DECREE

PROVISIONS ON THE CONSIDERATION AND BESTOWAL OF THE TITLES "PEOPLE'S ARTIST" AND "OUTSTANDING ARTIST"

Decree No. 89/2014/ND-CP dated September 29, 2014 of the Government on the consideration and bestowal of the titles "People's Artist" and "Outstanding Artist", effective from November 15, 2014, was amended and supplemented by:

Decree No. 40/2021/ND-CP dated March 30, 2021 amending and supplementing certain articles of Decree No. 89/2014/ND-CP dated September 29, 2014 of the Government on the consideration and bestowal of the titles "People's Artist" and "Outstanding Artist", effective from May 15, 2021.

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Encouragement of Competition and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Encouragement of Competition and Reward dated November 16, 2013;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates this Decree on the consideration and bestowal of the titles "People's Artist" and "Outstanding Artist".1.

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the subjects, criteria, procedures, and formalities for the consideration and bestowal of the titles "People's Artist" and "Outstanding Artist".

Article 2. Applicability

1. This Decree applies to:

a) Individuals engaged in artistic activities at grassroots artistic units;

b) Individuals engaged in freelance artistic activities;

c) Organizations and individuals related to the activity of considering and bestowing the titles "People's Artist" and "Outstanding Artist".

2. The individuals specified in points a and b of Clause 1 of this Article include:

a) Performers: Singing, dancing, music, theater, film, television in the fields of Tuong; Cheo; Cai Luong; Folk Drama; Spoken Drama; Physical Theater; Musical; Ballet; Circus; Puppetry; Singing; Dancing; Recitation; Film; Television;

b) Directors of works in the fields: Tuong; Cheo; Cai Luong; Folk Drama; Spoken Drama; Physical Theater; Musical; Dance Drama; Ballet; Circus; Puppetry; Comprehensive Art Programs; Film and Television (various types of feature films, documentaries, scientific films, animated films), radio and television stage;

c) Sound technicians in film, television, and theater works; lighting technicians for theater and comprehensive art programs;

d) Choreographers; orchestra conductors; choral conductors; symphonic ballet conductors; artistic directors;

đ) Cinematographers and television cameramen for various types of films: Feature films, documentary films, scientific films, animated films;

e) Artists: Puppet figure design; animation action design; stage set design; makeup and costume design for stage, film, and television;

g) Radio and television announcers working in the field of cultural arts.

3. The individuals specified in Clause 2 of this Article, due to requirements and tasks, are assigned to teach, research, or manage in the field of arts, meeting the criteria stipulated in this Decree, may be nominated for the consideration and bestowal of the titles "People's Artist" and "Outstanding Artist".

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. National Gold Award is the Golden Lotus Award at the Vietnam Film Festival or the Gold Medal at national professional art competitions, festivals, and performances organized by the Ministry of Culture, Sports, and Tourism.

2. National Silver Award is the Silver Lotus Award at the Vietnam Film Festival or the Silver Medal at national professional art competitions, festivals, and performances organized by the Ministry of Culture, Sports, and Tourism.

32The period of professional artistic activity of an individual is calculated from the time:

a) The individual graduates from a professional art school to the date when the application for the bestowal of the title "People's Artist" or "Outstanding Artist" is reviewed by the grassroots award committee;

b) The individual reaches 18 years old, engages in artistic activities at a professional artistic unit to the date when the application for the bestowal of the title "People's Artist" or "Outstanding Artist" is reviewed by the grassroots award committee.

Article 4. Principles for awarding the titles "People's Artist" and "Meritorious Artist"

1. Achievements that have already been recognized in other state honorary titles shall not be used to propose for the awarding of the titles "People's Artist" and "Meritorious Artist".

2. It shall be carried out on a voluntary basis.

3. Ensure objectivity, fairness, accuracy, and transparency.

Article 5. Authority to organize the awarding of the titles "People's Artist" and "Meritorious Artist"

1. The Ministry of Culture, Sports and Tourism shall take the lead in organizing the awarding of the titles "People's Artist" and "Meritorious Artist".

2. The Ministry of Culture, Sports and Tourism shall issue the Plan for awarding the titles "People's Artist" and "Meritorious Artist" (hereinafter referred to as the Plan) before each round of awarding.

Article 6. Rights and obligations of individuals awarded the titles "People's Artist" and "Meritorious Artist"

Individuals awarded the titles "People's Artist" and "Meritorious Artist" shall receive Medals, Certificates of Award presented by the President, and monetary rewards, and shall enjoy rights and fulfill obligations as prescribed by laws on competition and reward.

Article 7. Funding for organizing the awarding and monetary rewards for the titles "People's Artist" and "Meritorious Artist"

1. Funding for organizing the awarding of the titles "People's Artist" and "Meritorious Artist" shall be used for the following activities:

a) Developing and implementing the Plan for awarding the titles at all levels of Councils;

b) Paying remuneration to members of all levels of Councils, secretaries, and the review of nomination files for the awarding of the titles;

c) Organizing meetings of all levels of Councils;

d) Announcing information about the results of the awarding by all levels of Councils through mass media to solicit public opinions;

đ) Holding press conferences to announce the results of all levels of Councils;

e) Organizing ceremonies to present the titles "People's Artist" and "Meritorious Artist";

g) Other activities as prescribed by law.

Specific expenditure levels shall be implemented in accordance with the provisions of the law.

2. Funding for organizing the awarding and monetary rewards for the titles "People's Artist" and "Meritorious Artist" shall be stipulated as follows:

a) The Ministry of Culture, Sports and Tourism shall be responsible for allocating funding for the organizing activities of the State-level Council; organizing ceremonies to present the titles "People's Artist" and "Meritorious Artist", and related expenses in accordance with the provisions of the law;

b) The Minister, Head of a ministry equivalent to a ministry, head of a government agency, Chairman of the People's Committee of provinces and centrally governed cities shall be responsible for allocating funding for the awarding activities of the grassroots Councils and the Councils at the ministry and provincial levels;

c) Monetary rewards for the titles "People's Artist" and "Meritorious Artist" shall be allocated from the budgets of ministries, agencies equivalent to ministries, government agencies, and provincial People's Committees in accordance with the provisions of the law.

Chapter II. STANDARDS FOR AWARDING THE TITLES "PEOPLE'S ARTIST" AND "MERITORIOUS ARTIST"

Article 8. Standards for awarding the title "People's Artist"3

The title "People's Artist" shall be awarded to individuals specified in Clause 2, Article 2 of this Decree who meet the following standards: 1. Loyalty to the Socialist Republic of Vietnam; compliance with the Party's guidelines, state policies, and laws; regulations, internal rules, and rules and regulations of the organization, institution, or locality.

2. Possess good moral character, serve as a model in life, be dedicated to their profession; demonstrate outstanding artistic talent, represent the type, industry, or profession of art; have professional prestige; be admired by colleagues and the people.

3. Have continuously or cumulatively worked in professional art for 20 years or more; for the Circus and Dance arts, have continuously or cumulatively worked in professional art for 15 years or more.

4. Have been awarded the title "Meritorious Artist" and subsequently met one of the following criteria:

a) At least two National Gold Awards (including one individual National Gold Award). Domestic or international Gold Awards for individuals or for films, programs, plays, or performances can be converted according to the provisions set forth in

b) At least three National Gold Awards (if there is no individual National Gold Award). Domestic or international Gold Awards for individuals or for films, programs, plays, or performances can be converted according to the provisions set forth in Seal Registration Certificate issued together with this Decree.

c) Demonstrate outstanding contributions, possess exceptional artistic talent, lack awards as stipulated in Point a and Point b of this clause but are discussed and evaluated by Councils at all levels as special cases, reported to the Prime Minister for consideration and decision in specific cases as follows: Seal Registration Certificate issued together with this Decree.

- Artists who are senior citizens as defined in Article 2 of the Law on Senior Citizens, with many contributions in the field of art;

- Artists actively participating in many activities serving major political tasks of the locality and the country;

- Artists who are lecturers at specialized cultural and artistic training schools, training many generations of students to win high awards in international professional art competitions.

- An artist who is a lecturer at professional cultural and artistic training institutions, teaching multiple generations of students who have won high awards in international professional art competitions.

Article 9. Criteria for awarding the title "Outstanding Artist"4

The title "Outstanding Artist" shall be awarded to the subjects specified in who meet the following standards: who meet the following criteria:

2. Possess good moral character, serve as a model in life, be dedicated to their profession; demonstrate outstanding artistic talent, represent the type, industry, or profession of art; have professional prestige; be admired by colleagues and the people.

2. Possess good moral qualities, serve as a model in life, be dedicated to their profession; have outstanding artistic talent; have professional reputation; be beloved by colleagues and the public.

3. Have at least 15 years of continuous or cumulative professional artistic activity; specifically, for Circus and Dance arts, there must be at least 10 years of continuous or cumulative professional artistic activity.

4. Meet one of the following criteria:

a) Have at least two National Gold Awards (including one Gold Award for individual achievement).

Domestic or international Gold Awards for individuals or for films, programs, plays, performances can be converted according to the provisions set out in Seal Registration Certificate issued together with this Decree.

b) Have at least one National Gold Award and two National Silver Awards (including one Gold Award for individual achievement).

Domestic or international Gold Awards for individuals or for films, programs, plays, performances can be converted according to the provisions set out in Seal Registration Certificate issued together with this Decree.

The conversion ratio of domestic and international Silver Awards for individuals or for films, programs, plays, performances to National Silver Awards is calculated based on the conversion ratio of Gold Awards.

c) Have at least three National Gold Awards (if there is no individual Gold Award). Domestic or international Gold Awards for individuals or for films, programs, plays, performances can be converted according to the provisions set out in Seal Registration Certificate issued together with this Decree.

d) Have outstanding contributions, exceptional artistic talent, but lack awards as stipulated in points a, b, and c of this clause, and are discussed and evaluated by councils at all levels as special cases, submitted to the Prime Minister for consideration and decision in specific cases.

- Artists actively participating in many activities serving major political tasks of the locality and the country;

- Artists who are lecturers at specialized cultural and artistic training schools, training many generations of students to win high awards in international professional art competitions.

- An artist who is a lecturer at professional cultural and artistic training institutions, teaching multiple generations of students who have won high awards in international professional art competitions.

Chapter III. PROCEDURE FOR AWARDS OF THE TITLES "PEOPLE'S ARTIST", "OUTSTANDING ARTIST"

Article 10. Time for awarding the titles "People's Artist", "Outstanding Artist"

The titles "People's Artist", "Outstanding Artist" shall be awarded and announced every three years, on the occasion of the National Day on September 2nd.

Article 11. Procedure for awarding the titles "People's Artist", "Outstanding Artist"

The awarding of the titles "People's Artist", "Outstanding Artist" shall be carried out through three levels of Councils as follows:

The grassroots level Council at the artistic unit is established by the head of the unit, including: theaters, professional art troupes under ministries, provinces, centrally-administered municipalities; academies, training schools for the arts, film studios under ministries, provinces, centrally-administered municipalities with functions of research, training, and artistic creation; the Cinema Department, the Performing Arts Department under the Ministry of Culture, Sports and Tourism; the Political Work Department under the Ministry of Public Security; the General Political Department of the Vietnam People's Army under the Ministry of Defense; specialized agencies managing state affairs on culture under provincial people's committees; provincial radio stations, television stations, radio-television stations.

2. The ministry-level Council at the Ministry of Culture, Sports and Tourism, Ministry of National Defense, Ministry of Public Security is established by the respective ministers; at Vietnam Television, Voice of Vietnam by the General Directors of Vietnam Television, Voice of Vietnam, or the provincial-level Council (hereinafter referred to as provincial level) is established by the Chairman of the Provincial People's Committee.

3. The national-level Council is implemented in two steps:

a) Step 1: The national-level specialized Council is established by the Minister of Culture, Sports and Tourism for each field of art: Music, Film, Theater, Dance, Radio, Television;

b) Step 2: The national-level Council is established by the Prime Minister upon the proposal of the Minister of Culture, Sports and Tourism.

Article 12. Principles of Operation of Councils at Various Levels

1. The Council is established for each round of awarding and dissolves itself upon completion of its tasks.

2. Individuals who are currently being considered for the titles of "People's Artist" and "Meritorious Artist" shall not participate in Councils at any level.

3. The Council operates on the principles of democracy, transparency, and secret ballot voting.

46. The Council convenes a meeting when at least 90% of its members are present, including the Chairman of the Council or the Vice-Chairman authorized by the Chairman.

5. The Council examines and evaluates each individual proposed for the titles of "People's Artist" and "Meritorious Artist" according to the criteria set forth in Article 8 and Article 9 of this Decree.

6. A higher-level Council only accepts and reviews files submitted by lower-level Councils in accordance with the procedures stipulated in Articles 14, 15, and 16 of this Decree.

Article 13. Files for Awarding the Titles of "People's Artist" and "Meritorious Artist"

1. The files for awarding the titles of "People's Artist" and "Meritorious Artist" include:

a) A form detailing achievements proposed for the titles of "People's Artist" and "Meritorious Artist" according to Form No. 1a and Form No. 1b in Appendix I e) |||

b)7 Decisions on awarding prizes as specified in Clause 4 of Article 8 or Clause 4 of Article 9 of this Decree: Submit a certified copy from the original book or a certified copy or a copy and present the original for verification (in case of direct submission); submit a certified copy from the original book or a certified copy with authentication (in case of submission through postal service).

c) A confirmation letter from the organization of the competition, festival, or professional art performance regarding the participation of the individual in works that won Gold or Silver awards, which can be converted into achievements under the provisions of Clause 4 of Article 8 or Clause 4 of Article 9 of this Decree (if applicable);

d) Copies of decisions on commendations and rewards (if any).

2. Individuals working in artistic units at the grassroots level shall submit one set of files in accordance with Clause 1 of this Article directly or via postal service to the grassroots artistic unit where they work within the time frame specified in the Plan.

38. Individuals engaged in freelance artistic activities shall submit one set of files in accordance with Clause 1 of this Article directly or via postal service to the specialized agency managing state cultural affairs at the provincial or centrally-administered city people's committee where they reside within the timeframe stated in the Plan.

Article 14. Procedures for Awarding the Titles of "People's Artist" and "Meritorious Artist" at Grassroots Councils

1. A grassroots Council consists of 5 to 7 members, including:

a) The Chairman of the Council is the head of the unit. In cases where the head of the unit is a candidate for the titles of "People's Artist" or "Meritorious Artist," the deputy in charge of arts of the unit serves as the Chairman of the Council.

b) The Vice-Chairman of the Council is the deputy in charge of arts of the unit;

In cases where both the head of the unit and the deputy in charge of arts of the unit are candidates for the titles of "People's Artist" and "Meritorious Artist," the unit must report in writing to its immediate superior to appoint substitutes for the Chairman and Vice-Chairman of the Council.

c) Members of the Council include representatives with prestige in the field of arts, People's Artists, Meritorious Artists, personnel responsible for organizational work, and personnel responsible for commendation and reward work of the unit.

The Council uses the seal of the unit. The Council has a Secretariat established by the Chairman of the Council.

2. Responsibilities of the Grassroots Council:

a) Examine and evaluate files proposing the titles of "People's Artist" and "Meritorious Artist" in accordance with regulations;

b) Publicly announce the results of the awarding process within five working days from the end of the examination and evaluation period of the files;

c) Receive and process complaints within twenty days from the end date of the announcement of results;

d)9 Complete and submit files proposing the titles of "People's Artist" and "Meritorious Artist" achieving at least 80% approval votes from the total number of Council members present at the meeting to the permanent office of the Ministry-level or provincial Council according to the timeframe specified in the Plan.

3. The grassroots Council sends one set of files to the permanent office of the Ministry-level or provincial Council. The files include:

a) A proposal for awarding the titles of "People's Artist" and "Meritorious Artist" according to Form No. 2a and Form No. 2b in Appendix I e) |||

b) A list proposing the titles of "People's Artist" and "Meritorious Artist" according to Sample No. 3a and Form No. 3b in Appendix I e) |||

c) Minutes of the Council meeting for awarding the titles of "People's Artist" and "Meritorious Artist" according to Form No. 4a and Form No. 4b in Appendix I e) |||

d) Minutes of the vote tally for awarding the titles of "People's Artist" and "Meritorious Artist" according to Form No. 5a and Form No. 5b in Appendix I e) |||

đ) Report on the process of awarding the titles of "People's Artist" and "Meritorious Artist" according to Form No. 6a and Form No. 6b in Appendix I e) |||

e) Decision on establishing the grassroots Council for awarding the titles of "People's Artist" and "Meritorious Artist";

g) Personal files as specified in Clause 1 of Article 13 of this Decree;

h)|||10 The Council's assessment of individuals who are special cases examined and evaluated.

Article 15. Procedures for awarding the titles "People's Artist" and "Meritorious Artist" at the Ministry-level Council and provincial council

111. The Ministry-level Council shall consist of from nine to eleven members, including:

a) The Chairperson of the Council is the leader of the Ministry of Culture, Sports and Tourism or the Ministry of Public Security or the Ministry of National Defense, the leader of the Voice of Vietnam Radio Station, or the Vietnam Television Station;

b) The Vice-Chairpersons of the Council are the Director of the Department of Mobilization and Reward of the Ministry of Culture, Sports and Tourism, or the Head of the Mobilization and Reward Department of the Ministry of Public Security, the Ministry of National Defense, or the Head of the Mobilization and Reward Board of the Voice of Vietnam Radio Station, or the Vietnam Television Station, and the head of the unit managing artistic activities of the Ministry of Culture, Sports and Tourism, the Ministry of Public Security, the Ministry of National Defense, the Voice of Vietnam Radio Station, or the Vietnam Television Station;

c)12 Members of the Council include: Units responsible for organizational work under the Ministry of Culture, Sports and Tourism, the Ministry of Public Security, the Ministry of National Defense, the Voice of Vietnam Radio Station, or the Vietnam Television Station; experts in the field of arts; People's Artists, Meritorious Artists.

The Council uses the seal of the Ministry or sector where the Ministry-level Council was established. The Department of Mobilization and Reward (Ministry of Culture, Sports and Tourism) or the Mobilization and Reward Department (or Board) under the Ministry of Public Security, the Ministry of National Defense, the Voice of Vietnam Radio Station, or the Vietnam Television Station serves as the permanent office of the Council. The Council has a Secretariat established by the Chairperson of the Council.

213. The provincial Council shall consist of from nine to eleven members, including:

a) The Chairperson of the Council: Deputy Chairman of the Provincial People's Committee;

b) The Vice-Chairpersons of the Council: Leaders of the Propaganda and Education Department of the provincial Party Committee, the provincial capital city Party Committee, the Director or Deputy Director in charge of art of the specialized agency managing state affairs on culture under the provincial People's Committee, or the municipal People's Committee directly under the central government;

c) Members of the Council include: The Mobilization and Reward Board of the province, the Literature and Art Association of the province; experts in various fields of arts; People's Artists, Meritorious Artists of the province.

The Council uses the seal of the provincial People's Committee.

The specialized agency managing state affairs on culture under the provincial People's Committee, or the municipal People's Committee directly under the central government serves as the permanent office of the Council. The Council has a Secretariat established by the Chairperson of the Council.

314. Responsibilities of the Ministry-level Council and provincial Council:

a) Publish publicly the list of nominations for the awarding of the titles "People's Artist" and "Meritorious Artist" on information media within their jurisdiction: Official website or industry/local newspaper for a period of seven working days, starting from the end date of the submission period set by the basic-level Council;

b) Examine and evaluate the nomination files for the awarding of the titles "People's Artist" and "Meritorious Artist" in accordance with regulations;

c) Receive and process complaints within twenty days from the end date of the announcement of results;

d) Complete the nomination files for the awarding of the titles "People's Artist" and "Meritorious Artist" that have received at least eighty percent agreement from the total number of Council members present at the meeting, and submit them to the permanent office of the national specialized Council according to the time specified in the Plan;

4. The Ministry-level Council and provincial Council shall send one set of files to the permanent office of the national specialized Council. The files include:

a) Documents prescribed in points a, b, c, d, đ, and point g Clause 3 Article 14 of this Decree b) Decision establishing the Ministry-level Council and provincial Council for awarding the titles "People's Artist" and "Meritorious Artist";;

Written opinions of the Standing Committee of the Provincial Party Committee, the Municipal Party Committee, the Central Steering Committee of Ministries and Sectors on the nomination files for the awarding of the title "People's Artist" within their jurisdiction at the local level, ministry, or sector.

c)15 Written opinions of the Provincial Party Committee Standing Committee, Municipal Party Committee Standing Committee, Party Committees of Ministries and Sectors regarding the dossiers for considering the conferral of the title "People's Artist" within their localities' and ministries'/sectors' jurisdiction.

d)16 The Council's assessment of individuals who are special cases examined and evaluated.

Article 16. Procedures for awarding the titles "People's Artist" and "Artist of Merit" at the State Council

The procedures for awarding the titles "People's Artist" and "Artist of Merit" at the State Council shall be carried out through two steps as follows:

1. Step 1 at the specialized council at the state level by field:

a)17 The specialized council at the state level by field shall have from 11 to 15 members, including:

- Chairman of the Council: Leader of the Ministry of Culture, Sports and Tourism;

- Vice Chairmen of the Council: Heads of the Department of Mobilization and Awards and Directors of the Cinema Administration or the Performing Arts Administration under the Ministry of Culture, Sports and Tourism;

- Members of the Council include: Central Propaganda Department (Department of Culture and Art), central specialized literary and artistic associations, experts in the arts field, People's Artists, and Artists of Merit.

b) The specialized council at the state level uses the seal of the Ministry of Culture, Sports and Tourism. The Department of Mobilization and Awards of the Ministry of Culture, Sports and Tourism is the permanent office of the Council. The Council has a Secretariat established by the Chairman of the Council.

c)18 Responsibilities of the specialized council at the state level:

- Publicly announce the list of nominations for awarding the titles "People's Artist" and "Artist of Merit" on the Ministry of Culture, Sports and Tourism's electronic portal within 15 days from the end of the submission period of the ministry-level and provincial councils;

- Examine and evaluate nomination files for awarding the titles "People's Artist" and "Artist of Merit" in accordance with regulations;

- Receive and process complaints within 20 days from the date of the announcement of the results;

- Complete nomination files for awarding the titles "People's Artist" and "Artist of Merit" that achieve at least 80% approval votes from the total number of attending council members and send them to the permanent office of the state-level council according to the schedule set forth in the Plan.

d)19 The specialized council at the state level sends one set of files to the permanent office of the state-level council. The files include:

- Documents prescribed in the following b) Decision establishing the Ministry-level Council and provincial Council for awarding the titles "People's Artist" and "Meritorious Artist";;

- Comments of the Council on individuals considered as special cases;

- Decision establishing the specialized council at the state level to award the titles "People's Artist" and "Artist of Merit."

2. Step 2 at the state council:

a)20 The state council shall have from 17 to 21 members, including:

- Chairman of the Council: Minister of Culture, Sports and Tourism;

- Vice Chairmen of the Council: Leaders of the Central Propaganda Department, Leaders of the Central Mobilization and Awards Board;

- Members of the Council include: Leaders of the Ministry of Public Security, Department of Mobilization and Awards (Ministry of Culture, Sports and Tourism), Vietnam Association of Literature and Art, central specialized literary and artistic associations, experts in various arts fields, People's Artists.

b) The state council uses the seal of the Ministry of Culture, Sports and Tourism. The Ministry of Culture, Sports and Tourism is the permanent office of the Council. The Council has a Secretariat established by the Chairman of the Council.

c)21 Responsibilities of the state council:

- Publicly announce the list of nominations for awarding the titles "People's Artist" and "Artist of Merit" on the Government's electronic portal and the Ministry of Culture, Sports and Tourism's electronic portal within 15 days from the end of the submission period of the specialized council at the state level;

- Examine, evaluate, and vote to select individuals nominated for awarding the titles "People's Artist" and "Artist of Merit" in accordance with regulations;

- Receive and process complaints within 20 days from the date of the announcement of the results;

d)22 The state council sends the Central Mobilization and Awards Board three sets of files for consolidation and submission to the Prime Minister according to the schedule set forth in the Plan. The files include:

- Documents prescribed in the following points a, b, c, d and point e Clause 3 Article 14 of this Decree;

- Comments of the Council on individuals considered as special cases;

- Summary of individual achievements confirmed by the Chairman of the state-level council;

- Decision establishing the state council to award the titles "People's Artist" and "Artist of Merit."

Chapter IV. IMPLEMENTING PROVISIONS23

Article 17. Effective Date

This Decree takes effect from May 15, 2021.

Article 18. Responsibility for Implementation

1. The Ministry of Culture, Sports and Tourism is responsible for guiding the implementation of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairpersons of provincial People's Committees, relevant agencies, organizations, and individuals are responsible for implementing this Decree./.

For a stage theatrical work or cultural and artistic program on radio or television awarded a Gold Medal, First Prize, A-Class Award, Excellent Award, or Golden Cup at a National Art Performance Festival, Contest, or Exhibition organized by a Ministry or Sector, the Gold Medal from a National Art Performance Festival, Contest, or Exhibition organized by the Ministry of Culture, Sports and Tourism shall serve as the standard for converting awards.

The conversion of awards for the following participants shall be carried out according to the conversion ratio specified in Point 4 of the Conversion Table for Awards in the Radio and Television Field.

7. Awards for groups or individuals not through National Art Performance Festivals, Contests, or Exhibitions shall not be eligible for conversion.

1 Decree No. 40/2021/ND-CP dated March 30, 2021, of the Government amending and supplementing some articles of Decree No. 89/2014/ND-CP dated September 29, 2014, of the Government on the granting of the titles "People's Artist" and "Artist of Merit", shall take effect from May 15, 2021, based on the following grounds:

"Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Encouragement of Competition and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Encouragement of Competition and Reward dated November 16, 2013;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates this Decree amending and supplementing some articles of Decree No. 89/2014/ND-CP dated September 29, 2014, of the Government on the granting of the titles "People's Artist" and "Artist of Merit".

2 This Clause has been amended and supplemented pursuant to Clause 1 of Article 1 of Decree No. 40/2021/ND-CP dated March 30, 2021, of the Government amending and supplementing some articles of Decree No. 89/2014/ND-CP dated September 29, 2014, of the Government on the granting of the titles "People's Artist" and "Artist of Merit", which takes effect from May 15, 2021.

3 This provision is amended and supplemented pursuant to Clause 2, Article 1 of Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing certain provisions of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the awarding of titles "People's Artist" and "Artist of Merit", which shall take effect from May 15, 2021.

4 This provision is amended and supplemented pursuant to Clause 3, Article 1 of Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing certain provisions of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the awarding of titles "People's Artist" and "Artist of Merit", which shall take effect from May 15, 2021.

5 This clause is amended pursuant to Clause 4, Article 1 of Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing certain provisions of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the awarding of titles "People's Artist" and "Artist of Merit", which shall take effect from May 15, 2021.

6 This clause is amended pursuant to Clause 5, Article 1 of Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing certain provisions of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the awarding of titles "People's Artist" and "Artist of Merit", which shall take effect from May 15, 2021.

21 This point is amended and supplemented pursuant to Clause 17, Article 1 of Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing certain provisions of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the awarding of titles "People's Artist" and "Artist of Merit", which shall take effect from May 15, 2021.

22 This point is amended and supplemented pursuant to Clause 17, Article 1 of Decree No. 40/2021/NĐ-CP dated March 30, 2021 of the Government amending and supplementing certain provisions of Decree No. 89/2014/NĐ-CP dated September 29, 2014 of the Government on the awarding of titles "People's Artist" and "Artist of Merit", which shall take effect from May 15, 2021.

23 Article 3 and Article 4 of Decree No. 40/2021/NĐ-CP dated March 30, 2021, of the Government amending and supplementing certain provisions of Decree No. 89/2014/NĐ-CP dated September 29, 2014, of the Government regarding the award of the titles "People's Artist" and "Meritorious Artist", which took effect from May 15, 2021, are hereby stipulated as follows:

“Article 3. Effective Date

This Decree takes effect from May 15, 2021.

Article 4. Responsibilities for Implementation

1. The Ministry of Culture, Sports and Tourism is responsible for guiding the implementation of this Decree.

2. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, relevant agencies, organizations, and individuals shall be responsible for implementing this Decree.

24 This Appendix has been amended and supplemented pursuant to Article 2 of Decree No. 40/2021/NĐ-CP dated March 30, 2021, of the Government amending and supplementing Appendix II on the Prize Conversion Table issued together with Decree No. 89/2014/NĐ-CP dated September 29, 2014, of the Government regarding the award of the titles "People's Artist" and "Meritorious Artist", which took effect from May 15, 2021.
