OF THE MINISTER OF FOREIGN AFFAIRS

REGULATING THE PROCEDURES FOR LEGALIZATION OF DOCUMENTS BY CONSULAR AUTHORITY

 

THE MINISTER OF FOREIGN AFFAIRS

Pursuant to Article 26 of the Consular Ordinance dated November 24, 1990;

Pursuant to Decree 157/CP dated October 9, 1961 of the Council of Ministers on the tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

ISSUES THE CIRCULAR regulating the procedures for legalization of documents as follows:

 

I. GENERAL PROVISIONS

1. In accordance with this Circular, consular legalization is the certification of signatures and seals on official documents and papers issued or notarized by agencies and organizations within the consular district in the receiving country for use in Vietnam, or official documents and papers issued or notarized by Vietnamese agencies and organizations for use in the consular district of the receiving country, and the verification of the conformity of the form of such documents and papers with the laws of the issuing country.

2. The legalization shall be carried out by consular officials at the consular office or by diplomatic officials authorized to perform consular functions (hereinafter referred to collectively as consular officials) at the diplomatic mission's premises. These individuals shall be responsible under the law for their acts of legalization.

3. Consular officials shall legalize documents and papers issued or notarized by Vietnamese agencies and organizations for use in the consular district of the receiving country upon request from the competent authorities of the receiving country in that consular district.

4. Consular officials shall verify the conformity of the form of documents and papers with the laws of the issuing country when requested and when there is no doubt about the legal status of those documents and papers.

 

II. PROCEDURES FOR LEGALIZATION OF DOCUMENTS BY CONSULAR AUTHORITY

1. Before being legalized at the diplomatic mission, documents and papers issued or notarized in the receiving country must be certified by the Consular Department of the Ministry of Foreign Affairs of the receiving country or another agency in the consular district authorized by the Ministry of Foreign Affairs of the receiving country regarding the signatures and seals on these documents and papers. If certification of the conformity of the form of the documents and papers with the laws of the receiving country is required, the consular official may require that the certification by the Ministry of Foreign Affairs of the receiving country include this content.

Documents and papers issued or notarized in Vietnam must be certified by the Consular Department of the Ministry of Foreign Affairs of Vietnam or another agency authorized by the Ministry of Foreign Affairs of Vietnam.

Documents and papers issued or notarized in a third country must be certified by the diplomatic mission or consular office of that country in the receiving country.

2. Consular officials have the responsibility to check whether the contents and intended use of the documents and papers comply with the basic principles of Vietnamese law.

If necessary, consular officials have the right to request the parties to clarify or produce documents to prove the intended use of the documents and papers.

3. In the legalization section, consular officials do not certify the signature of the person who signed the document and the seal of the agency he or she represents. Consular officials only certify the signature of the authorized representative and the registered seal of the Consular Department of the Ministry of Foreign Affairs of the issuing country or another agency authorized by the Ministry of Foreign Affairs, or the seal of the diplomatic mission or consular office of the third country in the receiving country.

4. Consular officials legalize documents and papers by affixing a pre-engraved or typed stamp with the content according to the model attached as an appendix.

When there is no space on the document or paper for legalization, the consular official certifies on a separate sheet attached to the document or paper, with the stamp affixed across the seam of the document or paper requiring legalization.

5. Consular officials collect fees for legalization in accordance with the general regulations on consular fees.

 

III. IMPLEMENTATION

This Circular takes effect from the date of issuance. The heads of diplomatic missions and consular offices of Vietnam abroad and those authorized to perform consular functions abroad, and the Heads of the Consular Department are responsible for implementing this Circular.
