Detailed regulations on the Civil Aviation Security Program and Quality Control of Civil Aviation Security in Vietnam

BASED ON Decree No. 66/2015/NĐ-CP dated August 12, 2015 of the Government on Civil Aviation Authorities;
AT THE PROPOSAL OF the Director of the Immigration Administration Department;
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
The Minister of Public Security promulgates this Circular detailing the Civil Aviation Security Program and Quality Control of Civil Aviation Security in Vietnam.
Article 2. Application of Law
The application of regulations on the Civil Aviation Security Program and Quality Control of Civil Aviation Security shall be implemented in accordance with this Circular and the provisions of other regulatory legal documents issued before the effective date of this Circular, provided that they do not conflict with the content of this Circular.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Mail includes letters, packages, consignments of goods accepted, transported, and delivered legally through the postal network.
2. Civil Aviation Security Inspection Point is the workplace of officers, soldiers, and staff engaged in civil aviation security inspection established at gates, doors, passages between restricted areas or between restricted areas and other areas, aimed at inspecting the security of people, means of transport, objects, maintaining security and order in the area of the civil aviation security inspection point.
3. Civil Aviation Security Control Point is the workplace of officers, soldiers, and staff engaged in civil aviation security control established in public areas or restricted areas, aimed at controlling the activities of people, means of transport, maintaining security and order within the limited range around the civil aviation security control point.
4. Objects served on aircraft are items for passengers and crew to use or sell on board the aircraft, excluding meals; items for aircraft operation, maintenance, and repair.
5. Unclaimed objects and luggage are objects left at airports that cannot be traced back to their owners.
6. Civil Aviation Security Surveillance is the use of individuals, animals, or technical equipment separately or in combination to manage and monitor in order to detect and prevent violations or signs of violation of civil aviation security.
7. Permit to Perform Civil Aviation Security Duties is a document issued by the Immigration Administration Department to individuals who meet the conditions stipulated by law to perform civil aviation security duties.
8. Cargo is property transported by aircraft, except mail, luggage, objects served on aircraft, and meals.
9. Transiting Cargo and Mail is cargo and mail transported by connecting two or more flights or by two or more modes of transportation, including air transportation.
10. Luggage is property of passengers or crew transported by aircraft.
11. Cabin Baggage is luggage carried onto the aircraft by passengers or crew members and kept under their own care during transportation.
12. Checked Baggage is luggage of passengers or crew members transported in the cargo hold of the aircraft and kept under the care of the carrier during transportation.
13. Unclaimed Luggage is luggage arriving at an airport that is not collected or claimed by passengers or crew members.
14. Lost Luggage is luggage of passengers or crew members separated from them during transportation.
15. Transit Passengers, Luggage, Cargo, and Mail are passengers, luggage, cargo, and mail reboarding the same flight at an airport where they previously arrived.
16. Connecting Passengers and Luggage are passengers and luggage directly participating in two or more different flights in a single journey.
17. Quality Control of Civil Aviation Security is the implementation of professional techniques and monitoring measures to assess the current status of civil aviation security assurance, and to address deficiencies identified in civil aviation security assurance. Quality control of civil aviation security includes activities such as regular supervision, quality inspections, testing, evaluation, security investigations, statistics, data analysis, and other measures.
a) Quality Inspection of Civil Aviation Security is the verification of compliance with the security program regulations of entities performing civil aviation security duties, airport operators, airlines, and air service providers approved or accepted by the Immigration Administration Department.
b) Civil Aviation Security Testing is the execution of simulated illegal interference with civil aviation activities through open or covert methods to test the effectiveness of security measures.
c) Civil Aviation Security Investigation is an activity conducted by authorized agencies and persons to clarify illegal interference, violations, or signs of violation of civil aviation security.
d) Civil Aviation Security Assessment is the review of compliance with some or all of the international civil aviation security standards and regulations by the International Civil Aviation Organization, civil aviation security authorities, and airlines.
18. Aircraft Maintenance and Repair Area is an area serving the maintenance and repair of aircraft, including: aircraft parking areas, facilities, workshops, vehicle parking lots, and internal traffic systems.
19. Isolation Area is a part of the restricted area defined from the civil aviation security inspection point for passengers and cabin baggage at the terminal to the departure gate.
20. Restricted Area for Exclusive Use is a restricted area having one of the following characteristics:
a) The restricted area does not belong to the terminal or airport;
b) Restricted area within the terminal or airport that engages in surveying, construction, repair, maintenance activities during which there is no provision of air transport services, and the boundaries of the survey, construction, repair, and maintenance areas are separated by fences or structures, ensuring isolation from other restricted areas, such that persons or vehicles in the construction area cannot illegally intrude into other restricted areas.
c) Restricted area within the terminal or airport managed and operated solely by one entity and not directly serving passengers, luggage, goods, or mail, with fences or structures separating it from other restricted areas., baggage, goods, mail, with fences or structures separating it from other restricted areas.
21. The public area of an airport is a zone determined specifically in the aviation security program by the subject having the right to organize the operation of that area, where passengers boarding aircraft, means of transportation, those seeing off or welcoming passengers, sending or receiving goods, or mail may access without undergoing aviation security screening. The public area includes the following specific zones:
a) Areas within the passenger terminal or cargo terminal that are not restricted areas and are not exclusive areas for agencies or units;
b) Zones of traffic roads and parking lots designated for passengers boarding aircraft;
c) Retail stores, shopping centers, public entertainment and leisure areas for passengers, those seeing off or welcoming passengers, sending or receiving goods, or mail located adjacent to the airport, terminal, traffic roads, and parking lots for passengers boarding aircraft.
22. Baggage storage area is a place for storing checked baggage awaiting transfer onto aircraft, lost baggage, or unclaimed baggage.
23. Internal security control is a preventive security measure aimed at eliminating factors and conditions that could be exploited, connected, or used to lure airline employees to assist or directly commit acts of terrorism, crimes, or other violations.
24. Aircraft security check involves inspecting inside and outside the aircraft according to a list to detect suspicious items, dangerous articles, or individuals hiding on board unlawfully.
25. Visual inspection is the direct use of hands, eyes, and other senses by security officers to examine persons, means of transportation, and objects to identify and detect suspicious items or dangerous articles.
26. Background check is the verification of a person's identity to assess their suitability for the role of an airline employee and to issue a long-term aviation security control card.
Air Security Officer is a person authorized by the government operating the aircraft and the government registering the aircraft, assigned to duties on board the aircraft to protect the aircraft and passengers against unlawful interference.
Security seal is the confirmation that goods, articles, or means of transportation have undergone aviation security checks or confirm their intact condition, or simultaneously confirm that they have undergone aviation security checks and are in an intact condition. Aviation security seals are implemented using sealing labels or sealing tapes.
29. Aircraft parking area is a zone designated within the airfield for aircraft to park for boarding and disembarking passengers, baggage, mail, cargo, refueling, providing meals, or maintenance.
30. Meal service consists of food, beverages, and utensils used for meals on board the aircraft.
31. In-service aircraft is an aircraft registered in Vietnam or another country parked at an aircraft parking or holding area preparing for flight operations and continuously monitored by appropriate security measures to detect unauthorized access or intrusion.
32. Non-operational aircraft is an aircraft registered in Vietnam or another country parked at an aircraft parking or holding area for more than twelve hours or without continuous security monitoring.
33. X-ray is a form of electromagnetic wave with wavelengths ranging from 0.01 nanometers to 10 nanometers corresponding to frequencies from 30 petahertz to 30 exahertz and energy levels from 120 electron volts to 120 kiloelectron volts.
34. Security plastic bag is a specialized transparent plastic bag that allows easy viewing and reading of purchase receipts without opening the bag, used to contain liquid items, thick substances, or spray purchased from shops in international quarantine areas or on international flights. Specifications are set forth in Appendix XIX attached hereto.
35. Isolated parking position is an area within the airport designated for aircraft to park when subjected to unlawful interference, isolated from other aircraft and airport facilities including underground structures and equipment to implement emergency plans.
36. Guard post, watchtower, checkpoint is a structure serving aviation security control at security screening points or security control points.
37. Aviation security violation incident is a violation of aviation security regulations that does not amount to unlawful interference.
38. ICAO stands for the International Civil Aviation Organization.
39. High-risk goods and mail are goods and mail falling under one of the following circumstances:
a) There is specific information indicating a higher threat to civil aviation concerning the shipment of goods or mail requiring enhanced or additional aviation security measures;
b) The shipment of goods or mail exhibits unusual signs threatening aviation security;
c) Dangerous articles capable of endangering aircraft cannot be detected through routine security measures alone.
40. Aviation security control unit comprises border police under the Exit and Entry Administration Department and Exit and Entry Management Units under provincial-level public security organs with airports.
Article 4. Responsibilities for developing aviation security programs
1. The air transport security control unit shall take the lead and coordinate with the airport operators to develop an aviation security program appropriate to their functions and tasks, submit it to the Immigration Management Department for approval; provide the relevant parts of the aviation security program according to the list in the approved aviation security program.
2. The airport operator shall take the lead and coordinate with the air transport security control unit and related agencies at the airport to develop an aviation security program, submit it to the Immigration Management Department for approval; provide the relevant parts of the aviation security program according to the list in the approved aviation security program. Contents related to aviation security assurance work in the aviation security program shall be implemented in accordance with the aviation security program of the air transport security control unit at the airport as stipulated in Clause 1 of this Article.
3. The operator of a dedicated airport shall develop an aviation security program, submit it to the Immigration Management Department for approval; provide the relevant parts of the aviation security program according to the list in the approved aviation security program.
4. Vietnamese airlines, air navigation service providers, aircraft manufacturing, maintenance, and repair enterprises, air cargo service facilities at airports, and facilities processing goods and mail for loading onto aircraft shall develop an aviation security program, submit it to the Immigration Management Department for approval in accordance with regulations; provide the relevant parts of the aviation security program according to the list in the approved aviation security program.
5. Foreign airlines operating regular flights to and from Vietnam must submit their current effective aviation security program and additional aviation security procedures for their operations in Vietnam to the Immigration Management Department for approval in accordance with regulations; provide the relevant parts of the aviation security program to the airport operators and air transport security control units at airports where they operate routes.
6. Organizations currently preparing documents to be submitted to competent state management authorities for issuance of airport operator certificates, aircraft operator certificates, and air cargo service permits may develop and submit aviation security programs to the Immigration Management Department for approval. In cases where the aviation security program is approved by the Immigration Management Department, the approval decision must clearly specify the validity period of the decision consistent with the certificate or permit issued.
7. The aviation security programs of the entities and air companies mentioned in Clauses 1, 2, 3, 4, 5, and 6 of this Article shall detail the responsibilities of collectives and individuals involved in aviation security work, procedures, formalities, and security measures as prescribed in this Circular. Contents in the aviation security programs of Vietnamese airlines, aircraft operators, air navigation service providers, security service providers, and air cargo service providers related to activities at airports must comply with the provisions of the law and be consistent with the aviation security program and emergency plans of the air transport security control unit.
8. The aviation security programs of the entities and businesses mentioned in Clauses 1, 2, 3, 4, 5, and 6 of this Article must be developed to ensure the contents as prescribed in Appendices I, II, III, IV, and V attached to this Circular.
Article 5. Procedures for approving aviation security programs and approving foreign airline aviation security programs
1. Enterprises and units with aviation security programs shall submit one set of documents (in Vietnamese for Vietnamese enterprises) directly or through postal services or electronically to the Immigration Management Department. The dossier includes:
a) A request letter in the format prescribed in Appendix VI attached to this Circular;
b) Draft Chapter on aviation security program.
2. Foreign airlines operating commercial flights to and from Vietnam shall submit one set of documents (in Vietnamese or English) directly or through postal service or electronically to the Immigration Management Department. The documents shall include:
a) A request letter in the format prescribed in Appendix VI attached to this Circular;
b) The aviation security program of the foreign airline approved by the aviation authority where the airline's headquarters is located;
c) Additional aviation security procedures for the airline's operations in Vietnam developed according to the framework specified in Appendix XXIV issued together with this Circular.
3. In case the submitted documents are incomplete as prescribed in Clause 1 of this Article, within 01 working day from the date of receipt of the documents, the Immigration Management Department shall send a letter directly or through postal service or electronically requesting additional documents.
4. Upon receiving complete documents as prescribed in Clause 1 of this Article, within 10 working days (for the approval and acceptance procedure of the aviation security program) or 05 working days (for the approval and acceptance procedure of the modified and supplemented aviation security program) from the date of receipt of all documents, the Immigration Management Department shall be responsible for reviewing the documents and conducting on-site inspections if necessary. If the conditions for approval and acceptance are met, the Immigration Management Department shall issue a decision approving or accepting; the approval or acceptance decision shall be sent directly or through postal service or electronically; in case the conditions for approval or acceptance are not met, the Immigration Management Department shall issue a letter directly or through postal service or electronically stating the reasons for non-approval or non-acceptance.
a) In case an on-site inspection is required, the Immigration Management Department shall notify the enterprise or unit requesting approval in writing or through postal service or electronically about the reasons, time of inspection not exceeding 03 working days and not counted towards the administrative procedure processing period;
b) In case the documents contain information that needs clarification or adjustment, the Immigration Management Department shall notify the enterprise or unit requesting approval of the aviation security program in writing or through postal service or electronically about the information that needs clarification or adjustment. The time for supplementing documents does not count towards the administrative procedure implementation period. Within a maximum of 02 working days from the date of receipt of the Immigration Management Department's notification about the information that needs clarification or adjustment, the enterprise or unit requesting approval of the aviation security program must complete and update the documents fully. In case more than 02 working days have passed since the receipt of the notification and the enterprise or unit has not completed the documents fully, the documents will be considered invalid, and the Immigration Management Department shall notify the refusal of the documents in writing or through postal service or electronically and state the reasons.
Article 6. Amendment and Supplement to the Aviation Security Program
1. Units and enterprises with an aviation security program must regularly review and assess the aviation security program to promptly amend and supplement it when it no longer complies with current regulations or fails to meet requirements during implementation.
2. The approval and acceptance procedures for amending and supplementing the aviation security program shall be carried out in accordance with the provisions of Article 5 of this Circular.
Article 7. Control of Aviation Security Documents
1. The determination of state secrets and levels of confidentiality of aviation security documents shall be carried out in accordance with the laws on protecting state secrets.
2. The list of restricted aviation security documents includes:
a) Aviation security programs approved and accepted by the Immigration Management Department;
b) Recommendations, notifications, inspections, tests, investigations, security risk assessments, and files of security violations in aviation that have not been publicly disclosed;
c) Regulations and coordination documents on aviation security between relevant agencies and units;
d) Aviation security documents of ICAO or provided by foreign countries identified as restricted documents by ICAO and the foreign side;
đ) Other aviation security documents determined as restricted documents by the Director of the Immigration Management Department.
3. Agencies and units are responsible for managing and using restricted aviation security documents for their intended purposes.
4. Restricted aviation security documents shall only be provided to recipients listed in the documents. Providing documents to entities outside the recipient list must be agreed upon in writing by the head of the issuing unit and signed off for handover and receipt. Containers storing restricted aviation security documents must have the label "restricted document" in a visible location. Drafting, issuance, management, use, and destruction of restricted aviation security documents are specifically regulated in the aviation security programs of agencies and units with such programs.
5. The Immigration Management Department shall guide the management, use, sharing, and destruction of restricted aviation security documents.
Article 8. Aviation Security Committee at Airports
1. The Aviation Security Committee at Airports is the Emergency Command Center at Airports, including representatives from state management agencies, public security units, military units, and enterprises operating regularly at airports. The establishment and operational regulations of the Aviation Security Committee at Airports are specified in the aviation security program of the aviation security control unit.
2. The Aviation Security Committee at Airports has the following tasks:
a) Reviewing threats and risks to airport aviation security;
b) Coordinating among related parties in ensuring airport security; exchanging information on aviation security issues;
c) Participating in providing opinions when developing aviation security programs, plans, and measures;
d) Reviewing the results of internal quality control activities and quality control by authorized agencies at airports or evaluations by airlines and international organizations;
đ) Evaluating the continuity and effectiveness of the aviation security program.
Chapter II
SECURITY CONTROL MEASURES FOR PREVENTION
Section 1
SECURITY CONTROL OF RESTRICTED AREAS AND PUBLIC AREAS
Article 9. Establishment of Restricted Areas
1. Based on the actual infrastructure and civil aviation operations, the following restricted areas must be established:
a) Passenger area after security screening for boarding aircraft (isolation area), area from staff security checkpoint before entering restricted areas inside the terminal;
b) Aircraft parking area, runway, taxiway, and other areas within the airport;
c) Baggage sorting area after security screening for loading onto aircraft (baggage sorting area);
d) Transit passenger area for connecting flights (transit area);
đ) Cargo and mail handling area after security screening for loading onto aircraft (cargo sorting, storage, and loading area) at airports and extended air cargo warehouses;
e) Passenger lounge serving special aircraft, special compartments, priority flights;
g) Baggage claim area for passengers at the arrival terminal;
h) Aircraft maintenance, repair, and installation area;
i) Food production, processing, and supply area;
k) Fuel storage area for aircraft;
l) Airport emergency center; National aviation emergency center;
m) Control tower area: Long-range control, Approach Control - On-field, Air Traffic Flow Management;
n) Air traffic control tower, radar surveillance station, flight service station;
o) Power and water supply station of the airport (located outside the restricted terminal and airport area);
p) Area from baggage screening point to inside the terminal;
q) Area from cargo and mail screening point for transportation by aircraft to inside the terminal and warehouse;
r) Area for installing central control equipment of terminal and airport technical systems, gate access control, terminal and cargo warehouse management; security monitoring room with cameras; location of broadcasting and video transmission system control equipment of the airport; location of mainframe computer server for airport operations.
2. Based on Clause 1 of this Article, the aviation security control unit shall take the lead and coordinate with the airport operator and relevant agencies and units to determine restricted areas and specific boundaries of each restricted area within the terminal and apron. The airport operator shall take the lead and coordinate with the aviation security control unit and relevant agencies and units to determine restricted areas under their exclusive management and operation when developing the risk-based aviation security program.
3. Based on Clause 1 of this Article, the air service provider at the airport shall take the lead and coordinate with the aviation security control unit (at the airport) and relevant agencies and units to determine restricted areas and specific boundaries of each restricted area under their management and operation for areas outside the terminal and airport when developing the aviation security program; the air navigation service provider, cargo and mail handling facility shall determine and establish restricted areas and specific boundaries of each restricted area for areas not within the airport when developing the risk-based aviation security program.
4. In cases where it is necessary to strengthen aviation security at the airport or to protect the scene or to serve civil aviation operations, if deemed necessary to temporarily establish new restricted areas, the aviation security control unit at the airport shall take the lead and coordinate with the airport operator to establish and immediately notify relevant agencies and units operating regularly in that area. The temporary establishment of restricted areas must meet the following requirements:
a) Have a time limit;
b) Have a physical or soft barrier as boundary; have appropriate warning signs and signals;
c) Have an aviation security checkpoint and arrange security personnel to check and monitor during the establishment period;
d) Have appropriate aviation security measures;
đ) If the temporary establishment of the restricted area exceeds 24 hours, it must be approved in writing by the Immigration Department.
5. The establishment of restricted areas and the application of aviation security inspection and supervision measures for each restricted area must be consistent with the purpose of ensuring aviation security and should not hinder the normal movement and activities of people and vehicles in the restricted area. The agency or unit establishing the restricted area must place warning signs "RESTRICTED AREA" at appropriate locations, easily visible, adjacent to the restricted area and public area. - RESTRICTED AREA” shall be placed at appropriate locations that are easily observable, adjacent to the restricted area and the public area.
Article 10. Provisions on entering, exiting, and operating in restricted areas
1. Persons and means of transport entering, exiting, and operating in restricted areas must have security control cards or permits issued by authorized agencies or units, allowing them to enter and exit such areas.
2. The card must be worn at the chest position to ensure that the front of the card can be observed throughout the time of operation within the restricted area, and the permit must be placed in the front of the cockpit or at a visible location on the means of transport.
3. Persons, objects carried, and means of transport entering and exiting restricted areas must use designated gates and doors, comply with guidance and security regulations in the restricted area, and be subject to appropriate aviation security inspections and supervision.
4. Persons using short-term validity aviation security control cards must be escorted when entering and operating in restricted areas. The escort must hold long-term validity airport and airfield aviation security control cards and must belong to one of the following categories:
a) Persons regularly working in the restricted area of the agency issuing the short-term card;
b) Personnel from: the management agency of the restricted area; the regulatory agency of the restricted area; units regularly operating in the restricted area;
c) Personnel from aviation security control units, Air Navigation Service Units.
5. The escort specified in Clause 4 of this Article must register with the shift duty of the aviation security control unit at the security checkpoint before escorting the person being escorted into and operating in the restricted area, providing the following information: name, number of the aviation security control card of the escort and the person being escorted. The escort must accompany the person being escorted, continuously observe the activities of the person being escorted; promptly guide the person being escorted on security regulations; take measures to prevent or report to the aviation security control unit or personnel of the competent authority nearby if violations by the person being escorted are discovered. After completing the escort, the escort must confirm the removal of the person being escorted out of the restricted area with the shift duty of the aviation security control unit. The registration for entry and confirmation for exit must be conducted at the same security checkpoint.
6. Means of transport entering and operating in the restricted area of the airport must have aviation security forces (persons regularly operating in the airport area) or ground service vehicle operators with operational permits supervise or lead the means of transport provided by the ground handling service unit or the airport operator in the following cases:
a) The driver of the means of transport is only issued a short-term validity aviation security control card;
b) The driver of the means of transport does not have a certificate for controlling and operating vehicles in aircraft parking areas issued by the authorized agency according to regulations;
c) The means of transport operates infrequently in the airfield.
7. The escort or the driver leading the means of transport specified in Clause 6 of this Article must register with the shift duty of the aviation security control unit at the security checkpoint before escorting or leading the means of transport into the restricted area, providing the following information: name, number of the aviation security control card of the escort, the driver leading the means of transport; name and number of the aviation security control card of the driver of the means of transport being escorted or led; number of the aviation security control permit of the means of transport being escorted or led. The escort and leading must meet the following requirements:
a) The escort must continuously observe the activities of the means of transport being escorted; promptly guide the driver of the means of transport being escorted on security and safety regulations; take measures to prevent or report to the aviation security control force or personnel of the competent authority nearby if violations by the driver of the means of transport being escorted are discovered;
b) The leading means of transport must proceed ahead and maintain a safe distance from the means of transport being led, ensuring movement, stopping, and parking according to safety regulations, especially when operating in the airfield. Promptly guide the driver of the means of transport being led on security and safety regulations; take measures to prevent or report to the aviation security control force or personnel of the competent authority nearby if violations by the driver of the means of transport being led are discovered.
8. Means of transport operating in restricted areas must follow designated lanes and routes, travel at prescribed speeds, stop and park at designated locations; be subject to inspection, supervision, and follow the guidance of the aviation security control force on duty.
9. Audio and video recording in the restricted area specified in Clause 1 of Article 9 of this Circular or at aviation security checkpoints or in the workplace of state management agencies at airports must be permitted in writing by the managing unit, except for the following cases:
a) Audio and video recording of information and documents within the scope of state secrets carried out in accordance with regulations on protecting state secrets;
b) Recording audio and video in boarding lounges, baggage claim areas that are not aviation security checkpoints;
c) State management agencies, aviation security control units record audio and video serving official duties according to their assigned authorities and responsibilities.
10. At locations where audio and video recording is not allowed but which passengers and civilians may access, the managing unit must place warning signs in positions easily observable.
11. In cases of urgent tasks or rescue operations, the head of the agency or unit managing the persons and means of transport participating in urgent tasks or rescue operations is responsible for coordinating with the aviation security control force of the managing unit of the restricted area to control the activities of persons and means of transport without requiring aviation security control cards or permits.
12. In restricted areas, checked baggage, goods, and mail must be ensured intact:
a) Heads of agencies and units operating at airports are responsible for organizing measures to prevent theft of property in checked baggage and goods, mail within their scope of responsibility. Aviation security control units monitor the implementation of these regulations by agencies and units;
b) Aviation security control units and enterprises serving goods, ground services are responsible for organizing inspections and monitoring the implementation of procedures, formalities, standards in the baggage and cargo service chain;
c) Airport operators are responsible for hosting and coordinating with aviation security control units at airports to issue specific regulations on the list of persons and means of transport permitted to enter and exit each gate, door, and passage; aviation security control units specify the list of items that must be registered or declared at security checkpoints when carried by persons into restricted areas; items not allowed to be carried by persons to work in restricted areas;
d) Airlines inform and publicize to passengers the regulations on transporting valuable items in checked baggage; procedures for complaints, claims, and compensation in case of loss or misplacement of baggage during transportation;
đ) Specific measures for preventing and combating theft of property are detailed in the aviation security programs of enterprises.
Article 11. Provisions on Bringing Hazardous Items into Restricted Areas
1. The carrying, management, and use of hazardous items within restricted areas must be specifically stipulated in the aviation security program of the aviation security control unit based on the list of prohibited or restricted hazardous items to be carried by individuals and luggage into restricted areas and onto aircraft, issued by the Immigration Management Department.
2. Units using hazardous items for work purposes within restricted areas at airports must register with the aviation security control unit. Aviation security control forces shall inspect and supervise the bringing of hazardous items into and out of restricted areas.
3. Units using hazardous items for work purposes within restricted areas at airports must organize management and bear responsibility for managing, using, ensuring security, and safety of hazardous items as specified in Clause 2 of this Article.
Article 12. Security Checkpoints at Gates, Doors, and Passageways
1. Security checkpoints for aviation must be established at the following locations:
a) At gates, doors, and passageways between restricted areas and other areas;
b) At gates, doors, and passageways from restricted areas with separate access from public areas to other restricted areas.
2. At each security checkpoint (except temporary security checkpoints from public areas into restricted areas) the following documents or electronic data must be available:
a) Procedures for checking persons, objects, and means of transport when entering and exiting restricted areas;
b) Templates for security control permits and identification cards allowing entry into restricted areas; templates for security surveillance identification cards;
c) Lists of persons and means of transport that have lost permits or identification cards; those who had permits revoked but did not return them;
d) Contact lists and forms, records, and registration slips for hazardous items, means of transport, and objects brought into restricted areas; lists of objects that must be registered or declared at security checkpoints when carried into restricted areas; objects that may not be carried into restricted areas for work purposes;
đ) Shift handover logs or electronic records documenting inspection and surveillance activities;
3. At security checkpoints, appropriate signs and directions must be posted, and suitable personnel, equipment, and devices must be arranged to ensure continuous aviation security checks. Gates, doors, and mobile barriers at security checkpoints must always remain closed (locked) and may only be opened when persons and means of transport have been checked and meet the conditions for entry and exit.
Article 13. Security Surveillance, Patrols, and Guarding in Restricted Areas
1. The aviation security control unit must continuously organize surveillance over passengers and persons and means of transport operating in restricted areas through appropriate measures to detect suspicious behavior, promptly prevent violations; check and handle unclaimed baggage and objects, and implement other aviation security measures.
2. The aviation security control unit must organize patrols and guarding to promptly prevent persons, means of transport, and livestock from entering restricted areas or violating regulations to ensure aviation security and safety; conscripts may be used to perform patrol and guard duties at airports.
3. At civil-military shared airports, the aviation security control unit must agree in writing with military units stationed at the airport to jointly patrol, guard, and protect the border area between civil aviation operational zones and military operational zones.
4. The organization of surveillance, patrols, and guarding must be detailed in the aviation security program of the aviation security assurance unit and air service provider.
Article 14. Security Inspection and Supervision of Persons, Means of Transport, Goods, and Objects When Entering, Exiting, and Operating in Restricted Areas Except for Passengers, Baggage, Cargo, and Objects Loaded onto Aircraft
1. The aviation security control force is responsible for conducting security inspections and supervision of persons, means of transport, goods, and objects entering, exiting, and operating in restricted areas.
2. Persons, means of transport, goods, and objects entering restricted areas must undergo aviation security inspections according to the following contents:
a) Security control permits and identification cards;
b) Persons and objects carried by individuals; goods and objects serving in restricted areas and necessary documents (if applicable);
c) Means of transport and objects on means of transport.
3. Persons, means of transport, goods, and objects exiting restricted areas will be inspected by the aviation security control force if there are suspicious signs such as theft, smuggling, commercial fraud, or increased security measures or upon instructions from competent state management authorities. The inspection includes:
a) Security control permits and identification cards;
b) Persons and objects carried by individuals and necessary documents (if applicable);
c) Means of transport and objects on means of transport.
4. Person inspection must be conducted as follows:
a) Checking security control identification cards and observing actual conditions;
b) Inspecting persons using metal detectors and handheld metal detectors at locations equipped with these devices. If the metal detector or handheld metal detector alarms, further visual inspection must be conducted to verify and clarify. Random visual inspections must be conducted at least 5% of the time when the metal detector or handheld metal detector does not alarm. Visual inspections must be evenly distributed and continuous during the operation hours of the security checkpoint;
c) Conducting visual inspections at locations without metal detectors or handheld metal detectors;
d) The sequence and actions of checking identification cards, procedures for visual inspections, and the use of handheld metal detectors; procedures for inspecting using metal detectors are specified in detail in the aviation security program of the unit and air service provider.
5. Object inspection must be conducted as follows:
a) Passing objects through X-ray machines at locations equipped with them. If there are suspicions after passing through the X-ray machine, further visual inspection must be conducted;
b) Conducting visual inspections of objects at locations without X-ray machines;
c) The sequence and actions of visual inspections and X-ray inspections are specified in detail in the aviation security program of the unit and air service provider.
6. Vehicle inspection must be conducted as follows:
a) Requesting the driver and accompanying persons to leave the vehicle;
b) Checking the vehicle permit;
c) Observing and inspecting the exterior of the vehicle;
d) Using mirrors to inspect the underside and upper surface of the vehicle;
đ) Conducting visual inspections inside the driver's cabin and engine compartment of the vehicle;
e) Inspecting passenger and cargo compartments of the vehicle (except in cases where cargo compartments are sealed according to regulations);
g) Inspecting seals on the vehicle and goods transported on it;
h) The sequence and actions of visual inspections and using mirrors to inspect the underside and upper surface of the vehicle are specified in detail in the aviation security program of the unit and air service provider.
7. Provisions for Controlling Objects Brought into and Out of Restricted Areas:
a) At security checkpoints, declaration forms as prescribed in Appendix XX attached to this Circular must be retained. The aviation security control force will inspect objects brought into and out of restricted areas at security checkpoints and conduct random and surprise inspections when there are unusual signs;
b) In cases where individuals carry objects listed in the security checkpoint declaration list and frequently enter and exit restricted areas at airports, the responsible agency, unit, or enterprise must provide the aviation security control force with a list of employees and objects they frequently bring in and out for comparison and control.
c) In the case of persons not listed under point b of this clause or persons listed under point b of this clause but carrying items not registered on the list or exceeding the registered quantity when passing through the aviation security checkpoint, they must declare the items carried in or out according to the form attached as Appendix XX to this Circular. The entry and exit must be conducted through the same gate. The aviation security control force at the aviation security checkpoint shall collect the declaration forms, compare them with the items carried in or out, and record any changes in quantity used within the restricted area (if applicable). through the same gate. The civil aviation security control force at the security checkpoint must collect declaration forms, compare them with the items being brought in or out, and record any changes in quantity used within the restricted area (if applicable).;
d) The aviation security control unit shall specify the detailed list and procedures for registering and controlling items entering and exiting the restricted area of the airport terminal.
d) Books or electronic records regarding the control items carried in or out the restricted area must be managed and retained in accordance with regulations on storage.
8. The process of aviation security inspection and supervision for each specific restricted area must be described in detail in the aviation security program of the entity or enterprise.
Article 15. Signs and directions in public areas of airports
NThe airport operator shall take the lead and coordinate with the aviation security control unit, air service providers, and traffic police and public security agencies to install various signs and directional signs along public traffic routes within the airport, parking lots, passenger pick-up and drop-off areas, and other public areas under the management and operation of the airport operator.
Article 16. Aviation Security Inspection and Supervision in Public Areas of Airports and Adjacent Facilities
1. Persons and vehicles traveling and operating in public areas must comply with road traffic laws, airport regulations, follow the guidance of the aviation security control force, adhere to aviation security and safety regulations, maintain social order and civility.
2. The aviation security control unit shall take the lead and coordinate with relevant units to determine the number, location, and operating hours of aviation security checkpoints. The aviation security control unit shall take the lead and coordinate with the airport operator to establish traffic routes, stopping times, and passenger pick-up and drop-off areas, service areas of service providers in public areas of the airport. public area of the airport.
3. The aviation security control unit shall deploy personnel to conduct aviation security inspections, guide people and vehicles in traffic; regulate the number of people and vehicles entering and operating in the airport parking lot, internal airport traffic lanes, check-in areas, and other public areas of the airport; coordinate with related forces to maintain order in public areas of the airport; coordinate with public security, military, and local authorities to enhance aviation security and public order, and handle violations when necessary.
4. The deployment of patrol and surveillance forces, specialized equipment, inspection procedures must ensure timely detection and handling of unclaimed items, luggage, goods, vehicles, disruptive behavior, and law violations in public areas of the airport, and must be specifically described in the aviation security program of the aviation security control unit.
5. Items, luggage, and passenger property left in public areas for storage at the passenger terminal must be subject to appropriate aviation security checks before acceptance.
6. For cargo terminals, cargo warehouses, the management and operation units of cargo terminals and warehouses shall be responsible for organizing to establish traffic routes and stopping times, to regulate the number of people and vehicles entering and operating in the cargo terminal and warehouse areas; to define areas for loading and unloading, vehicle parking, service areas of service providers, check-in areas, and other public areas within their scope of responsibility; to coordinate with the aviation security control unit, public security, military, and local authorities to maintain overall order at the airport and enhance aviation security and handle violations when necessary.
7. The aviation security control unit shall take the lead and coordinate with the airport operator and related entities and enterprises to arrange and install appropriate barriers or implement aviation security controls using suitable methods based on aviation security risk assessments to prevent unauthorized access by persons or vehicles or the illegal delivery of items into restricted areas.
8. Traffic routes in front of passenger and cargo terminals, motorcycle and car parking lots in front of passenger and cargo terminals must establish checkpoints to regulate motorcycles and cars entering and exiting and conduct aviation security checks when necessary. Short-term motorcycle and car parking lots (allowing parking for less than 24 hours) shall not be located adjacent to the terminal (except for parking lots for cargo and mail vehicles accessing the cargo terminal and warehouse for loading and unloading cargo and mail), air traffic control tower, power supply station for the terminal, and power supply station for the air traffic control tower.
9. Traffic routes in front of passenger terminals serving passengers and near the air traffic control tower must be at least 30 meters away from the terminal and air traffic control tower (except for internal traffic routes, priority vehicles, official vehicles, emergency service vehicles).. Adjacent to traffic routes in front of passenger and cargo terminals, motorcycle and car parking lots in front of passenger and cargo terminals must be equipped with fixed or mobile obstacles to prevent the use of vehicles to attack the terminal or airport. This regulation applies to terminal buildings and air traffic control towers approved for design after the effective date of this Circular.
Article 17. Ensuring Security in the Vicinity of Airports
1. The air transport security control unit shall take the lead in coordinating with the airport operator, the People's Committee, and the local police force to publicize regulations on aviation security to residents living in the vicinity of airports.
2. The local police force shall take the lead in coordinating with the relevant People's Committee and the air transport security control unit to ensure compliance with aviation security regulations, develop and implement preventive measures against illegal interference, and prevent violations of the law in the vicinity of airports.
3. Business units under the Ministry of Public Security and provincial-level police forces shall cooperate with functional agencies under the Ministry of National Defense, Provincial Military Command, and related units at the local level to assess positions that pose risks of attacks on aircraft using shoulder-fired anti-aircraft missiles, unmanned aerial devices, and other types of weapons during takeoff and landing phases to organize the development and implementation of preventive measures.
4. Aviation security control forces from relevant agencies and units shall cooperate with the local police to patrol the vicinity of airports and restricted areas outside airports when requested to detect and promptly address any violations of the law.
Section 2
AIRCRAFT SECURITY CHECKS AND SUPERVISION PRIOR TO FLIGHTS
COMMERCIAL AIR TRANSPORT
Article 18. Security Sealing
1. The following items must be sealed for security after inspection.
a) Cargo containers, mail boxes, loose cargo trays or racks, lost luggage, unclaimed baggage, food service cabinets, and bags;
b) Containers or bags holding onboard service items, except those for aircraft maintenance and repair;;
c) Fueling equipment must be sealed for security at the fuel intake and exhaust ports after receiving fuel; non-operational aircraft must be sealed for security at all doors.
2. Security seals must be tamper-evident and irreparable once applied; the size and type of seal or tape must be appropriate for the item being sealed. The Immigration Management Department will provide detailed guidance on the method of controlling and using security seals for air transport.
3. The model of security seals, management procedures, statistics, issuance, distribution, and usage of security seals must be specifically stipulated in the aviation security program of air transport enterprises. Requirements for security sealing are set forth in Appendix VIII attached to this Circular.
Article 19. Security Checks and Supervision of Departing Passengers and Cabin Baggage
1. Airlines may only accept passengers for boarding and transportation if they meet the following requirements:
a) The passenger has a boarding pass and personal identification documents (or biometric authentication data of the passenger or electronic personal information equivalent to personal identification documents) as prescribed in Appendix IX attached to this Circular; the passenger’s identity and flight details have been verified to match the documents (or electronic personal information equivalent to personal identification documents or biometric authentication data of the passenger);
b) The passenger and their luggage have undergone aviation security checks.
2. Passengers with checked baggage, except in cases provided for in Clause 3 and Clause 4 of this Article, must be present at the check-in counter to complete formalities. Check-in staff must verify the passenger's identity against the boarding pass or ticket and personal identification documents as prescribed in Point a, Clause 1 of this Article, interview the passenger about their luggage; if there are doubts, they must report to the security officer at the security checkpoint.
3. Passengers may authorize a representative to handle their check-in procedures in the following cases:
a) Delegations including members of the Politburo, Central Committee members, alternate Central Committee members, ministers, and equivalent positions; former members of the Politburo, former Secretaries of the Central Committee, former Vice Presidents, former Vice Chairpersons of the National Assembly, former Deputy Prime Ministers; Secretaries and Deputy Secretaries of provincial Party Committees directly under the Central Government; Chairpersons of Provincial People's Councils and People's Committees directly under the Central Government; Deputy Ministers of Public Security, Construction, and National Defense, Deputy Chief of General Staff, Director of Operations Bureau of the General Staff, and Directors of the Political Department of the Vietnam People's Army;
b) Urgent cases decided and responsible for by the Director of the Immigration Management Department.
4. Passengers may self-check-in through online check-in systems or self-service kiosks approved by airlines and relevant authorities.
5. All passengers and cabin baggage must undergo security screening by X-ray before entering restricted areas, except where exempted from security screening according to regulations; passengers who refuse security screening will be denied transportation.
6. The aviation security control unit must allocate sufficient personnel to verify passengers' personal identification documents (or biometric authentication data of the passenger or electronic personal information equivalent to personal identification documents) against tickets or boarding passes either on paper or on electronic devices.
7. Each security checkpoint must have a room for conducting security searches; it must be equipped with X-ray machines, metal detectors (or body scanners), handheld explosive detection devices, explosive detection tools, communication devices, and other necessary equipment.
8. At each security checkpoint, sufficient aviation security control personnel must be allocated to effectively perform the following tasks:
a) Guide passengers to remove personal items, place luggage and objects on the X-ray conveyor belt;
b) Conduct metal detection and explosive detection using handheld devices, visual inspections, and security searches of passengers;
c) Monitor the X-ray screen continuously without exceeding 30 minutes, then return to the task after a minimum of 30 minutes;
d) Receive luggage and objects requiring inspection as requested by the screener monitoring the X-ray screen and transfer them to the visual inspection and search personnel;
đ) Conduct visual inspections and security searches of cabin baggage and objects;
e) The shift leader is responsible for directing, managing, and supervising all work at the security checkpoint; rotating positions among staff during the shift; addressing any issues or violations reported.
9. Passengers must comply with all instructions and requirements of the aviation security control personnel and follow the security screening process for persons and cabin baggage as follows:
a) Present personal identification documents (or biometric authentication data of the passenger or electronic personal information equivalent to personal identification documents); remove shoes (unless using shoe and boot security screening equipment), jackets, hats, belts, personal items, and other carried items; place items, liquids, and electronic devices in trays for X-ray screening before passing through the metal detector or body scanner;
b) Pass through the metal detector or body scanner (if available); if the metal detector or body scanner alarms or the passenger appears suspicious, the aviation security control personnel will use handheld metal detectors and conduct visual inspections to examine the passenger;
c) Place cabin baggage on the X-ray conveyor belt; if there are suspicions about the baggage, the aviation security control personnel must conduct a visual inspection or security search according to regulations.
10. Passengers and carry-on baggage that have completed air security screening must be continuously monitored by security surveillance cameras or directly supervised by air security officers, or both methods until boarding the aircraft.
11. Air security screening for passengers with disabilities, war veterans, patients using wheelchairs or stretchers, and those equipped with medical auxiliary devices shall be conducted visually or through other appropriate measures at suitable locations.
12. Visual inspection of passengers and carry-on baggage shall be carried out at the air security checkpoint or in the search room. At the air security checkpoint, visual inspections of passengers shall be performed by personnel of the same gender; in necessary cases, female officers may inspect male passengers. In the search room, visual inspections must be conducted by personnel of the same gender, with a third party of the same gender present to witness, and a record of the visual inspection must be made.
13. When dangerous items not allowed on board are discovered according to regulations, air security officers shall act in accordance with Article 40 of this Circular.
14. A minimum of 10% random additional checks (including visual inspections or checks using tools, equipment, or explosive detection animals) shall be conducted after the initial air security screening of passengers and carry-on baggage. Random visual inspections can be carried out at the air security checkpoint or in the search room upon request (by the passenger or authorized authority). The random visual inspection ratio must be evenly distributed and continuously maintained during the operational hours of the air security checkpoint each day. The method and procedure for random visual inspections of passengers and carry-on baggage are specified in the air security program of the air security control unit.
15. The procedures for air security inspection and supervision of departing passengers and carry-on baggage must be detailed in the air security program of the air security control unit.
Article 20. Air Security Inspection and Supervision of Transit, Connecting, and Domestic Stopover Passengers and Carry-On Baggage
1. If transit or domestic stopover passengers remain on board the aircraft, the aircraft must be continuously monitored by security surveillance cameras or directly supervised by air security officers, or both methods until departure, and passengers are not allowed to disembark from the aircraft.
2. Transit, connecting, and domestic stopover passengers who disembark must carry their personal belongings and carry-on baggage with them and not leave them on the aircraft.
3. The aircraft operator is responsible for checking to ensure that the personal belongings and carry-on baggage of transit, connecting, and domestic stopover passengers who disembark are not left on the aircraft.
4. Transit, connecting, and domestic stopover passengers and carry-on baggage must undergo air security screening by means of scanning before reboarding the aircraft, except in the following cases:
a) The passenger has been issued a domestic stopover, connecting, or transit passenger tag;
b) From the moment of disembarking, the passenger does not leave the restricted area and is continuously monitored for security; simultaneously, the passenger does not come into contact with their checked baggage and does not enter the baggage claim area;
c) There is an agreement between Vietnam and the country where the aircraft departs for Vietnam regarding the recognition and application of scanning and security monitoring measures or an agreement to avoid re-scanning of passengers.
5. The procedures for air security inspection and supervision of transit, connecting, and domestic stopover passengers and carry-on baggage must be detailed in the air security program of the air security control unit.
6. The Director of the Immigration Management Department decides on the implementation of air security inspection measures for passengers and crew members' luggage and cargo on flights based on risk assessment and determination of air security risks or at the request of authorized agencies; the inspection procedures are carried out in accordance with Article 19 of this Circular.
Article 21. Security checks and supervision for flight crew members
1. The aircraft operator must provide the flight crew list to the air transport security control unit before the flight crew undergoes security checks. The flight crew must wear prescribed uniforms, pack their luggage themselves, and only be allowed to carry luggage as specified in Clause 4 of this Article.
2. Flight crew members must present their flight crew identification cards at the security check point. Air transport security officers will check and compare the flight crew list provided by the aircraft operator with the flight crew identification cards.
3. Departing flight crew members and their luggage must be subject to security checks and supervision as required for departing passengers; transit and transfer flight crew members and their luggage must be subject to security control as required for passengers and transit and transfer luggage, except as provided for in Clause 6 of this Article.
4. Airlines must detail the procedures for controlling flight crew luggage when boarding the aircraft in their airline's security program.
5. The security check process for flight crews and carry-on luggage must be detailed in the security program of the air transport security control unit.
6. Domestic flight crew members and their luggage, after completing a flight from one airport, participate in the next domestic flight as flight crew members to another airport:
a) If they have left the restricted area, upon re-entering for the next flight, they must undergo security checks and screening at the security check and screening points designated for flight crews.
b) If they have not left the restricted area, they do not need to undergo security checks and screening again for persons and carry-on luggage, except in cases where re-screening is required due to urgent security risks as stipulated.
c) In both cases, airlines must closely coordinate with the air transport security control unit to implement measures to prevent smuggling and commercial fraud as required.
Article 22. Security checks for checked baggage
1. Check-in staff must require each passenger to identify their checked baggage correctly before processing check-in procedures, except in the case specified in Clause 3 of Article 19 of this Circular; if there are suspicious signs, they must report to the air transport security officer to enhance the inspection.
2. Checked baggage of departing and connecting passengers must be screened by X-ray machines; if there are doubts, further visual inspections or explosive detection equipment checks or other appropriate measures must be conducted. If there are indications or threats related to flight safety and security, the checked baggage must be thoroughly searched.
3. At each security checkpoint, sufficient security personnel must be deployed to ensure the full and effective performance of the following tasks:
a) Monitoring the X-ray screen; this task must be continuously performed for no more than 30 minutes and must be resumed at least 15 minutes later.
b) Conducting visual inspections and thorough security searches.
c) Commanding the shift team responsible for directing, managing, and supervising all activities at the security checkpoint.
4. The procedures and processes for checking and supervising security of checked baggage are detailed in the security program of the air transport security control unit.
5. Visual inspections of passenger checked baggage must be carried out in the presence of the owner of the baggage or their authorized representative or airline representative, except in emergencies.
6. Checked baggage for transit, connecting flights, and domestic stopover flights that has been unloaded from the aircraft must undergo security checks as required for departing checked baggage before being loaded back onto the aircraft, except in cases where the following requirements are met:
a) The baggage does not leave the aircraft parking area or is under continuous security surveillance from the time it is unloaded until it is reloaded onto the aircraft.
b) The baggage is marked with transit, connecting, or domestic stopover labels.
c) The baggage is synchronized with the passenger or synchronized with the flight crew (if it is flight crew baggage).
d) There is an agreement between Vietnam and the country where the aircraft takes off for Vietnam regarding the recognition and application of screening and security monitoring measures or agreements to avoid rescreening.
7. Airlines must specify specific methods to synchronize baggage with passengers in the case described in point c of Clause 6 of this Article in their security program.
Article 23. Air Security Surveillance for Checked Baggage
1. Checked baggage of departing, connecting, and transiting passengers after acceptance procedures and air security checks must be continuously monitored by security surveillance cameras or directly supervised by air security officers, or both measures until loading onto the aircraft; appropriate protective measures must be taken until the aircraft takes off; unauthorized persons must not be allowed to access the checked baggage.
2. The baggage conveyor belt area and baggage sorting area must be continuously controlled and monitored by security surveillance cameras or directly supervised by air security officers, or both measures; unauthorized persons are not permitted to access these areas.
3. Enterprises providing baggage transportation services from the terminal to the aircraft and vice versa are responsible for implementing preventive measures against loss of property in checked baggage, preventing unauthorized baggage from being loaded onto the conveyor belt or baggage cart.
4. Checked baggage that is torn, broken, or has its lock compromised before being loaded onto the aircraft, or shows signs of unauthorized interference, must undergo re-air security screening. The re-air security screening must be documented. Specific responsibilities of organizations and individuals in ensuring the integrity of baggage, management, supervision, and specific handling procedures for baggage that is not intact before loading onto the aircraft or shows signs of unauthorized interference must be stipulated in the enterprise's and air security control unit's aviation security program.
Article 24. Synchronized Transportation of Passengers and Baggage
1. Each passenger's baggage must be transported on the same flight as the passenger, except in the following cases:
a) Lost baggage transportation;
b) Baggage retained due to flight safety and security reasons;
c) Diplomatic bag and consular bag transportation;
d) Passenger death on board and removal of the body from the aircraft;
đ) Baggage transported as cargo;
e) Force majeure cases.
2. Airlines or aircraft operators must ensure:
a) Each piece of checked baggage must have a baggage tag clearly indicating the flight number, date, month, year, and baggage identification number;
b) Before the aircraft departs, a list of checked baggage must be prepared and cross-checked with the passenger and crew list of the flight;
c) Sign the manifest of the baggage loaded onto the aircraft.
3. In cases where passengers have been issued boarding passes but are not present to board the flight or crew members do not participate in the flight, the airline is responsible for ensuring that all baggage of such passengers or crew members must be unloaded from the aircraft before departure.
4. Checked baggage transported separately from passengers on the flight as specified in Clause 1 of this Article must apply at least one of the following additional air security inspection measures and must be documented, except for diplomatic bags and consular bags:
a) X-ray scanning of items in different positions;
b) Inspection using explosive detection devices.
5. Aircraft operators must specify specific measures to ensure synchronized transportation of passengers and baggage in their aviation security program.
6. Airlines are responsible for notifying air security forces of cases where checked baggage is transported separately from passengers on the flight as follows:
a) For transit flights: Notify when processing the next leg of the journey for the baggage;
b) For departing flights: Notify when accepting the transportation of the baggage.
Article 25. Storage of Lost Baggage, Unclaimed Baggage; Unidentifiable Items and Baggage
1. Enterprises providing passenger terminal operation services are responsible for arranging storage areas for lost baggage, unclaimed baggage, and unidentifiable items until they are transferred. The storage area for items and baggage must be protected, and unauthorized persons must not enter this area. Protection measures must be specifically defined in the enterprise's airport security program.
2. Airlines and enterprises providing passenger and baggage service are responsible for storing and maintaining records of lost baggage and unclaimed baggage, including quantity, weight, flight, route, and resolution measures. Lost baggage and unclaimed baggage must undergo air security screening by x-ray and security sealing before being placed in storage and before being loaded onto the aircraft.
3. If there are signs or information threatening flight security and safety, lost baggage and unclaimed baggage must undergo air security search.
4. When agencies or units discover unidentifiable items or baggage, they must immediately notify air security forces for initial handling. If unidentifiable items or baggage are stored in the lost baggage or unclaimed baggage storage area, they must be handled according to the regulations for lost baggage and unclaimed baggage.
Article 26. Security Inspection and Supervision of Diplomatic Bags and Consular Bags
1. Diplomatic bags and consular bags are exempt from X-ray screening, visual inspection, and security search except in cases provided for in Clause 5 of this Article.
2. The security inspection of diplomatic bags and consular bags shall be carried out by the aviation security control force as follows:
a) Checking seals and external identification marks of diplomatic bags and consular bags in accordance with the provisions of the laws on diplomacy and consular affairs;
b) Checking passports, authorization letters for carrying diplomatic bags and consular bags, and confirmation documents from diplomatic representative agencies and consular representative agencies regarding the number of items in diplomatic bags and consular bags.
3. In case there is a basis to confirm that diplomatic bags and consular bags contain dangerous items not permitted to be transported on aircraft according to regulations, such diplomatic bags and consular bags will be refused carriage. When refusing carriage, a record must be made clearly stating the reasons, with the confirmation of the diplomatic courier or consular courier and the aviation security control force; the record must be sent to the diplomatic representative agency or consular representative agency.
4. Persons holding diplomatic passports, diplomatic couriers, consular couriers, or representatives of diplomatic representative agencies and consular representative agencies, and items they carry when entering restricted areas to send or accompany diplomatic bags and consular bags must undergo aviation security inspection in accordance with Articles 14 and 19 of this Circular.
5. Diplomatic bags and consular bags shall be subject to X-ray screening if the airline directly transporting them requests it in writing to the head of the aviation security control unit at the airport and obtains the agreement of the diplomatic courier or consular courier. The X-ray screening must be recorded in a report confirmed by the airline, diplomatic courier or consular courier, and the aviation security control force; the report must be sent to the diplomatic representative agency or consular representative agency.
6. The security inspection procedures for diplomatic bags and consular bags must be detailed in the aviation security program of the aviation security control unit.
Article 27. Security Inspection and Supervision of Aircraft Crew Members, Passengers, Baggage, and Cargo of Special Aircraft Flights
1. The security inspection and supervision of aircraft crew members, passengers, baggage, and cargo of special aircraft flights shall be carried out by the aviation security control force in accordance with Articles 19, 21, 22, 23, and 28 of this Circular, except where the Security Command of the Ministry of Public Security carries out the inspection and supervision.
2. The Immigration Management Department shall coordinate with the Security Command of the Ministry of Public Security and relevant agencies in the security inspection and supervision of aircraft crew members, passengers, baggage, and cargo of special aircraft flights.
3. The exemption from aviation security inspection for special aircraft flights shall be implemented in accordance with the laws on ensuring special aircraft flights.
Article 28. Security Inspection and Supervision of Cargo and Mail
1. Cargo and mail departing must undergo 100% aviation security X-ray screening, except in cases provided for in Clause 7 of this Article and special items exempted from X-ray screening as stipulated in Article 30 of this Circular. If there is suspicion, further visual inspection or other appropriate measures must continue. The X-ray screening method must be suitable for the nature and type of goods. Visual inspection must be conducted in the presence of the owner or their authorized representative or the representative of the air carrier. If there are signs or information threatening the safety of the flight, cargo and mail must undergo aviation security search. The procedures and formalities for security inspection and supervision of cargo and mail are detailed in the aviation security programs of air transport enterprises and aviation security control units.
2. High-risk cargo and mail must apply additional and enhanced aviation security inspection measures appropriately. The determination of high-risk cargo and mail and the application of additional and enhanced aviation security inspection measures are specified in the aviation security programs of airlines, aviation security control units, and related enterprises.
3. In the case of X-raying cargo and mail using X-ray machines at airports or air cargo warehouses, sufficient aviation security control forces must be arranged at each security checkpoint for cargo and mail to ensure the full and effective performance of tasks. ensuring the following responsibilities: a) Checking documents (sender's declaration form, completion of customs procedures for cargo sent on international flights), recording information about each inspected consignment; conducting visual inspection and aviation security search; checking with explosive detection devices;
b) Monitoring the X-ray screen; this task must be continuously performed for no more than 30 minutes and only returned to after a minimum of 15 minutes;
c) Applying aviation security seals; d) The shift team leader is responsible for directing, managing, and supervising all work at the security checkpoint.
4. Cargo and mail that have undergone aviation security inspection must be continuously monitored by appropriate means until loaded onto the aircraft. Upon discovering that cargo and mail are no longer intact or the packaging lacks aviation security seals before loading onto the aircraft, the cargo and mail service staff must promptly inform the aviation security control force. The aviation security control force is responsible for implementing appropriate re-inspection measures to detect and prevent dangerous items as prescribed. The aircraft operator is responsible for ensuring that cargo and mail are loaded onto the aircraft in compliance with regulations.
5. Cargo and mail that have undergone aviation security inspection but must be transported through non-restricted areas to reach the aircraft or conveyance must be escorted by personnel or continuously monitored by appropriate means during transportation to prevent the illegal introduction of dangerous items into cargo and mail.
6. Transit and transfer cargo and mail must be subjected to X-ray screening and aviation security monitoring like outgoing cargo and mail, except as provided for in Clause 7 of this Article.
7. Transit and transfer cargo and mail are exempt from aviation security inspection if they have an aviation security declaration proving that 100% aviation security inspection has been conducted at the point of departure and fall under one of the following circumstances:
a) Transit and transfer cargo and mail do not leave the aircraft, aircraft parking area, or restricted area and are continuously monitored by appropriate aviation security measures;
b) Transit and transfer cargo and mail are transported from the aircraft parking area to the cargo storage area through non-restricted areas and vice versa, sealed with aviation security seals and continuously monitored by appropriate aviation security measures during transportation to prevent the illegal introduction of dangerous items into cargo and mail.
8. Outgoing cargo and mail must be recorded in paper or electronic documentation regarding their security status, and such documentation must accompany the cargo and mail throughout the air transport journey. The air carrier transporting transit and transfer cargo and mail must provide an aviation security declaration to the aviation security control force at the transit and transfer airport and the air carrier transporting the cargo and mail. The Immigration Management Department shall issue guidelines for recording the security status of cargo and mail and sending documentation regarding the security status of cargo and mail accompanying the cargo and mail.
b) Cargo and mail in transit or transfer transported from aircraft parking areas to cargo storage areas through non-restricted areas and vice versa must be sealed for security and have continuous appropriate security surveillance measures during transportation to prevent unauthorized dangerous articles from being introduced into the cargo and mail.
8. Departing goods and mail must be recorded for security status by paper or electronic documentation. Documentation on the security status of goods and mail must accompany the goods and mail throughout their air transport journey. The airline transporting transit or transfer goods and mail must provide security declaration forms to the civil aviation security control force at the transit or transfer airport and the airline transporting the consignment of goods and mail must also provide such forms. The Immigration Department shall issue guidelines for recording the security status of goods and mail and for accompanying documentation on the security status of goods and mail with the goods and mail.
9. The records of goods extraction, mail, weapons, explosives, support tools, and all minutes must be kept in accordance with the laws on archiving.
Article 29. Security inspection and supervision of goods and mail at facilities outside airports
1. Only facilities processing goods and mail with large volumes transported by air that meet the conditions regarding infrastructure and personnel to ensure aviation security and have an approved aviation security program by the Immigration Administration Department may establish security checkpoints for goods and mail at facilities outside airports and airfields.
2. Based on ensuring aviation security and the interests of all parties involved, the Immigration Administration Department permits aviation security control units to provide services for inspecting and supervising aviation security for goods and mail at facilities outside airports and airfields.
3. The enterprise managing the facility processing goods and mail shall be responsible for ensuring security and protecting the facility according to the approved aviation security program; implementing appropriate security measures for goods and mail when receiving, storing, and transporting them from the security checkpoint to the airport after the security inspection.
4. Enterprises producing or assembling and packaging their own goods for transportation by air shall be reviewed and approved by the Immigration Administration Department for an aviation security program when:
a) Goods transported by air must be complete products with stable construction and accuracy; the production and assembly process must undergo strict quality control stages to ensure safety;
b) They comply with the provisions of Clause 1, 2, and 3 of this Article and Article 96 of this Circular.
Article 30. Security Inspection of Special Items
1. X-ray screening and visual inspection are exempted for human remains placed in sealed metal coffins transported by aircraft. The packaging and sealing process must be supervised by authorized health authorities. The coffin must remain sealed and accompanied by a confirmation document from the supervising health authority along with a death certificate.
2. X-ray screening and visual inspection are exempted for blood products, organs for transplantation, vaccines, and pharmaceuticals that must be continuously sealed. Packaging must be sealed and accompanied by a confirmation document from authorized health authorities.
3. X-ray screening and visual inspection are exempted for dangerous goods where such inspections would pose a risk to the life and health of aviation security inspectors, such as nuclear research materials and radioactive materials. Packaging must be sealed and accompanied by a confirmation document of safe packaging, and a request from an authorized state agency.
4. For bones and ashes, security inspections are conducted like regular goods and luggage, except in cases where exemption from x-ray screening is requested by relevant state agencies, foreign diplomatic representatives, and accepted by the head of the aviation security control unit at the airport.
5. For live animals and perishable items that cannot be inspected by x-ray, visual inspection or other suitable methods must be performed.
6. Dangerous goods transportation must comply with regulations for air transport of dangerous goods. Dangerous goods must be properly packaged, labeled, and declared before acceptance for transport. Airlines are responsible for checking and verifying compliance with air transport regulations for dangerous goods before accepting them for transport. When dangerous goods are detected during security inspection, the aviation security force must notify the carrier to consider its decision.
7. Bringing medical equipment as dangerous items aboard an aircraft for patient care and protection must be requested in writing and approved by airline representatives and the head of the aviation security control unit at the airport.
8. Special items mentioned in Clauses 1, 2, 4, 5, and 7 of this Article must be checked using explosive detection devices.
9. The security inspection procedures for special items must be detailed in the aviation security program of the aviation security control unit.
Article 31. Security Inspection and Supervision of In-flight Meals
1. Enterprises producing, processing, and supplying in-flight meals (hereinafter referred to collectively as meal enterprises) shall be responsible for implementing security measures for in-flight meals according to the approved aviation security program of the enterprise.
2. The production, processing, and supply areas for meals must be protected; materials, tools, and items brought into these areas must undergo aviation security screening and protection to prevent illegal interference; entry and activities in these areas require aviation security access cards and permits. Measures to ensure security must be implemented for meal transportation from the supply area to the aircraft through non-restricted zones.
3. Meal samples must be retained for at least 24 hours from the time they are served on the aircraft.
4. Meal storage containers or bags that have been inspected for aviation security must be sealed with a security seal. Aviation security forces only allow access to restricted areas of airports and airfields if the meal storage containers or bags retain the original security seal of the meal enterprise.
5. In cases where meal storage containers or bags move from other areas into restricted zones without a security seal or if the security seal or storage containers or bags are not intact, they must undergo aviation security inspection by X-ray or visual inspection before being moved into restricted areas at the airport for loading onto the aircraft, and must be continuously monitored for security.
6. The process of aviation security inspection and supervision for meals must be detailed in the aviation security program of the aviation security control unit.
Article 32. Security Inspection and Supervision of Items Served on Aircraft
1. Items served on aircraft must be stored in boxes or bags and undergo aviation security inspection by X-ray. Boxes or bags containing items served on aircraft must be sealed with a security seal after undergoing X-ray aviation security inspection (except for items used for aircraft maintenance and repair) and must be continuously monitored by security cameras or directly by aviation security forces or both until loaded onto the aircraft.
2. Storage areas for items served on aircraft must be protected; entry and activities in these areas require appropriate aviation security access cards and permits.
3. Aircraft operators, maintainers, and repairers are responsible for inspecting and verifying the quantity and type of items used for aircraft maintenance and repair when loading and unloading them from the aircraft, recording this information in writing, and presenting it to aviation security forces upon entering and exiting restricted areas.
4. The process of aviation security inspection and supervision for items served on aircraft must be detailed in the aviation security program of the aviation security control unit.
Article 33. Ensuring Aviation Security for Aircraft Fuel
1. Fuel supply enterprises are responsible for implementing aviation security measures for fuel according to the enterprise's security program approved by the Exit and Entry Administration Department.
2. Fuel storage areas and transport vehicles must be protected; entry and activities in these areas require appropriate aviation security access cards and permits.
3. Fuel intake and discharge ports of aircraft refueling vehicles after receiving fuel for aircraft refueling must be sealed with a security seal; the vehicle must be escorted, protected, or have appropriate security measures implemented when moving through non-restricted areas.
4. Aviation security forces at airports and airfields are responsible for inspecting and supervising aircraft refueling vehicles before entering the airport, ensuring that the security seals on the discharge and intake ports of the refueling vehicle remain intact.
5. The process of aviation security inspection and supervision for aircraft fuel must be detailed in the aviation security program of the aviation security control unit.
Article 34. Security checks and supervision for air passengers who are suspects, defendants, convicts, deported persons, extradited persons, or arrested persons pursuant to an arrest warrant
1. When handling air travel procedures, the escort must present the escort order or decision issued by the competent authority.
2. The airline representative shall cooperate with the escort to assess risks in transporting escorted passengers and decide on appropriate security measures; notify the air security control force at the departure airport.
3. The escorted person and the escort may be subject to air security checks in a separate area. The escorted person and their luggage and belongings shall be visually inspected.
4. The air security control force shall cooperate with the escort to strictly manage and supervise during the process of boarding and deplaning the escorted person from the aircraft.
5. The airline representative must inform the aircraft commander of the seating position of the suspect, defendant, convict, deported person, extradited person, or arrested person pursuant to an arrest warrant and the escort, along with any support equipment they carry. The aircraft commander shall notify the air security control force at the destination airport about any necessary assistance.
Article 35. Security checks and supervision for air passengers refused entry or transit
1. The airline shall be responsible for passengers carried by the airline that are refused entry or transit to Vietnam and shall have the following obligations:
a) Transport the passenger out of Vietnam as soon as possible;
b) Coordinate with the immigration control unit to temporarily hold the passenger's personal documents and to obtain other necessary documents issued by the competent authority for the purpose of transporting the passenger out of Vietnam if the passenger does not have valid personal documents;
c) Notify the immigration control unit of the list of passengers refused entry or transit, the time and location of managing such passengers, and the flight transporting them out of Vietnam;
d) Accept the passenger's personal documents or other documents provided by the competent authority and only return these documents when the passenger has been handed over to the competent authority of the country where the aircraft arrives.
2. In cases where the airline transports passengers refused entry abroad back to Vietnam, the airline shall be responsible for coordinating with the competent authority of the host country to obtain the passenger's personal documents or other documents issued by the competent authority of the host country for the purpose of transporting the passenger.
3. In cases where passengers refused entry or transit are managed and supervised at the airport, the air security control force shall manage and supervise passengers refused entry or transit. If passengers refused entry or transit do not voluntarily return to their home country, the airline must arrange security personnel to escort them on the flight, with a minimum of one escort for each passenger.
4. The airline shall bear all costs related to passengers refused entry, except as provided for in Clause 6 of this Article.
5. The airline representative must inform the aircraft commander of the seating position of the passenger refused entry and the escort, along with any support equipment they carry. The aircraft commander shall notify the air security control force at the airport or foreign authorities where the aircraft is scheduled to land about any necessary assistance.
6. In cases where a foreign national passenger who has entered Vietnam subsequently exits to a third country but is refused entry and forced to return to Vietnam, the airline shall be responsible for transporting the passenger back to Vietnam, handing over the passenger, and coordinating with the immigration control unit to verify the passenger's journey, personal information, and nationality so that the competent authority can take appropriate measures and assist the passenger until they leave Vietnam.
Article 36. Security checks and supervision for air passengers who cannot control their behavior
1. Passengers who cannot control their behavior are passengers in a state of impaired consciousness or loss of control over their actions due to mental illness, alcohol consumption, or other stimulants.
2. The acceptance of transportation of mentally ill passengers shall be evaluated and decided by the airline representative. In cases where the airline accepts transportation, it must comply with the following requirements:
a) Mentally ill passengers must be accompanied by a doctor or relative capable of controlling the passenger's abnormal behavior. In necessary cases, mentally ill passengers must be sedated before boarding the aircraft, with the drug's effect lasting longer than the flight duration;
b) Mentally ill passengers and their luggage and belongings must be visually inspected; the inspection may be conducted in a separate area;
c) In necessary cases, upon request of the airline representative, the air security control force must escort mentally ill passengers onto the aircraft and vice versa;
d) The airline representative must inform the aircraft commander of the seating position of the mentally ill passenger. The aircraft commander shall notify the airport operator, air security control force at the destination airport about any necessary assistance if deemed necessary.
3. The acceptance of transportation of passengers who have consumed alcohol or other stimulants but have not lost control of their behavior shall be evaluated and decided by the airline representative. When transporting such individuals, the airline must apply appropriate air security measures.
Article 37. Procedure for Handling Disruptive Passengers
1. In cases where passengers have not boarded the aircraft, aviation security forces shall prevent passengers from boarding the aircraft, temporarily detain the passengers and their personal identification documents. The subsequent steps shall be carried out as prescribed in Articles 61 and 62 of this Circular. The handling must ensure that the impact on the normal operation of the airport is minimized to the greatest extent possible.
2. In cases where passengers have boarded the aircraft but the aircraft is still on the ground, the aircraft commander must apply appropriate measures within their authority; decide to suspend the flight if deemed necessary for the safety and security of the flight; notify the airline representative; the airline representative shall report the incident to the leading aviation security force, coordinating with relevant forces at the airport to handle the situation.
3. In cases where the aircraft is in flight, the aircraft commander must apply appropriate measures within their authority; decide to land the aircraft if deemed necessary for the safety and security of the flight; notify the airline or the civil aviation authority at the airport where the aircraft lands (if there is no airline representative), depending on the nature and severity of the incident, the aircraft commander shall organize the administrative violation record or report the incident according to the law on administrative penalties in the field of civil aviation or record according to the regulations of the host country, hand over the case to the civil aviation authority at the landing site or the aviation security force.
4. Upon receiving notification, the aviation security force at the airport shall immediately board the aircraft to coordinate with the crew, apply necessary coercive measures to remove passengers from the aircraft, temporarily detain the passengers' personal identification documents and prohibited items; the crew shall prepare a report of the incident to transfer to the leading aviation security force, coordinating with relevant forces to handle the situation; the airline representative must be present to witness and coordinate during the handling process.
5. The leading aviation security force, coordinating with relevant forces, upon receiving notification, must immediately go to the location of the incident to directly assess and decide on the handling, applying necessary security measures within their authority; supervise the entire handling process, including on the aircraft; request the transfer of the case file; suspend or allow the continuation of the flight; record, impose administrative penalties; in cases exceeding their authority, transfer the case to competent authorities with sufficient authority to handle it.
Article 38. Refusal and Prohibition of Transport for Security Reasons; Mandatory Visual Inspection of Passengers
1. Airlines have the right to refuse transportation of passengers for aviation security reasons as prescribed by law.
2. The procedures, formalities, and authority to decide on refusing transportation of passengers for aviation security reasons must be clearly specified in the airline's aviation security program. The refusal of transportation of passengers must be immediately reported to the aviation security force for implementation.
3. The Immigration Department issues decisions to prohibit air transport for a limited period or permanently for passengers who violate the law; based on the nature and severity of the violation, the Immigration Department will consider and decide to apply mandatory visual inspections for individuals who violate security and discipline on board the aircraft, at airports.
4. The Immigration Department regularly updates and reports the list of passengers prohibited from transport and those required to undergo mandatory visual inspections to the Civil Aviation Administration of Vietnam, airlines, and aviation security units.
5. Airlines must take appropriate and effective measures to promptly warn and detect prohibited transport subjects; when these subjects make reservations or check-in for flights, they must be subject to mandatory visual inspections to effectively prevent and intercept them in a timely manner.
Article 39. Re-inspection of aviation security
1. Re-inspection of aviation security shall be conducted for restricted areas, persons, means of transport, and objects in the following cases:
a) Passengers and carry-on baggage that have been inspected for aviation security but leave the restricted area and return must undergo re-inspection of aviation security;
b) Restricted areas, persons, means of transport, and objects in restricted areas that come into contact or mix with persons or objects not yet inspected for aviation security;
c) Restricted areas, persons, means of transport, and objects in restricted areas that come into contact or mix with suspected persons carrying dangerous items or suspected means of transport or objects containing dangerous items.
2. The re-inspection of aviation security for passengers and carry-on baggage as stipulated in points b and c of Clause 1 of this Article shall be carried out as follows:
a) All passengers and carry-on baggage must be transferred to another area and the entire related restricted area must be re-inspected;
b) All passengers and carry-on baggage must be re-inspected for aviation security before boarding the aircraft;
c) In case passengers have boarded the aircraft, all passengers, carry-on baggage, and passenger compartments of the aircraft must be re-inspected for aviation security.
3. In case the security seal is not intact or checked-in baggage, goods, mail, service items on board the aircraft, food containers are torn or broken, they must be re-inspected for aviation security before being loaded onto the aircraft.
4. The re-inspection of aviation security as stipulated in points b and c of Clause 1 and Clause 3 of this Article must be recorded in a report.
Article 40. Measures for Handling Dangerous Items During Aviation Security Inspection of Passengers, Baggage, Goods, and Mail
1. When discovering or suspecting bombs, mines, explosives, explosive precursors, flammable substances, biological, chemical agents, poisons, radioactive materials posing a danger, the aviation security control force must immediately assess the risk to take appropriate measures. In case of bombs, mines, or explosives whose mechanisms are unknown, they must remain in place, quickly isolate the area, evacuate passengers to a safe location, and immediately notify the bomb disposal forces of the police or military to defuse them.
2. When discovering dangerous items without a permit as prescribed by law, the aviation security control force at airports and airfields must record it according to the model specified in Appendix XVIII of this Circular and transfer the person, file, and dangerous item to the competent authority, while simultaneously notifying the airline to take appropriate measures.
3. When discovering dangerous items not complying with the conditions for safe air transportation, the aviation security control force at airports and airfields must guide passengers to leave the items behind or follow the procedures for transporting them according to regulations or refuse to complete the aviation security inspection process and request the airline, the legal representative of the consignor, and the passenger to comply with the transportation conditions.
4. When discovering weapons or explosives on passengers, immediate appropriate measures must be taken to control and prevent their handling; when discovering weapons or explosives in passengers' carry-on baggage, passengers must be immediately isolated from their baggage and controlled to handle the situation.
Article 41. Inspection and Supervision of Aviation Security in Isolated Areas
1. Isolated areas must be inspected for aviation security before daily operation and closely monitored continuously throughout the operational period.
2. When not in operation, all entrances and exits of isolated areas must be locked or guarded by aviation security control personnel.
3. The procedures and methods for inspecting and supervising aviation security in isolated areas must be specifically detailed in the aviation security program of the aviation security control unit.
Section 3
ENSURING AVIATION SECURITY FOR PASSENGER AIRCRAFT
COMMERCIAL FLIGHTS
Article 42. Protection of Aircraft at Parking Areas
1. Aircraft parked at parking areas must be protected by appropriate measures to detect and prevent unauthorized persons, means of transport from approaching, loading or leaving objects on the aircraft.
2. Non-operational aircraft must implement the measures prescribed in Clause 1 of this Article and the following requirements:
a) Stairs, passenger boarding bridges, conveyor belts, and other service equipment must be removed from the aircraft;
b) The operator of the aircraft is responsible for closing and locking the aircraft doors; sealing the aircraft doors; and illuminating the aircraft parked overnight.
3. Operational aircraft must implement the measures prescribed in Clause 1 of this Article and the following requirements:
a) The operator of the aircraft is responsible for organizing the control of persons and objects boarding and disembarking the aircraft;
b) The operator of the aircraft is responsible for organizing supervision to prevent illegal interference with the aircraft, persons, baggage, cargo, and mail on the aircraft from the time of aviation security inspection and search until takeoff.
Article 43. Aviation security inspection and aviation security search of aircraft
1. Aviation security inspection of aircraft
a) For operating aircraft on flights without transit passengers: before receiving passengers, baggage, cargo, and mail on board the aircraft, the aircraft operator must conduct an aviation security inspection of the aircraft according to the checklist for each type of aircraft; after the inspection, the aircraft operator must organize continuous surveillance and protection of the aircraft until takeoff;
b) For operating aircraft on flights with transit passengers: the aircraft operator must ensure that passengers disembarking from the aircraft (not continuing their transit journey) carry all their baggage with them, and transit passengers must be required by the airline to identify their baggage before disembarking; before receiving passengers, baggage, cargo, and mail on board the aircraft, the aircraft operator must conduct an aviation security inspection of the aircraft according to the checklist for each type of aircraft; after the inspection, the aircraft operator must organize continuous surveillance and protection of the aircraft until takeoff;
c) For operating aircraft transitioning to non-operational status: before sealing the aircraft doors, the aircraft operator must conduct an aviation security inspection of the aircraft according to the checklist for each type of aircraft; after the inspection, the aircraft operator must organize continuous surveillance and protection of the aircraft until the aircraft transitions to the non-operational aircraft protection status;
d) For non-operating aircraft being put back into operation: before receiving passengers, baggage, cargo, and mail on board the aircraft, the aircraft operator must conduct an aviation security inspection of the aircraft according to the checklist for each type of aircraft to detect hidden dangerous items or stowaways;
đ) The person assigned to conduct the aviation security inspection of the aircraft must have knowledge of the compartments and the inspection checklist for the type of aircraft being inspected; persons not assigned tasks must be required to leave the aircraft during the inspection (except for transit passengers remaining on the aircraft); persons assigned tasks but not responsible for conducting the aviation security inspection of the aircraft may not obstruct or interfere with the inspection;
e) In addition to the provisions of points a, b, c, and d of this Clause, the aircraft operator shall conduct a re-inspection of aviation security of the aircraft when the aviation security risk level requires a re-inspection or upon request for enhanced aviation security control by the competent authority; random checks of life vest bags shall also be conducted;
g) Each aircraft must have an aviation security inspection checklist (in paper or electronic form). The aviation security inspection checklist must at least include: Areas accessible to passengers in the passenger cabin, cockpit; areas accessible without technical equipment in the cargo hold, baggage compartment, and technical compartments containing aircraft control panels;
h) The aircraft commander must be informed of the results after the aircraft has been inspected; aviation security inspection documentation must be retained according to the airline's regulations but for a minimum period of 24 hours after the aircraft takes off;
i) The aircraft operator must detail the checklist, procedures, and processes for aviation security inspections of the aircraft in the airline's aviation security program based on aviation security risks;
2. Aviation security search of aircraft:
a) Aviation security search of aircraft is carried out by aviation security personnel according to the decision of the competent authority, the search must be conducted according to the checklist;
b) The relevant airline is responsible for assigning aircraft technicians to participate and advise during the aviation security search of the aircraft. Each aircraft must have an appropriate aviation security search checklist in accordance with the regulations;
c) The aviation security search of the aircraft must be specified in the airline's aviation security program and the aviation security unit must ensure compliance with the regulations.
Article 44. Protection of the Flight Deck
1. During the entire time the aircraft is in flight, the flight deck door must be locked from the inside and there must be a method for secret communication between cabin crew and the flight crew when suspicion or signs of air transport security threats are detected in the passenger cabin. The procedures for entering and exiting the flight deck while the aircraft is in flight must be detailed in the airline's aviation security program.
2. Aircraft with a maximum takeoff weight of 45,500 kilograms or more or carrying at least 60 passengers must meet the following requirements:
a) The aircraft flight deck door must be capable of resisting light weapons, grenade fragments, or the use of force to enter the flight deck illegally;
b) There must be equipment installed to allow the flight crew to monitor the entire area outside the flight deck door to identify individuals requesting entry to the flight deck, detect suspicious behavior, or potential threats.
3. The aircraft operator must ensure that once the aircraft doors are closed for departure, no one may enter the flight deck until the aircraft doors are opened for passengers to disembark, except for the following persons if the aircraft commander agrees:
a) Members of the flight crew on duty;
b) Persons permitted by the aircraft operator;
c) Persons permitted to enter the flight deck according to the law.
4. Flight crew members are not allowed to leave the flight deck without permission from the aircraft commander. At all times, two flight crew members must be present in the flight deck. In exceptional circumstances, if only one flight crew member is present, an additional cabin crew member must also be present.
Article 45. Ensuring Air Transport Security During Flights
1. When passengers board the aircraft, the airline is responsible for organizing checks and verifying identity documents (or biometric data of passengers or electronic identity information equivalent to identity documents), boarding passes of passengers to ensure they match the correct person and flight. The inspection measures must be detailed in the airline's aviation security program.
2. Before allowing the aircraft to depart, the aircraft commander must be responsible for organizing a verification of the total number of passengers who have been issued boarding passes against the actual number of passengers on board using appropriate methods; if there is no match, the cause must be clarified before departure is permitted.
3. During the flight, the aircraft commander is responsible for ensuring air transport security, maintaining order and discipline on board the aircraft; preventive, blocking, and response measures can be applied to illegal interference, violations of aviation security regulations, disruptive behavior, breaches of order and discipline, non-compliance with crew instructions according to the law; organizing the handover of violators, evidence, and violation reports or records to competent state authorities when the aircraft lands at an airport. The aircraft commander organizes the monitoring of air transport security and maintains order and discipline throughout the flight.
4. Crew members must comply with the orders, commands, and management of the aircraft commander; frequently observe the passenger cabin to promptly detect abnormal passenger behavior, report to the aircraft commander for handling; cooperate with in-flight security officers to resolve and handle cases of illegal interference during flight.
5. The Immigration Management Department is the coordinating body working with relevant agencies, foreign authorities with jurisdiction, and airlines in implementing in-flight security officers' duties on flights.
Article 46. Transporting Passengers Who Are Suspects, Defendants, Convicts, Deportees, Extraditees, or Arrested Pursuant to Warrants
1. The transportation of suspects, defendants, convicts, deportees, extraditees, or those arrested pursuant to warrants must comply with legal provisions, accompanied by escorts, and on a single flight, no more than five such individuals may be transported unless otherwise provided for in Clause 7 of this Article. Special flights do not carry passengers who are suspects, defendants, convicts, deportees, extraditees, or those arrested pursuant to warrants. When purchasing tickets for escorting suspects, defendants, convicts, deportees, extraditees, or those arrested pursuant to warrants, the escorting agency must inform the airline of the following information (in addition to the necessary information for regular passengers): the number of escorted individuals, the nature of the escorted individuals (suspect, defendant, convict, deportee, extraditee, or arrested pursuant to warrant); the number of escorts, planned management measures during escorting and transportation, risk assessment, and special considerations (if any).
2. For flights returning from abroad to Vietnam, if the laws of the host country differ from the provisions of Clause 1 of this Article, the Immigration Management Department will assess and decide on the limit of carriage.
3. The seats of escorted individuals must be designated far from boarding and emergency exit doors. Escorts sit by the aisle, escorted individuals sit in the middle seat, and if the number of escorts is twice the number of escorted individuals, the escorted individual sits between two escorts.
4. Escorted individuals must be monitored by escorts throughout the flight, including when using the restroom. Escorted individuals may consume food and drink on the aircraft with the consent of the escort. Neither escorts nor escorted individuals may use stimulants or alcoholic beverages.
5. It is prohibited to secure escorted individuals to any part of the aircraft.
6. Airlines must arrange for escorts and escorted individuals to board before other passengers and disembark last.
7. The transportation of voluntary returnees in larger numbers or without the escorts specified in Clause 1 of this Article may be carried out if sufficient security assurance is available. The airline is responsible for assessing and deciding.
8. The airline representative must coordinate with the escort to evaluate risks in transporting escorted individuals and decide on appropriate security measures; notify the air transport security control forces at the departure airport.
Article 47. Transport of weapons, war equipment, radioactive materials, and other dangerous items on aircraft
1. The transport of weapons, war equipment, radioactive materials, and other dangerous items on aircraft into or through the territory of Vietnam must comply with the provisions of Vietnamese law.
2. The list of dangerous items that passengers and crew members are not allowed to carry on their person, in hand luggage, or checked baggage onto the aircraft shall be issued by the Immigration Management Department.
3. For dangerous goods that are transported as dangerous cargo, they must be accepted for transport on the aircraft by a representative of the airline in accordance with the legal regulations on the transportation of dangerous goods.
4. Air security control units must post the list of dangerous items that are not allowed to be carried on persons, in hand luggage, or checked baggage at the air security checkpoint; cooperate with airport operators to notify passengers at the terminal about the list of dangerous items that are not allowed to be brought onto the aircraft in an appropriate manner.
5. Airlines must organize the posting of the list of dangerous items that are not allowed to be carried on persons, in hand luggage, or checked baggage at ticket counters and check-in counters.
6. Bringing weapons into the passenger cabin of an aircraft, including dedicated flights (this provision does not apply to charter flights), for international flights arriving in or transiting through Vietnam must be approved by the Immigration Management Department. Airlines must inform individuals carrying weapons of aviation safety regulations and Vietnamese regulations regarding the carriage of weapons in the passenger cabin of the aircraft.
7. Bringing weapons into the passenger cabin of an aircraft, including dedicated flights (this provision does not apply to charter flights), from Vietnam for international flights must be approved by the destination country and transit countries (if there is a transit). Airlines must inform individuals carrying weapons of aviation safety regulations and regulations of the destination and transit countries regarding the carriage of weapons in the passenger cabin of the aircraft.
Article 48. Procedures, sequence for receiving, managing, transporting, and handing over weapons and support tools
1. Individuals carrying weapons and support tools, except in cases provided for in Clause 3 of this Article, must complete boarding procedures at the check-in counter as follows:
a) Present weapons, support tools, and related permits to airline staff for inspection when completing boarding procedures;
b) In case of carrying firearms on board, they must complete a declaration form according to the model prescribed in Appendix X attached to this Circular. In case of checking firearms and ammunition, they must complete a declaration form according to the model prescribed in Appendix XI attached to this Circular.
2. Check-in staff of the airline must notify the air security force to inspect the relevant permits for weapons and support tools. In case of firearms and ammunition, the air security force must check the declaration contents and sign to confirm on the declaration form.
3. In case the passenger is a guard officer or guard soldier accompanying a protected individual or an air security officer or mobile police officer performing a mission, they must complete a declaration form according to the model prescribed in Appendix X attached to this Circular and submit the declaration form to the airline's check-in staff before boarding the aircraft, and bear responsibility for the safety of the firearms, ammunition, and support tools carried.
4. Regulations on receiving, transporting weapons and support tools:
a) Individuals with firearms must disassemble the magazine from the firearm; disassemble or disconnect the power source of the support tool; ensure that weapons and support tools are in a safe state;
b) Ammunition must be packed and stacked in accordance with the regulations on the transportation of dangerous goods. A representative of the airline must sign to confirm on the declaration form according to the model prescribed in Appendix XI attached to this Circular;
c) Ground service personnel transporting firearms and ammunition from the check-in point to the aircraft must be supervised and escorted by air security personnel;
d) Weapons and support tools must be placed in areas where passengers cannot access them throughout the flight.
5. The aircraft commander must be informed of the number of firearms and ammunition being transported on the flight.
6. At arrival airports, the handover procedure for weapons and support tools is as follows:
a) Airlines must notify the airline representative at the arrival airport in an appropriate manner to receive, supervise, and provide information related to flights transporting checked weapons and support tools (flight number, landing time, landing position) to the air security force at the airport;
b) Ground service personnel are responsible for transporting weapons and support tools from the aircraft to the baggage claim area; compare personal identification documents and boarding passes with baggage tags; hand over weapons and support tools to passengers at the baggage claim area;
c) The air security force is responsible for supervising the transportation, handover process, registering in the logbook, and monitoring passengers carrying weapons and support tools out of restricted areas at the airport.
7. The procedures and processes for receiving, managing, transporting, and handing over weapons and support tools must be detailed in the civil aviation security program of the airline and the air security control unit.
Điều 49. Mang chất lỏng, chất đặc sánh, dung dịch xịt (chất lỏng) theo người và hành lý xách tay đối với chuyến bay quốc tế
1. Khi qua điểm kiểm tra an ninh hàng không vào khu vực cách ly quốc tế, mỗi hành khách, thành viên tổ bay chỉ được mang không quá 01 lít chất lỏng theo người và hành lý xách tay; dung tích của mỗi chai, lọ, bình chứa chất lỏng không quá 100 mi-li-lít, đồng thời phải được đóng kín hoàn toàn.
2. Không áp dụng khoản 1 Điều này đối với chất lỏng là thuốc chữa bệnh, sữa, thức ăn cho trẻ em nếu đáp ứng các điều kiện sau:
a) Thuốc chữa bệnh có kèm theo đơn thuốc trong đó ghi rõ họ tên, địa chỉ của người kê đơn thuốc, họ tên người sử dụng thuốc phù hợp với họ tên trên thẻ lên tàu bay của hành khách;
b) Sữa, thức ăn dành cho trẻ em, trẻ sơ sinh phải có trẻ em, trẻ sơ sinh đi cùng.
3. Chất lỏng mua tại cửa hàng trong khu cách ly quốc tế, trên chuyến bay quốc tế được phép mang theo người và hành lý xách tay không giới hạn dung tích với điều kiện phải đựng trong túi nhựa an ninh được dán kín.
Mục 4
BẢO ĐẢM AN NINH CHO HOẠT ĐỘNG HÀNG KHÔNG CHUNG
Điều 50. Bảo đảm an ninh đối với tàu bay hoạt động hàng không chung
1. Bảo đảm an ninh đối với tàu bay hoạt động hàng không chung được thực hiện như đối với tàu bay vận chuyển hàng không thương mại.
2. Bảo đảm an ninh đối với tàu bay hoạt động hàng không chung đỗ ngoài cảng hàng không, sân bay thực hiện như sau:
a) Người khai thác tàu bay phải xây dựng quy định về bảo vệ tàu bay phù hợp với hoạt động khai thác của mình; phối hợp với chính quyền địa phương tổ chức bảo vệ tàu bay; bố trí lực lượng canh gác tàu bay liên tục nhằm phát hiện và ngăn chặn kịp thời người, phương tiện tiếp cận và lên tàu bay trái phép; thiết lập hệ thống hàng rào, chiếu sáng ban đêm thích hợp xung quanh khu vực tàu bay đỗ;
b) Cửa tàu bay phải được khóa hoặc niêm phong.
3. Người khai thác tàu bay hoạt động hàng không chung chịu trách nhiệm tổ chức kiểm tra an ninh hàng không đối với tàu bay trước khi cho người, đồ vật lên tàu bay và bảo đảm an ninh trong khi bay.
4. Tàu bay hoạt động hàng không chung có trọng lượng cất cánh tối đa trên 5.700 kg phải được bảo đảm an ninh như tàu bay vận chuyển hàng không thương mại.
5. Hãng hàng không thực hiện hoạt động hàng không chung vì mục đích thương mại phải xây dựng chương trình an ninh hàng không cho hoạt động khai thác của hãng. Nội dung chương trình phải quy định chi tiết các biện pháp bảo đảm an ninh hàng không, bảo vệ tàu bay của hãng trong và ngoài phạm vi cảng hàng không, sân bay; thiết lập, duy trì bộ phận bảo đảm an ninh hàng không của hãng và chỉ định người chịu trách nhiệm về toàn bộ công tác bảo đảm an ninh của hãng theo hệ thống độc lập, không kiêm nhiệm.
Điều 51. Kiểm tra, giám sát an ninh người, đồ vật đưa lên chuyến bay hoạt động hàng không chung
1. Việc kiểm tra, giám sát an ninh đối với người, đồ vật đưa lên tàu bay hoạt động hàng không chung được thực hiện bằng biện pháp thích hợp và được quy định cụ thể trong chương trình an ninh hàng không của hãng hàng không.
2. Tàu bay xuất phát từ một cảng hàng không, sân bay, người khai thác tàu bay phải gửi danh sách người, đồ vật đưa lên tàu bay cho lực lượng kiểm soát an ninh hàng không tại cảng hàng không, sân bay để thực hiện kiểm tra, giám sát an ninh hàng không trước chuyến bay.
3. Tàu bay xuất phát từ nơi nằm ngoài cảng hàng không, sân bay, người khai thác tàu bay phải tổ chức thực hiện kiểm tra, giám sát an ninh hàng không đối với người, đồ vật đưa lên tàu bay.
Mục 5
BẢO ĐẢM AN NINH HÀNG KHÔNG TẠI SÂN BAY CHUYÊN DÙNG CÓ HOẠT ĐỘNG HÀNG KHÔNG DÂN DỤNG
Điều 52. Tổ chức bảo đảm an ninh hàng không tại sân bay chuyên dùng do Bộ Công an, Bộ Quốc phòng quản lý, khai thác
1. Cục Quản lý xuất nhập cảnh chủ trì, phối hợp, hướng dẫn các đơn vị liên quan bảo đảm an ninh, trật tự tại sân bay chuyên dùng do Bộ Công an quản lý, khai thác.
2. Đối với sân bay chuyên dùng do Bộ Quốc phòng quản lý, khai thác:
a) Cục Quản lý xuất nhập cảnh phối hợp với cơ quan chuyên môn thuộc Bộ Quốc phòng hướng dẫn bảo đảm an ninh sân bay chuyên dùng; thực hiện quy chế phối hợp trong kiểm tra, thanh tra, giám sát hoạt động của sân bay chuyên dùng;
b) Đối với các vụ việc vi phạm quy định về an ninh hàng không tại sân bay chuyên dùng, lực lượng làm nhiệm vụ bảo đảm duy trì an ninh, trật tự tại sân bay xử lý ban đầu, thông báo và bàn giao cho chính quyền địa phương xử lý theo quy định của pháp luật.
Điều 53. Sân bay chuyên dùng không do Bộ Công an, Bộ Quốc phòng quản lý, khai thác
Đối với các vụ việc vi phạm quy định về an ninh hàng không tại sân bay chuyên dùng, lực lượng làm nhiệm vụ bảo đảm duy trì an ninh, trật tự tại sân bay xử lý ban đầu, thông báo và bàn giao cho chính quyền địa phương xử lý theo quy định của pháp luật.
Mục 6
BIỆN PHÁP KIỂM SOÁT AN NINH HÀNG KHÔNG TĂNG CƯỜNG
Điều 54. Thu thập thông tin về nguy cơ uy hiếp an ninh hàng không
1. Cục Quản lý xuất nhập cảnh chủ trì, phối hợp với các cơ quan thuộc Bộ Công an, Bộ Quốc phòng và các bộ, ngành liên quan thu thập, đánh giá thông tin về tình hình an ninh chính trị, trật tự an toàn xã hội; âm mưu, phương thức, thủ đoạn hoạt động của các đối tượng khủng bố, các tổ chức phản động và các loại tội phạm, âm mưu can thiệp bất hợp pháp vào hoạt động hàng không dân dụng để quyết định áp dụng biện pháp kiểm soát an ninh tăng cường cho từng cấp độ theo quy định của pháp luật.
2. Cục Quản lý xuất nhập cảnh, Cục Hàng không Việt Nam, Cảng vụ hàng không, người khai thác cảng hàng không, sân bay, hãng hàng không, đơn vị kiểm soát an ninh hàng không công bố số điện thoại đường dây nóng để tiếp nhận các thông tin liên quan đến âm mưu tấn công can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
Điều 55. Phạm vi áp dụng kiểm soát an ninh hàng không tăng cường
1. Căn cứ tình hình, nguy cơ đe doạ, rủi ro an ninh hàng không, Cục trưởng Cục Quản lý xuất nhập cảnh quyết định áp dụng, hủy bỏ việc áp dụng kiểm soát an ninh hàng không tăng cường theo cấp độ hoặc áp dụng, hủy bỏ một số biện pháp kiểm soát an ninh hàng không tăng cường phù hợp các mối đe doạ cụ thể.
2. Cục Quản lý xuất nhập cảnh xem xét chấp thuận áp dụng các biện pháp kiểm soát an ninh hàng không tăng cường thay thế có tác dụng tương tự của các nước khác đối với các chuyến bay, đường bay quốc tế đến Việt Nam.
3. Cục Quản lý xuất nhập cảnh xem xét áp dụng các biện pháp kiểm soát an ninh hàng không tăng cường theo yêu cầu của nhà chức trách nước ngoài phù hợp với điều ước quốc tế mà nước Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên.
Điều 56. Các biện pháp kiểm soát an ninh hàng không tăng cường
1. Quy trình triển khai các biện pháp kiểm soát an ninh hàng không tăng cường áp dụng cho từng cấp độ phải được quy định cụ thể trong chương trình an ninh hàng không của đơn vị kiểm soát an ninh hàng không, người khai thác cảng hàng không, sân bay, hãng hàng không, doanh nghiệp, đơn vị cung cấp dịch vụ hàng không trên cơ sở quy định tại Phụ lục XII ban hành kèm theo Thông tư này.
2. Quyết định áp dụng biện pháp kiểm soát an ninh hàng không tăng cường phải được Cục Quản lý xuất nhập cảnh và các cơ quan, đơn vị có trách nhiệm triển khai thực hiện ngay, đồng thời được báo cáo Bộ trưởng Bộ Công an.
Mục 7
CUNG CẤP, SỬ DỤNG THÔNG TIN VỀ HÀNH KHÁCH, HÀNG HÓA VÀ AN NINH HỆ THỐNG THÔNG TIN CHUYÊN NGÀNH HÀNG KHÔNG
Điều 57. Nguyên tắc sử dụng, cung cấp thông tin về nhân thân hành khách, người gửi, người nhận hàng hóa
1. Chỉ hãng hàng không liên quan đến việc vận chuyển hành khách, hàng hóa được phép khai thác, sử dụng thông tin về nhân thân hành khách, người gửi, người nhận hàng hóa, trừ trường hợp quy định tại khoản 2 Điều này.
2. Hãng hàng không có trách nhiệm bảo mật thông tin cá nhân của hành khách theo quy định của pháp luật; chỉ cung cấp thông tin về nhân thân hành khách, người gửi, người nhận hàng hóa cho cơ quan nhà nước có thẩm quyền theo yêu cầu vì mục đích phục vụ công tác quản lý nhà nước về an ninh hàng không dân dụng, bảo đảm an ninh chính trị, trật tự an toàn xã hội, phòng, chống buôn lậu, gian lận thương mại và các tội phạm hình sự khác.
Điều 58. Bảo vệ hệ thống thông tin chuyên ngành hàng không
1. Đơn vị chủ quản hệ thống thông tin chuyên ngành hàng không phải xây dựng và ban hành các quy định về bảo vệ, quản lý, sử dụng để chống lại hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng, đánh cắp và làm sai lệch thông tin, dữ liệu theo quy định của pháp luật.
2. Việc bảo vệ hệ thống thông tin chuyên ngành hàng không phải được thực hiện từ giai đoạn lựa chọn nhà cung cấp và trong quá trình xây dựng, thiết kế lắp đặt, sử dụng, vận hành, khai thác phải tuân thủ đúng quy định của pháp luật về an ninh mạng, an toàn thông tin mạng. Các biện pháp bảo vệ gồm:
a) Quản trị hệ thống thông qua việc ban hành tiêu chuẩn, quy trình, thủ tục an ninh; lựa chọn và đào tạo cán bộ, đặc biệt là những người có quyền quản trị hệ thống; đánh giá mối đe dọa và rủi ro để xác định các lỗ hổng của hệ thống và khả năng bị tấn công; kiểm tra và thử nghiệm; bảo đảm an ninh chuỗi cung ứng;
b) Kiểm soát bằng tường lửa; mã hóa dữ liệu; sử dụng hệ thống phát hiện xâm nhập mạng và hệ thống chống vi-rút;
c) Bảo vệ hệ thống, đặc biệt là các máy chủ, phải nằm trong khu vực mà việc vào, ra và hoạt động trong khu vực đó phải được kiểm soát và hạn chế; chỉ những người có thẩm quyền mới được truy cập vào hệ thống bằng phương pháp đăng nhập sinh trắc học, mật khẩu; hạn chế số lượng người có quyền truy cập; kiểm soát và giám sát liên tục việc truy cập vào hệ thống; sử dụng hệ thống sao lưu đề phòng trường hợp hệ thống chính bị trục trặc; ghi lưu các hoạt động để phục vụ kiểm tra, đánh giá và cảnh báo khi có hoạt động bất thường.
3. Chương trình an ninh hàng không, phương án khẩn nguy, phương án ứng phó không lưu của các doanh nghiệp ngành hàng không phải quy định cụ thể về bảo vệ thông tin và hệ thống công nghệ thông tin, phương án phòng ngừa, bảo đảm an ninh thông tin, phương án ứng phó khi bị tấn công can thiệp bất hợp pháp bằng kỹ thuật điện tử.
4. Đơn vị chủ quản hệ thống thông tin chuyên ngành hàng không phải thực hiện việc đánh giá nguy cơ uy hiếp an ninh hàng không, mức độ thiệt hại nếu bị tấn công, can thiệp bất hợp pháp vào các thiết bị, hệ thống thông tin của đơn vị mình để có biện pháp bảo vệ thích hợp. Việc đánh giá dựa trên tiêu chí sau:
a) Mức độ uy hiếp trực tiếp đến hoạt động điều hành bay và tàu bay đang bay;
b) Mức độ uy hiếp trực tiếp đến tính mạng hành khách, nhân viên tại cảng hàng không, sân bay;
c) Mức độ uy hiếp trực tiếp đến hoạt động bình thường của các thiết bị điều hành bay, hệ thống cơ sở hạ tầng, thiết bị bảo đảm an ninh hàng không.
5. Đơn vị chủ quản hệ thống thông tin chuyên ngành hàng không phải phối hợp với các cơ quan chuyên môn của Bộ Công an, Bộ Quốc phòng để bảo vệ, chống hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng và đánh cắp, làm sai lệch thông tin, dữ liệu; tuân thủ các quy định của pháp luật về an ninh thông tin.
Mục 8
KIỂM SOÁT AN NINH NỘI BỘ
Điều 59. Nguyên tắc kiểm soát an ninh nội bộ đối với nhân viên hàng không
1. Kiểm soát an ninh nội bộ được thực hiện thông qua việc xây dựng, duy trì, áp dụng tiêu chuẩn vị trí việc làm; nội quy, kỷ luật của cơ quan, đơn vị và công tác phối hợp với cơ quan chức năng trong phòng, chống các hành vi vi phạm pháp luật và thẩm tra xác minh nhân thân.
2. Kiểm soát an ninh nội bộ phải được thực hiện trong tất cả quy trình tuyển dụng, huấn luyện, đào tạo, quản lý, giám sát, xử lý vi phạm, đánh giá, nhận xét, bổ nhiệm, điều động của mỗi cơ quan, đơn vị; phải kết hợp chặt chẽ công tác kiểm soát an ninh nội bộ với công tác bảo vệ chính trị nội bộ.
3. Khi tuyển dụng lao động, hồ sơ dự tuyển phải có phiếu lý lịch tư pháp hoặc ý kiến của cơ quan công an hoặc chính quyền địa phương nơi cư trú về việc chấp hành pháp luật của người dự tuyển; cơ quan, đơn vị tuyển dụng tổ chức thẩm tra, xác minh lý lịch và nhân thân tại nơi cư trú và nơi họ đã làm việc trước khi quyết định tuyển dụng nếu cần. Đơn vị quản lý, sử dụng lao động định kỳ hàng năm phải đánh giá người lao động về việc chấp hành nội quy, kỷ luật lao động, pháp luật nhà nước. Khi người lao động có biểu hiện bất thường về phẩm chất đạo đức, sinh hoạt, kinh tế, ý thức chấp hành kỷ luật, nội quy của cơ quan, đơn vị thì phải xác minh làm rõ.
Điều 60. Trách nhiệm của các cơ quan, đơn vị trong công tác kiểm soát an ninh nội bộ
1. Cục An ninh kinh tế chủ trì, hướng dẫn, kiểm tra công tác bảo vệ an ninh chính trị nội bộ và kiểm soát an ninh nội bộ đối với các cơ quan, doanh nghiệp ngành hàng không; Cục Quản lý xuất nhập cảnh phối hợp với Cục An ninh kinh tế trong công tác kiểm soát an ninh nội bộ đối với nhân viên hàng không trong thời gian làm việc tại khu vực cảng hàng không và trên tàu bay, tạm đình chỉ ngay lập tức hoạt động của nhân viên hàng không có dấu hiệu vi phạm pháp luật về an ninh hàng không hoặc theo yêu cầu của cơ quan có thẩm quyền.
2. Cơ quan, doanh nghiệp quản lý sử dụng nhân viên hàng không có trách nhiệm phối hợp với Cục An ninh kinh tế trong công tác bảo vệ an ninh chính trị nội bộ và kiểm soát an ninh nội bộ; phối hợp với Cục Quản lý xuất nhập cảnh và các cơ quan công an liên quan thực hiện công tác kiểm soát an ninh nội bộ; ban hành quy định về kiểm soát an ninh nội bộ theo các nội dung sau:
a) Xác minh và định kỳ hàng năm thực hiện đánh giá nhân thân đối với nhân viên hàng không theo quy định tại khoản 3 Điều 59 của Thông tư này và giám sát quá trình thực hiện nhiệm vụ của nhân viên thuộc đơn vị mình;
b) Nâng cao ý thức chấp hành kỷ luật, phẩm chất đạo đức của cán bộ, nhân viên trong cơ quan, đơn vị;
c) Kiểm soát chặt chẽ việc đi lại, mang đồ vật ra, vào khu vực hạn chế, lên, xuống tàu bay; hoạt động thực hiện nhiệm vụ của nhân viên trong các khu vực hạn chế;
d) Quy định người hoặc bộ phận chuyên trách hoặc kiêm nhiệm bảo đảm thực hiện hiệu quả công tác kiểm soát an ninh nội bộ, lập hồ sơ quản lý nhân viên; phối hợp chặt chẽ với Cục Quản lý xuất nhập cảnh và cơ quan công an, chính quyền địa phương để trao đổi, nắm bắt thông tin liên quan đến người lao động; kịp thời phát hiện, xử lý các trường hợp vi phạm kỷ luật lao động, vi phạm pháp luật và khắc phục thiếu sót;
đ) Xây dựng các tiêu chí để tuyển dụng, bố trí sắp xếp phù hợp đối với từng loại nhân viên hàng không; phối hợp với cơ quan an ninh có thẩm quyền để kiểm tra nhân thân đối với nhân viên hàng không là người nước ngoài.
3. Cơ quan, đơn vị quản lý, sử dụng người lao động vào và hoạt động trong khu vực hạn chế, công trình quan trọng liên quan đến an ninh quốc gia, mục tiêu quan trọng về chính trị, kinh tế, ngoại giao, khoa học - kỹ thuật, văn hóa, xã hội theo quy định của pháp luật thì phải chịu trách nhiệm nếu người lao động do mình quản lý có hành vi vi phạm pháp luật trong quá trình làm việc.
Chương III
XỬ LÝ VỤ VIỆC VI PHẠM AN NINH HÀNG KHÔNG VÀ ĐỐI PHÓ VỚI HÀNH VI CAN THIỆP BẤT HỢP PHÁP
Mục 1
XỬ LÝ VỤ VIỆC VI PHẠM AN NINH HÀNG KHÔNG
Điều 61. Nguyên tắc xử lý vi phạm
1. Mọi vụ việc vi phạm an ninh hàng không phải được xử lý kịp thời, nhanh chóng, không để vi phạm lan rộng và hạn chế tới mức thấp nhất hậu quả xảy ra. Việc xử lý phải căn cứ vào tính chất, mức độ vi phạm do hành vi vi phạm gây ra và tuân thủ các quy định của pháp luật hiện hành. Việc lên tàu bay của lực lượng kiểm soát an ninh hàng không để trấn áp, cưỡng chế, áp giải đối tượng vi phạm được thực hiện theo yêu cầu của người chỉ huy tàu bay hoặc người đứng đầu đơn vị kiểm soát an ninh hàng không trừ trường hợp đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
2. Lực lượng kiểm soát an ninh hàng không bố trí nơi xử lý, giải quyết vụ việc vi phạm; bảo đảm việc xử lý vi phạm nhanh chóng, an toàn, thuận tiện và hạn chế đến mức thấp nhất việc gây ách tắc làm ảnh hưởng đến các hoạt động bình thường của cảng hàng không, sân bay và chuyến bay.
3. Lực lượng kiểm soát an ninh hàng không chủ trì phối hợp với các cơ quan, đơn vị liên quan hoạt động tại cảng hàng không, sân bay để thống nhất những vấn đề cụ thể trong phối hợp xử lý vi phạm về an ninh hàng không, trật tự công cộng tại cảng hàng không, sân bay và giải quyết những vướng mắc phát sinh trong quá trình phối hợp theo quy định của pháp luật. Doanh nghiệp cung cấp dịch vụ hàng không phối hợp với lực lượng công an, chính quyền địa phương trong xử lý vi phạm về an ninh hàng không xảy ra tại khu vực nằm ngoài cảng hàng không, sân bay trong phạm vi quản lý của doanh nghiệp và trao đổi với đơn vị kiểm soát an ninh hàng không.
4. Đơn vị kiểm soát an ninh hàng không, các doanh nghiệp có lực lượng kiểm soát an ninh hàng không phải tổ chức trực ban 24/24 giờ, công bố số máy điện thoại trực để tiếp nhận thông tin và xử lý kịp thời vụ việc vi phạm an ninh hàng không, trật tự công cộng.
5. Hồ sơ, thủ tục, biên bản, quyết định xử lý vi phạm phải được lập và lưu giữ theo quy định của pháp luật.
Điều 62. Trách nhiệm xử lý đối với vụ việc vi phạm an ninh hàng không
1. Lực lượng kiểm soát an ninh hàng không chịu trách nhiệm xử lý ban đầu các vụ việc vi phạm an ninh hàng không, trật tự công cộng xảy ra tại cảng hàng không, sân bay thuộc quyền quản lý như sau:
a) Ngăn chặn hành vi vi phạm; tạm giữ đối tượng vi phạm;
b) Kiểm tra, lục soát, thu giữ tang vật, chứng cứ;
c) Đưa người, tang vật vi phạm về nơi quy định để giải quyết, xử lý vi phạm;
d) Báo cáo ngay cho chỉ huy đơn vị trực ca công tác, lập biên bản vi phạm theo mẫu quy định tại Phụ lục XVIII ban hành kèm theo Thông tư này;
đ) Bảo vệ hiện trường và trao đổi các cơ quan, đơn vị liên quan tại cảng hàng không, sân bay nếu xét thấy cần thiết;
2. Các cơ quan, đơn vị, cá nhân có liên quan có trách nhiệm phối hợp chặt chẽ với đơn vị kiểm soát an ninh hàng không trong quá trình xử lý các vụ việc vi phạm an ninh hàng không.
3. Đối với tàu bay đang khai thác, tàu bay đang bay, quy trình xử lý vi phạm thực hiện theo khoản 2, 3, 4 và 5 Điều 37 của Thông tư này. Sĩ quan an ninh trên không hoạt động bí mật, không tham gia xử lý vụ việc vi phạm an ninh hàng không.
4. Lực lượng kiểm soát an ninh hàng không làm nhiệm vụ tại cơ sở nằm ngoài cảng hàng không, sân bay chịu trách nhiệm xử lý ban đầu đối với vụ việc vi phạm an ninh hàng không xảy ra tại cơ sở do mình quản lý; quy trình xử lý theo quy định tại các điểm a, b, c và đ khoản 1 Điều này; lập hồ sơ ban đầu (biên bản vi phạm theo mẫu quy định tại Phụ lục XVIII ban hành kèm theo Thông tư này), bàn giao hồ sơ, bằng chứng, tang vật, người vi phạm cho cơ quan chức năng tại địa phương và phối hợp xử lý tiếp theo đối với các vụ việc vi phạm an ninh hàng không.
5. Đơn vị kiểm soát an ninh hàng không có trách nhiệm cử người trực tiếp đến ngay địa điểm đang giải quyết vi phạm khi nhận được thông báo theo quy định tại điểm d khoản 1 Điều này để giám sát việc xử lý ban đầu, đánh giá tính chất, mức độ vi phạm, thẩm quyền giải quyết vụ việc và quyết định việc xử lý tiếp theo như sau:
a) Trường hợp vi phạm xét thấy chưa tới mức xử phạt hành chính thì tiếp nhận vụ việc và có văn bản yêu cầu cơ quan có người vi phạm xem xét, xử lý kỷ luật đối với người vi phạm và thông báo kết quả xử lý cho đơn vị kiểm soát an ninh hàng không;
b) Trường hợp vi phạm thuộc thẩm quyền xử phạt hành chính của đơn vị kiểm soát an ninh hàng không thì tiến hành các công việc cần thiết để xử phạt vi phạm hành chính theo quy định;
c) Trường hợp vi phạm thuộc thẩm quyền xử phạt hành chính của Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh thì đơn vị kiểm soát an ninh hàng không bàn giao để xử phạt vi phạm hành chính theo quy định;
d) Trường hợp vi phạm có dấu hiệu hình sự thì đơn vị kiểm soát an ninh hàng không bàn giao cho cơ quan công an có thẩm quyền;
đ) Trường hợp vi phạm thuộc thẩm quyền xử phạt hành chính của cơ quan nhà nước có thẩm quyền khác thì đơn vị kiểm soát an ninh hàng không bàn giao cho cơ quan có thẩm quyền để xử lý;
e) Trong trường hợp vi phạm hành chính thuộc thẩm quyền xử phạt của nhiều cơ quan thì thực hiện theo quy định của pháp luật về xử lý vi phạm hành chính.
6. Khi bàn giao vụ việc cho cơ quan nhà nước có thẩm quyền khác, đơn vị kiểm soát an ninh hàng không lập biên bản bàn giao theo mẫu quy định tại Phụ lục XVIII ban hành kèm theo Thông tư này và phối hợp thực hiện các biện pháp dẫn giải, giữ người, phương tiện, tang vật vi phạm khi được yêu cầu.
7. Đơn vị kiểm soát an ninh hàng không, các doanh nghiệp có lực lượng kiểm soát an ninh hàng không nội bộ phải trang bị máy ghi hình, máy ghi âm, máy ảnh, ống nhòm và các thiết bị hỗ trợ phù hợp khác để ngăn chặn kịp thời hành vi vi phạm và ghi nhận, thu thập toàn bộ diễn biến của vụ việc vi phạm một cách chính xác, đầy đủ, phục vụ cho việc xử lý được nhanh chóng, đúng người, đúng tính chất, mức độ vi phạm và đúng quy định của pháp luật hiện hành.
8. Đơn vị kiểm soát an ninh hàng không, đơn vị kiểm soát an ninh hàng không nội bộ của hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp bảo dưỡng, sửa chữa tàu bay và các doanh nghiệp khác hoạt động tại cảng hàng không, sân bay phải trang bị máy điện thoại có chức năng hiển thị, lưu số gọi đến, gọi đi và ghi âm với thời gian tối thiểu 03 giờ đồng hồ cho các số điện thoại trực ban, trực khẩn nguy, đường dây nóng, giải đáp thông tin cho hành khách. Các đơn vị phải sử dụng dịch vụ thông báo nhanh số máy gọi đi, gọi đến các số máy điện thoại của đơn vị để kịp thời tra cứu khi nhận được thông tin đe dọa qua điện thoại; thiết lập hòm thư tiếp nhận các thông tin về các vụ việc vi phạm, các hành vi can thiệp bất hợp pháp.
Điều 63. Giảng bình, rút kinh nghiệm vụ việc vi phạm
1. Vụ việc vi phạm an ninh hàng không phải được rút kinh nghiệm, giảng bình để khắc phục những sơ hở, thiếu sót:
a) Căn cứ tính chất, mức độ của từng vụ việc vi phạm xảy ra tại cảng hàng không, sân bay, đơn vị có chức năng giám sát an ninh hàng không quyết định giao cho cơ quan, đơn vị thích hợp chủ trì tổ chức rút kinh nghiệm, giảng bình cấp cơ sở hoặc lực lượng giám sát an ninh hàng không chủ trì tổ chức rút kinh nghiệm, giảng bình;
b) Đơn vị chủ quản cơ sở nằm ngoài cảng hàng không chủ trì tổ chức rút kinh nghiệm, giảng bình đối với vụ việc vi phạm xảy ra tại cơ sở của mình;
c) Cục Quản lý xuất nhập cảnh chủ trì tổ chức rút kinh nghiệm, giảng bình cấp ngành đối với vụ việc vi phạm nghiêm trọng, phức tạp hoặc theo yêu cầu của Bộ Công an, Ủy ban An ninh hàng không dân dụng quốc gia.
2. Thời gian tổ chức rút kinh nghiệm, giảng bình phải được tiến hành sớm nhất có thể, chậm nhất không quá 05 ngày làm việc đối với cấp cơ sở, 07 ngày làm việc đối với trường hợp đơn vị có chức năng giám sát an ninh hàng không trực tiếp tổ chức rút kinh nghiệm, giảng bình và 10 ngày làm việc đối với cấp ngành kể từ ngày xảy ra vi phạm hoặc nhận được báo cáo về vụ việc vi phạm.
3. Nội dung rút kinh nghiệm, giảng bình tối thiểu phải bao gồm:
a) Xác định nguyên nhân, đánh giá ưu điểm, hạn chế trong việc triển khai các biện pháp, quy trình xử lý của đơn vị, cá nhân liên quan trong quá trình xử lý vụ việc vi phạm;
b) Xác định nguyên nhân, đánh giá ưu điểm, hạn chế trong công tác phối hợp xử lý vụ việc vi phạm của đơn vị, cá nhân liên quan;
c) Những bất cập trong các quy định của pháp luật, chương trình an ninh hàng không và các văn bản có liên quan cần phải được bổ sung, sửa đổi;
d) Những sơ hở, thiếu sót của từng đơn vị, cá nhân liên quan, nguyên nhân và biện pháp khắc phục.
MỤC 2
ĐỐI PHÓ VỚI HÀNH VI CAN THIỆP BẤT HỢP PHÁP
Điều 64. Nguyên tắc đối phó với hành vi can thiệp bất hợp pháp
1. Việc đối phó với các hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng thực hiện theo các quy định của pháp luật và tuân thủ phương án khẩn nguy do cấp có thẩm quyền ban hành.
2. Khi nhận được thông tin về một hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng, đơn vị kiểm soát an ninh hàng không chủ trì, phối hợp với người khai thác cảng hàng không, sân bay, hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu liên quan có trách nhiệm phân tích, đánh giá sơ bộ về tính chất của thông tin, báo cáo ngay cơ quan có thẩm quyền để xem xét triển khai phương án khẩn nguy thích hợp. Trước mắt, huy động lực lượng, phương tiện của đơn vị mình tổ chức đối phó ban đầu theo quy định; trường hợp cần thiết, Cục Quản lý xuất nhập cảnh hoặc Công an cấp tỉnh trực tiếp chỉ đạo các lực lượng thực hiện phương án khẩn nguy ban đầu.
3. Mọi biện pháp đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng phải ưu tiên bảo đảm an toàn cho tàu bay và tính mạng con người. Đối với tàu bay đang bay bị can thiệp bất hợp pháp, cơ sở cung cấp dịch vụ không lưu liên quan ưu tiên trợ giúp tối đa để bảo đảm an toàn cho tàu bay trong vùng trời của Việt Nam, vùng thông báo bay do Việt Nam quản lý.
4. Sau khi kết thúc việc đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay, các cơ quan, đơn vị có trách nhiệm nhanh chóng thực hiện các biện pháp cần thiết để bảo đảm đưa cảng hàng không, sân bay trở lại hoạt động bình thường; bố trí cho hành khách tiếp tục hành trình trong thời gian sớm nhất có thể.
Điều 65. Kế hoạch khẩn nguy
1. Đơn vị kiểm soát an ninh hàng không chủ trì, phối hợp với người khai thác cảng hàng không, sân bay xây dựng kế hoạch khẩn nguy đối phó ban đầu với hành vi can thiệp bất hợp pháp trình Cục Quản lý xuất nhập cảnh phê duyệt và phải phù hợp với Phương án khẩn nguy tổng thể đối phó với hành vi can thiệp bất hợp pháp do Thủ tướng Chính phủ ban hành và Phương án khẩn nguy của Ban chỉ đạo phòng, chống khủng bố tỉnh, thành phố.
2. Doanh nghiệp chủ quản cơ sở cung cấp dịch vụ bảo đảm hoạt động bay xây dựng kế hoạch khẩn nguy của cơ sở bảo đảm hoạt động bay. Kế hoạch khẩn nguy phải phù hợp với phương án khẩn nguy tổng thể đối phó với hành vi can thiệp bất hợp pháp do Thủ tướng Chính phủ ban hành và phương án khẩn nguy của Ban chỉ đạo phòng, chống khủng bố tỉnh, thành phố.
Điều 66. Chế độ báo cáo về đối phó với hành vi can thiệp bất hợp pháp
1. Đơn vị kiểm soát an ninh hàng không chủ trì, phối hợp với người khai thác cảng hàng không, sân bay, hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu, đơn vị chủ quản của khu vực hạn chế ngoài cảng hàng không, sân bay có trách nhiệm báo cáo ban đầu bằng văn bản về Cục Quản lý xuất nhập cảnh và thông báo Cục Hàng không Việt Nam trong vòng 24 giờ kể từ thời điểm xảy ra hành vi can thiệp bất hợp pháp; báo cáo 02 lần trên 01 ngày trong thời gian đối phó với hành vi can thiệp bất hợp pháp; báo cáo sơ bộ trong vòng 24 giờ kể từ thời điểm kết thúc việc đối phó.
2. Cục Quản lý xuất nhập cảnh có trách nhiệm báo cáo Bộ Công an bằng văn bản trong vòng 24 giờ kể từ thời điểm nhận được báo cáo của đơn vị về công tác đối phó với hành vi can thiệp bất hợp pháp.
Điều 67. Quản lý thông tin và họp báo
Việc cung cấp thông tin, phát ngôn và họp báo liên quan đến hành vi can thiệp bất hợp pháp và công tác triển khai thực hiện theo quy định tại Phương án khẩn nguy tổng thể đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng do Thủ tướng Chính phủ ban hành.
Điều 68. Thông báo cho quốc gia liên quan và ICAO
1. Cục Quản lý xuất nhập cảnh có trách nhiệm thông báo những thông tin về tàu bay bị can thiệp bất hợp pháp hạ cánh trong lãnh thổ Việt Nam cho nhà chức trách hàng không của quốc gia liên quan trong thời gian sớm nhất có thể.
Thông tin bao gồm: loại tàu bay, số hiệu chuyến bay, đường bay, số lượng hành khách, tổ bay trên chuyến bay và những yêu cầu đề nghị các quốc gia liên quan trợ giúp. Thông báo được gửi tới:
a) Quốc gia nơi tàu bay đăng ký;
b) Quốc gia của nhà khai thác tàu bay;
c) Quốc gia có các công dân bị chết, bị thương hoặc bị giữ do hành vi can thiệp bất hợp pháp;
d) Quốc gia có công dân là hành khách trên tàu bay bị can thiệp bất hợp pháp;
đ) ICAO.
2. Cục Quản lý xuất nhập cảnh có trách nhiệm thông báo ICAO về các hành vi can thiệp bất hợp pháp như sau:
a) Thông báo sơ bộ theo mẫu quy định tại Phụ lục XVI ban hành kèm theo Thông tư này trong vòng 30 ngày kể từ ngày vụ việc xảy ra;
b) Thông báo chính thức theo mẫu quy định tại Phụ lục XVII ban hành kèm theo Thông tư này trong vòng 60 ngày kể từ ngày vụ việc xảy ra.
Điều 69. Diễn tập đối phó hành vi can thiệp bất hợp pháp
1. Cục Quản lý xuất nhập cảnh chủ trì phối hợp với cơ quan, đơn vị liên quan trong và ngoài ngành hàng không tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp ngành tối thiểu 03 năm một lần tại 01 cảng hàng không hoặc 01 cơ sở cung cấp dịch vụ không lưu. Cục Quản lý xuất nhập cảnh báo cáo Bộ Công an về kế hoạch tổ chức diễn tập cấp ngành.
2. Đơn vị kiểm soát an ninh hàng không, hãng hàng không Việt Nam, doanh nghiệp chủ quản cơ sở cung cấp dịch vụ bảo đảm hoạt động bay có trách nhiệm chủ trì, phối hợp với các cơ quan, đơn vị liên quan tổ chức diễn tập cấp cơ sở tại mỗi cảng hàng không, sân bay, mỗi hãng hàng không, mỗi cơ sở cung cấp dịch vụ không lưu tối thiểu 02 năm 01 lần.
3. Cơ quan, tổ chức nước ngoài có thể được mời tham quan diễn tập đối phó với các hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
Chương IV
HỆ THỐNG TỔ CHỨC BẢO ĐẢM AN NINH HÀNG KHÔNG
Điều 70. Các cơ quan, đơn vị thực hiện nhiệm vụ bảo đảm an ninh hàng không
1. Cơ quan, đơn vị tham mưu, giúp việc về bảo đảm an ninh hàng không:
a) Cục Quản lý xuất nhập cảnh thực hiện nhiệm vụ quản lý nhà nước và thực hiện nhiệm vụ bảo đảm an ninh hàng không; là văn phòng thường trực của Ủy ban An ninh hàng không dân dụng quốc gia;
b) Trung tâm An ninh hàng không quốc gia là đơn vị giúp việc Cục Quản lý xuất nhập cảnh thực hiện các nhiệm vụ quản lý nhà nước về an ninh hàng không; thực hiện chức năng kiểm tra, giám sát, hướng dẫn công tác bảo đảm an ninh hàng không trong phạm vi toàn quốc;
c) Công an cửa khẩu thuộc Cục Quản lý xuất nhập cảnh, Phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh thực hiện quản lý nhà nước về an ninh hàng không và kiểm tra, giám sát công tác bảo đảm an ninh hàng không trong phạm vi quản lý được giao;
d) Các cơ quan tham mưu, giúp việc về an ninh hàng không của các doanh nghiệp hàng không.
2. Cơ quan, đơn vị thực hiện nhiệm vụ kiểm soát an ninh hàng không:
a) Công an cửa khẩu thực hiện chức năng kiểm soát an ninh hàng không tại các cảng hàng không, sân bay do Cục Quản lý xuất nhập cảnh chủ trì, bảo đảm an ninh hàng không;
b) Phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh có cảng hàng không, sân bay được giao chủ trì, bảo đảm an ninh hàng không;
c) Đơn vị kiểm soát an ninh hàng không nội bộ của các doanh nghiệp hàng không.
Điều 71. Lực lượng kiểm soát an ninh hàng không
1. Lực lượng kiểm soát an ninh hàng không là lực lượng chuyên trách bảo đảm an ninh hàng không, có chức năng thực hiện các biện pháp bảo đảm an ninh hàng không và cung cấp dịch vụ bảo đảm an ninh hàng không theo quy định của pháp luật. Lực lượng kiểm soát an ninh hàng không trực tiếp thực hiện nhiệm vụ giám sát, các biện pháp kiểm soát an ninh hàng không, phòng ngừa, đối phó với các hành vi can thiệp bất hợp pháp và vụ việc vi phạm an ninh hàng không theo quy định, bao gồm:
a) Lực lượng kiểm soát an ninh hàng không của Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh;
b) Lực lượng kiểm soát an ninh hàng không của doanh nghiệp cung cấp dịch vụ không lưu;
c) Lực lượng kiểm soát an ninh hàng không của hãng hàng không Việt Nam, doanh nghiệp kinh doanh hàng không chung;
d) Lực lượng kiểm soát an ninh hàng không của doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay; doanh nghiệp cung cấp dịch vụ xăng dầu hàng không; doanh nghiệp cung cấp dịch vụ suất ăn hàng không.
2. Lực lượng kiểm soát an ninh hàng không có nhiệm vụ và quyền hạn theo quy định của Chính phủ về an ninh hàng không.
3. Cơ cấu tổ chức của lực lượng kiểm soát an ninh hàng không thuộc Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh do Bộ trưởng Bộ Công an quyết định; cơ cấu tổ chức của lực lượng kiểm soát an ninh hàng không của doanh nghiệp được quy định cụ thể trong chương trình an ninh hàng không của doanh nghiệp. Cục Quản lý xuất nhập cảnh hướng dẫn việc bố trí lực lượng kiểm soát an ninh hàng không để thực hiện các biện pháp bảo đảm an ninh hàng không, xử lý vi phạm, đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
4. Lực lượng kiểm soát an ninh hàng không phải được đào tạo huấn luyện nghiệp vụ phù hợp với chức danh, nhiệm vụ công việc được giao theo quy định về đào tạo, huấn luyện an ninh hàng không của Bộ trưởng Bộ Công an.
Điều 72. Cán bộ, chiến sĩ, nhân viên kiểm soát an ninh hàng không
1. Cán bộ, chiến sĩ kiểm soát an ninh hàng không:
a) Cán bộ, chiến sĩ kiểm soát an ninh hàng không gồm cán bộ, chiến sĩ thuộc Cục Quản lý xuất nhập cảnh và Phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh;
b) Cán bộ, chiến sĩ kiểm soát an ninh hàng không là người trực tiếp thực hiện các biện pháp kiểm soát an ninh hàng không, phòng ngừa, đối phó với các hành vi can thiệp bất hợp pháp và xử lý vụ việc vi phạm an ninh hàng không;
c) Cán bộ, chiến sĩ thực hiện nhiệm vụ an ninh kiểm soát, an ninh cơ động phải được tập huấn kiến thức an ninh hàng không do Bộ Công an quy định. Cán bộ, chiến sĩ thực hiện nhiệm vụ soi chiếu phải có giấy phép và năng định còn hiệu lực do Cục Quản lý xuất nhập cảnh cấp.
2. Nhân viên kiểm soát an ninh hàng không của doanh nghiệp:
a) Nhân viên kiểm soát an ninh hàng không gồm nhân viên của doanh nghiệp cung cấp dịch vụ hàng không, hãng hàng không Việt Nam, doanh nghiệp kinh doanh hàng không chung được tổ chức và hoạt động phù hợp chức năng, nhiệm vụ của doanh nghiệp;
b) Nhân viên kiểm soát an ninh hàng không của doanh nghiệp là người trực tiếp thực hiện các biện pháp kiểm soát an ninh hàng không, phòng ngừa, đối phó với các hành vi can thiệp bất hợp pháp và xử lý vụ việc vi phạm an ninh hàng không, đủ tiêu chuẩn, điều kiện theo quy định của Bộ Công an, được Cục Quản lý xuất nhập cảnh cấp giấy phép nhân viên kiểm soát an ninh hàng không theo quy định.
Điều 73. Lực lượng kiểm soát an ninh hàng không của hãng hàng không Việt Nam; doanh nghiệp cung cấp dịch vụ hàng không; doanh nghiệp kinh doanh hàng không chung
1. Nhiệm vụ, quyền hạn
a) Lực lượng kiểm soát an ninh hàng không của hãng hàng không Việt Nam, doanh nghiệp kinh doanh hàng không chung thực hiện các biện pháp kiểm soát an ninh hàng không trên tàu bay và hoạt động khai thác tàu bay bên ngoài khu vực cảng hàng không, sân bay;
b) Lực lượng kiểm soát an ninh hàng không của doanh nghiệp cung cấp dịch vụ không lưu thực hiện bảo đảm an ninh hàng không tại khu vực hạn chế của doanh nghiệp;
c) Lực lượng kiểm soát an ninh hàng không của doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay thực hiện bảo đảm an ninh hàng không tại cơ sở sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay;
d) Lực lượng kiểm soát an ninh hàng không của doanh nghiệp cung cấp dịch vụ xăng dầu hàng không, doanh nghiệp cung cấp dịch vụ suất ăn hàng không thực hiện việc bảo đảm an ninh hàng không tại các khu vực hạn chế thuộc quyền quản lý của doanh nghiệp.
2. Người đứng đầu và cấp phó của người đứng đầu phụ trách chuyên môn, nghiệp vụ về an ninh hàng không của lực lượng kiểm soát an ninh hàng không phải đáp ứng tiêu chuẩn sau:
a) Là công dân Việt Nam, có kiến thức về hàng không, an ninh hàng không và công tác liên tục tối thiểu 02 năm trong lĩnh vực an ninh hàng không;
b) Tốt nghiệp đại học ngành an ninh hoặc tốt nghiệp đại học khác và được đào tạo một trong các ngành liên quan đến an ninh hàng không, luật, quản lý hành chính nhà nước hoặc tốt nghiệp đại học về các lĩnh vực an ninh, quốc phòng do Bộ Công an, Bộ Quốc phòng đào tạo;
c) Có chứng chỉ hoặc chứng nhận hoàn thành khóa học trong nước hoặc quốc tế về bồi dưỡng nghiệp vụ quản lý an ninh hàng không.
3. Nhiệm vụ, quyền hạn của người đứng đầu lực lượng kiểm soát an ninh hàng không và lực lượng kiểm soát an ninh hàng không phải được quy định trong chương trình an ninh hàng không của hãng hàng không Việt Nam, doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay, doanh nghiệp kinh doanh hàng không chung.
Điều 74. Hệ thống quản lý an ninh hàng không của các doanh nghiệp hàng không
1. Hệ thống quản lý về an ninh hàng không của hãng hàng không Việt Nam, doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay, doanh nghiệp kinh doanh hàng không chung phải đáp ứng yêu cầu sau:
a) Độc lập về chức năng, nhiệm vụ; cơ quan tham mưu, giúp việc về an ninh hàng không không kiêm nhiệm các nhiệm vụ khác và có chức trách, thẩm quyền về mặt hành chính tương đương với các cơ quan tham mưu, giúp việc khác trong cùng doanh nghiệp;
b) Người đứng đầu hệ thống quản lý về an ninh hàng không là người chịu trách nhiệm chính trước ban điều hành doanh nghiệp về an ninh hàng không;
c) Hãng hàng không Việt Nam khai thác các chuyến bay thường lệ ở nước ngoài phải chỉ định người chịu trách nhiệm chính về công tác bảo đảm an ninh hàng không của hãng tại quốc gia đó và phải quy định trong chương trình an ninh hàng không của người khai thác tàu bay;
d) Người chịu trách nhiệm chính về an ninh hàng không, cấp phó của người chịu trách nhiệm chính về an ninh hàng không, chuyên viên, giám sát viên an ninh hàng không của hệ thống quản lý an ninh hàng không phải phù hợp với quy định về điều kiện kinh doanh dịch vụ hàng không và được đào tạo huấn luyện nghiệp vụ phù hợp với chức danh, nhiệm vụ công việc được giao theo quy định tại chương trình đào tạo, huấn luyện an ninh hàng không Việt Nam do Bộ trưởng Bộ Công an ban hành;
đ) Người chịu trách nhiệm chính về an ninh hàng không phải có đầy đủ thẩm quyền, trách nhiệm, nguồn lực để triển khai thực hiện hiệu quả chương trình an ninh hàng không và được doanh nghiệp quy định bằng văn bản;
e) Thủ trưởng cơ quan, đơn vị có chương trình an ninh hàng không quy định chức năng, nhiệm vụ cụ thể của hệ thống quản lý an ninh hàng không, bảo đảm có đầy đủ thẩm quyền, trách nhiệm, nguồn lực để triển khai thực hiện hiệu quả chương trình an ninh hàng không.
2. Các hãng hàng không nước ngoài khai thác các chuyến bay thường lệ đến và đi từ Việt Nam phải chỉ định người chịu trách nhiệm chính về an ninh hàng không của hãng tại Việt Nam và thông báo bằng văn bản cho Cục Quản lý xuất nhập cảnh.
Điều 75. Đánh giá, xếp loại chất lượng cán bộ, chiến sĩ, nhân viên kiểm soát an ninh hàng không hàng năm
1. Cán bộ, chiến sĩ kiểm soát an ninh hàng không thuộc Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh được đánh giá, xếp loại chất lượng theo quy định của Bộ Công an.
2. Nhân viên kiểm soát an ninh hàng không của các doanh nghiệp phải được đánh giá bằng văn bản của thủ trưởng đơn vị quản lý về các nội dung sau:
a) Năng lực chuyên môn nghiệp vụ;
b) Chấp hành nội quy, quy định của cơ quan, đơn vị;
c) Trách nhiệm, thái độ phục vụ trong công việc.
3. Đánh giá quy định tại khoản 2 của Điều này là căn cứ để doanh nghiệp xếp loại nhân viên kiểm soát an ninh hàng không ở 04 mức độ: hoàn thành xuất sắc, hoàn thành tốt, hoàn thành, không hoàn thành. Kết quả xếp loại là cơ sở để bố trí sắp xếp nhân viên và đào tạo, huấn luyện bổ sung nhân viên kiểm soát an ninh hàng không. Trường hợp xếp loại không hoàn thành phải đưa ra biện pháp và thời hạn khắc phục hoặc đưa ra khỏi lực lượng kiểm soát an ninh hàng không.
4. Văn bản đánh giá và xếp loại nhân viên kiểm soát an ninh hàng không phải được lưu giữ tại đơn vị chủ quản.
5. Đơn vị quản lý nhân viên kiểm soát an ninh hàng không xây dựng hướng dẫn chi tiết về việc đánh giá chất lượng nhân viên kiểm soát an ninh hàng không trong chương trình an ninh hàng không.
Chương V
CÔNG TRÌNH, TRANG BỊ, THIẾT BỊ, PHƯƠNG TIỆN VÀ VŨ KHÍ, CÔNG CỤ HỖ TRỢ PHỤC VỤ BẢO ĐẢM AN NINH HÀNG KHÔNG
Điều 76. Yêu cầu an ninh đối với việc thiết kế, xây dựng cảng hàng không, sân bay, công trình hàng không
1. Chủ đầu tư xây dựng, cải tạo nâng cấp, sửa chữa công trình hàng không, kết cấu hạ tầng cảng hàng không khi lập dự án, khảo sát, thiết kế xây dựng phải tuân thủ các yêu cầu, tiêu chuẩn về an ninh hàng không được quy định tại Thông tư này.
2. Cơ quan có thẩm quyền thẩm định, phê duyệt thiết kế kỹ thuật, thiết kế bản vẽ thi công và dự toán xây dựng, cải tạo, nâng cấp, sửa chữa công trình hàng không, kết cấu hạ tầng cảng hàng không, sân bay phải thẩm định các yêu cầu, tiêu chuẩn về an ninh hàng không bảo đảm tuân thủ quy định tại Thông tư này.
Điều 77. Các công trình, thiết bị phục vụ bảo đảm an ninh hàng không
1. Công trình, thiết bị phục vụ bảo đảm an ninh hàng không của nhà ga, sân bay bao gồm:
a) Công trình phục vụ bảo đảm an ninh hàng không sân bay: hàng rào an ninh hàng không ngăn cách khu vực hạn chế và khu vực khác, đường tuần tra, hệ thống cảnh báo xâm nhập, hệ thống chiếu sáng, bốt gác, cổng, cửa, điểm kiểm tra an ninh hàng không, hệ thống đèn chiếu sáng vị trí đỗ của tàu bay ban đêm;
b) Cổng, cửa, điểm kiểm tra an ninh hàng không tại lối đi giữa khu vực hạn chế sử dụng riêng và khu vực hạn chế không sử dụng riêng; lối đi từ khu vực khác vào khu vực hạn chế;
c) Trung tâm khẩn nguy; vị trí đỗ biệt lập cho tàu bay; hầm xử lý bom mìn, vật phẩm nguy hiểm; khu vực tập kết hành khách, hành lý, hàng hóa trong trường hợp tàu bay bị can thiệp bất hợp pháp;
d) Hệ thống ca-me-ra giám sát an ninh toàn bộ nhà ga, sân đỗ tàu bay, đường giao thông liền kề nhà ga và phòng giám sát điều khiển hệ thống ca-me-ra;
đ) Điểm (khu vực) kiểm tra an ninh hàng không đối với hành khách, hành lý, hàng hóa gồm cả phòng lục soát, kiểm tra trực quan tại nhà ga;
e) Phòng trực ban của đơn vị kiểm soát an ninh hàng không tại nhà ga; phòng quản lý hành khách bị từ chối nhập cảnh tại nhà ga quốc tế.
2. Công trình, thiết bị phục vụ bảo đảm an ninh hàng không nằm ngoài nhà ga, sân bay bao gồm:
a) Hệ thống đèn chiếu sáng vành đai; hệ thống ca-me-ra giám sát an ninh toàn bộ các khu vực hạn chế; hàng rào an ninh hàng không ngăn cách khu vực hạn chế với khu vực khác;
b) Bốt gác, cổng, cửa, điểm kiểm tra an ninh hàng không tại lối vào khu vực hạn chế từ khu vực khác.
3. Yêu cầu đối với công trình phục vụ bảo đảm an ninh hàng không:
a) Công trình phục vụ bảo đảm an ninh hàng không phải được kiểm tra, bảo dưỡng, bảo trì theo đúng tiêu chuẩn, quy chuẩn, quy định của pháp luật và phải có đầy đủ hồ sơ; khi có hư hỏng phải khắc phục kịp thời;
b) Hàng rào an ninh hàng không giữa khu vực hạn chế với khu vực khác phải có khả năng ngăn chặn, cảnh báo việc xâm nhập qua hàng rào;
c) Số lượng cổng, cửa vào khu vực hạn chế từ khu vực khác phải hạn chế ở mức tối thiểu cần thiết;
d) Bảo đảm sự tách biệt giữa hành khách, hành lý, hàng hóa, bưu gửi đã được kiểm tra an ninh hàng không với hành khách, hành lý, hàng hóa, bưu gửi chưa kiểm tra an ninh hàng không;
đ) Vị trí trung tâm khẩn nguy; vị trí đỗ biệt lập cho tàu bay; hầm xử lý bom mìn, vật phẩm nguy hiểm; khu vực tập kết hành khách, hành lý, hàng hóa trong trường hợp tàu bay bị can thiệp bất hợp pháp phải thuận tiện cho việc xử lý các tình huống khẩn cấp và thực hiện kế hoạch khẩn nguy;
e) Bảo đảm tách biệt luồng hành khách đi, đến, nối chuyến và quá cảnh; luồng hành khách, hàng hóa quốc tế và nội địa;
g) Khu vực bố trí điểm kiểm tra an ninh hàng không đối với hành khách, hành lý phải có đủ diện tích để tránh gây ùn tắc và bảo đảm thuận lợi cho việc kiểm tra, soi chiếu hành khách, hành lý;
h) Khu vực cách ly phải được ngăn cách với khu vực không phải khu vực hạn chế bằng vật liệu bền vững; ngăn cách với khu vực hạn chế khác bằng vật liệu phù hợp;
i) Sử dụng nguyên vật liệu phù hợp nhằm giảm thiểu tối đa những tổn thất, thiệt hại đối với người, thiết bị của nhà ga, sân bay khi xảy ra cháy, nổ;
k) Các cảng hàng không, sân bay xây dựng công trình phục vụ bảo đảm an ninh hàng không phải đáp ứng đầy đủ theo quy định tại khoản 1 Điều này.
4. Yêu cầu, tiêu chuẩn về hàng rào an ninh hàng không, cổng, cửa, rào chắn, hệ thống chiếu sáng, hệ thống ca-me-ra giám sát, bốt gác, đường tuần tra tại cảng hàng không, sân bay, cơ sở cung cấp dịch vụ hàng không được quy định tại Phụ lục VII ban hành kèm theo Thông tư này.
Điều 78. Thiết bị, phương tiện bảo đảm an ninh hàng không
1. Thiết bị, phương tiện bảo đảm an ninh hàng không bao gồm:
a) Máy soi, cổng từ, thiết bị soi chiếu cơ thể, ca-me-ra giám sát an ninh hàng không, thiết bị cảnh báo xâm nhập, thiết bị phát hiện kim loại cầm tay; thiết bị, dụng cụ chuyên dụng phát hiện chất nổ, vũ khí, vật phẩm nguy hiểm;
b) Phương tiện sử dụng cho tuần tra; thiết bị ghi âm, ghi hình, quan sát, nhận dạng, phát hiện giấy tờ, tài liệu giả chuyên dụng; thiết bị sử dụng cho việc cấp thẻ, giấy phép kiểm soát an ninh hàng không;
c) Phương tiện, thiết bị thông tin liên lạc phục vụ chỉ huy, điều hành, đối phó với hành vi can thiệp bất hợp pháp; mũ, áo giáp và các trang bị, công cụ chuyên dụng cho đối phó với hành vi can thiệp bất hợp pháp; hầm, thiết bị phục vụ xử lý bom, mìn, vật phẩm nguy hiểm; địa điểm xử lý chất hóa học, phóng xạ, sinh học;
d) Dụng cụ, thiết bị sử dụng cho thử nghiệm, đào tạo, huấn luyện an ninh hàng không; vũ khí, công cụ hỗ trợ.
2. Yêu cầu đối với thiết bị, phương tiện bảo đảm an ninh hàng không:
a) Thiết bị, phương tiện quy định tại khoản 1 Điều này phải đáp ứng các quy chuẩn, tiêu chuẩn theo quy định của pháp luật;
b) Máy soi, cổng từ, thiết bị soi chiếu cơ thể, thiết bị phát hiện kim loại cầm tay phải có bộ mẫu thử phù hợp với tính năng kỹ thuật và hướng dẫn của nhà sản xuất;
c) Hệ thống thiết bị sử dụng cho việc cấp thẻ, giấy phép kiểm soát an ninh hàng không phải bảo đảm tính đồng bộ, thống nhất trong toàn ngành;
d) Thiết bị, phương tiện quy định tại khoản 1 Điều này phải có đầy đủ hồ sơ, lý lịch; hệ thống máy soi phải được cấp phép an toàn bức xạ của cơ quan có thẩm quyền;
đ) Khi đầu tư mới thiết bị an ninh hàng không, phải bảo đảm thiết bị đáp ứng công nghệ tiên tiến trên thế giới. Các điểm kiểm tra an ninh hàng không cần có thiết bị soi chiếu cơ thể phải được trang bị đầy đủ theo quy định.
3. Cục Quản lý xuất nhập cảnh hướng dẫn cụ thể về yêu cầu, danh mục trang thiết bị, phương tiện, công cụ, dụng cụ bảo đảm an ninh hàng không. Lực lượng kiểm soát an ninh hàng không thuộc Cục Quản lý xuất nhập cảnh và Công an cấp tỉnh chịu trách nhiệm quản lý, sử dụng thiết bị, phương tiện bảo đảm an ninh hàng không tại cảng hàng không, sân bay.
Điều 79. Quy định về khai thác, bảo trì thiết bị, phương tiện an ninh hàng không
1. Khai thác, quản lý, bảo trì thiết bị, phương tiện bảo đảm an ninh hàng không phải tuân thủ theo quy định của nhà sản xuất và đơn vị khai thác, sử dụng thiết bị, phương tiện; phải có sổ sách hoặc văn bản điện tử theo dõi các hỏng hóc và việc sửa chữa, bảo trì thiết bị, phương tiện.
2. Dữ liệu hình ảnh từ máy soi, ca-me-ra giám sát an ninh phải được lưu giữ tối thiểu 45 ngày.
3. Máy soi, cổng từ, thiết bị soi chiếu cơ thể, thiết bị phát hiện kim loại cầm tay phải được kiểm tra bằng bộ mẫu thử phù hợp với tính năng kỹ thuật và hướng dẫn của nhà sản xuất.
a) Đối với máy soi: yêu cầu kiểm tra, các bước tiến hành kiểm tra, ghi chép kết quả kiểm tra theo mẫu quy định tại Phụ lục XIII ban hành kèm theo Thông tư này;
b) Đối với cổng từ, thiết bị soi chiếu cơ thể: yêu cầu kiểm tra, cách thức kiểm tra, ghi chép kết quả kiểm tra theo mẫu quy định tại Phụ lục XIV ban hành kèm theo Thông tư này hoặc theo hướng dẫn của nhà sản xuất;
c) Đối với thiết bị phát hiện kim loại cầm tay: yêu cầu kiểm tra, cách thức kiểm tra, ghi chép kết quả kiểm tra theo mẫu quy định tại Phụ lục XV ban hành kèm theo Thông tư này;
4. Máy soi, cổng từ, thiết bị soi chiếu cơ thể, thiết bị phát hiện kim loại cầm tay, thiết bị phát hiện chất nổ, ca-me-ra giám sát an ninh, hệ thống cảnh báo xâm nhập phải định kỳ bảo dưỡng theo quy định của nhà sản xuất để bảo đảm các thiết bị hoạt động ổn định. Thiết bị an ninh hàng không khi kiểm tra không đạt tiêu chuẩn phải ngừng khai thác sử dụng. Sổ hoặc văn bản điện tử kiểm tra, bảo dưỡng định kỳ, sửa chữa đột xuất phải được ghi chép, cập nhật rõ ràng, chính xác và phải có các thông tin sau:
a) Tên thiết bị, vị trí, người, thời gian lắp đặt;
b) Ngày, tháng, năm tiến hành kiểm tra, bảo dưỡng; nội dung, kết quả kiểm tra, bảo dưỡng; tên nhân viên kỹ thuật tiến hành kiểm tra, bảo dưỡng.
5. Các cơ quan, đơn vị quản lý khai thác thiết bị an ninh hàng không có trách nhiệm báo cáo Cục Quản lý xuất nhập cảnh về công tác quản lý thiết bị an ninh hàng không định kỳ hàng năm theo quy định tại Phụ lục XXI ban hành kèm theo Thông tư này.
6. Đơn vị quản lý khai thác thiết bị an ninh hàng không chịu trách nhiệm ban hành quy trình quản lý, vận hành, kiểm tra, bảo dưỡng thiết bị an ninh hàng không.
Điều 80. Quản lý, trang bị, sử dụng vũ khí, công cụ hỗ trợ
1. Những đối tượng dưới đây được trang bị, sử dụng vũ khí quân dụng khi làm nhiệm vụ:
a) Lực lượng kiểm soát an ninh hàng không khi đối phó với hành vi can thiệp bất hợp pháp xảy ra tại cảng hàng không, sân bay, trên tàu bay;
b) Lực lượng kiểm soát an ninh hàng không khi làm nhiệm vụ trong thời gian thực hiện các biện pháp bảo đảm an ninh hàng không tăng cường cấp độ 1, cấp độ 2 và cấp độ 3;
c) Lực lượng an ninh cơ động, kiểm soát an ninh làm nhiệm vụ tuần tra, canh gác ban đêm; hạ sĩ quan, chiến sĩ nghĩa vụ thực hiện nhiệm vụ tuần tra, bảo vệ mục tiêu, cổng, vọng gác tại cảng hàng không, sân bay;
d) Sĩ quan an ninh trên không khi thực hiện nhiệm vụ được trang bị súng và đạn phù hợp sử dụng trên tàu bay.
2. Đối tượng được phép trang bị, sử dụng công cụ hỗ trợ:
a) Đối tượng nêu tại các điểm a, b, và d khoản 1 Điều này được trang bị, sử dụng một hoặc một số công cụ hỗ trợ sau: mũ chống đạn, áo chống đạn; lá chắn, găng tay điện; lựu đạn hơi cay; súng bắn hơi cay, súng bắn đạn nhựa, cao su; các loại phương tiện xịt hơi cay, gây mê; dùi cui điện, dùi cui kim loại, dùi cui cao su, khóa số tám;
b) Lực lượng kiểm soát an ninh hàng không, hạ sĩ quan, chiến sĩ nghĩa vụ khi thực hiện nhiệm vụ tuần tra, canh gác tại khu vực đường cất hạ cánh, đường lăn, cổng, cửa vào, ra tiếp giáp sân bay, khu vực hạn chế, khu vực công cộng (nhà ga, bãi đỗ xe) được trang bị, sử dụng một hoặc một số công cụ hỗ trợ sau: súng bắn hơi cay, súng bắn đạn nhựa, cao su; dùi cui điện, dùi cui kim loại, dùi cui cao su, khóa số tám;
c) Lực lượng kiểm soát an ninh hàng không thực hiện nhiệm vụ tăng cường đảm bảo an ninh cho chuyến bay, cưỡng chế, áp giải hành khách gây rối, hành khách bị từ chối nhập cảnh được trang bị, sử dụng một hoặc một số công cụ hỗ trợ sau: súng bắn hơi cay, súng bắn đạn nhựa, cao su; dùi cui điện, dùi cui kim loại, dùi cui cao su, khóa số tám;
d) Trưởng ca trực khi thực hiện nhiệm vụ tại điểm kiểm tra an ninh hàng không đối với hành khách, hành lý, hàng hóa được trang bị, sử dụng một hoặc một số công cụ hỗ trợ sau: súng bắn hơi cay; dùi cui điện, dùi cui kim loại, dùi cui cao su;
đ) Lực lượng kiểm soát an ninh hàng không khi thực hiện nhiệm vụ kiểm tra, giám sát, áp tải hàng hóa ngoài phạm vi cảng hàng không, sân bay được trang bị, sử dụng một hoặc một số công cụ hỗ trợ sau: dùi cui điện, dùi cui kim loại, dùi cui cao su.
3. Bảo quản vũ khí, công cụ hỗ trợ:
a) Cán bộ, chiến sĩ, nhân viên kiểm soát an ninh hàng không được trang bị, sử dụng vũ khí, công cụ hỗ trợ khi làm nhiệm vụ phải nghiêm chỉnh chấp hành chế độ kiểm tra, bảo quản vũ khí, công cụ hỗ trợ được trang bị. Khi hoàn thành nhiệm vụ hoặc kết thúc ca trực phải bàn giao vũ khí, công cụ hỗ trợ cho người có trách nhiệm để quản lý hoặc bàn giao cho người trực ca sau. Việc bàn giao vũ khí, công cụ hỗ trợ phải đảm bảo chặt chẽ và cập nhật vào sổ hoặc văn bản điện tử, có chữ ký của người nhận và người giao;
b) Đối với vũ khí, công cụ hỗ trợ sử dụng thường xuyên, đơn vị được trang bị vũ khí, công cụ hỗ trợ phải có tủ đựng vũ khí, công cụ hỗ trợ riêng biệt, duy trì chế độ bảo dưỡng hàng ngày và tổ chức kiểm tra chất lượng bảo quản vào cuối tuần;
c) Đối với vũ khí, công cụ hỗ trợ không sử dụng thường xuyên phải bố trí người chuyên trách bảo quản, phải có kho, tủ riêng để bảo quản. Kho bảo quản vũ khí, công cụ hỗ trợ phải bảo đảm các yêu cầu kỹ thuật an toàn phòng, chống cháy, nổ, có nội quy ra, vào kho; vũ khí, công cụ hỗ trợ bảo quản trong kho phải được sắp xếp hợp lý, để riêng từng chủng loại, nhãn hiệu. Các cơ quan, đơn vị phải thực hiện việc kiểm tra kỹ thuật, tiến hành bảo dưỡng theo đúng định kỳ và quy trình bảo dưỡng của nhà sản xuất;
d) Người được giao chuyên trách bảo quản vũ khí, công cụ hỗ trợ phải có phẩm chất đạo đức tốt, có trách nhiệm; đã qua lớp đào tạo, huấn luyện cơ bản về bảo quản, sử dụng vũ khí, công cụ hỗ trợ; chấp hành nghiêm chỉnh chế độ kiểm tra, bảo quản và có sổ sách hoặc dữ liệu điện tử theo dõi việc bảo quản vũ khí, công cụ hỗ trợ.
4. Người được trang bị, sử dụng vũ khí, công cụ hỗ trợ phải có chứng chỉ hoặc chứng nhận về quản lý, sử dụng vũ khí, vật liệu nổ, công cụ hỗ trợ của cơ quan có thẩm quyền cấp.
5. Các cơ quan, đơn vị được trang bị vũ khí, công cụ hỗ trợ tổng hợp có trách nhiệm báo cáo Cục Quản lý xuất nhập cảnh về công tác quản lý vũ khí và công cụ hỗ trợ và đào tạo, huấn luyện về bảo quản, sử dụng vũ khí, công cụ hỗ trợ, chi tiết báo cáo theo quy định tại Phụ lục XXII ban hành kèm theo Thông tư này;
6. Đối tượng được trang bị sử dụng vũ khí, công cụ hỗ trợ phải chấp hành các quy định chuyên ngành về quản lý, sử dụng, bảo quản, kiểm tra, bảo dưỡng vũ khí, công cụ hỗ trợ. Cơ quan, đơn vị quản lý, sử dụng vũ khí, công cụ hỗ trợ chịu trách nhiệm ban hành quy định quản lý, sử dụng, bảo quản, kiểm tra, bảo dưỡng vũ khí, công cụ hỗ trợ trong chương trình an ninh hàng không.
Chương VI
QUẢN LÝ RỦI RO AN NINH HÀNG KHÔNG
Điều 81. Quản lý rủi ro về an ninh hàng không
1. Rủi ro an ninh hàng không là xác suất thực hiện hoàn thành hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng đối với mục tiêu cụ thể, dựa trên đánh giá về đe dọa, hậu quả và yếu điểm hoặc hạn chế.
2. Quản lý rủi ro về an ninh hàng không là các giải pháp tổng thể trong hệ thống các hoạt động hàng không nhằm giảm thiểu rủi ro đến mức thấp nhất, bao gồm: đánh giá rủi ro, thực hiện các biện pháp an ninh phòng ngừa và điều chỉnh các biện pháp đã được áp dụng.
3. Việc xây dựng, áp dụng các quy định, giải pháp, quy trình, thủ tục, quy chuẩn, tiêu chuẩn về an ninh hàng không, chương trình an ninh hàng không, kế hoạch khẩn nguy hoặc xây dựng các kế hoạch, phương án trong bảo đảm an ninh hàng không, đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng, các hoạt động kiểm soát chất lượng an ninh hàng không phải dựa trên rủi ro an ninh hàng không.
4. Các cơ quan, đơn vị, doanh nghiệp được pháp luật quy định có trách nhiệm trong công tác bảo đảm an ninh hàng không phải thực hiện quản lý rủi ro an ninh hàng không trong phạm vi trách nhiệm của mình theo quy định của pháp luật và hướng dẫn của Cục Quản lý xuất nhập cảnh; xây dựng báo cáo đánh giá rủi ro an ninh hàng không định kỳ 06 tháng hoặc đột xuất (khi phát hiện các mối đe dọa, các hạn chế, tồn tại trong công tác bảo đảm an ninh hàng không tiềm ẩn nguy cơ cao hoặc khi cần xem xét, điều chỉnh phương án kiểm soát an ninh hàng không), rà soát, sửa đổi, bổ sung báo cáo đánh giá rủi ro và thông báo đến cơ quan, đơn vị được đề cập trong báo cáo để áp dụng biện pháp giảm thiểu rủi ro phù hợp.
5. Cục Quản lý xuất nhập cảnh chỉ đạo tổ chức công tác quản lý rủi ro an ninh hàng không đối với các cơ quan, đơn vị liên quan; phối hợp với các cơ quan liên quan, thu thập thông tin, xây dựng báo cáo đánh giá, thực hiện quản lý rủi ro an ninh hàng không. Kết quả đánh giá rủi ro an ninh hàng không phải báo cáo Bộ Công an, Ủy ban An ninh hàng không dân dụng quốc gia theo quy định.
6. Đơn vị kiểm soát an ninh hàng không chủ trì, phối hợp với các cơ quan, đơn vị liên quan đánh giá và xác định mức độ rủi ro an ninh hàng không tại cảng hàng không, sân bay định kỳ 06 tháng một lần hoặc đột xuất.
7. Hội đồng đánh giá rủi ro an ninh hàng không quốc gia do Ủy ban an ninh hàng không dân dụng quốc gia thành lập. Hội đồng đánh giá rủi ro an ninh hàng không ở các cảng hàng không, sân bay do đơn vị kiểm soát an ninh hàng không thành lập. Các thành viên của hội đồng đánh giá rủi ro về an ninh hàng không hoạt động theo chế độ kiêm nhiệm.
Chương VII
KIỂM SOÁT CHẤT LƯỢNG AN NINH HÀNG KHÔNG
Điều 82. Nguyên tắc về kiểm soát chất lượng an ninh hàng không
1. Cục Quản lý xuất nhập cảnh tổ chức thực hiện giám sát thường xuyên, kiểm tra, đánh giá, thử nghiệm công khai, bí mật, điều tra tại tất cả các cảng hàng không, sân bay, cơ sở cung cấp dịch vụ hàng không, hãng hàng không và các phương tiện, trang bị, thiết bị hoạt động hàng không dân dụng trong phạm vi toàn quốc. Công an cửa khẩu thuộc Cục Quản lý xuất nhập cảnh và Phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh có cảng hàng không, sân bay tổ chức thực hiện giám sát thường xuyên, kiểm tra, đánh giá, điều tra tại cảng hàng không, sân bay, cơ sở cung cấp dịch vụ hàng không, hãng hàng không và các phương tiện, trang bị, thiết bị hoạt động hàng không dân dụng trong phạm vi quản lý. Các doanh nghiệp có chương trình an ninh hàng không (trừ người khai thác cảng hàng không, sân bay) thực hiện kiểm tra, thử nghiệm công khai, bí mật, điều tra nội bộ và đánh giá theo quy định. Đơn vị thực hiện các biện pháp kiểm soát chất lượng an ninh hàng không phải độc lập với chủ thể áp dụng các biện pháp đó.
2. Hoạt động giám sát thường xuyên, kiểm tra, thử nghiệm, đánh giá, điều tra an ninh hàng không được thực hiện theo kế hoạch hoạt động kiểm soát chất lượng hàng năm hoặc đột xuất. Không thực hiện thử nghiệm đối với tàu bay đang bay hoặc chuyến bay chuyên cơ, chuyên khoang.
3. Kế hoạch hoạt động kiểm soát chất lượng an ninh hàng không hàng năm bao gồm các hoạt động giám sát thường xuyên, kiểm tra, thử nghiệm, đánh giá được xây dựng căn cứ vào đánh giá rủi ro an ninh hàng không, nguồn lực của cơ quan, đơn vị và phải bảo đảm tính thống nhất không chồng chéo, tính bí mật đối với hoạt động thử nghiệm bí mật. Việc xây dựng kế hoạch thực hiện như sau:
a) Hàng năm trước ngày 30 tháng 10, Cục Quản lý xuất nhập cảnh ban hành kế hoạch kiểm soát chất lượng an ninh hàng không năm sau và gửi các đơn vị, doanh nghiệp có chương trình an ninh hàng không;
b) Hàng năm trước ngày 30 tháng 11, căn cứ kế hoạch kiểm soát chất lượng an ninh hàng không của Cục Quản lý xuất nhập cảnh, hãng hàng không, cơ quan, đơn vị và doanh nghiệp có chương trình an ninh hàng không xây dựng và ban hành kế hoạch kiểm soát chất lượng an ninh hàng không nội bộ, gửi báo cáo Cục Quản lý xuất nhập cảnh để giám sát.
4. Hoạt động thanh tra, kiểm tra, thử nghiệm, đánh giá và hoạt động điều tra đột xuất do người có thẩm quyền quyết định khi xét thấy cần thiết.
5. Cục Quản lý xuất nhập cảnh ban hành sổ tay kiểm soát chất lượng an ninh hàng không để triển khai thực hiện hiệu quả, thống nhất.
6. Cơ quan, đơn vị quản lý người có hành vi vi phạm, quản lý thiết bị không đảm bảo tiêu chuẩn an ninh hàng không chịu trách nhiệm đình chỉ hoạt động của người vi phạm, thiết bị không bảo đảm tiêu chuẩn theo yêu cầu của trưởng đoàn kiểm tra, thử nghiệm, điều tra.
7. Các đơn vị, doanh nghiệp thực hiện thống kê, tổng hợp, phân tích dữ liệu kiểm soát chất lượng an ninh hàng không để cập nhật vào hệ thống cơ sở dữ liệu an ninh hàng không theo quy định tại Điều 87 và Điều 88 của Thông tư này.
Điều 83. Yêu cầu đối với hoạt động kiểm tra, thử nghiệm, đánh giá, điều tra an ninh hàng không
1. Yêu cầu đối với hoạt động kiểm tra, đánh giá, thử nghiệm, điều tra của Cục Quản lý xuất nhập cảnh, Công an cửa khẩu thuộc Cục Quản lý xuất nhập cảnh và Phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh có cảng hàng không, sân bay:
a) Có quyết định thành lập đoàn của người có thẩm quyền. Kế hoạch kiểm tra, đánh giá, thử nghiệm, điều tra phải được người ra quyết định thành lập đoàn phê duyệt;
b) Trưởng đoàn chịu trách nhiệm xây dựng kế hoạch kiểm tra, đánh giá, thử nghiệm, điều tra và báo cáo kết quả thực hiện với người ra quyết định thành lập đoàn chậm nhất 10 ngày làm việc tính từ ngày kết thúc các hoạt động kiểm tra, thử nghiệm, điều tra;
c) Cục Quản lý xuất nhập cảnh tổ chức kiểm tra, đánh giá đối với đơn vị kiểm soát an ninh hàng không tại cảng hàng không, hãng hàng không, doanh nghiệp cung cấp dịch vụ hàng không được thực hiện tối thiểu một năm một lần; tổ chức thử nghiệm, đánh giá đối với đơn vị kiểm soát an ninh hàng không tại cảng hàng không được thực hiện tối thiểu một năm một lần; hãng hàng không Việt Nam tối thiểu hai năm một lần; trừ trường hợp đột xuất.
2. Yêu cầu đối với hoạt động kiểm tra, đánh giá, thử nghiệm, điều tra của đơn vị kiểm soát an ninh hàng không, hãng hàng không và các doanh nghiệp khác có chương trình an ninh hàng không:
a) Phải có kế hoạch kiểm tra, đánh giá, thử nghiệm, điều tra được người đứng đầu đơn vị, tổ chức phê duyệt. Nội dung kiểm tra, đánh giá, thử nghiệm, điều tra có trọng tâm, trọng điểm và phù hợp với rủi ro an ninh hàng không;
b) Hoạt động đánh giá của các hãng hàng không Việt Nam tại các cảng hàng không nước ngoài do hãng hàng không chịu chi phí phải có sự tham gia của Cục Quản lý xuất nhập cảnh. Hoạt động đánh giá tại Việt Nam của nhà chức trách, hãng hàng không Việt Nam, hãng hàng không nước ngoài phải được Cục Quản lý xuất nhập cảnh cho phép, sau khi kết thúc đánh giá phải gửi kết quả về Cục Quản lý xuất nhập cảnh;
c) Đơn vị kiểm soát an ninh hàng không thực hiện kiểm tra và thử nghiệm tối thiểu một quý một lần, trừ trường hợp đột xuất;
d) Doanh nghiệp có lực lượng kiểm soát an ninh hàng không khác thực hiện kiểm tra và thử nghiệm nội bộ tối thiểu một năm một lần, trừ trường hợp đột xuất.
3. Đơn vị kiểm soát an ninh hàng không, hãng hàng không và các doanh nghiệp có chương trình an ninh hàng không có trách nhiệm báo cáo Cục Quản lý xuất nhập cảnh về kết quả thực hiện công tác kiểm soát chất lượng an ninh hàng không theo quy định tại Phụ lục XXIII ban hành kèm theo Thông tư này.
4. Hồ sơ, tài liệu hoạt động kiểm tra, đánh giá, thử nghiệm, điều tra an ninh hàng không phải được quản lý, lưu trữ theo quy định của pháp luật về lưu trữ.
Điều 84. Thử nghiệm an ninh hàng không
1. Thử nghiệm bí mật phải bảo đảm bí mật nội dung, thời gian, địa điểm, kế hoạch, phương án và toàn bộ quá trình thử nghiệm, chỉ thành viên trong đoàn mới được phổ biến. Thử nghiệm công khai phải thông báo trước nội dung, thời gian, địa điểm thử nghiệm cho đơn vị là đối tượng chịu sự thử nghiệm. Căn cứ kế hoạch thử nghiệm được phê duyệt, trưởng đoàn thử nghiệm xây dựng phương án thực hiện cho từng thử nghiệm cụ thể.
2. Trong quá trình thử nghiệm phải bảo đảm an ninh, an toàn cho người, tài sản, các hoạt động của người thử nghiệm và đối tượng chịu sự thử nghiệm. Khi thử nghiệm bí mật bị phát hiện, người thử nghiệm phải xuất trình ngay quyết định thử nghiệm cùng với thẻ giám sát viên an ninh hàng không hoặc giấy tờ về nhân thân có ảnh hoặc tài khoản định danh điện tử mức độ 2 của người thử nghiệm cho đối tượng chịu sự thử nghiệm biết, đối tượng chịu sự thử nghiệm phải hợp tác và bảo đảm an ninh, an toàn cho người, phương tiện, đồ vật thử nghiệm.
3. Ngay sau cuộc thử nghiệm kết thúc, người thử nghiệm phải tiến hành lập biên bản ghi nhận kết quả cuộc thử nghiệm và yêu cầu đối tượng chịu sự thử nghiệm ký vào biên bản. Kết thúc cuộc thử nghiệm, trưởng đoàn thử nghiệm phải tổ chức họp với các thành phần liên quan tại đơn vị chịu sự thử nghiệm để rút kinh nghiệm, giảng bình và thông báo sơ bộ về kết quả của cuộc thử nghiệm với người đứng đầu hoặc đại diện được ủy quyền của đơn vị chịu sự thử nghiệm.
4. Thử nghiệm bí mật được phép sử dụng người có nhân thân tốt và đủ độ tin cậy để bảo đảm yếu tố bí mật và hiệu quả của hoạt động thử nghiệm.
Điều 85. Khắc phục sơ hở, thiếu sót qua kiểm tra, đánh giá, thử nghiệm, điều tra
1. Trong khi kiểm tra, đánh giá, thử nghiệm, điều tra xét thấy những sơ hở, thiếu sót cần phải khắc phục ngay nếu không sẽ gây mất an ninh, trưởng đoàn lập biên bản yêu cầu phải khắc phục ngay hoặc chuyển giao cho người có thẩm quyền đình chỉ hoạt động để bảo đảm an ninh.
2. Đơn vị được kiểm tra, đánh giá, thử nghiệm, điều tra, sau khi nhận được kết luận, trong đó bao gồm các kiến nghị khắc phục sơ hở, thiếu sót, phải xây dựng kế hoạch khắc phục gửi đơn vị chủ trì thực hiện; trường hợp có những kết luận, kiến nghị chưa chính xác thì có văn bản phản hồi gửi đến đơn vị chủ trì thực hiện và Cục Quản lý xuất nhập cảnh.
3. Thời gian, nội dung tổ chức khắc phục sơ hở, thiếu sót qua hoạt động kiểm soát chất lượng của Cục Quản lý xuất nhập cảnh.
a) Trong 15 ngày làm việc tính từ ngày kết thúc các hoạt động kiểm tra, thử nghiệm, điều tra, người ra quyết định thành lập đoàn phải có văn bản kết luận, trong đó nêu rõ những sơ hở, thiếu sót và yêu cầu, khuyến cáo khắc phục, nếu có;
b) Trong 10 ngày làm việc tính từ ngày nhận được kết luận kiểm tra, thử nghiệm, điều tra, đơn vị chịu sự kiểm tra, thử nghiệm, điều tra phải gửi kế hoạch khắc phục sơ hở, thiếu sót trong đó nêu cụ thể biện pháp khắc phục, cá nhân, tổ chức chịu trách nhiệm khắc phục và thời gian hoàn thành việc khắc phục;
c) Trong 05 ngày làm việc tính từ ngày nhận được kế hoạch khắc phục, người ra quyết định thành lập đoàn phải có văn bản phản hồi về kế hoạch khắc phục sơ hở, thiếu sót gửi đơn vị, trong đó nêu rõ việc chấp thuận hay không chấp thuận với từng nội dung.
4. Thời gian, nội dung tổ chức khắc phục sơ hở, thiếu sót qua hoạt động kiểm soát chất lượng của đơn vị có chương trình an ninh hàng không
a) Trong 10 ngày làm việc tính từ ngày kết thúc kiểm tra, điều tra, thử nghiệm nội bộ, đánh giá phải ban hành kết luận và kế hoạch khắc phục sơ hở, thiếu sót sau kiểm tra, điều tra, trong đó nêu cụ thể biện pháp khắc phục, cá nhân, tổ chức chịu trách nhiệm khắc phục và thời gian hoàn thành việc khắc phục (nếu có);
b) Trong 15 ngày, kết luận kiểm tra, điều tra, thử nghiệm và kế hoạch khắc phục sơ hở, thiếu sót phải gửi Cục Quản lý xuất nhập cảnh. Đối với kết luận của hoạt động đánh giá phải được gửi đến các đơn vị chịu sự đánh giá và Cục Quản lý xuất nhập cảnh.
5. Đơn vị kiểm soát chất lượng an ninh hàng không có trách nhiệm theo dõi, kiểm tra đánh giá thực tế việc thực hiện kế hoạch khắc phục, báo cáo kết quả cho thủ trưởng cơ quan, đơn vị.
6. Trường hợp đơn vị chịu sự kiểm soát chất lượng không khắc phục đúng theo yêu cầu của trưởng đoàn kiểm tra, thử nghiệm, đánh giá, điều tra hoặc đơn vị chịu sự kiểm soát chất lượng không khắc phục đúng theo kế hoạch khắc phục đã được chấp thuận, đơn vị kiểm soát chất lượng xem xét kiến nghị áp dụng hình thức xử lý để bảo đảm việc khắc phục được thực thi. Việc kiến nghị áp dụng hình thức xử lý phải phù hợp với tính chất mức độ vi phạm và quy định của pháp luật, và có thể đồng thời áp dụng một hoặc nhiều biện pháp sau:
a) Yêu cầu cơ quan, đơn vị quản lý cá nhân, tổ chức vi phạm đình chỉ hoặc tạm đình chỉ thực hiện nhiệm vụ đối với cá nhân, tổ chức; yêu cầu cơ quan, đơn vị quản lý cá nhân, tổ chức vi phạm huấn luyện lại hoặc huấn luyện bổ sung, hoặc huấn luyện phục hồi (nếu bị thu hồi giấy phép, năng định) đối với cá nhân;
b) Thu hồi, đình chỉ hiệu lực giấy phép, năng định nhân viên; thu hồi thẻ kiểm soát an ninh hàng không đối với cá nhân;
c) Thu hồi giấy phép hoặc đình chỉ hoạt động đối với trang thiết bị, đình chỉ hoạt động đối với công trình;
d) Thu hồi giấy phép đối với tổ chức;
đ) Đình chỉ chuyến bay; cấm bay, từ chối vận chuyển;
e) Đóng cửa, đóng cửa tạm thời một phần hoặc toàn bộ cảng hàng không;
g) Yêu cầu cơ quan, đơn vị liên quan áp dụng biện pháp kiểm soát an ninh hàng không tăng cường, bổ sung; yêu cầu cơ quan, đơn vị liên quan áp dụng biện pháp ứng phó khẩn nguy;
h) Kiến nghị cơ quan chức năng xử lý theo quy định của pháp luật.
Điều 86. Quy định về giám sát viên an ninh hàng không, giám sát viên an ninh nội bộ
1. Giám sát viên an ninh hàng không là người thuộc Cục Quản lý xuất nhập cảnh và Công an cấp tỉnh thực hiện các hoạt động kiểm soát chất lượng và các hoạt động giám sát an ninh hàng không được Cục Quản lý xuất nhập cảnh bổ nhiệm và cấp thẻ giám sát viên an ninh hàng không. Yêu cầu về bổ nhiệm giám sát viên an ninh hàng không như sau:
a) Giám sát viên an ninh hàng không được bổ nhiệm theo lĩnh vực hoặc địa bàn hoặc đơn vị được giao giám sát;
b) Quyết định bổ nhiệm phải được thông báo đến đối tượng giám sát;
c) Trong quyết định bổ nhiệm phải ghi rõ nhiệm vụ, quyền hạn, trách nhiệm của giám sát viên theo nguyên tắc giám sát viên chỉ được sử dụng quyền hạn quy định tại khoản 2 Điều này để thực hiện trách nhiệm đối với lĩnh vực chuyên môn hoặc địa bàn hoặc đơn vị được giao giám sát;
d) Nhiệm kỳ của giám sát viên an ninh hàng không không quá 03 năm.
2. Nhiệm vụ, quyền hạn của giám sát viên an ninh hàng không:
a) Thực hiện hoạt động kiểm soát chất lượng an ninh hàng không theo quy định của thông tư này, khi thực hiện nhiệm vụ độc lập, không được phép thử nghiệm bí mật;
b) Được phép tiếp cận, lên tàu bay, vào bất cứ khu vực hạn chế nào tại cảng hàng không, sân bay, cơ sở cung cấp dịch vụ hàng không, công trình, trang thiết bị, phương tiện;
c) Được quyền yêu cầu tổ chức, cá nhân cung cấp giấy tờ, tài liệu hoặc đồ vật có liên quan; thu giữ giấy phép, thẻ kiểm soát an ninh hàng không có liên quan của cán bộ, chiến sĩ, nhân viên vi phạm; đình chỉ hoạt động của trang thiết bị, phương tiện vi phạm gây uy hiếp an ninh hàng không;
d) Yêu cầu người có trách nhiệm thực hiện ngay các biện pháp khắc phục có thể; lập biên bản vi phạm, chuyển cho người có thẩm quyền để xử lý theo quy định của pháp luật;
đ) Khi thực hiện nhiệm vụ kiểm soát chất lượng độc lập, nếu phát hiện thiếu sót, sai phạm trong công tác bảo đảm an ninh hàng không, giám sát viên an ninh hàng không được quyền trực tiếp khuyến cáo đơn vị, người vi phạm nhằm ngăn chặn hành vi vi phạm và yêu cầu các cơ quan, đơn vị liên quan có hành động khắc phục hậu quả, giảm thiểu rủi ro an ninh hàng không; sau khi đưa ra khuyến cáo phải báo cáo với cơ quan, đơn vị trực tiếp quản lý mình; giám sát viên an ninh hàng không có quyền đưa ra và phải hoàn toàn chịu trách nhiệm về các đánh giá, kết luận, khuyến cáo khi thực hiện nhiệm vụ độc lập;
e) Khi thực hiện nhiệm vụ kiểm soát chất lượng theo đoàn, giám sát viên an ninh hàng không phải tuân thủ sự phân công nhiệm vụ của cấp có thẩm quyền, các đề xuất về đánh giá, kết luận, khuyến cáo phải gửi đến trưởng đoàn kiểm soát chất lượng để tổng hợp chung; trưởng đoàn kiểm soát chất lượng chịu trách nhiệm cao nhất trong đoàn công tác về kết quả thực hiện nhiệm vụ của đoàn; trong trường hợp kết luận của trưởng đoàn khác với ý kiến của giám sát viên an ninh hàng không, giám sát viên an ninh hàng không có quyền bảo lưu ý kiến trong hồ sơ báo cáo cấp thành lập đoàn công tác.
3. Giám sát viên an ninh nội bộ là người của doanh nghiệp, đơn vị có chương trình an ninh hàng không do doanh nghiệp thực hiện việc bổ nhiệm, cấp thẻ và quy định về quyền hạn và trách nhiệm cho giám sát viên an ninh nội bộ. Mẫu thẻ giám sát viên an ninh nội bộ phải được thông báo cho Cục Quản lý xuất nhập cảnh.
4. Giám sát viên an ninh hàng không, giám sát viên an ninh nội bộ khi thực hiện nhiệm vụ phải chịu trách nhiệm về những việc làm của mình; sử dụng thẻ đúng nhiệm vụ, quyền hạn theo quy định của pháp luật.
5. Tiêu chuẩn giám sát viên an ninh nội bộ:
a) Có thời gian làm việc trong lĩnh vực an ninh hàng không tối thiểu 02 năm hoặc tối thiểu 01 năm đối với trường hợp đã công tác trong lực lượng công an, quân đội;
b) Đã hoàn thành khóa học nghiệp vụ giám sát viên an ninh hàng không và được cấp chứng chỉ hoặc chứng nhận theo quy định về đào tạo, bồi dưỡng nghiệp vụ, huấn luyện an ninh hàng không.
6. Giám sát viên an ninh hàng không, giám sát viên an ninh nội bộ được đào tạo, huấn luyện theo quy định về đào tạo, huấn luyện an ninh hàng không của Bộ trưởng Bộ Công an.
Điều 87. Công tác báo cáo, thống kê an ninh hàng không
1. Cục Quản lý xuất nhập cảnh xây dựng, hướng dẫn hệ thống báo cáo, thống kê về công tác bảo đảm an ninh hàng không đối với các cơ quan, đơn vị liên quan theo quy định của pháp luật.
2. Các tổ chức sau đây có trách nhiệm báo cáo về Cục Quản lý xuất nhập cảnh theo quy định tại khoản 1 Điều này:
a) Công an cửa khẩu thuộc Cục Quản lý xuất nhập cảnh và Phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh có cảng hàng không, sân bay;
b) Các hãng hàng không;
c) Người khai thác cảng hàng không, sân bay;
d) Doanh nghiệp cung cấp dịch vụ không lưu; sửa chữa bảo dưỡng tàu bay, thiết bị tàu bay doanh nghiệp cung cấp dịch vụ suất ăn hàng không; doanh nghiệp cung cấp dịch vụ xăng dầu hàng không;
đ) Doanh nghiệp cung cấp dịch vụ hàng không.
3. Khi xảy ra các vụ việc vi phạm an ninh hàng không nghiêm trọng, tiềm ẩn nguy cơ uy hiếp an ninh hàng không hoặc có nguy cơ ảnh hưởng xấu đến an ninh quốc gia, trật tự, an toàn xã hội, các tổ chức quy định tại khoản 2 Điều này phải báo cáo về Cục Quản lý xuất nhập cảnh như sau: báo cáo ban đầu ngay khi vụ việc xảy ra bằng điện thoại hoặc các phương tiện thông tin khác và báo cáo bằng văn bản trong vòng 24 giờ theo mẫu quy định tại Phụ lục XVIII ban hành kèm theo Thông tư này. Định kỳ hàng tháng các tổ chức quy định tại điểm a, b, c, d và đ khoản 2 Điều này phải báo cáo về Cục Quản lý xuất nhập cảnh các vụ việc vi phạm an ninh hàng không đã được ghi nhận trong hệ thống quản lý an ninh hàng không.
4. Đối với vụ việc khẩn nguy, đối phó với hành vi can thiệp bất hợp pháp, đơn vị thực hiện báo cáo theo quy định tại Điều 66 của Thông tư này.
5. Việc báo cáo được thực hiện bằng văn bản hoặc thông qua hệ thống cơ sở dữ liệu an ninh hàng không, qua điện thoại hoặc các phương tiện thông tin khác hoặc bằng dịch vụ bưu chính.
Điều 88. Tổ chức xây dựng cơ sở dữ liệu an ninh hàng không
1. Cục Quản lý xuất nhập cảnh tổ chức thống kê và xây dựng cơ sở dữ liệu an ninh hàng không để thực hiện thống nhất. Cơ sở dữ liệu an ninh hàng không phải được bảo vệ, tránh truy cập trái phép; chỉ những tổ chức, cá nhân được Cục Quản lý xuất nhập cảnh cho phép mới được truy cập và khai thác.
2. Cơ sở dữ liệu về an ninh hàng không gồm:
a) Các hành vi can thiệp bất hợp pháp và các vụ việc vi phạm an ninh hàng không;
b) Đối tượng phải kiểm tra trực quan hàng không bắt buộc, bị từ chối vận chuyển vì lý do an ninh, cấm vận chuyển bằng đường hàng không;
c) Công tác kiểm soát chất lượng an ninh hàng không;
d) Thẻ, giấy phép kiểm soát an ninh hàng không;
đ) Hệ thống kết cấu hạ tầng, trang bị, thiết bị, vũ khí, công cụ hỗ trợ;
e) Hệ thống tổ chức, lực lượng kiểm soát an ninh hàng không, giấy phép nhân viên kiểm soát an ninh hàng không.
3. Cục Quản lý xuất nhập cảnh tổ chức quản trị cơ sở dữ liệu an ninh hàng không; các doanh nghiệp có chương trình an ninh hàng không phải thường xuyên thống kê, cập nhật các nội dung nêu tại khoản 2 của Điều này vào cơ sở dữ liệu.
4. Cục Quản lý xuất nhập cảnh hướng dẫn về việc thống kê, báo cáo, cập nhật, khai thác, quản lý và sử dụng cơ sở dữ liệu an ninh hàng không.
Chương VIII
TRÁCH NHIỆM CỦA CÁC ĐƠN VỊ, TỔ CHỨC, CÁ NHÂN TRONG CÔNG TÁC BẢO ĐẢM AN NINH HÀNG KHÔNG
Điều 89. Trách nhiệm của Cục Quản lý xuất nhập cảnh
1. Thực hiện nhiệm vụ, quyền hạn của Nhà chức trách an ninh hàng không đối với công tác bảo đảm an ninh hàng không theo quy định của pháp luật.
2. Phê duyệt, chấp thuận và giám sát thực hiện chương trình an ninh hàng không của đơn vị kiểm soát an ninh hàng không, người khai thác cảng hàng không, sân bay, các hãng hàng không, doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay, doanh nghiệp cung cấp dịch vụ suất ăn hàng không, doanh nghiệp cung cấp dịch vụ xăng dầu hàng không, doanh nghiệp cung cấp dịch vụ hàng không tại cảng hàng không, sân bay, doanh nghiệp xử lý hàng hóa, bưu gửi để đưa lên tàu bay.
3. Ban hành, cấp, công nhận và giám sát việc thực hiện:
a) Tiêu chuẩn, quy trình, chỉ thị, hướng dẫn, tài liệu nghiệp vụ, sổ sách hoặc văn bản điện tử, khuyến cáo về an ninh hàng không;
b) Các biện pháp khẩn cấp bao gồm cả việc tạm ngừng hoạt động bay tại sân bay, đình chỉ chuyến bay và hoạt động của phương tiện, thiết bị, nhân viên hàng không, hoạt động của người khai thác tàu bay, doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp sản xuất, bảo dưỡng, sửa chữa tàu bay, thiết bị tàu bay, doanh nghiệp cung cấp dịch vụ suất ăn hàng không, doanh nghiệp cung cấp dịch vụ xăng dầu hàng không, doanh nghiệp cung cấp dịch vụ hàng không tại cảng hàng không, sân bay, doanh nghiệp xử lý hàng hóa, bưu gửi để đưa lên tàu bay để bảo đảm an ninh hàng không;
c) Giấy phép, chứng chỉ, chứng nhận chuyên môn cho cán bộ an ninh hàng không, lực lượng kiểm soát an ninh hàng không;
d) Danh mục các vật phẩm nguy hiểm bị cấm hoặc hạn chế mang theo người và hành lý lên tàu bay bảo đảm tuân thủ theo hướng dẫn kỹ thuật và yêu cầu của ICAO.
4. Yêu cầu các hãng hàng không, doanh nghiệp thay đổi mẫu, nội dung thẻ nhận dạng tổ bay, thẻ, giấy phép kiểm soát an ninh hàng không nội bộ khi đánh giá có nguy cơ về an ninh hàng không.
5. Tham gia thẩm định, đánh giá về việc áp dụng các tiêu chuẩn và yêu cầu an ninh hàng không trong việc thiết kế xây dựng, cải tạo cảng hàng không, sân bay.
6. Tổ chức điều tra, xác minh và chỉ đạo xử lý các vụ việc vi phạm, uy hiếp an ninh hàng không; giám sát việc thực hiện các biện pháp khẩn cấp bao gồm việc đình chỉ chuyến bay và hoạt động của phương tiện, thiết bị, nhân viên hàng không để bảo đảm an ninh hàng không.
7. Chủ trì, phối hợp với các đơn vị liên quan thực hiện các biện pháp đối phó ban đầu với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng, thực hiện các biện pháp khẩn cấp phục vụ an ninh, quốc phòng, khẩn nguy quốc gia; đánh giá lại các biện pháp, thủ tục an ninh sau khi xảy ra hành vi can thiệp bất hợp pháp và đưa ra các biện pháp khắc phục để ngăn ngừa các hành vi tương tự tái diễn.
8. Chỉ đạo, hướng dẫn nghiệp vụ, kiểm tra các đơn vị về công tác bảo đảm an ninh hàng không, bao gồm:
a) Thực hiện các biện pháp phòng ngừa và đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng; các biện pháp khẩn cấp phục vụ an ninh, khẩn nguy hàng không quốc gia;
b) Diễn tập khẩn nguy về an ninh hàng không, kiểm soát chất lượng an ninh hàng không;
c) Tổ chức lực lượng chuyên ngành bảo đảm an ninh hàng không đáp ứng tiêu chuẩn của ICAO;
d) Kiểm soát an ninh nội bộ, an ninh thông tin đối với các đơn vị, cơ quan, doanh nghiệp, cá nhân trong thời gian làm việc tại khu vực cảng hàng không và trên tàu bay; xử lý, rút kinh nghiệm, giảng bình vụ việc vi phạm an ninh hàng không.
9. Chỉ đạo đơn vị có chức năng giám sát an ninh hàng không thực hiện chức năng kiểm tra, giám sát việc tuân thủ các quy định về an ninh hàng không tại cảng hàng không, sân bay.
10. Kiểm tra, sát hạch, cấp, đình chỉ, thu hồi giấy phép và năng định chuyên môn cho lực lượng kiểm soát an ninh hàng không; cấp, thu hồi thẻ, giấy phép kiểm soát an ninh cảng hàng không, sân bay theo quy định; bổ nhiệm, đình chỉ và cấp, thu hồi thẻ giám sát viên an ninh hàng không.
11. Thanh tra, kiểm tra, đánh giá, thử nghiệm, điều tra việc tuân thủ các quy định của pháp luật về an ninh hàng không đối với các cơ quan, tổ chức, cá nhân tham gia vào hoạt động hàng không dân dụng; ban hành các khuyến cáo, văn bản cần thiết nhằm phòng ngừa, ngăn chặn sự cố an ninh hàng không; xử phạt vi phạm hành chính đối với các vụ việc vi phạm an ninh hàng không; kiểm tra, giám sát việc xử lý, khắc phục, giảng bình vụ việc vi phạm an ninh hàng không.
12. Xây dựng hệ thống báo cáo, thu thập thông tin, phân tích và đánh giá nguy cơ đe dọa đến an ninh hàng không; quyết định áp dụng các biện pháp, quy trình, thủ tục phòng ngừa an ninh hàng không phù hợp với nguy cơ đe dọa.
13. Tổ chức đánh giá và quyết định không cho phép thực hiện các chuyến bay dân dụng trong các trường hợp sau đây:
a) Tại cảng hàng không, sân bay của Việt Nam không đảm bảo các yêu cầu của pháp luật về bảo đảm an ninh hàng không;
b) Chuyến bay của hãng hàng không không tuân thủ các quy định về bảo đảm an ninh hàng không;
c) Chuyến bay xuất phát từ cảng hàng không, sân bay nước ngoài không đảm bảo tuân thủ các tiêu chuẩn của ICAO về an ninh hàng không.
14. Là đầu mối quan hệ, hợp tác quốc tế về an ninh hàng không của Việt Nam với ICAO, các tổ chức quốc tế liên quan và các quốc gia:
a) Chủ trì phối hợp với các cơ quan, đơn vị liên quan của Việt Nam trong các hoạt động hợp tác quốc tế về an ninh hàng không;
b) Tham gia điểm liên lạc an ninh hàng không của ICAO và tổ chức thực hiện việc trao đổi thông tin về an ninh hàng không; tham vấn việc áp dụng tăng cường biện pháp kiểm soát an ninh hàng không với các tổ chức quốc tế, các quốc gia, các hãng hàng không liên quan; tiếp nhận, quản lý, sử dụng, tiêu huỷ thông tin an ninh hàng không đã tiếp nhận từ ICAO, các quốc gia, tổ chức, hãng hàng không nước ngoài theo tiêu chuẩn và hướng dẫn của ICAO;
c) Quyết định thực hiện các biện pháp bảo đảm an ninh khi các quốc gia, hãng hàng không nước ngoài có yêu cầu, kể cả việc đánh giá an ninh hàng không;
d) Đề xuất đưa các tiêu chuẩn, khuyến cáo, hướng dẫn về an ninh hàng không của ICAO vào quy định của pháp luật, quy chuẩn, tiêu chuẩn quốc gia hoặc đưa vào hướng dẫn của Cục Quản lý xuất nhập cảnh. Thông báo cho ICAO các khác biệt giữa pháp luật Việt Nam về an ninh hàng không với các tiêu chuẩn của ICAO;
đ) Chấp thuận hoặc không chấp thuận đề nghị của quốc gia liên quan về việc mang vũ khí lên khoang hành khách của tàu bay đối với các chuyến bay quốc tế đến hoặc quá cảnh Việt Nam (kể cả chuyến bay chuyên khoang, không áp dụng quy định này đối với chuyến bay chuyên cơ).
15. Chấp thuận miễn kiểm tra an ninh hàng không đối với hành khách, hành lý, hàng hóa và chịu trách nhiệm trong những trường hợp có yêu cầu của cơ quan có thẩm quyền thuộc Văn phòng Trung ương Đảng, Văn phòng Chủ tịch nước, Văn phòng Quốc hội, Văn phòng Chính phủ, Bộ Ngoại giao, Bộ Công an, Bộ Quốc phòng.
16. Đánh giá và xem xét việc quyết định tạm dừng khai thác các chuyến bay dân dụng đến Việt Nam từ cảng hàng không, sân bay nước ngoài không tuân thủ các tiêu chuẩn của ICAO về an ninh hàng không.
17. Chủ trì, phối hợp với các cơ quan, đơn vị thuộc Bộ Công an, Bộ Quốc phòng:
a) Tổ chức đào tạo, huấn luyện, chỉ đạo, hướng dẫn nghiệp vụ cho lực lượng kiểm soát an ninh hàng không.
b) Tiếp nhận, trao đổi, xử lý thông tin về tình hình an ninh chính trị, trật tự an toàn xã hội; âm mưu, phương thức, thủ đoạn hoạt động của đối tượng khủng bố, các loại tội phạm; âm mưu can thiệp bất hợp pháp; đánh giá rủi ro và đe dọa đối với hoạt động hàng không dân dụng;
c) Bảo đảm an ninh chuyến bay khai thác thương mại có đối tượng được phục vụ trên chuyến bay chuyên cơ, chuyên khoang theo quy định;
d) Thực hiện các quy định của pháp luật về an ninh, quốc phòng, phòng, chống khủng bố và pháp luật khác có liên quan đến bảo đảm an ninh hàng không;
đ) Ký kết và triển khai thực hiện các quy chế phối hợp trong công tác bảo đảm an ninh hàng không;
e) Phối hợp với các đơn vị nghiệp vụ thuộc Bộ Công an để kiểm soát nhân thân của nhân viên hàng không nhằm kịp thời phát hiện các hành vi vi phạm pháp luật, uy hiếp an ninh, an toàn hàng không.
18. Phối hợp với các cơ quan, đơn vị thuộc Bộ Ngoại giao, Bộ Xây dựng:
a) Giải quyết các vấn đề liên quan trong trường hợp tàu bay mang quốc tịch Việt Nam bị can thiệp bất hợp pháp tại nước ngoài; tàu bay mang quốc tịch nước ngoài bị can thiệp bất hợp pháp tại Việt Nam;
b) Trao đổi, xử lý thông tin có yếu tố nước ngoài liên quan đến can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
19. Phối hợp với Ban chỉ đạo phòng, chống khủng bố tỉnh, thành phố tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp ngành; cấp quốc gia theo quy định.
20. Phối hợp với Cục Hải quan trong việc thực hiện bảo đảm an ninh hàng không và phòng chống buôn lậu, gian lận thương mại, vận chuyển trái phép trên các chuyến bay quốc tế; chỉ đạo việc bố trí thiết bị soi chiếu chung giữa lực lượng kiểm soát an ninh hàng không và hải quan.
21. Phối hợp với các cơ quan chức năng triển khai thực hiện các quy định của pháp luật đối với công trình quan trọng liên quan đến an ninh quốc gia.
22. Chỉ đạo tổ chức ký kết các cơ chế phối hợp về công tác bảo đảm an ninh hàng không, an ninh, trật tự, an toàn xã hội với chính quyền địa phương, đơn vị trên địa bàn cảng hàng không, sân bay và các cơ quan, đơn vị liên quan.
Điều 90. Trách nhiệm của Công an cấp tỉnh
1. Thực hiện kiểm soát chất lượng an ninh hàng không theo thẩm quyền. Kiểm tra, giám sát việc tuân thủ các quy định của pháp luật về bảo đảm an ninh hàng không, các chương trình an ninh hàng không, việc thực hiện các biện pháp bảo đảm an ninh hàng không và cung cấp dịch vụ bảo đảm an ninh hàng không, an ninh mạng, an toàn thông tin mạng hàng không và bảo vệ dữ liệu cá nhân tại cảng hàng không, sân bay, việc xử lý vụ việc vi phạm an ninh hàng không, trật tự công cộng tại cảng hàng không, sân bay do Công an cấp tỉnh quản lý. Tham gia thẩm định chương trình an ninh hàng không theo yêu cầu của Cục Quản lý xuất nhập cảnh.
2. Chủ trì, tham mưu Ban chỉ đạo phòng, chống khủng bố tỉnh, thành phố triển khai công tác đánh giá rủi ro an ninh hàng không và ban hành, triển khai kế hoạch khẩn nguy tổng thể đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng trên địa bàn tỉnh, thành phố. Tham gia đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay theo quy định.
3. Báo cáo đề xuất cấp có thẩm quyền quyết định đình chỉ chuyến bay, yêu cầu tàu bay hạ cánh trong trường hợp chuyến bay vi phạm các quy định về an ninh hàng không, phát hiện chuyến bay có dấu hiệu bị uy hiếp an ninh hàng không; cho phép tàu bay bị đình chỉ tiếp tục thực hiện chuyến bay; tạm giữ tàu bay trong trường hợp không khắc phục vi phạm quy định về an ninh hàng không; căn cứ tính chất, mức độ của hành vi vi phạm để đình chỉ thực hiện nhiệm vụ, thu hồi hoặc kiến nghị cơ quan, đơn vị cấp thẻ, giấy phép thu hồi thẻ kiểm soát an ninh hàng không, giấy phép của nhân viên hàng không vi phạm quy định của pháp luật về bảo đảm an ninh hàng không.
4. Xử phạt hành vi vi phạm hành chính xảy ra tại cảng hàng không, sân bay theo thẩm quyền trong lĩnh vực an ninh hàng không; chuyển giao vụ việc vi phạm không thuộc thẩm quyền cho các cơ quan chức năng liên quan.
5. Tổ chức cấp, quản lý thẻ, giấy phép kiểm soát an ninh cảng hàng không, sân bay trong phạm vi quản lý.
6. Chủ trì phối hợp với các cơ quan quản lý nhà nước hoạt động tại cảng hàng không, sân bay giải quyết các vấn đề liên quan đến an ninh, trật tự tại cảng hàng không, sân bay. Chủ trì tổ chức đánh giá các vấn đề về bảo đảm an ninh tại cảng hàng không, sân bay trong các cuộc họp định kỳ hoặc bất thường. Giám đốc Công an cấp tỉnh xem xét quyết định và chịu trách nhiệm về những vấn đề về bảo đảm an ninh hàng không phát sinh và báo cáo ngay Cục Quản lý xuất nhập cảnh.
7. Chỉ đạo lực lượng công an cấp cơ sở phối hợp thực hiện các quy định về an ninh hàng không, ngăn chặn các hành vi vi phạm pháp luật tại khu vực lân cận cảng hàng không, sân bay.
8. Phối hợp với các cơ quan, đơn vị liên quan trao đổi, nắm tình hình về an ninh, trật tự, tội phạm và vi phạm pháp luật khác có liên quan đến cảng hàng không, sân bay.
Điều 91. Trách nhiệm của người khai thác cảng hàng không, sân bay
1. Xây dựng chương trình an ninh hàng không của người khai thác cảng hàng không, sân bay và tổ chức triển khai thực hiện sau khi được phê duyệt. Cung cấp chương trình an ninh hàng không của người khai thác cảng hàng không, sân bay được phê duyệt cho đơn vị kiểm soát an ninh hàng không tại cảng hàng không, cung cấp phần phù hợp của chương trình cho các hãng hàng không, cơ quan, doanh nghiệp liên quan hoạt động tại cảng hàng không, sân bay theo yêu cầu. Chịu sự thanh tra, kiểm tra, đánh giá, điều tra an ninh hàng không của Cục Quản lý xuất nhập cảnh và Công an cấp tỉnh theo quy định.
2. Xây dựng kết cấu hạ tầng, bố trí thiết bị cần thiết cho việc bảo đảm an ninh hàng không, bảo vệ cảng hàng không, sân bay và phối hợp duy trì trật tự công cộng tại cảng hàng không, sân bay trong phạm vi trách nhiệm.
3. Cung cấp thông tin, tình hình liên quan công tác bảo đảm an ninh hàng không theo yêu cầu của đơn vị kiểm soát an ninh hàng không phục vụ đánh giá rủi ro tại cảng hàng không, sân bay.
4. Xây dựng Trung tâm khẩn nguy cảng hàng không, sân bay phục vụ chỉ huy điều hành việc phòng ngừa, đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay. Phối hợp xây dựng kế hoạch khẩn nguy đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay. Phối hợp tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp cơ sở, tham gia diễn tập cấp ngành, cấp tỉnh, cấp quốc gia theo quy định.
5. Bảo đảm các yêu cầu, tiêu chuẩn về an ninh hàng không được áp dụng khi thiết kế, xây dựng, cải tạo các công trình thuộc cảng hàng không, sân bay.
6. Thực hiện đào tạo, bồi dưỡng nghiệp vụ, huấn luyện kiến thức an ninh hàng không cho cán bộ, nhân viên có liên quan theo quy định pháp luật hoặc theo đề nghị của Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh.
7. Chấp hành quy định về cấp, quản lý thẻ, giấy phép kiểm soát an ninh hàng không nội bộ.
8. Xây dựng quy định về kiểm soát an ninh nội bộ và thực hiện trong tất cả các quy trình tuyển dụng, huấn luyện, đào tạo, quản lý, giám sát, xử lý vi phạm, đánh giá, nhận xét, bổ nhiệm, điều động của đơn vị.
9. Xây dựng quy định về bảo vệ thông tin và hệ thống công nghệ thông tin hàng không được sử dụng trong hoạt động hàng không dân dụng, chống lại hành vi truy cập, can thiệp trái phép gây mất an ninh, an toàn cho hoạt động hàng không dân dụng và đánh cắp thông tin cần được bảo mật; phối hợp bảo đảm an ninh hàng không, an ninh mạng, an toàn thông tin mạng hàng không và bảo vệ dữ liệu cá nhân đối với các hoạt động thuộc phạm vi trách nhiệm quản lý.
10. Tuyên truyền, phổ biến, giáo dục cán bộ, nhân viên thuộc doanh nghiệp mình về ý thức chấp hành, tuân thủ các quy định về an ninh hàng không; tổ chức tuyên truyền trên các phương tiện thông tin tại cảng hàng không, sân bay các quy định về an ninh hàng không trừ tài liệu an ninh hàng không hạn chế.
11. Chịu sự chỉ đạo, hướng dẫn nghiệp vụ về an ninh hàng không của Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh.
12. Thực hiện các biện pháp bảo vệ đối với công trình quan trọng liên quan đến an ninh quốc gia theo quy định của pháp luật.
Điều 92. Trách nhiệm của đơn vị kiểm soát an ninh hàng không
1. Thực hiện các biện pháp kiểm soát an ninh hàng không, tham gia xử lý các vụ việc vi phạm về an ninh hàng không và đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng tại cảng hàng không, sân bay.
2. Bảo đảm an ninh hàng không theo quy định của pháp luật.
3. Xây dựng, trình Cục Quản lý xuất nhập cảnh phê duyệt và triển khai thực hiện chương trình an ninh hàng không, kế hoạch khẩn nguy đối phó với hành vi can thiệp bất hợp pháp tại cảng hàng không, sân bay sau khi được phê duyệt.
4. Xây dựng cơ chế phối hợp với Cảng vụ hàng không, người khai thác cảng hàng không, sân bay, chính quyền địa phương, đơn vị công an, quân đội trên địa bàn cảng hàng không, sân bay và các cơ quan, đơn vị liên quan về công tác bảo đảm an ninh hàng không, an ninh, trật tự, an toàn xã hội.
5. Phối hợp với người khai thác cảng hàng không, sân bay xây dựng chương trình an ninh hàng không, kế hoạch khẩn nguy sân bay của người khai thác cảng hàng không, sân bay; triển khai thực hiện các nhiệm vụ trong phạm vi trách nhiệm khi chương trình an ninh, kế hoạch khẩn nguy cảng hàng không, sân bay được phê duyệt.
6. Đánh giá và đề nghị với người khai thác cảng hàng không, sân bay trong việc đầu tư, xây dựng, cải tạo các công trình phục vụ bảo đảm an ninh hàng không hiệu quả, đồng bộ và thống nhất.
7. Thực hiện công tác kiểm soát an ninh nội bộ, bảo vệ hệ thống thông tin chuyên ngành hàng không của đơn vị.
8. Tổ chức lực lượng kiểm soát an ninh hàng không thực hiện các biện pháp bảo đảm an ninh, trật tự tại cảng hàng không, sân bay. Kiểm tra, soi chiếu, giám sát người, hành lý, hàng hóa, bưu gửi, phương tiện, nhiên liệu, suất ăn và các vật phẩm khác khi đưa vào khu vực hạn chế, lên tàu bay; kiểm soát, giám sát người, phương tiện, đồ vật ra, vào, hoạt động trong các khu vực hạn chế. Tổ chức giám sát, bảo vệ tàu bay khi tàu bay đỗ tại sân bay; thực hiện lục soát an ninh hàng không.
9. Thực hiện áp tải, áp giải đối với các đối tượng là người, phương tiện đặc biệt, tiềm ẩn nguy cơ uy hiếp an ninh theo quy định hoặc khi được yêu cầu. Quản lý, giám sát hành khách bị từ chối nhập cảnh theo quy định của pháp luật.
10. Đề xuất với Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh, Ban Chỉ đạo phòng, chống khủng bố tỉnh, thành phố về tăng cường các biện pháp kiểm soát an ninh hàng không thích hợp. Thực hiện các biện pháp kiểm soát an ninh hàng không tăng cường khi áp dụng các cấp độ tăng cường theo quy định. Triển khai thực hiện các biện pháp đối phó khi xảy ra hành vi can thiệp bất hợp pháp theo kế hoạch, phương án được phê duyệt.
11. Thực hiện các biện pháp kiểm soát an ninh hàng không đối với chuyến bay chuyên cơ, chuyên khoang, chuyến bay hoạt động hàng không chung theo quy định của pháp luật.
12. Chủ động rà soát, báo cáo đề xuất tổ chức công tác đào tạo, huấn luyện, bồi dưỡng, tập huấn về an ninh hàng không cho cán bộ, chiến sĩ kiểm soát an ninh hàng không.
13. Tổ chức tuyên truyền, phổ biến, giáo dục cán bộ, chiến sĩ của đơn vị về ý thức chấp hành, tuân thủ các quy định về an ninh hàng không; thông tin, tuyên truyền cho hành khách biết và thực hiện quy định về bảo đảm an ninh hàng không khi đi tàu bay.
14. Thực hiện công tác tổng hợp, báo cáo, thống kê, quản lý, lưu trữ hồ sơ tài liệu trong lĩnh vực an ninh hàng không; rút kinh nghiệm, giảng bình các vụ việc liên quan đến an ninh hàng không xảy ra trên địa bàn theo quy định; cập nhật, lưu trữ tất cả các tài liệu, quy định có liên quan trong và ngoài nước về an ninh hàng không để nghiên cứu, triển khai thực hiện.
15. Thực hiện công tác kiểm soát chất lượng an ninh hàng không nội bộ theo quy định của pháp luật.
16. Bảo vệ hiện trường khi xảy ra các vụ việc vi phạm an ninh hàng không dân dụng, trật tự công cộng và can thiệp bất hợp pháp vào hoạt động hàng không dân dụng tại cảng hàng không, sân bay.
17. Tham gia thẩm định các tiêu chuẩn, yêu cầu an ninh hàng không trong quy hoạch, thiết kế xây dựng mới và cải tạo, nâng cấp hệ thống kết cấu hạ tầng, trang thiết bị nghiệp vụ phục vụ công tác đảm bảo an ninh hàng không của cảng hàng không, sân bay.
18. Tổ chức khai thác có hiệu quả hệ thống hạ tầng, máy móc thiết bị an ninh hàng không được đầu tư trang bị. Phối hợp chặt chẽ, kịp thời với người khai thác cảng trong việc duy tu, bảo dưỡng, sửa chữa trong quá trình sử dụng.
19. Phối hợp với các cơ quan, tổ chức có liên quan:
a) Quản lý, bảo quản, khai thác, sử dụng hệ thống công trình, máy móc, thiết bị phục vụ bảo đảm an ninh hàng không;
b) Phối hợp với người khai thác cảng hàng không, sân bay và các cơ quan, đơn vị liên quan đánh giá rủi ro an ninh hàng không theo quy định; phát hiện, ngăn chặn, xử lý các vụ việc vi phạm về an ninh hàng không và đối phó với hành vi can thiệp bất hợp pháp;
c) Phối hợp trong việc đình chỉ thực hiện chuyến bay nhằm ngăn chặn khả năng uy hiếp an ninh đối với chuyến bay;
d) Phối hợp thực hiện các biện pháp bảo vệ đối với công trình quan trọng liên quan đến an ninh quốc gia theo quy định của pháp luật;
đ) Phối hợp với cơ quan công an trong công tác dẫn giải tội phạm.
20. Trao đổi với người khai thác cảng hàng không, sân bay các vụ việc gây gián đoạn đến hoạt động khai thác, gây mất an ninh, trật tự công cộng, gây thiệt hại đến tài sản, công trình, phương tiện tại cảng hàng không hoặc hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng.
21. Hộ tống hành khách mất khả năng làm chủ hành vi khi có yêu cầu.
22. Tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp cơ sở tại cảng hàng không, sân bay theo quy định của pháp luật.
Điều 93. Trách nhiệm của doanh nghiệp cung cấp dịch vụ hàng không
1. Xây dựng chương trình an ninh hàng không bao gồm phương án khẩn nguy đối phó với hành vi can thiệp bất hợp pháp và tổ chức triển khai thực hiện sau khi được phê duyệt; cung cấp chương trình an ninh hàng không được phê duyệt cho đơn vị có chức năng giám sát an ninh hàng không và người khai thác cảng hàng không, sân bay. Chịu sự thanh tra, kiểm tra, giám sát, đánh giá, thử nghiệm an ninh hàng không của các cơ quan có thẩm quyền theo quy định của pháp luật và Thông tư này.
2. Tổ chức việc bảo đảm an ninh hàng không theo quy định của Thông tư này; doanh nghiệp cung cấp dịch vụ không lưu, doanh nghiệp cung cấp dịch vụ suất ăn hàng không, doanh nghiệp cung cấp dịch vụ xăng dầu hàng không, doanh nghiệp bảo dưỡng, sửa chữa tàu bay tổ chức bộ phận kiểm soát an ninh hàng không làm công tác bảo đảm an ninh hàng không tại các khu vực thuộc phạm vi trách nhiệm của doanh nghiệp.
3. Thực hiện quyền hạn, trách nhiệm đối phó ban đầu với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng tại các cơ sở cung cấp dịch vụ nằm ngoài khu vực cảng hàng không theo quy định của pháp luật.
4. Phối hợp với đơn vị kiểm soát an ninh hàng không, cơ quan công an, quân đội, chính quyền địa phương có liên quan trong việc giải quyết, xử lý các vụ việc, hành vi vi phạm an ninh hàng không tại các khu vực hạn chế của doanh nghiệp.
5. Thu thập thông tin, tình hình, đánh giá và xác định mức độ của các mối đe dọa tiềm ẩn đối với công tác bảo đảm an ninh hàng không tại cơ sở để tham mưu cho Cục Quản lý xuất nhập cảnh, Ban chỉ đạo phòng, chống khủng bố tỉnh, thành phố về tăng cường các biện pháp kiểm soát an ninh hàng không thích hợp.
6. Chịu sự kiểm tra, giám sát, thử nghiệm, điều tra an ninh hàng không của cơ quan có thẩm quyền. Cung cấp thông tin, tài liệu liên quan đến công tác bảo đảm an ninh hàng không cho cơ quan nhà nước có thẩm quyền theo yêu cầu.
7. Trong phạm vi nội bộ do mình quản lý, chịu trách nhiệm:
a) Xác định khu vực hạn chế của doanh nghiệp nằm ngoài cảng hàng không, sân bay. Cấp, quản lý thẻ, giấy phép kiểm soát an ninh nội bộ theo quy định;
b) Kiểm soát an ninh nội bộ đối với nhân viên hàng không. Tổ chức hệ thống kiểm tra, giám sát nội bộ;
c) Bảo vệ thông tin và hệ thống công nghệ thông tin hàng không dân dụng do mình quản lý chống lại hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng và đánh cắp thông tin cần được bảo mật theo quy định của pháp luật;
d) Tổ chức thực hiện kiểm soát chất lượng an ninh nội bộ theo quy định;
đ) Đào tạo, bồi dưỡng nghiệp vụ, huấn luyện kiến thức an ninh hàng không cho cán bộ, nhân viên có liên quan theo quy định của pháp luật;
e) Tuyên truyền, phổ biến, giáo dục cán bộ, nhân viên của mình ý thức chấp hành, tuân thủ các quy định về an ninh hàng không; tổ chức tuyên truyền trên các phương tiện thông tin đại chúng các quy định về an ninh hàng không, trừ tài liệu an ninh hàng không hạn chế.
8. Tổ chức ký kết các văn bản phối hợp về công tác bảo đảm an ninh hàng không, an ninh, trật tự, an toàn xã hội với chính quyền, công an địa phương, đơn vị quân đội liên quan nơi có cơ sở cung cấp dịch vụ.
9. Tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp cơ sở, tham gia diễn tập cấp ngành, cấp quốc gia theo quy định.
10. Chịu sự chỉ đạo, hướng dẫn nghiệp vụ về an ninh hàng không của Cục Quản lý xuất nhập cảnh.
11. Đối với doanh nghiệp cung cấp dịch vụ không lưu có công trình quan trọng liên quan đến an ninh quốc gia phải thực hiện các biện pháp bảo vệ theo quy định của pháp luật.
12. Phối hợp với đơn vị bảo đảm an ninh hàng không trong công tác bảo đảm an ninh hàng không theo quy định của pháp luật.
13. Các doanh nghiệp cung cấp dịch vụ hàng không về phục vụ hành khách: phối hợp với Công an cửa khẩu khi triển khai kiểm soát xuất nhập cảnh tự động và phối hợp với các cơ quan, đơn vị, doanh nghiệp liên quan trong việc thiết lập, vận hành, chia sẻ hệ thống xác thực sinh trắc học và thông tin hành khách;
14. Doanh nghiệp cung cấp dịch vụ khai thác nhà ga hành khách:
a) Đối với các chuyến bay nội địa: Chủ trì, phối hợp với các doanh nghiệp liên quan trong việc thiết lập, vận hành, chia sẻ hệ thống xác thực sinh trắc học và thông tin hành khách tại nhà ga;
b) Đối với các chuyến bay quốc tế: Phối hợp với Công an cửa khẩu khi triển khai kiểm soát xuất nhập cảnh tự động và các cơ quan, đơn vị, doanh nghiệp liên quan trong việc thiết lập, vận hành, chia sẻ hệ thống xác thực sinh trắc học và thông tin hành khách tại nhà ga.
Điều 94. Trách nhiệm của hãng hàng không, người khai thác tàu bay
1. Xây dựng chương trình an ninh hàng không của hãng hàng không trình Cục Quản lý xuất nhập cảnh và tổ chức triển khai thực hiện sau khi được phê duyệt, chấp thuận; cung cấp toàn bộ chương trình an ninh đã được phê duyệt, chấp thuận cho đơn vị có chức năng giám sát an ninh hàng không, đơn vị kiểm soát an ninh hàng không để kiểm tra, giám sát việc tuân thủ.
2. Tổ chức đào tạo, bồi dưỡng nghiệp vụ, huấn luyện về an ninh hàng không cho cán bộ, nhân viên theo quy định của pháp luật.
3. Phối hợp với đơn vị kiểm soát an ninh hàng không, người khai thác cảng hàng không, sân bay, các cơ quan, đơn vị liên quan xử lý các vụ việc vi phạm an ninh hàng không và những vi phạm khác liên quan đến tàu bay trong thời gian tàu bay đang khai thác, không khai thác. Cung cấp thông tin, tài liệu liên quan đến công tác bảo đảm an ninh hàng không theo yêu cầu của Cục Quản lý xuất nhập cảnh, đơn vị kiểm soát an ninh hàng không tại cảng hàng không liên quan đến hoạt động của hãng hàng không, người khai thác tàu bay.
4. Thực hiện kiểm tra an ninh hàng không tàu bay trước chuyến bay, phối hợp lục soát an ninh tàu bay khi có thông tin đe dọa theo quy định của pháp luật. Bảo đảm an ninh, duy trì trật tự kỷ luật trên tàu bay đang bay.
5. Hãng hàng không, người khai thác tàu bay Việt Nam:
a) Tổ chức lực lượng kiểm soát an ninh hàng không thực hiện các biện pháp kiểm soát an ninh hàng không, duy trì an ninh, trật tự kỷ luật trên tàu bay và bảo đảm an ninh cho hoạt động khai thác tàu bay ngoài khu vực cảng hàng không, sân bay;
b) Tổ chức quản lý bảo đảm an ninh hàng không theo quy định tại Điều 70, Điều 71, Điều 73 và Điều 74 của Thông tư này;
c) Tổ chức đánh giá công tác bảo đảm an ninh hàng không đối với hoạt động của hãng tại cảng hàng không, sân bay trong và ngoài nước; bảo đảm kinh phí cho Cục Quản lý xuất nhập cảnh tham gia hoạt động đánh giá của hãng tại cảng hàng không nước ngoài;
d) Phối hợp thực hiện Phương án khẩn nguy đối phó với hành vi can thiệp bất hợp pháp vào hoạt động hàng không dân dụng trong phạm vi trách nhiệm của mình theo quy định. Tổ chức diễn tập đối phó với hành vi can thiệp bất hợp pháp cấp cơ sở; tham gia diễn tập cấp ngành, cấp quốc gia theo quy định;
đ) Xác định ranh giới khu vực hạn chế thuộc phạm vi quản lý nằm ngoài cảng hàng không, sân bay. Cấp, quản lý thẻ, giấy phép kiểm soát an ninh nội bộ, thẻ nhận dạng tổ bay theo quy định;
e) Bố trí chỗ ngồi trên chuyến bay cho sĩ quan an ninh trên không đi làm nhiệm vụ trên chuyến bay theo yêu cầu của Cục Quản lý xuất nhập cảnh và cơ quan có thẩm quyền;
g) Thực hiện công tác kiểm soát an ninh nội bộ đối với nhân viên hàng không theo quy định;
h) Bảo vệ thông tin và hệ thống công nghệ thông tin hàng không của hãng chống lại hành vi truy cập, can thiệp trái phép gây mất an toàn cho hoạt động hàng không dân dụng và đánh cắp thông tin cần được bảo mật bao gồm cả thông tin cá nhân của hành khách;
i) Phổ biến, giáo dục cán bộ, nhân viên của mình ý thức chấp hành, tuân thủ các quy định về an ninh hàng không; tuyên truyền, phổ biến các quy định về an ninh hàng không bằng các hình thức thích hợp cho hành khách đi tàu bay;
k) Báo cáo Cục Quản lý xuất nhập cảnh các khác biệt trong chương trình an ninh hàng không của hãng hàng không trình nhà chức trách hàng không nước ngoài so với pháp luật Việt Nam. Chịu sự chỉ đạo, hướng dẫn nghiệp vụ về an ninh hàng không của Cục Quản lý xuất nhập cảnh.
6. Hãng hàng không nước ngoài phải tuân thủ đầy đủ các quy định của pháp luật Việt Nam về an ninh hàng không trong hoạt động khai thác của hãng tại Việt Nam; chỉ định và thông báo cho Cục Quản lý xuất nhập cảnh người chịu trách nhiệm trực tiếp, toàn diện về bảo đảm an ninh hàng không trong hoạt động khai thác của hãng tại Việt Nam.
7. Khi làm thủ tục bán vé đi tàu bay, hãng hàng không phải yêu cầu hành khách cung cấp thông tin cá nhân theo quy định tại Phụ lục IX ban hành kèm theo Thông tư này. Khi làm thủ tục tiếp nhận đăng ký vận chuyển hàng hóa, bưu gửi, hãng hàng không phải thông báo cho khách hàng chính sách khác biệt của hãng đối với việc vận chuyển các vật phẩm đặc biệt quy định tại Điều 30 của Thông tư này hoặc vận chuyển vật phẩm nguy hiểm, túi thư ngoại giao, túi lãnh sự (nếu có).
8. Phối hợp với đơn vị bảo đảm an ninh hàng không trong công tác bảo đảm an ninh hàng không theo quy định của pháp luật.
9. Phối hợp với Công an cửa khẩu khi triển khai kiểm soát xuất nhập cảnh tự động và các cơ quan, đơn vị, doanh nghiệp liên quan trong việc thiết lập, vận hành, chia sẻ hệ thống xác thực sinh trắc học và thông tin hành khách.
Điều 95. Trách nhiệm của tổ chức, cá nhân có liên quan
1. Tuân thủ đầy đủ các quy định của Thông tư này, chương trình an ninh của người khai thác cảng hàng không, sân bay khi hoạt động tại cảng hàng không, sân bay. Chịu sự thanh tra, kiểm tra, giám sát, điều tra, thử nghiệm, đánh giá an ninh hàng không của Cục Quản lý xuất nhập cảnh, Công an cấp tỉnh.
2. Đối với tổ chức, cá nhân kinh doanh dịch vụ phi hàng không tại cảng hàng không, sân bay:
a) Bảo vệ cơ sở vật chất, tài sản, trang thiết bị, bảo đảm an ninh hàng không, trật tự cho các hoạt động của mình thông qua việc cơ chế phối hợp với đơn vị kiểm soát an ninh hàng không;
b) Phối hợp với lực lượng kiểm soát an ninh hàng không và các cơ quan, đơn vị liên quan xử lý các vụ việc vi phạm an ninh hàng không và trật tự xảy ra trong phạm vi quản lý của mình;
c) Đảm bảo những cán bộ, nhân viên có liên quan được huấn luyện về an ninh hàng không theo quy định của pháp luật;
d) Tuyên truyền, phổ biến, giáo dục cán bộ, nhân viên thuộc doanh nghiệp mình ý thức chấp hành, tuân thủ các quy định về an ninh hàng không;
đ) Các doanh nghiệp kinh doanh sản phẩm có chứa chất lỏng, chất đặc sánh, dung dịch xịt, hãng hàng không phải cung cấp túi nhựa an ninh để đựng chất lỏng, chất đặc sánh, dung dịch xịt (kèm theo phiếu mua hàng) khi bán cho hành khách tại các cửa hàng trong khu vực cách ly quốc tế, trên chuyến bay quốc tế. Phiếu mua hàng có ghi các nội dung: ngày bán hàng (ngày/tháng/năm); mã quốc tế nơi bán (quốc gia, cảng hàng không, hãng hàng không); số chuyến bay; tên hành khách (nếu có); số lượng và danh sách hàng trong túi.
3. Hành khách, người gửi hàng phải thực hiện các quy định về bảo đảm an ninh hàng không theo quy định của Thông tư này. Hành khách phải tuyệt đối chấp hành các chỉ dẫn về an ninh, trật tự của lực lượng kiểm soát an ninh hàng không, mệnh lệnh của thành viên tổ bay. Trong trường hợp không tuân thủ thì căn cứ vào tính chất và mức độ vi phạm sẽ bị xử lý theo quy định của pháp luật. Hành khách phải biết nội dung và phải chịu trách nhiệm trước pháp luật đối với hành lý mang theo người hoặc ký gửi lên tàu bay; tổ chức, cá nhân gửi hàng hóa, bưu gửi phải biết nội dung của hàng hóa, bưu gửi và phải chịu trách nhiệm trước pháp luật đối với hàng hóa, bưu gửi lên tàu bay.
4. Nhân viên hàng không phải tuân thủ các quy định về bảo đảm an ninh hàng không theo quy định của Thông tư này và quy định pháp luật về an ninh hàng không; trong khi thực hiện nhiệm vụ, không được sử dụng đồ uống có cồn, các chất kích thích khác; nếu vi phạm sẽ bị đình chỉ thực hiện nhiệm vụ, căn cứ tính chất, mức độ vụ việc vi phạm sẽ bị thu hồi thẻ kiểm soát an ninh hàng không, giấy phép nhân viên hàng không.
Điều 96. Kinh phí bảo đảm an ninh hàng không
1. Cục Quản lý xuất nhập cảnh căn cứ nhiệm vụ được giao, hàng năm xây dựng dự toán kinh phí từ nguồn ngân sách nhà nước và các nguồn kinh phí hợp pháp khác, trình Bộ Công an và triển khai thực hiện sau khi được phê duyệt.
2. Các doanh nghiệp tự bảo đảm toàn bộ kinh phí cho công tác bảo đảm an ninh hàng không thuộc trách nhiệm của mình được quy định trong Thông tư này và các quy định khác của pháp luật.
Chương IX
ĐIỀU KHOẢN THI HÀNH
Điều 97. Hiệu lực thi hành
1. Thông tư này có hiệu lực kể từ ngày ký ban hành.
2. Thay thế Phụ lục I ban hành kèm theo Thông tư số 31/2025/TT-BCA ngày 21 tháng 5 năm 2025 bằng Phụ lục IA ban hành kèm theo Thông tư này.
3. Cục Quản lý xuất nhập cảnh, Thủ trưởng các cơ quan thuộc Bộ Công an, Giám đốc Công an cấp tỉnh và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này./.
