Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Labor Code dated June 23, 1994; the Law Amending and Supplementing Certain Articles of the Labor Code dated April 2, 2002; the Law Amending and Supplementing Certain Articles of the Labor Code dated November 29, 2006 and the Law Amending Article 73 of the Labor Code dated April 2, 2007;

Considering the proposal of the Minister, Head of the Government Office,

DECISION:

Article 1. Organizing work on Saturdays each week to receive and process administrative procedures

1. Based on the actual needs of citizens and organizations and the conditions of administrative state agencies, the Minister, Head of a ministry equivalent to a minister, Head of a government agency, People's Committee of provinces and centrally governed cities shall decide to select administrative procedures, agencies, units and areas that need to organize half-day or full-day work on Saturdays each week (except for holidays, festivals and other days off as prescribed by law) to receive and process administrative procedures.

2. The Minister, Head of a ministry equivalent to a minister, Head of a government agency shall stipulate working on Saturdays each week for civil servants, public officials, and employees of agencies and units uniformly organized at the central level located within the territory of provinces and centrally governed cities; the People's Committee of provinces and centrally governed cities shall stipulate working on Saturdays each week for civil servants, public officials, and employees of agencies and units under their management.

3. Heads of agencies and units organizing the receipt and processing of administrative procedures on Saturdays each week must scientifically and reasonably arrange labor so as not to increase staffing, not to affect normal activities on other working days of the week, ensuring the effectiveness of work.

Article 2. Working system, policies, and conditions for work

1. Civil servants, public officials, and employees working on Saturdays will be granted compensatory leave on other days, ensuring a 40-hour workweek as prescribed in Decision No. 188/1999/QĐ-TTg dated September 17, 1999 of the Prime Minister; in cases where civil servants, public officials, and employees work overtime, they will be entitled to benefits and policies as prescribed by law.

2. The budget for arranging work on Saturdays each week shall be guaranteed by the state budget and included in the self-management and self-responsibility budget according to the provisions of Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government stipulating the system of self-management and self-responsibility regarding the use of staffing and administrative management budgets for state agencies.

Article 3. Responsibilities and effect of implementation

1. The Minister, Head of a ministry equivalent to a minister, Head of a government agency, People's Committee of provinces and centrally governed cities shall implement this Decision; they shall report annually to the Prime Minister.

2. The Government Office shall monitor, urge, inspect the implementation, and compile and report to the Prime Minister the situation of implementing this Decision.

3. This Decision takes effect from April 1, 2010 and replaces Decision No. 127/2007/QĐ-TTg dated August 1, 2007 of the Prime Minister regarding organizing work on Saturdays each week to receive and process administrative procedures.

4. The ministers, heads of ministerial-level agencies, heads of government agencies, and chairpersons of provincial people's committees directly under the central government shall be responsible for enforcing this Decision./.
