CIRCULAR
Guidance on Implementing the Base Salary for Personnel Receiving Salaries and Allowances in Party, State, Vietnam Fatherland Front, Political-Social Organizations, and Associations within Public Sector Units of the Party and State, Vietnam Fatherland Front, Political-Social Organizations, and Associations
Based on Decree No. 25/2025/NĐ-CP dated February 21, 2025 of the Government on the Functions, Powers, Tasks, and Organizational Structure of the Ministry of Home Affairs;
Based on Clause 1 of Article 7 of Decree No. 161/2026/NĐ-CP dated May 15, 2026 of the Government on Base Salary and Bonus System for Civil Servants, Public Officials, Staff Members, and Armed Forces;

Request from the Director of the Wage and Social Insurance Bureau,

The Minister of Home Affairs issues this Circular to guide the implementation of the base salary for personnel receiving salaries and allowances in Party, State, Vietnam Fatherland Front, political-social organizations, and associations within public sector units of the Party and State.

Article 1. Scope of Application

1. Civil servants receiving state budget salaries working in party organs, state organs, Vietnam Fatherland Front, affiliated political-social organizations under the Vietnam Fatherland Front, and social organizations performing tasks assigned by the state at the central level; provincial level; district level; or special economic administrative units.

2. Staff members receiving salaries from the unit's salary fund in accordance with legal provisions.

3. Civil servants, public officials, and staff members authorized to work in associations, non-governmental organizations, projects, and international agencies based in Vietnam while still receiving a salary according to the wage table attached to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on Wage System for Civil Servants, Public Officials, Staff Members, and Armed Forces as amended by Decrees Nos. 76/2009/NĐ-CP, 14/2012/NĐ-CP, 17/2013/NĐ-CP, 117/2016/NĐ-CP, and 7/2026/NĐ-CP.

4. Individuals working in positions with authorized staffing levels assigned by the Party or State to associations performing tasks supported by state funds as per Decree No. 126/2024/NĐ-CP dated October 8, 2024 of the Government on Organization, Operation, and Management of Associations.

5. Non-professional individuals working in communes or neighborhood associations as per provisions of the Government Decree on Commune and Neighborhood Association Organization, Operations, and Policies for Non-Professional Individuals.

6. Members of People's Councils at all levels receiving activity allowances according to current legal provisions.

7. Personnel working in critical organizations.

8. Individuals performing work under a labor contract within administrative agencies and public sector units as per Government Decree, where applicable or by agreement in the labor contract, applying the wage ranking system set forth in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on Wage System for Civil Servants, Public Officials, Staff Members, and Armed Forces.

9. The following individuals are subject to this Circular for calculating contributions and benefits under social insurance and resolving related salary issues as per legal provisions:

a) Civil servants, public officials, and staff members undergoing training, internships, work assignments, medical treatment, or convalescence (domestically or abroad) who are on the payroll of party organs, state organs, political-social organizations, public sector units, and associations receiving state funds for operations;

b) Individuals in a probationary period as per Article 24 of the Labor Code working in party organs, state organs, political-social organizations, public sector units, and associations receiving state funds for operations;

c) Civil servants, public officials, and staff members temporarily suspended from duty, under temporary detention, or provisional arrest.

b) Persons during the probation period as provided for in Article 24 of the Labor Code in agencies of the Party, State, political-social organizations, public institutions, and associations funded by state budget shall be included;

c) Civil servants, public officials, and staff currently suspended from duty, under temporary detention, or provisional arrest.

Article 2. Interpretation of Terms

2. The State policy towards associations assigned tasks by the Party and the State, and the policies and remuneration systems for personnel working in such associations are specified in Article 39 and Article 40 of Decree No. 126/2024/NĐ-CP dated October 8, 2024 by the Government on the organization, activities, and management of associations.

3. The agencies, units, organizations, and associations referred to in this Circular are collectively referred to as agencies or units hereinafter.

Article 3. Calculation of Remuneration, Allowances, and Activity Fees

1. For cadres, civil servants, public sector employees, and workers specified in Clauses 1, 2, 3, 4, 8, and 9 of Clause 1 of this Circular:

Based on the salary coefficient and allowances currently being enjoyed as stipulated in the documents of the Party's competent authorities concerning remuneration systems for cadres, civil servants, public sector employees, and military personnel, and the basic salary specified in Decree No. 161/2026/NĐ-CP dated May 15, 2026 by the Government on the basic salary and reward system for cadres, civil servants, public sector employees, and military personnel (hereinafter referred to as Decree No. 161/2026/NĐ-CP), calculate the salary, allowance, and amount of the differential retention coefficient (if applicable) as follows:

a) Formula for calculating the salary:

Effective from July 1, 2026

b) Formula for calculating the allowance:

- For allowances calculated based on the basic salary:

Effective from July 1, 2026

- For allowances calculated as a percentage of the current salary plus leadership position allowance and excess seniority allowance (if applicable):

- For allowances specified in specific amounts, retain according to the current regulations.

c) Formula for calculating the amount of the differential retention coefficient (if applicable):

Effective from July 1, 2026

2. For deputies of people's councils at all levels specified in Clause 6 of Clause 1 of this Circular:

Based on the activity fee coefficient for deputies of people's councils as stipulated by current laws to calculate the activity fee according to the following formula:

3. For those who work part-time in hamlets and residential communities specified in Clause 5 of Clause 1 of this Circular, the subsidy fund is allocated to each hamlet or residential community according to the regulations of the Government, calculated at a basic salary of 2,530,000 VND per month.

4. For those working in core organizations specified in Clause 7 of Clause 1 of this Circular:

a) Those working in core organizations under the management scope of the Ministry of National Defense and the Ministry of Public Security shall follow the guidelines issued by the Minister of National Defense and the Minister of Public Security;

b) Those working in core organizations within Party, State, political-social organizations (not under the management scope of the Ministry of National Defense and the Ministry of Public Security), calculate the salary, allowance, and amount of the differential retention coefficient (if applicable) according to the calculation method specified in Clause 1 of Article 3 of this Circular.

b) Persons working in critical organizations within agencies of the Party, State, and political-social organizations (not falling under the management scope of the Ministry of National Defense and the Ministry of Public Security) shall have their salary level, allowance level, and differential retention coefficient level (if applicable) calculated according to the method specified in Clause 1 of this Circular.

Article 4. Effective Date

This Circular shall take effect from July 1, 2022.

Paragraph 2. This Circular replaces Circular No. 07/2024/TT-BNV dated July 5, 2024 by the Minister of Justice guiding the implementation of the basic salary level for individuals receiving salaries and allowances in public sector agencies, organizations, and units of the Party, State, Vietnam Fatherland Front, political-social organizations, and associations.

Paragraph 3. The provisions concerning deductions and benefits shall be calculated according to the adjusted basic salary level from July 1, 2026.

Article 5. Implementation Responsibility

Clause 1. The head of the agency or unit directly managing individuals receiving salaries, allowances, and specified activity fees as provided in Paragraph 1 of this Circular shall, based on the number of such individuals as of July 1, 2026, calculate the salary, allowance, and differential retention coefficient (if applicable) and activity fee according to the guidance contained herein.

Clause 2. The determination of requirements, sources, and methods for implementing the basic salary level shall be carried out in accordance with Decree No. 161/2026/NĐ-CP as directed by the Minister of Finance.

In the course of implementation, if any difficulties arise, it is requested that ministries, agencies, and localities report to the Ministry of Justice for study and resolution./.
