Manage the center's logistics and engineering work according to the plan approved by the director;

b) Manage finances, distribute, and recover weapons, student uniforms, and other teaching equipment;

c) Organize disease prevention, treatment, emergency care, and food safety monitoring;

d) Store, maintain, repair, and periodically inspect technical equipment and infrastructure. Manage the center's engineering work according to the plan approved by the director;

đ) Perform other tasks assigned by competent authorities.

Article 18. Inspection and Legal Affairs Department

1. Assist the director in inspecting and checking the implementation of internal regulations, rules, plans, and activity programs of the National Defense and Security Education Center.

2. Advise on resolving complaints, accusations, and handling violations related to national defense and security education in accordance with the law.

3. Performs other tasks assigned by competent authorities.

Article 19. Departments (Departments)

1. As the administrative base unit of the center, assist the director in organizing the implementation of national defense and security education courses, scientific research as assigned.

2. Develop detailed programs, assign lecturers and teachers to prepare lesson plans, lectures, and reference materials; participate in compiling textbooks and educational materials, and scientific research according to the center's plan.

3. Closely coordinate with relevant organizations, individuals, and management staff to guide students and training subjects in implementing education and training activities according to the plan.

4. Organize professional and military pedagogical training for center staff, lecturers, and teachers.

5. Develop examination questions and answers, implement examination and assessment plans for students' academic performance; guide writing summaries and assessing the results of training activities.

6. Summarize students' and training subjects' academic and discipline performance.

7. Perform other tasks assigned by competent authorities.

Article 20. Units and Student Management Officers

1. Fulfill responsibilities and tasks as stipulated in the Regulations on Military Unit Management of the Vietnam People's Army.

2. Coordinate with relevant agencies, organizations, and individuals to implement the center's national defense and security education plan.

3. Centralized management, maintaining study and living routines, and discipline of students and training subjects according to the center's internal regulations and rules.

4. Manage weapons, technical equipment, and infrastructure of the center.

5. Organize cultural, artistic, physical education, sports, and other activities of the center.

6. Inspect, urge, and guide units in performing assigned tasks; conduct mid-term and final reviews and report as prescribed.

7. Perform other tasks assigned by competent authorities.

Article 21. Party Organizations and Mass Organizations

1. The operation of the Party organization within the center follows the Party Charter.

2. The operation of mass organizations follows the provisions of the law, their charters, and the center's internal regulations and rules.

Chapter III

ACTIVITIES OF THE NATIONAL DEFENSE AND SECURITY EDUCATION CENTER

Article 22. Teaching and Learning Activities

Teaching, learning, and evaluating the results of national defense and security education courses are carried out in accordance with the law and relevant ministries and sectors.

Article 23. Textbooks and teaching materials

1. Textbooks and teaching materials for the GDQPAN subject for students shall be issued by the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs, in coordination with the Ministry of National Defense and the Ministry of Public Security.

2. Textbooks and teaching materials for BDKTQPAN shall be issued by the Ministry of National Defense, in coordination with the Ministry of Public Security and related organizations.

Article 24. Conditions and authority to issue certificates of national defense and security education; certificate of completion of the program for enhancing knowledge of national defense and security

1. The conditions and authority to manage, print, and issue certificates of national defense and security education shall be implemented according to the regulations of the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs.

2. Issuance of the certificate of completion of the program for enhancing knowledge of national defense and security shall be carried out in accordance with Clause 2, Article 5 of Decree No. 13/2014/NĐ-CP.

Article 25. Lecturers, teachers, and speakers

1. Lecturers and teachers

a) Object: Includes full-time lecturers and teachers, visiting lecturers, and military and police officers seconded who meet the lecturer and teacher standards for GDQPAN as stipulated by the Law on National Defense and Security Education and Decree No. 13/2014/NĐ-CP.

b) Requirements: Teach according to the prescribed content, curriculum, and plan for GDQPAN for each target group, ensuring quality and effectiveness; fully participate in training activities organized by competent authorities;

c) Benefits and policies: Enjoy other benefits as prescribed by law.

2. Speakers

a) Object: Individuals invited by authorized agencies and organizations to participate in the program for enhancing knowledge of national defense and security as provided for in Article 26 of the Law on National Defense and Security Education;

b) Requirements: Deliver the content accurately to the target groups according to the prescribed program and plan for BDKTQPAN;

c) Benefits and policies: Enjoy benefits and policies as prescribed by law.

Article 26. Duties and rights of students and subjects of the program for enhancing knowledge of national defense and security

1. Students and subjects of the BDKTQPAN program have the following duties:

a) Fully comply with the internal rules and study plans of the center;

b) Safeguard and maintain weapons, technical equipment, teaching aids, textbooks, teaching materials, shared uniforms, and assigned facilities;

c) Build cultural lifestyles, environmental landscapes, and participate in extracurricular activities of the center;

d) Other duties as prescribed by law.

2. Students and subjects of the BDKTQPAN program have the following rights:

a) To be informed of legal documents on GDQPAN and the center's internal rules;

b) To use tools and uniforms as prescribed during their studies at the center;

c) To be notified of their academic and training results at the center, and to receive certificates upon completion of the GDQPAN course and certificates of completion of the BDKTQPAN program as prescribed;

d) Other rights as prescribed by law.

Article 27. Infrastructure and teaching equipment

1. The center may use infrastructure, technical equipment, teaching aids, military explosives, training grounds, firing ranges, and shooting ranges of the managing unit and collaborate with military units and related organizations to implement the GDQPAN and BDKTQPAN courses.

2. Annually, the center will reinforce, upgrade, and invest in infrastructure, teaching equipment, training grounds, firing ranges, and shooting ranges to ensure operational readiness.

Article 28. Sources of funding

1. Central budget.

2. Local budget.

3. Support from the managing agency.

4. Funding from enterprises and units for national defense education and training.

5. Tuition fees collected from joint contracts.

6. Investments, sponsorships from organizations and individuals, and other lawful revenues as prescribed by law.

Article 29. Contents of expenditure

1. Ensuring material infrastructure and equipment for the center's activities.

2. Wages for contractual employees, electricity, water, common medical expenses, inspection, supervision, interim review, final assessment, and rewards.

3. Expenditure for teaching activities, teaching support services, and implementation of national defense and security education.

4. Expenditure for management and operation.

5. Other lawful expenditures as prescribed by law.

Article 30. Tuition Fees

1. The center implements tuition fee collection levels according to Decree No. 86/2015/NĐ-CP dated October 2, 2015 of the Government on mechanisms for collecting and managing tuition fees for educational institutions under the national education system and policies for exempting, reducing tuition fees, and supporting study costs from the 2015-2016 academic year to the 2020-2021 academic year.

2. Apart from the funding specified in the training contract, centralized meal fees, and any other revenues (if any) transferred from schools, the center shall not collect any additional funding from students.

Chapter IV

NATIONAL DEFENSE AND SECURITY EDUCATION LINKAGE

Article 31. Participants in Linkage

1. The managing unit is a school that has the necessary conditions to organize teaching and evaluate learning outcomes of national defense and security subjects and link education with other schools, including universities, academies, colleges, and national defense and security education centers as stipulated in Decision No. 161/QĐ-TTg and units with departments or subject groups of national defense and security education authorized by the Ministry of Education and Training to operate autonomously.

2. The linked unit is a school that does not have the necessary conditions to organize teaching and evaluate learning outcomes of national defense and security subjects and is allowed to link with the center or other schools.

Article 32. Conditions for Linkage

1. Centers that have been assessed as meeting the operational conditions as currently prescribed (List of managing units and linked units attached to this Circular).

2. Centers stipulated in Decision No. 161/QĐ-TTg must have sufficient staffing, teaching facilities, equipment, lecture halls, training grounds, and comprehensive training fields in accordance with regulations and the agreement of the Ministries of National Defense, Education and Training, and Labor, War Invalids and Social Affairs.

3. An autonomous educational unit that has not yet met the conditions stipulated in Clause 1 of this Article and is not located within the planning area for a center must implement guest lecturing, purchase teaching equipment, and link educational content or the entire program with local military schools to conduct national defense and security subjects.

4. Colleges and higher education institutions currently having departments or subject groups of national defense and security education teaching at their institutions.

5. Managing units and linked units implementing national defense and security education linkage according to the list of national defense and security education linkage attached to this Circular.

Article 33. Educational Linkage Contracts

1. Contract contents must meet the following requirements:

a) Commitment to responsibilities that each party must fulfill when participating in national defense and security education linkage as prescribed in Clause 1, Article 35 of this Joint Circular;

b) Main information about activities during the organization of teaching and learning of national defense and security subjects; among which, the following information must be included in the contract:

- Time for organizing study, training, and evaluating study and training results;

- Assurance work of each party: Ensuring student living conditions and uniforms; receiving and transferring students along with their study and training results. The managing unit must provide full information about the Center's organizational and operational regulations related directly to learners and linked units.

2. Determination of payment methods and conditions must comply with current regulations on financial settlement; revenues of the managing unit must be transparent and comply with current regulations; the amount of financial contribution and the time for transferring funds, contract termination must be fully recorded in the contract between the parties.

Article 34. Implementation Procedures for Collaboration

1. The managing entity:

a) Hosts the education collaboration conference and informs collaborating entities about the regulations on education collaboration for National Defense and Security (ND&SEC);

b) Urges collaborating entities to submit plans, progress, and educational procedures; the number of students in each course and study period two months before the new academic year;

c) Organizes the implementation of ND&SEC content and programs, and extracurricular activities; combines ND&SEC education with discipline training for students;

d) Evaluates learning outcomes and discipline, and issues ND&SEC certificates to students when they meet the conditions;

đ) Stores, transfers learning outcomes and discipline results, and related files to collaborating entities after completing the course or study period; terminates the collaboration contract.

2. Collaborating entities:

a) Proactively coordinate with the managing entity regarding ND&SEC collaboration; attend education collaboration conferences;

b) Coordinate with the managing entity to develop plans for implementing ND&SEC within the course or study period, and draft the collaboration contract;

c) Receive student learning outcomes and discipline results, coordinate in handling matters related to the course or study period;

d) Transfer funds to the managing entity according to the agreement in the education collaboration contract.

Article 35. Responsibilities of Parties Involved in Collaboration

1. The managing entity:

a) Implement education as prescribed; ensure conditions for program implementation; be responsible for education quality; accept supervision from state management agencies on ND&SEC;

b) Ensure sufficient quantity and quality of teaching staff, instructors, and managers; provide adequate textbooks, materials, and teaching equipment for ND&SEC courses; plan implementation, assign teaching duties, evaluate, and recognize student learning and discipline outcomes;

c) Strictly handle procedures for receiving and transferring personnel and learning outcomes and discipline results;

d) Manage students during their learning and discipline periods, ensuring personal and teaching equipment safety; guarantee legitimate rights and special benefits (if applicable) of ND&SEC courses according to current regulations;

đ) Within thirty days after the end of the course or study period, fully transfer student learning outcomes and discipline results to collaborating entities;

2. Collaborating entities:

a) Closely cooperate with the managing entity to prepare all contents and requirements for education collaboration; ensure student safety during handover and reception processes;

b) Appoint officials to manage and supervise the implementation of education plans and report any violations to the managing entity for timely correction;

c) Coordinate with the managing entity to implement exemptions, reductions, or temporary suspensions of ND&SEC studies according to current regulations and policies for learners (if applicable);

d) Announce plans, enforce rules and study regulations for students at least one month before starting classes.

3. Both collaborating parties are responsible for fulfilling commitments in the education contract and other agreements; coordinate, monitor, and supervise the implementation of regulations on teaching organization and assessment of learning outcomes and discipline; ensure rights for educators and learners and the execution of the education collaboration contract.

Article 36. Rights and responsibilities of parties participating in the linkage

1. The managing entity:

a) Proactively report to the competent authority on the capacity to accept students and implement the linkage of national defense and security education;

b) Develop an educational plan based on the agreement between the managing unit and the linked unit; detail the national defense and security education program issued by the Ministry of Education and Training; prepare lecturers, teachers, and teaching facilities and equipment; assign teaching tasks; enter into guest lecturer contracts;

c) Organize the assessment of learning outcomes and training; recognize learning outcomes and training results and issue national defense and security education certificates for students according to current regulations.

2. Collaborating entities:

a) Proactively propose to the competent authority and the managing unit regarding the implementation of the linkage of national defense and security education;

b) Coordinate with the managing unit to develop an educational plan, unify the time and number of students studying national defense and security education per course, study period;

c) Directly sign the education linkage contract with the managing unit.

Article 37. Management of linkage activities

1. The managing unit, the linked unit, and the self-managed unit organize and implement the content and program of national defense and security education; when participating in the education linkage, they must comply with the provisions of this Circular.

2. At the end of each semester and academic year, the managing unit reports the learning outcomes and training results of students and any recommendations and proposals to the Ministry of National Defense, the Ministry of Education and Training, and the Ministry of Labor, Invalids, and Social Affairs.

Article 38. Inspection and supervision of linkage activities

1. The managing unit and the linked unit inspect, supervise, and participate in inspection and supervision teams from higher authorities regarding the linkage of national defense and security education.

2. Local management agencies for national defense and security education inspect, supervise, and monitor the linkage of national defense and security education within their assigned scope and responsibility.

3. The Central Council for National Defense and Security Education, the Ministry of National Defense, the Ministry of Education and Training, and the Ministry of Labor, Invalids, and Social Affairs organize inspections and supervision of the implementation of national defense and security education tasks and the linkage of national defense and security education as prescribed.

Article 39. Handling violations

1. During the process of linking national defense and security education, if the parties involved violate the provisions of this Circular, they will be handled according to current laws.

2. When one or both parties in the linkage fail to meet commitments or lack the capacity to continue implementing the education linkage contract, the managing unit shall report to the Ministry of National Defense, the Ministry of Education and Training, and the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution.

Chapter V

IMPLEMENTATION

Article 40. Effective Date

1. This Circular takes effect from December 20, 2015.

2. This Circular replaces the following documents:

a) Circular No. 109/2009/TT-BQP dated November 11, 2009, of the Minister of National Defense guiding the organization and operation of the National Defense and Security Education Center at military schools;

b) Decision No. 82/2007/QĐ-BGDĐT dated December 24, 2007, of the Minister of Education and Training promulgating the Regulations on the organization and operation of the Student National Defense and Security Education Center;

c) Decision No. 57/2008/QĐ-BGDĐT dated October 14, 2008, of the Minister of Education and Training promulgating the Regulations on the linkage of national defense and security education of higher education institutions;

d) Circular No. 25/2009/TT-BGDĐT dated September 24, 2009, of the Minister of Education and Training amending and supplementing the list of managing units and education linkage units specified in Decision No. 57/2008/QĐ-BGDĐT dated October 14, 2008, of the Minister of Education and Training promulgating the Regulations on the linkage of national defense and security education of higher education institutions.

Article 41. Responsibility for Implementation

1. The Minister, the head of ministerial-level agencies, central agencies under the Government, the Chairman of provincial and centrally-administered city People's Committees; the heads of colleges, higher education institutions, national defense and security education centers, and related organizations and individuals are responsible for implementing this Circular.

2. Annually, the Ministry of National Defense, in collaboration with the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs, reviews, adjusts, and supplements the linkage list of national defense and security education as appropriate.

3. In the course of implementation, if there are difficulties or obstacles, relevant agencies, units, organizations, and individuals should promptly reflect them to the Ministry of National Defense for coordination with the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs to consider and resolve./.
