AMENDING AND SUPPLEMENTING CERTAIN CONTENTS OF CIRCULAR NO. 03/2018/TT-BNNPTNT DATED FEBRUARY 9, 2018 ISSUED BY THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT ON THE ISSUE OF THE LIST OF PLANT PROTECTION CHEMICALS PERMITTED FOR USE AND PROHIBITED FROM USE IN VIETNAM.

Pursuant to the Law on Plant Protection and Quarantine dated November 25, in 2013;
At the proposal of the Director of the Plant Protection Department;
The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain contents of Circular No. 03/2018/TT-BNNPTNT dated February 9, 2018 issued by the Minister of Agriculture and Rural Development on the issuance of the List of plant protection chemicals permitted for use and prohibited from use in Vietnam.
Article 1. Amending and supplementing certain contents of Circular No. 03/2018/TT-BNNPTNT dated February 9, 2018 issued by the Minister of Agriculture and Rural Development on the issuance of the List of plant protection chemicals permitted for use and prohibited from use in Vietnam, including:
1. Amending the name of the organization requesting registration; the trade name, form, and concentration of the chemical (Annex I attached hereto), including:
a) Amending the name of the organization requesting registration: 63 active ingredients, 71 trade names;
b) Amending the trade name, form, and concentration: 9 active ingredients, 12 trade names.
2. Plant protection chemicals officially registered in the List of plant protection chemicals permitted for use in Vietnam (Annex II attached hereto), including:
a) Insecticides: 06 active ingredients, 08 trade names;
b) Fungicides: 07 active ingredients, 07 trade names;
c) Post-harvest pesticides: 01 active ingredient, 01 trade name.
3. Plant protection chemicals registered for supplementary inclusion in the List of plant protection chemicals permitted for use in Vietnam (Annex III attached hereto), including:
a) Insecticides: 121 active ingredients, 151 trade names;
b) Fungicides: 70 active ingredients, 87 trade names;
c) Herbicides: 13 active ingredients, 18 trade names;
d) Growth regulators: 03 active ingredients, 06 trade names;
e) Rodenticides: 01 active ingredient, 01 trade name;
f) Post-harvest pesticides: 01 active ingredient, 01 trade name.
4. The HS code table for plant protection chemicals shall be implemented in accordance with Circular No. 24/2017/TT-BNNPTNT dated November 15, 2017 on the HS code table for goods in the export and import sectors under the management of the Ministry of Agriculture and Rural Development.
Article 2. Effective Date
This Circular takes effect from November 22, 2018.
Article 3. Responsibility for Implementation
The Director of the Ministry's Office, the Director of the Plant Protection Department, the Heads of units under the Ministry, the Directors of Provincial Departments of Agriculture and Rural Development, the Directors of Departments of Agriculture and Rural Development of centrally governed cities, and relevant organizations and individuals are responsible for implementing this Circular.
