Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 11/2011/QĐ-TTg dated February 18, 2011 of the Prime Minister on policies encouraging the development of the rattan industry (hereinafter referred to as Decision No. 11/2011/QĐ-TTg);

The Ministers of Agriculture and Rural Development, Planning and Investment, and Finance issue this Joint Circular guiding certain contents for implementing Decision No. 11/2011/QĐ-TTg dated February 18, 2011 of the Prime Minister on policies encouraging the development of the rattan industry.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

This Circular guides certain contents encouraging the development of the rattan industry according to Decision No. 11/2011/QĐ-TTg of the Prime Minister.

This Circular applies to organizations, households, individuals, village communities within the country, overseas Vietnamese, foreign organizations and individuals implementing activities to develop the rattan industry according to Decision No. 11/2011/QĐ-TTg of the Prime Minister.

Article 2. Implementation Principles

1. Developing the rattan industry must be integrated with agricultural planning and rural development plans, forest protection and development plans, and consistent with local socio-economic development orientations.

2. Building long-term, medium-term, and annual plans to develop the rattan industry based on integrating targeted support programs and other ongoing programs and projects at the local level.

3. Ensuring transparency in the management and use of resources; promoting the role of the people and community as the main actors, implementing grassroots democracy during the planning process, organization of implementation, supervision, and evaluation.

Chapter II

BUILDING PLANS FOR DEVELOPING THE RATTAN INDUSTRY

Article 3. Provincial-level plans for developing the rattan industry (hereinafter collectively referred to as provincial level)

1. Authority and basis for plan formulation

a) The People's Committee of the province or centrally governed city shall assign the Department of Agriculture and Rural Development to take the lead and coordinate with relevant departments and agencies to formulate plans to implement policies encouraging the development of the rattan industry in the locality;

b) Basis for formulating plans: Socio-economic development orientation; forest protection and development plans; current status of planting, harvesting, processing, and consumption of products from rattan in the province; projected plan for developing rattan in the upcoming planning period.

2. Main contents of the plan

a) Summary of results in implementing the plan for planting, harvesting, processing, and consumption of products from rattan in the planning period (aggregated data from participating districts);

b) Evaluation of achievements, existing issues, and reasons for these issues in the work of planting, harvesting, processing, and consumption of products from rattan in the planning period;

c) Formulate plans for planting, harvesting, processing, and consumption of products from rattan in the planning period (aggregated data from participating districts);

d) Implementation measures: Regarding land zoning, allocation, and leasing for planting; scientific research and application of advanced technology; training and capacity building; market information; identification of sources of funding, including central and local government funds, enterprises, joint ventures, partnerships, and other legitimate sources of funding;

đ) Organization of implementation: Clearly define the responsibilities of organizations and individuals during the implementation of the plan.

3. Submission and approval

The Department of Agriculture and Rural Development submits the plan for developing the rattan industry to the People's Committee of the province for approval.

Article 4. County Bamboo and Rattan Industry Development Plan

1. Authority and basis for plan formulation

a) The People's Committee at the county level shall direct the establishment and implementation of the bamboo and rattan industry development plan;

b) Basis for building the plan: Based on the provincial bamboo and rattan development plan; the current status of planting, processing, and consumption of bamboo and rattan products within the area; anticipated bamboo and rattan development plan for the upcoming planning period.

2. Main contents of the plan

a) Situation of implementing the planting, protection (area), yield, harvesting, processing, and consumption of bamboo and rattan products within the area during the previous planning period (aggregated data from participating communes);

b) Building the planting, protection (area), yield, harvesting, processing, and consumption plan for bamboo and rattan within the area during the upcoming planning period (aggregated data from participating communes);

c) Implementation measures: Regarding land; construction of infrastructure; training and technical guidance; market consumption; sources of capital from the central government through the province, county, enterprises, joint ventures, associations, households, individuals, and other legitimate sources;

d) Organizing implementation: Clearly stating the responsibilities of organizations and individuals during the implementation of the plan.

3. Submission and Approval of the Plan

Based on the proposal of the state management agency for agriculture, the People's Committee at the county level shall approve and direct the organization to implement the bamboo and rattan industry development plan within the county.

Article 5. Commune Bamboo and Rattan Industry Development Plan

1. Authority and basis for plan formulation

a) The People's Committee at the commune level shall take the lead and coordinate with organizations and individuals interested in planting, harvesting, processing, and consuming bamboo and rattan to establish and implement the bamboo and rattan industry development plan within the commune;

b) Basis for building the plan: Based on the county bamboo and rattan development plan; the current status of planting, harvesting, processing, and consumption of bamboo and rattan during the planning period; anticipated bamboo and rattan development plan for the upcoming planning period.

2. Main contents of the plan

a) Evaluation of the situation of implementing the planting, protection (area), yield, harvesting, processing, and consumption of bamboo and rattan products within the commune during the previous planning period;

b) Building the planting, protection (area), yield, harvesting, processing, and consumption plan for bamboo and rattan within the commune during the upcoming planning period;

c) Implementation measures: Popularizing, promoting, and guiding planting, care, and protection techniques for bamboo and rattan; directing and coordinating with related organizations and individuals to plant, harvest, process, and consume bamboo and rattan; implementing the integration of allocated funds, enterprise funds, joint venture and association funds, household and individual funds, and other legitimate sources.

Chapter III

FINANCIAL MECHANISM

Article 6. Sources of Capital for Implementation

1. Sources of Capital for Implementation:

a) Budgetary funds, including: Implementing according to Decision No. 11/2011/QĐ-TTg of the Prime Minister on policies encouraging the development of the bamboo and rattan industry and related implementation guidelines;

b) Credit funds, including: State investment development credit funds; commercial credit funds;

c) Other sources of capital include: Contributions, support, and non-repayable aid from organizations, individuals, domestic and foreign enterprises; capital from domestic joint ventures and associations; funds raised from other legitimate sources.

2. The People's Committee at the provincial level shall proactively allocate the budget according to the division of authority to implement policies encouraging the development of the bamboo and rattan industry within the area; manage, use, and integrate various sources of capital to effectively implement the program.

Article 7. Guidance on the content and budget allocation

Cultivation, harvesting, processing, and consumption of rattan products based on implementing the provisions of decrees, decisions, circulars, and projects including from planning, design, project evaluation, support for agricultural extension services, industrial promotion, model construction, scientific and technological investment, vocational training, encouraging enterprises to invest in agriculture and rural areas, and promoting trade. (List of related documents in the attached Appendix to this Circular).

1. Regarding the development planning of the rattan industry

a) Rattan raw material area planning: Implemented according to Article 5, Article 6 Decision No. 11/2011/QĐ-TTg;

b) Rattan product processing facility planning: Implemented according to Article 8, Article 9, Article 10 Decision No. 11/2011/QĐ-TTg;

c) The establishment, evaluation, approval, and management of planning: Implemented according to the Government's Decree No. 92/2006/NĐ-CP dated September 7, 2006 on the establishment, approval, and management of overall socio-economic development planning; Decree No. 04/2008/NĐ-CP dated January 11, 2008 on amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP;

d) Provincial People's Committees organize the construction and approval of rattan raw material area planning and rattan product production facility planning. The cost of planning construction, evaluation, and implementation is funded from local budgets.

2. Regarding the development plan for the rattan industry

Development plan for the rattan industry: Implemented according to the forest protection and development plan for the period 2011-2020; Section III on mechanisms, policies, and laws of Decision No. 57/QĐ-TTg dated January 9, 2012 of the Prime Minister approving the forest protection and development plan for the period 2011-2020.

3. Regarding the establishment of investment projects for developing and processing rattan

a) The establishment, evaluation, and approval of rattan planting investment projects: Implemented according to Article 15 Decision No. 147/2007/QĐ-TTg dated September 10, 2007 of the Prime Minister on some policies for developing production forests for the period 2007-2015 (hereinafter referred to as Decision No. 147/2007/QĐ-TTg); Article 6, Article 7 Joint Circular No. 10/2013/TTLT-BNNPTNT-BKHĐT dated February 1, 2013 of the Ministry of Agriculture and Rural Development and the Ministry of Planning and Investment guiding the management and use of state budget investment funds to implement the forest protection and development plan for the period 2011-2020 according to Decision No. 57/QĐ-TTg dated January 9, 2012 of the Prime Minister.

In cases where both timber and rattan trees are planted, the investor may establish a single project. If a timber planting project has already been approved and is converted to planting rattan or supplemented with rattan planting, the investor reports to the Department of Agriculture and Rural Development to add to the existing project and adjust the investment rate accordingly;

b) For projects planting rattan along riverbanks, canal banks, stream banks, and lake shores for soil conservation and providing raw materials for processing, the Department of Agriculture and Rural Development establishes a joint project submitted to the provincial People's Committee for approval. Based on administrative boundaries, the provincial People's Committee assigns county-level authorities or forestry organizations to implement the investment under a contract system for households, individuals, and organizations to plant and benefit. The planting range along riverbanks, canal banks, stream banks, and lake shores should have a minimum density of 300 clumps per hectare. This support level is similar to that for protective forest planting according to Decision No. 60/2010/QĐ-TTg dated September 30, 2010 of the Prime Minister on principles, criteria, and funding allocation standards for state budget development investment for the period 2011-2015;

c) Support for costs of surveying, designing, evaluating projects, issuing sustainability certificates, transferring, and issuing land use rights certificates, and contracting land for household, individual, and community organization forest planting: Implemented according to point d clause 1 Article 1 Decision No. 66/2011/QĐ-TTg dated December 9, 2011 of the Prime Minister amending and supplementing certain articles of Decision No. 147/2007/QĐ-TTg (hereinafter referred to as Decision No. 66/2011/QĐ-TTg). These costs are calculated separately from the total investment support for planting rattan;

d) For wood processing plants that have already obtained investment certificates and now switch to processing rattan, they do not need to change their existing investment certificates but must report to the Department of Planning and Investment in writing before investing.

4. Regarding the determination and implementation of support levels for planting rattan

Details of the support items are implemented according to Clause 9 Section II Joint Circular No. 03/2012/TTLT-BKHĐT-BNNPTNT-BTC dated June 5, 2012 of the Ministry of Planning and Investment, the Ministry of Agriculture and Rural Development, and the Ministry of Finance guiding the implementation of Decision No. 147/2007/QĐ-TTg and Decision No. 66/2011/QĐ-TTg of the Prime Minister, and Joint Circular No. 04/2013/TTLT-BKHĐT-BNNPTNT-BTC dated August 19, 2013 amending and supplementing certain provisions of Joint Circular No. 03/2012/TTLT-BKHĐT-BNNPTNT-BTC. The support levels for each item are taken from annual budget allocations according to plans of localities.

5. Regarding the construction of demonstration models for developing rattan raw material areas and processing

a) For demonstration models supported from agricultural extension funds

Support for constructing demonstration models for planting rattan for organizations and households includes costs for purchasing seeds and essential materials: Implemented according to point b clause 2, point b clause 3 Article 5, Circular No. 15/2013/TT-BNNPTNT dated February 26, 2013 on implementing certain provisions of Government Decree No. 02/2010/NĐ-CP dated January 8, 2010 on Agricultural Extension;

b) For demonstration models supported from industrial promotion funds

For demonstration models supporting the construction of rattan product processing models for organizations: Implemented according to Article 4 clause 2 Circular No. 46/2012/TT-BCT dated December 28, 2012 of the Ministry of Industry and Trade detailing certain provisions of Government Decree No. 45/2012/NĐ-CP dated May 21, 2012 on Industrial Promotion;

c) For models demonstrating the development of raw material areas and rattan bamboo processing at the local level: Implement according to the provisions of Article 7 Clause 5 Points a and b of this Joint Circular. The content and level of support for building demonstration models at the local level shall be specifically regulated by the People's Committee of the province or centrally governed city in accordance with current regulations.

d) The financial resources allocated for building models at the central and local levels shall be implemented from the agricultural extension budget as stipulated in Articles 18, 19, and 20 of Decree No. 02/2010/NĐ-CP dated January 8, 2010 of the Government on Agricultural Extension; and from the small-scale industry promotion budget as stipulated in Articles 12, 13, and 14 of Decree No. 45/2012/NĐ-CP dated May 21, 2012 of the Government on Small-Scale Industry Promotion.

6. Regarding training, education, and vocational instruction

a) Short-term training for management staff, technical staff, and agricultural extension staff at all levels: Implement according to the provisions of Circular No. 139/2010/TT-BTC dated September 21, 2010 of the Ministry of Finance on the preparation of budgets, management, and utilization of state budget funds for staff training and capacity building.

b) Training for producers: The content and expenditure levels are prescribed in Joint Circular No. 183/2010/TTLT-BTC-BNN dated November 15, 2010 of the Ministry of Finance and the Ministry of Agriculture and Rural Development on guiding the management and use of annual state budget funds for economic public services to implement agricultural extension activities.

c) Vocational training for rural labor in developing raw material production areas for rattan bamboo products: Implement according to the provisions of Decision No. 1956/QĐ-TTg dated November 27, 2009 of the Prime Minister approving the "Vocational Training Program for Rural Labor until 2020"; and Joint Circular No. 30/2012/TTLT-BLDTBXH-BNV-BNNPTNT-BCT-BTTTT dated December 12, 2012 guiding the responsibilities for organizing the implementation of Decision No. 1956/QĐ-TTg dated November 27, 2009 of the Prime Minister approving the "Vocational Training Program for Rural Labor until 2020".

d) Financial resources for vocational training in rattan bamboo product processing shall be allocated from the vocational training resources for rural labor as stipulated in Clause 4 Section 6 of Decision No. 1956/QĐ-TTg dated November 27, 2009 of the Prime Minister.

7. Regarding encouraging enterprises to invest in planting, harvesting, and processing rattan bamboo

a) Organizations and individuals investing in planting and processing rattan bamboo shall enjoy investment incentives and support as provided for in Decree No. 61/2010/NĐ-CP dated June 4, 2010 of the Government on policies to encourage enterprises to invest in agriculture and rural areas.

b) The financial resources for implementing policies for enterprises investing in planting and processing rattan bamboo shall be balanced within the annual plan by the provincial People's Committee.

8. Regarding trade promotion for rattan bamboo products

a) To support trade promotion activities serving export and domestic consumption, implement according to Chapter II Articles 9, 10, 11, and 12 of the National Trade Promotion Program Regulation issued together with Decision No. 72/2011/QĐ-TTg dated November 15, 2010 of the Prime Minister.

b) The financial resources supporting trade promotion activities shall be implemented according to the annual trade promotion plans in each locality decided by the provincial People's Committee.

Article 8. Establishment, allocation, distribution, management and settlement of state budget funds

The establishment, allocation, distribution, management and settlement of state budget funds shall be carried out in accordance with the current laws.

Chapter IV

IMPLEMENTATION

Article 9. Responsibilities of Ministries

1. The Ministry of Agriculture and Rural Development:

a) Serve as the permanent agency to organize implementation, urge, inspect and supervise the implementation of this Circular throughout the country;

b) Take the lead and coordinate with relevant ministries and sectors to develop plans, aggregate financial requirements for the development of the rattan and bamboo industry nationwide, and submit them to the Ministry of Planning and Investment and the Ministry of Finance;

c) Annually aggregate and report to the Prime Minister on the implementation of policies encouraging the development of the rattan and bamboo industry.

2. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance and relevant ministries and sectors to develop plans, balance and allocate central government budget funds to implement this Circular.

Article 10. Responsibilities of the Provincial People's Committee

1. Direct the development of long-term, medium-term and short-term plans for the development of the rattan and bamboo industry in accordance with the planning and development plans for agriculture and rural areas, consistent with the socio-economic development orientation at the local level.

2. Conduct reviews, adjustments and supplements to the planning for the development of raw material regions for rattan and bamboo, and the planning for the development of rattan and bamboo production facilities; intensify land allocation, forest allocation, land leasing, and issuance of land use right certificates to organizations, households, and individuals involved in the development of raw material regions for rattan and bamboo.

3. Strengthen scientific research work, technology transfer, vocational training, pollution prevention and environmental treatment in handicraft villages producing rattan and bamboo; establish models for preserving, processing, and supporting the marketing of rattan and bamboo products.

Allocate local budgets according to the classification levels to implement policies encouraging the development of the rattan and bamboo industry within the administrative area; manage, use and integrate various sources of funds to implement programs and projects for the development of the rattan and bamboo industry.

6. Direct the Department of Agriculture and Rural Development to take the lead, develop specific plans to implement policies encouraging the development of the rattan and bamboo industry at the local level, submit these plans to the Provincial People's Committee for approval; direct and encourage economic entities to collaborate during the implementation process.

Article 11. Effective Date

7. Regularly inspect and supervise the implementation of policies encouraging the development of the rattan and bamboo industry, and report the results before December 15 each year to the Ministry of Agriculture and Rural Development for consolidation.

This Circular takes effect from June 16, 2014.
