CIRCULAR

GUIDELINES FOR STANDARDS AND QUOTAS FOR THE USE OF EQUIPMENT IN THE FIELD OF EDUCATION AND TRAINING

On the basis of The Education Law June 14, 2005; Law Amending and Supplementing Certain Provisions of the Education Law November 25, 2009;

On the basis of Higher Education Law June 18, 2012; Law Amending and Supplementing Certain Provisions of the Higher Education Law November 19, 2018;

On the basis of dated October 28, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment; June 21, 2017;

Pursuant to Decision No. Decision No. 50/2017/QĐ-TTg December 31, 2017 of the Prime Minister stipulating standards and quotas for the use of equipment;

Decree No. Decree No. 69/2017/NĐ-CP of the Government dated May 25, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training; Decree No. 20/2014/NĐ-CP

At the proposal of the Director of the General Infrastructure Department;

The Minister of Education and Training issues this Circular to provide guidelines on standards and quotas for the use of specialized equipment in the field of education and training.

Article 1. Scope of Regulation and Applicability

1. This Circular provides guidelines on standards and quotas for the use of specialized equipment in the field of education and training within the scope of management under the Ministry of Education and Training as prescribed in point a, Clause 2, Article 8 of Decision No. 50/2017/QĐ-TTg dated December 31, 2017 of the Prime Minister.

2. Standards and quotas for the use of specialized equipment in the field of education and training as prescribed in this Circular apply to equipment that meets the criteria for fixed assets according to the regulations on the management and depreciation of fixed assets at agencies, organizations, and units.

3. This Circular applies to public service units, including:

a) Preschool education facilities, general education facilities, continuing education centers, vocational education and continuing education centers, special schools (hereinafter referred to collectively as educational facilities).

b) Universities, university-level institutions, and higher education institutions with other names, teacher training colleges, secondary teacher training colleges, college-level institutions with teacher training majors (hereinafter referred to collectively as training facilities).

c) Relevant agencies, organizations, and individuals.

Article 2. Interpretation of Terms

Specialized equipment in the field of education and training as defined in this Circular includes integrated equipment; single pieces of equipment; production lines; tools; teaching aids, toys; tables; chairs; blackboards; cabinets/shelves, racks, and other equipment (hereinafter referred to collectively as equipment) used for nurturing, caring, teaching, learning, training, experimentation, practical work, scientific research, and technology transfer in educational facilities and training facilities.

Article 3. Purpose of Guidelines on Equipment Standards and Quotas

1. To serve as a basis for educational facilities and training facilities to establish standards and quotas for the use of equipment.

2. To serve as a basis for educational facilities and training facilities to develop plans and budget forecasts; allocate, invest in, purchase, lease, and subcontract funds for the use of equipment; manage and use equipment.

Article 4. Standards and Quotas for the Use of Equipment in Educational Facilities

1. Equipment Standards

a) Equipment included in the list of teaching aids issued by the Ministry of Education and Training.

b) Equipment not included in the list of teaching aids as prescribed by the Ministry of Education and Training, including:

- Equipment and utensils for dining halls, kitchens, dormitories serving the nurturing and care of children and students;

- Equipment for examination and admission activities, assessment, and quality assurance;

- Computers, network connection devices, software supporting teaching, learning, and scientific research, audiovisual equipment, desks, chairs, blackboards, cabinets/shelves, racks installed in classrooms and functional rooms including meeting rooms, subject department activity rooms, art education rooms, science and technology rooms, computer rooms, foreign language rooms, subject-specific rooms, libraries, multi-purpose rooms, youth league activity rooms, tradition rooms, health rooms, inclusive education support rooms for disabled students, counseling rooms, and multipurpose halls;

- Sanitary equipment in student restrooms;

- Equipment for school health services;

- School sports equipment;

- Equipment for special schools;

- Other equipment for teaching and learning activities.

2. Equipment Quotas

To determine equipment quotas, educational facilities must base their calculations on the following principles:

a) For equipment included in the list of teaching aids issued by the Ministry of Education and Training:

Base the number of students, the number of classes, and the provisions in the list of teaching aids issued by the Ministry of Education and Training to ensure sufficient equipment for teaching and learning activities and child care in educational facilities.

b) For equipment not included in the list of teaching aids as prescribed by the Ministry of Education and Training, the following principles should be considered:

- Compatibility with curriculum content and educational activities;

- In line with the development orientation of the educational facility to achieve material and equipment standards at each stage;

- The number of students and the number of classes;

- Meeting the requirements for innovative teaching and learning methods;

- Actual usage needs;

- Conditions for installation, maintenance, and utilization of equipment.

Article 5. Standards and quotas for the use of equipment in training institutions

1. Equipment Standards

- Equipment in laboratories, practical rooms; workshops/practice camps/practice stations for practical, experimental activities;

- Equipment in libraries or information-library centers, technology chains serving education, scientific research, and technology transfer;

- Equipment for examination and admission activities, assessment, and quality assurance;

- Computers, network connection devices, software supporting teaching, learning, and scientific research; audio-visual equipment, desks, chairs, cabinets/shelves installed in classrooms, auditoriums, specialized activity rooms, lecture halls, medical stations, laboratories, practical rooms; workshops/practice camps/practice stations for practical, experimental activities, libraries or information-library centers;

- Air conditioning, dehumidification, thermal insulation, fire prevention and extinguishing, water and waste treatment systems in laboratories, practical rooms, scientific research rooms; workshops/practice camps/practice stations for practical, experimental activities;

- Other equipment serving educational activities, scientific research, technology transfer, and special tasks of training institutions.

2. Equipment Quotas:

To determine equipment quotas, training institutions must base on the following principles:

a) The scale of students and faculty converted according to the development orientation of the training institution.

b) Requirements and goals of the field of training, training programs; requirements and goals of scientific research linked to training and technology transfer; requirements and goals of tasks, projects, programs, research topics serving training.

c) The scale of students in each specialized training field.

d) Conditions regarding infrastructure for installing, preserving, and utilizing equipment.

Article 6. Implementation Organization

1. For Departments of Education and Training, Departments of Education and Science and Technology (collectively referred to as Departments of Education and Training):

a) Base on the provisions of this Circular to establish standards and quotas for the use of equipment for educational institutions and training institutions under their management.

b) Submit to the People's Committee of the province or centrally governed city for approval after obtaining the opinion of the Standing Committee of the People's Council at the same level, and issue or delegate authority to issue standards and quotas for the use of equipment for agencies, organizations, units under their management.

2. For training institutions:

a) Base on the provisions of this Circular to establish standards and quotas for the use of equipment for their units.

b) Submit to the competent authority for approval or delegation of authority to issue standards and quotas for the use of equipment for training institutions.

3. Educational institutions and training institutions that self-fund recurrent and capital expenditures shall establish and issue standards and quotas for the use of equipment for their units based on the provisions of this Circular.

4. Specialized equipment standards and quotas shall be publicly disclosed on the websites of Departments of Education and Training and training institutions.

Article 7. Transitional Provisions

1. For standards and quotas for the use of equipment in the field of education and training that have been issued or delegated authority to issue by competent authorities before the effective date of this Circular, if they comply with the provisions of this Circular, they shall continue to be implemented. In cases where they do not comply with the provisions of this Circular, a review shall be conducted and proposals made for amendments and supplements to ensure compliance.

2. For investment projects and equipment procurement plans approved by competent authorities in accordance with the law before the effective date of this Circular, they shall continue to be implemented.

Article 8. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from November 20, 2019.

2. The Director of the Office, the Director of the Infrastructure Department, Heads of units under the Ministry of Education and Training; Chairmen of Provincial People's Committees; Directors of Departments of Education and Training; Heads of training institutions and related organizations and individuals are responsible for implementing this Circular./.
