Decree No. 129/2018/ND-CP Abolishes Certain Legal Normative Documents in the National Defense Field

Abolishing certain legislative acts in the field of national defense

Pursuant to the Law on Legislative Documents dated June 22, 2015;

PURSUANT TO THE PROPOSAL OF THE MINISTER Ministry of Justice;

The Government issues this Decree certain legal normative documents issued by the Minister of Education and Training certain legislative acts in the field of national defense.

Article 1. Abolish certain legislative acts in the field of national defense, including:

1. Decision No. 191-CP dated June 23, 1980 of the Council of Ministers on forms of handling desertion by military personnel, evasion of military service by young people, and those who commit acts of sabotage and obstruction of the implementation of the conscription system.

2. Decision No. 163-HĐBT dated September 23, 1982 of the Council of Ministers on the term of active duty for non-commissioned officers and soldiers of the Vietnam People's Army belonging to ethnic minorities.

3. Decree No. 58-HĐBT dated June 1, 1989 of the Council of Ministers on the establishment of production and business organizations under the Ministry of National Defense.

4. Decree No. 54-CP dated August 7, 1995 of the Government on the issuance of the Service Regulations of Non-Commissioned Officers and Soldiers of the Vietnam People's Army.

5. Decree No. 17/2007/NĐ-CP dated February 1, 2007 of the Government amending and supplementing some articles of the Service Regulations of Non-Commissioned Officers and Soldiers in the Vietnam People's Army issued together with Decree No. 54/CP dated August 7, 1995 of the Government.

6. Decree No. 63/2002/NĐ-CP dated June 18, 2002 of the Government on medical examination and treatment for the relatives of serving officers.

7. Decree No. 18/2007/NĐ-CP dated February 1, 2007 of the Government on professional military personnel in the Vietnam People's Army.

8. Decree No. 38/2007/NĐ-CP dated March 15, 2007 of the Government on deferring and exempting from call-up for military service during peacetime for male citizens of conscription age.

9. Decree No. 114/2011/NĐ-CP dated December 13, 2011 of the Government on forms for administrative penalties by Border Guard and Coast Guard.

Article 2. Repealing part of legal normative documents

Abolish Article 12 of Decree No. 32/2013/NĐ-CP dated April 16, 2013 of the Government detailing and guiding the implementation of certain provisions of the Cryptographic Law regarding the regime and policies for cryptographic personnel.

Article 3. Implementation Provisions

1. This Decree takes effect from November 10, 2018.

2. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decree./.
