CIRCULAR

DETAIL REGULATIONS IMPLEMENTING CERTAIN ARTICLES OF THE LAW ON COMPETITION AND REWARD FOR THE INTERNAL AFFAIRS SECTOR

On the basis of Law on Encouragement and Reward 2022;

Decree No. Government Decree No. 63/2022/NĐ-CP dated September 12, 2022 on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Director of the Office of the Ministry of Home Affairs;

The Minister of Home Affairs issues this Circular detailing the implementation of certain articles of the Law on Competition and Reward for the Internal Affairs Sector.

Article 1. Scope of Regulation and Applicability

1. This Circular details the implementation of Clause 4 Article 24; Clause 3 Article 26; Clause 3 Article 27; Clause 3 Article 28; Clause 6 Article 74; Clause 2 Article 75; Clause 6 Article 84 of the Law on Competition and Rewards 2022.

2. This Circular applies to collectives, officials, civil servants, public officials, and workers of units under and affiliated with the Internal Affairs sector and organizations and individuals who have achievements and contributions to the development of the Internal Affairs sector.

Article 2. Criteria for awarding the title "Advanced Worker"

1. The title "Advanced Worker" shall be awarded annually to individuals of agencies, organizations, and units under the Ministry of Home Affairs that meet the criteria stipulated in Clause 1, Article 24 of the 2022 Law on Competition and Reward.

2. Time spent by individuals who are assigned to attend training courses, study programs, or refresher courses shall be counted towards the assessment for the title "Advanced Worker".

3. Maternity leave according to regulations shall be counted towards the assessment for the title "Advanced Worker".

4. For individuals transferred to work at the Ministry of Home Affairs during the year of commendation, the recommending agency for the commendation must seek comments from the previous workplace if the individual has worked there for six months or more.

5. In cases where individuals are assigned or detailed to work at the Ministry of Home Affairs, the assessment for the title "Advanced Worker" shall be conducted by the assigning or detailing agency. The receiving agency shall provide comments on compliance with Party guidelines, state policies and laws, internal rules and regulations, and performance of assigned tasks during the assignment period at the Ministry of Home Affairs.

6. The title "Advanced Worker" shall not be assessed for any of the following cases:

a) Individuals who have been employed or are working under a labor contract for less than six months.

b) Individuals who have taken non-working leave according to the law for three to less than six months during the year (except for the case stipulated in Clause 3 of this Article).

c) Individuals currently under investigation for disciplinary action, investigation, audit, or inspection due to suspected violations, or whose complaints or reports are being verified.

Article 3. Criteria and Recipients for Awarding the Title "Flag of Competition of the Ministry of Home Affairs"

1. The title "Flag of Competition of the Ministry of Home Affairs" shall be awarded to collectives meeting the criteria stipulated in Clauses 1 and 2, Article 26 of the 2022 Law on Competition and Reward.

2. The recipients for the title "Flag of Competition of the Ministry of Home Affairs" are outstanding collectives leading competition movements organized by the Minister of Home Affairs, including:

a) Departments, Inspection Department, Office of the Ministry, Institute of State Organization Science, State Organization Magazine, Information Center, Office of the Party Committee of the Ministry of Home Affairs, and mass organizations.

b) National Archives and Records Management Agency, Central Competition and Reward Board, Government Religious Board, National Administration Academy.

c) Units of the National Administration Academy specified in Article 3 of Decision No. 27/2022/QĐ-TTg dated December 19, 2022 of the Prime Minister on the functions, tasks, powers, and organizational structure of the National Administration Academy under the Ministry of Home Affairs.

d) Provincial Departments of Home Affairs under central cities and provinces.

Article 4. Standards and Recipients for the Award of the Title "Outstanding Labor Collective"

1. The title "Outstanding Labor Collective" shall be awarded annually to collectives meeting the standards prescribed in Clause 1, Article 27 of the Law on Encouragement of Competition and Rewarding Excellence 2022.

2. The recipients of the award of the title "Outstanding Labor Collective" are collectives of agencies, organizations, and units under the Ministry of Home Affairs, including:

a) Departments, Inspection Department, Office of the Ministry, Institute of State Organization Science, State Organization Magazine, Information Center, Office of the Party Committee of the Ministry of Home Affairs, and mass organizations.

b) National Archives and Records Management Agency, Central Competition and Reward Board, Government Religious Board, National Administration Academy.

c) Units constituting the agencies, organizations, and units specified in points a and b of Clause 2 of this Article.

Article 5. Standards and Recipients for the Award of the Title "Advanced Labor Collective"

1. The title "Advanced Labor Collective" shall be awarded annually to collectives meeting the standards prescribed in Clause 1, Article 28 of the Law on Encouragement of Competition and Rewarding Excellence 2022.

2. The recipients of the award of the title "Advanced Labor Collective" are collectives of agencies, organizations, and units under the Ministry of Home Affairs, including:

a) Collectives at the Department level and equivalent.

b) Collectives at the Directorate, General Department, Bureau, and equivalent levels.

c) National Civil Service Academy collective.

Article 6. Standards for the Granting or Posthumous Granting of Certificates of Merit by the Ministry of Home Affairs

The Certificate of Merit of the Ministry of Home Affairs shall be granted or posthumously granted to collectives and individuals meeting the standards prescribed in Clauses 1, 2, 3, 4, and 5 of Article 74 of the Law on Encouragement of Competition and Rewarding Excellence 2022.

Article 7. Criteria for awarding Certificates of Merit

1. Heads of agencies, organizations, and units with legal personality under the Ministry of Home Affairs shall grant Certificates of Merit to individuals within their management authority who meet the following standards:

a) Completing tasks satisfactorily or better.

b) Possess good moral qualities; maintain internal unity; set a good example in implementing Party policies, State laws, internal regulations, and work rules of the agency or unit; actively participate in competition movements organized and launched by the agency or unit.

c) Continuously studying to improve professional knowledge and skills.

2. Heads of agencies, organizations, and units with legal personality under the Ministry of Home Affairs shall grant Certificates of Merit to collectives within their management authority who meet the following standards:

a) Completing tasks satisfactorily or better.

b) Internal unity maintained, no complaints or denunciations; democratic regulations implemented well at the grassroots level, and competition movements organized properly.

c) Care for the material and spiritual life of members of the collective, practice thrift, and combat waste.

d) Fully implementing policies and benefits for members of the collective.

Article 8. Number of Files for Proposing Awards of Commendation Titles and Forms of Reward Within the Authority of the Minister of Home Affairs

The files for proposing awards of commendation titles and forms of reward within the authority of the Minister of Home Affairs include one set (original) and electronic documents of the reward file, except for documents containing state secrets.

Article 9. Responsibilities of Organizations and Individuals in Competition and Reward Work

1. Heads of agencies, organizations, and units under the Ministry of Home Affairs directly lead and direct and are responsible for competition and reward work, identifying collectives and individuals with outstanding achievements for rewards within their authority; proposing the Minister of Home Affairs to grant rewards or submitting to competent authorities for granting rewards; promoting exemplary models; evaluating the achievements of collectives and individuals and being responsible for the proposed rewards.

2. Responsibilities of relevant agencies, organizations, units, and individuals:

a) Strictly comply with the provisions of the Law, and the agencies, organizations, and units in competition and reward work.

b) Be responsible under the law for reporting achievements, preparing reward proposal files; have the responsibility to preserve and store reward items.

3. The Information Center, the Journal of State Organization, and the websites of units under the Ministry of Home Affairs are responsible for publicizing the policies of the Party, State laws, and the Ministry's policies on competition and reward; regularly posting slogans and competition content; popularizing and setting examples for collectives and individuals with outstanding achievements, exemplary models, good people, and good deeds in competition movements; publicizing and reflecting the results achieved in competition movements and reward work; promptly reflecting and combating violations of the law on competition and reward.

Article 10. Effective Date

1. This Circular takes effect from January 1, 2024.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced, the new documents shall apply.

Article 11. Implementation Organization

1. The Office of the Ministry of Home Affairs, Heads of agencies, organizations, and units under the Ministry of Home Affairs; ministries, sectors, central agencies; People's Committees and Provincial Departments of Home Affairs of centrally governed cities; relevant agencies, organizations, and individuals are responsible for organizing the implementation of this Circular.

2. During the implementation process, if there are difficulties, relevant agencies, organizations, units, and individuals are requested to promptly reflect them to the Ministry of Home Affairs for consolidation, review, amendment, and supplementation as appropriate./.
