Decision on Amending and Supplementing Clause 2 of Article 4 of the Regulation on Management, Use, Operation, and Traffic Safety Assurance for the Ho Chi Minh Road - Phase I
THE MINISTER OF TRANSPORTATION
Pursuant to the Road Traffic Law dated June 29, 2004;
Pursuant to the Government Decree No. 34/2003/NĐ-CP dated April 4, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decision No. 1621/QĐ-BGTVT dated June 7, 2004 of the Minister of Transport on announcing the cross-section planning of the Ho Chi Minh Road construction project;
At the proposal of the Director of the Vietnam Highway Administration, the Director of the Quality Control and Supervision Bureau, and the Head of the Legal Department,
DECISION:
Article 1. Clause 2 of Article 4 of the "Regulation on Management, Use, Operation, and Traffic Safety Assurance for the Ho Chi Minh Road - Phase I" issued together with Decision No. 1944/2003/QĐ-BGTVT dated July 4, 2003 of the Minister of Transport is amended and supplemented as follows:
2. For roads outside urban areas, based on the technical grade of the road according to the planning, the safety zone width is calculated from the edge of the embankment base or the top of the cutting slope or the outer edge of the longitudinal ditch or the outer edge of the crown ditch of the road, specifically as follows:
a. The section of the road from Hòa Lạc to Tân Cảnh on the Ho Chi Minh Road, the safety zone width on each side is 20 meters (twenty meters), except for the section from Xuân Mai to Thạch Quảng which will be announced after the approval decision on the adjustment of the planning is made.
b. The western branch of the Ho Chi Minh Road including the sections from Khe Gát to Khe Sanh and from Đăk Rông to Thạch Mỹ, the safety zone width on each side is 10 meters (ten meters).
Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 3. The Chief of the Office, the Director of the Vietnam Highway Administration, the Director of the Quality Control and Supervision Bureau, the General Director of the Ho Chi Minh Road Project Management Board, the Heads of the Legal Department, the Directors of the Transport Departments of Ha Tay, Hoa Binh, Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Quang Nam, Kon Tum Provinces, and the Heads of relevant agencies and units are responsible for implementing this Decision.
