Announcing the waters of the seaports within the jurisdiction of Thai Binh province, Nam Dinh province, and the management area of Thai Binh Maritime Port Office.
The Minister of Transport issues this Circular to announce the waters of the seaports within the jurisdiction of Thai Binh province, Nam Dinh province, and the management area of Thai Binh Maritime Port Office.

Pursuant to the Vietnam Maritime Code on November 25, 2015;
Pursuant to Decree No.Decision No. 12/2017/NĐ-CPpursuant to Decision No. 58/2017/NĐ-CP dated February 10, 2017 of the Government detailing certain provisions of the Maritime Code of Vietnam on managing maritime activities;

Article 1. Announcing the waters of the seaports within the jurisdiction of Thai Binh province and Nam Dinh province.
Clause 1. The waters of the seaport of Thai Binh within the jurisdiction of Thai Binh province are the waters of the seaport located at the Diem Dien wharf area and the Trà Lý river mouth area.
Clause 2. The waters of the seaport of Nam Dinh within the jurisdiction of Nam Dinh province are the waters of the seaport located in the Ninh Co area.
Article 2. Scope of the waters of the seaports within the jurisdiction of Thai Binh province and Nam Dinh province.
Clause 1. The scope of the waters of the seaport within the jurisdiction of Thai Binh province, measured according to the highest tidal level, is defined as follows:
Point a) The seaward boundary is limited by straight lines connecting the following points in sequence: TB1, TB2, TB3, TB4, and TB5, with the following coordinates:

Clause 3. The boundaries of the waters of the Thai Binh seaport specified in this Circular are determined on Chart number VN 40009 issued by the Northern Marine Safety Assurance Corporation in 2015; the boundaries of the waters of the Nam Dinh seaport are determined on Chart number VN 50010 issued by the Northern Marine Safety Assurance Corporation in 2015. |

Article 3. Pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, storm shelters, and other related water areas.
The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Thai Binh seaport, Nam Dinh seaport, and other related water areas as prescribed.
The Director of the Vietnam Maritime Administration shall organize the announcement of the pilot transfer zone, quarantine zone, anchorage area, cargo transfer area, and typhoon shelter for vessels entering and leaving the Thai Binh Sea Port, the Nam Dinh Sea Port, and other water areas and zones as prescribed.
Article 4. Responsibilities of the Thai Binh Maritime Port Office
1. Perform tasks and exercise powers as prescribed by the Vietnam Maritime Code and related legal normative documents for maritime activities at seaports and port waters within the jurisdiction of Thai Binh Province and Nam Dinh Province.
2. Based on actual conditions regarding weather, waves, winds, draft, tonnage of vessels, and nature of cargo, designate specific positions for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid typhoons in accordance with regulations, ensuring maritime safety, maritime security, and prevention of environmental pollution.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Jurisdiction of Thai Binh and Nam Dinh Provinces
In addition to the water areas specified in Article 2 of this Circular, the Thai Binh Maritime Port Office also has state management responsibilities for maritime safety, maritime security, and prevention of environmental pollution in the sea area within the jurisdiction of Thai Binh Province and Nam Dinh Province.
Article 6. Effectiveness
1. This Circular takes effect from October 1, 2020.
2. Repeal Circular No. 07/2014/TT-BGTVT dated April 11, 2014 issued by the Minister of Transport on announcing the water areas of seaports within the jurisdiction of Thai Binh Province and the management area of the Thai Binh Maritime Port Office, and Circular No. 46/2018/TT-BGTVT dated August 20, 2018 issued by the Minister of Transport on announcing the water areas of seaports within the jurisdiction of Nam Dinh Province and the management area of the Nam Dinh Maritime Port Office.
