Regulations on the delegation of state management authority in the field of managing and using public assets
On the basis of The Government Organization Law 2025;
On the basis of The Local Government Organization Law 2025;
Pursuant to Resolution No. Decision 190/2025/QH15 dated February 19, 2025 of the National Assembly regarding handling certain issues related to the restructuring of the state apparatus;
On the basis of Law on Management and Use of State Assets dated June 21, 2017; Law amending and supplementing certain articles of the Securities Law, Accounting Law, Independent Audit Law, State Budget Law, Public Asset Management and Usage Law, Tax Administration Law, Personal Income Tax Law, National Reserve Law, Administrative Violation Handling Law dated November 29, 2024;
At the proposal of the Minister of Finance;
The Government promulgates this Decree to regulate the delegation of state management authority in the field of managing and using public assets.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Decree provides for:
a) Delegation by the Prime Minister to ministers, heads of central agencies, and local authorities; delegation by ministers and heads of ministerial-level agencies to local authorities.
b) Procedures for performing tasks and exercising powers by agencies and persons authorized to perform delegated tasks and powers.

This Decree applies to central government agencies, local authorities, and other organizations and individuals related to the field of managing and using public assets.
Article 2. Principles of Delegation
1. Ensuring compliance with the Constitution; consistency with principles and regulations on the division of authority and delegation under the Government Organization Law and the Local Administration Law.
2. Ensuring thorough delegation of tasks between central government agencies and local authorities, ensuring the unified management role of the Government and the executive power of the head of the Government over state management in the field of managing and using public assets, while promoting the initiative, creativity, and responsibility of local authorities in performing state management tasks in this field.
3. Ensuring that the Government, the Prime Minister, ministries, ministerial-level agencies, and central agencies perform macro-level state management tasks, ensuring and organizing the development of consistent and unified systems, strategies, plans, playing a constructive role, and strengthening inspection, supervision, and monitoring.
4. Promoting delegation and clearly distinguishing the authority of People's Councils, People's Committees, and Chairpersons of People's Committees; clearly distinguishing the general authority of People's Committees and the specific authority of their Chairpersons; ensuring consistency with the tasks, powers, and capabilities of agencies and persons authorized to perform delegated tasks and powers.
5. Implementing delegation among relevant sectors and fields in a comprehensive, integrated, interconnected manner, without omission or overlap of tasks; ensuring a legal basis for the normal, continuous, and smooth operation of agencies; preventing work interruptions, overlapping, duplication, or omission of functions, tasks, areas, and regions.
6. Ensuring human rights and citizens' rights; ensuring transparency and creating favorable conditions for individuals and organizations to access information, exercise their rights and fulfill their obligations according to the law, and follow prescribed procedures; not affecting the normal activities of society, citizens, and businesses.
7. Ensuring no impact on the implementation of international treaties and agreements to which the Socialist Republic of Vietnam is a party.
Chapter II
DELEGATION OF STATE MANAGEMENT IN THE FIELD OF MANAGING AND USING PUBLIC ASSETS AT AGENCIES, ORGANIZATIONS, AND UNITS
1. The Chairman of the People's Committee of the province shall decide on the transfer of state assets at agencies, organizations, and units under their management to ministries, central agencies, or other localities as provided for in point a, Clause 1, Article 20 of Decree No. 151/2017/ND-CP dated December 26, 2017 of the Government detailing certain provisions of the Law on Management and Use of State Assets, amended and supplemented by Decree No. 114/2024/ND-CP dated September 15, 2024 of the Government and Decree No. 50/2025/ND-CP dated February 28, 2025 of the Government (hereinafter referred to as Decree No. 151/2017/ND-CP).
The procedures for transferring state assets shall be carried out in accordance with Article 21 of Decree No. 151/2017/ND-CP; there is no need to report to the Minister of Finance for consideration and decision as stipulated in Article 21 of Decree No. 151/2017/ND-CP.
2. The Minister, Head of Central Agencies, and the Chairman of the People's Committee of the province shall issue a list of specific assets within their management scope that must be insured against typhoon, flood, and storm risks and the implementation timeline as provided for in Clause 2, Article 135 of Decree No. 151/2017/ND-CP.
3. The Chairman of the People's Committee of the province shall decide on the transfer of state assets at agencies, organizations, and units under their management to people's armed forces units as provided for in point b, Clause 2, Article 59 of Decree No. 151/2017/ND-CP.
The procedures for transferring state assets shall be carried out in accordance with Article 21 of Decree No. 151/2017/ND-CP; there is no need to report to the Minister of Finance for consideration and decision as stipulated in Article 21 of Decree No. 151/2017/ND-CP.
4. The Chairman of the People's Committee of the province shall approve the plan for transferring state assets of projects under the management of the locality to agencies, organizations, units, or projects managed by the central government or other localities as provided for in point a, Clause 2, Article 92 of Decree No. 151/2017/ND-CP.
The approval procedures shall be carried out in accordance with Article 93 of Decree No. 151/2017/ND-CP; there is no need to request the agency responsible for managing state assets to report to the Minister of Finance for consideration and decision as provided for in points d and đ, Clause 1, Article 93 of Decree No. 151/2017/ND-CP.
1. The Minister, Head of Central Agencies, and the Chairman of the People's Committee of the province shall approve plans for reorganizing and disposing of houses and land as provided for in point a, Clause 1, Article 8 of Decree No. 03/2025/ND-CP dated January 1, 2025 of the Government on the reorganization and disposal of state assets (hereinafter referred to as Decree No. 03/2025/ND-CP). The procedures for approving plans for reorganizing and disposing of houses and land by the Minister and Heads of Central Agencies shall be carried out in accordance with Article 6 of Decree No. 03/2025/ND-CP; there is no need to report to the Prime Minister as provided for in point a, Clause 6, Article 6 of Decree No. 03/2025/ND-CP.
The procedures for approving plans for reorganizing and disposing of houses and land by the Chairman of the People's Committee of the province shall be carried out in accordance with Article 7 of Decree No. 03/2025/ND-CP; there is no need to report to the Prime Minister as provided for in point a, Clause 3, Article 7 of Decree No. 03/2025/ND-CP. The Chairman of the People's Committee of the province shall perform the tasks and powers of the People's Committee of the province as provided for in point d, Clause 3, Article 7 of Decree No. 03/2025/ND-CP.
2. The Chairman of the People's Committee of the province shall approve the plan for transferring houses and land at agencies, organizations, and units under their management to ministries, central agencies, or other localities as provided for in Clause 2, Article 8 of Decree No. 03/2025/ND-CP.
The procedures for approving plans for reorganizing and disposing of houses and land by the Chairman of the People's Committee of the province shall be carried out in accordance with Article 7 of Decree No. 03/2025/ND-CP; there is no need to report to the Minister of Finance as provided for in point c, Clause 3, Article 7 of Decree No. 03/2025/ND-CP. The Chairman of the People's Committee of the province shall perform the tasks and powers of the People's Committee of the province as provided for in point d, Clause 3, Article 7 of Decree No. 03/2025/ND-CP.
1. The Minister, Head of Central Agencies, and Chairman of the Provincial People's Committee shall decide on the following matters:
a) Transfer of used vehicles of Vietnamese agencies abroad under their management with remaining value or re-evaluated value higher than 15% compared to the maximum price specified in Clause 14, Article 5 of Decree No. 166/2017/ND-CP dated December 31, 2017 of the Government stipulating standards, quotas, and regulations for managing and using public assets of Vietnamese agencies abroad, amended and supplemented by Decree No. 171/2024/ND-CP dated December 27, 2024 of the Government (hereinafter referred to as Decree No. 166/2017/ND-CP);
b) Investment in construction, purchase, and provision of office premises, non-profit activity facilities, housing, and ambassadors' private residences of Vietnamese agencies abroad under their management in other cases prescribed in Point d, Clause 1, Article 9 of Decree No. 166/2017/ND-CP.
c) Provision of vehicles with prices excluding all types of taxes higher than 15% compared to the maximum price stipulated for Vietnamese agencies abroad under their management as provided in Clause 2, Article 18 of Decree No. 166/2017/ND-CP;
2. The Chairman of the Provincial People's Committee shall decide on the following matters:
a) Transfer from localities to central ministries or agencies or between localities for used vehicles of Vietnamese agencies abroad under their management with remaining book value or re-evaluated value according to the law not exceeding the maximum price or not exceeding 15% higher than the maximum price specified in Clause 14, Article 5 of Decree No. 166/2017/ND-CP.
b) Transfer from localities to central ministries or agencies or between localities for office premises, non-profit activity facilities, housing, and ambassadors' private residences of Vietnamese agencies abroad under their management as provided in Point a, Clause 2, Article 12a of Decree No. 166/2017/ND-CP.
Chapter III
STATE ADMINISTRATIVE GRADATION IN THE MANAGEMENT, USE, AND EXPLOITATION OF INFRASTRUCTURE ASSETS
Article 6. Management, use, and exploitation of aviation infrastructure assets
1. The Minister of Construction shall decide on the transfer of aviation infrastructure assets as provided in Point a, Clause 2, Article 5 of Decree No. 44/2018/ND-CP dated March 13, 2018 of the Government stipulating the management, use, and exploitation of aviation infrastructure assets (hereinafter referred to as Decree No. 44/2018/ND-CP).
The procedures for deciding on the transfer of aviation infrastructure assets shall be carried out in accordance with Clause 4, Article 5 of Decree No. 44/2018/ND-CP; there is no need to report to the Prime Minister for consideration and approval of the plan for transferring management of aviation infrastructure assets as provided in Point đ, Clause 4, Article 5 of Decree No. 44/2018/ND-CP.
2. The Minister of Construction shall decide on the approval of the Exploitation Plan of aviation infrastructure assets as provided in Point a, Clause 1, Article 11, Article 12, and Article 13 of Decree No. 44/2018/ND-CP.
The procedures for drafting and approving the Exploitation Plan of aviation infrastructure assets shall be carried out in accordance with Clause 4, Article 11, Clause 4, Article 12, and Clause 4, Article 13 of Decree No. 44/2018/ND-CP; there is no need to report to the Prime Minister for consideration and approval of the Exploitation Plan of aviation infrastructure assets as provided in Point d, Clause 4, Article 11, Point d, Clause 4, Article 12, and Point d, Clause 4, Article 13 of Decree No. 44/2018/ND-CP.
3. The Minister of Construction shall decide on the recovery, transfer, and sale of aviation infrastructure assets as provided in Point a, Clause 2, Article 17, Point a, Clause 2, Article 18, and Point a, Clause 2, Article 19 of Decree No. 44/2018/ND-CP.
The procedures for recovering, transferring, and selling aviation infrastructure assets shall be carried out in accordance with Clause 5, Article 17, Clause 4, Article 18, and Clause 5, Article 19 of Decree No. 44/2018/ND-CP; there is no need to report to the Prime Minister for consideration and decision on the recovery, transfer, and sale of aviation infrastructure assets as provided in Point b, Clause 5, Article 17, Point b, Clause 4, Article 18, and Point b, Clause 5, Article 19 of Decree No. 44/2018/ND-CP.
4. The Minister of Construction shall decide on the use of existing aviation infrastructure assets to participate in public-private partnership investment projects as provided in Point a, Clause 3, Article 22 of Decree No. 44/2018/ND-CP.
Article 7. Management, use, and exploitation of road traffic infrastructure assets
1. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall decide to transfer road traffic infrastructure assets within their management scope related to national defense and security as stipulated in Clause 1, Article 6 of Decree No. 44/2024/NĐ-CP dated April 24, 2024 of the Government on the management, use, and exploitation of road traffic infrastructure assets (hereinafter referred to as Decree No. 44/2024/NĐ-CP).
The procedures for deciding to transfer road traffic infrastructure assets shall be carried out in accordance with Article 7 of Decree No. 44/2024/NĐ-CP, without having to report to the Prime Minister for consideration and decision on the transfer of road traffic infrastructure assets as stipulated in Point c, Clause 3, Article 7 of Decree No. 44/2024/NĐ-CP.
2. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall approve the Exploitation Plan of road traffic infrastructure assets within their management scope related to national defense and security as stipulated in Point a, Clause 2, Article 13 of Decree No. 44/2024/NĐ-CP.
The procedures for approving the Exploitation Plan of road traffic infrastructure assets shall be carried out in accordance with Clause 3 and Clause 4, Article 13 of Decree No. 44/2024/NĐ-CP, without having to report to the Prime Minister for consideration and approval of the Exploitation Plan of road traffic infrastructure assets as stipulated in Clause 5, Article 13 of Decree No. 44/2024/NĐ-CP.
3. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall decide to recover road traffic infrastructure assets within their management scope related to national defense and security as stipulated in Point a, Clause 2, Article 21 and Point a, Clause 2, Article 26 of Decree No. 44/2024/NĐ-CP.
The procedures for deciding to recover road traffic infrastructure assets shall be carried out in accordance with Clause 4 and Clause 5, Article 21 of Decree No. 44/2024/NĐ-CP, without having to report to the Prime Minister for consideration and decision on the recovery of road traffic infrastructure assets as stipulated in Point b, Clause 4, Point a, Clause 5, Article 21 and Point a, Clause 2, Article 26 of Decree No. 44/2024/NĐ-CP.
4. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall decide to reallocate road traffic infrastructure assets within their management scope related to national defense and security as stipulated in Point a, Clause 2, Article 22 and Point a, Clause 3, Article 26 of Decree No. 44/2024/NĐ-CP.
The procedures for deciding to reallocate road traffic infrastructure assets shall be carried out in accordance with Clause 3, Article 22 of Decree No. 44/2024/NĐ-CP, without having to report to the Prime Minister for consideration and decision on the reallocation of road traffic infrastructure assets as stipulated in Point b, Clause 3, Article 22 and Point a, Clause 3, Article 26 of Decree No. 44/2024/NĐ-CP.
5. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall decide to transfer road traffic infrastructure assets within their management scope related to national defense and security to local management and handling as stipulated in Point a, Clause 2, Article 23 of Decree No. 44/2024/NĐ-CP.
The procedures for deciding to transfer road traffic infrastructure assets to local management and handling shall be carried out in accordance with Clause 4, Article 23 of Decree No. 44/2024/NĐ-CP, without having to report to the Prime Minister for consideration and decision on the transfer of road traffic infrastructure assets as stipulated in Point b, Clause 4, Article 23 of Decree No. 44/2024/NĐ-CP.
6. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall decide to use existing road traffic infrastructure assets within their management scope related to national defense and security to participate in public-private partnership investment projects as stipulated in Point a, Clause 2, Article 28 of Decree No. 44/2024/NĐ-CP.
The procedures for deciding to use existing road traffic infrastructure assets to participate in public-private partnership investment projects shall be carried out in accordance with Clause 3, Article 28 of Decree No. 44/2024/NĐ-CP, without having to report to the Prime Minister for consideration and decision on the use of existing road traffic infrastructure assets as stipulated in Point b, Clause 3, Article 28 of Decree No. 44/2024/NĐ-CP.
7. The Chairman of the People's Committee at the provincial level shall decide to reallocate road traffic infrastructure assets, materials, and supplies recovered from the liquidation of road traffic infrastructure assets within their management scope from localities to central ministries and agencies, or to other localities as stipulated in Point b, Clause 2, Article 22 and Point b, Clause 5, Article 24 of Decree No. 44/2024/NĐ-CP. The Chairman of the People's Committee at the provincial level shall also decide to reallocate road traffic infrastructure assets within their management scope from localities to central ministries and agencies, or to other localities which are the representative owners of enterprises as stipulated in Point a, Clause 3, Article 26 of Decree No. 44/2024/NĐ-CP.
The procedures for deciding to reallocate road traffic infrastructure assets, materials, and supplies recovered from the liquidation of road traffic infrastructure assets shall be carried out in accordance with Clause 3, Article 22 and Point b, Clause 5, Article 24 of Decree No. 44/2024/NĐ-CP, without having to report to the Minister of Finance for consideration and decision on the reallocation of road traffic infrastructure assets, materials, and supplies recovered from the liquidation of road traffic infrastructure assets as stipulated in Point b, Clause 3, Article 22, Point b2, Clause 5, Article 24, and Point a, Clause 3, Article 26 of Decree No. 44/2024/NĐ-CP.
Article 8. Management, use, and exploitation of infrastructure assets of marketplaces
The Chairman of the People's Committee of the province shall approve the project for leasing or transferring with a time limit the right to exploit infrastructure assets of marketplaces related to national defense and security as specified in point c, Clause 2, Article 24 and point b, Clause 2, Article 25 of Decree No. 60/2024/NĐ-CP dated June 5, 2024 of the Government on the development and management of marketplaces, without having to report to the Prime Minister for approval before approving it.
Article 9. Management, use, and exploitation of infrastructure assets of irrigation works
1. The Chairman of the People's Committee of the province shall decide on the transfer of infrastructure assets of irrigation works managed by asset management agencies within the local jurisdiction as specified in Clause 3, Article 1 of Decree No. 08/2025/NĐ-CP dated January 9, 2025 of the Government on the management, use, and exploitation of infrastructure assets of irrigation works (hereinafter referred to as Decree No. 08/2025/NĐ-CP).
2. The Chairman of the People's Committee of the province shall decide on the transfer of infrastructure assets of irrigation works as specified in point a, Clause 2, Article 22 of Decree No. 08/2025/NĐ-CP.
3. The procedures for deciding on the transfer of infrastructure assets of irrigation works as specified in Clauses 1 and 2 of this Article shall be carried out according to the provisions of Clauses 3 and 4, Article 22 of Decree No. 08/2025/NĐ-CP, without having to propose the Minister of Finance to consider and decide on the transfer as specified in point b, Clause 3, and point b, Clause 4, Article 22 of Decree No. 08/2025/NĐ-CP.
Article 10. Management, use, and exploitation of infrastructure assets of inland waterways
1. The Minister of Construction and the Chairman of the People's Committee of the province shall approve the project for exploiting infrastructure assets of inland waterways under their management that are related to national defense and security as specified in point a, Clause 3, Article 13 of Decree No. 12/2025/NĐ-CP dated January 20, 2025 of the Government on the management, use, and exploitation of infrastructure assets of inland waterways (hereinafter referred to as Decree No. 12/2025/NĐ-CP).
The procedures for approving the project for exploiting infrastructure assets of inland waterways related to national defense and security as specified in point a, Clause 3, Article 13 of Decree No. 12/2025/NĐ-CP shall be carried out according to the provisions of Article 13 of Decree No. 12/2025/NĐ-CP, without having to report to the Prime Minister as specified in point d, Clause 3, Article 13 of Decree No. 12/2025/NĐ-CP.
2. The Minister of Construction and the Chairman of the People's Committee of the province shall decide on the use of existing infrastructure assets of inland waterways under their management that are related to national defense and security to participate in investment projects under the public-private partnership model as specified in point a, Clause 2, Article 25 of Decree No. 12/2025/NĐ-CP.
The procedures for deciding on the use of existing infrastructure assets of inland waterways related to national defense and security to participate in investment projects under the public-private partnership model as specified in point a, Clause 2, Article 25 of Decree No. 12/2025/NĐ-CP shall be carried out according to the provisions of Clause 3, Article 25 of Decree No. 12/2025/NĐ-CP, without having to report to the Prime Minister as specified in point b, Clause 3, Article 25 of Decree No. 12/2025/NĐ-CP.
3. The Chairman of the People's Committee of the province shall decide on the transfer of infrastructure assets of inland waterways managed by asset management agencies within the local jurisdiction as specified in point a, Clause 2, Article 20 of Decree No. 12/2025/NĐ-CP.
The procedures for the transfer shall be carried out according to the provisions of Clause 3, Article 20 of Decree No. 12/2025/NĐ-CP, without having to propose the Minister of Finance to consider and decide on the transfer as specified in point b, Clause 3, Article 20 of Decree No. 12/2025/NĐ-CP.
4. The Chairman of the People's Committee of the province shall decide on the transfer of materials and supplies recovered from the liquidation of infrastructure assets of inland waterways managed by asset management agencies outside the province or centrally-administered city as specified in point a, Clause 7, Article 22 of Decree No. 12/2025/NĐ-CP.
The procedures for transferring materials and supplies recovered from the liquidation of infrastructure assets of inland waterways shall be carried out according to the provisions of Clause 7, Article 22 of Decree No. 12/2025/NĐ-CP, without having to propose the Minister of Finance as specified in point d, Clause 7, Article 22 of Decree No. 12/2025/NĐ-CP.
Article 11. Management, use, and exploitation of railway infrastructure assets
1. The Minister of Construction shall decide to transfer railway infrastructure assets from the form of asset transfer without state capital component at enterprises to the form of asset with state capital component at enterprises for assets under the management scope specified in Clause 1, Article 7 of Decree No. 15/2025/NĐ-CP dated February 3, 2025 of the Government on the management, use, and exploitation of railway infrastructure assets (hereinafter referred to as Decree No. 15/2025/NĐ-CP).
The procedures for deciding to transfer railway infrastructure assets from the form of asset transfer without state capital component at enterprises to the form of asset with state capital component at enterprises shall be carried out in accordance with the provisions of Clause 2, Article 7 of Decree No. 15/2025/NĐ-CP; there is no need to report to the Prime Minister for consideration and decision as stipulated in Clause 4, Article 7 of Decree No. 15/2025/NĐ-CP.
2. The Minister of Construction and the Chairman of the People's Committee of the province shall approve the exploitation of railway infrastructure assets related to national defense and security as specified in Point a, Clause 3, Article 16 and Point a, Clause 3, Article 33 of Decree No. 15/2025/NĐ-CP.
The procedures for establishing and approving the exploitation project of railway infrastructure assets related to national defense and security shall be carried out in accordance with the provisions of Point b, Clause 3, Article 16 and Point b, Clause 3, Article 33 of Decree No. 15/2025/NĐ-CP; there is no need to report to the Prime Minister for consideration and approval of the exploitation project as stipulated in Point c, Clause 3, Article 16 and Point c, Clause 3, Article 33 of Decree No. 15/2025/NĐ-CP.
3. The Minister of Construction and the Chairman of the People's Committee of the province shall decide to use existing railway infrastructure assets to participate in public-private partnership investment projects as specified in Point a, Clause 2, Article 28 and Point a, Clause 2, Article 44 of Decree No. 15/2025/NĐ-CP.
The procedures for deciding to use existing railway infrastructure assets to participate in public-private partnership investment projects shall be carried out in accordance with the provisions of Point a, Clause 3, Article 28 and Point a, Clause 3, Article 44 of Decree No. 15/2025/NĐ-CP; there is no need to report to the Prime Minister for consideration and decision as stipulated in Point b, Clause 3, Article 28 and Point b, Clause 3, Article 44 of Decree No. 15/2025/NĐ-CP.
4. The Chairman of the People's Committee of the province shall decide to reallocate railway infrastructure assets within the management scope as specified in Point a, Clause 2, Article 39 of Decree No. 15/2025/NĐ-CP.
The procedures for implementing the reallocation of railway infrastructure assets shall be carried out in accordance with the provisions of Point a, Clause 3, Article 39 of Decree No. 15/2025/NĐ-CP; there is no need to request the Minister of Finance to consider and decide on reallocation as stipulated in Point b, Clause 3, Article 39 of Decree No. 15/2025/NĐ-CP.
5. The Chairman of the People's Committee of the province shall decide to reallocate materials and supplies recovered from the liquidation of railway infrastructure assets within the management scope from localities to central ministries and agencies or other localities as specified in Point a, Clause 7, Article 41 of Decree No. 15/2025/NĐ-CP.
The procedures for deciding to reallocate materials and supplies recovered from the liquidation of railway infrastructure assets shall be carried out in accordance with the provisions of Point b, Clause 7, Article 41 of Decree No. 15/2025/NĐ-CP; there is no need to request the Minister of Finance to consider and decide on reallocation as stipulated in Point d, Clause 7, Article 41 of Decree No. 15/2025/NĐ-CP.
Article 12. Management, use, and exploitation of maritime infrastructure assets
1. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall approve the exploitation project of maritime infrastructure assets under their management as specified in point a, Clause 3, Article 13, and point a, Clause 5, Article 14 of Decree No. 84/2025/ND-CP dated April 4, 2025 of the Government on the management, use, and exploitation of maritime infrastructure assets (hereinafter referred to as Decree No. 84/2025/ND-CP).
The procedures for approving the exploitation project of maritime infrastructure assets shall be carried out in accordance with Clause 3, Article 13, and Clause 6, Article 14 of Decree No. 84/2025/ND-CP, without the need to report to the Prime Minister for consideration and approval of the exploitation project of maritime infrastructure assets as specified in point c, Clause 3, Article 13, and Clause 7, Article 14 of Decree No. 84/2025/ND-CP.
2. The Minister of Construction and the Chairman of the People's Committee at the provincial level shall decide to use existing maritime infrastructure assets under their management to participate in investment projects according to the public-private partnership method as specified in point a, Clause 2, Article 26 of Decree No. 84/2025/ND-CP.
The procedures for deciding to use existing maritime infrastructure assets to participate in investment projects according to the public-private partnership method shall be carried out in accordance with Clause 3, Article 26 of Decree No. 84/2025/ND-CP, without the need to report to the Prime Minister for consideration and decision on the use of existing maritime infrastructure assets as specified in point b, Clause 3, Article 26 of Decree No. 84/2025/ND-CP.
3. The Chairman of the People's Committee at the provincial level shall decide to transfer maritime infrastructure assets under their management as specified in point a, Clause 2, Article 20, and point a, Clause 3, Article 24 of Decree No. 84/2025/ND-CP.
The procedures for implementing the decision to transfer maritime infrastructure assets shall be carried out in accordance with Clause 3, Article 20 of Decree No. 84/2025/ND-CP, without the need to request the Minister of Finance to consider and decide on the transfer as specified in point b, Clause 3, Article 20, and Clause 3, Article 24 of Decree No. 84/2025/ND-CP.
4. The Chairman of the People's Committee at the provincial level shall decide to transfer materials and supplies recovered from the liquidation of maritime infrastructure assets under their management from localities to central ministries and agencies or to other localities as specified in point a, Clause 7, Article 22 of Decree No. 84/2025/ND-CP.
The procedures for deciding to transfer materials and supplies recovered from the liquidation of maritime infrastructure assets shall be carried out in accordance with Clause 7, Article 22 of Decree No. 84/2025/ND-CP, without the need to request the Minister of Finance to consider and decide on the transfer as specified in point d, Clause 7, Article 22 of Decree No. 84/2025/ND-CP.
Article 13. Management, use, and exploitation of clean water supply infrastructure assets
1. The Chairman of the People's Committee at the provincial level shall decide to transfer clean water supply infrastructure assets as specified in point b, Clause 3, Article 19 of Decree No. 43/2022/ND-CP dated June 24, 2022 of the Government on the management, use, and exploitation of clean water supply infrastructure assets (hereinafter referred to as Decree No. 43/2022/ND-CP).
2. The procedures for transferring clean water supply infrastructure assets shall be carried out in accordance with Clause 5, Article 19 of Decree No. 43/2022/ND-CP; there is no need to implement the procedure of requesting the Minister of Finance to consider and decide on the transfer of clean water supply infrastructure assets as specified in point e, Clause 5, Article 19 of Decree No. 43/2022/ND-CP.
Chapter IV
LEVELS OF STATE MANAGEMENT IN ESTABLISHING FULL NATIONAL OWNERSHIP RIGHTS OVER ASSETS AND HANDLING ASSETS WITH FULL NATIONAL OWNERSHIP RIGHTS ESTABLISHED
1. The Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling property that is evidence of administrative violations seized pursuant to Clause 1 of Article 10 of Decree No. 77/2025/NĐ-CP dated April 1, 2025 of the Government on the authority and procedures for establishing the right of全民所有的财产权 and handling property that has been established as全民所有的财产 (hereinafter referred to as Decree No. 77/2025/NĐ-CP) through transfer from localities to ministries or central agencies or between localities.
The procedures for establishing and approving plans for handling property that is evidence of administrative violations seized through transfer from localities to ministries or central agencies or between localities, when the agency managing state-owned assets formulates the implementation plan in accordance with Article 11 of Decree No. 77/2025/NĐ-CP, shall not be required to report to the Minister of Finance for examination and approval as provided for in Point b, Clause 4, and Clause 5 of Article 11 of Decree No. 77/2025/NĐ-CP.
2. The Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling property that is evidence of criminal cases, property of convicted persons seized pursuant to Clause 1 of Article 20 of Decree No. 77/2025/NĐ-CP through transfer from localities to ministries or central agencies or between localities.
The procedures for establishing and approving plans for handling property that is evidence of criminal cases, property of convicted persons seized and already subject to enforcement decisions by competent authorities in accordance with Article 21 of Decree No. 77/2025/NĐ-CP, shall not be required to report to the Minister of Finance for examination and approval as provided for in Point c, Point d of Clause 1, and Points d, đ of Clause 2 of Article 21 of Decree No. 77/2025/NĐ-CP.
3. The Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling unclaimed real estate, lost or abandoned property, and intestate estates pursuant to Clause 1 of Article 31 of Decree No. 77/2025/NĐ-CP through transfer from localities to ministries or central agencies or between localities.
The procedures for establishing and approving plans for handling unclaimed real estate, lost or abandoned property, and intestate estates shall be carried out in accordance with Article 32 of Decree No. 77/2025/NĐ-CP, and shall not be required to report to the Minister of Finance for examination and approval as provided for in Point b, Point c of Clause 1, and Points d, đ of Clause 2 of Article 32 of Decree No. 77/2025/NĐ-CP.
4. The Minister, Head of Central Agencies shall decide to approve the plan for handling property voluntarily transferred by the owner to the State of Vietnam through ministries or central agencies pursuant to Clause 1 of Article 47 of Decree No. 77/2025/NĐ-CP.
The procedures for establishing and approving plans for handling property voluntarily transferred by the owner to the State of Vietnam through ministries or central agencies, when the agency managing state-owned assets formulates the plan for handling the property in accordance with Article 48 of Decree No. 77/2025/NĐ-CP, shall not be required to report to the Prime Minister for examination and approval as provided for in Point b of Clause 4, and Clause 5 of Article 48 of Decree No. 77/2025/NĐ-CP.
5. The Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling (including plans for handling through transfer from localities to ministries or central agencies or between localities) property voluntarily transferred by the owner to the State of Vietnam through local authorities pursuant to Clause 1 and Clause 2 of Article 47 of Decree No. 77/2025/NĐ-CP.
The procedures for establishing and approving plans for handling property voluntarily transferred by the owner to the State of Vietnam through local authorities, when the agency managing state-owned assets formulates the plan for handling the property in accordance with Article 48 of Decree No. 77/2025/NĐ-CP, shall not be required to report to the Prime Minister, the Minister of Finance for examination and approval as provided for in Point b of Clause 4, and Clause 5 of Article 48 of Decree No. 77/2025/NĐ-CP.
6. The Minister, Head of Central Agencies shall decide to approve the plan for handling property transferred无偿地给越南国家的外商投资企业通过中央部委或机构在经营期限结束后根据协议的规定,按照第55条第1款的规定。
处理程序和批准无偿转让给越南国家的外商投资企业的财产,在经营期限结束后根据协议的规定,应按照第77/2025/NĐ-CP号议定书第56条和第57条的规定进行,无需按照第56条第4点、第5点和第57条第2点、第3点的规定向总理和财政部长报告审查和批准。
7. The Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling (including plans for handling through transfer from localities to ministries or central agencies or between localities) property transferred无偿地给越南国家的外商投资企业通过地方政府在经营期限结束后根据协议的规定,按照第55条第1款和第2款的规定。
处理程序和批准无偿转让给越南国家的外商投资企业的财产,在经营期限结束后根据协议的规定,应按照第77/2025/NĐ-CP号议定书第56条和第57条的规定进行,无需按照第56条第4点、第5点和第57条第2点、第3点的规定向总理和财政部长报告审查和批准。
8. The Minister and the Head of central agencies shall decide to approve the plan for handling assets invested under public-private partnership methods in cases where the agency signing the project contract is under central management as provided for in Clause 1 of Article 63 of Decree No. 77/2025/NĐ-CP.
The procedures for establishing and approving plans for handling assets invested under BOT and BLT contracts shall be carried out in accordance with the provisions of Articles 65 and 66 of Decree No. 77/2025/NĐ-CP, without having to report to the Prime Minister for consideration and approval as stipulated in Point b, Clause 4, Clause 5 of Article 65, Point b, Clauses 2 and 3 of Article 66 of Decree No. 77/2025/NĐ-CP.
9. The Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling (including the plan for transferring from localities to central ministries or agencies or between localities) assets invested under public-private partnership methods in cases where the agency signing the project contract is under local management as provided for in Clauses 1 and 2 of Article 63 of Decree No. 77/2025/NĐ-CP.
The procedures for establishing and approving plans for handling assets invested under BOT and BLT contracts shall be carried out in accordance with the provisions of Articles 65 and 66 of Decree No. 77/2025/NĐ-CP, without having to report to the Prime Minister and the Minister of Finance for consideration and approval as stipulated in Point b, Clause 4, Clause 5 of Article 65, Point b, Clauses 2 and 3 of Article 66 of Decree No. 77/2025/NĐ-CP.
10. The Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling (including the plan for transferring from localities to central ministries or agencies or between localities) assets that have been buried, hidden, covered up, or submerged and established as national property as provided for in Clauses 1 and 2 of Article 80 of Decree No. 77/2025/NĐ-CP.
The procedures for establishing and approving plans for handling assets that have been buried, hidden, covered up, or submerged and established as national property shall be carried out in accordance with the provisions of Article 81 of Decree No. 77/2025/NĐ-CP, without having to report to the Prime Minister and the Minister of Finance for consideration and approval as stipulated in Point b, Clauses 2 and 3 of Article 81 of Decree No. 77/2025/NĐ-CP.
11. The Minister of Finance shall decide to approve the plan for handling assets that are parts (specimens) of wild animals belonging to endangered, precious, or rare species as provided for in Clause 3 of Article 104 of Decree No. 77/2025/NĐ-CP.
The procedures for establishing and approving plans for handling assets that are parts (specimens) of wild animals belonging to endangered, precious, or rare species shall be carried out in accordance with the provisions of Clause 3 of Article 104 of Decree No. 77/2025/NĐ-CP, without having to report to the Prime Minister as stipulated in Clause 3 of Article 104 of Decree No. 77/2025/NĐ-CP.
12. The Minister and the Head of central agencies, and the Chairman of the People's Committee at the provincial level shall decide to approve the plan for handling assets that are parts (specimens) of wild animals belonging to endangered, precious, or rare species as provided for in Clause 4 of Article 104 of Decree No. 77/2025/NĐ-CP.
The procedures for establishing and approving plans for handling assets that are parts (specimens) of wild animals belonging to endangered, precious, or rare species shall be carried out in accordance with the provisions of Clause 4 of Article 104 of Decree No. 77/2025/NĐ-CP, without having to report to the Prime Minister and the Minister of Finance for consideration and approval as stipulated in Clauses 3 and 4 of Article 104 of Decree No. 77/2025/NĐ-CP.
Chapter V
IMPLEMENTING PROVISIONS
Article 15. Effective Date
1. This Decree takes effect from July 1, 2025 until February 28, 2027. In case of extending the application period of this Decree, central ministries and agencies shall report to the Government to propose the National Assembly for consideration and decision.
2. In cases where the provisions on authority, responsibility for state management, procedures, and processes in this Decree differ from those in related regulatory documents, they shall be implemented according to the provisions of this Decree, except for the provisions in Clause 3 of this Article.
3. Laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and resolutions of the Government, decisions of the Prime Minister that provide for authority, responsibility for state management, procedures, and processes specified in this Decree, if adopted or issued from July 1, 2025 and take effect before March 1, 2027, then the corresponding provisions in this Decree shall become invalid upon the entry into force of such regulatory documents.
Article 16. Transitional Provisions
1. Tasks being handled by the agency or person authorized to handle them and which have been partially completed but not yet finished before the effective date of this Decree shall transfer all files, documents, and results already achieved to the agency, organization, unit, or individual authorized to continue implementing and resolving them according to the authority specified in this Decree.
2. Documents and decisions issued by the agency or person authorized to handle them before the effective date of this Decree and which are still valid or within their validity period shall continue to be applied and used until their expiration date as stated in the documents and decisions.
3. Agencies and individuals authorized to handle functions and tasks of state management in areas under the Ministry of Finance’s jurisdiction shall have the following responsibilities:
a) Review the authorities assigned according to this Decree to adjust, supplement, and announce the Decision on the list of administrative procedures within their jurisdiction; ensure the continuity of administrative procedures after decentralization without interruption;
b) Take over all files, documents, steps taken, and results obtained by the agency or person authorized to handle them before the effective date of this Decree. They shall not require individuals or organizations to resubmit previously submitted files; they shall not repeat steps in administrative procedures already completed before decentralization.
Article 17. Implementation Provisions
Ministers, Heads of central agencies, Chairmen of provincial People's Committees, and Heads of relevant agencies, organizations, units, and enterprises shall be responsible for implementing this Decree.
