On the basis of Law amending and supplementing certain articles of the Securities Law, Accounting Law, Independent Audit Law, State Budget Law, Law on Management and Use of State Property, Tax Administration Law, Personal Income Tax Law, National Reserve Law, Administrative Violation Handling Law dated November 29, 2024;
At the proposal of the Minister of Finance;
The Prime Minister issues this Decision to regulate standards and quotas for the use of machinery and equipment.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Decision regulates standards and quotas for the use of machinery and equipment at agencies, organizations, and units specified in Clause 1 of Article 2 of this Decision, including:
a) Machinery and equipment serving job functions;
b) Machinery and equipment serving common activities;
c) Specialized machinery and equipment.
Article 2. Standards and quotas for the use of machinery and equipment of Vietnamese agencies abroad shall be implemented according to separate regulations of the Government.
Article 3. Standards and quotas for the use of special assets, specialized assets, and management service assets at people's armed forces units shall be implemented according to separate regulations prescribed by competent authorities.
Article 2. Applicability
Article 4. The subjects to which this Decision applies include:
a) State agencies, Communist Party of Vietnam agencies, Vietnam Fatherland Front Council (including political-social organizations), public service organizations, project management boards using state capital (hereinafter referred to as agencies, organizations, and units);
b) Organizations and individuals related to determining, deciding, and applying standards and quotas for the use of machinery and equipment.
Article 5. State financial organizations outside the budget that operate under the financial mechanism and asset management mechanism of public service organizations shall implement standards and quotas for the use of machinery and equipment as stipulated in this Decision.
1. Standards and quotas for the use of machinery and equipment stipulated in this Decision shall be used as one of the bases for planning and preparing budget estimates; allocating, purchasing, leasing, managing, using, and disposing of machinery and equipment.
2. Standards and quotas for the use of machinery and equipment serving job functions shall be determined based on each position and rank. In cases where a person holds multiple positions and ranks, the highest standard shall apply. When a predecessor retires, transfers, or for other reasons no longer holds that position but the machinery and equipment provided has not yet met the conditions for replacement or disposal according to regulations, the successor shall continue to use it without providing new equipment; except in cases where the machinery and equipment is decided to be disposed of according to laws on the management and use of state property by competent authorities.
A Central Committee Party alternate member who is currently holding a position shall apply standards and quotas for the use of machinery and equipment according to their current position.
For positions and ranks in agencies, organizations, and units not specifically defined in Appendix I and Appendix II attached to this Decision, the standards and quotas shall be determined based on the regulations of competent authorities regarding the equivalent positions and ranks defined in Appendix I and Appendix II attached to this Decision or by determining equivalent positions and ranks based on equivalent position salaries or position allowance coefficients compared to those defined in Appendix I and Appendix II attached to this Decision.
3. For projects using official development assistance (ODA) funds, preferential loans, and non-reimbursable aid with specific provisions on types, quantities, and prices of machinery and equipment serving project management, implementation shall follow the signed agreement or project documentation approved by authorized authorities. If the agreement or project documentation does not specify these details, implementation shall follow the standards and quotas for the use of machinery and equipment stipulated in this Decision.
5. Principles for determining the price of machinery and equipment:
a) The price of machinery and equipment stipulated in this Decision when newly purchased includes all taxes required by law after deducting any discounts or reductions (if applicable); excluding transportation fees; installation fees; insurance fees; certification fees for technical safety and environmental protection inspections; and other related costs;
b) The price of machinery and equipment used as a basis for determining standards and quotas in cases of allocation, transfer, or change in usage function of used machinery and equipment is the remaining value recorded in accounting books or the re-evaluated value according to law (for machinery and equipment not tracked in accounting records or when re-evaluation is required according to law); competent authorities decide on the allocation, transfer, or change in usage function of assets according to laws on the management and use of state property in cases where the remaining value or re-evaluated value of used machinery and equipment exceeds the maximum price stipulated in this Decision.
6. Workrooms specified in this Decision refer to workrooms designed for office buildings or activity facilities (not organizational structure rooms of agencies, organizations, and units).
7. Machinery and equipment specified in this Decision shall be replaced when they meet the conditions for disposal according to laws on the management and use of state property.
Chapter II
STANDARDS AND QUOTAS FOR THE USE OF MACHINERY AND EQUIPMENT AT AGENCIES, ORGANIZATIONS, AND UNITS
Article 4. Standards and quotas for using machinery and equipment to serve the work of positions
2. The quantity and price of machinery and equipment to serve the work of positions shall be implemented according to the provisions of Clause 4, Article 3 of this Decision and Clauses 3 and 4 of this Article.
a) The Director of the Central Party Office decides or delegates decision-making power to agencies and units under the Central Party for cases within their jurisdiction, except for cases stipulated in point e of this clause;
b) The Standing Committee of the Central Vietnam Fatherland Front United Board decides or delegates decision-making power to agencies, organizations, and units under its management, except for cases stipulated in point e of this clause;
c) The Minister or Head of a ministry-level agency, agency under the Government, or other agency at the central level (hereinafter referred to as the Minister or Head of a central-level agency) decides or delegates decision-making power to agencies, organizations, and units under their jurisdiction, except for cases stipulated in point e of this clause;
d) The Provincial Party Committee Standing Committee, City Party Committee Standing Committee decides or delegates decision-making power to agencies and units of the Party at the locality level, except for cases stipulated in point e of this clause;
đ) The People's Committees of provinces and centrally-administered cities (hereinafter referred to as provincial People's Committees) decide or delegate decision-making power according to the Law on Organization of Local Administration and related laws for agencies, organizations, and units at the locality level, except for cases stipulated in points d and e of this clause;
e) The Management Board or the head of a public institution self-financing recurrent and investment expenses (in cases without a Management Board) decides for their own unit.
4. In cases where it is necessary to adjust the prices of machinery and equipment stipulated in Clause 1 of this Article, the adjustment of prices shall be regulated as follows:
a) The Head of the agency, organization, or unit decides in cases where the adjusted price is higher but does not exceed 15% compared to the price stipulated in Clause 1 of this Article;
Article 5. Standards and quotas for using machinery and equipment to serve common activities
1. Machinery and equipment serving common activities include:
a) Machinery and equipment serving common activities installed in offices;
b) Machinery and equipment serving common activities of agencies, organizations, and units and machinery and equipment attached to buildings, architectural structures, construction projects, including: elevators; fire prevention and extinguishing systems; lighting systems; information systems; air conditioning; cameras; sound systems; sanitary equipment; conference room and meeting room tables and chairs; generators; water pumps; televisions; LED screens; projectors; other machinery and equipment.
2. Standards and quotas for using machinery and equipment stipulated in point a of Clause 1 of this Article.
a) The standards and quotas for using machinery and equipment serving common activities installed in offices of agencies, organizations, and units at the central and local levels are specified in Section B of Appendix I and Section B of Appendix II issued together with this Decision and Clause 4, Article 3, Clauses 3 and 4 of Article 4 of this Decision;
c) Based on the total number of machinery and equipment serving common activities installed in offices determined according to the provisions of point a and point b of this clause, the Head of the agency, organization, or unit decides the number of machinery and equipment installed in each office within their own agency, organization, or unit;
d) The machinery and equipment in the standards and quotas stipulated in point a of this clause have specific functions. In cases where agencies, organizations, or units need to equip multi-functional machinery and equipment (such as printing, photocopying, scanning, and other functions), the maximum quantity of multi-functional machinery and equipment shall be applied according to the maximum quantity of machinery and equipment with the highest maximum price; the maximum price of multi-functional machinery and equipment shall not exceed the total maximum price of machinery and equipment with specific functions; separate types of machinery and equipment with integrated functions shall not be equipped.
Article 6. Standards and quotas for the use of specialized machinery and equipment
1. Specialized machinery and equipment includes:
a) Specialized machinery and equipment in the fields of healthcare, education, and training;
b) Other specialized machinery and equipment outside those specified in point a of this clause.
2. Standards and quotas for the use of specialized machinery and equipment as specified in point a of Clause 1 of this Article:
a) Within twelve months from the date this Decision takes effect, the Minister of Health and the Minister of Education and Training shall provide detailed guidelines on standards and quotas for the use of specialized machinery and equipment in the fields of healthcare, education, and training under their respective areas of state management;
b) Based on the detailed guidelines provided by the Minister of Health and the Minister of Education and Training as specified in point a of this clause, the agency or person with authority as stipulated in Clause 3 of Article 4 of this Decision shall determine the standards and quotas for the use of specialized machinery and equipment in the fields of healthcare, education, and training for agencies, organizations, and units as specified in Clause 3 of Article 4 of this Decision;
3. Standards and quotas for the use of specialized machinery and equipment as specified in point b of Clause 1 of this Article:
4. The price level of specialized machinery and equipment in the standards and quotas for the use of specialized machinery and equipment shall be decided by the agency or person with authority as specified in point b, point c of Clause 2, and point b of Clause 3 of this Article, in accordance with the market purchase price of corresponding types of machinery and equipment.
5. The determination of standards and quotas for the use of specialized machinery and equipment as specified in Clauses 2 and 3 of this Article shall apply to machinery and equipment meeting the criteria for fixed assets according to the regulations on the management and depreciation of fixed assets at agencies, organizations, and units.
For specialized machinery and equipment that do not meet the criteria for fixed assets, the head of the agency, organization, or unit shall decide on the provision of such machinery and equipment.
6. Decisions on standards and quotas for the use of specialized machinery and equipment shall be publicly disclosed on the Central Party Committee's online portal, the Central Committee of the Vietnam Fatherland Front, the websites of ministries, central agencies, provincial-level municipalities directly under the central government.
Chapter III
IMPLEMENTATION
Article 7. Implementation Provisions
1. This Decision shall take effect from July 1, 2025.
The Central Party Committee Office, the Central Committee of the Vietnam Fatherland Front, ministries, central agencies, provincial people's committees, central and local agencies, organizations, and units may use the standards and quotas prescribed in this Decision to develop plans, make decisions, and organize the allocation, arrangement, and disposal of machinery and equipment when implementing streamlined administrative reforms and building and implementing two-tier local governments from the date this Decision comes into effect.
2. Decision No. 50/2017/QĐ-TTg dated December 31, 2017 of the Government on standards and quotas for the use of machinery and equipment shall cease to be effective from the date this Decision takes effect.
3. In cases where the legal normative documents cited in this Decision are amended, supplemented, or replaced by other legal normative documents, they shall be implemented in accordance with the provisions of the amending, supplementing, or replacing documents.
Article 8. Transitional Provisions
1. In cases where assets and equipment have been approved for procurement by competent authorities in accordance with regulations prior to the effective date of this Decision but have not yet been procured, the standards and quotas for using machinery and equipment shall be adjusted according to the provisions of this Decision.
2. For standards and quotas for using specialized machinery and equipment that were issued by competent authorities before the effective date of this Decision and remain appropriate, they shall continue to be implemented according to the issued documents until the competent authorities specified in Article 6 of this Decision determine new standards and quotas for using specialized machinery and equipment. In such cases, the competent authorities shall notify relevant agencies, organizations, and units through written communications.
3. For machinery and equipment that had been equipped prior to the effective date of this Decision, they shall continue to be used until liquidation or disposal is carried out in accordance with laws on managing and using public assets.
4. For leadership and management positions in agencies, organizations, and units specified in Appendices I and II attached to this Decision, if they currently enjoy higher position salary levels or allowances compared to those specified in Appendices I and II attached to this Decision, the standards and quotas shall be determined based on the positions enjoying higher salary levels or allowances.
5. For non-professional staff at commune level who are still benefiting from extended terms as concluded by competent authorities and stipulated by regulations, they shall continue to use the machinery and equipment already provided; in cases where there is a shortage, the People's Committee of the commune shall allocate existing machinery and equipment within the commune for these positions.
Article 9. Responsibility for implementation
1. The Minister of Health and the Minister of Education and Training shall be responsible for detailing and guiding standards and quotas for using specialized machinery and equipment in the health and education sectors in accordance with point a, Clause 2, Article 6 of this Decision.
2. The Central Party Office, the Vietnam Fatherland Front Central Committee, ministries, central agencies, provincial People's Committees, and central and local agencies and organizations shall be responsible for:
a) Organizing inspections and supervision of compliance with standards and quotas for using machinery and equipment and implementation of this Decision; handling violations within their authority or reporting to competent authorities for handling violations in managing and using machinery and equipment in accordance with the law;
b) Fulfilling other responsibilities as prescribed in this Decision and related laws.
3. The Government Inspectorate and other inspection agencies shall be responsible for:
a) Organizing inspections of compliance with standards and quotas for using machinery and equipment and implementation of this Decision;
b) Fulfilling tasks as prescribed in Clause 2 of this Article.
4. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial People's Committees, heads of agencies and organizations, and individuals concerned shall be responsible for implementing this Decision.

Note:
- The maximum purchase price of desktop computers, laptops, tablets, and equivalent information technology devices does not include the cost of software product licenses, system software, and other application software.
