CIRCULAR
Issuing the List of Insecticides and Disinfectants Used in Household and Medical Fields with HS Codes Determined According to the Export and Import Goods List of Vietnam
Pursuant to the Law on Customs No. 54/2014/QH13 dated June 23, 2014;
Pursuant to the Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;
Pursuant to the Decree No. 59/2018/NĐ-CP dated April 20, 2018 of the Government amending and supplementing certain articles of the Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;
Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to the Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government regulating the management of chemicals, insecticides, and disinfectants used in household and medical fields;
At the proposal of the Director of the Department of Environmental Health Management;
The Minister of Health issues this Circular issuing the List of Insecticides and Disinfectants Used in Household and Medical Fields with HS Codes Determined According to the Export and Import Goods List of Vietnam.
Article 1. Scope of Regulation
This Circular issues the List and principles for applying the List of Insecticides and Disinfectants Used in Household and Medical Fields with HS Codes Determined According to the Export and Import Goods List of Vietnam.
Article 2. Issuing the List
Attached to this Circular is the List of Insecticides and Disinfectants Used in Household and Medical Fields with HS Codes Determined According to the Export and Import Goods List of Vietnam issued together with Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Minister of Finance on the issuance of the Export and Import Goods List of Vietnam.
Article 3. Principles for Applying the List
Clause 1. Goods listed in the attached List shall be managed in accordance with the provisions of the Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government on the management of chemicals, insecticides, and disinfectants used in household and medical fields.
Clause 2. In cases where there are discrepancies or inconsistencies in classification and determination of HS codes for goods included in the Lists attached to this Circular, the determination of HS codes shall be carried out in accordance with the laws on customs.
Clause 3. For insecticides and disinfectants used in household and medical fields that are not listed and have not been assigned HS codes in the attached List, the determination of HS codes shall be carried out in accordance with the laws on customs. After clearance, organizations and individuals exporting and importing such products shall submit written documents to the Ministry of Health (Department of Environmental Health Management) for the purpose of coordinating with the Ministry of Finance to review, unify, update, and issue supplementary Lists.
Article 4. Reference Provisions
In case the regulatory legal documents and provisions cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulatory legal documents.
Article 5. Effective Date
Clause 1. This Circular takes effect from November 15, 2024.
Clause 2. Circular No. 09/2018/TT-BYT dated April 27, 2018 of the Minister of Health on the List of Chemicals and Insecticides, Disinfectants Used in Household and Medical Fields under the Management of the Ministry of Health with HS Codes Determined According to the Export and Import Goods List of Vietnam ceases to be effective from the date this Circular takes effect.
Article 6. Responsibility for Implementation
The Director of the Department of Environmental Health Management, Heads of units under and affiliated to the Ministry of Health; Provincial Departments of Health under centrally governed cities and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Health (Department of Environmental Health Management) for consideration and resolution.
