DECISION OF THE PRIME MINISTER

On issuing the Regulation on Management of Search and Rescue Equipment

PRIME MINISTER

Based on the Law on the Organization of the Government dated December 25, 2001;

Pursuant to the Government Decree No. 14/1998/NĐ-CP dated March 6, 1998 on State Asset Management;

Considering the proposal of the Chairman of the National Committee for Search and Rescue,

DECISION:

Article 1. This Decision promulgates the Regulation on Management of Search and Rescue Equipment.

Article 2. This Decision takes effect 15 days from the date of publication in the Official Gazette.

Article 3. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial People's Committees under the central city, and the Chairman of the National Committee for Search and Rescue are responsible for implementing this Decision./.

REGULATIONS

Management of search and rescue equipment

(Issued together with Decision No. 124/2007/QĐ-TTg dated July 31, 2007)

PART I

GENERAL PROVISIONS

Article 1. Scope of regulation, applicable subjects

Article 1. This Regulation stipulates the issuance, management, use, storage, maintenance, inspection, and disposal of various types of search and rescue equipment, means, materials, and goods ensuring search and rescue activities owned by the state (hereinafter referred to as search and rescue equipment).

Article 2. This Regulation applies to the National Committee for Search and Rescue, ministries, sectors, localities, specialized units performing tasks in the field of search and rescue (hereinafter referred to as specialized units), and units participating in search and rescue operations (hereinafter referred to as auxiliary units).

Article 2. Sources of search and rescue equipment

Point 1. Items withdrawn from national reserves.

Point 2. State budget funds allocated to the National Committee for Search and Rescue, ministries, sectors, localities, specialized units, and auxiliary units for investment in purchasing search and rescue equipment.

Point 3. Purchasing search and rescue equipment from self-balancing funds of ministries, sectors, localities, specialized units, and auxiliary units.

Point 4. Goods and financial aid, support, and donations from organizations and individuals both within and outside the country.

Article 3. Types of search and rescue equipment

Point 1. Specialized search and rescue equipment refers to equipment with a service life that ensures the operation of specialized units on maritime, riverine, air routes, oil spill response, disaster prevention and mitigation, fire control, epidemic prevention, and national defense and security.

Point 2. General-purpose search and rescue equipment refers to equipment without a defined service life that ensures the operation of forces participating in search and rescue operations.

Chapter II

ISSUANCE, MANAGEMENT, USE, STORAGE, MAINTENANCE AND DISPOSAL OF SEARCH AND RESCUE EQUIPMENT

Authority for issuance and mobilization of search and rescue equipment

Article 4. Clause 1. The withdrawal of items from national reserves for search and rescue purposes shall be carried out in accordance with the Law on National Reserves.

Clause 2. The Chairman of the National Committee for Search and Rescue decides on the issuance of all types of search and rescue equipment to ministries, sectors, localities, specialized units, and auxiliary units participating in search and rescue operations.

Clause 3. The Minister, the Chairman of the People's Committee of provinces and centrally governed cities decides on the issuance of search and rescue equipment to subordinate units.

Clause 4. When necessary, the Chairman of the National Committee for Search and Rescue may decide to mobilize forces, means, and equipment of ministries, sectors, localities, specialized units, and related units to participate in domestic and international search and rescue missions upon request.

Forms of issuance of search and rescue equipment

Article 5. Clause 1. Issuance without payment refers to the issuance of search and rescue equipment from national reserves and non-reimbursable aid from organizations and individuals both within and outside the country.

Clause 2. Issuance with payment refers to the issuance of equipment purchased from state budget funds, self-balancing funds of ministries, sectors, localities, or loans from organizations and individuals both within and outside the country.

Management and use of search and rescue equipment

Article 6. Clause 1. Ministries, sectors, localities, specialized units, and auxiliary units receiving search and rescue equipment must strictly manage all such equipment issued and purchased from sources specified in Article 2 of this Regulation.

Clause 2. The use of equipment must be in accordance with its intended purpose, achieving efficiency in search and rescue, disaster prevention and mitigation, fire control, epidemic prevention, and other catastrophes.

Clause 3. Units assigned the task of managing, using, and storing search and rescue equipment must fully implement registration, statistics, inventory, inspection, and reporting procedures in accordance with regulations.

Maintenance and storage of search and rescue equipment

Article 7. Clause 1. New equipment received and not yet used must be carefully inspected for quantity, quality, type, technical condition, and packaging before being stored. In cases where the quantity, quality, type, or technical specifications are unclear, a detailed inspection report must be prepared to determine the technical condition.

Clause 2. Storage and maintenance of search and rescue equipment must follow the manufacturer's guidelines and standards set by relevant ministries and sectors.

Clause 3. Equipment storage must be neat, following the principle of easy visibility, accessibility, inspection, and convenient issuance.

Clause 4. Strict measures must be taken to prevent fires, ensure security, prevent damage, loss, or sabotage by criminals.

Clause 5. Equipment issued for use and then returned for storage must be inspected for technical condition, classified according to quality, repaired if damaged, registered, and statistically reported as required.

Clause 6. In case of loss, damage, or consumption of equipment during operations, a report must be made, confirmed by competent authorities, and submitted for consideration and decision by authorized bodies.

Authority for disposal and handling of search and rescue equipment

Article 8. Authority to liquidate and dispose of search and rescue equipment

1. Annually, ministries, sectors, localities, specialized units, and兼任单位负责管理、使用和保管搜救设备的,必须成立清查委员会,掌握设备数量,评估技术状况,分级评定每种设备的质量;向国家搜救委员会主席报告并建议将损坏、超过使用年限、落后的设备从目录中删除;不配套、无备件、无法修理的设备进行清理处理,按照规定执行。

2. The Chairman of the National Search and Rescue Committee decides on the policy regarding the disposal and handling of search and rescue equipment.

3. Ministries, sectors, and localities are responsible for organizing the disposal and handling of search and rescue equipment according to regulations.

Article 9. Regulations on the Disposal and Handling of Search and Rescue Equipment

1. The disposal and handling of search and rescue equipment must follow procedures, ensure safety, be economical, and comply with state regulations on state asset management.

Costs for disposal and handling must be based on the budget estimates, standards, and unit prices prescribed by the State. The proceeds from disposal and handling must be managed according to regulations.

2. For specialized search and rescue equipment, when disposing and handling, usable parts should be utilized to serve repair and replacement work for currently used equipment.

3. After completing the disposal and handling of search and rescue equipment, ministries, sectors, and localities must compile and report to the National Search and Rescue Committee.

Chapter III

RESPONSIBILITIES OF LEVELS REGARDING DISTRIBUTION, MANAGEMENT,

USE, STORAGE, MAINTENANCE, AND DISPOSAL,

HANDLING OF SEARCH AND RESCUE EQUIPMENT

Article 10. National Search and Rescue Committee

The National Search and Rescue Committee is the agency assisting the Prime Minister in the distribution and management of search and rescue equipment, and directing the Search and Rescue Steering Committees of ministries, sectors, and localities to implement distribution, management, use, storage, maintenance, disposal, and handling of search and rescue equipment.

Article 11. Search and Rescue Steering Committees of Ministries, Sectors, and Localities

The Search and Rescue Steering Committees of ministries, sectors, and localities are the permanent agencies assisting ministries, sectors, and localities in the distribution, management, use, storage, maintenance, disposal, and handling of search and rescue equipment.

Article 12. Reporting System

1. Annually, ministries, sectors, localities, specialized units, and兼任单位组织清查,掌握设备的数量、种类,分级评定设备质量;实施关于管理、使用、存储、维护、处置和处理设备的报告制度。

Reporting time:

- Six-month report: submitted before July 5;

- Annual report: submitted before January 5 of the following year;

- Ad hoc report: whenever there is a change in search and rescue equipment.

2. After participating in search and rescue operations, ministries, sectors, localities, specialized units, and兼任单位必须向国家搜救委员会报告设备、物资、燃料的损失、损坏和消耗情况,以便汇总上报总理。

Article 13. Inspection work

1. The National Search and Rescue Committee leads and coordinates with relevant ministries and sectors to inspect ministries, sectors, and localities on the distribution, management, use, storage, maintenance, disposal, and handling of search and rescue equipment;

2. Ministries, sectors, and localities inspect subordinate agencies and units on the management, use, storage, maintenance, disposal, and handling of search and rescue equipment according to regulations.

Article 14. Plan for Procurement, Storage, Maintenance, and Payment, Compensation for Search and Rescue Equipment

1. Annually and every five years, the National Search and Rescue Committee guides and directs ministries, sectors, and localities to develop plans for procurement of search and rescue equipment to meet requirements.

2. Ministries and sectors develop and promulgate standards and norms for storage and maintenance of search and rescue equipment for approval by competent authorities.

3. Payment and compensation for losses, damages, and destruction of search and rescue equipment of organizations and individuals mobilized for search and rescue operations must comply with state regulations.

Chapter IV

IMPLEMENTING PROVISIONS

Article 15. Awards

Organizations and individuals who achieve outstanding results in implementing this Regulation on the Management of Search and Rescue Equipment will be rewarded according to the law.

Article 16. Handling of violations

Organizations and individuals who fail to fulfill the responsibilities stipulated in this Regulation shall be subject to disciplinary action, administrative penalties, or criminal liability追究刑事责任,depending on the nature and severity of the violation.

Article 17. Implementation

The National Search and Rescue Committee, ministries, sectors, provincial people's committees under the central government, relevant agencies, organizations, and individuals have the responsibility to implement this Regulation.
