Regulations on the Management of the Training and Capacity Building Program for Scientific and Technological Human Resources
within the country and abroad using state budget

Pursuant to Decree No.20/2013/NĐ-CPdated February 26, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Pursuant to Decree No.40/2014/ND-CPdated May 12, 2014, of the Government stipulating the use and promotion of individuals engaged in scientific and technological activities;
The Minister of Information and Communication issues this Circular to amend and supplement some articles of Circular No. 06/2022/TT-BTTTT dated June 30, 2022 of the Minister of Information and Communication guiding the implementation of the Communication and Information Poverty Reduction Project under the National Target Program on Sustainable Poverty Reduction for the period of 2021-2025.Decision No. 2395/QĐ-TTgdated December 25, 2015, of the Prime Minister approving the Training and Capacity Building Program for Scientific and Technological Human Resources within the country and abroad using the state budget;
The Minister of Science and Technology issues this Circular to regulate the management of the Training and Capacity Building Program for Scientific and Technological Human Resources within the country and abroad using the state budget.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular regulates the management of the Training and Capacity Building Program for Scientific and Technological Human Resources within the country and abroad using the state budget approved by Decision No. 2395/QĐ-TTg dated December 25, 2015, of the Prime Minister (hereinafter referred to as the Program 2395).
Article 2. The subjects to which this Circular applies are individuals engaged in scientific and technological activities, research groups, science and technology management officials from ministries, sectors, localities, organizations for science and technology, and enterprises; ministries, sectors, localities, and related organizations.
Article 3. Forms and Objectives of Training and Capacity Building
Clause 1. Training and Capacity Building for Experts: Sending experts in science and technology to training and capacity building through implementing research tasks or working for a limited time at research institutions, training institutions, or technology enterprises abroad with the aim of forming a team of experts in science and technology with deep professional knowledge, research skills, and the ability to address scientific and technological issues in their fields at regional and world levels, serving as a source for developing leading scientists and chief engineers.
Clause 2. Training and Capacity Building for Research Groups: Sending research groups to training and capacity building through implementing research tasks at research institutions, training institutions, or technology enterprises abroad to form strong research groups capable of addressing important scientific and technological tasks in their fields. Each group may consist of no more than five members proposed by the Group Leader.
Clause 3. Post-doctoral Training: Sending individuals with doctoral degrees engaged in scientific and technological activities to post-doctoral training through implementing research tasks at domestic and foreign research institutions and training institutions to develop and perfect research and implementation skills, serving as a source for forming experts in various fields of science and technology.
Clause 4. Training for Science and Technology Management Personnel: Sending science and technology management personnel to training courses both domestically and abroad to enhance knowledge and skills in managing science and technology and innovation.
Article 4. Duration of Training and Capacity Building
Clause 1. Duration of Training and Capacity Building for Experts: not exceeding two years.
Clause 2. Duration of Training and Capacity Building for Research Groups: not exceeding six months.
Clause 3. Duration of Post-doctoral Training: not exceeding two years.
Clause 4. Duration of Training for Science and Technology Management Personnel: not exceeding three months.
In special cases where the duration of training and capacity building needs to be extended, it shall be reviewed and decided by the Minister of Science and Technology, but not exceeding three months for the subjects specified in Clause 1 and Clause 3 of this Article, and not exceeding one month for the subjects specified in Clause 2 and Clause 4 of this Article.
Article 4. Fields and contents of training and capacity building
1. Training and capacity building for experts, research groups, and post-doctoral candidates in fields of science and technology, with a focus on priority technologies, new technologies, and high technologies as determined in the strategy and plan for the development of science and technology during each period.
2. Capacity building for management staff in scientific and technological management and innovation management, including professional knowledge, skills, and management capabilities in science and technology.
Article 5. Training and capacity building institutions
1. Overseas training and capacity building institutions are research institutes, universities, and enterprises in countries with advanced science and technology, reputable and experienced in the required fields, achieving advanced achievements in research and development, scientific management, and technology governance.
2. Domestic training and capacity building institutions are reputable and experienced entities with sufficient capacity, selected and assigned by the Ministry of Science and Technology to organize and implement training and capacity building tasks.
Article 6. Training and capacity building plans
1. Public science and technology organizations propose human resource training and capacity building needs according to the forms prescribed in Article 2 of this Circular, and submit them to their managing authorities, which are ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government, before April 30 each year for consolidation and plan formulation.
Ministries, ministerial-level agencies, government agencies, and provincial people's committees under the central government consolidate and propose human resource training and capacity building needs according to Model B1.1-ĐKNC in Appendix 1 of this Circular, and submit them to the Ministry of Science and Technology before April 30 each year for consolidation and plan formulation.
2. Non-public science and technology organizations and enterprises propose training and capacity building needs according to the provisions of Clause 1 of this Article, and submit them to the Ministry of Science and Technology before March 30 each year for consolidation and plan formulation.
3. The Ministry of Science and Technology bases its plan formulation on guidance, strategies, plans for the development of science and technology, human resource planning in each period; proposals from agencies and organizations specified in Clauses 1 and 2 of this Article, and the ability to meet the financial resources for science and technology activities. The Ministry consolidates, formulates, and issues the human resource training and capacity building plan of Project 2395 before June 20 each year for budgeting the next year's implementation costs. The training and capacity building plan for human resources in science and technology is publicly posted on the Ministry of Science and Technology's website at www.most.gov.vn.
Chapter II
CONDITIONS, CRITERIA, AND PROCEDURES FOR SELECTING INDIVIDUALS TO
TRAINING AND CAPACITY BUILDING FOR EXPERTS, RESEARCH GROUPS,
AND POST-DOCTORAL STUDIES
Article 7. Conditions for applying for training and capacity building for experts
Individuals engaged in science and technology who simultaneously meet the following conditions will be considered and sent for training and capacity building for experts:
1. They are included in the database of science and technology experts maintained by the Ministry of Science and Technology; if not included in this database, the decision is made by the Minister of Science and Technology.
2. They are part of the staffing establishment or have been working full-time continuously for at least 12 months at units specified in Clause 2 of Article 1 of this Circular.
3. They are not older than 55 years old for males and 50 years old for females at the time of submitting the application.
4. They have a proposed research outline to be implemented during the training and capacity building period (clearly stating the necessity, objectives, significance, content, implementation plan, expected results, and application methods), which has been approved by the overseas research and training institution.
5. They have proficient language skills meeting the requirements of the training and capacity building institution or have reached a language proficiency level equivalent to Level 4 (B2) as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language proficiency framework for Vietnam.
6. They have a plan for professional development, dissemination of knowledge, experience, and research to researchers at their unit after completing the training and capacity building course.
7. They have been officially agreed to be sent for training and capacity building in writing by their managing agency or unit.
Article 8. Conditions for group training and development recruitment
Research groups that simultaneously meet the following conditions shall be considered and sent for group training and development:
1. Currently conducting research at a research institute, university, laboratory, incubation facility, or enterprise; having a leading scientist serving as the Group Leader, directing and being responsible for the professional aspects.
2. The group or its members have scientific and technological achievements demonstrated through: articles published in reputable international scientific journals, monographs, protected inventions or useful solutions, registered and approved technology or technical solutions, or awards for science and technology.
Requirements for published scientific articles and published monographs are implemented according to the provisions of Article 2 and Article 3 of Circular No. 16/2009/TT-BGDĐT dated July 17, 2009, issued by the Ministry of Education and Training on detailed regulations for recognizing standards and appointing, dismissing professor and associate professor positions.
The List of reputable international scientific journals is determined according to the Decision approving the List of specialized scientific journals counted towards the converted scientific work points when recognizing the standards for professor and associate professor positions annually by the State Council for Professor Titles.
Science and technology awards are defined according to the provisions of Decree No. 78/2014/NĐ-CP dated July 30, 2014, issued by the Government on Ho Chi Minh Awards, State Awards, and other science and technology awards, and guiding documents.
3. Having a plan and direction for in-depth research with specific group objectives.
4. Having a research outline planned to be implemented during the training and development period (clearly stating the necessity, objectives, significance, research content, implementation plan, expected results, application methods) or currently implementing a scientific and technological task that cannot be carried out due to domestic conditions, accepted by foreign training and development institutions.
5. Each member's age in the group does not exceed 50 years old.
6. Proficient in foreign languages, meeting the requirements of the training and development institution or reaching a foreign language level equivalent to Level 4 (B2) as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam.
Article 9. Conditions for post-doctoral training recruitment
Individuals engaged in science and technology activities with a doctoral degree shall be considered and sent for post-doctoral training when they simultaneously meet the following conditions:
1. Working at a science and technology organization or enterprise; under 40 years old.
2. Having at least three consecutive years of research experience in the field of science and technology applied for training, calculated up to the time of submitting the application.
3. Being the main author of at least one article published in a reputable international scientific journal within five (5) years from the date of submitting the application.
The List of reputable international scientific journals is determined according to the provisions of Clause 2 of Article 8 of this Circular.
4. Having a research outline explanation planned to be implemented during the training and development period (clearly stating the necessity, objectives, significance, research content, implementation plan, expected results, application methods), accepted by the training and development institution.
5. Proficient in foreign languages, meeting the requirements of the training and development institution or reaching a foreign language level equivalent to Level 4 (B2) as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam.
Article 10. Principles and criteria for selecting individuals to undergo training and specialist development, research group training, and post-doctoral training
The selection of individuals to be sent for training and specialist development, research group training, and post-doctoral training shall be conducted based on competitive principles, according to the following criteria:
1. Professional qualifications and scientific and technological achievements.
2. Quality of the proposed research outline expected to be implemented during the period of training and development.
3. Priority shall be given to research outlines that are scientific and technological tasks under national science and technology programs and projects; special or particularly important scientific and technological tasks; urgent scientific and technological tasks affecting health, security, defense, or technology transfer and operation of new technologies at scientific and technological organizations, enterprises, healthcare institutions, security and defense organizations, state management agencies; scientific and technological tasks serving new research directions and other scientific and technological tasks not yet formed, not available, or lacking conditions for implementation domestically.
4. Priority shall be given to individuals supported with partial training and development funding from sources outside the state budget.
Article 11. Announcement of Selection
1. Annually, after approving the training and development plan, the Ministry of Science and Technology publicly announces the selection of personnel to be sent for training and development as specialists, research groups, and post-doctoral training. The selection process may be conducted multiple times within a year.
2. The announcement content includes: Content, form, training and development quotas; policies and benefits for trainees; eligible candidates; eligibility requirements; application forms and deadlines.
3. The selection announcement is sent to ministries, ministerial-level agencies, government agencies, provincial people's committees, centrally-administered cities, economic groups, state-owned corporations, and published publicly on the Ministry of Science and Technology’s website at www.most.gov.vn.
Article 12. Application Documents for Selection
Application documents for selection to undergo training and development sent to the Ministry of Science and Technology include one set of paper documents accompanied by a PDF file.
The application package includes:
1. A selection and recruitment registration form confirmed by the direct managing unit according to Model B1.2-ĐKCG; Model B1.3-ĐKNNC or Model B1.4.ĐKSTS in Appendix 1 of this Circular.
2. Scientific curriculum vitae in Vietnamese and English.
3. Proposed research outline expected to be implemented during the period of training and development in Vietnamese and English (clarifying Objectives, significance, necessity of the research outline, research content, implementation plan, anticipated results, application plans).
4. Acceptance document from the domestic or foreign training and development institution translated into Vietnamese.
5. Dispatch agreement for training and development from the sending agency or managing unit.
6. Copies of diplomas, certificates; documents proving compliance with conditions stipulated in Articles 7, 8, or 9 of this Circular.
7. Professional development orientation (for specialist training); detailed research plan and orientation (for research group training) in Vietnamese and English.
8. Commitment document to fulfill responsibilities and obligations of the trainee before and after completing the training and development program.
9. Confirmation of additional support from non-state budget sources (if applicable).
Article 13. Processing of Application Files and Approval of Successful Candidates List
1. Upon expiration of the application submission deadline (as announced), the Ministry of Science and Technology will compile a list of individuals applying for training and capacity building according to each form of training and capacity building; organize an evaluation of the application files through the Selection Committee.
2. The Minister of Science and Technology shall approve the list of successful candidates and notify the results to the successful candidates and the managing units of the successful candidates through one or a combination of the following methods:
a) Publishing information on the Ministry of Science and Technology's electronic website at: www.most.gov.vn:
b) Notifying via postal service;
c) Notifying via personal email of the applicant;
d) Other forms.
The result of being selected is valid for a period of twelve months from the date of signing the decision approving the selection.
Article 14. Selection Committee
1. The Selection Committee shall be established by the Minister of Science and Technology, consisting of five members:
a) Chairman of the Committee: Head of the Management Board of Project 2395;
b) Deputy Chairman of the Committee: Representative of the unit assigned by the Minister of Science and Technology as the permanent agency of Project 2395;
c) Secretary of the Committee: Representative of the unit assigned by the Minister of Science and Technology as the permanent agency of Project 2395;
d) Member of the Committee: Representative of the leadership of related units under the Ministry of Science and Technology. Depending on the requirements of each form and content of training and capacity building, committee members may include scientists and representatives of other agencies and units.
2. Tasks of the Selection Committee:
a) Review and evaluate application files according to each form of training and capacity building based on the conditions stipulated in Articles 7, 8, and 9 of this Circular;
b) Select applications that meet the conditions and criteria of each form of training and capacity building as prescribed and vote to assess each file according to Model B2.1-PDG in Appendix 2 of this Circular. If the number of applications exceeds the training and capacity building quota, then competitive selection will be conducted based on the criteria stipulated in Article 10 of this Circular.
3. Tasks of the Committee Secretary: record minutes of meetings, results of the Selection Committee's assessment of application files according to Model B2.2-KQHD in Appendix 2 of this Circular, send to the permanent agency of Project 2395, and perform other tasks arising during the selection process as required by the Chairman of the Selection Committee.
4. The Committee shall operate when at least four members are present, following the principle of collective decision-making and majority voting. In case of equal votes, the decision shall be made according to the side with the Chairman's vote.
5. Individuals whose parents, spouse, children, or full siblings have applied for training shall not participate in the Selection Committee.
6. The Board shall dissolve itself upon completion of its tasks.
Article 15. Contacting Training Institutions and Dispatching for Training and Capacity Building
1. Successful candidates shall contact and request formal acceptance documents for training and capacity building from the receiving institution. The Ministry of Science and Technology shall coordinate with relevant agencies to assist applicants in contacting training and capacity building institutions if necessary.
2. Successful candidates shall be issued a summons for training and capacity building by the Ministry of Science and Technology and dispatched for training and capacity building under Project 2395 upon receipt of dispatch documents from the managing agency or unit of the applicant.
Chapter III
TRAINING OF SCIENTIFIC AND TECHNOLOGICAL MANAGEMENT PERSONNEL
Article 16. Conditions for sending for training and upgrading
1. Domestic Upgrading
Scientific and technological management officials sent to participate in domestic upgrading courses must simultaneously meet the following conditions:
a) Having at least two consecutive years, up to the time of being sent for training and upgrading, working in scientific and technological management at ministries, sectors, localities, scientific and technological organizations, and enterprises, and always performing their tasks well;
b) Not during the period of considering or implementing disciplinary measures from reprimand upwards;
c) The position of work is suitable with the content of the upgrading course;
d) Having a dispatching document for upgrading issued by the managing agency;
đ) Still having at least two years of service time calculated from the start date of the upgrading course.
2. Overseas Upgrading
Scientific and technological management officials sent to participate in overseas upgrading courses must simultaneously meet the following conditions:
a) Holding a leadership position at the department level or higher, or being planned for the Deputy Director of the Department of Science and Technology, Deputy Director of the Department, or equivalent position or higher;
b) Still having at least three years of service time calculated from the start date of the upgrading course;
c) Not during the period of considering or implementing disciplinary measures from reprimand upwards;
d) Performing tasks well in the immediately preceding year;
đ) The position of work is suitable with the content of the upgrading course;
e) Having a dispatching document for upgrading issued by the managing agency.
Article 17. Organizing Upgrading Domestically
1. Based on the annual plan for training and upgrading scientific and technological human resources domestically and abroad, the Ministry of Science and Technology selects and decides to assign domestic training and upgrading institutions to organize and implement upgrading courses on knowledge and skills in scientific and technological management and innovation management for scientific and technological management officials.
2. Training and upgrading institutions assigned to organize and implement upgrading courses shall perform the following tasks:
a) Building the program/planning for organizing each upgrading course (including: target audience, objectives, program content, implementation methods, duration, location, topics for upgrading, lecturers, expected number of participants, etc.) and detailed budget estimate for implementation, to be submitted to the Ministry of Science and Technology for review and approval;
b) Organizing the compilation, review, and issuance of teaching materials for the upgrading course and bearing responsibility for the content of the materials;
c) Organizing the implementation of upgrading courses according to the approved plan (the minimum number of participants in one upgrading course is 30 people); managing the upgrading course; evaluating learning outcomes and issuing certificates to participants in accordance with current regulations;
d) Reporting on the results of the upgrading course and submitting the final financial report to the Ministry of Science and Technology within 20 days after the end of the upgrading course;
đ) Storing all files and vouchers for each upgrading course.
3. Institutions assigned to organize and implement upgrading courses may hire foreign experts to teach; they are entitled to enjoy policies according to current regulations.
Article 18. Organizing Upgrading Abroad
1. Based on the annual plan for upgrading scientific and technological human resources domestically and abroad, the Ministry of Science and Technology distributes quotas for upgrading scientific and technological management officials abroad to ministries, sectors, localities, and related organizations.
2. Ministries, sectors, localities, and related organizations decide to send officials who meet the conditions stipulated in Clause 2 of Article 16 of this Circular to the Ministry of Science and Technology.
3. The Ministry of Science and Technology compiles the list, decides to form an outbound upgrading delegation, including appointing one member as the Team Leader; signing training and upgrading contracts with foreign training and upgrading institutions.
Chapter IV
RIGHTS AND OBLIGATIONS OF PERSONS SENT FOR TRAINING AND UPGRADING

Article 19. Rights of persons sent for training and development
1. Enjoy benefits and policies as stipulated in Articles 21 and 22 of this Circular.
2. Be provided with conditions and time arrangements by the employing and managing unit to participate in training and development programs.
3. Be accepted back to the agency or unit and provided with conditions to apply the results of training and development to their professional work.
Article 20. Obligations of persons sent for training and development
1. Adhere to Vietnam's policies and laws, and those of the country sending them to study, as well as regulations of domestic and foreign training and development institutions.
2. Complete the registered training and development program, return to the workplace on schedule to apply the results of training and development to their professional work; continue performing their professional tasks at the unit that sent them for training and development for at least three times the duration of the training and development period.
3. Submit annual reports periodically (for training and development courses lasting over one year) according to Form B3.1-BCĐK and submit final reports upon completion of the course according to Form B3.2-BCKQ in Appendix 3 of this Circular, to be sent to the Ministry of Science and Technology and the managing unit.
Reporting deadline: Within fifteen days after the end of each year (twelve months) of training and development from the start date of the course (for annual periodic reports); within fifteen days after the end of the training and development course (for final reports upon completion of the course).
4. Must compensate for training and development costs according to current regulations on training and developing cadres, civil servants, and public officials if they voluntarily do not participate in the training and development course after completing all admission procedures and receiving funding for training and development; voluntarily withdraw from the course, leave their job, or resign during the training and development period; fail to comply with the provisions of Clause 2 of this Article; or violate discipline at the training and development institution leading to termination of the course.
5. The head of a research group sent abroad for training and development must manage and be responsible for all professional activities, research activities, and other activities of the group; represent the group to handle procedures related to the training and development course, transact with the training and development institution, and report to the Ministry of Science and Technology the results of the group's training and development.
6. The person designated as the head of a delegation sent abroad for management training must manage and be responsible for the activities of the delegation during the training period; act on behalf of the delegation to transact with the training and development institution and report to the Ministry of Science and Technology the results of the delegation's training.
Article 21. Benefits and Policies for Persons Sent for Training and Development Domestically
1. Persons sent for management training in science and technology domestically who work in state agencies or public scientific and technological organizations shall enjoy current benefits and policies for training and developing cadres, civil servants, and public officials in Vietnam.
Persons participating in management training in science and technology domestically who work in non-public organizations or enterprises shall be supported with tuition fees and other directly related course fees.
2. Persons sent for post-doctoral training domestically shall be supported with the contents prescribed in Point b Clause 1, Clause 3 Article 6 and Article 7 of Circular No. 09/2015/TT-BKHCN dated May 15, 2015 issued by the Minister of Science and Technology on the management of national scientific and technological capacity enhancement activities funded by the National Science and Technology Development Fund.
Article 22. Treatment and policies for persons sent abroad for training and development
1. Shall enjoy salary and other benefits as prescribed for civil servants, public officials, and employees sent for training and development if they are working at state agencies, public scientific and technological organizations.
2. Shall be reimbursed for training and development costs, research mission fees, and other related fees for mandatory training and development programs (if applicable) according to agreements with training and development institutions.
3. Shall be provided with living expenses to ensure research and study needs; round-trip economy class airfare, travel expenses, passport and visa fees, and health insurance.
4. Shall be supported with research funding for individuals sent for specialist training, research teams, and post-doctoral development, as follows:
a) Purchase of necessary materials, specialized books, and tools directly serving study and research needs;
b) Conducting supplementary research, testing, and experimentation activities for implementing research missions;
c) Publishing research results in reputable ISI journals, clearly indicating that the support for publication comes from Government Project 2395 of Vietnam;
d) Registration fees for intellectual property rights both domestically and internationally for inventions and plant varieties if these are the results of research under Project 2395 and have been protected by competent authorities. Intellectual property rights for inventions and plant varieties resulting from research under Project 2395 belong to Vietnamese organizations and individuals.
Chapter V
MANAGEMENT OF THE PROJECT
Article 23. Content of Project Management
1. Develop annual and phased training and development plans consistent with the objectives of Project 2395.
2. Organize announcements, selection, and implementation of sending individuals for training and development.
3. Monitor, inspect, and evaluate the training and development process of those sent for training and development.
4. Negotiate and sign training and development contracts with domestic and foreign training and development institutions.
5. Establish a database on scientific and technological personnel participating in Project 2395.
6. Organize information dissemination and promotion about Project 2395 through conferences, seminars, mid-term reviews, final evaluations, and other forms.
7. Handle risks during the implementation of Project 2395.
8. Other contents serving the management of Project 2395.
Article 24. Project Management Authority
1. The Ministry of Science and Technology is the main authority responsible for organizing and managing the implementation of Project 2395.
2. The Minister of Science and Technology decides to establish a Steering Committee for the Project consisting of seven members, with one Leader from the Ministry of Science and Technology as the Chairman.
The Steering Committee operates according to regulations issued by the Minister of Science and Technology.
3. The Minister of Science and Technology assigns a subordinate unit within the Ministry of Science and Technology to serve as the permanent office to assist in management and organization of Project 2395's implementation.
Specific tasks of the permanent office of Project 2395 are stipulated by the Minister of Science and Technology.
Article 25. Management of individuals sent for training and capacity building
1. The Ministry of Science and Technology shall coordinate with relevant agencies to manage individuals sent for training and capacity building.
2. Individuals who fail to comply with regulations during their training and capacity building period or violate the discipline of research and training institutions shall be handled according to the provisions of laws on training and capacity building for civil servants and public officials and must reimburse expenses according to current regulations.
The Ministry of Science and Technology shall coordinate with the units managing individuals sent for training and capacity building to handle violations according to current regulations.
Article 26. Management of funds for Project 2395
1. The funds for implementing Project 2395 include annual science and technology development funds and funds raised from other lawful sources.
2. Funds must be used for the intended purposes, ensuring efficiency according to the approved budget and the financial management regulations of Project 2395.
3. The detailed content of financial management for Project 2395 is specified in the Circular guiding the financial management for implementing Project 2395 issued by the Ministry of Finance.
Article 27. Risk Management
During training and capacity building abroad under Project 2395, if individuals sent for training and capacity building fall ill, suffer accidents, or encounter other force majeure situations, the Ministry of Science and Technology will coordinate with relevant agencies to resolve the issues.
Chapter VI
RESPONSIBILITIES OF THE MINISTRY OF SCIENCE AND TECHNOLOGY, MINISTRIES, SECTORS, LOCALITIES, AND RELATED ORGANIZATIONS
Article 28. Ministry of Science and Technology
1. To take the lead in organizing the implementation and management of Project 2395.
2. To guide ministries, sectors, localities, organizations, and individuals registered to participate in Project 2395.
3. To organize the review, selection, and decision to send individuals engaged in science and technology activities and research groups for training and capacity building within and outside the country according to Project 2395.
4. Negotiate and sign training and development contracts with domestic and foreign training and development institutions.
5. To implement policies for individuals sent for training and capacity building as stipulated in this Circular and the Circular on financial management of Project 2395.
6. To manage individuals sent for training and capacity building.
7. To organize interim and final evaluations to assess the results of Project 2395.
Article 29. Ministries, Sectors, People's Committees of Provinces
1. To propose human resource training and capacity building needs of their ministries, sectors, and localities to the Ministry of Science and Technology for consolidation and the development of a human resource training and capacity building plan for Project 2395.
2. To guide organizations and individuals under their management to register to participate in Project 2395. To send science and technology management cadres for training and capacity building according to the guidance of the Ministry of Science and Technology.
3. To coordinate with the Ministry of Science and Technology to manage individuals sent for training and capacity building.
Article 30. Related Organizations
State-owned economic groups, state-owned corporations, scientific and technological organizations, units registered for scientific and technological activities, enterprises, and other organizations shall propose human resource training and capacity building needs to the Ministry of Science and Technology for consideration and dispatch for training and capacity building under Project 2395.
Chapter VII
IMPLEMENTING PROVISIONS
Article 31. Application of Referenced Documents
In case the legal normative documents cited in this Circular are amended, supplemented, or replaced, apply the amended, supplemented, or replacing documents.
Article 32. Effectiveness
1. This Circular takes effect from September 1, 2016.
2. In the course of implementation, if there are difficulties, agencies, organizations, and individuals are requested to report to the Ministry of Science and Technology for examination and amendment to make it appropriate.
