Issuing Regulations on Updating, Exploiting, Using, and Managing Specialized Civil Service Databases

Pursuant to the Law on Information Technology No. 67/2006/QH11 dated June 29, 2006;

Pursuant to the Law on Cybersecurity No. 86/2015/QH13 dated November 19, 2015;

Pursuant to the Law on Access to Information No. 104/2016/QH13 dated April 6, 2016;

The Minister of Home Affairs issues this Circular on Regulations on Updating, Exploiting, Using, and Managing Specialized Civil Service Databases.

Article 1. Attached herewith are the Regulations on Updating, Exploiting, Using, and Managing Specialized Civil Service Databases.

Article 2. Effectiveness

1. This Circular shall take effect from February 15, 2025.

2. This Circular replaces Circular No. 14/2023/TT-BNV dated September 5, 2023 of the Minister of Home Affairs on Regulations on Updating, Exploiting, and Managing Specialized Civil Service Databases.

3. In case the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 3. Responsibility for Implementation

1. The Head of the Ministry's Office, the Director of the Department of Planning and Finance, the Heads of units under the Ministry of Home Affairs related to this matter, ministries, ministerial-level agencies, government agencies, provincial People's Committees, centrally governed cities, and other relevant agencies and units are responsible for implementing this Circular.

2. Any difficulties encountered during implementation should be reported to the Ministry of Home Affairs for consideration and resolution./.

REGULATIONS
UPDATING, EXPLOITING, USING AND MANAGING SPECIALIZED CIVIL SERVICE DATABASES

(Attached to Circular No. 14/2024/TT-BNV dated December 31, 2024 of the Minister of Home Affairs)

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

1. These regulations stipulate updating, exploiting, using, and managing specialized civil service databases.

2. This Circular does not apply to the updating, exploiting, and managing of the National Database on Cadres, Civil Servants, and Public Officials, and the Archive Database.

Article 2. Applicability

1. Ministries, ministerial-level agencies, and agencies under the Government.

2. Provincial People's Committees, centrally governed city People's Committees.

3. Units under and affiliated with the Ministry of Home Affairs (hereinafter referred to collectively as units under the Ministry).

4. Other agencies and organizations as prescribed by law.

Article 3. Explanation of Terms

1. Specialized Civil Service Database is a collection of digitized information on specialized civil service matters established, managed, operated, and assigned by the Ministry of Home Affairs to specialized civil service database management agencies at the central level, ministry level, provincial/city level for management, exploitation, use, and delegation of authority to subordinate agencies and units under their jurisdiction.

2. Specialized Civil Service Database Management Agency is the agency authorized to manage or delegated to manage and implement the establishment, confirmation, approval of content modifications, status changes, exploitation of specialized civil service databases within state agencies under its jurisdiction.

a) Central Specialized Civil Service Database Management Agency is the agency or unit under the Ministry of Home Affairs designated by the Ministry of Home Affairs to lead and manage specialized civil service data (hereinafter referred to as Level I data management agency).

b) Specialized Civil Service Database Management Agency at the ministry level, sector level, provincial/city level is the agency or unit designated to collect, aggregate, report, and manage data under their respective jurisdictions (hereinafter referred to as Level II data management agency).

3. Data Update is the process of entering information into the specialized civil service database.

4. Account is the identifier name and password granted to organizations or individuals to log into the specialized civil service database.

5. User Account Management is the creation, update, restriction, expansion, or revocation of access rights to the specialized civil service database.

6. Database Management is the administration, operation, updating, modification of content, status changes, and exploitation of the specialized civil service database.

7. Exploitation and Use of the Database is the execution of functions such as searching, finding, viewing information, compiling statistical criteria, reporting, exporting, and printing results based on the specialized civil service database.

8. Delegation of Authority is the process by which the Level I data management agency delegates authority for updating, exploiting, using, and managing the database to the Level II data management agency for data aggregation, updates, and reporting to the Ministry of Home Affairs, and further delegating authority to lower-level agencies and units for data collection and updates as requested by the Level II data management agency.

Article 4. Principles for updating, connecting, exploiting, and managing specialized civil service databases

1. Specialized civil service databases shall be centrally managed from the central level to ministries, sectors, and localities; ensuring uniformity in guidance and management, maximizing resource concentration, shortening the time required for collecting, revising, and updating information for specialized civil service databases within agencies and units.

2. The work of updating and managing specialized civil service databases is the responsibility of relevant agencies and units, which must be carried out uniformly, continuously, synchronously, scientifically, with inheritance, completeness, accuracy, timeliness, ensuring the integrity, reliability, security, and safety of information in fields under the Ministry of Home Affairs' state management functions. Data updates must adhere to the principle that data is collected from a single source, once, without duplication, and shared among related information systems to serve data exploitation and utilization.

3. Specialized civil service databases shall be shared to serve state agency activities aimed at serving citizens and businesses in compliance with legal regulations on establishing, managing, and using data.

4. Information systems of agencies and units connected, shared, exploited, and utilized with specialized civil service databases must ensure infrastructure conditions, connection models, data structures, security, safety, and information confidentiality according to legal provisions.

5. Specialized civil service databases shall be stored and secured, ensuring their update and synchronization with national databases. Management, updating, exploitation, and utilization of specialized civil service databases must comply with Vietnam's e-Government architecture, the Ministry of Home Affairs' e-Government architecture, regulations on managing, connecting, and sharing digital data of state agencies, regulations on ensuring cybersecurity, and other relevant legal provisions.

6. Updating, exploitation, utilization, and management of specialized civil service databases within the scope of state secrets shall be conducted in accordance with legal provisions on cryptographic matters, protection of state secrets, and other related regulatory documents.

7. Violations of the provisions set forth in this Circular shall be handled according to legal provisions concerning the handling of violations related to management, exploitation, and utilization of data.

Article 5. Actions Not Permitted

Implementation shall follow the provisions of Article 8 of Decree No. 47/2020/NĐ-CP dated April 9, 2020, of the Government on managing, connecting, and sharing digital data of state agencies, and other actions as prescribed by relevant laws.

Chapter II

CONTENT OF SPECIALIZED CIVIL SERVICE DATABASES

Article 6. List of Specialized Civil Service Databases

1. Database on quality assessment of civil servants' entry qualifications.

2. Database on organization and administrative structure.

3. Database on local administration and administrative boundaries.

4. Database on associations, funds, and non-governmental organizations.

5. Database on youth affairs.

6. Database on religions.

7. Database on commendation and awards.

8. Database on training and capacity building for cadres, civil servants, and public officials.

Article 7. Content of the specialized civil service database

The content of the specialized civil service database shall be implemented in accordance with the provisions of Clause 3 and 4, Article 11 of Decree No. 47/2020/NĐ-CP dated April 9, 2020 of the Government on management, connection, and sharing of digital data of state agencies. The scope and specific content of each database are detailed in the attached Circular.

Chapter II

MANAGEMENT, UPDATE, EXPLOITATION AND USE OF THE DATABASE

Article 8. Accounts on the specialized civil service database

Accounts on the specialized civil service database are granted to organizations and individuals for managing, updating data, exploiting, and using information from the specialized civil service database.

1. The account for managing the specialized civil service database is managed by the Ministry of Home Affairs.

2. The management accounts of ministries, ministerial-level agencies, government agencies, central agencies, provincial/municipal agencies under the central government (second-level data management agencies) are granted and handed over to the respective agencies for management and use by the Ministry of Home Affairs.

3. Management accounts of agencies and units are granted and handed over to the agencies and units under their jurisdiction for management and use by the second-level data management agency. Accounts for exploitation and use by units and individuals under and directly under the agencies and units are managed and used by the agencies and units that grant them.

4. Organizations and individuals entrusted with accounts are responsible for securing the accounts, securing data, and managing and using the accounts in accordance with the prescribed purposes and functions.

Article 9. Updating Data on the Specialized Civil Service Database

1. Agencies and units entrusted with updating data are responsible for accessing the specialized civil service database to process business, update information; the information must be uniformly formatted, fully and accurately reflecting the specified time for each data. Data updates on the specialized civil service database are carried out through provided accounts or through integrated and shared data platforms according to the guidance of the Ministry of Home Affairs for cases where agencies and units already have specialized databases.

2. Second-level data management agencies are responsible for organizing guidance and urging the implementation of data updates and management within their jurisdiction on the specialized civil service database; they are responsible for ensuring that the data is complete, accurate, and timely as required by the Ministry of Home Affairs.

Article 10. Exploitation and Use of Information in the Specialized Civil Service Database

1. Information in the specialized civil service database is uniformly used nationwide and has legal value in civil service management.

2. The forms of exploitation and use of information in the specialized civil service database are carried out through granted accounts or through integrated and shared data platforms.

3. The use of information in the specialized civil service database must comply with legal regulations on data ownership and personal data protection.

4. Managing agencies and subordinate agencies are entitled to exploit and use information within their management scope; issue internal regulations on data management, exploitation, and use, specifying the responsibilities for managing, exploiting, and using information from user accounts; receive and handle comments and complaints regarding data within their management authority.

5. Agencies, organizations, and individuals outside the civil service sector requiring the use of information from the specialized civil service database shall follow the legal regulations on access to information.

6. For information related to national defense and security, the exploitation and use of information must comply with legal regulations and regulations of the Ministry of National Defense and the Ministry of Public Security on the protection of national defense and security information.

Article 11. Guidance and technical support for the exploitation and use of the specialized civil service database

1. The Ministry of Civil Affairs provides electronic materials on guidance for exploitation and use, and related materials to serve training needs and guidance on the use of the specialized civil service database for users; receives information requests for technical support and guidance on exploitation and use through the Ministry of Civil Affairs' online portal.

2. The organization of guidance and technical support for the exploitation and use of the specialized civil service database at agencies, ministries, sectors, provincial-level cities under the central government shall be carried out by the agencies and units themselves according to conditions and requirements.

Article 12. Provisions on connection and data sharing with the specialized civil service database

1. Technical provisions on data, technical provisions on connection, and guidance on connecting and sharing data with the specialized civil service database shall be issued and publicly announced on the Ministry of Civil Affairs' online portal by the Ministry of Civil Affairs.

2. The Ministry of Civil Affairs shall share specialized civil service data with other agencies and units for use in accordance with Decree No. 47/2020/NĐ-CP dated April 9, 2020 of the Government on management, connection, and sharing of state agency data and relevant laws; in compliance with the Vietnam Digital Government Architecture Framework.

Chapter IV

IMPLEMENTATION

Article 13. Responsibilities of units under the Ministry of Civil Affairs

1. Units under the Ministry of Civil Affairs assigned as Level I data management agencies

a) Shall be the main managing agency of the specialized civil service database; responsible for building business processes and measures to control and maintain the specialized civil service database ensuring that the data is "accurate - complete - clean - current."

b) Coordinate with ministries, equivalent-level agencies, government agencies, People's Committees of provinces and centrally-administered cities, and related agencies to implement the use and update information in the specialized civil service database.

c) Connect and share data from the specialized civil service database to the National Data Portal to serve the exploitation and use of information by agencies, organizations, and individuals in accordance with this Regulation.

d) Be responsible for urging and guiding professional matters within the assigned field and approving reports on data submitted by agencies and units on the software system.

đ) Be responsible for leading and coordinating with the Information Center of the Ministry of Civil Affairs to develop operational regulations for the database within their scope of responsibility.

e) Inspect, handle complaints and accusations, and deal with violations related to the specialized civil service database in accordance with the law.

g) Organize training, guidance, and urging ministries, equivalent-level agencies, government agencies, People's Committees of provinces and centrally-administered cities to implement this Regulation.

h) Summarize, conclude, and statistically analyze the results of implementation by units, ministries, equivalent-level agencies, government agencies, People's Committees of provinces and centrally-administered cities in implementing this Regulation.

2. The Information Center of the Ministry of Civil Affairs

a) Shall be responsible for ensuring information technology infrastructure; managing and operating; connecting and sharing data; ensuring network security and safety to serve the operation of the specialized civil service database.

b) Shall be responsible for submitting to the Minister of Civil Affairs and publicly announcing on the Ministry of Civil Affairs' online portal the list, updates, and additional lists, contents of the database, and access addresses of the specialized civil service database.

c) Coordinate with the Level I data management agency to define technical specifications for data and connections with the specialized civil service database and publicly announce on the Ministry of Civil Affairs' online portal in accordance with this Regulation.

d) Coordinate with related agencies in evaluating and implementing information security assurance in accordance with Decree No. 85/2016/NĐ-CP dated July 1, 2016 of the Government on ensuring the security of information systems by level.

đ) Inspect, evaluate, and maintain data in accordance with Article 16 of Decree No. 47/2020/NĐ-CP dated April 9, 2020 of the Government on management, connection, and sharing of digital data of state agencies.

Article 14. Responsibilities of Ministries, ministerial-level agencies, agencies under the Government, Provincial People's Committees, and Municipal People's Committees directly under the Central Government

1. Direct the organization to use, update, exploit, and manage specialized civil service database.

2. Ensure material resources, equipment, technical infrastructure to connect stably, smoothly, and securely the specialized civil service database system at the agency; meet the requirements of technical standards for the specialized civil service database system.

3. Manage user accounts, grant, restrict, expand, or revoke access rights to the database system of agencies and units within their management scope based on written requests from data management agencies.

4. Ensure strict compliance with regulations on safety, security, and confidentiality of specialized civil service data; meet requirements for innovation and enhanced management of civil service areas by the Party and State.

5. Organize training and skill enhancement for civil servants and employees involved in managing databases and user accounts to ensure safe and smooth connection and sharing of databases.

6. Guide, urge, inspect, supervise the implementation of legal provisions on managing specialized civil service databases within their authority. Examine and handle violations by agencies, units, and individuals who fail to update data, make errors in updating data, and manage databases according to the分级管理系统。对于未按规定更新数据、在数据更新中存在错误以及保管数据库方面存在问题的机构、单位和个人,根据分级管理权限进行审查和处理。

Article 15. Funding for activities related to updating, connecting, sharing, and managing specialized civil service databases

Funding for activities related to updating, connecting, sharing, and managing specialized civil service databases shall be allocated in accordance with laws on public investment, state budget, information technology, and other relevant laws, and sources of funding shall come from legitimate revenues of state agencies and public institutions.

ANNEX

CONTENT OF THE LIST OF SPECIALIZED CIVIL SERVICE DATABASES

(Attached to Circular No. 14/2024/TT-BNV dated December 31, 2024 of the Minister of Home Affairs)

I. DATABASE ON QUALITY CONTROL OF ENTRY REQUIREMENTS FOR CIVIL SERVANTS

1. Main agency in charge and management: Civil Servant Department, Ministry of Home Affairs

2. Purpose

a) To serve state management, provide public services, and share information on quality control of entry requirements for civil servants with national databases, information systems, and databases of organizations and individuals;

b) To create a foundation for collecting, processing, storing, managing, exploiting, and using centralized data on quality control of entry requirements for civil servants; unify the quality control of entry requirements for civil servants so that localities, agencies, and units can select and recruit according to requirements and tasks; contribute to promoting administrative reform, civil servants, and public officials.

3. Scope of Data

Collect data on quality control of entry requirements for civil servants nationwide as stipulated in Decree No. 06/2023/NĐ-CP dated February 21, 2023 of the Government on quality control of entry requirements for civil servants and Circular No. 17/2023/TT-BNV dated November 29, 2023 of the Minister of Home Affairs on Internal Regulations and Rules for Organizing Quality Control of Entry Requirements for Civil Servants.

4. Content of Data

- Information on quality control entry examinations for civil servants nationwide.

- Information on applicants for quality control entry examinations for civil servants according to the Application Form for Quality Control Entry Examination issued together with Decree No. 06/2023/NĐ-CP dated February 21, 2023 of the Government on quality control of entry requirements for civil servants.

- Information on results of quality control entry examinations for civil servants.

5. Mechanism for Collection and Update

- From the Application Form for Quality Control Entry Examination of applicants for quality control entry examinations for civil servants;

- From the unit entrusted with the main responsibility and management of the quality control entry examination database;

- From the unit entrusted with organizing quality control entry examinations for civil servants;

- Data shared and linked from databases of ministries, sectors, and localities related to the matter.

6. Method of Data Sharing

Share data according to special requirements: Implemented through cooperation regulations or request letters from agencies requiring data sharing.

II. DATABASE ON ORGANIZATION AND STRUCTURE

1. Main agency in charge and management: Organization and Staffing Department, Ministry of Home Affairs

2. Purpose

Uniformly manage state administration regarding organizational structure of administrative agencies and public institutions, positions, staffing, number of personnel in public institutions, reduction of staffing, etc., forming a common database on organizational structure.

3. Scope of Data

- Collect data on organizational structure of administrative agencies and public institutions, positions, staffing, and reduction of staffing, data on deputy positions.

4. Content of Data

- Comprehensive data on organizational structure of administrative agencies and public institutions.

- Data on positions, staffing of civil servants, and number of personnel in public institutions;

- Data on reduction of staffing in administrative agencies and public institutions.

- Data on deputy positions in administrative agencies and public institutions.

5. Mechanism for Collection and Update

- State agencies at all levels shall update data on organizational structure of administrative agencies and public institutions on the system provided by the Ministry of Home Affairs.

- Integrate data from the information system on organizational structure of state agencies at all levels.

- Sources from other data sharing and integration systems.

6. Method of Data Sharing

a) Default data sharing

Connect and share common data for other information systems and databases.

b) Specialized data sharing

Implemented through cooperation regulations or request letters from agencies requiring data sharing.

III. DATABASE ON LOCAL ADMINISTRATION AND ADMINISTRATIVE BOUNDARIES

1. Main agency in charge and management: Local Administration Department, Ministry of Home Affairs

2. Purpose

Serve state management in the field of local administration and administrative boundaries including: number, quality of cadres, civil servants at commune level and non-professional staff at commune level, village, and neighborhood; number of representatives of People's Councils at all levels; number, quality of members of People's Committees at all levels; number of leaders of local administrations and state management agencies at local levels; villages, neighborhoods, and administrative boundaries at all levels.

3. Scope of Data

Apply in state agencies at local levels.

4. Content of Data

- Data on the quantity and quality of cadres, civil servants at the commune level and non-professional workers at the commune level, village, and neighborhood association: (1) Total number (including the number for each position); (2) Quality: Party member; ethnic group, religion; age; educational level, professional qualifications, political theory level.

- Data on the number of representatives to People's Councils at all levels: (1) Total number; (2) Quality: gender, Party member, ethnic group, religion, age, educational level, professional qualifications, political theory level.

- Data on the quantity and quality of members of People's Committees at all levels (position, concurrent position, gender, Party, ethnicity, religion, age; educational level; professional qualifications, political theory level).

- Data on the quantity of leaders of local administrative authorities and state management agencies (position, gender, Party, ethnicity, religion, age, education and professional level, political theory, foreign language and information technology).

IV. DATABASE ON ASSOCIATIONS, FUNDS, AND NON-GOVERNMENTAL ORGANIZATIONS

1. Main agency in charge and management: Department of Non-Governmental Organizations, Ministry of Home Affairs

2. Purpose

The database on associations, funds, and non-governmental organizations is connected to the National Public Service Portal and the Ministry of Home Affairs' Public Service Portal; other national databases, databases of ministries, ministerial-level agencies, government agencies, provincial people's committees, and district people's committees to support the processing of procedures for associations, funds, and the management of their activities according to the division of responsibilities.

3. Scope of Data

Data on social funds, charitable funds, and domestic non-governmental organizations.

4. Content of Data

a) Data on associations:

- Information established when the association's organizing committee proposes the establishment of the association;

- A copy or electronic version with valid digital signature of the application file for establishing, dividing, splitting, merging, dissolving, renaming, approving, or amending the charter of the association;

- Some information about the personnel of the association's executive board or another name (hereinafter referred to as the executive board), the association's standing committee or another name (hereinafter referred to as the standing committee); chairman, vice-chairman of the association; organizational structure, headquarters, phone number, term of office of the association;

- Regular and ad hoc reports;

- Information about the assets and finances of the association;

- Other relevant information (if any):

b) Data on funds:

- Information established when the fund's founding committee proposes the establishment of the fund;

- A copy or electronic version with valid digital signature of the application file for establishing, dividing, splitting, merging, dissolving, renaming, approving, or amending the charter of the fund;

- Some information about the personnel of the fund's management board; director, deputy director of the fund; organizational structure, headquarters, phone number, term of office of the fund;

- Regular and ad hoc reports;

- Information about the assets and finances of the fund;

- Other relevant information (if any);

5. Mechanism for Collection and Update

- Information updated on the National Public Service Portal and the Ministry of Home Affairs' Public Service Portal;

- Information provided by state management agencies regarding associations and funds;

- Information shared, converted, and standardized from previously established databases;

- Digitization of association and fund information.

- Associations and funds have the responsibility to update the database.

V. DATABASE ON VIETNAMESE YOUTH

2. Purpose

Management of Vietnamese youth; management of outstanding graduates and young scientific officials.

3. Scope of Data

Vietnamese youth are citizens aged from 16 to 30 years old according to Article 1 of the Youth Law 2020.

4. Content of Data

- Statistical data on Vietnamese youth across various fields of life and socio-economic sectors.

- Information on the files of outstanding graduates and young scientific officials according to the criteria and conditions stipulated in Decree No. 140/2017/ND-CP dated December 5, 2017 of the Government on policies to attract and develop human resources from outstanding graduates and young scientific officials; information according to regulations on cadre, civil servant, and public official files (for cases after recruitment).

5. Mechanism for Collection and Update

- Inheriting national population data, national cadre, civil servant, and public official databases in state agencies, etc.

- Digitizing initial files (if available).

2. Purpose

Centralized management of data on religious functionaries, religious affairs, and religious establishments currently operating nationwide.

3. Scope of Data

Religious establishments and religious functionaries within the country.

4. Content of Data

- Information on religious dignitaries and religious officials as required for state management such as: Brief biographical information; Religious name; Name of religious organization; Sect; Current position within the religious organization; Current rank in religion; Religious activity history; Religious education and training history; Religious study and activity history abroad.

- Information on religious facilities: Name of religious facility; address; construction and renovation history; Names of individuals or organizations responsible for building, using, and managing; current status of the religious facility; Religious dignitaries and officials.

5. Mechanism for Collection and Update

- Transfer existing data to a new database.

- The Religious Department (Religious Office) at provincial Departments of Home Affairs shall be responsible for reviewing and updating old and supplementary data onto the new database. Regularly, the Religious Department (Religious Office) at provincial Departments of Home Affairs shall update the database when there are changes in the data.

- Sources from other data sharing and integration systems.

Aggregate data on training and staff development activities for civil servants and public officers as stipulated in Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government on training and staff development for civil servants and public officers; Circular No. 03/2023/TT-BNV dated April 30, 2023 of the Minister of Home Affairs guiding certain provisions of Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government on training and staff development for civil servants and public officers and Decree No. 89/2021/ND-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/ND-CP of the Government on training and staff development for civil servants and public officers and Circular No. 06/2014/TT-BNV dated August 9, 2014 of the Minister of Home Affairs guiding the annual reporting system on training and staff development activities for civil servants and public officers in state agencies, political organizations, political-social organizations, and people's armed forces.
