Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport.
The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.
The Minister of Transport issues this Circular regulating the forms of certificates and logs for technical safety and environmental protection issued to seagoing ships, inland waterway vessels, and industrial products used for inland waterway vessels as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of application
1. This Circular regulates the forms of certificates and logs for technical safety and environmental protection issued to seagoing ships, inland waterway vessels, and industrial products used for inland waterway vessels (including machines, materials, and equipment used for inland waterway vessels).
2. This Circular does not apply to seagoing ships and inland waterway vessels used for national defense, security purposes, and fishing vessels, except where required by competent state authorities.
Article 2. Applicability
This Circular applies to organizations and individuals involved in the design, manufacture, use, and inspection of technical safety and environmental protection of seagoing ships, inland waterway vessels, and industrial products used for inland waterway vessels.
Article 3. Application of laws
Where laws and regulations cited in this Circular are amended, supplemented, or replaced by other documents, the amended, supplemented, or replacing documents shall be applied.
Chapter II
FORMS OF CERTIFICATES AND LOGS FOR TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION ISSUED TO SEAGOING SHIPS
AND PROTECTION OF THE ENVIRONMENT GRANTED TO SHIPS
Article 4. Forms of certificates for technical safety and environmental protection issued to seagoing ships according to the provisions of the country and Circular No. 32/2011/TT-BGTVT dated April 19, 2011, of the Minister of Transport:
1. Certificate of seaworthiness issued according to National Technical Regulations: QCVN 21:2010/BGTVT, QCVN 54:2013/BGTVT, QCVN 56:2013/BGTVT, QCVN 03:2009/BGTVT (model SW) specified in Appendix 1.
2. Classification certificate issued according to National Technical Regulations: QCVN 21:2010/BGTVT, QCVN 42:2012/BGTVT, QCVN 56:2013/BGTVT (model CL) specified in Appendix 2.
3. Single voyage certificate issued according to National Technical Regulations: QCVN 21:2010/BGTVT, QCVN 54:2013/BGTVT, QCVN 56:2013/BGTVT, QCVN 03:2009/BGTVT (model SV) specified in Appendix 3.
4. Deferred maintenance, repair, and inspection certificate issued according to National Technical Regulations: QCVN 42:2012/BGTVT (model CPS) specified in Appendix 4.
5. Equipment safety certificate issued according to National Technical Regulation: QCVN 42:2012/BGTVT model SE.B specified in Appendix 5.
6. Dry-docking certificate issued according to National Technical Regulation: QCVN 21:2010/BGTVT (model LL.C) specified in Appendix 6.
7. Gross tonnage certificate (for vessels less than 24 meters in length) issued according to National Technical Regulation: QCVN 63:2013/BGTVT (model TN.C) specified in Appendix 7.
8. Oil pollution prevention certificate issued according to National Technical Regulation: QCVN 26:2010/BGTVT (model OPP) specified in Appendix 8.
9. Test and inspection certificate for derrick wire rope winches, hoists, and parts issued according to National Technical Regulation: QCVN 23:2010/BGTVT (model CG.2) specified in Appendix 9.
10. Test and overall inspection certificate for derrick wire rope winches, hoists, and parts, working in pairs issued according to National Technical Regulation: QCVN 23:2010/BGTVT (model CG.2(U)) specified in Appendix 10.
11. Test and overall inspection certificate for slewing tower cranes or lifting machines and parts issued according to National Technical Regulation: QCVN 23:2010/BGTVT (model CG.3) specified in Appendix 11.

Article 5. Forms of certificates for technical safety and environmental protection issued to seagoing ships according to international conventions of the International Maritime Organization (IMO) and the International Labour Organization (ILO):
1. For certificates of technical safety and environmental protection issued according to international conventions of IMO and ILO that Vietnam is a member of, the Ministry of Transport assigns the Vietnam Ship Registry to implement them using the forms prescribed by these international conventions.
2. For certificates of technical safety and environmental protection issued according to international conventions of the IMO and ILO that Vietnam has not yet joined or where the convention does not specify a specific certificate model and at the request of the shipowner to provide information to relevant authorities about the ship's compliance, the following models of certificates of compliance shall be used to issue to the ship:
a) Certificate of compliance for preventing pollution from sewage issued according to Annex IV of the International Convention for the Prevention of Pollution from Ships (MARPOL) (model SPP) set out in Appendix 25.
b) Certificate of compliance for preventing air pollution issued according to Annex VI of the International Convention for the Prevention of Pollution from Ships (MARPOL) (model APP) set out in Appendix 26.
c) Certificate of compliance for preventing air pollution from engines issued according to Annex VI of the International Convention for the Prevention of Pollution from Ships (MARPOL) (model EAPP) set out in Appendix 27.
d) Certificate of compliance for energy efficiency issued according to Annex VI of the International Convention for the Prevention of Pollution from Ships (MARPOL) (model EE) set out in Appendix 28.
đ) Certificate of compliance for ship ballast water management systems issued according to the International Convention on the Control of Harmful Anti-Fouling Systems on Ships (AFS 2001) (model AFS) set out in Appendix 29.
e) Certificate of compliance for the management of ballast water issued according to the International Convention for the Control and Management of Ships' Ballast Water and Sediments (BWM 2004) (model BWM) set out in Appendix 30.
g) Certificate of compliance for the inventory of hazardous materials issued according to the International Convention for the Safe and Environmentally Sound Recycling of Ships (Hong Kong Convention 2010) (model IHM) set out in Appendix 31.
i) Certificate of compliance for ship recycling readiness issued according to the International Convention for the Safe and Environmentally Sound Recycling of Ships (Hong Kong Convention 2010) (model RR) set out in Appendix 32.
h) Certificate of compliance for crew accommodation areas (ILO 92) issued according to ILO Convention 92 (model ILO92) set out in Appendix 33.
k) Certificate of compliance for seafarers' accommodation areas (ILO 133) issued according to ILO Convention 133 (model ILO133) set out in Appendix 34.
l) Certificate of compliance for the carriage of dangerous goods in packaged form or solid bulk form issued according to Chapter II-2 of the International Convention for the Safety of Life at Sea (SOLAS 74) (model CDG) set out in Appendix 35.
n) Certificate of approval for the plan for the carriage of solid bulk cargoes issued according to Chapter VI of the International Convention for the Safety of Life at Sea (SOLAS 74) (model DAG) set out in Appendix 36.
m) Certificate of compliance with the International Maritime Solid Bulk Cargoes Code (IMSBC) (model IMSBC) set out in Appendix 37.
3. For temporary certificates or conditional certificates, corresponding models as specified in Clauses 1 and 2 of this Article shall be used, and the words "Temporary" or "Conditional" shall be added to the certificate.
Chapter III
MODELS OF CERTIFICATES OF TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION ISSUED TO INLAND WATER VESSELS
Article 6. Models of certificates of technical safety and environmental protection issued to inland water vessels according to Decision No. 25/2004/QĐ-BGTVT dated November 25, 2004 and Circular No. 34/2011/TT-BGTVT dated April 26, 2011 of the Minister of Transport:
1. Certificate of technical safety and environmental protection for inland water vessels issued according to Vietnamese Standard: TCVN 5801: 2005, Industry Standard 22TCN 325-04 (model SI-01) set out in Appendix 38.
2. One-trip certificate issued according to Vietnamese Standard: TCVN 5801:2005, Industry Standard 22TCN 325-04, National Technical Regulation QCVN 25: 2010/BGTVT (model SI-01A) set out in Appendix 39.

1. Type approval certificate for industrial products used for inland water vessels issued according to Vietnamese Standard: TCVN 5801:2005 (model STA) set out in Appendix 49.
2. Design approval certificate for industrial products used for inland water vessels issued according to Vietnamese Standard: TCVN 5801:2005 (model TK08-TNĐ) set out in Appendix 50.

Chapter IV
RESPONSIBILITIES OF STATE MANAGEMENT ORGANIZATIONS AND ORGANIZATIONS AND INDIVIDUALS PROVIDING SERVICES IN IMPLEMENTING SERVICE PRICES
Article 8. Vietnam Vehicle Inspection Bureau
1. Organize printing, management, directing inspection, guiding usage, and issuing forms as prescribed in this Circular.
2. Report and recommend to the Ministry of Transport to update, amend, supplement, or revoke the forms specified in this Circular.
Article 9. Vehicle inspection units
Use the certificate forms in accordance with the provisions of this Circular.
Chapter V
EFFECTIVE DATE AND IMPLEMENTATION
Article 10. Effectiveness
1. This Circular takes effect from September 25, 2013.
2. Repeal the provisions set forth in Clause 3, Article 7 of Decision No. 51/2005/QĐ-BGTVT dated October 12, 2005, and Clause 3, Article 9 of Decision No. 25/2004/QĐ-BGTVT dated November 25, 2004 issued by the Minister of Transport.
Article 11. Implementation
The Director of the Office, the Inspector General, Heads of Departments, the Director of the Vietnam Vehicle Inspection Bureau, Heads of agencies, organizations, and individuals related shall be responsible for implementing this Circular.
During implementation, if any difficulties arise, agencies, organizations, and individuals concerned shall reflect them to the Ministry of Transport for timely resolution./.
