pursuant to Circular No. 11/2010/TTLT-BTP-BNV dated June 17, 2010 of the Joint Ministry of Justice and Ministry of Home Affairs guiding the implementation of the rights to self-management and self-responsibility for performing tasks, organizational structure, staffing, management, and utilization of public officials for public service units under the Ministry of Justice;

pursuant to Joint Circular No. 07/2009/TTLT-BGDĐT-BNV dated April 15, 2009 of the Joint Ministry of Education and Training and Ministry of Home Affairs guiding the implementation of the rights to self-management and self-responsibility for performing tasks, organizational structure, and staffing for public service units in education and training;

Considering the proposal of the Director of the Department of Personnel Organization,

DECISION:

Article 1. The attached Decision hereby promulgates the regulations on the division of responsibilities and decentralization in managing civil servants, public officials, and employees in the units under the Ministry of Justice.

Article 2. This Decision takes effect from the date of signature.

Article 3. Heads of the Ministry, Heads of the Department of Organization and Cadres, Heads of units under the Ministry, Heads of public service units under the Ministry, and Heads of public service units under the Bureau shall be responsible for implementing this Decision.

Regulations on the Division of Responsibilities and Decentralization in Managing Civil Servants, Public Officials, and Employees in the Units Under the Ministry of Justice
(Issued together with Decision No. 1503/QD-BTP dated June 19, 2013 of the Minister of Justice)

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 1. These regulations specify the authority of the Minister, Deputy Ministers, Heads of the Department of Organization and Cadres, Directors of Bureaus, Heads of public service units under the Ministry, and Heads of public service units under the Bureau in managing civil servants and public officials working under indefinite-term labor contracts as stipulated in Decree No. 68/2000/ND-CP of the Government (hereinafter referred to as civil servants and public officials) in public service units under the Ministry and public service units under the Bureau.

Article 2. Matters related to the management of civil servants that require consideration by the Party Cadre Committee before the Minister makes a decision shall be implemented according to the work regulations of the Party Cadre Committee.

Article 3. The delegation of management authority over civil servants and employees in the field of Enforcement of Civil Judgments has separate provisions.

Article 2. Interpretation of Terms

In this Regulation, the following terms shall be understood as follows:

Clause 1. Delegation means the assignment by the Minister of his duties and powers to Deputy Ministers to assist the Minister in organizing their implementation, and Deputy Ministers may exercise these powers and act on behalf of the Minister when handling matters within their delegated scope; they are responsible to the Minister and the law for their decisions.

Clause 2. Decentralization means the transfer by the Minister of his duties and powers to Bureau Directors and Heads of public service units under the Ministry, and Heads of public service units under the Bureau, who have the autonomy and responsibility to perform their assigned duties and powers, and are accountable to the law and the Minister for their decisions.

Article 3. Content of management of civil servants and public officials

1. The content of management of civil servants and public officials in units under the Ministry and units under the Department provided for in this Regulation includes:

a) Management of job positions, organizational structure of civil servants, occupational titles of public officials; staffing, number of personnel;

b) Management of vocational standards for civil servant ranks, occupational title standards for public officials;

c) Planning, evaluation of civil servants and public officials;

d) Recruitment, signing of employment contracts, appointment to occupational titles of public officials;

đ) Assignment of work, transfer, reassignment, rotation, secondment, change of position;

e) Appointment, reappointment, removal, resignation, dismissal from position;

g) Transfer of civil servant ranks, occupational titles of public officials; examination and promotion of civil servant ranks, advancement in occupational titles of public officials;

h) Implementation of salary system, termination of employment, leave without pay, annual leave, retirement benefits for civil servants and public officials;

i) Discipline of civil servants and public officials;

k) Implementation of social insurance for civil servants and public officials;

l) Management and implementation of systems and policies for employees working under indefinite-term labor contracts as prescribed in Decree No. 68/2000/NĐ-CP of the Government;

m) Reporting and statistics on civil servants and public officials;

n) Inspection of compliance with laws on civil servants and public officials; handling complaints and denunciations according to the division of authority and provisions of laws on complaints and denunciations.

2. Contents related to training and development of civil servants and public officials; dispatching civil servants and public officials abroad; rewarding, management of personnel files of civil servants and public officials, and other contents about management of civil servants and public officials in units under the Ministry and units under the Department not provided for in this Regulation shall be implemented in accordance with the regulations of the Party, State, and regulations and rules of the Ministry of Justice.

Article 4. Principles of delegation and decentralization

1. Ensuring the principle of democratic centralism, unified leadership of the Party, and unified state management by the Minister over the cadre of civil servants and public officials in units under the Ministry and units under the Department.

2. Promoting initiative, emphasizing responsibility of Deputy Ministers, Heads of the Cadre and Civil Service Department, Directors of Departments, Heads of units under the Ministry, and Heads of units under the Department regarding management of civil servants and public officials in units under the Ministry and units under the Department.

3. Fully complying with all regulations of the Party, State, and the Minister of Justice on conditions, standards, procedures, and formalities when deciding on management contents of civil servants and public officials delegated and decentralized.

4. Delegating authority according to the degree of autonomy and capacity of units, combined with strengthening inspection work to ensure compliance with legal provisions, improving the effectiveness of civil servant and public official management, and enhancing the operational efficiency of units under the Ministry and units under the Department.

Chapter II

AUTHORITY FOR MANAGEMENT OF CIVIL SERVANTS, PUBLIC OFFICIALS AND EMPLOYEES IN UNITS UNDER THE MINISTRY AND UNITS UNDER THE DEPARTMENT

Article 5. Authority of the Minister

The Minister shall comprehensively manage policies and strategies for building and developing the civil servant and public officer workforce in units under the Ministry and those under the General Department, deciding on the following specific matters:

1. Regarding planning work:

a) Approving the Project to improve the civil servant and public officer workforce of units under the Ministry;

b) Deciding on the planning of leadership and management positions at the department level in units under the Ministry that the Minister oversees.

2. Regarding job positions, structure, staffing, and number of employees:

a) Managing job positions, structure, and standards for civil servants, and occupational titles for public officers in units under the Ministry; the number and structure of contractual staff under Decision No. 68/2000/NĐ-CP of the Government for units under the Ministry that partially self-fund their operations, and units under the Ministry fully funded by the state budget;

b) Assigning staffing for civil servants in the leadership and management structures of units under the Ministry and those under the General Department;

c) Deciding on the allocation of the number of employees for the Hanoi Law University, the Academy of Judicial Science, units under the Ministry that partially self-fund their operations, and units under the Ministry fully funded by the state budget.

3. Regarding managerial personnel:

a) Deciding on management contents for civil servants and public officers as stipulated in Clause 1, Article 3 of this Regulation for heads and deputy heads of units under the Ministry, except for contents delegated to Vice Ministers to decide or assigned to the Director of the Personnel Department to decide on behalf of the Minister.

4. Regarding appointment of cadres:

Approving the policy to improve, appoint, reappoint, relieve from duty, and accept resignation for leadership and management positions at the department level in units under the Ministry that partially self-fund their operations, and units under the Ministry fully funded by the state budget, overseen by the Minister, excluding the Hanoi Law University and the Academy of Judicial Science.

5. Regarding recruitment, acceptance, transfer, and secondment of public officers:

a) Approving plans and results of recruitment, proposals for acceptance, transfer, and secondment of public officers for units under the Ministry that partially self-fund their operations overseen by the Minister;

b) Deciding on recruitment, acceptance, transfer, and secondment of public officers for units under the Ministry fully funded by the state budget overseen by the Minister.

6. Regarding transfer and promotion of occupational titles of public officers:

a) Deciding on the transfer of occupational titles at the first grade for public officers in units under the Ministry and those under the General Department;

b) Signing documents sent to the Ministry of Home Affairs to approve the Project organizing examinations or promotions, and lists of public officers eligible to participate in examinations or promotions for specialized occupational titles managed by the Ministry of Justice;

c) Cooperating with the Ministry of Home Affairs to organize examinations or promotions for public officers in units under the Ministry and those under the General Department from the second grade to the first grade; sending civil servants and public officers to participate in examinations or promotions from the second grade to the first grade organized by other ministries and sectors; appointing and determining salaries for public officers after examination or promotion results from the second grade to the first grade are available.

7. Regarding implementation of systems and policies:

Implementing salary systems for civil servants holding senior specialist ranks and equivalent positions, and heads and deputy heads of units under the Ministry.

8. Regarding evaluation of civil servants and public officers:

Annually evaluating civil servants for heads of units under the Ministry overseen by the Minister.

9. Deciding on matters delegated or decentralized when the Minister deems it necessary to directly examine and decide.

10. Inspecting the enforcement of laws concerning civil servants and public officers.

Article 6. Authority of the Deputy Minister in charge of事业单位部下的事业单位

The Deputy Minister in charge of the事业单位部下的事业单位,受指派决定该事业单位部下事业单位的公务员和职员管理内容如下:

1. Regarding planning work:

决定事业单位部下事业单位处级领导和管理人员职位规划。

2. Regarding appointment of officials:

Approve the policy to strengthen, appoint, reappoint, dismiss, accept resignation, and remove from office the leadership and management positions at the department level in self-funded operation事业单位部下的事业单位(部分运营费用自理)和全额由国家财政保障运营费用的事业单位部下的事业单位(不包括位于河内的法律大学和司法学院)。

3. Regarding recruitment, acceptance, and transfer of staff members:

a) Approve the recruitment plan and results, recommend acceptance, transfer, and assignment of staff members for self-funded operation事业单位部下的事业单位(部分运营费用自理)和法律研究所;

b) Decide on the recruitment, acceptance, transfer, and assignment of staff members for fully state-funded operation事业单位部下的事业单位。

4. Regarding job title promotion of staff members:

a) Decide on the promotion of job titles from Grade II for staff members in self-funded operation事业单位部下的事业单位(部分运营费用自理)和全额由国家财政保障运营费用的事业单位部下的事业单位(不包括位于河内的法律大学和司法学院);

b) Lead and coordinate with the Ministry of Home Affairs and the relevant ministry managing specialized staff member job titles to organize examinations or evaluations for promotion from Grade III to Grade II; send civil servants and staff members to participate in examinations or evaluations for promotion from Grade III to Grade II organized by various ministries and departments; appoint and set salaries after obtaining examination or evaluation results for promotion from Grade III to Grade II;

c) Approve the examination or evaluation plans and results for promotion of staff member job titles from Grade IV to Grade III for fully self-funded operation事业单位部下的事业单位、河内法律大学和司法学院;organize examinations or evaluations for promotion of staff member job titles from Grade IV to Grade III; appoint and set salaries after obtaining examination or evaluation results for promotion from Grade IV to Grade III for self-funded operation事业单位部下的事业单位(部分运营费用自理)和全额由国家财政保障运营费用的事业单位部下的事业单位。

5. Regarding dispatching civil servants and staff members to work domestically:

Decide on dispatching the heads of事业单位部下的事业单位to work domestically when other departments outside the Ministry of Justice request the dispatch of personnel.

6. Regarding implementation of systems and policies:

Decide on unpaid leave; announce and decide on retirement benefits under social insurance for deputy heads of事业单位部下的事业单位。

7. Regarding assessment of civil servants and staff members:

Conduct annual performance assessments for the heads of事业单位部下的事业单位。

8. Regarding management of contractual employees:

Approve the structure and number of contractual employees according to Decree No. 68/2000/ND-CP of the Government for self-funded operation事业单位部下的事业单位(部分运营费用自理)and fully state-funded operation事业单位部下的事业单位。

Article 7. Authority of the Deputy Minister in charge of the Bureau with affiliated public service units

The Deputy Minister in charge of the Bureau with affiliated public service units shall be responsible for deciding on the management of civil servants and officials in the Bureau's affiliated public service units as follows:

1. Regarding planning work:

a) Approving the Project to improve the cadre of civil servants and officials of the Bureau's affiliated public service units;

b) Approving the planning of leadership and managerial positions of the Bureau's affiliated public service units.

2. Regarding personnel management:

a) Deciding on the management of civil servants as stipulated in Clause 1, Article 3 of this Regulation for the heads of the Bureau's affiliated public service units, except for the content delegated by the Minister to the Director of the Personnel Department and the content delegated to the Bureau Director for management of the Bureau's affiliated public service units;

b) Approving the policy to improve, appoint, reappoint, relieve from duty, and allow resignation for the heads and deputy heads of the Bureau's affiliated public service units.

3. Regarding transfer and promotion of occupational rank for officials:

Deciding on the transfer of occupational rank, examination or assessment for promotion for the Bureau's affiliated public service units as prescribed in Points a and b, Clause 4, Article 6 of this Regulation.

4. Regarding dispatching civil servants and officials to work domestically:

Deciding to dispatch the heads of the Bureau's affiliated public service units to work domestically when other ministries request the Ministry of Justice to dispatch personnel.

Article 8. Assignment of Deputy Ministers to perform tasks involving multiple units or absence of assigned Deputy Ministers

1. In cases where the contents of work specified in Articles 6 and 7 of this Regulation involve multiple units under the Ministry, the Deputy Minister in charge of the leading unit shall have the authority to implement; if that Deputy Minister is absent, the leading unit shall propose to the Minister to specifically assign another (one) Deputy Minister to perform the task.

2. In cases where the Deputy Minister assigned to perform the tasks specified in Articles 6 and 7 of this Regulation is absent while urgent work needs to be handled, the leading unit responsible for handling shall report to the Minister for consideration and decision or assignment within the Ministry Leadership to promptly handle the work, and the leading unit responsible for handling shall report back so that the Deputy Minister knows.

Article 9. Authority of the Director of the Personnel Department

1. The Director of the Personnel Department, acting on behalf of the Minister, shall perform the following tasks:

a) Confirming the curriculum vitae of cadres, confirming working time, confirming signatures, and resolving other procedures already regulated concerning civil servants and officials of the Ministry's affiliated public service units and the Bureau's affiliated public service units under the management of the Director of the Personnel Department;

b) Inspecting the implementation of the management of officials delegated to the Ministry's affiliated public service units, the Bureau's affiliated public service units, and the Bureau managing the Bureau's affiliated public service units;

c) Reporting and statistics on the cadre of civil servants and officials of the Ministry's affiliated public service units and the Bureau's affiliated public service units according to regulations and requirements of competent authorities.

2. The Director of the Personnel Department assists the Minister and Deputy Ministers in managing civil servants and officials of the Ministry's affiliated public service units and the Bureau's affiliated public service units as follows:

a) Advising the Minister to manage civil servants and officials of the Ministry's affiliated public service units and the Bureau's affiliated public service units according to functions, tasks, and powers assigned by the Minister's Decision on the functions, tasks, powers, and organizational structure of the Personnel Department;

b) Serving as the lead to submit to the Minister and Deputy Ministers for decisions on the management of civil servants and officials within their authority, except for dispatching civil servants and officials to work domestically at the request of other ministries for the Ministry of Justice, and annual performance evaluation of the heads of the Ministry's affiliated public service units.

Article 10. Authority of the Director of the Bureau

The Director of the Bureau is authorized to decide on the following management matters concerning civil servants and employees of units under the Bureau:

1. Regarding personnel management:

a) Appoint, reappoint, remove from office, accept resignation, and dismiss persons holding leadership positions and deputy positions of units under the Bureau, after approval by the Deputy Minister responsible for the Bureau, except where otherwise provided by law;

b) Decide on employee management matters specified in Clause 1, Article 3 of this Regulation for deputy positions of unit leaders and equivalent professional titles to the rank of Chief Specialist of units under the Bureau, except for matters within the authority of the Minister, Deputy Ministers, and Heads of the Cadre Organization Department.

2. Regarding recruitment and acceptance of employees:

Approve plans and results of recruitment, propose acceptance, and transfer of employees of self-financing units under the Bureau and those fully funded by the state budget.

3. Regarding promotion of professional ranks of employees:

Organize examinations or evaluations for promotion of professional ranks of employees from Rank IV to Rank III; appoint and set salaries after examination or evaluation results for promotion from Rank IV to Rank III are obtained.

4. Regarding dispatching civil servants and officials to work domestically:

Decide to send employees of units under the Bureau to work domestically when other agencies outside the Ministry request the Ministry of Justice to send personnel.

5. Regarding implementation of policies and benefits:

Announce and decide on retirement or leave with social insurance benefits for deputy positions of unit leaders under the Bureau.

6. Regarding assessment of civil servants and employees:

Conduct annual assessments of civil servants for unit leaders under the Bureau.

7. Regarding management of contractual staff:

Approve the structure and number of contractual staff according to Decree No. 68/2000/NĐ-CP of the Government for self-financing units under the Bureau and those fully funded by the state budget.

8. Regarding reporting and statistics:

Aggregate, report, and compile statistics on the workforce of civil servants, employees, and contractual staff of units under the Bureau as prescribed and required by competent authorities.

Article 11. Authority of Heads of Self-Financed Units Under the Ministry, Rector of Hanoi Law University, and Director of the Academy of Judicial Science

The heads of self-financed units, the Rector of Hanoi Law University, and the Director of the Academy of Judicial Science are authorized to decide on the following management matters concerning civil servants and employees of their units:

1. Regarding personnel management:

Decide on management matters concerning civil servants and employees as specified in Clause 1, Article 3 of this Regulation for employees from leadership and management positions at the department level and below, excluding matters within the authority of the Minister and Deputy Ministers.

2. Regarding the number of workers:

Decide on the number of workers based on job positions and the structure of civil servants and employees by professional titles approved by competent authorities (except for Hanoi Law University and the Academy of Judicial Science, which are decided by the Minister).

3. Regarding recruitment and acceptance of employees:

a) Decide on the recruitment of employees for the unit;

b) Sign employment contracts; assign supervisors for probationary training for recruited personnel; accept employees to work at the unit.

4. Regarding job title promotion of staff members:

a) Decide on the transfer of professional ranks at Level II for employees of the unit;

b) Organize examinations or evaluations for promotion of professional ranks of employees from Rank IV to Rank III for the unit according to plans approved by the Ministry's leadership; appoint and set salaries for employees after examination or evaluation results for promotion have been approved by the Ministry's leadership.

5. Regarding assessment of civil servants and employees:

a) Conduct annual assessments of civil servants and employees for deputy positions of unit leaders and below;

b) Assess civil servants and employees of the unit before appointment, reappointment, planning, training, and further education.

6. Regarding dispatching civil servants and employees to work domestically:

Decide to send civil servants and employees of the unit to work domestically when other agencies outside the Ministry request the unit to send personnel.

7. Regarding implementation of systems and policies:

Decide on annual leave; announce and decide on retirement or leave with social insurance benefits for employees from department-level leadership positions of the unit and below.

8. Regarding management of contractual employees:

Decide on the structure and number; sign, change, and terminate contracts for certain types of work of the unit according to Decree No. 68/2000/NĐ-CP of the Government; implement policies and benefits for contractual staff as prescribed by law.

9. Regarding reporting and statistics:

Report and compile statistics on the workforce of civil servants, employees, and workers of the unit as prescribed and required by competent authorities.

Article 12. The authority of the heads of units under the Ministry that partially self-fund their operational costs (except for the Hanoi University of Law and the Academy of Judicial Science), the Director of the Institute of Legal Science, and the Editor-in-Chief of the Journal of Democracy and Law.

The heads of units under the Ministry that partially self-fund their operational costs (except for the Hanoi University of Law and the Academy of Judicial Science), the Director of the Institute of Legal Science, and the Editor-in-Chief of the Journal of Democracy and Law are authorized to decide on personnel management matters within their units as follows:

1. Decide on personnel management matters within their units as prescribed in Clauses 1, 5, 6, 7, and 9 of Article 11 of this Regulation.

For the appointment, reappointment, removal, resignation, and dismissal of officials holding leadership positions at the department level, such actions shall be carried out after approval by the responsible leader of the Ministry regarding the policy.

2. Regarding recruitment, acceptance, and transfer of officials:

a) Organize the recruitment of officials within the unit after approval by the responsible leader of the Ministry regarding the recruitment plan; sign employment contracts based on the recruitment results and successful candidates approved by the responsible leader of the Ministry; assign mentors for newly recruited officials; appoint them to official positions after they have successfully completed their probationary period.

b) Accept and transfer officials after approval by the responsible leader of the Ministry.

3. Regarding management of contractual employees:

Sign, amend, and terminate contracts for certain types of work within the unit according to Decree No. 68/2000/NĐ-CP of the Government based on the structure and number of staff approved by the responsible leader of the Ministry.

Article 13. The authority of the heads of units under the Ministry that are fully funded by the State (except for the Institute of Legal Science and the Journal of Democracy and Law).

The heads of units under the Ministry that are fully funded by the State are authorized to decide on personnel management matters within their units as follows:

1. Decide on personnel management matters within their units as prescribed in Clauses 5, 6, 7, and 9 of Article 11 of this Regulation.

2. Sign and terminate employment contracts after recruitment results are obtained; assign mentors for newly recruited officials; appoint them to official positions after they have successfully completed their probationary period.

3. Assign tasks, transfer, rotate, detail, and change job positions for officials within the unit;

4. Appoint, reappoint, remove, resign, and dismiss officials holding leadership positions at the department level after approval by the Ministry's leadership regarding the policy.

5. Implement salary systems, termination of employment, unpaid leave, annual leave, retirement, and social insurance benefits for officials below the departmental leadership level within the unit, and enforce disciplinary measures against them.

6. Regarding assessment of civil servants and employees:

a) Conduct annual assessments of civil servants and employees for deputy positions of unit leaders and below;

b) Assess civil servants and employees of the unit before appointment, reappointment, planning, training, and further education.

7. Decide to send officials from the unit to work domestically when other agencies outside the Ministry request the unit to send representatives.

8. Establish and manage personnel files for officials within the unit; implement social insurance procedures for officials within the unit.

9. Sign, amend, and terminate contracts for certain types of work within the unit according to Decree No. 68/2000/NĐ-CP of the Government based on the structure and number of staff approved by the responsible leader of the Ministry, and implement labor policies and benefits as stipulated.

Article 14. Competence of the Heads of Public Service Units under the Department

1. The Directors of the Registration Centers for Transactions and Assets under the National Registry of Security Interests shall decide on personnel management matters of their Centers as prescribed in Circular Joint No. 11/2010/TTLT-BTP-BNV dated June 17, 2010 of the Ministry of Justice and the Ministry of Home Affairs guiding the implementation of self-management and self-responsibility for performing tasks, organizational structure, staffing, and management and utilization of civil servants and employees for public service units under the judicial sector, and the following matters:

a) Deciding on the transfer of job titles at levels III and IV for employees of the unit, except for the head of the unit and the deputy head of the unit;

b) Implementing social insurance for civil servants and employees of the unit;

c) Signing, amending, and terminating contracts for certain types of work at the unit in accordance with Government Decree No. 68/2000/NĐ-CP based on the approved job title structure by the Department Director;

d) Reporting and statistics on the workforce of civil servants, employees, and contractual staff of the unit as prescribed and required by competent authorities.

2. The Heads of other public service units under the Department shall decide on personnel management matters for civil servants and employees as stipulated in Clause 1 of this Article for the Directors of the Registration Centers for Transactions and Assets.

Chapter III

IMPLEMENTATION

Article 15. Responsibilities of the Minister

1. Decide on personnel management matters within the scope of authority as prescribed by the Party and State laws; be responsible to the Government for the management of civil servants and employees of the Ministry.

2. Inspect and supervise the implementation of assigned and delegated matters to Deputy Ministers and Heads of units.

3. Examine and handle cases where the assigned authority is not properly exercised or violated regulations on personnel management of the Party, State, Ministry, and provisions of this Regulation.

Article 16. Responsibilities of Deputy Ministers

1. Decide on personnel management matters for civil servants and employees assigned by the Minister in this Regulation in accordance with principles, standards, procedures, and formalities prescribed by the Party and State laws; be responsible under the law and to the Minister for their decisions.

2. Direct, guide, monitor, and inspect the implementation of cadre affairs in units under the Ministry assigned to manage; promptly report to the Minister on the management of cadres in assigned units and issues requiring rectification and handling.

Article 17. Responsibilities of the Head of the Cadre and Civil Servant Management Department

1. Advise and assist the Minister in uniformly managing civil servants and employees of public service units of the Ministry; be responsible to the Minister for the results of implementation.

2. Guide, monitor, urge, coordinate, and inspect public service units of the Ministry and Cadastral units in managing civil servants and employees according to the delegated authority stipulated in this Regulation.

3. Aggregate, report, and statistically analyze the workforce of civil servants, employees, and contractual staff of public service units under the Ministry and Cadastral units as prescribed and required by competent authorities.

4. Annually organize mid-term reviews, evaluations, and reports to the Minister on the implementation and outcomes of this Regulation.

Article 18. Responsibilities of the Director managing public service units under the Bureau

1. Decides on the management contents of civil servants and officials of public service units under the Bureau that are delegated according to this Regulation in accordance with the principles, standards, procedures, and formalities prescribed by the Party and laws; bears legal responsibility before the law and the Minister for their decisions.

2. Cooperates with the Cadre and Civil Servant Organization Department to advise, prepare files and materials, and submit them to the Cadre and Civil Servant Organization Department for the Leadership of the Ministry to decide on the management contents of civil servants and officials of units under the Bureau within the authority of the Leadership of the Ministry for matters within the responsibility of the Cadre and Civil Servant Organization Department.

3. Sends decisions regarding civil servants and officials within delegated authority to the responsible Leadership of the Ministry and the Cadre and Civil Servant Organization Department within ten days from the date of signing the decision.

4. Summarizes, reports on the situation and results of cadre work for public service units under the Bureau in the six-month interim report and annual work summary of the Bureau; summarizes, reports, and statistically analyzes the cadre and civil servant workforce and contractual labor cadres of public service units under the Bureau as prescribed and required by competent authorities.

5. Periodically each year, evaluates, summarizes, and reports on the implementation of this Regulation by public service units under the Bureau and sends them to the Cadre and Civil Servant Organization Department before October 10th each year for consolidation and reporting to the Minister.

Article 19. Responsibilities of Heads of Public Service Units under the Ministry

1. Decides on the management contents of civil servants and officials of units that are delegated according to this Regulation in accordance with the principles, standards, procedures, and formalities prescribed by the Party and laws; bears legal responsibility before the law and the Minister for the results of implementation.

2. Cooperates with the Cadre and Civil Servant Organization Department to advise, prepare files and materials, and submit them to the Cadre and Civil Servant Organization Department for the Leadership of the Ministry to decide on the management contents of civil servants and officials of units within the authority of the Leadership of the Ministry for matters within the responsibility of the Cadre and Civil Servant Organization Department.

3. Sends decisions regarding civil servants and officials within delegated authority to the responsible Leadership of the Ministry and the Cadre and Civil Servant Organization Department within ten days from the date of signing the decision.

4. Reports on the situation and results of cadre work in the six-month interim report and annual work summary of the unit; reports and statistically analyzes the cadre and civil servant workforce and contractual labor cadres of the unit as prescribed and required by competent authorities.

5. Periodically each year, evaluates and reports on the implementation of this Regulation by the unit and sends them to the Cadre and Civil Servant Organization Department before October 7th each year for consolidation and reporting to the Minister.

Article 20. Responsibilities of Heads of Public Service Units under the Bureau

1. Decides on the management contents of civil servants and officials of units that are delegated according to this Regulation in accordance with the principles, standards, procedures, and formalities prescribed by the Party and laws; bears legal responsibility before the law, the Minister, and the Director for the results of implementation.

2. Prepares files and materials for the Director to decide or for the Director to cooperate with the Cadre and Civil Servant Organization Department to submit to the Leadership of the Ministry to decide on the management contents of civil servants and officials of units within the authority.

3. Sends decisions regarding civil servants and officials within delegated authority to the Director within ten days from the date of signing the decision.

4. Reports to the Bureau on the situation and results of cadre work in the six-month interim report and annual work summary of the unit; reports and statistically analyzes the cadre and civil servant workforce and contractual labor cadres of the unit as prescribed and required by competent authorities.

5. Periodically each year, evaluates and reports on the implementation of this Regulation by the unit and sends them to the Bureau before October 7th each year for monitoring, consolidation, and sending to the Cadre and Civil Servant Organization Department for reporting to the Minister.

Article 21. Implementation clause

During the implementation of this Regulation, if there are difficulties or obstacles, units shall promptly reflect these issues to the Cadre and Civil Servant Organization Department for coordination in resolution or report to the Minister for consideration, decision, or amendment and supplementation of this Regulation to meet the requirements of work./.
