DECREE

Amending and supplementing certain articles of Decree No. 63/2011/NĐ-CP dated July 28, 2011 of the Government detailing and guiding the implementation of certain provisions of the Commercial Arbitration Law

On the basis of The Law on Archives dated November 11, 2011;

On the basis of Commercial Arbitration Law on June 17, 2010;

At the proposal of the Minister of Justice;

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 63/2011/NĐ-CP dated July 28, 2011 of the Government detailing and guiding the implementation of certain provisions of the Commercial Arbitration Law.

Article 1. Amending and supplementing certain articles of Decree No. 63/2011/NĐ-CP dated July 28, 2011 of the Government detailing and guiding the implementation of certain provisions of the Commercial Arbitration Law

1. Repealing Point d Clause 1 Article 8.

2. Repealing Point đ Clause 1 Article 10.

3. Clause 2 and Clause 3 Article 21 shall be amended and supplemented as follows:

a) Point đ Clause 2 Article 21 shall be amended and supplemented as follows:

“đ) Documents proving that the Branch Manager is permanently resident in Vietnam;"

b) Repealing Points b, c and e Clause 2 Article 21;

c) Clause 3 Article 21 shall be amended and supplemented as follows:

"3. The establishment dossier for a Representative Office includes one set of the following documents:

a) Application for establishing a Representative Office;

b) Certified copy of the Charter of the foreign arbitration organization."

4. Repealing Points b and d Clause 2 Article 22.

Article 2. Responsibility for Implementation

1. The Minister of Justice shall be responsible for organizing the implementation of this Decree.

2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under the central government, and related organizations and individuals shall be responsible for implementing this Decree.

Article 3. Effectiveness

This Decree takes effect from the date of issuance./.
