Circular Joint No. 15/2018/TTLT-BTP-TANDTC-VKSNDTC abolishes Circular Joint No. 04/2014/TTLT-BTP-TANDTC-VKSNDTC dated January 23, 2014, issued by the Minister of Justice with the Chief Justice of the Supreme People's Court and the Procurator-General of the Supreme People's Procuracy guiding the implementation of the duty to refund by public officials.

Repeals Joint Circular No. 04/2014/TTLT-BTP-TANDTC-VKSNDTC dated January 23, 2014between the Minister of Justice and the President of the Supreme People's Court and the Procurator General of the Supreme Procuratorate guiding the implementation of the duty to reimburse of public officials

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Pursuant to the Law on Organization of the People's Courts dated November 24, 2014;

Pursuant to the Law on the Organization of the People's Procuratorate dated November 24, 2014;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

The Minister of Justice, the President of the Supreme People's Court, and the Procurator General of the Supreme Procuratorate issue this Joint Circular to abolish Joint Circular No. 04/2014/TTLT-BTP-TANDTC-VKSNDTC dated January 23, 2014 between the Minister of Justice and the President of the Supreme People's Court and the Procurator General of the Supreme Procuratorate guiding the implementation of the duty to reimburse of public officials Abolishing entirely Joint Circular No. 04/2014/TTLT-BTP-TANDTC-VKSNDTC dated January 23, 2014 between the Minister of Justice and the President of the Supreme People's Court and the Procurator General of the Supreme Procuratorate guiding the implementation of the duty to reimburse of public officials..

This Circular takes effect from January 25, 2026.

In cases where compensation claims have been accepted and resolved by the compensation settlement agency in accordance with the Law on State Compensation No. 35/2009/QH12, the duty to reimburse of the public official who caused the damage leading to such compensation claim shall be implemented in accordance with Joint Circular No. 04/2014/TTLT-BTP-TANDTC-VKSNDTC dated January 23, 2014 between the Minister of Justice and the President of the Supreme People's Court and the Procurator General of the Supreme Procuratorate guiding the implementation of the duty to reimburse of public officials.

Article 2. Transitional Provisions

1. This Joint Circular takes effect from January 12, 2019.

Article 3. Effectiveness

2. The Ministry of Justice, the Supreme People's Court, the Supreme Procuratorate, and related agencies, organizations, and individuals are responsible for implementing this Joint Circular./.
