CIRCULAR
Amending and supplementing Circular No. 146/2009/TT-BTC dated July 20, 2009 guiding the regime for collection, submission, and management and use of fees forhandling matters related to nationality

Pursuant to the Nationality Law;
Pursuant to the Ordinance on Fees and Charges;
Pursuant to Decree No. 78/2009/NĐ-CP dated September 22, 2009 of the Government detailing and guiding the implementation of certain provisions of the Nationality Law;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 and Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Fees and Charges Ordinance;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
The Ministry of Finance guides the regime for collection, submission, and management and use of fees for handling matters related to nationality in Vietnam as follows:
Article 1: Amending and supplementing Clause 1 of Article 2 as follows:
A person with special merit contributing to the cause of building and defending the Socialist Republic of Vietnam must be a person awarded Orders, Medals, or other high honors by the Democratic Republic of Vietnam, the Provisional Revolutionary Government of the Republic of South Vietnam, the Socialist Republic of Vietnam, or confirmed by competent authorities of Vietnam regarding such special merit.
A person whose acquisition of Vietnamese nationality would benefit the Socialist Republic of Vietnam must be a person with talent in scientific, economic, cultural, social, artistic, or sports fields, certified by the organization or agency where they work, and recognized by a state management agency at the ministerial level or provincial People's Committee that their acquisition of Vietnamese nationality will contribute to development in these fields in Vietnam.
Article 2.
2. Amending and supplementing Article 7 as follows:
The fee collection agency for applications to acquire Vietnamese nationality, reacquire Vietnamese nationality, or renounce Vietnamese nationality is the Department of Justice of provinces and centrally administered cities when receiving applications for acquiring Vietnamese nationality, reacquiring Vietnamese nationality, or renouncing Vietnamese nationality. The fee collection agency is responsible for registering and declaring the payment of fees into the State budget according to the regulations of the Ministry of Finance in Circular No. 60/2007/TT-BTC dated June 14, 2007 and Circular No. 157/2009/TT-BTC dated August 6, 2009 amending and supplementing Circular No. 60/2007/TT-BTC dated June 14, 2007 of the Ministry of Finance guiding the implementation of certain provisions of the Tax Administration Law and guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 of the Government detailing the implementation of certain provisions of the Tax Administration Law.
2. Amending and supplementing Clause 2, Article 3 as follows:
Fees for handling matters related to nationality are revenues belonging to the State Budget. The fee collection agency may retain a portion of the collected fees to cover expenses for unit activities as follows: Retain thirty percent (30%) of the collected fees to serve the work of reviewing and verifying applications and compensating other related costs for handling applications to acquire, reacquire, or renounce Vietnamese nationality. The fee collection agency shall submit seventy percent (70%) of the collected fees into the State Budget according to the corresponding chapters, types, items, sub-items of the current State Budget Classification.
3. Amends and supplements Clause 4 of Article 3 as follows:
Fees for handling matters related to nationality apply to foreign nationals and overseas Vietnamese submitting applications at Vietnamese representative offices abroad as stipulated in Circular No. 236/2009/TT-BTC dated December 15, 2009 guiding the regime for collection, submission, management, and use of consular fees applicable at Vietnamese diplomatic and consular representative offices abroad and any amendments, supplements, or replacements thereof.
Article 3.
1. This Circular shall take effect 45 days from the date of signature.
2. Other contents related to nationality fees not covered by this Circular shall still be implemented according to the guidance in Circular No. 146/2009/TT-BTC dated July 20, 2009 of the Ministry of Finance guiding the regime for collection, submission, and management and use of fees for handling matters related to nationality.
3. Organizations and individuals subject to the payment of fees and relevant agencies are responsible for implementing this Circular. In the course of implementation, if there are difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for consideration and guidance./.
