CIRCULAR

Regulations on Energy Consumption Standards in the Brewing and Non-Alcoholic Beverages Industry

 

Circular No. 28/2024/TT-BCT dated December 25, 2025 by the Minister of Industry and Trade regulating energy consumption standards in the brewing and non-alcoholic beverages industry, effective from April 1, 2025, amended and supplemented by:

Circular No. 12/2026/TT-BCT dated March 9, 2026 by the Minister of Industry and Trade abolishing certain regulatory documents within the authority of the Minister of Industry and Trade, effective from May 1, 2026.

Based on the Law on Energy Conservation and Efficiency dated June 17, 2010;

Based on Decree No. 96/2022/NĐ-CP dated November 29, 2022 by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on Decree No. 105/2024/NĐ-CP dated August 1, 2024 by the Government amending and supplementing certain provisions of Decree No. 96/2022/NĐ-CP dated November 29, 2022 by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade and Decree No. 26/2018/NĐ-CP dated February 28, 2018 by the Government on the Regulations Governing the Organization and Operation of Vietnam Electricity Group;

In accordance with the proposal from the Director of the Energy Conservation and Sustainable Development Department;

The Minister of Industry and Trade promulgates this Circular regulating energy consumption standards in the brewing and non-alcoholic beverages industry.[1]

CHAPTER I.GENERAL PROVISIONS

 

Article 1. Scope of Application

This Circular stipulates methods for determining energy consumption, energy consumption quotas, and reporting procedures in the brewing and non-alcoholic beverages industry. Article 2. Applicability 1. Production facilities and organizations operating within the brewing and non-alcoholic beverages industry whose production type and capacity scale are specified under Article 5 of this Circular.

2. Other relevant agencies, organizations, and individuals.

Article 3. Interpretation of Terms 1. The brewing and non-alcoholic beverages industry is the industrial sector producing various types of beer and non-alcoholic beverages as defined in the Vietnamese Economic Classification System..

2. Production facilities within the brewing and non-alcoholic beverages industry subject to this Circular (hereinafter referred to as production facilities) are those with a production type and capacity scale specified under Article 5 of this Circular.

3. A production facility is a facility producing beer, non-alcoholic beverage products according to the seven-digit product code issued by the Prime Minister regarding the Vietnamese Product Classification System.

4. Non-alcoholic beer refers to beer produced using de-alcoholization technology.

5. Energy consumption (SEC) is the total energy consumed for producing one unit of product. 6. Energy consumption quota is the energy consumption standard specified for each specific type of product under this Circular..

CHAPTER II.

METHODS FOR DETERMINING ENERGY CONSUMPTION, ENERGY QUOTA AND REPORTING PROCEDURES

Article 4. Method for Determining Energy Consumption

1. The energy consumption in beer production is determined according to the method specified in Appendix I of this Circular.

2. The energy consumption in non-alcoholic beverage production is determined according to the method specified in Appendix II of this Circular.METHODS FOR DETERMINING ENERGY USAGE, DEFINING ENERGY USAGE QUANTITIES AND REPORTING REGIME

 

Article 4. Method for Determining Energy Usage

1. The energy usage in beer production is determined according to the method specified in Appendix I of this Circular.

2. The energy usage in non-alcoholic beverage production is determined according to the method specified in Appendix II of this Circular.

Article 5. Energy Consumption Quotas

The energy consumption quotas apply to production facilities in the beer and non-alcoholic beverage manufacturing industry as follows:

Article 6. Regular Reporting System

1. By January 31st each year, production facilities falling under the subject matter of paragraph 1 of this Circular's Article 2 shall report in writing to the local Department of Industry and Trade via direct delivery or postal service or through the electronic information platform https://dataenergy.vn regarding the results of implementing the energy consumption quotas for the preceding calendar year as per Appendix IV of this Circular. In case of reporting through the electronic information platform https://dataenergy.vn, production facilities shall be responsible for contacting the Department of Industry and Trade to obtain an account.

Within 20 working days from the date of receipt of the report from the production facility, the Department of Industry and Trade shall provide feedback and request additional information (if any).

Within 5 working days from the date of receiving the request for additional information from the Department of Industry and Trade, the production facility shall submit a revised and supplemented report as required.

2. By March 31st each year, the Department of Industry and Trade shall report on the results of implementing the energy consumption quotas for the preceding calendar year in the beer and non-alcoholic beverage manufacturing industry within its jurisdiction to the Ministry of Industry and Trade (Department of Energy Conservation and Sustainable Development) via writing through direct delivery or postal service or through the electronic information platform https://dataenergy.vn according to the format specified in Appendix III of this Circular. Chapter III. ORGANIZATION OF IMPLEMENTATION

Article 7. Responsibilities of the Department of Energy Conservation and Sustainable Development

1. To coordinate with relevant agencies to disseminate, promote, and guide organizations and individuals concerned in implementing the provisions of this Circular.

2. To cooperate with local Departments of Industry and Trade to inspect the implementation status of energy consumption quotas for plans to ensure that the energy consumption quotas stipulated in this Circular are observed.

3. To compile and statistically process data on energy consumption by the beer and non-alcoholic beverage manufacturing industry from reports submitted by localities.Article 8. Responsibilities of the Department of Industry and Trade[2]

 

1. Annually, to coordinate with relevant agencies to guide, urge, develop inspection plans, conduct inspections for compliance with energy consumption quotas regulations for production facilities within its jurisdiction that fall under the subject matter of this Circular, and handle cases of violations in accordance with legal provisions.

2. To cooperate with the Department of Energy Conservation and Sustainable Development to guide, urge, inspect the implementation of energy consumption quotas as per the contents of this Circular.

Article 9. Responsibilities of Production Facilities

1. To manage and supervise production processes to determine the amount of energy consumed. (Abolished)

2. In the event of any difficulties or issues arising during implementation, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Industry and Trade for study, amendment, and supplementation of this Circular./.

APPENDIX I.METHOD FOR DETERMINING ENERGY USAGE IN BEER MANUFACTURING FACILITIES
(Issued as an Annex to Circular No. 28/2024/TT-BCT dated December 25, 2024 by the Minister of Industry and Trade)

1. Scope of Evaluation: The production area for beer products includes the main production area and auxiliary areas (such as refrigeration units, compressors, steam boilers, etc.); it does not include administrative areas, internal transportation, raw water treatment, wastewater treatment, or production facilities for other products outside those specified in Point 3 of this Circular. 2. Time period for determining energy usage is one year (from January 1 to December 31). In the event that an inspection of energy usage is required, the time period shall be sufficient to complete a full production cycle..

3. Parameters for determining energy usage in beer manufacturing facilities are specified in Table 1.1 and apply within the scope and timeframe as per Clauses 1 and 2 of Appendix I of this Circular.

4. The reference product is bottled beer. Production volumes of other beer products will be converted to the volume of bottled beer using electrical energy usage coefficients and thermal energy usage coefficients for calculating energy usage. 5. 1. Scope of Evaluation: The production area for non-alcoholic beverage products includes the main production area and auxiliary areas (such as refrigeration, compression, steam boilers, PET bottle blow molding); it does not include administrative areas, internal transportation, raw water treatment, wastewater treatment, or other product production areas except those specified in Point 3 of this Circular. 2. The period for determining energy consumption is one year (from January 1 to December 31). In the event that an inspection of energy consumption is required, the time frame for such inspection shall be sufficient to complete a full production cycle..

3. Parameters for determining energy consumption in non-alcoholic beverage production facilities are specified in Table 2.1 and apply to the scope and period as defined in Clauses 1 and 2 of Appendix II of this Circular.

4. The reference product is PET-bottled non-alcoholic beverages. In cases where both gaseous and non-gaseous non-alcoholic beverage products are produced, the PET-bottled gaseous product will be selected as the reference product. Non-PET and non-glass bottled products shall be converted to the reference product using electricity consumption coefficients and heat usage coefficients for energy consumption calculation. 5. The SEC (Specific Energy Consumption) of a non-alcoholic beverage production facility is determined as follows:.

Heat energy (T) is determined from the steam consumption used to produce non-alcoholic beverages as follows:

The thermal energy (T) is determined from the amount of steam used (t_hơi) to produce beer as follows:

[1] Circular No. 12/2026/TT-BCT abolishing certain regulatory documents within the authority of the Minister of Industry and Trade is as follows:

“Based on Law on Issuing Normative Legal Documents No. 64/2025/QH15; Law on Issuing Normative Legal Documents No. 87/2025/QH15;

Based on Decree No. 78/2025/NĐ-CP of the Government, detailing certain provisions and measures for implementing the Law on Issuing Normative Legal Documents; Decree No. 79/2025/NĐ-CP dated April 1, 2025, of the Government on reviewing, checking, systematizing, and handling normative legal documents; Decree No. 187/2020/NĐ-CP dated July 1, 2020, of the Government amending and supplementing certain provisions of Decree No. 78/2025/NĐ-CP dated April 1, 2025, of the Government detailing certain provisions and measures for implementing the Law on Issuing Normative Legal Documents and Decree No. 79/2025/NĐ-CP dated April 1, 2025, of the Government on reviewing, checking, systematizing, and handling normative legal documents;

Based on Decree No. 40/2025/NĐ-CP dated February 26, 2025, of the Government, detailing functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade; Decree No. 109/2025/NĐ-CP dated May 20, 2025, of the Government, detailing functions, tasks, powers, and organizational structure of the Office of the Prime Minister; Decree No. 193/2025/NĐ-CP dated July 2, 2025, of the Government, detailing certain provisions and measures for implementing the Law on Geology and Mineral Resources;

In accordance with the request of the Director of the Legal Affairs Department,

The Minister of Industry and Trade promulgates this Circular to abolish certain regulatory documents within his authority.”

[2] Article 3 of Circular No. 12/2026/TT-BCT abolishing certain regulatory documents within the authority of the Minister of Industry and Trade, effective from May 1, 2026, is as follows:

“Article 3. Implementation Provisions

1. This Circular takes effect on May 1, 2026.

2. The Director of the Legal Affairs Department, Head of the Office of the Ministry, Heads of units under the Ministry of Industry and Trade, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.”

[3] This clause is abolished in accordance with paragraph 2 of Article 2 of Circular No. 12/2026/TT-BCT abolishing certain regulatory documents within the authority of the Minister of Industry and Trade, effective from May 1, 2026 2026.
