THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Considering the proposal of the Director of the Forest Project Management Board;

At the proposal of the Head of the Cadre and Civil Servant Organization Department.

DECISION:

Article 1. Now amending and supplementing certain Articles of the Regulation on the organization and implementation of the Forestry Area Project and management of upstream protective forests (ADB-1515.VIE(SP)), issued together with Decision No. 83/1999/QĐ-BNN-TCCB dated May 22, 1999 of the Minister of Agriculture and Rural Development, as follows:

1. Article 4,

a) Clause 2,

Amend the phrase "located at the Department of Agriculture and Rural Development"

to read "under the Department of Agriculture and Rural Development";

b) Clause 3,

Add at the end

"The project management board of the district shall be allowed to have its own seal for transactions.";

c) Clause 4,

Add at the end

"The project management board implementing the village sub-projects shall be established by the Chairman of the People's Committee of the district. When necessary, the project management board implementing the village sub-projects shall be allowed to have its own seal for transactions.";

2. Article 11,

a) Point a Clause 1,

- Amend the phrase "Costs for seminars, conferences, and training organized at the central level"

to read "Costs for seminars and conferences organized at the central level";

- Amend the phrase "Organizing bidding or contracting construction works and basic surveys with a scale covering the entire project area;"

to read "Organizing bidding or contracting surveys of resources with a scale covering the entire project area (ADB funding 90%, counterpart funding 10%)";

Add at the end of point a

- Annual audit service costs;"

b) Point b Clause 1,

- Amend the phrase "Organizing training, seminars, and training at the provincial, district, and commune levels;"

to read "Organizing seminars and conferences at the provincial, district, and commune levels;"

c) Clause 3,

- Amend the phrase "Administrative management costs and activities of the project management board"

to read "Administrative management costs and activities of the project management board (67% from counterpart funds, 33% from ADB support)";

- Amend the phrase "- Audit costs; ... feasibility studies of sub-projects"

to read "- Costs for resource surveys, resource investigations, land allocation for forestry, land use planning, and feasibility studies of sub-projects (90% from counterpart funds, 10% from ADB funding)."

3. Article 13,

a) Section * Delegation to the People's Committees of provinces,

- Remove point "3. Approval of the project management cost budget" (last item);

b) Section * Delegation to the Central Project Management Board,

- Remove the old point 1 and replace it with new point 1 as follows

"1. Inspecting and approving designs and budgets of components delegated to the province before submitting them to the People's Committee of the province for approval in accordance with the signed Agreement and national regulations on investment and construction management.";

- Add point 3:

"3. Inspecting completed components before final settlement of accounts.";

4. Amend the content of Article 18 to read

"The project will implement accounting through bookkeeping vouchers, uniformly applied from the Central Project Management Board to local Project Management Boards.

Article 2. The reporting forms according to the accounting voucher system for enterprises (issued pursuant to Decision No. 1141/TC/QĐ/CĐKT dated November 1, 1995 of the Ministry of Finance)."
