Detailed Implementation Regulations for the Mobilization of Industry Law

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Mobilization of Industry Ordinance dated February 25, 2003;
At the proposal of the Minister of National Defense,
DECREE:
PART I
GENERAL PROVISIONS
Article 1
1. Industrial enterprises subject to this Decree include those operating in the fields of machinery, metallurgy, chemicals, and electronics.
2. The mobilization of industry does not apply to industrial enterprises with foreign investment including:
a) Joint ventures, joint stock companies (enterprises established in Vietnam by one or more Vietnamese parties and one or more foreign parties);
b) Enterprises with 100% foreign capital.
Article 2
1. The mobilization of industry must be carried out based on the existing production and repair capabilities of industrial enterprises. The State will only invest additional specialized equipment to complete production and repair lines for military equipment.
2. The selection and assignment of tasks for the mobilization of industry to industrial enterprises must ensure synchronization according to the production and repair needs of the military and be consistent with the production and repair capabilities of the enterprises.
3. The payment price for products from the mobilization of industry shall be calculated accurately based on the national standards and price ranges at the time of payment, ensuring the legitimate interests of the enterprises and workers.
Article 3
1. The Ministry of National Defense is the representative of state ownership for equipment provided by the State to industrial enterprises to complete production and repair lines. Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations established by the Prime Minister's decision (hereinafter referred to as State-owned corporations) shall cooperate with the Ministry of National Defense to manage the quantity and quality of equipment provided to industrial enterprises under their jurisdiction.
2. Industrial enterprises receiving equipment from the State shall have the responsibility to:
a) Maintain accurate records and promptly and truthfully reflect the usage and changes in the provided equipment;
b) Develop management regulations for the use of the provided equipment;
c) Conduct regular and annual inventory checks to determine the accurate quantity and quality of the provided equipment, and report the results to the Ministry of National Defense and higher supervisory authorities.
Article 4
1. When there is a need to utilize the provided equipment outside the mobilization plan to complete production and repair lines, the industrial enterprise must report to its direct superior authority and submit a written request to the Minister of National Defense. Within fifteen (15) working days from receipt of the enterprise's request, the Minister of National Defense must provide a written response.
2. Upon permission to utilize the equipment outside the mobilization plan, the industrial enterprise may only use it within the permitted period and must depreciate the fixed assets according to the prescribed regime. The depreciation amount of the State-invested assets must be used for reinvestment to serve maintenance and repair of the equipment, ensuring technical performance and readiness for production and repair tasks.
Article 5
1. During the process of producing and repairing military equipment, industrial enterprises are responsible for strictly managing the quantity of products produced.
2. It is strictly prohibited for industrial enterprises to use mobilized products for business purposes, gifts, loans, pledges, or sales.
3. The disposal of surplus and defective products during the production and repair process at industrial enterprises shall be carried out in accordance with the regulations of the Ministry of National Defense.
Chapter II
PREPARATION FOR THE MOBILIZATION OF INDUSTRY
Article 6. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of National Defense, the Ministry of Finance, and the Ministry of Industry and Construction to develop a comprehensive survey program for all industrial enterprises nationwide subject to the Mobilization of Industry Ordinance, to be submitted to the Prime Minister for decision.
Article 7. Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations shall organize surveys of the production and repair capacities of subordinate industrial enterprises and report the results to the Prime Minister (through the Ministry of National Defense). The Ministry of National Defense shall compile the survey results and select industrial enterprises meeting the conditions for mobilization of industry to be submitted to the Prime Minister for decision.
Article 8
Within thirty (30) days from the date the Prime Minister issues a decision assigning mobilization tasks to industrial enterprises, the Ministry of National Defense shall be responsible for transferring to the enterprises all technical documents required for the production and repair of military equipment.
Industrial enterprises shall be responsible for accepting the transferred technical documents within the specified timeframe and implementing the management, use, and confidentiality regimes as prescribed. Based on the transferred technical documents, enterprises shall study and apply them appropriately to their technological conditions to produce and repair equipment effectively.
Article 9
1. Based on the Prime Minister's decision regarding mobilization tasks, the Ministry of National Defense shall coordinate with ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations to guide industrial enterprises in developing investment projects to enhance production and repair capacity lines in accordance with current investment and construction management regulations.
2. The Ministry of National Defense shall be responsible for reviewing investment projects to enhance production and repair capacity lines of industrial enterprises and decide on investment after obtaining approval from the Prime Minister.
Article 10
1. Annually, the Ministry of National Defense shall develop a production and repair plan for equipment to maintain the capacity of production lines at industrial enterprises to be submitted to the Prime Minister for decision. The production and repair of equipment to maintain the capacity of production lines at industrial enterprises shall be carried out on a regular basis but not more than four (4) years once, depending on the characteristics of the production lines and the ability to ensure state budget funds.
2. Industrial enterprises shall have the responsibility to deliver all products to the Ministry of National Defense according to the implementation plan for production and repair of equipment to maintain the capacity of production lines. The delivery and receipt of products shall be carried out in accordance with the regulations of the Ministry of National Defense.
Article 11
1. Within twenty (20) working days from the date of the decision on merger, division, dissolution, or transfer of ownership to a subject not within the scope of regulation of the Mobilization of Industry Ordinance or upon request for declaration of bankruptcy, if the enterprise has completed technological renewal and no longer has the capability to fulfill mobilization tasks, the legitimate representative of the industrial enterprise must report in writing to the agency that established the enterprise and the Ministry of National Defense.
2. Within fifteen (15) working days from the date of receiving the report from the enterprise, the head of the agency that established the enterprise must report to the direct superior agency and report to the Ministry of National Defense to compile a report to the Prime Minister, while establishing a council to inventory and evaluate the current status of transferred technical documents and the condition and value of equipment provided by the State to the enterprise.
3. The Ministry of National Defense shall compile reports from Ministries, agencies equivalent to Ministries, provincial People's Committees, and General Corporations to submit to the Prime Minister for decision regarding industrial enterprises that no longer have the capability for industrial mobilization. The Minister of National Defense shall decide to reclaim management or transfer all transferred technical documents and equipment provided by the State to another industrial enterprise. The procedures and formalities for reclaiming transferred technical documents and equipment provided by the State shall be implemented in accordance with the guidelines of the Ministry of National Defense.
4. When no longer having the capability for industrial mobilization, industrial enterprises shall have the responsibility to hand over all transferred technical documents and equipment provided by the State according to the reclamation decision of the Minister of National Defense; if there is any loss, the enterprise must compensate for the losses before handing over, the determination of compensation for losses shall be carried out in accordance with the guidelines of the Ministry of National Defense and the Ministry of Finance.
Article 12
1. Reserve materials for serving industrial mobilization must be synchronized, of high quality, in appropriate quantities, supplied promptly and accurately.
2. The Ministry of National Defense shall be responsible for reserving specialized defense materials, and the Ministry of Finance shall be responsible for reserving general-purpose materials according to the decision of the Prime Minister.
Article 13. The Minister of National Defense and the Minister of Finance shall draft and submit to the Prime Minister for approval the planning and reserve material supply plans for industrial mobilization. When there is a need to supplement or modify the list of reserve materials according to the assigned responsibilities, the Ministry of National Defense and the Ministry of Finance shall prepare a report to submit to the Prime Minister for decision.
Article 14. The management of reserve materials for serving industrial mobilization shall be carried out in accordance with the laws on managing national reserve goods.
Chapter III
IMPLEMENTATION OF INDUSTRIAL MOBILIZATION
Article 15
1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Planning and Investment to develop the number of industrial enterprises and mobilization targets for Ministries, agencies equivalent to Ministries, provincial People's Committees, and General Corporations when implementing industrial mobilization to be submitted to the Prime Minister for decision.
2. Mobilization decisions must be announced within the correct time frame, accurately, secretly, and safely. The announcement shall be conducted simultaneously through the administrative system from central to local levels.
3. Responsibilities for announcing mobilization decisions:
a) The Government Office shall be responsible for announcing the Prime Minister's decision on the number of industrial enterprises and mobilization targets for Ministries, agencies equivalent to Ministries, provincial People's Committees, and General Corporations;
b) Based on the Prime Minister's decision, the Ministry of National Defense shall be responsible for announcing the Minister of National Defense's decision on the list of industrial enterprises and mobilization targets for each enterprise to Ministries, agencies equivalent to Ministries, provincial People's Committees, General Corporations, and military units under its authority;
c) Based on the Prime Minister's decision and the Minister of National Defense's decision, Ministries, agencies equivalent to Ministries, provincial People's Committees, and General Corporations shall be responsible for announcing the decision to assign production and repair equipment tasks by the Minister, head of the agency equivalent to a Ministry, Chairman of the provincial People's Committee, and the head of the General Corporation to industrial enterprises under their authority.
4. The deadline for completing announcements at each level from receiving the mobilization decision to completing the announcement shall not exceed sixty (60) minutes.
Article 16
1. Provincial People's Committees shall be responsible for ensuring relocation sites for industrial enterprises within the relocation plan approved for industrial mobilization when such sites fall within the administrative boundaries managed by the province, and at the same time ensuring the number of means of transportation required for relocation for these enterprises. These means of transportation must be present at the location of the production and repair lines requiring relocation within twelve (12) hours from the time of receiving the relocation order.
2. Industrial enterprises within the relocation scope (including those not under provincial management) shall report to the provincial People's Committee (where the production and repair lines requiring relocation are located) the number of missing means of transportation when relocation is necessary, after being approved by the superior management agency.
Article 17. The completion deadline for relocation of enterprises within the relocation scope shall be carried out according to the decision of the Minister of National Defense.
Article 18. When there is a mobilization industrial mobilization decision and a national strategic material reserve dispatch decision issued by the Prime Minister, the Minister of National Defense and the Minister of Finance shall direct units under their authority to dispatch national strategic materials for industrial mobilization practice according to the responsibilities assigned. Industrial enterprises organize the reception of materials at state strategic material storage facilities.
Chapter IV
REGIME AND POLICIES FOR INDUSTRIAL ENTERPRISES AND WORKERS IN INDUSTRIAL MOBILIZATION
Article 19. During preparation and implementation of industrial mobilization, industrial enterprises and workers enjoy regimes and policies as stipulated in Articles 27, 28, and 29 of the Mobilization Ordinance.
Article 20. Industrial enterprises when implementing production, repair of equipment, and technology transfer during industrial mobilization are not subject to value-added tax as prescribed by the Value Added Tax Law and guiding documents.
Article 21. Workers directly involved during the period of participating in the implementation of industrial mobilization shall be entitled to defense and security allowances as provided for current regulations for defense workers and civil servants.
Chapter V
STATE BUDGET TO ENSURE INDUSTRIAL MOBILIZATION
Article 22
1. The state budget ensures the tasks of preparing industrial mobilization for ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations allocated in the annual state budget estimate in accordance with the State Budget Law and guiding documents.
2. The state budget ensures the tasks of implementing industrial mobilization for ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations allocated upon issuance of a Decision by the Prime Minister assigning the task of implementing industrial mobilization.
Article 23
1. The central budget ensures the tasks of preparing industrial mobilization within the responsibility of the Ministry of National Defense to be spent on the following items:
a) Surveying the production and repair capacity of industrial enterprises:
Preparing documents to serve the survey of production and repair capacity;
Organizing surveys of production and repair capacity of enterprises;
Workshops to select enterprises capable of producing and repairing equipment;
Verifying the capability of enterprises meeting the conditions for industrial mobilization.
b) Completing production and repair lines for industrial mobilization:
Costs serving the construction of investment projects to complete production and repair capacity;
Preparing design, technology, technical guidance deployment documents, supplementing specialized tools, and special defense equipment;
Ensuring wages and allowances for workers and those participating in technology transfer;
Ensuring materials for product trial production and other costs for line acceptance.
c) Scientific research and application of scientific and technological progress for industrial mobilization: outsourcing expertise, product trials, conferences, seminars, and other expenses as prescribed by laws on scientific research work.
d) Professional training for cadres, workers, civil servants, and other workers and organizing training, drills for industrial mobilization:
Organizing professional training for cadres, workers, civil servants, and other workers and organizing training, drills for industrial mobilization;
Ensuring wages and allowances for workers and those participating in professional training, training, drills, and instructor fees;
Ensuring materials for production and repair and organizing product acceptance in training and drills for industrial mobilization;
Compensating for material losses caused by training and drills for industrial mobilization (if any); Summarizing and concluding training and drills for industrial mobilization.
đ) Activities to maintain the production and repair capacity of industrial mobilization lines:
Preserving, maintaining, and repairing specialized equipment;
Labor costs, production and repair materials, energy costs, enterprise management, insurance, trade union activities, and other costs as prescribed by the State regarding product cost.
e) Material reserves: reserve material capital, support for purchasing equipment for material reserves, constructing and renovating warehouses, and other auxiliary works.
g) Surveying and selecting relocation sites for enterprises that need to relocate.
h) Mobilization industrial operations:
Developing industrial mobilization plans;
Conferences, seminars, summarizing, concluding, rewarding, printing documents;
Supporting the purchase of office equipment for industrial mobilization work.
i) Other related tasks concerning industrial mobilization as prescribed by law.
2. The central budget ensures the tasks of preparing industrial mobilization within the responsibility of ministries, ministerial-level agencies, and State-owned corporations to be spent on the following items:
a) Surveying the production and repair capacity of industrial enterprises:
Preparing documents to serve the survey of production and repair capacity;
Organizing surveys of production and repair capacity of enterprises;
Workshops to select enterprises capable of producing and repairing equipment; Verifying the capability of enterprises meeting the conditions for industrial mobilization.
b) Scientific research and application of scientific and technological progress for industrial mobilization: outsourcing expertise, product trials, conferences, seminars, and other expenses as prescribed by laws on scientific research work.
c) Professional training for cadres, workers, civil servants, and other workers and organizing training, drills for industrial mobilization:
Organizing professional training for cadres, workers, civil servants, and other workers and organizing training, drills for industrial mobilization;
Ensuring wages and allowances for workers and those participating in professional training, training, drills, and instructor fees;
Compensating for material losses caused by training and drills for industrial mobilization (if any);
Summarizing and concluding training and drills for industrial mobilization.
d) Activities to maintain the production and repair capacity of industrial mobilization lines: preserving, maintaining, and repairing specialized equipment.
đ) Surveying and selecting relocation sites for enterprises that need to relocate.
e) Mobilization industrial operations:
Developing industrial mobilization plans;
Conferences, seminars, summarizing, concluding, rewarding, printing documents;
Supporting the purchase of office equipment for industrial mobilization work.
g) Other related tasks concerning industrial mobilization as prescribed by law.
h) Specifically, for the central budget ensuring the tasks of preparing industrial mobilization within the responsibility of the Ministry of Finance (other ministries and ministerial-level agencies, State-owned corporations do not have this expenditure item), it will be spent on the item of material reserves: reserve material capital, support for purchasing equipment for material reserves, constructing and renovating warehouses, and other auxiliary works.
3. The local budget ensures funding for the tasks of preparing industrial mobilization, which shall be allocated to the following items:
a) Surveying the production and repair capacity of industrial enterprises:
Preparing documents to serve the survey of production and repair capacity;
Organizing surveys of production and repair capabilities of enterprises; organizing seminars to select enterprises capable of producing and repairing equipment;
Verifying the capability of enterprises meeting the conditions for industrial mobilization.
b) Scientific research and application of scientific and technological progress for industrial mobilization: outsourcing expertise, product trials, conferences, seminars, and other expenses as prescribed by laws on scientific research work.
c) Professional training for cadres, workers, civil servants, and other workers and organizing training, drills for industrial mobilization:
Organizing professional training for cadres, workers, civil servants, and other workers and organizing training, drills for industrial mobilization;
Ensuring wages and allowances for workers and those participating in professional training, training, drills, and instructor fees;
Compensating for material losses caused by training and drills for industrial mobilization (if any);
Summarizing and concluding training and drills for industrial mobilization.
d) Activities to maintain the production and repair capacity of industrial mobilization lines: preserving, maintaining, and repairing specialized equipment.
đ) Surveying and selecting relocation sites for enterprises that need to relocate.
e) Mobilization industrial operations:
Developing industrial mobilization plans;
Conferences, seminars, summarizing, concluding, rewarding, printing documents;
Supporting the purchase of office equipment to serve industrial mobilization work;
g) Other related tasks concerning industrial mobilization as prescribed by law.
Article 24. The budget for practicing industrial mobilization under the responsibility of Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations shall be allocated to the following activities:
1. Relocating industrial mobilization production lines upon a mobilization decision:
a) Constructing infrastructure and other conditions to support production and repair equipment lines at the relocation site;
b) Dismantling, packaging, loading, and addressing damage during transportation, installation, and operation of production and repair equipment lines, and ensuring transportation means for officials, workers, and equipment belonging to the line to the new location and vice versa;
c) Resolving policies for owners of means of transport directly mobilized for relocation;
2. Producing and repairing equipment upon a mobilization decision: labor costs, production materials, repair costs, energy expenses, and other costs according to state regulations on product cost;
3. Scientific research and application of scientific and technological progress to serve industrial mobilization: outsourcing expertise, product trials, conferences, seminars, and other expenditures as prescribed by laws on scientific research;
4. Reserve materials: reserve material capital, supporting the purchase of equipment to serve reserves, constructing and renovating warehouses and auxiliary facilities;
5. Supporting production for enterprises after completing industrial mobilization tasks;
6. Mobilization business operations:
a) Conferences, seminars, mid-term reviews, final summaries, awards, and printing of documents;
b) Supporting the purchase of office equipment to serve industrial mobilization work;
7. Other tasks related to industrial mobilization as prescribed by law;
Article 25
1. Based on assigned industrial mobilization tasks, Ministries, ministerial-level agencies, and State-owned corporations prepare the budget estimate for industrial mobilization, including regular expenditure and investment development expenditure, to be submitted to the Ministry of Finance, the Ministry of Defense, and the Ministry of Planning and Investment for consolidation and submission;
2. Provincial People's Committees prepare the budget estimate for industrial mobilization within the local budget, to be submitted to the same-level People's Council for decision in accordance with the Law on State Budget and guiding documents;
Article 26
1. Based on the allocated industrial mobilization budget, Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations allocate the budget estimate to subordinate units and enterprises; consolidate and report the results of budget allocation to the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Defense;
2. Ministries, ministerial-level agencies, provincial People's Committees, State-owned corporations, and their subordinate units and enterprises responsible for the allocated industrial mobilization budget must implement tasks and submit final accounts in accordance with current regulations;
Chapter VI
RESPONSIBILITIES FOR STATE MANAGEMENT AND ORGANIZATION OF IMPLEMENTATION IN INDUSTRIAL MOBILIZATION
Article 27
1. Ministry of National Defense:
a) Be responsible before the Government for managing state affairs regarding industrial mobilization; guide, urge, and inspect the implementation of legal provisions on industrial mobilization;
b) Take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Industry to build the national plan on industrial mobilization to be submitted to the Prime Minister for approval;
c) Take the lead and coordinate with the Ministry of Planning and Investment to establish mobilization targets to be assigned to Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations to be submitted to the Prime Minister for decision;
d) Coordinate with the Ministry of Planning and Investment to establish the content of decisions assigning tasks to survey production and repair capabilities of industrial enterprises to be assigned to Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations to be submitted to the Ministry of Planning and Investment for the Prime Minister's decision;
đ) Coordinate with the Ministry of Finance and the Ministry of Planning and Investment to compile the annual budget estimate for industrial mobilization to be submitted to the Ministry of Finance for the Prime Minister's decision;
e) Coordinate with the Ministry of Finance to determine the list of specialized defense material reserves and general-purpose materials serving industrial mobilization to be submitted to the Ministry of Finance for the Prime Minister's decision;
g) Submit to the Prime Minister for decision on the scale, content, and form of industrial mobilization exercises;
2. The Ministry of Planning and Investment:
a) Within their scope of duties and authority, coordinate with the Ministry of Defense to manage state affairs regarding industrial mobilization;
b) Take the lead and coordinate with the Ministry of Defense to establish the content of decisions assigning tasks to survey production and repair capabilities of industrial enterprises to be assigned to Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations to be submitted to the Prime Minister for decision;
c) Coordinate with the Ministry of Defense to build the national plan on industrial mobilization to be submitted to the Ministry of Defense for the Prime Minister's approval;
d) Coordinate with the Ministry of Defense to establish mobilization targets to be assigned to Ministries, ministerial-level agencies, provincial People's Committees, and State-owned corporations to be submitted to the Ministry of Defense for the Prime Minister's decision;
đ) Participate in reviewing complete investment projects to perfect production and repair lines for industrial mobilization of enterprises;
e) Coordinate with the Ministry of Finance to compile the annual budget estimate for industrial mobilization to be submitted to the Ministry of Finance for the Prime Minister's decision;
3. Ministry of Finance:
a) Within their scope of duties and authority, coordinate with the Ministry of Defense to manage state affairs regarding industrial mobilization;
b) Coordinate with the Ministry of Defense to build the national plan on industrial mobilization to be submitted to the Ministry of Defense for the Prime Minister's approval;
c) Take the lead and coordinate with the Ministry of Defense to determine the list of specialized defense material reserves and general-purpose materials serving industrial mobilization to be submitted for the Prime Minister's decision;
d) Take the lead and coordinate with the Ministry of Planning and Investment and the Ministry of Defense to compile the annual budget estimate for industrial mobilization to be submitted for the Prime Minister's decision;
d) Participate in the appraisal of complete investment projects for production and repair chains to mobilize industry for enterprises.
4. The Ministry of Industry:
a) Within their scope of duties and authority, coordinate with the Ministry of Defense to manage state affairs regarding industrial mobilization;
b) Coordinate with the Ministry of National Defense to build the state plan on industrial mobilization for the Ministry of National Defense to submit to the Prime Minister for approval; organize the construction and implementation of the industrial mobilization plan within the scope of management according to the Prime Minister's decision;
c) Participate in the appraisal of complete investment projects for production and repair chains to mobilize industry for enterprises under their authority;
d) Notify the Ministry of National Defense in writing about programs concerning strategies, overall development plans, regional planning for the mechanical engineering, metallurgy, and chemical industries when approved by the Government.
5. Ministries, ministerial-level agencies, provincial People's Committees:
a) Within their respective functions and powers, coordinate with the Ministry of National Defense to implement state management over industrial mobilization; participate in the appraisal of complete investment projects for production and repair chains to mobilize industry for enterprises under their authority; organize the construction and implementation of the industrial mobilization plan within the scope of management according to the Prime Minister's decision;
b) Provincial People's Committees manage industrial enterprises directly subordinate to them tasked with industrial mobilization, coordinate with ministries, ministerial-level agencies, and State-owned corporations having industrial enterprises in their jurisdiction to carry out industrial mobilization tasks; notify the Ministry of National Defense in writing about long-term five-year plans for local industrial development related to the mechanical engineering, metallurgy, chemical, and electronics sectors.
6. State-owned Corporations: organize the construction and implementation of the industrial mobilization plan within the scope of management according to the Prime Minister's decision; participate in the appraisal of complete investment projects for production and repair chains to mobilize industry for directly subordinate enterprises.
Chapter
VII REWARD AND VIOLATION HANDLING
Article 28. Agencies, organizations, and individuals who have achievements in preparing for industrial mobilization and practicing industrial mobilization shall be rewarded in accordance with the provisions of the law.
Article 29. Agencies, organizations, and individuals who violate the provisions of this Decree shall be subject to disciplinary action, administrative penalties, or criminal prosecution according to the provisions of the law depending on the nature and severity of the violation.
Chapter
VIII IMPLEMENTATION PROVISIONS
Article 30. This Decree shall take effect fifteen days after its publication in the Official Gazette. Previous regulations that conflict with this Decree are hereby abolished.
Article 31. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Industry within the scope of their functions, duties, and powers to guide the implementation of this Decree.
Article 32. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government, and heads of State-owned Corporations are responsible for implementing this Decree./.
