Circular No. 13/2018/TT-BGDĐT amends and supplements Article 14 of the Regulation on the organization and operation of private kindergartens issued together with Circular No. 13/2015/TT-BGDĐT dated June 30, 2015 of the Minister of Education and Training.

CIRCULAR

Amending and supplementing Article 14 of the Regulation on the organization and operation of private kindergartens issued together with Circular No. 13/2015/TT-BGDĐT dated June 30, 2015 of the Minister of Education and Training

On the basis of The Education Law dated June 14, 2005; Law amending and supplementing certain articles of the Education Law dated November 25, 2009;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain articles of the Education Law; Decree No. 31/2011/NĐ-CP dated March 11 2018 2011 of the Government amending and supplementing certain articles of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain articles of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9 2013 of the Government regarding the amendment of point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated March 11 2018 2011 of the Government amending and supplementing certain articles of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain articles of the Education Law;

Pursuant to Decree No. 86/2018/NĐ-CP dated June 6, 2018 of the Government stipulating foreign cooperation and investment in the field of education;

Pursuant to Decision No. 14/2008/QĐ-BGDĐT dated April 7, 2008 of the Minister of Education and Training promulgating the Kindergarten Charter; amended and supplemented by Circulars: Circular No. 44/2010/TT-BGDĐT dated December 30, 2010, Circular No. 05/2011/TT-BGDĐT dated February 10, 2011 and Circular No. 09/2015/TT-BGDĐT dated May 14, 2015 of the Minister of Education and Training regarding the amendment and supplementation of certain articles of the Kindergarten Charter;

Based on the proposal of the Director of the Department of Preschool Education;

The Minister of Education and Training issues this Circular amending and supplementing Article 14 of the Regulation on the organization and operation of private kindergartens issued together with Circular No. 13/2015/TT-BGDĐT dated June 30, 2015 of the Minister of Education and Training.

Article 1. Amending and supplementing Article 14 of the Regulation on the organization and operation of private kindergartens issued together with Circular No. 13/2015/TT-BGDĐT dated June 30, 2015 of the Minister of Education and Training as follows:

"Article 14. Organizational structure and management of activities of independent private nursery groups and classes

1. Independent private nursery groups and classes are educational institutions within the national education system. The organizational structure includes: the head of the independent private nursery group or class; the head of the specialized team; teachers, staff, and the nursery groups and classes.

2. The head of the specialized team shall be appointed by the head of the independent private nursery group or class through a labor contract, ensuring the standards and performing the following tasks:

a) Having a diploma in early childhood education or higher; good health; meeting the regulations of the occupational standard and vocational qualification for kindergarten teachers;

b) Implementing the task of managing the care and education activities of children according to the Early Childhood Education Program, including: organizing the development and implementation of the child education plan; inspecting and supervising the implementation of nurturing, caring, and educating activities for children at the independent private nursery group or class;

c) In cases where the head of the independent private nursery group or class meets the requirements set out in point a Clause 2 of this Article, they may concurrently serve as the head of the specialized team.

3. The number of children in an independent private nursery group or class shall not exceed seventy (70) children.

Children in each nursery group or class shall be organized according to age and quantity as prescribed in the Kindergarten Charter.

4. Conditions for establishment, procedures for establishment, merger, division, dissolution, and cessation of operations of independent private nursery groups and classes shall be implemented in accordance with Articles 10, 11, 12, and 13 of Decree No. 46/2017/NĐ-CP dated April 21, 2017 of the Government stipulating conditions for investment and operation in the field of education.

5. In areas where the network of early childhood education facilities does not meet the demand for children's attendance at schools and classes, individuals may organize nursery groups to meet the needs of parents for nurturing and caring for children, and must register their activities with the People's Committee of the commune, ensuring the registration conditions as prescribed in Clause 6 of Article 10 of Decree No. 46/2017/NĐ-CP dated April 21, 2017 of the Government stipulating conditions for investment and operation in the field of education.

6. The People's Committee of the commune shall direct the organization to regularly and spot-check the activities of independent private nursery groups and classes and nursery groups as prescribed in Clause 5 of this Article; promptly identify and strictly handle any violations according to current regulations."

Article 2. This Circular takes effect from July 15, 2018.

Article 3. The Director of the Office, Heads of the Department of Early Childhood Education, Heads of relevant units under the Ministry of Education and Training, Chairmen of Provincial People's Committees, Directors of Departments of Education and Training are responsible for implementing this Circular./.
