JOINT CIRCULAR

Regulations on standards, conditions, forms, and contents of examinations for promotion to higher ranks in the profession of natural resources and environment specialists

Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitmentPursuant to the Government Decree No. 79/2017/NĐ-CP dated July 17, 2017 on the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

The Minister of Natural Resources and Environment and the Minister of Home Affairs hereby promulgate this Joint Circular stipulating standards, conditions, forms, and contents of examinations for promotion to higher ranks in the profession of natural resources and environment specialists,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Joint Circular stipulates standards, conditions, forms, and contents of examinations for promotion to higher ranks in the profession of natural resources and environment specialists.

2. This Joint Circular applies to natural resources and environment specialists participating in examinations for promotion to higher ranks in the profession of natural resources and environment specialists in public service units.

Article 2. Principles of examination for promotion

1. The organization of examinations for promotion to higher ranks shall be based on job positions, the structure of professional ranks, and the needs of public service units.

2. The organization of examinations for promotion to higher ranks must be equal, transparent, fair, objective, and in accordance with the law.

Article 3. Standards and Conditions for Registration to Participate in Examinations

A specialist may register to participate in examinations for promotion to higher ranks in the profession of natural resources and environment specialists if they meet the following standards and conditions:

1. Belonging to a public service unit with a need.

2. Currently holding a professional rank with the same first four digits in the professional rank code as the rank being applied for.

3. Meeting the standards of the professional rank being applied for according to regulations.

4. Having the ability to perform or currently working in a position suitable for the professional rank being applied for.

5. Being evaluated by the employing agency or unit as having sufficient moral character and professional ethics; completing tasks well for a continuous period of three years up to the time of the announcement of the examination application deadline by the competent authority; not during a disciplinary action period or having been notified about a disciplinary review process according to the law.

6. Being nominated to participate in the examination for promotion to higher ranks by the competent authority managing or using the specialist.

Chapter II

FORMS AND CONTENTS OF EXAMINATIONS FOR PROMOTION TO HIGHER RANKS

Article 4. Examination for Promotion from Rank III to Rank II

Clause 1. Common knowledge subject

a) Form of examination: essay;

b) Duration of examination: 180 minutes;

c) Content of examination: assessing knowledge and capacity of the specialist regarding strategic orientation, development plans, and understanding of specialized laws relevant to the standards of Rank II in the field of examination (60% of the examination content) and understanding of civil servant laws (40% of the examination content).

Clause 2. Professional subject

a) Form of examination: multiple choice or practical test decided by the Examination Board;

b) Duration of examination: 45 minutes for multiple choice or 30 minutes for practical test;

c) Content of examination: assessing and evaluating proficiency, capacity, and proposing solutions to current issues in practice related to the standards of proficiency and capacity in specialized fields at Rank II in the field of examination.

Clause 3. Foreign language subject

a) Form of examination: writing;

Sub-clause b) Duration of examination: 90 minutes.

Sub-clause c) Content of examination: Testing reading comprehension and writing skills at level 3 as prescribed by the standards of Rank II occupational titles.

4. Computer Science subject

Sub-clause a) Form of examination: Multiple choice or practical on computer.

Sub-clause b) Duration of examination: 45 minutes.

Sub-clause c) Content of examination: Testing knowledge of Windows operating system, using Microsoft Office applications, and using the Internet.

Article 5. Examination for promotion from Level IV to Level III professional title

Clause 1. Common knowledge subject

a) Form of examination: essay;

b) Duration of examination: 150 minutes;

c) Content of examination: assess knowledge and capacity of officials regarding strategic orientation, development plans, and understanding of specialized laws relevant to the standards of Level III professional title in the field of examination (60% of the examination content) and understanding of civil servant laws (40% of the examination content).

Clause 2. Professional subject

a) Form of examination: multiple choice or practical test decided by the Examination Board;

b) Duration of examination: 30 minutes of multiple-choice test or 15 minutes of practical exercise;

c) Content of examination: assess and evaluate proficiency and capacity, propose solutions to address current issues in practice in accordance with the standards of Level III professional title proficiency and capacity in the field of examination.

Clause 3. Foreign language subject

a) Form of examination: writing;

b) Duration of examination: 60 minutes;

c) Content of examination: assess skills in reading comprehension and writing at level 2 according to the standards of Level III professional title.

4. Computer Science subject

Sub-clause a) Form of examination: Multiple choice or practical on computer.

b) Duration of examination: 30 minutes;

Sub-clause c) Content of examination: Testing knowledge of Windows operating system, using Microsoft Office applications, and using the Internet.

Article 6. Conditions for exemption from foreign language and information technology subjects in the examination for promotion of professional titles

1. Exemption from the foreign language subject for civil servants who meet one of the following conditions:

a) Officials who are aged 55 years or older for males and 50 years or older for females as of the date of announcement of the application deadline for the examination by the competent authority;

b) Officials working in ethnic minority regions, holding certificates of ethnic minority language training issued by authorized educational institutions;

c) Ethnic minority officials working in ethnic minority regions;

d) Officials holding a second bachelor's degree in a foreign language;

đ) Officials holding a degree obtained through education at a higher level than the specified professional and vocational training standards for the examination for promotion, either studied abroad or studied in a foreign language in Vietnam.

2. Exemption from the information technology subject for civil servants who have graduated from a technical college in information technology or above.

Chapter III

IMPLEMENTATION

Article 7. Implementation Provisions

1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, centrally-administered city People's Committees, public service units have the responsibility to organize examinations for promotion of professional titles in the natural resources and environment sector in accordance with this Joint Circular. In cases where they do not have the conditions to organize separate examinations, they shall compile the demand, submit lists of officials meeting the criteria and conditions for promotion of professional titles in the natural resources and environment sector as stipulated in Article 3 of this Joint Circular to the Ministry of Natural Resources and Environment before March 31 each year for the Ministry of Natural Resources and Environment to coordinate with the Ministry of Home Affairs to organize joint examinations.

2. Officials who have been granted a Certificate of Economic and Technical Management Training for the Main Cadre Level in the Natural Resources and Environment Sector (Level II professional title) may continue to use this Certificate to participate in examinations for promotion of natural resources and environment professionals from Level III to Level II until December 31, 2016.

Article 8. Effective Date

1. This Joint Circular takes effect from September 1, 2016.

2. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, centrally-administered city People's Committees, public service units, and related organizations and individuals are responsible for implementing this Joint Circular.

During implementation, if there are any difficulties, please reflect them to the Ministry of Natural Resources and Environment for consolidation and coordination with the Ministry of Home Affairs to consider, amend, and supplement appropriately.
