CIRCULAR

REGULATING THE STATISTICAL REPORTING SYSTEM FOR THE SCIENCE AND TECHNOLOGY SECTOR

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to the Law on Science and Technology dated June 18, 2013;

On the basis of Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;

On the basis of Decree No. 97/2016/NĐ-CP dated July 1, 2016 of the Government stipulating the contents of statistical indicators within the national statistical indicator system;

BASED ON Decree No. 60/2018/NĐ-CP dated April 20, 2018 of the Government detailing the contents of the national statistical reporting system;

BASED ON Decree No. 95/2017/NĐ-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology The Director of the National Science and Technology Information Center and the Head of the Legal Department;

At the proposal of of the Ministry of Science and Technology;

The Minister of Science and Technology issues this Circular stipulating regulate the statistical reporting system for the science and technology sector.

Article 1. Scope of Regulation

This Circular regulates the statistical reporting system for the science and technology sector under the management of the Ministry of Science and Technology to collect statistical information belonging to the science and technology statistical indicator system and national statistical indicators in the field of science and technology as prescribed by law.

Article 2. Applicability

1. The objects of statistical reporting for the science and technology sector include:

a) Agencies and units under ministries, ministerial-level agencies, government agencies, the Supreme People's Procuracy, and the Supreme People's Court assigned statistical tasks in science and technology;

b) Provincial Departments of Science and Technology under centrally governed cities;

c) Units under and directly under the Ministry of Science and Technology (hereinafter referred to as units under the Ministry of Science and Technology);

d) Other relevant agencies, units, and organizations.

2. This Circular does not apply to the Ministry of Defense and the Ministry of Public Security.

Article 3. Statistical Reporting System for the Science and Technology Sector

1. The list of statistical report forms for the science and technology sector is specified in Appendix I; the forms and instructions for filling out statistical report forms for the science and technology sector are specified in Appendix II attached hereto, including:

a) Form 01/KHCN-TC: Number of science and technology organizations;

b) Form 02/KHCN-NL: Number of people in science and technology organizations;

c) Form 03/KHCN-CP: Expenditure on science and technology;

d) Form 04/KHCN-NV: Science and technology tasks;

đ) Form 05/KHCN-HTQT: International cooperation in science and technology activities;

e) Form 06/KHCN-CG: Technology transfer;

g) Form 07/KHCN-DN: Enterprises and the science and technology market;

h) Form 08/KHCN-SHTT: Intellectual property;

i) Form 09/KHCN-TĐC: Standards, measurements, and quality;

k) Form 10/KHCN-NLAT: Atomic energy, radiation safety, and nuclear safety.

2. Reporting Unit

a) The reporting unit is the entity subject to the statistical reporting system specified in Appendix I attached hereto.

b) The reporting unit shall be recorded at the top right corner of each statistical form in Appendix II attached hereto. The agency or unit responsible for reporting shall record the name of the agency or unit in this position.

3. Units receiving reports

The recipient of the report is the National Science and Technology Information Center under the Ministry of Science and Technology.

4. Reporting period and deadline for submitting reports

a) The reporting period is one year from January 1 to December 31 of the reporting year;

b) The deadline for units to submit reports to the National Science and Technology Information Center under the Ministry of Science and Technology is no later than February 15 of the following year of the reporting year.

5. Methods of submitting reports

Statistical reports must be submitted simultaneously in two formats: paper or electronic:

a) Paper reports must bear the signature and stamp of confirmation of the head of the agency or unit implementing the statistical reporting system to facilitate verification, cross-checking, and processing of data;

b) Electronic reports or electronic reports with digital signatures of the head of the reporting unit must be saved in Excel spreadsheet format using Times New Roman font according to the national standard TCVN 6909:2001 Unicode code set, without password protection, and sent to the email address [email protected].

Article 4. Organization of Implementation

1. Ministry of Science and Technology

a) The National Science and Technology Information Center under the Ministry of Science and Technology shall take the lead and coordinate with relevant units to implement the statistical reporting system for the science and technology sector; compile statistical data belonging to the national statistical indicator system assigned to the Ministry of Science and Technology and statistical data belonging to the science and technology statistical indicator system to perform publication, use, and secure statistical information in accordance with current regulations; request reporting units to verify and provide reports and related information to the statistical report when necessary to check the accuracy of reported data; coordinate inspections of the implementation of the statistical reporting system for the science and technology sector and other related contents in the field of science and technology statistics in accordance with the law on specialized inspection of statistics.

b) Units under the Ministry of Science and Technology shall organize and implement the statistical reporting system in accordance with the division of labor prescribed in this Circular.

2. Ministers, heads of ministerial-level agencies, government agencies, the Supreme People's Procuracy, the Supreme People's Court, Chairpersons of provincial People's Committees under centrally governed cities have the responsibility to direct the organization and implementation of the statistical reporting system for the science and technology sector.

3. Agencies and units under ministries, ministerial-level agencies, government agencies, the Supreme People's Procuracy, the Supreme People's Court assigned statistical tasks in science and technology, Provincial Departments of Science and Technology under centrally governed cities are the focal points responsible for complying with full, accurate, and correct content of the information prescribed in the statistical reporting system and bear legal responsibility for the contents of the reports; submit reports within the prescribed deadlines; verify and provide reports and related information to the statistical report when requested by the recipient of the report and submit reports in accordance with Articles 3(3), 3(4), and 3(5) of this Circular.

4. Scientific and technological organizations, enterprises, and related organizations are responsible for coordinating to provide information to serve the compilation of reporting systems on scientific and technological statistics.

Article 5. Effective Date

1. This Circular takes effect from January 1, 2019.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulations.

3. Circular No. 25/2015/TT-BKHCN dated November 26, 2015, issued by the Minister of Science and Technology, regarding the basic reporting system on scientific and technological statistics, and Circular No. 26/2015/TT-BKHCN dated November 26, 2015, issued by the Minister of Science and Technology, regarding the consolidated reporting system on scientific and technological statistics shall cease to be effective from the date this Circular takes effect with respect to Provincial Departments of Science and Technology.

4. In the course of implementation, if any difficulties arise, it is recommended that agencies, units, and organizations report to the Ministry of Science and Technology for study, amendment, and supplementation./.
