Regulations on Safety Technical Inspection and Environmental Protection for Motor Vehicles

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.
The Minister of Transport shall issue a Circular to regulate safety technical inspection and environmental protection for motor vehicles.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular regulates safety technical inspection and environmental protection for automobiles; semi-trailers and tractor-trailers pulled by automobiles (hereinafter referred to collectively as motor vehicles).
2. This Circular does not apply to motor vehicles of the military and police used for national defense and security purposes.
Article 2. Applicability
This Circular applies to organizations and individuals involved in safety technical inspection and environmental protection activities (hereinafter abbreviated as STI and EP) for motor vehicles.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Safety Technical Inspection and Environmental Protection for Motor Vehicles (hereinafter referred to as inspection) is the process of initial and periodic examination and evaluation of the safety technical condition and environmental protection status of motor vehicles according to standards, regulations, and provisions.
2. Certificate of Safety Technical Inspection and Environmental Protection for Motor Vehicles (hereinafter referred to as the Inspection Certificate) is a certificate confirming that a motor vehicle has been inspected and meets the quality standards, regulations, and provisions regarding safety technical conditions and environmental protection.
3. Safety Technical Inspection and Environmental Protection Label for Motor Vehicles (hereinafter referred to as the Inspection Label) is a sticker issued to motor vehicles that have received the Inspection Certificate and are permitted to operate on public roads within the territory of the Socialist Republic of Vietnam and other countries with which Vietnam has signed mutual recognition agreements regarding the Inspection Certificate.
4. Original Motor Vehicle is a motor vehicle without changes in its structure, appearance, layout, working principle, specifications, and technical characteristics compared to the manufacturer's design.
5. Vehicle Registration Form is a record of administrative information and technical specifications of original motor vehicles and updates on changes throughout their usage period.
6. is the confirmation document of the results of the technical safety inspection and environmental protection of each motor vehicle during the inspection. Inspection Report
7. is a record of the results of each inspection and photographs of the motor vehicle during each inspection. Inspection Stamp

11. 2. Amending and supplementing Point a, Clause 1, Article 6 of Circular No. 16/2021/TT-BGTVT (amended and supplemented by Clause 2, Article 1 of Circular No. 02/2023/TT-BGTVT) as follows: includes the owner of the motor vehicle, driver, or person bringing the motor vehicle for inspection.
12. Technical Documentation consists of manufacturer's documents, certificates from authorized agencies, technical specification manuals, technical standards, or other technical publications that have been published and have clear origins.
Article 4. Prohibited Actions During Motor Vehicle Inspections
1. Conducting inspections that are incomplete, not following procedures and regulations, conducting inspections outside the designated inspection line, outside the specified unit; falsifying inspection results.
2. Conducting inspections when testing equipment is damaged; conducting inspections when testing equipment has not been tested, evaluated, or calibrated.
3. Conducting inspections when network connection for data transmission and inspection results is not ensured; conducting inspections when the surveillance and video storage system does not meet regulations.
4. Arranging personnel to perform inspection tasks on the inspection line insufficiently or not in accordance with regulations.
5. Requiring vehicle owners to take their vehicles to designated repair and maintenance facilities for repairs and maintenance.
6. Collecting inspection fees, charges, and levies contrary to regulations; engaging in corrupt practices or harassment.
7. Conducting inspections and issuing Inspection Certificates for motor vehicles beyond their service life.
8. Preparing Vehicle Files, conducting inspections, using inspection stamps, printing Inspection Certificates and Inspection Labels, and reporting inspection results contrary to regulations.
Chapter II
MOTOR VEHICLE INSPECTION
Article 5. Location for Inspection
1. The establishment of Vehicle Files and inspection (including when supplementing or modifying Vehicle Files) for motor vehicles shall be carried out at any inspection unit throughout the country.
2. Motor vehicles must be inspected on the inspection assembly line. In cases where oversized or overloaded motor vehicles cannot enter the inspection assembly line, they may be tested for operational performance and braking efficiency on test tracks outside the assembly line. For motor vehicles operating in island areas without roads to reach inspection units; motor vehicles operating in areas ensuring safety, security, and national defense that do not have conditions to bring the vehicle to inspection units; motor vehicles performing urgent tasks (natural disaster prevention, disease control), inspections may be conducted outside inspection units in accordance with Clause 3, Article 8 of this Circular.
Article 6. Necessary Documents for Establishing Vehicle Files and Inspection
1. Establishing Vehicle Files
The establishment of Vehicle Files shall be carried out when motor vehicles undergo their first inspection to participate in traffic (in cases where the first inspection is for issuing a Certificate of Inspection and Inspection Label with a validity period of 15 days, there is no need to establish a Vehicle File). When bringing motor vehicles to inspection units for inspection and establishing Vehicle Files, the vehicle owners need to present and submit the following documents:
a) Present: vehicle registration documents (original Registration Certificate issued by competent state authorities or Receipt for retaining the original certificate of ownership of the means of transport currently under mortgage by financial institutions) or Notice of Issuance of Registration Certificate;
b) Submit a copy of the Quality Inspection Report upon factory release for domestically produced and assembled motor vehicles (except for motor vehicles for liquidation);
c) Submit the original Certificate of Technical Quality and Environmental Protection for newly refurbished motor vehicles.
2. Inspection
When bringing motor vehicles to inspection units for inspection, the vehicle owners need to present and submit the following documents and provide the following information:
a) The documents mentioned in points a and c of Clause 1 of this Article;
b) Information about login name, password, and website address for managing the driving recorder and camera for motor vehicles required to install driving recorders and cameras;
c) Declaration of transportation business on the Follow-up Record Sheet according to the model attached as Appendix I to this Circular.
Article 7. Conducting Inspection and Evaluation of Motor Vehicles
1. The contents of inspection, inspection methods, and defects of motor vehicles during inspection are stipulated in Table 1 of Appendix II attached to this Circular.
2. Defects of motor vehicles during inspection are classified into three levels as follows:
a) Minor Defects (MINOR DEFECTS - MiD) are defects that do not cause loss of technical safety or environmental pollution when motor vehicles participate in traffic. Motor vehicles will still be issued a Certificate of Inspection;
b) Major Defects (MAJOR DEFECTS - MaD) are defects that may cause loss of technical safety or environmental pollution when motor vehicles participate in traffic. Motor vehicles will not be issued a Certificate of Inspection and must be repaired and re-inspected;
c) Dangerous Defects (DANGEROUS DEFECTS - DD) are defects that directly and immediately endanger motor vehicles when participating in traffic. Motor vehicles will not be issued a Certificate of Inspection, will not be allowed to participate in traffic, and must be repaired and re-inspected.
3. Motor vehicles with defects at different levels will be evaluated based on the highest level of defect among them.
4. Motor vehicles with multiple defects at the same level will be evaluated at the next higher level if the combination of defects poses greater danger to the motor vehicles.
5. Motor vehicles that are reinspected on the same day at the same inspection unit only require reinspection of defective items. Specifically, for brake system and steering system items, if any item does not meet the standard, the entire brake system and steering system must be rechecked. If reinspection is conducted on another day or at another unit, all items must be reinspected.
6. The inspection and evaluation of technical safety and environmental protection of motor vehicles must be carried out by inspectors; each motor vehicle can be assigned one or more inspectors. The inspection and evaluation of technical safety and environmental protection of motor vehicles are divided into five stages, the inspection contents of each stage are specified in Table 2 of Appendix II attached to this Circular, which includes five stages.
a) Stage 1: identification and general inspection;
b) Stage 2: upper part inspection;
c) Stage 3: braking efficiency and lateral skid inspection;
d) Stage 4: environmental inspection;
e) Stage 5: lower part inspection.
7. Motor vehicles undergoing inspection must be photographed at the inspection unit, specifically as follows.
a) Take overall photos of the vehicle and license plate photos of motor vehicles to print on the Inspection Report: Photos showing the overall view of the vehicle and its license plate, with the vehicle occupying approximately 75% of the photo area.
b) Take photos of motor vehicles to print on the Certificate of Inspection: Photos taken from a diagonal angle of about 45 degrees from the right rear side of the vehicle, showing the overall view of the vehicle and its license plate, with the vehicle occupying approximately 75% of the photo area.
c) Take photos of the luggage compartment (cargo hold); take photos of the passenger compartment from the front and rear of the vehicle for passenger cars with over nine seats including the driver.
d) Clear photos (minimum resolution of 1280 x 720) showing the full date and time of the photo taken, including the day, month, year, hour, and minute.
8. Inspectors drive the vehicle themselves during inspection. In cases involving vehicle combinations (tractor and semi-trailer; integral body and trailer), passenger cars with over thirty seats, if unable to drive the vehicle, inspectors may request the vehicle owner to operate the vehicle.
Article 8. Procedure and manner of implementation
1. Establishing Vehicle Files
a) The inspection unit receives the file, checks the documents in accordance with Clause 1 of Article 6 of this Circular, reviews the file contents according to Appendix III issued together with this Circular; if incomplete, guide the vehicle owner to complete it.
b) The inspection unit prints out the technical specifications of the vehicle from the production and assembly, import database of the Vietnam Registration Agency; inspects the motor vehicle and compares it with the documents and printed technical specifications. In cases where the motor vehicle for disposal or carrying diplomatic license plates is not in the production and assembly, import, and inspection databases of the Vietnam Registration Agency, the unit shall implement according to Section 3 of Appendix IV issued together with this Circular.
c) If the inspection and comparison results meet the requirements, enter the technical specifications and administrative information of the motor vehicle into the management program; the method of implementation follows Appendix IV issued together with this Circular; print out the Vehicle File Establishment Form according to the model specified in Appendix V issued together with this Circular; if not meeting the requirements, notify the vehicle owner to rectify and complete it.
d) Take two overall photos clearly showing the license plate of the motor vehicle for storage (photos at a 45-degree angle from the front side and the rear opposite side, with the time of taking the photo shown on the image); take two photos (one from the front and one from the rear) of the underside of the motor vehicle for storage in cases of passenger vehicles up to nine seats.
2. Inspection at the inspection unit
Organizations and individuals bring the motor vehicle and documents as stipulated in Clause 2 of Article 6 of this Circular to the inspection unit for inspection. The inspection unit receives the documents and conducts inspections according to the procedures specified in Appendix III issued together with this Circular:
a) Receive, check, search for warnings, compare the file with data in the Management Program, if incomplete, guide the vehicle owner to complete it; if complete, register for inspection, conduct inspection, assess the safety and environmental protection status of the motor vehicle, and print out the Inspection Report according to the model specified in Appendix VI issued together with this Circular;
b) For motor vehicles that pass the inspection, the inspection unit issues the Certificate of Inspection and affixes the Inspection Label on the vehicle. For motor vehicles only having a Notice of Vehicle Registration Appointment, the issuing unit provides the Certificate of Inspection to the vehicle owner according to the model specified in Appendix VII issued together with this Circular; when the vehicle owner presents the registration documents, the inspection unit photocopies them for storage in the Vehicle File, inspection file, and returns the Certificate of Inspection. In cases where the motor vehicle has an unsatisfactory inspection notice on the Vietnam Registration Agency's online portal, the inspection unit deletes the notice;
c) For motor vehicles that have defects or damage during inspection, the inspection unit prints and sends the Defect and Damage Notification Report according to the model specified in Appendix VIII issued together with this Circular to the vehicle owner for repair and rectification. In cases where the inspection is unsatisfactory and the Certificate of Inspection is not issued, the inspection unit must enter the unsatisfactory content into the non-compliance warning section on the Vietnam Registration Agency's online portal.
3. Inspection outside the inspection unit
a) The vehicle owner submits a written request according to the model in Appendix IX issued together with this Circular, clearly stating the reasons, inspection location outside the inspection unit, and a list of motor vehicles for inspection, directly or through postal services or other appropriate methods to the inspection unit.
b) The inspection unit examines and considers the request of the vehicle owner; if it meets the criteria as stipulated in Clause 2 of Article 5 of this Circular and has suitable testing conditions, within three working days from receiving the request, the inspection unit will notify the vehicle owner about the inspection time. If the testing conditions are not met, the inspection unit will notify the vehicle owner and specify the reasons.
c) The vehicle owner brings the vehicle to the inspection location, the inspection unit proceeds with the inspection of the motor vehicle according to the procedures and methods specified in Clause 2 of this Article.
4. Supplementing and amending the Vehicle File when there is a change in information on the vehicle registration documents.
a) The vehicle owner brings the documents as stipulated in Point a of Clause 1 of Article 6 of this Circular to the inspection unit to record the changes.
b) The inspection unit checks the documents: if complete, records the changes in the Vehicle File and the management program; if incomplete, immediately guides the vehicle owner to complete it. In cases where the inspection unit does not manage the Vehicle File, it must send a copy of the vehicle registration documents stamped by the unit to the inspection unit managing the Vehicle File for updating and storing in the Vehicle File.
5. Supplementing and amending the Vehicle File when there is a change in technical specifications.
a) The vehicle owner brings the motor vehicle along with the documents as stipulated in Points a and c of Clause 1 of Article 6 of this Circular and related technical documents to the inspection unit for inspection and recording the changes.
b) The inspection unit checks the documents and compares them with the management program: if incomplete, guides the vehicle owner to complete it; if complete, conducts inspection, takes photos, and supplements and amends the Vehicle File and the management program. In cases where the inspection unit conducting the inspection is not the unit managing the Vehicle File, the inspection unit must send the Certificate of Quality Safety Technical and Environmental Protection of the modified motor vehicle, related technical documents, and a copy of the Inspection Certificate to the unit managing the Vehicle File for updating and storing in the Vehicle File.
6. Procedures for supplementing the Vehicle File in certain cases
a) For scrap motor vehicles not having information in the production, assembly, import, inspection database, they must be brought to the inspection unit for inspection, and if the inspection results meet the requirements, the unit shall establish the Vehicle Record, issue a Certificate of Inspection to the vehicle owner according to the model prescribed in Appendix VII attached to this Circular, affix the Inspection Label on the vehicle, and simultaneously verify the conformity of the scrap motor vehicle based on the registration database or the registration authority. In case the verification content does not match the actual vehicle, the inspection unit shall notify the vehicle owner, cancel the established Vehicle Record, recall the issued Inspection Label, and warn on the electronic portal of the Vietnam Registration Agency; in case the verification content matches the actual vehicle, the inspection unit shall notify and return the Certificate of Inspection to the vehicle owner.
b) For vehicles of organizations permitted for temporary import and re-export: after establishing the Vehicle Record, the inspection units shall conduct inspections, issue Certificates of Inspection and Inspection Labels with a validity period not exceeding the date on the Vehicle Registration Certificate, and simultaneously send the vehicle information to the Vietnam Registration Agency to implement warnings on the Inspection Management Program. Motor vehicle inspection units must conduct initial inspections for temporarily imported and re-exported vehicles after they have been transferred to agencies, organizations, or individuals in Vietnam, and verify the conformity based on the registration database or the registration authority, and follow the provisions at point a, Clause 6, Article 9 of this Decree.
Chapter III
RECORDS, SEALS AND REPORTS ON INSPECTION WORK
Article 9. Certificate of Inspection, Inspection Label
1. Motor vehicles that pass the inspection requirements shall be issued a Certificate of Inspection and an Inspection Label according to the model prescribed in Appendix X attached to this Circular.
a) The Certificate of Inspection and Inspection Label issued to motor vehicles must have the same serial number, printed from the inspection management program on the uniform blank provided by the Vietnam Registration Agency, consistent with the Vehicle Record and data on the inspection management program. For motor vehicles declared by the owner as being engaged in commercial transportation, a Certificate of Inspection and an Inspection Label for motor vehicles engaged in commercial transportation shall be issued; for motor vehicles declared by the owner as not being engaged in commercial transportation, a Certificate of Inspection and an Inspection Label for non-commercial transportation shall be issued.
b) Motor vehicles that are not allowed to participate in road traffic shall only be issued a Certificate of Inspection and not an Inspection Label.
c) For motor vehicles with a Certificate of Quality of Safety and Environmental Protection for Imported Motor Vehicles or a Certificate of Quality of Safety and Environmental Protection for Domestic Production and Assembly indicating operation within a limited area and oversized and overweight vehicles as stipulated in Circular No. 46/2015/TT-BGTVT, only a Certificate of Inspection shall be issued without an Inspection Label, and the Certificate of Inspection shall include the statement: "Permission from the road management agency must be obtained when participating in traffic."
2. The validity period of the Certificate of Inspection and Inspection Label issued according to the inspection cycle specified in Appendix XI attached to this Circular shall not exceed the expiration date of the Vehicle Registration Certificate (if applicable) or the service life of the motor vehicle.
3. Motor vehicles shall be issued a Certificate of Inspection and Inspection Label with a validity period of 15 days when passing the inspection requirements in the following cases:
a) Motor vehicles warned on the Inspection Management Program according to Clause 12, Article 80 of Decree No. 100/2019/NĐ-CP.
b) Motor vehicles undergoing regional transfer record completion; motor vehicles already issued a Certificate of Quality of Safety and Environmental Protection for Modified Motor Vehicles; newly produced and assembled motor vehicles with a Factory Test Report; imported motor vehicles with a Certificate of Quality of Safety and Environmental Protection for Imported Motor Vehicles; exported motor vehicles with a Certificate of Quality of Safety and Environmental Protection for Domestic Production and Assembly (in case there is no such certificate, documentation from the manufacturer must be provided), which require participation in traffic to move to a designated location (inspection does not require submission of the documents stipulated in Article 6 of this Circular).
c) Motor vehicles requiring movement for research and testing before quality certification in production and assembly. In this case, the vehicle owner does not need to present the documents stipulated in Article 6 of this Circular during inspection but must provide the following documents: design records; proof that the vehicle has been tested internally in the factory for at least 3000 kilometers; a commitment letter from the manufacturer regarding responsibility for technical safety and environmental protection during movement for research and testing, including the scope, route, and duration of operation; a technical specification declaration accompanying the manufacturer's quality production and assembly inspection report, and the note section of the issued Certificate of Inspection must state: "The owner must operate within the specified scope, route, and duration and bear responsibility for ensuring safety during movement."
4. The Certificate of Inspection shall be handed over to the vehicle owner to carry while participating in traffic, and the Inspection Label shall be affixed in the upper right corner, inside the front windshield of the automobile; for trailers and semi-trailers, the Inspection Label shall be affixed to the chassis near the license plate installation position, covered with a clear protective layer externally.
5. If the Certificate of Inspection or Inspection Label is lost or damaged, the vehicle owner must bring the vehicle for re-inspection to obtain a new Certificate of Inspection and Inspection Label.
6. When detecting that the documents provided by the vehicle owner have been falsified or altered; when the Certificate of Inspection and Inspection Label issued do not match the inspected motor vehicle, the inspection unit shall be responsible for recalling the Certificate of Inspection and Inspection Label issued to the motor vehicle (if still valid) and report to the Vietnam Motor Vehicle Inspection Agency.
7. The Certificate of Inspection and Inspection Label become invalid in the following cases:
a) A new Certificate of Inspection and Inspection Label has been issued for the motor vehicle;
b) The vehicle owner has reported the loss to the inspection unit;
c) There is a notice of recall from the inspection units;
d) The motor vehicle has been involved in an accident to the extent that it does not meet technical safety standards and environmental protection requirements;
đ) There is confirmation from the inspection unit regarding the inconsistency between the technical specifications on the Certificate of Inspection and the actual technical specifications of the motor vehicle.
Article 10. Issuance of Inspection Seals
1. The inspection unit shall establish and send the application form for providing inspection seals (directly or through postal service or email) according to the model prescribed in Appendix XII attached to this Circular to the Vietnam Motor Vehicle Inspection Agency from the 15th to the 20th of the last month of each quarter.
2. The Vietnam Motor Vehicle Inspection Agency shall issue inspection seals through postal service or directly provide them to the corresponding inspection units based on their needs from the 23rd to the 30th of the last month of each quarter.
3. In case of supplementary issuance request, the inspection unit shall establish and send the application form for providing supplementary inspection seals (directly or through postal service or email) according to the model prescribed in Appendix XII attached to this Circular to the Vietnam Motor Vehicle Inspection Agency. The Vietnam Motor Vehicle Inspection Agency shall issue inspection seals through postal service or directly provide them to the inspection unit within 15 days from the date of receipt of the application form for providing supplementary inspection seals.
Article 11. Reporting on Inspection Work
1. Report on the results of inspection work and usage of inspection seals:
a) Name of the report: report on the results of inspection work and usage of inspection seals;
b) Content required in the report: number of vehicles inspected including those inspected outside the unit (if any), number of seals used, number of seals remaining;
c) Entity responsible for the report: inspection units;
d) Receiving authority: Vietnam Motor Vehicle Inspection Agency for reports on the results of inspection work, usage of inspection seals, and inventory reports of inspection seals; local Department of Transportation for reports on the results of inspection work;
đ) Method of sending and receiving reports: direct submission or through postal service or electronic mail system;
e) Deadline for submitting reports: before the 20th of each month;
g) Frequency of reporting: monthly reports;
h) Time period for finalizing report data: from the 15th of the previous month to the 14th of the month covered by the report;
i) Format of the report data: according to Appendix XIII attached to this Circular.
2. Report on the list of vehicles exceeding their service life, report on the list of vehicles approaching the end of their service life:
a) Name of the report: report on the list of vehicles exceeding their service life, report on the list of vehicles approaching the end of their service life;
b) Content required in the report: number of vehicles exceeding their service life and number of vehicles approaching the end of their service life;
c) Entity responsible for the report: inspection units;
d) Receiving authority: Vietnam Motor Vehicle Inspection Authority, local Department of Transport;
đ) Method of sending and receiving reports: direct submission or through postal service or electronic mail system;
e) Deadline for submitting reports: before January 20th each year for vehicles exceeding their service life and before August 20th each year for vehicles approaching the end of their service life;
g) Frequency of reporting: annual;
h) Time period for finalizing report data: number of vehicles exceeding their service life from January 1st of the reporting year and number of vehicles approaching the end of their service life from January 1st of the following year;
i) Format of the report data: according to Appendix XIV attached to this Circular.
3. Ad hoc reports as requested by authorized agencies.
Article 12. Storage of inspection files and data
The inspection units must manage and store vehicle files, inspection files, and inspection data. Stored files must be complete, well-preserved, easy to track, and easy to review.
1. Vehicle files shall be stored and organized separately according to the management file number sequence. The vehicle file includes:
a) The form for establishing the vehicle file;
b) Documents specified in point b, Clause 1, Article 6 of this Circular;
c) Certificates of quality for road safety and environmental protection for modified motor vehicles (for modified motor vehicles);
d) Printed images of the overall view of motor vehicles as prescribed in point d, Clause 1, Article 8 of this Circular (including when modified motor vehicles change technical parameters or general layout);
đ) A copy of the Certificate of Inspection issued after the establishment of the vehicle file or due to changes in technical parameters;
e) A copy of the registration documents when the vehicle undergoes its first inspection after the establishment of the vehicle file or after changing the registration certificate;
g) Documents related to the supplementation and modification of administrative information and technical parameters during the use of motor vehicles (if applicable);
h) Documents related to verifying compliance based on the vehicle registration database or the registration authority as required for motor vehicles that need verification.
2. Each motor vehicle's inspection file shall be organized separately according to the tracking form number sequence and stored daily with a copy of the daily task assignment form and printed reports of the inspection work results. The inspection file includes:
a) The tracking form, inspection forms; in cases of re-inspection on the same working day, the inspection forms shall be stored in the same inspection file;
b) Copies of documents: registration documents, Inspection Certificate, new Inspection Stickers for motor vehicles. In cases where no Inspection Sticker is issued, retain the blank Inspection Sticker;
c) Documents related to the supplementation and modification of vehicle files not managed by the unit;
d) Printed results of monitoring equipment checks, surveillance cameras through electronic information pages;
đ) Printed images of the cargo compartment (cargo hold); images of the passenger compartment from the front and rear of the vehicle for passenger cars over nine seats including the driver.
3. Establish management registers and seals to monitor storage, reporting, including:
a) Register for issuing Inspection Certificates and Stickers according to the model at Appendix XV attached to this Circular;
b) Register for amending the form for establishing vehicle files according to the model at Appendix XVI attached to this Circular;
c) Task assignment register for inspections according to the model at Appendix XVII attached to this Circular;
d) Management register for the form for establishing vehicle files according to the model at Appendix XVIII attached to this Circular.
4. Inspection data shall be stored at the inspection unit and in the management program database at the Vietnam Registration Bureau.
5. Damaged seals shall be stored by type, in serial number order, and stored monthly, with the reason for damage clearly marked on the seal for cancellation upon guidance from the Vietnam Registration Bureau.
6. Time and location of storage
a) Vehicle files and management issuance registers during the establishment of vehicle files: stored at the inspection unit establishing the vehicle files throughout the vehicle's usage period. For vehicles past their service life, destroy after three years (36 months) from the date the vehicle reaches the end of its service life.
b) Inspection files and management issuance registers during the inspection process; photographs taken when the vehicle enters for inspection: stored at the inspection unit conducting the inspection and destroyed after three years (36 months) from the inspection date.
c) Vehicles entering for inspection must be recorded on the inspection line and stored at the inspection unit. Video recordings of the IP camera monitoring the inspection process on the line must be stored at the inspection unit for a minimum of 30 working days from the inspection date.
d) Photographs taken when the vehicle enters for inspection as prescribed in Clause 7, Article 7 of this Circular must be stored in .JPEG format according to the inspection date for a period of three years (36 months) from the inspection date.
Chapter IV
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 13. Responsibilities of the Vehicle Owner
In addition to implementing the contents stipulated in this Circular, the vehicle owner shall also be responsible for complying with the following regulations:
1. Bear responsibility for maintaining the technical safety condition and environmental protection of the vehicle according to the prescribed standards during its operation on public roads between two inspection periods.
2. Shall not rent or borrow complete assemblies or parts of motor vehicles for the purpose of evading requirements during inspections; forge, erase, or alter the contents of the Inspection Certificate and Inspection Label.
3. Bear responsibility for providing accurate information related to the inspection content, administrative information, and technical specifications of motor vehicles, including providing relevant files and documents to inspection units.
4. Safeguard the Inspection Certificate and Inspection Label.
5. Return the Inspection Certificate and Inspection Label upon notification of recall from the inspection unit.
Article 14. Responsibilities of the Vietnam Motor Vehicle Inspection Agency
1. Organize and guide professional activities related to motor vehicle inspections in accordance with the provisions of this Circular.
2. Develop, manage, and guide the uniform use of the inspection management program and inspection database nationwide; receive and manage inspection data of motor vehicles from inspection units.
3. Regularly, periodically, and randomly inspect and supervise the inspection activities of inspection units. Handle violations of inspectors, technical staff, and motor vehicle inspection units according to regulations, and simultaneously issue written notifications of violation handling results to local Departments of Transport.
4. Issue warnings and remove warnings on the inspection management program for motor vehicles that have inconsistencies in administrative information, technical specifications, and other cases as specified in Clause 12, Article 80 of Decree No. 100/2019/NĐ-CP dated December 20, 2019 of the Government.
5. Print, manage, distribute, and guide the use of various seals and certificates of inspection; guide the cancellation of damaged seals that are no longer usable.
Article 15. Responsibilities of the Department of Transport
1. Conduct inspections and checks on motor vehicle inspection activities within their jurisdiction.
2. Provide and exchange information and data related to motor vehicle inspection work.
3. Handle violations in the registration inspection work against leaders, inspectors, and technical staff within their authority.
4. Coordinate with the Vietnam Motor Vehicle Inspection Agency to implement state management over motor vehicle inspection work and perform other tasks within their authority in the local area.
Article 16. Responsibilities of Motor Vehicle Inspection Units
1. Carry out inspections and issue Inspection Certificates for motor vehicles according to regulations. Leaders of inspection units, supervisors, inspectors, and technical staff must bear responsibility for the inspection results.
2. Publicize procedures, formalities, contents, processes, standards, regulations, fees, and working hours.
3. Implement storage and reporting systems as prescribed.
4. Maintain confidentiality of login accounts to the Vietnam Motor Vehicle Inspection Agency's electronic portal and update warning data from the Vietnam Motor Vehicle Inspection Agency's network database as prescribed.
5. Transmit inspection result data and road usage fee collection data to the Vietnam Motor Vehicle Inspection Agency's inspection management program database at least twice daily in compressed file format, retaining the original file name from the inspection management program in the unit's directory on the Vietnam Motor Vehicle Inspection Agency server.
6. Comply with inspection, supervision, and oversight activities conducted by competent authorities. Report to the Vietnam Motor Vehicle Inspection Agency and the Department of Transport on the implementation of inspection and check conclusions.
7. Manage and distribute various seals and certificates of inspection in accordance with regulations; cancel damaged seals according to the guidance of the Vietnam Motor Vehicle Inspection Agency.
8. Inspect, maintain, and repair equipment and tools for inspection to ensure accuracy and operational status as prescribed, recording all details in the Equipment Management Logbook as specified in Appendix XIX of this Circular. Report to the Vietnam Motor Vehicle Inspection Agency and the local Department of Transport when inspection equipment or lines cease operations.
9. Use inspection management software and device control software as officially announced by the Vietnam Motor Vehicle Inspection Agency.
10. Manage and supervise inspection activities within the unit.
11. Accept inspection registrations (via telephone or website) for motor vehicles when requested by the vehicle owner.
12. Develop annual and long-term training plans for inspectors and technical staff within the unit to ensure and improve motor vehicle inspection skills.
13. Accurately provide information related to the vehicle during the inspection process to other inspection units when required.
14. Be responsible for sending and updating relevant documents concerning changes in administrative information and technical specifications of motor vehicles as stipulated in Clause 4 and Clause 5, Article 8 of this Circular.
15. Continuously educate staff, inspectors, and technical personnel on professional ethics to prevent corruption in inspection activities; remind vehicle owners not to leave money or valuable items on the vehicle during inspections.
16. Inventory and confirm the Seal Distribution Form and send it to the Vietnam Motor Vehicle Inspection Agency within ten working days from the date of receipt of the inspection seal from the Vietnam Motor Vehicle Inspection Agency.
17. Verify the consistency based on vehicle registration databases or registration agencies for decommissioned motor vehicles.
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Effective Date
1. This Circular takes effect from October 1, 2021, replacing Circular No. 70/2015/TT-BGTVT dated November 9, 2015, issued by the Minister of Transport regarding the inspection of technical safety and environmental protection of motor vehicles.
2. The Inspection Certificates and Inspection Labels issued by inspection units to motor vehicles before the effective date of this Circular remain valid until their expiration date.
3. In cases where referenced documents in this Circular are newly issued or amended, they will be applied according to the new or amended documents.
Article 18. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Administration, the Director of the Vietnam Vehicle Inspection Agency, the Directors of Provincial Department of Transport under centrally governed cities and provinces, the heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
