Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 164/2017/NĐ-CP dated December 30, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Chief of General Staff of the Vietnam People's Army;

The Minister of National Defense issues this Circular amending and supplementing some articles of the Regulation on the organization of emergency transportation of wounded and sick persons in marine, island, remote, and mountainous areas by military aircraft issued together with Circular No. 193/2016/TT-BQP dated November 26, 2016 of the Minister of National Defense.

Article 1. Amending and supplementing some articles of the Regulation on the organization of emergency transportation of wounded and sick persons in marine, island, remote, and mountainous areas by military aircraft issued together with Circular No. 193/2016/TT-BQP dated November 26, 2016 of the Minister of National Defense.

1. Economic organizations conducting foreign exchange trading agency activities; economic organizations conducting foreign currency receipt and payment service provision activities; economic organizations conducting border country currency exchange agency activities.

"Article 1. Scope of Regulation

1. This Regulation stipulates the conditions, principles, and procedures for organizing emergency transportation of wounded and sick persons in marine, island, remote, and mountainous areas by military aircraft; organizing escort for emergency purposes, organizing coordination, and responsibilities of relevant agencies, units, and individuals.

2. This Regulation does not apply to commercial flights in the field of medical emergency conducted by Binh Doan 18 (Vietnam Helicopter Corporation) pursuant to contracts with organizations and individuals within and outside the country.

2. Clause 1 of Article 6 shall be amended and supplemented as follows:

"1. When a patient arrives at a military hospital for emergency treatment and there is a decision to transport the patient by military aircraft, the person in charge of the military hospital shall act as follows:

a) For the Spratly Islands area and DK1 platforms: Promptly report the patient's condition to the Director of the main hospital and the Military Medical Service Chiefs at all levels up to the Chief of the Military Medical Service of the Navy Command;

b) For nearshore islands and remote areas: Promptly report the patient's condition to the Military Medical Service Chiefs at all levels up to the Chief of the Military Medical Service of the Military Region or the Chief of the Military Medical Service of the Navy Command. The Chief of the Military Medical Service of Binh Doan 15, the Chief of the Military Medical Service of Binh Doan 16."

3. Point b and point c of Clause 3 of Article 6 shall be amended and supplemented as follows:

"b) In case of a decision to transport a patient by military aircraft, the Military Medical Department reports to the Head of the General Staff Headquarters (through the Operations Department) and simultaneously reports to the Head of the Logistics General Department. In urgent cases, report directly to the Head of the General Staff Headquarters;

c) For patients who are subjects under Clause 2 of Article 2 of this Regulation and have a decision to transport by military aircraft, the Military Medical Department reports to the Head of the General Staff Headquarters (through the Rescue and Disaster Relief Department) and simultaneously reports to the Head of the Logistics General Department. In urgent cases, report directly to the Head of the General Staff Headquarters."

4. Clause 5 of Article 6 shall be amended and supplemented as follows:

"5. After receiving the request from the Military Medical Department and the Rescue and Disaster Relief Department, the Operations Department reports to the Head of the General Staff Headquarters. The Head of the General Staff Headquarters examines and reports to the Minister of National Defense and the Chief of the General Staff for decision. In urgent cases, the Military Medical Department reports directly to the Head of the General Staff Headquarters, while reporting to the Head of the Logistics General Department and the Rescue and Disaster Relief Department, and the Operations Department."

5. Point c of Clause 7 of Article 6 shall be amended and supplemented as follows:

"c) After landing, based on actual conditions, the flight captain decides whether to shut down the engine or keep it running (in idle mode) to hand over the patient. During the handover of the patient, at least one member of the flight crew must descend to guide and control access to the aircraft. Upon completion of the emergency flight, Air Force units compile and report to their superiors."

6. Clause 8 of Article 6 shall be added as follows:

"8. Reporting after accepting patients for treatment:

a) Military hospitals promptly report the results of accepting patients for treatment to the Military Medical Department;

b) The Military Medical Department compiles the situation and reports to the Head of the General Staff Headquarters (through the Operations Department and the Rescue and Disaster Relief Department) and the Head of the Logistics General Department."

7. Clause 1 of Article 11 shall be amended and supplemented as follows:

"1. In case a patient contraindicates transportation by aircraft, additional forces and medical equipment should be strengthened to handle emergency treatment at the unit; the Director of the Military Medical Department reports to the Head of the Logistics General Department to propose the Head of the General Staff Headquarters to organize a flight to transport forces and medical equipment to reinforce the military hospital."

Article 2. Effective Date

This Circular takes effect from December 5, 2020.

Article 3. Responsibility for Implementation

The Chief of General Staff, the Director of the Political General Department, commanders of relevant agencies, units, and individuals are responsible for implementing this Circular./.
