Regulations on Energy Consumption Standards in the Plastic Manufacturing Industry

Circular No. 29/2024/TT-BCT dated December 25, 2024 by the Minister of Industry and Trade prescribing energy consumption standards for the plastic manufacturing industry, effective from April 1, 2025, amended and supplemented by:

Circular No. 12/2026/TT-BCT dated March 9, 2026 by the Minister of Industry and Trade abolishing certain regulatory documents within the authority of the Minister of Industry and Trade, effective from May 1, 2026.

Based on the Law on Energy Conservation and Efficiency dated June 17, 2010;

Based on Decree No. 96/2022/NĐ-CP dated November 29, 2022 by the Government prescribing functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on Decree No. 105/2024/NĐ-CP dated August 1, 2024 by the Government amending and supplementing certain provisions of Decree No. 96/2022/NĐ-CP dated November 29, 2022 by the Government prescribing functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade and Decree No. 26/2018/NĐ-CP dated February 28, 2018 by the Government on the Regulations Governing Organization and Operation of Vietnam Electricity Group;

In accordance with the request of the Director of the Energy Conservation and Sustainable Development Department;

The Minister of Industry and Trade promulgates this Circular prescribing energy consumption standards for the plastic manufacturing industry as follows^[1].

CHAPTER I.GENERAL PROVISIONS

Article 1. Scope of Application

This Circular prescribes methods for determining energy consumption, energy consumption quotas, and reporting systems in the plastic manufacturing industry.

Article 2. Applicability

1. Production facilities manufacturing plastic packaging products, construction plastics, household plastics, technical plastics with an annual electricity usage of 3,000,000 kWh or more.

2. Other relevant agencies, organizations, and individuals.

Article 3. Definitions

1. Energy consumption (SEC) is the total energy consumed to produce one unit of product volume.

2. Energy consumption quota refers to the energy consumption level applicable to specific types of products as prescribed in this Circular.

3. Plastic bag: a nylon bag produced by blow molding technology.

4. Plastic bottle: bottles made from PET (Polyethylene Terephthalate) through blow molding technology, and other plastic bottles through extrusion-blow molding technology.

5. Packaging plastic: products such as PE (Polyethylene) shrink wrap, food packaging films, protective films, air bubble films, multi-layered packaging, household adhesive tapes, plastic sheets.

6. Construction plastics: pipes used in construction produced through extrusion molding using PVC (Polyvinyl Chloride), HDPE (High Density Polyethylene), and PPR (Random Copolymer of Polypropylene).

7. Household plastics: household products made through injection molding such as kitchenware, bathroom accessories, cleaning tools, storage containers, plastic baskets, plastic toys, child seats, chairs, tables, plant pots, watering cans.

8. Technical plastics: technical products made through injection molding, excluding technical plastic components in electrical and electronic equipment.

Chapter II.METHODS FOR DETERMINING AND SETTING ENERGY USAGE QUOTAS IN THE PLASTICS INDUSTRY AND REPORTING PROCEDURES

Article 4. Method for Determining Energy Usage Quotas

The energy usage quota in the plastics manufacturing industry is determined according to the method prescribed in Appendix I of this Circular.

Article 5. Setting Energy Usage Quotas

Energy usage quotas apply to production facilities manufacturing plastic products, specifically:

Within twenty working days from the date of receipt of the report from the production facility manufacturing plastic products, the Department of Commerce shall provide comments and request additional information (if any).

Within five working days from the date of receiving the request for additional information from the Department of Commerce, the production facilities manufacturing plastic products shall be responsible for revising and supplementing the information as requested.

2. By March 31st each year, the Department of Commerce shall report on the implementation of energy usage quotas to the Ministry of Industry and Trade (Department of Energy Conservation and Sustainable Development) in writing by direct delivery or through postal services or via the electronic information platform https://dataenergy.vn according to the form prescribed in Appendix II attached to this Circular.

Chapter III

. ORGANIZATION OF IMPLEMENTATION

Article 7. Responsibilities of the Department of Energy Conservation and Sustainable Development^[2]1. To take the lead, coordinate with relevant agencies to disseminate, promote, and guide organizations and individuals concerned in implementing the provisions of this Circular.

2. To cooperate with local Departments of Commerce to inspect the implementation of energy usage quotas for plastic production facilities within the scope regulated by this Circular.

3. To compile and statistically process data on energy consumption in the plastics manufacturing industry from reports submitted by localities.

Article 8. Responsibilities of the Department of Commerce

1. Annually, to take the lead in guiding, urging, reminding, developing inspection plans, conducting inspections for compliance with the energy usage quota regulations for production facilities within the scope of application at the local level and handling cases of violations according to legal provisions.

2. To cooperate with the Department of Energy Conservation and Sustainable Development in guiding, urging, inspecting the implementation of energy usage quotas as per the contents of this Circular.

3. To implement reporting systems as prescribed in

Article 9. Responsibilities of Plastic Manufacturing Establishments

1. Managing and supervising the production process to determine the amount of energy consumed.

Article 10. Enforceability

1. This Circular shall come into force on April 1, 2025 and replace Circular No. 38/2016/TT-BCT dated December 28, 2016 of the Ministry of Industry and Trade concerning energy consumption standards in the plastic industry.

2. In the course of implementation, if there are any issues or difficulties, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Industry and Trade for study, revision, and supplementation of this Circular./.

APPENDIX I. METHOD FOR DETERMINING ENERGY USAGE IN PLASTIC MANUFACTURING ESTABLISHMENTS

1. Scope of Measurement and Calculation

The measurement and calculation of energy consumption shall be conducted for production lines producing plastic products and the energy used by auxiliary systems supporting the production process (excluding other areas such as administrative or production areas of different products). 2. Time Period for Measurement and Calculation:

For a period of one year from January 1 to December 31.

* For PET bottle manufacturing from PET pellets, Psx_i is determined according to formula (3), as follows:

Ppt_i is calculated and determined as follows:

- Where energy consumption by auxiliary systems can be separated for each product group through a metering system, the energy consumption of auxiliary systems producing product group i is determined from the corresponding metering system., - Where energy consumption by auxiliary systems cannot be separated for each product group through a metering system, the energy consumption of auxiliary systems producing product group i is determined on the basis of the production volume ratio of product group
