Regulations on the functions, tasks, powers, and organizational structure of the Ho Chi Minh National Academy of Politics and Public Administration

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Director of the Ho Chi Minh National Academy of Politics and Public Administration,

DECREE:

Article 1. Position and Functions

1. The Ho Chi Minh National Academy of Politics and Public Administration is a public service unit directly under the Central Committee of the Communist Party of Vietnam and the Government, subject to direct and continuous guidance from the Politburo, the Secretariat, and the Prime Minister.

The Ho Chi Minh National Academy of Politics and Public Administration performs the following functions: training and enhancing cadres and civil servants at intermediate and advanced levels for leadership and management positions, person LIMITATION within the leadership apparatus, THE HEAD OF THE MINISTRY’S OFFICE, THE HEAD OF THE MINISTRY’S INSPECTION DEPARTMENT, THE HEADS OF THE DEPARTMENTS, THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION, THE CHIEF EXECUTIVE OFFICER OF THE VIETNAM AIRPORTS CORPORATION - CPTP, AND THE HEADS OF THE AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS CONCERNED ARE RESPONSIBLE FOR IMPLEMENTING THIS CIRCULAR./. of public service units state-owned enterprises, members of boards of directors, general managers, deputy general managers, directors, and deputy directors enterprises of the state and other objects as prescribed by competent authorities, political and administrative cadres in the political system; researching scientific theories of Marxism-Leninism and Ho Chi Minh's thought, the Party's guidelines, state policies and laws, political sciences, and administrative sciences.

2. The Ho Chi Minh National Academy of Politics and Public Administration has the international trade name in English as: Ho Chi Minh National Academy of Politics and Public Administration (abbreviated as HCMA).

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Ho Chi Minh National Academy of Politics and Public Administration (hereinafter referred to as the Academy) shall perform the following tasks and powers:

1. Regardingtraining and enhancing cadres, civil servants, and officials:

a) Training cadres for leadership and management at intermediate and advanced levels on: Marxism-Leninism, Ho Chi Minh's thought; the Party's guidelines, state policies and laws; political leadership science and state administration;

b) Enhancing and updating new viewpoints, policies, and knowledge in the Party's guidelines, state policies and laws; new theoretical and practical issues domestically and internationally for cadres at intermediate and advanced levels;

c) Training advanced theoretical political and administrative cadres for civil servants, officials;

d) Training and enhancing officials from the level of principal specialist and above in the political system, political-social organizations, public service units, and enterprises; enhancing civil servants before appointing them to leadership and administrative management positions at various levels;

đ) Enhancing and updating knowledge for National Assembly deputies, People's Council representatives of provinces and centrally-administered cities;

e) Training and enhancing lecturers, researchers, and other subjects in theoretical political, administrative, state administration management, and some social and humanistic sciences;

g) Training and enhancing propaganda cadres and leaders of mass media agencies;

h) Training and enhancing specialized fields for cadres in the political system engaged in ideological work, organization, inspection, mass mobilization, religious affairs, office work, and state administrative management;

i) Training undergraduate and postgraduate programs in areas specified by authorized state agencies;

k) Managing and issuing various types of certificates and diplomas in the field of training and enhancement according to the regulations of the Party and the State.

2. Regarding scientific research:

a) Researching Marxist-Leninist theory, Ho Chi Minh's thought, the Party's viewpoints and guidelines; researching theoretical and experiential knowledge of some communist parties and ideological trends worldwide; researching political sciences, administrative sciences, state administration management, and some social and humanistic sciences; summarizing practical experiences and developing theoretical knowledge about socialism and the path towards socialism in Vietnam;

b) Researching and compiling the history of the Communist Party of Vietnam and the world revolutionary movement;

c) Researching, building, supplementing programs, contents, organizing the compilation and revision of textbooks and study materials for the Academy's training and enhancement programs;

3. Advising, proposing, and consulting the Party and the State on formulating guidelines, building policies, reforming the organizational structure and activities of the political system, and administrative reforms.

4. Directing and uniformly managing the implementation of training and enhancement programs, teaching methods, and scientific research of provincial and centrally-administered city political schools and cadre training and enhancement institutions of central ministries and sectors in the fields of political and administrative sciences.

5. Guiding the research, compilation, and participation in the review of party histories of localities, central ministries, departments, and mass organizations; materials on the life and revolutionary career of President Ho Chi Minh and Party and State leaders.

6. International cooperation in training and enhancing cadres, researching political and administrative sciences, and other fields.

7. Coordinating to organize examinations, assessments, inspections, and evaluations of civil servant qualifications according to civil servant grade and position standards for recruitment and appointment to civil servant grades and positions.

8. Managing the organizational structure, staffing, and cadres, civil servants, and officials; implementing systems, policies, training, enhancement, commendation, rewards, and disciplinary measures for cadres, civil servants, and officials of the Academy according to the regulations of the Party and the State.

9. Managing financial resources and assets assigned by the State; deciding and being responsible under the law for investment projects within its authority as prescribed by the State.

10. Resolving complaints and denunciations, preventing and combating corruption, wastefulness, and bureaucratic practices in subordinate units of the Academy according to the law.

11. Publishing and distributing journals, newsletters, scientific publications, and materials serving the Academy's training, enhancement of cadres, and scientific research according to the regulations of the Party and the State.

12. Performing other tasks power assigned by the Politburo, the Secretariat, the Government, and the Prime Minister.

In this Article, units specified from Clause 1 to Clause 8 are advisory units assisting the Director of the Academy, which shall establish offices; units specified from Clause 9 to Clause 29 are public service units.

The Director of the National Academy of Politics and Public Administration Ho Chi Minh City shall submit to the Prime Minister for issuance of decisions detailing the functions, tasks, powers, and organizational structure of the Academies specified from Clause 9 to Clause 14 of this Article.

The Director of the National Academy of Politics and Public Administration Ho Chi Minh City shall submit to the Politburo, the Secretariat, and the Prime Minister for decision on changes to the organizational structure of the Academy. The Director of the Academy decides on the establishment, merger, dissolution, and renaming of units subordinate to the Academy at the department level.

Article 4. Leadership of the Academy

1. The National Academy of Politics and Public Administration Ho Chi Minh City has a Director and three Deputy Directors. The Director of the Academy is the head and leader of the Academy, appointed by the Politburo and is responsible before the Politburo, the Secretariat, the Government, the Prime Minister, and the law for all activities of the Academy.

2. The Deputy Directors of the Academy are appointed by the Central Party Organization Committee upon the recommendation of the Academy Director and the Central Organization Committee, and are responsible to the Academy Director for the assigned tasks.

3. The Academy Director issues internal regulatory documents, individual documents, operational regulations of the Academy, organizational and operational regulations of subordinate units of the Academy; decides on appointment, dismissal, removal, rotation, commendation, disciplinary action, and other systems and policies according to the regulations of the Party and the law for the heads and deputies of heads of subordinate units of the Academy.

Article 5. Effectiveness and responsibility for implementation

1. This Decree takes effect fifteen days after its publication in the Official Gazette and replaces Decree No. 48/2006/NĐ-CP dated May 17, 2006 of the Government detailing the functions, tasks, powers, and organizational structure of the National Academy of Politics Ho Chi Minh City; Decision No. 234/2003/QĐ-TTg dated November 13, 2003 of the Prime Minister detailing the functions, tasks, powers, and organizational structure of the National Academy of Administration.

Article 2. Abolish previous provisions that conflict with this Decree.

3. The Director of the National Academy of Politics and Public Administration Ho Chi Minh City, Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree./.
