Pursuant to the Cinema Law No. 62/2006/QH11 adopted by the National Assembly of the Socialist Republic of Vietnam at its 11th session, 9th meeting on June 29, 2006;
Pursuant to Resolution No. 01/2007/QH12 dated July 31, 2007 of the National Assembly of the 12th term regarding the organizational structure of the Government and the number of Deputy Prime Ministers for the 12th term;
Considering the proposal of the Director of the Cinema Department,
DECISION:
Article 1. This Decision promulgates the Regulation on the Selection of Films to Participate in the Oscar Award for Foreign Language Film.
Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette and shall replace Decision No. 366/QĐ-BVHTTDL dated September 9, 2007 of the Minister of Culture, Sports and Tourism.
Article 3. The Head of the Office, the Director of the Cinema Department, the Director of the International Cooperation Department, the National Council for the Selection of Films to Participate in the Oscar Award for Foreign Language Film, and all film production units nationwide are responsible for implementing this Decision./.

TSelection of films to participate ofthe Oscar Award for Foreign Language Film

Article 1. Applicability
This Regulation applies to all Vietnamese films registered to participate in the national selection round to be sent to compete for the Oscar Award for Foreign Language Film.
Article 2. Definition of Vietnamese films participating in the Oscar Award for Foreign Language Film
Vietnamese films submitted to participate in the Oscar Award for Foreign Language Film under this Regulation refer to films produced by Vietnamese film production units or co-produced with foreign entities outside the United States, directed by Vietnamese directors or overseas Vietnamese citizens, and primarily not in English.
Article 3. Criteria and conditions for films participating in the national selection round
1. Regarding content:
- The film must be reviewed and approved for wide distribution both domestically and internationally by competent authorities in Vietnam;
- The film must demonstrate profound humanistic values and unique artistic creativity;
- Preference will be given to films that strongly reflect Vietnamese cultural characteristics and primarily use Vietnamese dialogue.
2. Regarding technical aspects:
- 35mm or 70mm film stock;
- Mono or stereo sound systems are not accepted;
- The image and sound quality must meet high technical standards and be suitable for digital cinema projection (D-cinema);
- The original dialogue of the film may be in one or more languages but should not predominantly be in English;
- The film must have English subtitles.
3. Regarding time and release method:
- The film must be commercially screened for at least seven consecutive days in Vietnam during the period from October 1 of the previous year to September 30 of the following year;
- During the registration period for the Oscar Award for Foreign Language Film, the film must not be broadcast on television or the internet.
4. Conditions for films co-produced by Vietnamese film production units and foreign entities:
- Satisfy the criteria and conditions stipulated in Clauses (1), (2), and (3) of this Article;
- The film must be agreed upon in writing by all parties involved to register for participation in the national selection round to be sent to compete for the Oscar Award for Foreign Language Film.
Article 4. Registration procedures for the national selection round
1. Each production company may only register one outstanding film that meets the criteria and conditions set forth in Article 3 of this Regulation.
2. Necessary documents to be submitted to the National Council for the Selection of Films to Participate in the Oscar Award for Foreign Language Film include:
- A letter requesting registration for the national selection round;
- Written agreements among cooperative parties regarding the registration of the film for participation in the national selection round to be sent to compete for the Oscar Award for Foreign Language Film (if it is a co-production);
- One copy of the 35mm or 70mm film with English subtitles;
- Two DVDs of the aforementioned film;
- Generic information about the film in Vietnamese and English;
- A synopsis of the film in Vietnamese and English;
- Two sets of ten different film stills each;
- Ten film posters;
- Biographies of the director and main actors in Vietnamese and English;
- Photos of the director and main actors (ten photos each);
- Names and addresses of domestic and international distributors (if applicable);
- Other promotional materials, articles about the film...
3. Deadline for registering and submitting films/documents to the National Council for the Selection of Films to Participate in the Oscar Award for Foreign Language Film:
- The film and documents specified in Clause (2) of this Article must be submitted to the Secretariat of the National Council for the Selection of Films to Participate in the Oscar Award for Foreign Language Film before August 10 each year;

4. Responsibilities of production companies with films participating in the national selection round:
- Complete all forms according to the regulations of the Academy Awards Organizing Committee, the Academy of Motion Picture Arts and Sciences;
- Bear all costs related to producing new English-subtitled copies of the film, shipping fees for sending the film and documents to the National Council for the Selection of Films to Participate in the Oscar Award for Foreign Language Film, and the Academy Awards Organizing Committee of the Academy of Motion Picture Arts and Sciences, on a prepayment basis.
Article 5. Organization and activities of the National Council for the Selection of Films to Participate in the Oscar Award for Foreign Language Film
1. Organization:
- The Minister of Culture, Sports and Tourism decides annually on the establishment of the National Council for the Selection of Films to Participate in the Oscar Award for Foreign Language Film;
- The Council's membership includes managers, renowned filmmakers, writers, and film critics with deep expertise in the field of cinema;
- The Council consists of eleven members, including a Chairperson and a Vice-Chairperson;
- The term of office of the Council is four years.
2. Activities and methods for the National Council to select films participating in the Oscar Award for Foreign Language Films:
- When necessary, the Chairman of the Council or the Vice-Chairman authorized by the Chairman shall convene a meeting of the Council (in accordance with time and rules for participation in the annual Oscar Awards) to view and vote on films participating in the Oscar Award;
- Members of the Council will directly view the film prints of those films registered for participation in the selection round by the studios;
- After viewing, members will score and cast a secret ballot to select only one film to participate in the Oscar Award;
- Voting ballots will be given according to a ten-point scale, with half points being 0.5. The film with the highest average score from valid ballots and must reach nine points or higher will be selected to send for participation in the Oscar Award;
- Any voting ballot with a score difference greater than or less than two points compared to the average score of all ballots will not be valid;
- There must be at least seven members participating in scoring and voting for the results to be accepted;
- Members of the Council who have films registered for participation in the selection round shall not have the right to vote and score;
- The Chairman or Vice-Chairman of the Council shall publicly announce the scores of each film registered for participation in the selection round immediately after counting votes and calculating the average score at the final session of the National Council to select films participating in the Oscar Award;
- Voting score ballots are protected as confidential work information of the agency in accordance with state regulations.
Article 6. Responsibilities of the Cinema Department
The Cinema Department is responsible for ensuring the activities of the National Council to select films participating in the Oscar Award for Foreign Language Films and basing on the working results of the Council to prepare documents to submit to the Minister of Culture, Sports and Tourism for decision.
Article 7. Decision to send films to participate in the Oscar Award for Foreign Language Films
The Minister of Culture, Sports and Tourism, based on the results of the National Council to select films participating in the Oscar Award and the report of the Cinema Department, shall decide to send films to participate in the Oscar Award for Foreign Language Films./.
