PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Decree regulates the organization of anniversary days; ceremonies for bestowing and receiving awards and achievement titles; foreign diplomatic rites and welcoming foreign guests.

Article 2. This Decree applies to state agencies, political organizations, political-social organizations, political-social-professional organizations, social-professional organizations, social organizations, economic organizations, and people's armed units when organizing anniversary days; bestowing and receiving awards and achievement titles; implementing foreign diplomatic rites and welcoming foreign guests.

Article 3. Requirements for the organization of anniversary days; ceremonies for bestowing and receiving awards and achievement titles; foreign diplomatic rites and welcoming foreign guests

Clause 1. The organization of anniversary days; bestowing and receiving awards and achievement titles must ensure safety, solemnity, economy, effectiveness, and not be ostentatious; it should have significance in honoring events, groups, and individuals.

Clause 2. The organization of anniversary days; bestowing and receiving awards and achievement titles must carry educational significance in fostering patriotism and revolutionary ideals; it should be linked with patriotic competition movements and the implementation of tasks for economic and social development, national defense, and security at local and national levels.

Clause 3. Adherence to civilized customs, preservation of cultural values, and ethnic identity in memorial ceremonies; bestowal and reception of awards and achievement titles.

Clause 4. The organization of foreign diplomatic rites and welcoming foreign guests must focus on political and diplomatic requirements, comply with Vietnamese laws, international laws, and practices to contribute to enhancing and expanding friendly relations and cooperation with countries and international organizations.

Clause 5. The level and ceremony for welcoming foreign delegations shall be based on the requirements of the visit and the principle of reciprocity proposed by the organizing agency.

Article 3. Explanation of Terms

In this Decree, the following terms shall be understood as follows:

Article 4. "Round year," "odd five-year," and "other years" refer to the number of years of commemoration (the occasion) of events.

Point a. "Round year" refers to years ending in "0."

Point b. "Odd five-year" refers to years ending in "5."

Point c. "Other years" refer to years ending in other digits.

For the case of organizing the Giỗ Tổ Hùng Vương Day, the determination of "round year," "odd five-year," and "other years" is calculated according to the Gregorian calendar.

Article 5. "Party and State leaders" include the General Secretary, President, Prime Minister, Chairman of the National Assembly, members of the Politburo, members of the Central Secretariat of the Communist Party, Vice Presidents, Deputy Prime Ministers, and Vice Chairmen of the National Assembly. The President of the State, the Prime Minister, the Chairman of the National Assembly, members of the Politburo, members of the Secretariat of the Central Committee of the Communist Party, the Vice President of the State, the Deputy Prime Minister, the Vice Chairman of the National Assembly.

Article 6. "High-level foreign guests" include Heads of State and Deputy Heads of State; Prime Ministers and Deputy Prime Ministers; Chairmen and Deputy Chairmen of the National Assembly and equivalents; other high-level foreign guests specified in this Decree. The Prime Minister and Deputy Prime Ministers; the Chairmen and Vice Chairmen of the National Assembly and equivalents; other high-level foreign guests as specified in this Decree.

Article 7. "State visit," "official visit," and "working visit" refer to the nature and level of visits by high-level foreign guests, where a state visit is the highest ceremonial level for welcoming and hosting.

Article 8. "Official welcoming ceremony," "Official talks," and "Official banquet" are key activities in the program of visits by high-level foreign guests hosted by Vietnamese Party and State leaders of equivalent rank.

Article 9. "High-level meeting" refers to meetings between high-level foreign guests and Vietnamese Party and State leaders.

Article 10. "Diplomatic delegation" refers to the group of heads of foreign diplomatic missions in Vietnam.

Article 11. "International Organizations in Hanoi" refers to organizations under the United Nations system and intergovernmental international organizations outside the United Nations system that have representative offices in Hanoi.

Chapter II

ANNIVERSARIES OF MAJOR NATIONAL HOLIDAYS

Article 4. National holidays

National holidays include:

1. Lunar New Year's Day (Tet Nguyen Dan on January 1st of the lunar calendar).

2. The Founding Day of the Communist Party of Vietnam (February 3, 1930).

3. King Hung Ancestral Commemoration Day (March 10th of the lunar calendar).

4. Reunification Day (April 30, 1975).

5. Dien Bien Phu Victory Day (May 7, 1954).

6. Ho Chi Minh's Birthday (May 19, 1890).

7. August Revolution Day (August 19, 1945) and National Day of the Socialist Republic of Vietnam (September 2, 1945).

Article 5. Lunar New Year's Day

1. The President sends Tet greetings through Vietnam Television and Voice of Vietnam at the stroke of midnight.

2. Five to seven days before Tet, the Minister of Foreign Affairs meets with the Diplomatic Corps and heads of international organizations in Hanoi.

Article 6. Founding Day of the Communist Party of Vietnam

1. In odd-numbered years:

a) In Hanoi, Party and State leaders, former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, departments, ministries, political-social organizations (hereinafter referred to as central mass organizations), and the city of Hanoi visit the Mausoleum of President Ho Chi Minh and pay tribute at the Martyrs' Memorial (hereinafter referred to as the Memorial). The Government Office takes the lead and coordinates with relevant agencies to organize these activities;

b) Organize propaganda activities on mass media at the central and local levels.

2. In even-numbered years:

a) Organize a national commemorative ceremony:

In Hanoi, the Central Committee of the Communist Party of Vietnam, the National Assembly, the President, the Government, the Central Committee of the Vietnam Fatherland Front, and the city of Hanoi solemnly organize the commemorative ceremony;

Party and State leaders, former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, departments, ministries, central mass organizations, the city of Hanoi, the Diplomatic Corps, and heads of international organizations in Hanoi attend the ceremony;

The General Secretary of the Central Committee of the Communist Party of Vietnam (hereinafter referred to as the General Secretary) delivers the commemorative speech;

b) Other activities are organized as in odd-numbered years.

Article 7. King Hung Ancestral Commemoration Day

1. In odd-numbered years:

a) In Phu Tho Province, the Provincial Party Committee, People's Council, People's Committee, and Provincial Vietnam Fatherland Front Committee organize a memorial ceremony. The Chairman of the Phu Tho Provincial People's Committee serves as the main officiant for the ceremony;

b) Provinces and centrally governed cities with historical sites and temples dedicated to King Hung organize memorial ceremonies;

c) Memorial rituals are uniformly implemented nationwide according to guidelines from the Ministry of Culture, Sports, and Tourism;

d) Organize propaganda activities on mass media at the central and local levels.

2. In even-numbered years:

a) Organize a national King Hung Ancestral Commemoration Ceremony:

In Phu Tho Province, the Ministry of Culture, Sports, and Tourism takes the lead and coordinates with the Phu Tho Provincial People's Committee to organize the King Hung Ancestral Commemoration Ceremony;

The President serves as the main officiant for the ceremony;

Party and State leaders (one of three positions: General Secretary, Prime Minister, or Chairperson of the National Assembly), former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, departments, ministries, central mass organizations, representatives of overseas Vietnamese, and representatives of the leadership of the Phu Tho Provincial Party Committee, People's Council, People's Committee, and Provincial Vietnam Fatherland Front Committee attend the ceremony;

Invitations for foreign guests are decided by the competent authority;

b) Other activities are organized as in odd-numbered years.

Article 8. South Vietnam Liberation Day, National Reunification Day

1. In odd-numbered years:

a) In Hanoi, Party and State leaders, former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, mass organizations, and the city of Hanoi visit the Mausoleum to pay respects to President Ho Chi Minh and commemorate heroes and martyrs at the Monument.

b) In Ho Chi Minh City, the Ho Chi Minh City Party Committee, People's Council, People's Committee, and Ho Chi Minh City Vietnam Fatherland Front Committee visit heroes and martyrs at the Ho Chi Minh City Martyrs' Cemetery;

c) Organize propaganda activities on mass media at the central level and localities.

2. In even-numbered years:

a) Organize a national commemorative ceremony:

In Ho Chi Minh City, the Central Committee of the Communist Party of Vietnam, the National Assembly, the State President, the Government, the Central Committee of the Vietnam Fatherland Front, and Ho Chi Minh City solemnly organize the commemoration ceremony;

Party and State leaders (one of four positions: General Secretary, State President, Prime Minister, Chairman of the National Assembly), former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, mass organizations, representatives of overseas Vietnamese, and representatives of the Ho Chi Minh City Party Committee, People's Council, People's Committee, and Ho Chi Minh City Vietnam Fatherland Front Committee attend the commemoration ceremony;

Invitations for foreign guests are decided by the competent authority;

Party and State leaders deliver the commemorative speech;

b) Other activities are organized as in odd-numbered years.

Article 9. Dien Bien Phu Victory Day

1. In odd-numbered years:

a) In Dien Bien Province, the Dien Bien Provincial Party Committee, People's Council, People's Committee, and Dien Bien Provincial Vietnam Fatherland Front Committee lay flowers at the Dien Bien Phu Historical Victory Monument and pay respects to heroes and martyrs at the Dien Bien Phu Martyrs' Cemetery;

b) Organize propaganda activities on mass media at the central and local levels.

2. In even-numbered years:

a) Organize a national-level commemoration ceremony: The ceremony in Dien Bien Province or Hanoi shall be decided by the competent authority;

The Central Committee of the Communist Party of Vietnam, the National Assembly, the State President, the Government, the Central Committee of the Vietnam Fatherland Front, and Dien Bien Province solemnly organize the commemoration ceremony;

Party and State leaders (one of four positions: General Secretary, State President, Prime Minister, Chairman of the National Assembly), former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, mass organizations, and representatives of the Dien Bien Provincial Party Committee, People's Council, People's Committee, and Dien Bien Provincial Vietnam Fatherland Front Committee attend the commemoration ceremony;

Invitations for foreign guests are decided by the competent authority;

Party and State leaders deliver the commemorative speech;

b) In case the commemoration ceremony is held in Hanoi, Party and State leaders, former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, mass organizations, Dien Bien Province, and the city of Hanoi visit the Mausoleum to pay respects to President Ho Chi Minh and commemorate heroes and martyrs at the Monument. The Office of the Government shall take the lead and coordinate with relevant agencies to organize these activities;

c) Other activities are organized as for years ending in 5, otherwise;

Article 10. Birthday of President Ho Chi Minh

1. In odd-numbered years:

a) In Hanoi, Party and State leaders, former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, mass organizations, and the city of Hanoi visit the Mausoleum to pay respects to President Ho Chi Minh and commemorate heroes and martyrs at the Monument.

b) In Nghe An Province, the Nghe An Provincial Party Committee, People's Council, People's Committee, and Nghe An Provincial Vietnam Fatherland Front Committee lay flowers at the Ho Chi Minh President Monument in Vinh Square, Vinh City, and the Kim Lien Historical Site, Nam Dan District;

c) Localities with Ho Chi Minh President memorials organize incense offering ceremonies to commemorate him;

d) Organize propaganda activities on mass media at the central level and localities;

đ) Vietnamese representative offices in countries with Ho Chi Minh President memorials and monuments organize incense offering ceremonies to commemorate him;

2. In even-numbered years:

a) Organize a national commemorative ceremony:

In Hanoi, the Central Committee of the Communist Party of Vietnam, the National Assembly, the State President, the Government, the Central Committee of the Vietnam Fatherland Front, Hanoi City, and Nghe An Province solemnly organize the commemoration ceremony;

Party and State leaders, former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, mass organizations, representatives of overseas Vietnamese, representatives of the Hanoi City Party Committee, People's Council, People's Committee, and Hanoi City Vietnam Fatherland Front Committee, representatives of the Nghe An Provincial Party Committee, People's Council, People's Committee, and Nghe An Provincial Vietnam Fatherland Front Committee, the Diplomatic Corps, and heads of international organizations in Hanoi attend the commemoration ceremony;

Party and State leaders deliver the commemorative speech;

b) Other activities are organized as in odd-numbered years.

Article 11. August Revolution Day and National Day of the Socialist Republic of Vietnam

1. In odd-numbered years:

a) In Hanoi, Party and State leaders, former Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, mass organizations, and the city of Hanoi visit the Mausoleum to pay respects to President Ho Chi Minh and commemorate heroes and martyrs at the Monument.

b) The Prime Minister (for years other than those ending in 5), and the President (for years ending in 5) shall host a banquet in the form of a wine reception;

Leaders of the Party and State, former leaders of the Party and State, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, and mass organizations, representatives of the leadership of the Hanoi Municipal Party Committee, Hanoi People's Council, Hanoi People's Committee, and the Hanoi Vietnam Fatherland Front Committee, the Diplomatic Corps, and heads of international organizations' representative offices in Hanoi shall attend the commemoration ceremony;

c) The Ministry of Foreign Affairs shall organize for the Diplomatic Corps and heads of international organizations' representative offices in Hanoi to visit the Mausoleum to pay respects to President Ho Chi Minh and to commemorate fallen heroes at the Commemorative Monument;

d) Organize propaganda activities on mass media at the central level and localities;

d) Overseas representative offices of Vietnam shall organize receptions for guests;

2. In even-numbered years:

a) Organize a national commemorative ceremony:

In Hanoi, the Central Committee of the Communist Party of Vietnam, the President, the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and Hanoi City shall solemnly organize the commemoration ceremony;

Leaders of the Party and State, former leaders of the Party and State, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, and mass organizations, representatives of overseas Vietnamese, representatives of the leadership of the Hanoi Municipal Party Committee, Hanoi People's Council, Hanoi People's Committee, and the Hanoi Vietnam Fatherland Front Committee, the Diplomatic Corps, and heads of international organizations' representative offices in Hanoi shall attend the commemoration ceremony;

The President shall deliver the commemorative speech;

b) Organize a solemn banquet with the invitation made in the name of the General Secretary of the Central Committee of the Communist Party of Vietnam; The President, the Prime Minister, and the Chairman of the National Assembly;

Leaders of the Party and State, former leaders of the Party and State, leaders of the Central Committee of the Vietnam Fatherland Front, central ministries, agencies, and mass organizations, representatives of the leadership of the Hanoi Municipal Party Committee, Hanoi People's Council, Hanoi People's Committee, and the Hanoi Vietnam Fatherland Front Committee, the Diplomatic Corps, and heads of international organizations' representative offices in Hanoi shall attend the commemoration ceremony;

The President shall deliver the speech;

c) Other activities are organized as for years ending in 5, otherwise;

Article 12. Organization of parades, marches, and reviews

The organization of parades, marches, and reviews during the commemoration ceremony shall be carried out according to the decision of the competent authority;

Article 13. Activities during the commemoration period

Central ministries, agencies, and mass organizations, provinces, and centrally-administered cities shall organize educational activities on traditional values, cultural, artistic, and sports events, and street decorations suitable to the actual conditions of their respective localities and units, in compliance with this Decree and other relevant regulations;

Chapter III

COMMEMORATION OF THE BIRTHDAY OF

 LEADERS OF THE PARTY AND STATE WHO HAVE PASSED AWAY;

COMMEMORATION OF THE ANNIVERSARY OF DEATH OF OUTSTANDING PERSONALITIES

Article 14. Provisions on the authority to decide and frequency of organizing birthday commemorations of leaders of the Party and State who have passed away

1. The organization of birthday commemorations of leaders of the Party and State who have passed away shall be implemented according to the decision of the Politburo and the Secretariat;

2. Frequency of commemoration:

a) The first commemoration of the birthday of leaders of the Party and State who have passed away shall be organized on the occasion of the centenary of their birth;

b) The first commemoration of the birthday of leaders of the Party and State who lived over 100 years and have passed away shall be organized on the occasion of the 110th or 120th anniversary of their birth;

c) Subsequent commemorations shall be held every 10 years, with a smaller scale than the first commemoration.

Article 15. Commemorating the birthday of Party and State leaders who have passed away

1. Organizing the commemoration of the birthday of the General Secretary, President, Prime Minister, and National Assembly Chairman who have passed away:

a) The first commemoration:

Organize a national-level memorial ceremony: At the hometown of the leader, the Central Committee of the Communist Party of Vietnam, the President, the National Assembly, the Government, the Central Committee of the Vietnam Fatherland Front, and the provincial/municipal People's Committees under direct central jurisdiction where the leader was from will solemnly organize the memorial ceremony;

Party and State leaders (one of the four positions: General Secretary, President, Prime Minister, National Assembly Chairman), leaders of the Central Committee of the Vietnam Fatherland Front, relevant departments, ministries, agencies, and mass organizations at the central level, and representatives of the Provincial Party Committees, Municipal Party Committees, People's Councils, People's Committees, and Vietnam Fatherland Front Committees at the provincial/municipal level where the leader was from will attend the memorial ceremony;

Invitations for foreign guests are decided by the competent authority;

Party and State leaders deliver the commemorative speech;

Organize publicity activities on mass media at the central and local levels in the hometown of the leader;

b) Subsequent commemorations:

The Central Committee of the Communist Party of Vietnam, The President, the National Assembly, the Government, and the Central Committee of the Vietnam Fatherland Front authorize the Provincial Party Committees, Municipal Party Committees, People's Councils, People's Committees, and Vietnam Fatherland Front Committees at the provincial/municipal level where the leader was from to organize incense offerings at the place of remembrance of the leader;

Organize scientific seminars or discussion forums about the leader;

Organize cultural, artistic, sports activities welcoming the event in the province/city where the leader was from.

2. Organizing the commemoration of the birthday of the Political Bureau member, Central Secretariat member of the Communist Party of Vietnam, Vice President, Deputy Prime Minister, and Vice Chairman of the National Assembly who have passed away: Organize a provincial-level memorial ceremony for the Provincial Party Committee, Municipal Party Committee, People's Council, People's Committee, Vietnam Fatherland Front Committee at the provincial/municipal level where the leader was from, or the Standing Committee of the department, ministry, agency, or mass organization at the central level where the leader held the highest position before retirement will solemnly organize the memorial ceremony;

a) The first commemoration:

Party and State leaders, leaders of the Central Committee of the Vietnam Fatherland Front, relevant departments, ministries, agencies, and mass organizations at the central level, and representatives of the Provincial Party Committees, Municipal Party Committees, People's Councils, People's Committees, and Vietnam Fatherland Front Committees at the provincial/municipal level where the leader was from will attend the memorial ceremony;

Leaders of the provincial/municipal level or leaders of the Standing Committee of the department, ministry, agency, or mass organization at the central level where the leader held the highest position before retirement will deliver the commemorative speech;

Invitations for foreign guests are decided by the competent authority;

Organize publicity activities on mass media at the central and local levels in the hometown of the leader;

The Provincial Party Committee, Municipal Party Committee, People's Council, People's Committee, and Vietnam Fatherland Front Committee at the provincial/municipal level where the leader was from, or the Standing Committee of the department, ministry, agency, or mass organization at the central level where the leader held the highest position before retirement will organize incense offerings at the place of remembrance of the leader;

b) Subsequent commemorations:

Inviting foreign guests shall be decided by the competent authority.

3. The organization of the commemoration of the birthday of other Party and State leaders and outstanding predecessors who have passed away shall be carried out according to the decision of the Political Bureau and the Secretariat.

3. The organization of birthday commemoration ceremonies for other Party and State leaders and outstanding predecessors who have passed away shall be carried out according to the decision of the Politburo and the Secretariat.

Article 16. Commemoration of the Year of Death of Renowned Figures Recognized by the Party and State

1. In odd-numbered years:

Organize publicity activities on central and local mass media in the hometown of the renowned figure.

2. In even-numbered years:

The province or centrally governed city where the renowned figure's hometown is located shall take the lead and coordinate with relevant ministries, agencies to organize the commemoration ceremony.

In cases where the hometown cannot be determined, the commemoration ceremony shall be organized in the year of death in the province or centrally governed city where the renowned figure passed away.

In cases where the year of death cannot be determined, the commemoration ceremony shall be organized in the year of birth of the renowned figure.

Chapter IV

COMMEMORATION OF FOUNDING DAY, TRADITIONAL DAY AND OTHER REMEMBRANCE DAYS

 AND OTHER REMEMBRANCE DAYS

Article 17. Commemoration of Founding Day and Traditional Day of Central Ministries, Agencies, Mass Organizations, Economic Organizations, People's Armed Forces Units, Provinces, and Centrally Governed Cities

1. In odd-numbered years:

Organize publicity activities on central and local mass media.

2. In even-numbered years:

Central ministries, agencies, mass organizations, economic organizations, people's armed forces units, provinces, and centrally governed cities shall organize the commemoration ceremony.

3. The number of guests invited by the Organizing Committee shall be appropriate to the nature and scale of the event. In cases where the highest leaders of the Party and State are invited, one of the four comrades: General Secretary, President, Prime Minister, Chairman of the National Assembly shall be invited.

3. The organization of the commemoration of the birthday of other Party and State leaders and outstanding predecessors who have passed away shall be carried out according to the decision of the Political Bureau and the Secretariat.

Article 18. Other Remembrance Days

1. Other remembrance days serving the political tasks of central ministries, agencies, mass organizations, economic organizations, people's armed forces units, provinces, and centrally governed cities shall be organized according to the decision of the competent authority.

2. The invitation of guests shall be carried out in accordance with Clause 3 of Article 17 of this Decree.

Article 19. Parade and Procession Organization

The organization of parades and processions during commemorative ceremonies can only be implemented upon consideration and decision by the competent authority.

Chapter V

COMMEMORATION OF INTERNATIONAL HOLIDAYS

Article 20. Commemoration of the Birthdays of V.I. Lenin (April 22, 1870), C. Marx (May 5, 1818), F. Engels (November 28, 1820), and the October Revolution in Russia (November 7, 1917)

1. In odd-numbered years:

a) Organize publicity activities on central and local mass media;

b) The Hanoi Municipal Party Committee, Hanoi Municipal People's Council, Hanoi People's Committee, and the Vietnam Fatherland Front Committee in Hanoi shall lay wreaths at the monument of V.I. Lenin in Hanoi on his birthday and on the day of the October Revolution in Russia.

2. In even-numbered years:

a) Leaders of the Party and State, the Vietnam Fatherland Front Central Committee, central ministries, agencies, mass organizations, and representatives of the leadership of the Hanoi Municipal Party Committee, Hanoi Municipal People's Council, Hanoi People's Committee, and the Vietnam Fatherland Front Committee in Hanoi shall lay wreaths at the monument of V.I. Lenin in Hanoi on his birthday and on the day of the October Revolution in Russia. The Office of the Government shall take the lead and coordinate with relevant agencies to organize these activities;

b) The Ho Chi Minh National Academy of Politics and Public Administration shall take the lead in organizing the commemoration ceremony and scientific seminars on V.I. Lenin, C. Marx, F. Engels, and the October Revolution in Russia. Leaders of the Party and State, the Vietnam Fatherland Front Central Committee, representatives of central ministries, agencies, mass organizations related to the topic, and representatives of the leadership of the Hanoi Municipal Party Committee, Hanoi Municipal People's Council, Hanoi People's Committee, and the Vietnam Fatherland Front Committee in Hanoi shall attend the commemoration ceremony;

c) Other activities shall be organized as for other years ending in 5.

Article 21. Commemorating other international holidays

1. In odd-numbered years:

Organize publicity activities on central and local mass media.

2. In even-numbered years:

a) Relevant central agencies, ministries, sectors, and mass organizations related to the event organizing the commemoration ceremony;

b) Inviting guests shall be carried out in accordance with Clause 3, Article 17 of this Decree.

Chapter VI

FORM OF THE CEREMONY

Article 22. Decorations for the ceremony

1. The ceremony shall be organized in a conference hall or outdoors.

2. Organizing in a conference hall:

a) The National Flag or both the National Flag and the Party Flag shall be hung on the left side of the stage; the National Flag on the right and the Party Flag on the left (viewed from below);

b) A bust of President Ho Chi Minh shall be placed on a high platform under the National Flag or between the National Flag and the Party Flag. In cases where flags are hung on poles, the bust of President Ho Chi Minh shall be placed slightly forward to the right of the flagpole (viewed from below);

c) The title of the ceremony shall be displayed in formal script on the background to the right of the stage. If awards or commendations are presented, the highest award or commendation received must be fully recorded;

d) Flowers for decoration shall be placed at the bottom, in front of the bust of President Ho Chi Minh. Flower baskets from Party and State leaders shall be placed in prominent positions. Multiple flower baskets or potted plants shall not be placed on the stage;

đ) Slogans of the ceremony shall be hung in prominent positions suitable to the space of the conference hall. The content of the slogans shall be decided by the Organizing Committee;

e) Outside the conference hall, the National Flag shall be hung in a prominent position, along with decorative flags and slogan banners, creating an appropriate atmosphere for the ceremony;

g) Guests shall be seated in order from the center to the sides, and from the front to the back.

3. Organizing outdoors:

a) Outdoor ceremonies shall be held in a square, stadium, or another dignified location as decided by the Organizing Committee;

b) The stage shall be designed securely and decorated similarly to indoor ceremonies.

4. Traditional Flags

a) Traditional flags shall be made of fabric; rectangular in shape, with a width equal to two-thirds of the length;

b) Ensuring Vietnamese cultural traditions and customs, and not violating legal provisions.

Article 23. Attire

1. The attire of members of the Organizing Committee, delegates, guests, and the general public attending the ceremony shall be formal and appropriate as stipulated by the Organizing Committee.

2. Encouraging guests, delegates, and the general public attending the ceremony to wear traditional costumes, religious ceremonial attire, or military uniforms.

3. No badges, bow ties, or boutonnieres shall be worn. Encouraging guests, delegates, and the general public attending the ceremony to wear medals and decorations. Badges shall only be used by members of the Organizing Committee.

Article 24. Art Performances, Gift-Giving, and Hospitality

1. Where there is a program of artistic performances, the program must be appropriate to the content of the ceremony; the performance time shall not exceed 30 minutes and must be clearly stated on the invitation.

2. No gifts, emblems, or logos shall be given. Hospitality events shall not be organized except as provided for in Article 11 of this Decree.

Chapter VII

REQUIREMENTS AND PROCEDURES FOR THE COMMEMORATION CEREMONY;

PROCLAMATION, PRESENTATION, AND RECEIPT OF AWARDS AND HONORS

 FORMS OF RECOGNITION, AWARDS

Article 25. Forms of recognition and honors

1. The forms of recognition and honors prescribed in the Law on Competition and Awards that are announced, presented, and received according to this Decree include:

a) Orders: "Order of the Star of the Republic", "Ho Chi Minh Order", "Independence Order", "Military Merit Order", "Labor Order", "Defending the Fatherland Order", "Combat Merit Order", "Great Unity Order", "Bravery Order", "Friendship Order";

b) National Honorary Titles: "Heroic Province", "Heroic City"; "Mother Heroine of Vietnam"; "People's Armed Forces Hero"; "Labor Hero"; "People's Teacher", "Outstanding Teacher"; "People's Doctor", "Outstanding Doctor"; "People's Artist", "Outstanding Artist"; "People's Master Craftsman", "Outstanding Master Craftsman";

c) "Ho Chi Minh Prize", "State Prize";

d) Medals: "Victory Banner Medal", "National Security Medal", "Distinguished Service Medal", "Friendship Medal";

đ) "Prime Minister's Commendation"; e) "Flag of Excellence from the Government";

g) "National Model Worker".

2. Forms of honoring titles and presenting awards prescribed in other legal documents shall not be organized according to the provisions of this Decree.

Article 26. Requirements for the ceremony of presenting awards and commendations, and receiving titles of honor

1. The person in charge of the ceremony shall be a representative of the leadership of the agency, ministry, sector, provincial People's Committee, or the unit organizing the ceremony.

2. Separate ceremonies for presenting awards and commendations, and receiving titles of honor shall not be organized. Such ceremonies may only be combined with national holidays, anniversaries of establishment, traditional days of agencies, ministries, sectors, localities, units, and summary conferences according to specific programs and in compliance with the provisions of this Decree (except for cases of presenting awards for outstanding and sudden achievements and commendations for combat achievements).

3. Each award decision shall be announced, presented, and received only once. Processions or receptions from one level or location to another shall not be organized.

4. A representative of the collective being awarded shall directly receive the award decision, form of award, and title of honor for the collective. Individuals being awarded shall directly receive the award decision, form of award, and title of honor. In cases of posthumous awards, a representative of the family of the individual being posthumously awarded shall receive on their behalf.

5. Awards and titles of honor shall be presented from higher to lower levels. If the same form of award is involved, it shall be presented to collectives first and then individuals; regular awards before posthumous awards.

6. During the announcement, presentation, and reception of awards and titles of honor, those without responsibilities shall not present flowers, film, or take photographs on the stage.

Article 27. Procedure for holding commemorative ceremonies

1. Announce the program of the ceremony.

2. Flag-raising ceremony, delegates sing the National Anthem.

3. Declare the purpose and introduce delegates briefly and solemnly.

4. Delivering speeches or reports: Only address "Your Excellency [name and position]" to the highest-ranking leader at the Central level and the agency, ministry, sector, locality, or unit.

5. Announce the award decision, form of award, and title of honor.

6. Speeches by senior leaders or representatives of guests.

7. Remarks of thanks by the head of the agency, ministry, sector, locality, or unit.

8. Conclude the ceremony.

Article 28. Rituals for announcing, presenting, and receiving awards

1. Announcing the award decision:

a) A representative of the agency responsible for competition and reward work or the unit organizing the ceremony shall announce the full text of the award decision;

b) Award decision of the President: Before announcing, the announcer invites the Traditional Flag Team (if available), representatives of the Party committee, government leadership, Vietnam Fatherland Front, Trade Union, Ho Chi Minh Communist Youth Union, or representatives of successive generations of the collective being awarded (or the individual being awarded) to the stage to listen to the announcement of the award decision;

c) Award decision of the Prime Minister: After announcing, the announcer invites representatives of the leadership of the collective (or individual) named in the award decision to the stage to receive the title of honor or form of award.

2. Presenting forms of awards and titles of honor:

a) The presenter shall be a representative of the leaders attending the ceremony; the presenter shall stand at the center of the stage;

b) Present the Medal (or Badge accompanying the title) first; then present the Certificate and the Flag of Hero (for collectives receiving the title of Hero);

c) For collectives with a Traditional Flag: The presenter shall attach the Medal (or Badge accompanying the title) to the top corner of the Traditional Flag. The position of attaching the Medal (or Badge accompanying the title) on the Traditional Flag shall be arranged from high to low rank;

For collectives without a Traditional Flag: The presenter shall present the Certificate already attached with the Medal (or Badge accompanying the title).

d) Presenting to individuals: The presenter shall attach the Medal (or Badge accompanying the title) to the left chest pocket of the recipient, then present the Certificate. The position of attaching the Medal (or Badge accompanying the title) on the chest pocket shall be arranged from high to low rank;

đ) Posthumous presentation: The presenter shall present the Certificate already attached with the Medal (or Badge accompanying the title) to a representative of the family of the individual being posthumously awarded.

3. Receiving forms of awards and titles of honor:

a) Receiving forms of awards signed by the President's decision: The awardee shall stand solemnly in a straight line at the center of the stage to listen to the announcement of the award decision;

b) Receiving forms of awards and titles of honor signed by the

c) When receiving the Certificate (or Flag), the awardee shall hold the Certificate or Flag at chest level and maintain the posture until leaving the stage;

d) If necessary, a representative of the collective (or individual) being awarded may make remarks after receiving the award.

4. Service personnel for the presentation ritual:

a) Shall not turn their back to the audience; stand behind and to the right of the presenter when handing over the Medal (or Badge accompanying the title, Certificate, Flag) to the presenter;

b) Place the Medal (or Badge accompanying the title, Certificate) in a red-covered tray; hand over the Flag with both hands to the presenter; the Certificate must be framed.

5. The Ministry of Foreign Affairs and Vietnamese representative offices abroad shall take the lead and coordinate with relevant ministries, sectors, and mass organizations to organize the rituals for announcing, presenting, and receiving forms of awards for foreign organizations and individuals in accordance with this Decree and the actual conditions.

Chapter VIII

RECEIVING AND HOSTING HIGH-LEVEL FOREIGN DELEGATIONS

VISITING THE STATE, OFFICIAL VISITS

Article 29. Titles for High-Level Visits

1. The Ministry of Foreign Affairs agrees with the host country on the titles for each visit of the Head of State, the Head of State concurrently serving as the Head of the Ruling Party, the Prime Minister, the Deputy Head of State, the Deputy Head of State concurrently serving as the Leader of the Ruling Party, and the Deputy Prime Minister. Deputy Prime Minister:

a) The Head of State and the Head of State concurrently serving as the Head of the Ruling Party shall conduct visits under one of four titles: state visit, official visit, working visit, or personal visit.

b) Head of Government, Deputy Head of State, Deputy Head of State concurrently serving as leader of the ruling party, b) The Prime Minister, the Deputy Head of State, the Deputy Head of State concurrently serving as the Leader of the Ruling Party, and the Deputy Prime Minister shall conduct visits under one of three titles: official visit, working visit, or personal visit.

- Theme-based activities.

2. Official welcoming ceremony:

a) The President hosts the welcoming ceremony;

b) Participants: Spouse (or husband) of the President if the spouse (or husband) of the visiting Head of State is present, Deputy Prime Minister, Deputy Chairman of the National Assembly, Minister (or Deputy Minister) of Foreign Affairs, Director of the President's Office, accompanying ministers, Vietnam's Ambassador to the host country, leaders of relevant ministries, sectors, and localities corresponding to the composition of the visiting delegation and requirements for welcoming and hosting. Invite representatives of the Diplomatic Corps to attend based on specific requirements and conditions of the visit; The President of the State if the spouse (consort) of the Head of State of the host country is present, the Deputy Prime Minister, the Vice Chairman of the National Assembly, the accompanying minister (or deputy minister) of the Ministry of Foreign Affairs, the Director of the President's Office, the accompanying minister, the Ambassador of Vietnam to the host country, leaders of relevant ministries, sectors, and localities corresponding to the composition of the visiting delegation and requirements for welcoming and receiving; invite representatives of the diplomatic delegation to attend based on specific requirements and conditions of the visit;

c) Ceremonial welcoming and reviewing the Honor Guard of the Vietnam People's Army;

d) After the welcoming ceremony, the President and his/her spouse (or husband) will take a commemorative photograph with the visiting Head of State and his/her spouse (or husband) in the reception hall; two rows of honor guards salute with arms; the spouse (or husband) of the President sees off the spouse (or husband) of the visiting Head of State at the vehicle parking area. 1. The welcoming and hosting of the Head of State concurrently serving as the Head of the Ruling Party's state visit upon invitation of the General Secretary and the President shall be organized as follows:

a) The General Secretary hosts the welcoming ceremony, official talks, and official banquet for the Head of State concurrently serving as the Head of the Ruling Party (hereinafter referred to as the Head of the Delegation);

b) The President co-hosts the official banquet together with the General Secretary, has a private meeting, and invites the Head of the Delegation to a friendly meal.

2. At the airport:

a) The State President will preside over the welcoming ceremony;

b) Participants: Spouse (or husband) of the President if the spouse (or husband) of the visiting Head of State is present, Deputy Prime Minister, Deputy Chairman of the National Assembly, Minister (or Deputy Minister) of Foreign Affairs, Director of the President's Office, accompanying ministers, Vietnam's Ambassador to the host country, leaders of relevant ministries, sectors, and localities corresponding to the composition of the visiting delegation and requirements for welcoming and hosting. RECEIVING AND HOSTING HIGH-LEVEL FOREIGN DELEGATIONS

WORKING VISITS, PERSONAL VISITS, AND OTHER VISITS

Article 39. Welcoming and hosting foreign senior officials for working visits

1. Welcoming and hosting the Head of State, Head of State who is also the Leader of the Ruling Party, and the Head of Government for working visits shall be conducted as for official visits but without organizing an official welcoming ceremony, street decorations, or honor guard rows at the airport. At the reception dinner, the host delivers a toast, and the head of the visiting delegation responds;

2. Welcoming and hosting the National Assembly Chairman, Deputy Head of State, and Deputy Head of State who is also the Leader of the Ruling Party for working visits shall be conducted as for official visits but without organizing an official welcoming ceremony;

3. Welcoming and hosting the Deputy Prime Minister, Deputy Chairman of the National Assembly for working visits shall be conducted as for official visits but without organizing an official welcoming ceremony;

4. Participants at the reception dinner for working visits:

Article 40. Receiving and hosting foreign senior officials on personal visits

The receiving and hosting of foreign senior officials on personal visits shall be carried out in accordance with the following provisions:

1. For the Head of State who is also the Leader of the Ruling Party on a personal visit: The Head or Deputy Head of the Central External Relations Commission shall receive and see off at the airport. Arrange for the General Secretary and the President to meet and invite the Head of State who is also the Leader of the Ruling Party of the visiting country to a formal dinner.

2. For the Head of State and the Head of Government on a personal visit: The Director of the National Reception Bureau or the Department Head of the Foreign Ministry's Regional Department shall receive and see off at the airport. Based on mutual agreement with the visiting side, arrange for the President to host a formal meeting and invite the Head of State of the visiting country to a formal dinner; the Prime Minister to host a formal meeting and invite the Head of Government of the visiting country to a formal dinner.

3. For the Deputy Head of State who is also a Party leader on a personal visit: A representative of the Central External Relations Commission leadership shall receive and see off at the airport. Arrange for a Politburo member, the Standing Member of the Central Party Secretariat, or the Vice President to meet and invite the Deputy Head of State who is also a Party leader of the visiting country to a formal dinner. 4. For the Deputy Head of State,

Deputy Prime Minister on a personal visit: The leadership of the National Reception Bureau or the Department Head of the Foreign Ministry's Regional Department shall receive and see off at the airport. Based on mutual agreement with the visiting side, arrange for the Vice President to host and invite the Deputy Head of State of the visiting country to a formal dinner; the Deputy Prime Minister to host a formal meeting and invite the Deputy Prime Minister of the visiting country to a formal dinner. 5. For

the Chairman of the National Assembly and the Vice Chairman of the National Assembly on a personal visit: Based on mutual agreement with the visiting side, arrange for the Chairman of the National Assembly to meet and invite the Chairman of the National Assembly of the visiting country to a formal dinner; the Vice Chairman of the National Assembly to meet and invite the Vice Chairman of the National Assembly of the visiting country to a formal dinner. Article 41. Receiving and hosting foreign senior officials transiting through Vietnam

The receiving and hosting of foreign senior officials transiting through Vietnam shall be carried out in accordance with the following provisions:

1. A Politburo member or a Central Party Secretariat member shall receive and host the Head of State who is also the Leader of the Ruling Party of a foreign country transiting through Noi Bai International Airport.

2. A Minister or equivalent rank shall receive and host the Head of State of a foreign country transiting through Noi Bai International Airport.

3. A Minister or Deputy Minister shall receive and host the Head of Government of a foreign country transiting through Noi Bai International Airport.

4. The Head or Deputy Head of the Central External Relations Commission or equivalent rank shall receive and host the Deputy Head of State who is also a Party leader of a foreign country transiting through Noi Bai International Airport.

5. An Alternate Chief of the Government Office or Deputy Minister shall receive and host

the Deputy Prime Minister of a foreign country transiting through Noi Bai International Airport. 6. The National Assembly's Foreign Affairs Committee and the National Assembly's Office shall arrange for the reception and hosting of delegations from national parliaments and international parliamentary organizations transiting through Noi Bai International Airport.

7. The leadership of provinces and centrally governed cities shall receive and host foreign senior officials transiting through local airports.

8. If the foreign senior delegation requests to stay overnight, the lead agency shall coordinate with the diplomatic mission of the visiting country to arrange accommodation, meals, and transportation for the delegation.

VIETNAMESE SIDE: Participants in receiving, seeing off, and working meetings;

VISITING SIDE: Official members, some accompanying officials, and representatives of the embassy.

Article 42. Welcoming and hosting the Minister, Chairman of the Committee of the National Assembly or equivalent level

1. Welcoming and hosting the Minister or equivalent level:

a) The leader of the International Cooperation Department of the Ministry or agency shall receive and see off the delegation at the airport;

b) The Minister or equivalent level shall invite guests to host the welcoming, hosting, negotiation, and reception;

c) High-level meetings: Arrange based on the specific requirements and conditions of the visit;

d) The composition of participants in formal activities shall be decided by the Minister or equivalent level who invites the guests.

2. Welcoming and hosting the Chairman of the Committee of the National Assembly or equivalent level:

a) The leader of the Foreign Affairs Department of the National Assembly Office shall receive and see off the delegation at the airport;

b) The Chairman of the Committee or equivalent level shall invite guests to host the welcoming, hosting, negotiation, and reception;

c) High-level meetings: Arrange based on the specific requirements and conditions of the visit;

d) The composition of participants in formal activities shall be decided by the Chairman of the Committee or equivalent level who invites the guests.

3. The Ministry of National Defense and the Ministry of Public Security shall take the lead and coordinate with relevant ministries and sectors to establish regulations on ceremonial welcoming and hosting of the Minister of National Defense, the Minister of Public Security, and leaders of foreign armed forces visiting Vietnam in accordance with international practices and the levels of welcoming and hosting Vietnamese guests as prescribed in this Decree, for submission. consideration and decision by the Prime Minister.

Article 43. Welcoming and hosting other guests

1. For the President of the European Council invited by the State President, the level and ceremony of welcoming and hosting shall be carried out as for a foreign Head of State visiting Vietnam under the name of the visit. For the President of the European Commission invited by the Prime Minister, the level and ceremony of welcoming and hosting shall be carried out as for a foreign Head of Government visiting Vietnam under the name of the visit. 2. For the Secretary-General of the United Nations visiting officially or working invited by the State President, the level and ceremony of welcoming and hosting shall be carried out as for a foreign Head of State visiting Vietnam for work.

3. For the President of the Upper House of a foreign country, the President of the Lower House of a foreign country, the President of the World Parliamentary Union (IPU), the President of the Southeast Asian Parliamentarians' Organization (AIPA) invited by the Chairman of the National Assembly, the level and ceremony of welcoming and hosting shall be carried out as for a foreign President of the National Assembly visiting Vietnam. For the Vice-President of the Upper House of a foreign country, the Vice-President of the Lower House of a foreign country, the Vice-President of the World Parliamentary Union (IPU), the Vice-President of the Southeast Asian Parliamentarians' Organization (AIPA) invited by the Vice-Chairman of the National Assembly, the level and ceremony of welcoming and hosting shall be carried out as for a foreign Vice-President of the National Assembly visiting Vietnam. 4. For the Heir to the Throne or Queen of a foreign country invited by the Deputy State President, the level and ceremony of welcoming and hosting shall be carried out as for a foreign Deputy Head of State visiting Vietnam.

5. The leader of the Ministry of Foreign Affairs shall host the welcoming and hosting of other members of the foreign Royal Family who are guests of the Ministry of Foreign Affairs. 6. The leader of the ministry or sector leading the economic, cultural, and social delegation headed by a member of the foreign Royal Family shall host the welcoming and hosting of that delegation.

7. The Ministry of Foreign Affairs shall organize the welcoming and hosting of former Heads of State, Heads of Government, Deputy Heads of State, Deputy Prime Ministers of foreign countries visiting Vietnam upon invitation by the State President, the Prime Minister, the Deputy State President, or the Deputy Prime Minister. 8. The Foreign Relations Committee of the National Assembly and the National Assembly Office shall organize the welcoming and hosting of former Presidents of foreign National Assemblies, Vice-Presidents of foreign National Assemblies, Secretaries-General of AIPA, IPU, and inter-parliamentary organizations visiting Vietnam upon invitation by the Chairman of the National Assembly or the Vice-Chairman of the National Assembly.

9. Former Heads of State, Heads of Government, Chairmen of National Assemblies, Deputy Heads of State, Deputy Prime Ministers, and Vice-Presidents of National Assemblies of foreign countries invited by any agency shall be hosted by that agency.

10. Based on the specific requirements and conditions of the visit, arrange for the leaders of the Party and State to meet.

ON WELCOMING AND HOSTING FOREIGN DELEGATIONS Deputy Prime Ministers from foreign countries visiting Vietnam upon invitation by the President of the State, the Prime Minister, the Vice President of the State, the Deputy Prime Minister.

8. The Foreign Affairs Committee of the National Assembly and the National Assembly Office organize welcoming and receiving of former Speakers of Parliament from foreign countries, Vice Speakers of Parliament from foreign countries, the Secretary-General of AIPA, IPU, and inter-parliamentary organizations visiting upon invitation by the Speaker of the National Assembly, the Vice Speaker of the National Assembly.

9. Former Heads of State, Heads of Government,  Speakers of Parliament, Deputy Heads of State, Deputy Prime Ministers, Vice Speakers of Parliament from foreign countries are guests of the agency that hosts them.

10. Based on the specific requirements and conditions of the visit, arrange for Party and State leaders to meet.

Chapter XI

OTHER PROVISIONS

ON WELCOMING AND RECEIVING FOREIGN DELEGATIONS

Article 44. Paying respects to President Ho Chi Minh and offering incense at the Monument

1. Paying respects to President Ho Chi Minh and offering incense at the Monument shall be arranged by mutual agreement between both parties.

2. For Heads of State, Heads of State who are also Leaders of the Ruling Party, Leaders of the Government, Chairpersons of the National Assembly, Deputy Heads of State, Deputy Heads of State who are also foreign ruling party leaders visiting at the state level, officially, or for work purposes:

a) At Ho Chi Minh Mausoleum, the Director of Ho Chi Minh Mausoleum Management Board will welcome and guide the delegation to pay respects;

b) At the Monument, the Director of Ho Chi Minh Mausoleum Management Board will welcome and guide the delegation to pay respects; there will be two rows of honor guards. During the moment of silence, military music will play "Soul of the Martyrs".

3. For other foreign guests from the Ministerial level or equivalent, representatives of the Ho Chi Minh Mausoleum Management Board will guide the delegation to visit the Mausoleum and pay respects at the Monument. At the Monument, the tapestry "Soul of the Martyrs" will be played.

Article 45. Accompanying persons and position of the Ambassador of Vietnam in the host country

1. Accompanying personnel:

a) Politburo Member or Central Committee Secretary (or Head of the Central External Relations Board) accompanying the Head of State who is also the Leader of the Ruling Party of the host country on a state-level visit, official visit;

b) Minister or equivalent accompanying the Head of State of the host country on a state-level visit, official visit;

c) The Ambassador of Vietnam in the host country accompanying the Head of Government of the host country on an official visit;

d) Head or Deputy Head of the Central External Relations Board of the Party or equivalent accompanying the Deputy Head of State who is also the Leader of the Ruling Party of the host country on an official visit;

e) A female Deputy Minister or Department Head accompanying the Spouse of the Head of State, the Head of State who is also the Leader of the Ruling Party of the host country on a state-level visit, official visit, and the Head of Government of the host country on an official visit;

f) Chairman or Vice-Chairman of the Foreign Affairs Committee of the National Assembly accompanying the Speaker of the National Assembly of the host country on an official visit; 

g) In other cases: The organizing agency arranges staff to serve the Head of Delegation and Spouse (Spouse) during formal activities;

h) Accompanying persons for the Head of Delegation participate in welcoming and seeing off the delegation at the airport, formal welcoming ceremonies, and accompany the Head of Delegation during formal activities, visits to facilities, and local visits. Accompanying persons for the Spouse (Spouse) of the Head of Delegation participate in welcoming and seeing off the delegation at the airport, formal welcoming ceremonies, and accompany the Spouse (Spouse) of the Head of Delegation during their separate program activities;

i) The Ambassador of Vietnam in the host country returns to the country to participate in welcoming and hosting the Head of State, the Head of State who is also the Leader of the Ruling Party of the host country on a state-level visit, official visit, work visit, and the Head of Government of the host country on an official visit, work visit (In special cases decided by the Minister of Foreign Affairs). The Ambassador participates in accompanying the Head of Delegation during formal activities, visits to facilities, and local visits.

2. Position of the Ambassador of Vietnam in the host country: In diplomatic activities, the position of the Ambassador of Vietnam in the host country is immediately after the positions of Central Committee Members, Members of the Standing Committee of the National Assembly, and members of the Government.

Article 46. Hoisting Flags and Decorations

1. For state visits and official visits by Heads of State, Heads of State who are also Leaders of Ruling Parties, and Heads of Government from foreign countries:

a) Hoist the National Flags of both countries at the entrance and on the roof of VEP-A International Airport, where the official welcoming ceremony takes place, in the conference room, high-level meeting room, signing room, press conference room, reception room, along the streets of Hung Vuong - Hoang Van Thu - Doc Lap (Hanoi), at the residence of the visiting delegation leader, and at the places visited by the delegation leader;

b) Hoist the combined National Flags of both countries at the gate of the Presidential Palace, at the intersection of Doc Lap - Dien Bien Phu - Chu Van An - One Pillar Pagoda streets, and at the intersection of Hung Vuong - Phan Dinh Phung streets (Hanoi);

c) In addition to the above provisions, for state visits and official visits by Heads of State who are also Leaders of Ruling Parties from foreign countries, hoist the combined National Flags of both countries at the gate of the Central Party headquarters.

2. For working visits by Heads of State, Heads of State who are also Leaders of Ruling Parties, and Heads of Government from foreign countries: Hoist the National Flags of both countries at the entrance of VIP-A International Airport, at the welcoming venue, conference room, high-level meeting room, signing room, press conference room, reception room, at the residence of the visiting delegation leader, and at the places visited by the delegation leader.

3. For official visits and working visits by Chairpersons of the National Assembly: Hoist the National Flags of both countries at the entrance of VIP-A International Airport, at the welcoming venue, conference room, high-level meeting room, signing room, press conference room, reception room, at the residence of the visiting delegation leader, and at the places visited by the delegation leader.

4. For official visits and working visits by Deputy Heads of State, Deputy Heads of State who are also foreign ruling party leaders: Hoist the National Flags of both countries at the entrance of VIP-A International Airport, at the welcoming venue, conference room, high-level meeting room, signing room, press conference room, reception room, at the residence of the visiting delegation leader, and at the places visited by the delegation leader. For official visits by Deputy Heads of State, Deputy Heads of State who are also foreign ruling party leaders, hoist the combined National Flags of both countries at the Presidential Palace.

5. For official visits and working visits by Deputy Prime Ministers, Deputy Chairpersons of the National Assembly, Ministers, Chairpersons of National Assembly Committees and equivalent foreign officials: Hoist the National Flags of both countries at the welcoming venue, conference room, signing room, press conference room, reception room, at the residence of the visiting delegation leader, and at the places visited by the delegation leader.

6. Place small-sized National Flags of both countries on the table for meetings at the level of Minister and equivalent, on the table for meetings of intergovernmental cooperation committees, and on the table for deputy foreign minister-level meetings.

7. On vehicles carrying high-level foreign guests, including those at the level of Minister and Chairperson of National Assembly Committees and equivalent during state visits, official visits, and working visits, hoist the National Flags of both countries.

8. For personal visits and transit stops by high-level foreign guests: Do not hoist the National Flags of both countries during activities.

9. When hoisting the Vietnamese National Flag and the National Flag of the guest country or the Vietnamese National Flag and the flag of an international organization during diplomatic activities, the Vietnamese National Flag should be on the right side, and the National Flag of the guest country or the flag of the international organization on the left side when viewed from outside or below. The National Flags and flags of international organizations must be made according to regulations, with the correct design, and hung horizontally.

10. For visits by Kings, Queens, or members of foreign royal families, if the guest side requests the use of royal banners, the organizing agency shall comply with the guest's requirements.

Article 47. Honorary lounge, carpeted reception and farewell for foreign guests at airports

1. At international airports in Hanoi and Ho Chi Minh City, airport management agencies shall arrange an honorary lounge (VIP-A room) to welcome and entertain delegations from the level of Minister, Chairman of the National Assembly's Committee and equivalent or higher. At other local airports, management agencies shall arrange an honorary lounge for guests from the level of Minister, Chairman of the National Assembly's Committee and equivalent or higher, depending on the actual conditions of each airport.

2. When welcoming and seeing off State Leaders, State Leaders who are also Heads of Ruling Party, Heads of Government, Chairmen of the National Assembly and Deputy State Leaders of foreign countries visiting at the state level, officially, or for work purposes, a red carpet shall be laid from the bottom of the aircraft stairs to where the Head of Delegation's car is parked.

Article 48. Escort vehicles, lead vehicles

1. Vehicles carrying State Leaders, State Leaders who are also Heads of Ruling Party of foreign countries visiting at the state level, officially, shall have 08 motorcycles as escorts; there will be police cars leading the way. Vehicles carrying Heads of Government of foreign countries visiting officially shall have 06 motorcycles as escorts; there will be police cars leading the way. Motorcycles as escorts shall only apply during official activities in the capital city of Hanoi and Ho Chi Minh City.

2. For working visits, personal visits, transit visits of Chairmen of the National Assembly, Deputy State Leaders, Deputy State Leaders who are also Party leaders, Deputy Prime Ministers, Deputy Chairmen of the National Assembly, Foreign Ministers of foreign countries, there will be police cars leading the way during official activities, without motorcycle escorts.

3. For official visits, working visits, transit visits of Ministers, Chairmen of the National Assembly's Committees and equivalent levels of foreign countries, there will be police cars leading the way during official activities. For high-level foreign guests visiting personally, there will be police cars leading the way during some official activities.

Article 49. Hospitality

Hospitality for foreign delegations visiting Vietnam shall be carried out according to Vietnam's regulations and in accordance with international practices based on reciprocity.

Article 50. Gifts

1. For high-level foreign delegations visiting at the state level, officially, or for work purposes, the Party and State leaders and the agencies hosting the delegation shall present gifts to the Head of the delegation and Spouse (Husband) if they accompany the delegation. In special cases, gifts may be presented to official members and accompanying officials.

2. The gifts specified in Clause 1 of this Article shall be products manufactured in Vietnam, reflecting the national cultural identity.

Article 51. Welcoming and seeing off high-level foreign guests arriving and departing by road, rail, waterway

Welcoming and seeing off high-level foreign delegations arriving and departing by road, rail, or waterway shall be conducted similarly to those arriving and departing by air but adapted to the actual conditions of the location where the event takes place.

Article 52. Welcoming and entertaining foreign guests visiting localities

1. Provinces and centrally-administered cities shall organize the welcoming and entertaining of foreign delegations visiting localities in a respectful, safe, and economical manner, avoiding ostentation.

2. The Ministry of Foreign Affairs shall take the lead and coordinate with relevant ministries and sectors to guide ceremonies and the welcoming and entertaining of foreign guests visiting localities.

Article 53. Welcoming and hosting foreign guests to attend international conferences and seminars in Vietnam

The welcoming and hosting of foreign guests attending international conferences and seminars held in Vietnam shall be carried out according to approved plans and programs, in compliance with relevant Vietnamese laws, international practices, and specific practices of each conference or seminar.

Chapter XII

SEEING OFF AND WELCOMING PARTY AND STATE LEADERS

ATTENDING INTERNATIONAL CONFERENCES ABROAD

Article 54. Seeing off and welcoming Party and State leaders on visits and attendance at international conferences abroad

The composition of personnel for seeing off and welcoming the delegation at the airport is as follows:

1. For seeing off and welcoming senior Party leaders who do not hold state positions, the regulations of the Central Party Secretariat shall apply.

2. Director or Deputy Director of the Office The President sees off and welcomes the President and Vice Presidents.

3. Minister, Director or Deputy Director of the Government Office sees off and welcomes the Prime Minister and Deputy Prime Ministers.

4. Director or Deputy Director of the National Assembly's Foreign Affairs Committee and Director or Deputy Director of the National Assembly Office see off and welcome the Chairman and Vice Chairmen of the National Assembly.

Chapter XIII

FOREIGN DIPLOMATIC PROTOCOL FOR FOREIGN DELEGATIONS,

INTERNATIONAL ORGANIZATIONS IN HANOI

Article 55. Presentation of Credentials by Ambassadors

1. Ambassadors present their credentials to the President at the Presidential Palace.

2. The ceremony of presenting credentials includes the Director or Deputy Director of the Office of the President, Deputy Minister of Foreign Affairs, Director of the State Reception Bureau, and Department Head of the Regional Department of the Ministry of Foreign Affairs.

3. A representative from the State Reception Bureau of the Ministry of Foreign Affairs accompanies the Ambassador to present credentials. The vehicle transporting the Ambassador to and from the presentation ceremony has four motorcycles escorting it. The return vehicle displays the national flags of both countries.

4. Two rows of honor guards stand before the Presidential Palace and salute when the Ambassador arrives and departs.

5. Prior to the presentation of credentials, the Director of the State Reception Bureau of the Ministry of Foreign Affairs receives a copy of the credentials and introduces the protocol for presenting credentials to the Ambassador.

Article 56. Diplomatic Visits by Foreign Ambassadors to Party and State Leaders

The Ministry of Foreign Affairs arranges for foreign ambassadors, after presenting their credentials, to pay courtesy calls on the Prime Minister, the Chairman of the National Assembly, and the Minister of Foreign Affairs. Arrangements for the ambassadors to visit Party and State leaders and the leadership of the Ministry of Foreign Affairs prior to the end of their term are made based on specific conditions.

Article 57. Receptions by Party and State Leaders for Heads of International Organizations' Representative Offices in Hanoi

1. The Prime Minister collectively receives the Heads of United Nations System International Organizations' Representative Offices in Hanoi on the occasion of the United Nations Day (October 24) every year.

2. In special cases, the Ministry of Foreign Affairs will consider and recommend that Party and State leaders receive them.

Article 58. Attending Foreign National Day Celebrations and Anniversaries of Establishing Diplomatic Relations

1. Attending foreign National Day celebrations: Deputy Minister-level leaders are the main guests, except in special circumstances.

2. Attending celebrations marking the anniversary of establishing diplomatic relations organized by foreign embassies in Hanoi:

a) On anniversaries of five years: Minister-level leaders are the main guests, except in special circumstances;

b) On anniversaries of five years and other years: Deputy Minister-level leaders are the main guests.

3. Attending ceremonies marking the establishment of diplomatic relations organized by mutual agreement: Implementation shall follow the approved plan.

Article 59. Inviting the Diplomatic Corps and Heads of International Organizations in Hanoi to attend activities

Clause 1. Inviting the Diplomatic Corps and Heads of International Organizations in Hanoi to attend the opening session of each National Assembly session and other activities as prescribed in this Decree.

Clause 2. In addition to the provisions on inviting the Diplomatic Corps and Heads of International Organizations in this Decree, if an agency, locality, or individual meets with or invites the Diplomatic Corps and Heads of International Organizations to attend events or activities, they must have a written exchange to reach consensus with the Ministry of Foreign Affairs before issuing the invitation.

Điều 60. Thu xếp khách chào Lãnh đạo Đảng, Nhà nước

1. Cơ quan chủ quản thu xếp cho khách nước ngoài chào Lãnh đạo Đảng thông qua Ban Đối ngoại Trung ương Đảng; chào Chủ tịch nước, Phó Chủ tịch nước thông qua Văn phòng Chủ tịch nước; chào Thủ tướng Chính phủ, Phó Thủ tướng Chính phủ thông qua Văn phòng Chính phủ; chào Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội thông qua Ủy ban Đối ngoại của Quốc hội.

2. Cơ quan chủ quản thu xếp cho khách nước ngoài chào Lãnh đạo Đảng, Nhà nước có trách nhiệm thông báo Bộ Ngoại giao và các cơ quan liên quan kết quả các cuộc tiếp để phối hợp triển khai thực hiện.

3. Bộ Ngoại giao làm đầu mối, thông qua Ban Đối ngoại Trung ương Đảng, Văn phòng Chủ tịch nước, Văn phòng Chính phủ và Ủy ban Đối ngoại của Quốc hội thu xếp để Lãnh đạo Đảng, Nhà nước tiếp Đoàn Ngoại giao và các Trưởng Đại diện của Tổ chức quốc tế tại Hà Nội.

Chương XIV

ĐIỀU KHOẢN THI HÀNH

Điều 61. Hiệu lực thi hành

1. Nghị định này có hiệu lực thi hành kể từ ngày 16 tháng 12 năm 2013.

2. Kể từ ngày Nghị định này có hiệu lực thi hành, Nghị định số 82/2001/NĐ-CP ngày 06 tháng 11 năm 2001 của Chính phủ về nghi lễ nhà nước và đón, tiếp khách nước ngoài và Nghị định số 154/2004/NĐ-CP ngày 09 tháng 8 năm 2004 của Chính phủ về nghi thức nhà nước trong tổ chức mít-tinh, lễ kỷ niệm; trao tặng và đón nhận danh hiệu vinh dự Nhà nước, Huân chương, Huy chương, Cờ Thi đua của Chính phủ, Bằng khen của Thủ tướng Chính phủ hết hiệu lực thi hành.

Điều 62. Trách nhiệm thi hành

1. Bộ Văn hóa, Thể thao và Du lịch:

a) Chịu trách nhiệm thống nhất quản lý nhà nước trong công tác tổ chức các ngày kỷ niệm; nghi thức trao tặng, đón nhận hình thức khen thưởng, danh hiệu thi đua;

b) Chủ trì hướng dẫn thi hành nghi thức trong tổ chức các ngày kỷ niệm; trao tặng, đón nhận hình thức khen thưởng, danh hiệu thi đua.

2. Bộ Ngoại giao:

a) Chịu trách nhiệm thống nhất quản lý nhà nước về thực hiện nghi lễ đối ngoại và đón, tiếp khách nước ngoài;

b) Kiến nghị mức độ đón, tiếp các đoàn khách cấp cao nước ngoài, các tổ chức quốc tế, các tổ chức khu vực khác chưa được quy định tại Nghị định này.

3. Bộ Tài chính chủ trì, phối hợp với Bộ Kế hoạch và Đầu tư, Bộ Văn hóa, Thể thao và Du lịch, Bộ Ngoại giao và các Bộ, ngành, cơ quan có liên quan hướng dẫn về nguồn kinh phí và việc sử dụng kinh phí tổ chức các sự kiện quy định tại Nghị định này.

4. Bộ Giao thông vận tải chủ trì, phối hợp với các bộ, ngành có liên quan xây dựng quy định phục vụ đón, tiễn Lãnh đạo Đảng, Nhà nước và khách nước ngoài tại các cửa khẩu quốc tế.

5. Bộ Thông tin và Truyền thông chủ trì, phối hợp với các bộ, ngành, đoàn thể có liên quan trong việc chỉ đạo các hoạt động tuyên truyền trên các phương tiện thông tin đại chúng ở Trung ương và địa phương nhân dịp tổ chức các sự kiện quy định tại Nghị định này.

6. Bộ Công an, Bộ Quốc phòng theo chức năng, nhiệm vụ của mình có trách nhiệm bảo đảm an toàn, an ninh tuyệt đối cho việc tổ chức các sự kiện quy định tại Nghị định này.

7. Các bộ, ngành có liên quan, trong phạm vi chức năng, nhiệm vụ, quyền hạn của mình, có trách nhiệm phối hợp với Bộ Văn hóa, Thể thao và Du lịch và Bộ Ngoại giao trong việc tổ chức các ngày kỷ niệm; thực hiện nghi thức trao tặng, đón nhận hình thức khen thưởng, danh hiệu thi đua; nghi lễ đối ngoại và đón, tiếp khách nước ngoài.

8. Người đứng đầu các cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức chính trị xã hội - nghề nghiệp, tổ chức xã hội - nghề nghiệp, tổ chức xã hội, tổ chức kinh tế, đơn vị vũ trang nhân dân chịu trách nhiệm thi hành Nghị định này./.
