Guidelines for implementing the residential policy stipulated in Decision No. 53/2015/QD-TTg dated October 20, 2015 of the Prime Minister on the residential policy for vocational college and intermediate level students

Joint Circular No. 12/2016/TTLT-BLDTBXH-BGDĐT-BTC dated June 16, 2016 of the Minister of Labor, Invalids and Social Affairs, the Minister of Education and Training, and the Minister of Finance guiding the implementation of the residential policy stipulated in Decision No. 53/2015/QD-TTg dated October 20, 2015 of the Prime Minister on the residential policy for vocational college and intermediate level students, effective from August 1, 2016, amended and supplemented by:

Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018 of the Minister of Labor, Invalids and Social Affairs amending and supplementing some articles of related Circulars concerning administrative procedures within the scope of state management functions of the Ministry of Labor, Invalids and Social Affairs, effective from December 18, 2018;

Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023 of the Minister of Labor, Invalids and Social Affairs amending, supplementing, and abolishing some articles of related Circulars and Joint Circulars concerning the submission and presentation of paper household registration books, paper temporary residence certificates, or other documents requiring confirmation of place of residence when performing administrative procedures under the jurisdiction of the Ministry of Labor, Invalids and Social Affairs, effective from October 12, 2023.

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 53/2015/QD-TTg dated October 20, 2015 of the Prime Minister on the residential policy for vocational college and intermediate level students;

The Minister of Labor, Invalids and Social Affairs, the Minister of Education and Training, and the Minister of Finance issue this Joint Circular guiding the implementation of the residential policy stipulated in Decision No. 53/2015/QD-TTg dated October 20, 2015 of the Prime Minister on the residential policy for vocational college and intermediate level students.1

Article 1. Scope of Regulation and Applicability

1. This Circular guides the implementation of the residential policy stipulated in Decision No. 53/2015/QD-TTg dated October 20, 2015 of the Prime Minister on the residential policy for vocational college and intermediate level students (hereinafter referred to as Decision No. 53). The residential policy includes: scholarship policy, support for purchasing personal items, support during Tet holiday, and travel support.

2. This Circular applies to individuals participating in regular vocational training programs at vocational education institutions at the college and intermediate levels, including:

a) Ethnic minority members belonging to poor households, near-poor households, or persons with disabilities;

b) Graduates of boarding schools for ethnic minorities;

c) Members of the Kinh ethnic group belonging to poor households, near-poor households, or persons with disabilities who have permanent residency in areas with particularly difficult socio-economic conditions, ethnic minority regions, border areas, and islands.

3. The criteria for poor households and near-poor households shall be implemented according to the regulations approved by the Prime Minister for each period. Areas with particularly difficult socio-economic conditions, ethnic minority regions, border areas, and islands are specified in Appendix I the annex to this Circular. Regulations regarding persons with disabilities shall be implemented according to the Law on Persons with Disabilities, Decree No. 28/2012/NĐ-CP dated April 10, 2012 of the Government detailing and guiding the implementation of certain provisions of the Law on Persons with Disabilities and other relevant documents.

Article 2. Implementation Principles

Principles for implementing the residential policy as stipulated in Article 4 of Decision No. 53 and the following principles:

1. In cases where students belong to groups eligible for multiple policies simultaneously, they may only benefit from one highest policy or if studying concurrently at multiple vocational education institutions, they may only benefit from one institution's policy or if studying multiple majors, trades, and levels simultaneously within one vocational education institution, they may only benefit from one policy throughout their entire study period.

2. For training programs based on academic years where the final year's study duration is less than twelve months, the scholarship policy will be granted based on the actual number of months studied in that academic year.

3. For modular or credit-based training programs, the scholarship policy will be granted based on the converted training time but not exceeding the training time of the major, trade, and equivalent level of training compared to the academic year program according to the formula below:

Article 3. Levels of policy scholarships and other support items

The levels of policy scholarships and other support items shall be implemented in accordance with the provisions of Article 3 of Decision No. 53.

Article 4. Procedures and application dossier for internal residence policies

1. Within thirty working days from the date of the opening ceremony, vocational education institutions shall notify students participating in intermediate and higher vocational training programs about the internal residence policy, the time to submit applications, and guide them on the application dossier as follows:

a) For students studying at public vocational education institutions: Submit the application dossier to the public vocational education institution where the students are enrolled;

b) For students studying at private vocational education institutions or vocational education institutions with foreign investment: Submit the application dossier to the Department of Labor, Invalids, and Social Affairs of the district, town, or provincial city where the students have their permanent household registration (hereinafter referred to as the District Department of Labor, Invalids, and Social Affairs).

2. The application dossier for internal residence policies consists of one set including:

a) Application form for internal residence policies:

For students studying at public vocational education institutions according to the model at Seal Registration Certificate attached hereto;

For students studying at private vocational education institutions or vocational education institutions with foreign investment according to the model at Appendix III promulgated together with this Circular.

b)2 (Repealed)

c) For ethnic minority students belonging to poor households or near-poor households, in addition to the documents specified in Points a and b of this Clause, they must supplement a certificate of poverty issued by the People's Committee of the commune where the students are registered (a certified copy from the original or a copy with the original attached for comparison);

d) For ethnic minority students who are persons with disabilities, in addition to the documents specified in Points a and b of this Clause, they must supplement a disability confirmation certificate issued by the People's Committee of the commune or a Decision of the People's Committee of the district regarding social assistance for persons with disabilities living in the community in cases where there is no disability confirmation certificate issued by the People's Committee of the commune (a certified copy from the original or a copy with the original attached for comparison);

đ) For Han Chinese students belonging to poor households or near-poor households with permanent household registration in areas with particularly difficult socio-economic conditions, ethnic minority areas, border areas, and islands, in addition to the documents specified in Points a and b of this Clause, they must supplement a certificate of poverty issued by the People's Committee of the commune (a certified copy from the original or a copy with the original attached for comparison);3;

e) For Han Chinese students who are persons with disabilities with permanent household registration in areas with particularly difficult socio-economic conditions, ethnic minority areas, border areas, and islands, in addition to the documents specified in Points a and b of this Clause, they must supplement a disability confirmation certificate issued by the People's Committee of the commune or a Decision of the People's Committee of the district regarding social assistance for persons with disabilities living in the community in cases where there is no disability confirmation certificate issued by the People's Committee of the commune (a certified copy from the original or a copy with the original attached for comparison);4;

g) For students graduating from boarding schools for ethnic minorities, in addition to the documents specified in Points a and b of this Clause, they must supplement a graduation certificate or a temporary graduation certificate (a certified copy from the original or a copy with the original attached for comparison);

h) For students staying at school during the Tet holiday, in addition to the documents specified in Points a and b of this Clause and one of the documents specified in Points c, d, đ, e, and g of this Clause, they must supplement a confirmation of staying at school during the Tet holiday according to the model at REGULATIONS ON THE CERTIFICATE DESIGN FOR OUTSTANDING RURAL INDUSTRIAL PRODUCTS issued together with this Circular for students studying at public vocational education institutions or according to the model at Annex V issued together with this Circular for students studying at private vocational education institutions or vocational education institutions with foreign investment.

3. Submission and examination of the application dossier:

a) Submission of the application dossier

Students eligible for internal residence policies submit the application dossier once at the beginning of the course. However, certificates of poverty (a certified copy from the original or a copy with the original attached for comparison) and certificates of staying at school during the Tet holiday must be submitted annually.

In case students eligible for internal residence policies fail to submit or delay submission of the application dossier as required during the course, they will not be entitled to internal residence policies. Payment of internal residence policies for students starts from the day the public vocational education institution or the District Department of Labor, Invalids, and Social Affairs receives the application dossier until the end of the course and will not be backdated for scholarship payments, other support items during the Tet holiday, and travel support for the period before the student submits the application dossier as required.

For students who do not qualify for internal residence policies as stipulated in Clause 2, Article 1 of this Circular,if during the course of study, due to objective or subjective circumstances, they become eligible for internal residence policies as stipulated in Clause 2, Article 1 of this Circular, then they must submit supplementary application dossiers to be eligible for internal residence policies in the subsequent period as stipulated in Clause 2 of this Article. The eligibility period is based on the validity of the confirmation documents. If the confirmation documents have different validity periods, the eligibility period is based on the latest valid document.

b) Examination of the application dossier for internal residence policies

For students studying at public vocational education institutions: The heads of public vocational education institutions, based on the provisions at Article 1, Article 2, Clause 1 and Clause 2 of this Article of this Circular organize the comparison, examination, and bear responsibility for the accuracy of the file; compile and create a list of beneficiaries of the policy. In case the file is not valid, the public vocational education institution shall be responsible for informing the learner of this within three working days from the date of receipt of the file;

For students participating in courses at private vocational education institutions or vocational education institutions with foreign investment capital: The head of the private vocational education institution or the vocational education institution with foreign investment capital shall be responsible for confirming on the application form for residential policy benefits for students according to the model issued Appendix III along with this Circular within ten working days from the date of receipt of the application form and guide students to submit the file in accordance with Clause 1 and Clause 2 of this Article to the Department of Labor - Invalids and Social Affairs of the district (where the students have their permanent residence) for comparison, examination, approval of the list of beneficiaries of the policy. In case the file is not valid, the Department of Labor - Invalids and Social Affairs of the district shall be responsible for informing the learner of this within three working days from the date of receipt of the file. The head of the private vocational education institution or the vocational education institution with foreign investment capital shall be responsible for the accuracy of the content confirmed on the application form for residential policy benefits of the students.

Article 5. Methods of disbursing scholarship policies and other allowances

1. For students studying at public vocational education institutions: The public vocational education institution where the students are currently studying shall be responsible for managing and organizing the direct disbursement of scholarship policies and other allowances in cash to students studying at that public vocational education institution.

2. For students studying at private vocational education institutions or vocational education institutions with foreign investment capital: The Department of Labor - Invalids and Social Affairs of the district where the students have their permanent residence shall be responsible for managing and organizing the direct disbursement of scholarship policies and other allowances in cash to students studying at private vocational education institutions or vocational education institutions with foreign investment capital.

3. The time for granting scholarship policies and other allowances shall be implemented twice during the academic year: The first grant for six months in October or November each year; the second grant for six months in March or April of the following year. In cases where students have not received scholarship policies and other allowances according to the prescribed deadlines, they will be entitled to claim them in the next disbursement period.

Article 6. Provisions on suspending the grant of scholarship policies and other allowances

1. During the course of study, if students no longer qualify for residential policy benefits as stipulated in Clause 2, Article 1 of this Circular, then students will no longer be eligible for residential policy benefits from the effective date of the documents confirming that they no longer qualify for residential policy benefits or from the expiration date of the old documents confirming their eligibility for residential policy benefits submitted to the public vocational education institution or the Department of Labor - Invalids and Social Affairs of the district.

2. Students who are expelled or suspended from studies due to disciplinary actions, illness, accidents, or other objective reasons unable to continue their studies. The period during which they are not eligible for residential policy benefits starts from the effective date of the expulsion or suspension decision. If students have already received scholarship policies and other allowances, the public vocational education institution and the Department of Labor - Invalids and Social Affairs of the district will suspend the disbursement of scholarship policies and other allowances in the subsequent semester.

3. Students during the period of suspension from studies (with a specified duration), except in cases of suspension due to illness, accidents, retaking courses, or suspension for objective reasons recognized by the school. If students have already received scholarship policies and other allowances, the public vocational education institution and the Department of Labor - Invalids and Social Affairs of the district will deduct the corresponding amount of scholarship policy funds (excluding other support funds) for the months of suspension from the subsequent semester after the student resumes studies.

4. Students during the period of detention or arrest pursuant to the decision of the competent authority

a) If declared innocent and continue to participate in the course, they will continue to receive scholarship policies and other allowances as prescribed. The implementation of residential policy benefits shall be carried out in accordance with Clause 3 of this Article;

b) If declared innocent but do not continue to participate in the course, they will be suspended from receiving residential policy benefits from the effective date of the decision to suspend studies for students made by the vocational education institution. If students have already received scholarship policies and other allowances, the suspension of residential policy benefits shall be carried out in accordance with Clause 2 of this Article;

c) If found guilty, students will be suspended from receiving residential policy benefits from the effective date of the decision of the competent authority. If students have already received scholarship policies and other allowances, the suspension of residential policy benefits shall be carried out in accordance with Clause 2 of this Article.

5. In cases where students suspend their studies as stipulated in Clause 2, Clause 3, and Clause 4 of this Article, they will not be eligible for residential policy benefits when participating in other higher vocational training programs.

6. Private vocational education and training institutions or vocational education and training institutions with foreign investment shall be responsible for sending decisions to suspend studies, decisions to force withdrawal from studies, and decisions to take leave of students and trainees who are eligible for residential policy benefits recognized by their schools to the Department of Labor - Invalids and Social Affairs of the district where such students and trainees have permanent residence registration.

Article 7. Sources of funds for implementation

The source of funds for implementing the payment of residential policy benefits as stipulated in this Circular shall be implemented according to Article 6 of Decision No. 53.

For the year 2016, ministries, sectors, central agencies, and localities that have not yet balanced their budgets shall submit consolidated reports on scholarship funding and other support amounts for beneficiaries as prescribed in this Circular to the Ministry of Finance for consolidation and submission to competent authorities for consideration and supplementation of the budget estimate to implement the policy.

Article 8. Budget Estimation, Allocation, and Settlement of Scholarship Funding and Other Support Amounts

1. Preparing budgets

Annually, based on the Prime Minister's Directive on the development plan for economic and social activities and the state budget estimate for the planning year; the Circular guiding the Ministry of Finance on the preparation of the state budget estimate for the planning year; based on the number of beneficiaries entitled to residential policy benefits, each agency and unit shall prepare the budget estimate for the expenditure of residential policy benefits, which will be included in the overall state budget estimate of the agency or unit and submitted to the same-level financial authority or the supervising authority for consolidation and submission to the same-level financial authority at the same time as the state budget estimate report for the planning year. Specifically as follows:

a) Public vocational education and training institutions shall base on the level of support and the number of beneficiaries entitled to scholarship funding and other support amounts to compile a list (accompanied by confirmation documents of beneficiaries as prescribed in Clause 2, Article 1 of this Circular), consolidate and prepare the budget estimate according to the model at Appendix VI issued together with this Circular and submit it to the same-level financial authority or the supervising authority for review and consolidation before submission to the same-level financial authority for consolidation and submission to the competent authority for approval;

b) District Departments of Labor - Invalids and Social Affairs shall base on the level of support and the number of beneficiaries entitled to scholarship funding and other support amounts to compile a list (accompanied by confirmation documents of beneficiaries as prescribed in Clause 2, Article 1 of this Circular), consolidate and prepare the budget estimate according to the model at Appendix VI issued together with this Circular and submit it to the same-level financial authority for review and consolidation before submission to the competent authority for approval;

Agencies and units responsible for managing the implementation of residential policy benefits for beneficiaries as prescribed in Clause 2, Article 1 of this Circular shall be responsible for submitting the budget estimate for the provision of scholarship funding and other support amounts to the same-level financial authority or the supervising authority for review and consolidation before July 20th each year for inclusion in the local government's projected budget estimate needs for education and training expenditures, and for submission to the Ministry of Finance by relevant ministries, sectors, and central agencies;

The budget estimate for the implementation of residential policy benefits shall be prepared based on the estimated number of beneficiaries entitled to residential policy benefits at vocational education and training institutions from January 1 to December 31 of the planning year.

2. Allocating budgets

Based on the decision to allocate the state budget estimate by the Prime Minister:

Provincial People's Committees and municipal people's committees under the central government shall submit to the same-level People's Council for decision on the allocation of funds for the payment of scholarship funding and other support amounts for students and trainees of public vocational education and training institutions, private vocational education and training institutions, and vocational education and training institutions with foreign investment simultaneously with the allocation of the annual state budget estimate in the local education and training expenditure budget according to the prescribed regulations;

Ministries, sectors, and central agencies shall decide on the allocation of scholarship funding and other support amounts for public vocational education and training institutions under their jurisdiction simultaneously with the allocation of the annual state budget estimate according to the prescribed regulations.

3. Management, Use, and Settlement of Funds

The management, use, and settlement of funds for the payment of scholarship funding and other support amounts shall be carried out in accordance with the current provisions of the State Budget Law, guiding documents, and the current State Budget Classification.

4. Annually, ministries, sectors, and localities shall be responsible for submitting consolidated reports on the implementation of residential policy benefits by their respective ministries, sectors, and localities according to the model issued together with this Circular to the Ministry of Finance, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Education and Training before January 31 of the following year. On the basis of the reports from ministries, sectors, and localities, the Ministry of Finance shall consolidate and submit reports to competent authorities as prescribed. Appendix VII issued together with this Circular and submit them to the Ministry of Finance, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Education and Training before January 31 of the following year. On the basis of the reports from ministries, sectors, and localities, the Ministry of Finance shall consolidate and submit reports to competent authorities as prescribed.

Article 9. Implementation Organization

1. From January 1, 2016, new students admitted to college and secondary vocational education (vocational college, college, secondary vocational school, and secondary specialized school) who fall within the scope prescribed in Clause 2, Article 1 of this Circular shall enjoy residential policy benefits as stipulated in this Circular.

2. Agencies responsible for paying scholarship funding and other support amounts to students and trainees shall be responsible for publicly announcing procedures and payment times for scholarship funding and other support amounts to facilitate students and trainees in enjoying the policy in accordance with regulations.

3. The Ministry of Labor - Invalids and Social Affairs and the Ministry of Education and Training (in accordance with the division of responsibilities for state management of vocational education and training as prescribed in Decree No. 48/2015/NĐ-CP dated May 15, 2015 of the Government detailing certain articles of the Vocational Education Law) shall take the lead and coordinate with the Ministry of Finance to inspect, supervise, evaluate, and consolidate the implementation of residential policy benefits as stipulated in Decision No. 53.

4. During the implementation process, in cases where the regulatory legal documents referred to for application in this Circular are amended, supplemented, or replaced by new documents, they shall be applied according to the new documents.

Article 10. Implementation Provisions⁵

1. This Circular takes effect from August 1, 2016.

2. The Date of implementation of scholarship grants and other support provisions stipulated in this Circular shall be calculated from January 1, 2016.

During the implementation process, if there are difficulties or obstacles, it is recommended that agencies, organizations, and individuals report them to the Ministry of Labor - Invalids and Social Affairs, the Ministry of Education and Training, and the Ministry of Finance for consideration and resolution./.

1 Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018 of the Minister of Labor - Invalids and Social Affairs amending and supplementing certain provisions of several circulars related to administrative procedures within the scope of state management functions of the Ministry of Labor - Invalids and Social Affairs is based on the following:

“Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 63/2010/NĐ-CP dated June 8, 2010 of the Government on administrative procedure control; Decree No. 48/2013/NĐ-CP dated May 14, 2013 and Decree No. 92/2017/NĐ-CP dated August 7, 2017 of the Government amending and supplementing certain provisions of several decrees related to administrative procedure control;

At the request of the Director of the Legal Department,

The Minister of Labor - Invalids and Social Affairs issues this Circular amending and supplementing certain provisions of several circulars related to administrative procedures within the scope of state management functions of the Ministry of Labor - Invalids and Social Affairs".

Circular No. 08/2023/TT-BLDTBXH amending, supplementing, and abolishing certain provisions of several Circulars and Joint Circulars concerning the submission and presentation of paper household registration books, temporary residence books, or other documents requiring confirmation of place of residence when performing administrative procedures under the jurisdiction of the Ministry of Labor - Invalids and Social Affairs is based on the following:

"Pursuant to the Law on Household Registration dated November 13, 2020;

Pursuant to the Law on Issuing Legal Documents dated June 22, 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Issuing Legal Documents dated June 18, 2020;

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 104/2022/NĐ-CP dated December 21, 2022 of the Government amending and supplementing certain provisions of several decrees related to the submission and presentation of paper household registration books and temporary residence books when performing administrative procedures and providing public services;

At the proposal of the Director of the Legal Department;

The Minister of Labor - Invalids and Social Affairs issues this Circular amending, supplementing, and abolishing certain provisions of several Circulars and Joint Circulars issued by the Minister of Labor - Invalids and Social Affairs."

2 This point is abolished according to Clause 2, Article 4 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018 of the Minister of Labor - Invalids and Social Affairs amending and supplementing certain provisions of several Circulars related to administrative procedures within the scope of state management functions of the Ministry of Labor - Invalids and Social Affairs, effective from December 18, 2018.

3 The content "and household registration book (a certified copy from the original or a copy with the original for comparison)" has been abolished pursuant to point a, Clause 4, Article 3 of Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023, issued by the Minister of Labor, Invalids, and Social Affairs to amend, supplement, and abolish certain provisions of Circulars and Joint Circulars concerning the submission and presentation of paper household registration books, paper temporary residence certificates, or documents requiring confirmation of place of residence when performing administrative procedures under the management of the Ministry of Labor, Invalids, and Social Affairs, which took effect on October 12, 2023.

5 Article 11 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of Circulars related to administrative procedures within the scope of the State management functions of the Ministry of Labor, Invalids, and Social Affairs, which took effect on December 18, 2018, provides as follows:

“Article 11. Implementation Provisions

1. This Circular takes effect from December 18, 2018.

2. In the course of implementation, if there are difficulties, they should be promptly reported to the Ministry of Labor, Invalids, and Social Affairs for study and appropriate amendments.

Article 5 of Circular No. 08/2023/TT-BLDTBXH amending, supplementing, and abolishing certain provisions of Circulars and Joint Circulars concerning the submission and presentation of paper household registration books, paper temporary residence certificates, or documents requiring confirmation of place of residence when performing administrative procedures under the management of the Ministry of Labor, Invalids, and Social Affairs, which took effect on October 12, 2023, provides as follows:

“Article 5. Implementation Provisions

1. This Circular takes effect from October 12, 2023.

2. For forms of documents that are part of the administrative procedure files received before this Circular takes effect and have not yet been resolved, they shall continue to be processed according to the provisions of the Circulars and Joint Circulars that have not been amended, supplemented, or abolished by this Circular.

3. The Director of the Legal Department, Heads of units under the Ministry of Labor, Invalids, and Social Affairs responsible for state management, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.

During the implementation process, if there are difficulties, they should be promptly reported to the Ministry of Labor, Invalids, and Social Affairs for research and resolution.
