PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on the Elderly dated April 28, 2000;

Considering the proposal of the Minister of Labor, Invalids and Social Affairs, and the Minister of Interior,

DECISION:

Article 1. The National Committee for the Elderly of Vietnam is hereby established.

The National Committee for the Elderly of Vietnam is an inter-ministerial organization with the function of assisting the Prime Minister in directing and coordinating activities to serve the care and promotion of the role of the elderly.The National Committee for the Elderly of Vietnam has the following tasks:

Article 2. 1. Assist the Prime Minister in formulating policies, programs, and plans for caring for and promoting the role of the elderly.

2. Assist the Prime Minister in directing, guiding, urging, inspecting, and evaluating the activities of ministries, sectors, and localities in implementing state laws and policies concerning the care and promotion of the role of the elderly.

3. Assist the Prime Minister in organizing cooperation among ministries, sectors, localities, and mass organizations in publicizing, disseminating, and mobilizing the people to implement the Party's policies and state laws regarding the elderly.

4. Assist the Prime Minister in implementing directives on international cooperation activities related to the elderly.

5. Summarize and periodically report to the Prime Minister on the implementation of work related to the care and promotion of the role of the elderly.

Members of the National Committee for the Elderly of Vietnam include:

Article 3. 1. Chair: Deputy Prime Minister;

2. Vice Chair: Minister of Labor, Invalids and Social Affairs;

3. Vice Chair: One representative from the Central Association of the Elderly of Vietnam.

4. Members:

- One Deputy Minister of Interior;

- One Deputy Minister of Planning and Investment;

- One Deputy Minister of Finance;

- One Deputy Minister of Health;

- One Deputy Minister of Education and Training;

- One Deputy Minister of Culture, Sports and Tourism;

- One Deputy Director of the Sports Committee;

- One Deputy Minister of Justice;

- One Deputy Minister of Agriculture and Rural Development;

- One Deputy Director of the Committee for Ethnic Minorities and Mountainous Areas;

- One Deputy Director of the Committee for Population, Family and Children.

- Inviting representatives from central mass organizations to participate, including:

+ One representative from the Standing Committee of the Central Committee of the Vietnam Fatherland Front;

+ One Vice President of the Vietnam Women's Union;

+ One Vice President of the Vietnam General Confederation of Labor;

+ One Vice President of the Vietnam Veterans Association;

+ One Vice President of the Vietnam Farmers' Association;

+ One representative from the Secretariat of the Communist Youth Central Committee.

+ One representative from the Vietnam Literacy Promotion Association.

The National Committee for the Elderly of Vietnam has an office located at the Central Association of the Elderly.

Article 4. The Ministry of Labor, Invalids and Social Affairs and the Central Association of the Elderly of Vietnam will assign personnel to assist in operations.

The Committee may use its own seal and operational funds provided by the state through the Central Association of the Elderly of Vietnam. The Central Association ensures the conditions for operation and working facilities for the Committee.

The operating regulations of the National Committee for the Elderly of Vietnam shall be decided by the Chairman of the Committee.

Specific responsibilities of agencies with members of the National Committee for the Elderly of Vietnam:

Article 5. 1. The Ministry of Labor, Invalids and Social Affairs performs state management functions over elderly affairs; takes the lead and coordinates with relevant ministries and sectors in drafting and promulgating normative legal documents in the field of elderly affairs.

2. The Ministry of Interior leads and coordinates with relevant ministries and sectors in directing and organizing the improvement and creating favorable conditions for the Elderly Association and the Elderly Association Representative Councils at all levels to operate effectively.

3. The Ministry of Finance ensures budget funding for supporting the care and promotion of the role of the elderly according to the national program's objectives; cooperates in inspecting and settling accounts for the use of funds in accordance with current state regulations.

4. The Ministry of Planning and Investment collaborates with the Ministry of Finance and relevant ministries and sectors in preparing annual budget estimates for supporting the care and promotion of the role of the elderly.

5. The Ministry of Health is responsible for state management of health care for the elderly; guides healthcare facilities on professional and technical aspects of health care for the elderly; strengthens research in the field of health care for the elderly; trains and improves the qualifications of medical staff in treating the elderly; implements educational and knowledge dissemination programs to help the elderly improve their skills in disease prevention and self-care.

6. The Ministry of Education and Training leads and coordinates with relevant ministries and sectors in organizing and implementing nationwide campaigns to build a learning society, establishing community learning centers. Develop mechanisms and policies to encourage and motivate the elderly to continue learning and contributing to the country.

7. The Ministry of Culture, Sports and Tourism leads and coordinates with relevant agencies in disseminating information and propaganda about elderly care and role promotion; encourages and creates conditions for the elderly to participate in cultural activities.

8. The Ministry of Justice participates in drafting and reviewing draft normative legal documents on the elderly; promotes and propagandizes legal documents on the elderly.

9. The Ministry of Agriculture and Rural Development leads and coordinates with relevant ministries and sectors in directing and creating conditions for the elderly to organize income-generating and employment activities in agriculture and rural development.

10. The Committee for Population, Family and Children leads and coordinates with relevant ministries and sectors in directing elderly care and role promotion activities linked to building harmonious, equal, progressive, happy, and sustainable families.

11. The Sports Committee leads and coordinates with the Ministry of Culture, Sports and Tourism in guiding the dissemination, encouragement, and creation of conditions for the elderly to participate in physical exercise activities.

12. The Committee for Ethnic Minorities leads and coordinates with relevant ministries and sectors in directing elderly affairs in mountainous areas and ethnic minority regions.

Article 12. The Committee for Ethnic Minority Affairs shall take the lead and coordinate with relevant ministries and sectors to direct work related to the elderly in mountainous areas and regions with ethnic minorities.

13. The Vietnam Association of the Elderly, the Central Committee of the Vietnam Fatherland Front, the Central Committee of the Vietnam Women's Union, the Vietnam General Confederation of Labour, the Vietnam Veterans Association, the Vietnam Farmers' Association, the Central Committee of the Ho Chi Minh Communist Youth Union, and the Vietnam Literacy Promotion Association shall cooperate with ministries, sectors, and localities to mobilize the strength of the entire people to participate in the work of caring for and promoting the role of the elderly.

Article 6. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 7. The Chairman of the National Committee on the Elderly of Vietnam, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial and centrally-administered city People's Committees, and members of the National Committee on the Elderly of Vietnam as stipulated in Article 3 shall be responsible for implementing this Decision.
