DECREE
Providing detailed regulations on certain provisions and enforcement measures of the Law on Traffic Order and Safety for road traffic
Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;
The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.
The Government issues this Decree providing detailed regulations on certain provisions and enforcement measures of the Law on Traffic Order and Safety for Road Transport.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree provides detailed regulations on certain provisions and enforcement measures of the Law on Traffic Order and Safety for Road Transport including:
1. Article 6 on education of traffic laws and regulations knowledge for road transport.
2. Clause 3, Article 7 on the Traffic Order and Safety Road Transport Database; the collection, management, and exploitation of information in the Traffic Order and Safety Road Transport Database.
3. Clause 6, Article 27 on the management, installation, and use of signal-emitting devices for priority vehicles; procedures and formalities for issuing new, reissuing, and revoking permits to use signal-emitting devices for priority vehicles.
4. Clause 5, Article 35 on the installation of vehicle tracking devices for commercial passenger-carrying motor vehicles; the installation of vehicle tracking devices and recording equipment for drivers on commercial passenger-carrying motor vehicles with eight seats or more (excluding the driver's seat), tractor-trailers, ambulances, road traffic rescue vehicles; permission for the operation of intelligent transportation systems; conditions for the operation of simple vehicles.
5. Point a, Clause 1, Article 46 on the paint color of commercial passenger-carrying motor vehicles transporting preschool children and students.
6. Point đ, Clause 4, Article 52 on situations where it is necessary to have personnel and means to assist drivers, warn other persons and vehicles participating in road traffic, and implement measures to ensure road traffic safety for oversized, overweight, tracked, and extra-long and extra-heavy vehicles traveling on roads.
7. Clause 4, Article 55 on ensuring traffic order and safety for foreign-owned motor vehicles registered abroad with right-hand steering wheels participating in traffic in Vietnam; foreign motor vehicles brought into Vietnam for tourism by foreigners.
Article 2. Applicability
This Decree applies to agencies, organizations, and individuals both within and outside Vietnam related to traffic order and safety for road transport on the territory of the Socialist Republic of Vietnam.
Article 3. Appendices to this Decree
1. Appendix I: Technical requirements for signal-emitting devices for priority vehicles.
2. Appendix II: Forms related to the issuance of permits to use signal-emitting devices for priority vehicles.
3. Appendix III: Forms related to the issuance of permits for the operation of intelligent transportation systems.
4. Appendix IV: Forms related to the approval of domestic travel agencies organizing for foreigners to bring foreign motor vehicles into Vietnam for tourism; organizations and individuals bringing right-hand steering motor vehicles into Vietnam for purposes other than tourism.
Chapter II
EDUCATION OF KNOWLEDGE OF TRAFFIC LAWS AND REGULATIONS ON TRAFFIC ORDER AND SAFETY FOR ROAD TRANSPORT Article 4. Content of education of traffic laws and regulations knowledge on traffic order and safety for road transport in educational institutions
1. Content of education of traffic laws and regulations knowledge on traffic order and safety for road transport for children at pre-school educational institutions includes:
a) Recognizing types of road transport vehicles;
b) Recognizing traffic lights, meanings of traffic light signals, and commonly encountered road signs;
c) Safety when walking and using various road transport vehicles;
d) Knowing how to wear a helmet correctly;
đ) Safe play areas;
e) Dangers and consequences of not adhering to traffic safety regulations for road transport.
2. Content of education of traffic laws and regulations knowledge on traffic order and safety for road transport for elementary school students includes:
a) Recognizing traffic control signals; traffic light signals; commonly encountered road signs;
b) Some common traffic rules for road transport; recognizing the necessity to comply with traffic rules for road transport;
c) Crossing roads safely;
d) Choosing and wearing a helmet correctly;
đ) Getting on and off bicycles, motorcycles safely;
e) Familiarizing with bicycles and safe bicycle handling;
g) Some skills to prevent road traffic accidents.
3. Content of education of traffic laws and regulations knowledge on traffic order and safety for road transport for junior high school students includes:
a) Road traffic rules;
b) Recognizing and complying with road signs;
c) Wearing standard helmets and fastening straps properly when participating in road transport;
d) Safety when sitting in motor vehicles;
đ) Safe handling of bicycles and electric bicycles;
e) Preventing risks and consequences of road traffic accidents and handling traffic incidents.
4. Content of education of traffic laws and regulations knowledge on traffic order and safety for road transport for high school students and vocational education institution students includes:
a) Road traffic rules; road signs; speed and safe distance for motor vehicles;
b) Predicting and preventing dangers;
c) Safe handling of motorcycles.
c) Methods for safely controlling a motorbike.
Article 5. Guidance on safe motorcycle driving skills for students starting secondary school and vocational education institutions
1. The content of guidance on safe motorcycle driving skills includes:
a) Methods to identify and handle dangerous situations when driving;
b) Structure and functions of motorcycle parts, maintenance methods, and safety vehicle checks;
c) Traffic participation culture; responsibility of motor vehicle drivers; assistance to traffic accident victims;
d) Starting and turning off the engine, using the throttle, brakes, shifting gears, and using protective equipment;
đ) Safe sitting posture when getting on and off the motorcycle;
e) Smooth start-up, appropriate speed adjustment, and safe stopping;
g) Driving according to four models including: passing through an "8" shape, passing through a straight line, passing through a lane with a stop bar, and passing through a bumpy road;
h) Other related contents.
2. Students shall practice safe motorcycle driving skills as prescribed in points d, đ, e, and g of Clause 1 of this Article.
3. The time for guidance and evaluation of safe motorcycle driving skills shall be carried out in accordance with the guidelines of the direct implementing traffic police agency, in line with practical requirements at educational facilities, and ensuring the content of guidance as stipulated in Clause 1 of this Article.
Article 6. Responsibilities for guiding safe motorcycle driving skills for students
2. The Ministry of Education and Training shall take the lead and instruct secondary school management agencies to prepare physical infrastructure and motorcycles to cooperate with traffic police forces in organizing guidance on safe motorcycle driving skills.
4. Responsibilities of secondary schools and vocational education institutions:
a) Organize for students and their parents to sign commitments to comply with laws on road traffic order and safety, including contents such as: students not operating motorcycles without meeting the required conditions, not operating motorcycles without completing the safe motorcycle driving skills guidance program; parents not giving motorcycles to students to operate without meeting the required legal conditions;
b) Coordinate with Parent-Teacher Associations to regularly remind children to fulfill signed commitments and frequently exchange and grasp information from parents about students' compliance with laws on road traffic order and safety when participating in traffic;
c) Incorporate compliance with laws on road traffic order and safety as one of the criteria for assessing and ranking student conduct.
5. Responsibilities of student families:
a) Cooperate with relevant functional forces to educate students on knowledge of laws on road traffic order and safety, and guide safe motorcycle driving skills;
b) Not give motorcycles to children to operate without meeting the required conditions;
c) Regularly remind children to fulfill signed commitments and frequently exchange and grasp information from schools about students' compliance with laws on road traffic order and safety when participating in traffic.
1. The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Public Security and other ministries and ministerial-level agencies related to the provisions of Article 4 of this Decree, shall have the responsibility to:
a) Develop a curriculum for teaching legal knowledge on traffic order and safety on roads suitable for each educational level;
b) Develop materials, integrate, and embed legal knowledge on traffic order and safety on roads into the core curriculum of preschool education, primary school, and lower secondary school;
c) Develop a subject on legal knowledge on traffic order and safety on roads according to the content of knowledge specified in Clause 4, Article 4 of this Decree for upper secondary schools and vocational education institutions.
1. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Ministry of Public Security and the Ministry of Education and Training to organize teaching activities on legal knowledge on traffic order and safety on roads at vocational education institutions according to the content of knowledge specified in Clause 4, Article 4 of this Decree.
2. The Ministry of Labor, Invalids and Social Affairs shall direct vocational education institutions to incorporate compliance with laws on traffic order and safety on roads as one of the criteria for assessing and ranking conduct grades for students.
Chapter III
TRAFFIC ORDER AND SAFETY DATABASE; COLLECTION, MANAGEMENT, EXPLOITATION, CONNECTION,SHARING INFORMATION IN THE TRAFFIC ORDER AND SAFETY DATABASEROAD TRAFFIC
Article 9. Principles for building, managing, exploiting, using, connecting, and sharing the Traffic Order and Safety Database.
1. The Traffic Order and Safety Database shall be built uniformly nationwide, shared among agencies, organizations, and individuals with authority, except for databases related to national defense and security areas.
2. The Traffic Order and Safety Database shall be updated fully, accurately, and promptly; maintained continuously, stably, smoothly, meeting the requirements for exploitation and use by agencies, organizations, and individuals as prescribed by law.
3. The Traffic Order and Safety Database shall be stored in accordance with legal regulations on storage.
4. Building, managing, exploiting, using, connecting, and sharing the Traffic Order and Safety Database shall comply with legal regulations on traffic order and safety on roads, administrative violation handling, information technology, network security, cyber security, electronic transactions, and personal data protection.
Article 10. Construction of Road Traffic Order and Safety Database and Specialized Databases
1. The Road Traffic Order and Safety Database shall be constructed in accordance with the framework architecture of Vietnam's e-Government; it must comply with relevant specialized legal regulations.
2. Ministries and sectors have the responsibility to construct national databases, specialized databases, connect and share information in accordance with the law with the Road Traffic Order and Safety Database built, managed by the Ministry of Public Security for state management tasks related to road traffic order and safety.
3. Responsibilities for constructing and managing specialized databases:
c) The Ministry of Finance has the responsibility to construct and manage the following databases: Export and import vehicle database; Invoice database for vehicle purchases and sales; Vehicle stamp duty database;
d) The Ministry of National Defense has the responsibility to construct and manage the following databases under its jurisdiction: Motor vehicle registration and inspection database; Driving license training, examination, issuance, and traffic law knowledge enhancement certificate database; Motor vehicle driver database; Road traffic accident database; Administrative violation handling database regarding road traffic order and safety;
đ) The Ministry of Health has the responsibility to construct and manage the database on the health status of motor vehicle drivers and special-purpose motorcycle drivers.
Article 11. Information in the Road Traffic Order and Safety Database
1. Information on motor vehicle registration and management:
a) Information on vehicle owners: For individuals: name, date of birth, gender, personal identification number, telephone number (if available), nationality, place of permanent residence, temporary residence, current address, registered vehicle address. For organizations: organization name, legal representative's name, address, tax code or establishment decision or organization identification number (if available), telephone number;
b) Information on vehicles as stipulated in point a, Clause 2 of this Article;
c) Registration and management information: license plate number; license plate color; number, date, month, year issued, issuing authority of the vehicle registration certificate; registration validity period; registration status; vehicle status; number, date, month, year issued, issuing authority of the vehicle origin certificate; number, date, month, year issued, issuing authority of the ownership rights certificate; number, date, month, year issued, issuing authority of the stamp duty receipt, stamp duty amount; priority vehicle type, number, usage period, issuing authority of the priority vehicle signal device permit.
2. Information on motor vehicle inspection:
a) Vehicle technical specifications: vehicle type; brand; model number; paint color; engine number; chassis number; seating capacity; standing capacity; lying capacity; permissible cargo weight; gross weight; towing weight, self-weight; cylinder displacement; power; energy type; year of manufacture; country of manufacture; wheelbase; overall dimensions; cargo box dimensions; tire formula; tread pattern; number of tires, tire size, and other vehicle technical specifications; pre- and post-repair vehicle information;
b) Inspection management information: license plate number; license plate color; number, date, month, year issued, issuing authority of the vehicle registration certificate (if applicable); number, date, month, year issued, issuing authority of the quality and environmental protection certificate for domestically produced, assembled, imported, and repaired vehicles; number, date, month, year issued, issuing authority of the technical inspection and environmental protection certificate for vehicles in operation; inspection cycle; service life; number, date, month, year issued, issuing authority of the customs declaration form or enterprise quality check-out certificate;
3. Information on invoices related to motor vehicle purchases and sales: invoice number, issue date, month, year; seller's name, tax code, address, phone number; buyer's name, address; goods description.
4. Information on motor vehicle stamp duty: stamp duty receipt number, issue date, month, year, issuing authority; asset value subject to stamp duty; stamp duty amount; information on the stamp duty payer as stipulated in point a, Clause 1 of this Article and vehicle technical specifications as stipulated in point a, Clause 2 of this Article.
5. Information on the origin of imported and exported vehicles: customs declaration form number, issue date, month, year, issuing authority; exporting and importing authorities and enterprises; export and import ports and technical specifications of imported and exported vehicles as stipulated in point a, Clause 2 of this Article.
6. Information on driving license training, examination, issuance; traffic law knowledge enhancement certificate:
a) Name; personal identification number; date of birth; nationality; place of residence; driver's license number; confirmation of completion of training course; driving school; type of vehicle trained for; training course; date of successful examination; examination authority; examination location (testing center or driving practice field); date of issuance, renewal, reissuance of driver's license; issuing authority; class of driver's license; validity period of driver's license; driver's license form number;
b) Name; date of birth; training course; time to complete the course; examination results for certification; date of examination results for certification; certificate number; date of issuance of certificate; training and certification institution; date of renewal, reissuance of certificate; issuing authority for renewal, reissuance of certificate;
7. Information about the motor vehicle operator, specialized machinery operator: name; personal identification number; date of birth; nationality; place of residence; driver's license number, class of driver's license, issuing authority for driver's license, training and certification institution for traffic law knowledge enhancement, certificate number for traffic law knowledge enhancement; information on the health examination results of the vehicle operator;
8. Information on mandatory civil liability insurance for owners of motor vehicles, specialized machinery:
a) Information on vehicle owners: For individuals: name, date of birth, gender, personal identification number, telephone number (if available), nationality, place of permanent residence, temporary residence, current address, registered vehicle address. For organizations: organization name, legal representative's name, address, tax code or establishment decision or organization identification number (if available), telephone number;
b) Information on motor vehicles: license plate number or frame number, engine number, type of vehicle, carrying capacity (for cars), seating capacity (for cars), purpose of use (for cars), brand, displacement, paint color, year of manufacture;
c) Information on the insurance company: name, address, hotline number;
d) Level of civil liability insurance coverage for third parties and passengers;
đ) Responsibilities of the motor vehicle owner and driver when an accident occurs;
e) Insurance period, insurance certificate number, insurance premium, payment deadline for insurance premium, date of issuance, place of issuance, issuer (if applicable);
9. Information on administrative violation handling regarding road traffic order and safety: Information in the Administrative Violation Handling Database for Road Traffic Order and Safety ensuring general requirements according to the National Database on Administrative Violation Handling and the following requirements:
a) Information on the violator: For individuals: name; date of birth; gender; nationality; occupation; current place of residence; personal identification number, passport or international travel document (for foreigners); date of issuance, place of issuance. For organizations: organization's name; main office address; business code; investment registration certificate number, business registration certificate or establishment permit; date of issuance, place of issuance; legal representative, gender, position;
b) Information on the violating vehicle: license plate number, paint color, type of vehicle;
c) Information on the violation: violation act, time of violation, location of violation; provisions in the legal normative document on administrative penalties in the field of road traffic order and safety;
d) Information on penalty measures: aggravating circumstances (if any); mitigating circumstances (if any); primary penalty measure; total fine amount; supplementary penalty measure (if any); remedial measures (if any); enforcement deadline;
đ) Information on demerit point management for driver's licenses: name of the driver's license holder; date of birth; gender; nationality; occupation; current place of residence; personal identification number, passport; driver's license number; class of driver's license; current points, points deducted, remaining points; recovery time (in cases where all points have been deducted);
e) Authority of the decision-maker for penalties, demerits, and point recovery for driver's licenses; name, position of the decision-maker for penalties, demerits, and point recovery for driver's licenses;
10. Information on the journey of road transport vehicles, images of the driver:
a) Vehicle information: license plate number, type of vehicle, paint color, brand, model number, year of manufacture; number, date of issuance, expiration date of the inspection certificate; information on transportation businesses, emergency medical services, traffic rescue services, vehicle owners;
b) Journey information: journey time; route; speed; distance; vehicle location;
c) Driver information: name; date of birth; address; driver's license; driver image data; driver violation history;
d) Information on traffic violations and accidents; handling measures;
11. Information on managing the operating hours of drivers: time; transportation business; license plate number; driver's name; driver's license number; type of activity; start time; end time; driving time;
12. Information on road traffic accidents:
a) Information on damage consequences: number of incidents, number of fatalities, number of injuries, damaged property, classification of traffic accidents, road traffic safety coefficient;
b) Information on investigation and resolution results: number of administrative cases handled, number of criminal cases handled;
c) Information on time, location, road infrastructure;
d) Information on accident vehicles: license plate number; model number; type of vehicle; brand; paint color; engine number; frame number; cylinder displacement or power; seating capacity, standing capacity, lying capacity; origin; vehicle registration certificate number; usage period; number, date of issuance, expiration date of the inspection certificate;
đ) Information about individuals: surname, given name; date, month, year of birth; personal identification number, passport, international travel document (applicable to foreign nationals), place of residence, gender (male, female), nationality, ethnicity, occupation, telephone number (if available); injury status; driver of the vehicle, related persons; victim; parties with rights and obligations related to the incident;
e) Information from the accident file: on-site inspection report; site diagram; scene photograph; vehicle inspection report related to the traffic accident; statement taking record; evidence proving damage consequences; documents related to vehicles and drivers; other relevant documents;
g) Information about the course of events, causes, and conditions leading to the occurrence of road traffic accidents;
h) Information regarding recommendations for traffic organization at the location where the road traffic accident occurred.
13. Information about the health of the driver, operator of specialized motorcycles: surname, given name; personal identification number; date, month, year of birth; profession as a motor vehicle driver or not; workplace (for those engaged in driving motor vehicles); health examination facility; time of health examination; clinical examination results; ancillary clinical examination results; conclusion on the health status of the driver, operator of specialized motorcycles.
Article 12. Collection of information in the Road Traffic Safety Database
1. The information specified in Clauses 1, 2, 3, 4, and 5 of Article 11 of this Decree shall be collected from:
a) National Population Database;
c) National Financial Database;
d) Registration and Management Database for Motor Vehicles and Specialized Motorcycles established and managed by the Ministry of Public Security;
đ) Other databases related to road traffic safety and order.
a) Driver Training and Examination Database for Driving Licenses and Legal Knowledge Certificates on Road Traffic Safety established and managed by the Ministry of Transport;
b) Driver Training and Examination Database for Driving Licenses and Legal Knowledge Certificates on Road Traffic Safety within the People's Police Force established and managed by the Ministry of Public Security;
c) Databases specified in points a and đ of Clause 1 of this Article.
3. The information specified in Clause 7 of Article 11 of this Decree shall be collected from:
a) Databases specified in points a and đ of Clause 1; points a and b of Clause 2 of this Article;
b) Health Database of Drivers and Operators of Specialized Motorcycles established and managed by the Ministry of Health.
4. The information specified in Clause 8 of Article 11 of this Decree shall be collected from:
a) Databases specified in points a, d, and đ of Clause 1 of this Article;
b) Compulsory Civil Liability Insurance Database for Motor Vehicle Owners as prescribed by the Government concerning compulsory civil liability insurance for motor vehicle owners.
5. The information specified in Clause 9 of Article 11 of this Decree shall be collected from:
a) Databases specified in points a, b, d, and đ of Clause 1; points a and b of Clause 2; point b of Clause 4 of this Article;
b) Travel Route Database of Road Traffic Vehicles, Driver Image Database;
c) Time Management Database of Vehicle Operation by Drivers;
d) Road Traffic Accident Database;
đ) Administrative Violation Handling Database concerning Road Traffic Safety and Order.
6. The information specified in Clause 10 of Article 11 of this Decree shall be collected from the databases specified in points a, b, d, and đ of Clause 1; points a and b of Clause 2; points b, d, and đ of Clause 5 of this Article.
7. The information specified in Clause 11 of Article 11 of this Decree shall be collected from the databases specified in points a, d, and đ of Clause 1; points a and b of Clause 2; point c of Clause 5 of this Article.
8. The information specified in Clause 12 of Article 11 of this Decree shall be collected from the databases specified in points a, b, d, and đ of Clause 1; point b of Clause 4; points b and d of Clause 5 of this Article.
9. The information specified in Clause 13 of Article 11 of this Decree shall be collected from:
a) Databases specified in points a and đ of Clause 1 of this Article;
b) Health Database of Drivers and Operators of Specialized Motorcycles established and managed by the Ministry of Health.
Article 13. Updating Information in the Road Traffic Order and Safety Database
1. Updating information in the Road Traffic Order and Safety Database includes activities to supplement and adjust information from the following sources:
a) Results of administrative procedures implementation processes, administrative violations handling related to road traffic order and safety, and other relevant business activities;
b) Results of modifications and supplements made by agencies, organizations, and individuals when there are changes in information or when they discover that the information in the Road Traffic Order and Safety Database is incomplete or inaccurate;
c) Other sources as prescribed by law.
2. The agency directly responsible for building, managing, operating, exploiting, and using the database as stipulated in Clause 3, Article 10 of this Decree shall be responsible for supplementing and adjusting information in the database under its management and synchronizing it with the Road Traffic Order and Safety Database according to the provisions of law on data connection and sharing.
Article 14. Connecting, Sharing, Exploiting, and Using the Road Traffic Order and Safety Database
1. The connection and sharing of information between the Road Traffic Order and Safety Database and specialized databases and other databases shall be carried out in accordance with the provisions of the Law on Road Traffic Order and Safety and the Government's regulations on management, connection, and data sharing in state agencies and other relevant regulations.
2. When connected and shared, the Road Traffic Order and Safety Database, state management agencies shall carry out exploitation and use of the database to serve state management activities based on their assigned functions and tasks according to the law.
3. Agencies, organizations, and individuals have the right to exploit information in the Road Traffic Order and Safety Database shared on the National Public Service Portal, the Ministry of Public Security Public Service Portal, traffic police force applications on electronic platforms, and other forms of exploitation as prescribed by law.
Article 15. Management of the Road Traffic Order and Safety Database
1. The Road Traffic Order and Safety Database is centrally and uniformly managed at the Ministry of Public Security.
2. Ministries, ministerial-level agencies, and government agencies within the scope of their assigned tasks and powers shall cooperate with the Ministry of Public Security to build and manage the Road Traffic Order and Safety Database according to the law.
3. Provincial People's Committees and municipal people's committees under the central government within the scope of their assigned tasks and powers shall be responsible for state management of the Road Traffic Order and Safety Database according to their authority.
Article 16. Funding for Construction, Exploitation, Operation, Use, Maintenance, Repair, and Upgrading of the Road Traffic Order and Safety Database
1. For ministries, ministerial-level agencies, government agencies, and localities, funding for construction, exploitation, operation, use, maintenance, repair, and upgrading of the Road Traffic Order and Safety Database shall be implemented according to the Government's regulations on investment management for information technology application using state budget funds and other relevant legal provisions.
2. Funding for construction, exploitation, operation, use, maintenance, repair, and upgrading of the Road Traffic Order and Safety Database provided to the Ministry of Public Security from the state budget according to regulations and revenue from fines for administrative violations related to road traffic order and safety, proceeds from auctioning vehicle license plates after payment into the state budget, and other sources of funding as prescribed by law.
Chapter IV
MANAGEMENT, INSTALLATION, AND USE OF SIGNAL EMITTING DEVICES ON PRIORITY VEHICLES; PROCEDURES AND PROCEDURES FOR ISSUING AND REVOKING LICENSES FOR THE USE OF SIGNAL EMITTING DEVICES ON PRIORITY VEHICLESORDER; PROCEDURE FOR ISSUING, REVOKING LICENSE TO USE MONITORING EQUIPMENT,PROCEDURES AND PROCEDURES FOR ISSUING AND REVOKING LICENSES FOR THE USE OF SIGNAL EMITTING DEVICES ON PRIORITY VEHICLES
Article 17. Signal-emitting devices for priority vehicles
1. Signal-emitting devices for priority vehicles include: priority signal lights, priority signal horns, priority flags.
2. Installation of signal-emitting devices for priority vehicles:
a) Passenger cars: priority signal lights installed on the roof of the vehicle; priority signal horns installed inside the vehicle or on the roof of the vehicle; priority flags installed at the front of the vehicle on the left side of the driver.
b) Motorcycles: priority signal lights installed on the kickstand; priority signal horns installed at the front of the vehicle; priority flags installed at the front of the vehicle on the left side of the driver.
c) For vehicles of the police force, prosecution forces engaged in urgent tasks, traffic police leading vehicles when installing priority signal lights, the red light portion must be on the left side of the driver, and the blue light portion on the right side of the driver.
3. Management of signal-emitting devices for priority vehicles:
a) Priority vehicles must have a permit to use signal-emitting devices for priority vehicles issued by the competent authority when installing such devices.
b) Organizations, individuals may only install and use signal-emitting devices for priority vehicles on the types of vehicles specified in Article 18 of this Decree.
4. Business activities involving signal-emitting devices for priority vehicles must comply with security and public order conditions applicable to certain industries and trades subject to conditional business investment according to the law.
Article 18. Vehicles eligible for installation and use of signal-emitting devices for priority vehicles
1. Firefighting vehicles of the Fire Prevention and Fighting Rescue Force and firefighting vehicles of other forces mobilized for firefighting tasks.
2. Military vehicles engaged in urgent tasks including: military vehicles executing command and control tasks for firefighting, rescue, combat operations, emergency communications, commanding convoys, military inspection and supervision, military protection; vehicles executing arrest, search or other investigative activities, escorting suspects, defendants, convicts; participating in anti-terrorism activities.
3. Police vehicles engaged in urgent tasks including: traffic police vehicles patrolling, inspecting, controlling, commanding, investigating, resolving traffic accidents; vehicles providing security services; vehicles involved in rescue and relief operations; vehicles executing arrest, search or other investigative activities, escorting suspects, defendants, convicts; emergency communication vehicles; vehicles dealing with riot control, dispersing crowds disrupting public order; vehicles involved in anti-terrorism and hostage rescue operations.
4. Prosecution vehicles engaged in urgent tasks including: vehicles executing arrest, search or other investigative activities.
5. Traffic police leading vehicles.
6. Ambulances engaged in emergency medical services.
7. Flood defense vehicles engaged in tasks; vehicles engaged in rescue and relief operations, disaster mitigation, epidemic control.
8. Vehicles engaged in emergency tasks as prescribed by law including: vehicles serving the Emergency Command Center, vehicles serving functional forces mobilized to perform tasks upon declaration of a state of emergency.
Article 19. Signals and technical requirements for priority vehicles' signaling devices
1. Signals and technical requirements for priority vehicles' signaling devices include:
a) For flashing signal lights on priority vehicles, the signals to be used are red flashing lights, blue flashing lights, and red and blue flashing lights according to the technical requirements specified in Appendix I attached to this Decree;
b) For sirens on priority vehicles, the signals to be used shall comply with the technical requirements specified in Appendix I attached to this Decree;
c) For priority flags, technical requirements shall be implemented in accordance with the provisions set out in Appendix I attached to this Decree.
2. The signals used for priority vehicles' signaling devices:
a) Firefighting vehicle signals of the Police Force for Fire Prevention, Firefighting, Rescue and other mobilized firefighting forces include: red flashing light signals, priority siren signals;
b) Emergency mission military vehicle signals include: red flashing light signals, priority siren signals, military flags;
c) Emergency mission police vehicle signals and procuratorial vehicle signals include: blue and red flashing light signals, priority siren signals;
d) Traffic police leading vehicle signals include: blue and red flashing light signals, priority siren signals, police flags;
đ) Ambulance vehicle signals for emergency rescue missions include: red flashing light signals, priority siren signals;
e) Flood control vehicle signals, rescue and relief vehicle signals, disaster and epidemic response vehicle signals, and emergency mission vehicle signals as prescribed by law include: blue flashing light signals.
Article 20. Documents for Applying for New or Renewal of Permits to Use Priority Vehicles' Signaling Devices
1. Application for new permit:
Agencies and organizations submit one set of documents to the competent authority as stipulated in Clause 1, Clause 2, and Clause 3 of Article 23 of this Decree including:
a) A request for a permit to use priority vehicles' signaling devices according to Model No. 02b in Appendix II attached to this Decree;
b) In cases as stipulated in Clause 6, Clause 7, and Clause 8 of Article 18 of this Decree: documents specifying functions and tasks, and other relevant materials proving that the agency or organization meets the conditions to use priority vehicles' signaling devices.
If proof documents can be accessed through a connected database shared with the issuing authority, agencies and organizations need not provide them when applying.
2. For ambulances, permits to use priority vehicles' signaling devices may only be issued if they meet the standards and usage regulations for ambulances as prescribed by the Minister of Health.
3. In cases where the permit to use priority vehicles' signaling devices is damaged, lost, or has expired, the agency or organization using priority vehicles must submit a request for renewal of the permit to use priority vehicles' signaling devices according to Model No. 02b in Appendix II attached to this Decree.
Article 21. Procedures and Formalities for Issuing New or Renewal of Permits to Use Priority Vehicles' Signaling Devices
1. Agencies and organizations submit the documents and requests as stipulated in Clause 1 and Clause 3 of Article 20 of this Decree through one of the following methods: online at the Public Service Portal; via postal service; direct submission to the competent authority as stipulated in Clause 1, Clause 2, and Clause 3 of Article 23 of this Decree.
2. Within two working days from the date of receiving complete and valid documents and requests, the receiving authority is responsible for reviewing and issuing new or renewed permits to use priority vehicles' signaling devices for agencies and organizations using priority vehicles; if the conditions for issuance are not met, a written response stating the reasons must be provided.
3. In urgent situations as stipulated in Clause 8 of Article 18 of this Decree, agencies and organizations requesting permits to use priority vehicles' signaling devices may communicate in advance with the competent authority as stipulated in Clause 1, Clause 2, and Clause 3 of Article 23 of this Decree through appropriate means to obtain the permit as prescribed and immediately thereafter submit the documents as required under Clause 1 of Article 20 of this Decree.
4. In cases of direct processing, the issuing authority for permits to use priority vehicles' signaling devices is responsible for updating information in the permit into the database for managing permits to use priority vehicles' signaling devices.
Article 22. Permit for Using Signal Emitting Devices on Priority Vehicles
1. The form and content of the permit for using signal emitting devices on priority vehicles shall be in accordance with Model No. 02a attached as Appendix II to this Decree.
2. The validity period of the permit for using signal emitting devices on priority vehicles:
a) Not exceeding five years from the date of issuance and not later than the expiration date of the vehicle's service life.
b) The permit for using signal emitting devices on priority vehicles issued for vehicles performing urgent tasks as stipulated in Clause 8, Article 18 of this Decree shall become invalid immediately upon the end of the state of emergency.
3. The permit for using signal emitting devices on priority vehicles shall be revoked in any of the following cases:
a) The priority vehicle is damaged beyond repair, has reached its service life limit.
b) The priority vehicle changes its purpose of use or is disposed of.
c) The permit was issued to an incorrect entity or has expired.
d) The signal emitting device on priority vehicles is used for purposes other than those specified; the signal emitting device on priority vehicles is used contrary to the issued permit.
4. Agencies and organizations that have been granted permits for using signal emitting devices on priority vehicles shall be responsible for submitting the permit to the competent authority that issued it previously for revocation in cases where the permit is subject to revocation as stipulated in Clause 3 of this Article.
Article 23. Authority to Issue, Reissue, and Revoke Permits for Using Signal Emitting Devices on Priority Vehicles
1. The Traffic Police Corps under the Ministry of Public Security shall issue, reissue, and revoke permits for using signal emitting devices on priority vehicles for entities under central ministries, sectors, and agencies, except for military vehicles performing urgent tasks.
2. Provincial and centrally-administered city traffic police departments shall issue, reissue, and revoke permits for using signal emitting devices on priority vehicles for entities under local agencies, units, and organizations, except for military vehicles performing urgent tasks.
3. The General Staff Department under the Ministry of National Defense shall issue, reissue, and revoke permits for using signal emitting devices on priority vehicles for military vehicles performing urgent tasks.
4. The competent authority issuing and revoking permits for using signal emitting devices on priority vehicles shall be responsible for compiling statistics and monitoring the issuance and revocation of such permits according to Model No. 02c attached as Appendix II to this Decree.
Article 24. Responsibilities for Managing and Using Signal Emitting Devices on Priority Vehicles
1. The Ministry of Public Security shall direct functional units to manage, install, and use signal emitting devices on priority vehicles; issue and revoke permits for using signal emitting devices on priority vehicles as stipulated in this Decree, except for priority vehicles under the management of the Ministry of National Defense.
2. The Ministry of National Defense shall direct functional units to manage, install, and use signal emitting devices on priority vehicles; issue and revoke permits for using signal emitting devices on priority vehicles within the scope of its management.
3. Agencies and organizations that have been granted permits for using signal emitting devices on priority vehicles shall annually (before December 15) compile and submit to the competent authority that issued the permit previously, information on the current status of managing and using signal emitting devices on priority vehicles according to Model No. 02d attached as Appendix II to this Decree for management purposes.
Chapter V
LICENSE FOR OPERATING TRANSPARENCY MEASURES IN TRAFFIC, CONDITIONS FOR OPERATING RAW MATERIAL VEHICLES AND INSTALLING MONITORING DEVICES,MONITORING EQUIPMENT, AND IMAGE CAPTURE DEVICES ON DRIVER'S VEHICLESVIDEO RECORDING DEVICES OF THE DRIVERVEHICLE
Article 25. Issuance of Operating Permit for Intelligent Transportation Vehicles
The classification of intelligent transportation vehicles allowing partial or full automation, and the certification of technical safety quality and environmental protection for such vehicles shall be carried out in accordance with the regulations of the Minister of Transport.
2. The application dossier for operating permit includes:
a) Application form for operating permit according to Form No. 03a attached as Appendix III to this Decree;
b) Certificate of technical safety quality and environmental protection in accordance with the prescribed regulations.
3. Procedures and formalities for issuing operating permits:
a) The owner of the vehicle, organization, or individual prepares one set of the dossier as stipulated in Clause 2 of this Article and submits it to the competent authority for issuing operating permits through one of the following methods: online submission at the Public Service Portal; via postal service; direct submission;
b) The authority issuing the operating permit is responsible for receiving and examining the dossier. Within seven working days from the date of receipt of the dossier, the competent authority will conduct a search of the vehicle registration database system and compare the information in the application form with that of the owner; if the dossier is valid, an operating permit will be issued according to Form No. 03b attached as Appendix III to this Decree. If the dossier does not meet the conditions, a written response stating the reasons will be provided;
c) In case the operating permit for intelligent transportation vehicles is damaged, it can be exchanged; if lost, it can be reissued.
The owner of the vehicle or the person authorized under the law may submit an application for exchanging or reissuing the operating permit according to Form No. 03a attached as Appendix III to this Decree to the competent authority that previously issued the permit through one of the methods specified in point a of this clause. Within two working days from the date of receipt of the application, the competent authority will consider exchanging or reissuing the operating permit; if the conditions for exchange or reissue are not met, a written response stating the reasons will be provided.
4. The General Traffic Police Corps, Ministry of Public Security issues the operating permit for intelligent transportation vehicles, except for intelligent transportation vehicles serving defense purposes which are issued by the Motor Vehicle Department, Ministry of National Defense.
5. Intelligent transportation vehicles whose operating permits are revoked fall into one of the following cases:
a) Exceeding the usage period or not being allowed to circulate;
b) Damaged and unusable;
c) Scrapped, lost without trace;
d) An operating permit has been issued but it is later found that the dossier was falsified to obtain the permit; the permit was issued beyond the authority's jurisdiction.
6. The owner of the vehicle or the person authorized under the law is responsible for submitting the operating permit of intelligent transportation vehicles subject to revocation as stipulated in Clause 5 of this Article to the competent authority that previously issued the permit for revocation.
Article 26. Conditions for Operation of Primitive Vehicles
1. The conditions for operation of primitive vehicles as defined in points a, b, c, and e of Clause 2, Article 34 of the Road Traffic Safety Law include:
a) Effective braking system;
b) Sound warning device (horn, bell);
c) Front lighting or reflective tape; rear must have signal lights or reflective tape.
In case there are technical standards and specifications applicable to primitive vehicles as stipulated in this Clause, they shall be implemented in accordance with the corresponding technical standards and specifications.
2. For primitive vehicles as defined in points d and e of Clause 2, Article 34 of the Road Traffic Safety Law, reflective tape or light-emitting devices must be installed for nighttime visibility.
Article 27. Installation of vehicle tracking devices on commercial transport vehicles, tractor units, ambulances, and road traffic rescue vehicles
1. Commercial transport vehicles, tractor units, ambulances, and road traffic rescue vehicles must be equipped with vehicle tracking devices that meet technical requirements as stipulated in the National Technical Regulations on vehicle tracking devices and driver image recording devices.
Article 28. Driver image recording devices installed on passenger vehicles with eight seats or more (excluding the driver's seat) engaged in commercial transport, tractor units, ambulances, and road traffic rescue vehicles
Passenger vehicles with eight seats or more (excluding the driver's seat) engaged in commercial transport, tractor units, ambulances, and road traffic rescue vehicles must be equipped with driver image recording devices that meet technical requirements as stipulated in the National Technical Regulations on vehicle tracking devices and driver image recording devices.
Article 29. Management and use of devices, transmission, provision, updating, storage, and use of data collected from vehicle tracking devices and driver image recording devices
The management and use of devices, transmission, provision, updating, storage, and use of data collected from vehicle tracking devices and driver image recording devices shall be carried out in accordance with the law on managing, operating, and using the vehicle tracking device data management system and driver image recording devices.
Article 30. Paint color for commercial transport vehicles carrying preschool children and students
1. Commercial transport vehicles carrying preschool children and students as specified in point a, Clause 1, Article 46 of the Road Traffic Safety Law must be painted in bright yellow on the exterior body; the front and two sides of the vehicle above the windows must have signs indicating that it is a specialized vehicle for transporting preschool children and students.
2. Commercial transport vehicles combining with the activity of picking up and dropping off preschool children and students as specified in Clause 2, Article 46 of the Road Traffic Safety Law must have signs indicating that they are vehicles transporting preschool children and students placed on the front and two sides of the vehicle above the windows.
Article 31. Assistance to drivers, warnings to persons and vehicles participating in road traffic, and implementation of measures to ensure road traffic safety in necessary cases for oversized vehicles, overweight vehicles, tracked vehicles, and vehicles transporting extra-long and extra-heavy cargo traveling on roads
1. Cases requiring the implementation of measures to ensure road traffic safety include:
a) When traveling with oversized vehicles, overweight vehicles, tracked vehicles, and vehicles transporting extra-long and extra-heavy cargo on roads where any of the external dimensions of the vehicle, including cargo loaded on the vehicle, exceed 3.5 meters in width or 25 meters in length;
b) When traveling through locations of reinforced road construction sites, sections of roads obstructing visibility, two-lane roads each having only one lane, or one-lane roads where other vehicles find it difficult to overtake or avoid the vehicle;
c) When traveling on sections of roads that are damaged, deteriorated, or subject to unforeseen incidents.
2. Measures to ensure road traffic safety include:
a) Organizations and individuals granted permits for traveling with oversized vehicles, overweight vehicles, tracked vehicles, and vehicles transporting extra-long and extra-heavy cargo must arrange personnel and equipment to assist drivers and warn other persons and vehicles participating in road traffic;
b) Vehicles must move safely to ensure the safety of persons and vehicles participating in road traffic.
Chapter VI
ROAD TRAFFIC ORDER AND SAFETY FOR FOREIGN MOTOR VEHICLES REGISTERED OUTSIDE THE COUNTRY WITH RIGHT-HAND DRIVINGREGISTRATION PARTICIPATING IN TRAFFIC IN VIETNAM; FOREIGN MECHANIZED VEHICLES BROUGHT INTO VIETNAM FOR TOURISMMALE; FOREIGN MECHANICAL VEHICLES BROUGHT INTO VIETNAM BY FOREIGNERS FOR TOURISM PURPOSES
Article 32. Foreign Motor Vehicles and Foreign Nationals Operating Motor Vehicles in Vietnam
1. Foreign motor vehicles brought into Vietnam for tourism purposes include: passenger cars with right-hand drive or left-hand drive up to eight seats (excluding the driver's seat), mobile homes; two-wheeled motorcycles.
2. Foreign passenger cars with right-hand drive participating in traffic in Vietnam for non-tourism purposes are passenger cars.
3. General conditions for foreign motor vehicles and foreign nationals participating in traffic in Vietnam:
a) Must have a written approval document issued by an organization for foreign nationals bringing foreign motor vehicles into Vietnam to participate in traffic.
b) Must go through a travel agency operating international tour services in Vietnam to process the application for approval in cases stipulated in Clause 1 of this Article.
c) Must have a diplomatic note from a diplomatic mission, consular office, or representative office of an intergovernmental international organization in Vietnam requesting and clearly stating the reason for the vehicle to participate in traffic in Vietnam in cases stipulated in Clause 2 of this Article.
4. Conditions for foreign motor vehicles participating in traffic in Vietnam:
a) Must have a vehicle registration certificate and license plate issued by the competent authority of the registering country and still valid.
b) Must have a safety and environmental protection technical inspection certificate for motor vehicles or equivalent documents issued by the competent authority of the registering country and still valid for passenger cars.
5. Conditions for foreign nationals operating foreign motor vehicles in traffic in Vietnam:
a) Must have a passport, visa, or other international travel document, residence permit in Vietnam, except in cases where a visa exemption applies and they do not fall under the category of persons not allowed entry according to Vietnamese laws on entry, exit, transit, and residence of foreigners.
In cases where foreign nationals enter Vietnam under unilateral visa-free entry, their passports must be valid for at least six months; foreign nationals using electronic visas must enter through international border gates determined by the Government according to Vietnamese laws on entry, exit, transit, and residence of foreigners.
b) Must have a driving license suitable for the type of vehicle permitted to operate, valid within the territory of Vietnam and still valid.
6. Customs procedures, entry and exit formalities, and maximum duration allowed to participate in traffic in Vietnam:
a) Can only temporarily import and re-export through international border gates approved by the competent authority.
b) Must comply with entry and exit formalities according to Vietnamese laws on entry, exit, transit, and residence of foreigners.
c) Must comply with customs procedures for temporary import and re-export immediately upon entry and exit at the border gate.
d) The maximum duration allowed to participate in traffic in Vietnam shall not exceed the validity period of the visa issued or visa exemption granted to foreign nationals entering Vietnam according to Vietnamese laws on entry, exit, transit, and residence of foreigners from the date of approval.
In cases where foreign nationals or foreign motor vehicles cannot leave Vietnam due to unforeseen incidents that cannot be immediately resolved despite taking necessary measures within their capacity, they may stay in Vietnam for an additional period not exceeding ten days and must comply with the procedures stipulated in Point c, Clause 4, Article 33 of this Decree.
Article 33. Approval for Vietnamese travel service enterprises organizing foreign individuals to bring foreign motor vehicles into Vietnam for tourism or organizations and individuals bringing right-hand-drive cars to participate in traffic in Vietnam for non-tourism purposes.
Clause 1. Vietnamese travel service enterprises organizing foreign individuals to bring foreign motor vehicles into Vietnam for tourism as stipulated in Clause 1 of Article 32 of this Decree shall submit one set of application documents to the Traffic Police Corps, Ministry of Public Security through one of the following methods: online at the Ministry of Public Security's public service portal; via postal service; direct submission. The application package includes:
Point a) A request for approval letter accompanied by a list of drivers and information about the motor vehicles according to Model No. 04a Appendix IV attached to this Decree;
Point b) A copy of the international travel service business license, for Vietnamese travel service enterprises applying for the first time to organize foreign tourists to bring foreign motor vehicles into Vietnam for traffic participation. In cases where the international travel service business license is exploited through connection and sharing, send the document specified in point a of this clause.
Clause 2. Organizations and individuals bringing right-hand-drive cars to participate in traffic in Vietnam for non-tourism purposes as stipulated in Clause 2 of Article 32 of this Decree shall submit one set of application documents to the Traffic Police Corps, Ministry of Public Security through one of the following methods: online at the Ministry of Public Security's public service portal; via postal service; direct submission. The application package includes:
Point a) A diplomatic note from the diplomatic mission, consular office, or intergovernmental organization's representative office in Vietnam requesting and specifying the reasons for the vehicle participating in traffic in Vietnam for non-tourism purposes;
Point b) A request for approval letter accompanied by a list of drivers and information about the motor vehicles according to Model No. 04a Appendix IV attached to this Decree.
Clause 3. Within five working days from the date of receiving complete valid application documents as stipulated in Clauses 1 and 2 of this Article, the Traffic Police Corps, Ministry of Public Security shall issue a written response approving or not approving, specifically:
Point b) In case of refusal, non-approval, there must be a written response according to Model No. 04c Appendix IV attached to this Decree, sent directly or online or via postal service to the organization or individual who submitted the application previously.
Cases of refusal, non-approval for Vietnamese travel service enterprises organizing foreign individuals to bring foreign motor vehicles into Vietnam for tourism, organizations and individuals bringing right-hand-drive cars to participate in traffic in Vietnam include: failing to meet conditions as stipulated in Clauses 3, 4, 5 of Article 32 of this Decree; violating contents in previously approved documents; not yet completing requirements of competent state agencies regarding handling violations of laws or traffic accidents involving foreigners or incidents related to foreign motor vehicles caused before; foreigner's background, activities, route, and time of operation if entering Vietnam may affect national defense, security, social order, and safety.
Clause 4. For cases of changing routes, movement paths, or the departure time of foreigners and foreign motor vehicles being delayed compared to the time determined in the approval document or exceeding the maximum stay period in Vietnam as prescribed by laws on entry, exit, transit, and residence of foreigners in Vietnam:
Point a) Vietnamese travel service enterprises organizing foreign individuals and foreign motor vehicles to enter Vietnam for tourism or organizations and individuals bringing right-hand-drive cars to participate in traffic in Vietnam for non-tourism purposes must submit a document according to Model No. 04d Appendix IV attached to this Decree to the competent authority that issued the permit previously through one of the following methods: online at the Ministry of Public Security's public service portal; via postal service; direct submission before implementing changes in routes, movement paths, or departure times;
Point c) In case of incidents affecting the departure time being later than the time determined in the approval document or exceeding the maximum stay period in Vietnam, Vietnamese travel service enterprises and organizations shall immediately communicate with the competent authority that issued the permit previously through appropriate means and contact the police agency where the incident occurred; after resolving the incident, submit a document according to Model No. 04e Appendix IV attached to this Decree to the competent authority that issued the permit previously.
5. Handling violations in cases where there are approved documents for Vietnamese travel service enterprises organizing foreign individuals to bring foreign motor vehicles into Vietnam for tourism; organizing and individuals bringing right-hand-drive cars into Vietnam for traffic purposes other than tourism:
a) In cases where the violation pertains to the content of the previously approved document, the competent authority that issued the prior permit shall suspend the activity of organizing foreign individuals to bring foreign motor vehicles into Vietnam according to Model No. 04c Appendix IV attached to this Decree and refuse to approve other groups of the enterprise, organization, or individual within a six-month period from the date of the violation for Vietnamese travel service enterprises, organizations, or individuals who violated previously;
b) In cases where foreign individuals violate Vietnamese laws and have not yet completed the requirements of the competent state agency regarding the handling of the violation case, the competent authority that issued the prior permit shall suspend the activity of organizing foreign individuals to bring foreign motor vehicles into Vietnam according to Model No. 04c Appendix IV attached to this Decree until the violation case is resolved.
Article 34. Foreign Individuals Operating Foreign Motor Vehicles in Traffic in Vietnam
1. Foreign individuals operating foreign motor vehicles in traffic in Vietnam must travel in a group and have a person driving a vehicle ahead to guide during their participation in traffic in Vietnam. The guiding vehicle must be a car or motorcycle suitable for the type of vehicle used in the group.
2. They may participate in traffic on routes, sections of roads, and times specified in the approval document of the competent authority.
3. When operating foreign motor vehicles in traffic, foreign individuals must comply with the regulations of Vietnamese law on road traffic order and safety; carry and present the following documents when requested by the competent authority:
a) Passport or international travel document, and related residence documents in Vietnam;
b) A valid driver's license appropriate to the type of vehicle being operated, which is valid within the territory of Vietnam;
c) Certificate of technical inspection and environmental protection for the foreign motor vehicle or equivalent document issued by the registration authority of the country of registration and still valid (for cars);
d) Vehicle registration certificate issued by the registration authority of the country of registration and still valid;
đ) Certificate of compulsory liability insurance for the owner of the foreign motor vehicle valid in Vietnam;
e) Customs declaration form for temporary import and re-export of road transport vehicles.
Article 35. Responsibilities of Vietnamese International Travel Service Enterprises; Organizations and Individuals Bringing Right-Hand-Drive Cars into Vietnam for Non-Tourism Purposes
1. To handle procedures for inviting and guaranteeing foreign individuals operating foreign motor vehicles to enter, exit, and reside in Vietnam, except in cases exempted from visa requirements; to comply with Vietnamese laws on entry, exit, transit, and residence of foreigners and other relevant laws.
2. To organize the bringing of foreign motor vehicles into traffic in Vietnam and out of the Vietnamese territory according to regulations; to arrange vehicles and drivers to guide foreign motor vehicles during their participation in traffic in Vietnam; to affix recognition logos or flags bearing the symbols of the enterprise or organization on the vehicles of the group.
3. To comply with Vietnamese laws on ensuring security and order during the participation of foreign motor vehicles in traffic in Vietnam. To manage the activities of foreign individuals according to the registered program and route; to coordinate with temporary residence declarations as required by law.
4. Within ten days from the end of the program, to send a report to the competent authority that issued the prior permit about the results of organizing foreign individuals to bring foreign motor vehicles into traffic in Vietnam according to Model No. 04e Appendix IV attached to this Decree.
5. To be responsible for organizing the handling and resolving costs arising from legal violations or traffic accidents caused by foreign individuals operating foreign motor vehicles, or incidents involving foreign motor vehicles during their participation in traffic in Vietnam.
6. To be responsible for the accuracy and legality of the documents and information of foreign individuals and foreign motor vehicles in the documents sent to the competent authority issuing permits and the documents stipulated in Clause 4 and Clause 5, Article 32 of this Decree.
Article 36. Responsibilities of relevant agencies in managing foreign individuals operating foreign motor vehicles in traffic in Vietnam
1. Responsibilities of the Ministry of Public Security:
a) Take the lead in organizing inspections and controls at border gates within their jurisdiction; implement procedures for issuing visas and temporary residence certificates for foreign individuals entering Vietnam in accordance with laws on entry, exit, transit, and residence of foreigners in Vietnam;
b) Coordinate with the Ministry of National Defense and the Ministry of Finance in handling temporary import and re-export procedures for foreign motor vehicles participating in traffic in Vietnam;
c) Inspect and handle violations committed by domestic travel service enterprises, organizations, and individuals in organizing foreign individuals to operate foreign motor vehicles in traffic in Vietnam; and by foreign individuals operating foreign motor vehicles when participating in traffic in Vietnam;
2. The Ministry of Culture, Sports and Tourism shall be responsible for:
a) Guiding organizations and individuals involved in bringing foreign motor vehicles into traffic in Vietnam in accordance with this Decree;
c) Cooperating with units, localities, and businesses to research and develop programs, routes, and roadways for foreign tourists traveling by road.
3. The Ministry of National Defense shall be responsible for taking the lead in organizing inspections and controls at border gates within its jurisdiction; implementing border procedures, issuing, amending, supplementing, or canceling visas, and issuing temporary residence certificates for foreign individuals entering Vietnam in accordance with the law; coordinating with specialized state management agencies at border gates to supervise vehicles in performing temporary import and re-export procedures in accordance with the law.
4. The Ministry of Finance shall be responsible for leading and coordinating with the Ministry of Public Security and the Ministry of National Defense in implementing temporary import and re-export procedures for foreign motor vehicles brought into Vietnam in accordance with the law.
Chapter VII
IMPLEMENTING PROVISIONS
Article 37. Transitional Provisions
1. Licenses for the use of signal-emitting devices on priority vehicles issued before this Decree takes effect for the subjects specified in Clauses 1, 2, 3, and 5 of Article 18 of this Decree shall remain valid for the period stated on the license; licenses for the use of signal-emitting devices on priority vehicles issued before this Decree takes effect for the subjects specified in Clauses 6, 7, and 8 of Article 18 of this Decree shall be subject to the relevant agencies or organizations that have previously been granted such licenses to follow the procedures and formalities for applying for new licenses for the use of signal-emitting devices on priority vehicles as stipulated in Chapter IV of this Decree.
2. In cases where competent authorities have approved international travel service enterprises in Vietnam organizing foreign individuals to bring foreign motor vehicles into Vietnam for tourism or organizing foreign individuals to bring right-hand-drive foreign registered motor vehicles to participate in traffic in Vietnam for non-tourism purposes before this Decree takes effect, they shall continue to implement the programs according to the approved documents.
Article 38. Effective Date
1. This Decree takes effect from January 1, 2025.
2. From the date this Decree takes effect, the following documents, articles, clauses within documents, and provisions shall be abolished:
a) Decree No. 109/2009/NĐ-CP dated December 1, 2009 of the Government on signals of priority vehicles, Decree No. 30/2024/NĐ-CP dated March 7, 2024 of the Government on management of foreign-registered motor vehicles brought into Vietnam for tourism, and Decree No. 80/2009/NĐ-CP dated October 1, 2009 of the Government on right-hand-drive foreign-registered motor vehicles participating in traffic in Vietnam;
b) Article 12, Clause 2 of Article 13, Clause 2 of Article 14, Clause 13 of Article 22, Clause 9 of Article 23, Clause 3 of Article 26, Clause 5 and Clause 8 of Article 34 of Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government on business and conditions for operating passenger transport services by road using motor vehicles (amended and supplemented by Decree No. 47/2022/NĐ-CP dated July 19, 2022 of the Government and Decree No. 41/2024/NĐ-CP dated April 16, 2024 of the Government);
c) The phrase "vehicle tracking device" as defined in Clause 4, the phrase "provision, management, and use of data from vehicle tracking devices; provision, management, and use of image data from cameras installed on commercial transport vehicles;" as defined in Point c Clause 5, the phrase "including a system for processing data from vehicle tracking devices" as defined in Clause 7 of Article 23, the phrase "vehicle tracking device and" as defined in Clause 1 of Article 27, the phrase "including a system for processing data from vehicle tracking devices" as defined in Clause 3 of Article 30, and Article 32 of Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government on business and conditions for operating passenger transport services by road using motor vehicles (amended and supplemented according to Decree No. 47/2022/NĐ-CP dated July 19, 2022 of the Government and Decree No. 41/2024/NĐ-CP dated April 16, 2024 of the Government).
Article 39. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and related agencies are responsible for implementing this Decree.
