CIRCULAR
when violating management and operation of detailing certain provisions of the Urban and Rural Planning Law

Pursuant to the Urban and Rural Planning Law No. 47/2024/QH15 dated November 26, 2024;
Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government qstipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Article 1. Amending and supplementing certain Articles of Circular No. 16/2025/TT-BXD
The Minister of Construction issues this Circular detailing certain provisions of the Urban and Rural Planning Law.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular details Clause 4 Article 16, Clause 2 Article 22, Clause 3 Article 23, Clause 3 Article 24, Clause 4 Article 27, Clause 3 Article 29, Clause 2 Article 31, Clause 2 Article 34, Clause 3 Article 35, Clause 5 Article 40, Point a Clause 2 and Clause 3 Article 47, Clause 4 and 6 Article 52 of the Urban and Rural Planning Law.
2. All organizations and individuals, both domestic and foreign, when preparing or participating in preparing planning assignment files, urban and rural planning files on the territory of Vietnam must comply with the provisions of this Circular.
Article 2. General provisions on the components of planning assignment files, urban and rural planning files
1. The approved planning assignment file, urban and rural planning file is a paper file stamped and confirmed by the competent authority.
b) Legal digital data comprising scanned or digitally certified files from paper-based documents, fully complying with the components specified in Chapters II and III of this Circular;
a) Basic digital data consists of drawing and text files printed as part of the paper file containing all contents prescribed in Chapters II and III of this Circular, excluding related documents and materials;
b) Legal digital data includes digitized, scanned (scan) files from the paper file or electronic certified files, fully comprising the components as prescribed in Chapters II and III of this Circular;
đ) Technical principles and requirements for electronic urban and rural planning documents shall be implemented according to the provisions of Chapter V of this Circular.
d) The urban and rural planning electronic file must be developed simultaneously during the preparation, review, and approval of the planning assignment file, urban and rural planning file, ensuring compliance with requirements for managing, exploiting, and using urban and rural planning data;
a) Community opinion solicitation documents include summary reports and drawings as required by the planning task, meeting the criteria set forth in the planning task;
b) Opinion solicitation documents for agencies and organizations include paper-based documents (explanatory notes, appropriate scale drawings, relevant legal documents) and electronic documents as specified in points a and b of Clause 2 of this Article.
4. Review submission documents
a) A request for review of the planning task and plan;
b) Paper-based documents reflecting the content and components of the planning task and plan as prescribed in Chapters II and III of this Circular;
c) Electronic documents as prescribed in Clause 2 of this Article.
5. Approval submission documents
a) A request for approval of the planning task and plan;
4. Files for submission for approval.
c) A report on the review of the planning task and plan;
d) Electronic documents as prescribed in Clause 2 of this Article.
6. Regulations on stamping approved or accepted urban and rural planning documents.
a) After the competent authority issues a decision approving or accepting the urban and rural planning, the organization responsible for preparing the planning completes the documents according to the approval or acceptance decision, submits them to the review authority for stamping according to the model specified in the Appendix of this Circular.
5. Provisions on stamping and confirming approved urban and rural planning files.
a) After the urban and rural planning has been issued with an approval decision by the competent authority, the organization responsible for preparing the planning completes the file according to the Approval Decision, submits the file to the planning review agency for stamping and confirmation according to the model prescribed in the Appendix of this Circular.
7. Drafting review requests, review result reports, approval requests, and approval decisions for planning tasks and plans.
a) Follow models 01 to 08 in Appendix III attached and supplemented by this Circular.
Article 3. General provisions on the presentation format of planning assignment files, urban and rural planning files
1. The content of the explanatory notes and drawings in the planning assignment files, urban and rural planning files for soliciting opinions, for review and approval must be clearly presented, fully covering the content for each type and level of planning, and complying with the provisions of Chapters II and III and the appendices of this Circular.
2. The system of drawing symbols for planning assignments and urban and rural planning must comply with the provisions set out in the appendices attached to this Circular.
3. Based on the conditions and characteristics of the planning area, separate maps and diagrams may be established for each current status content and infrastructure orientation to ensure comprehensive representation of the required content. At the same time, integrate fire prevention and firefighting solutions and designs suitable for each level of planning in accordance with the laws on fire prevention, firefighting, and rescue operations.
4. All diagrams and maps in the drawing component of the planning assignment file and the urban and rural planning file must clearly indicate the planning scope; boundaries, names of administrative units within and adjacent to the planning scope.
Chapter II
URBAN AND RURAL PLANNING ASSIGNMENT
Article 4. Regarding the General Plan
1. Explanation:
a) Reasons, necessity, and basis for establishing the general plan; determining the location, scope, and scale of the planning area.
b) Overview of natural characteristics and current status of the planning area; overview of main issues existing during the process of management and development.
c) Stating the directions for development at the national level, regional level, and planning scheme at the provincial level and projects currently underway that affect the planning area.
d) Determining the nature, driving force, role, and function of the planning area for the country, region, and province; viewpoints and development goals; identifying key issues to be resolved in the planning.
đ) Providing an overall assessment of the current status and potential for socio-economic development as a basis for forecasting population, labor, land, urban and rural development, and technical infrastructure.
e) Requirements for the level of investigation, data collection, statistics, and evaluation of the current status; requirements for current database (including geographic data).
g) Research requirements on the contents of the general plan suitable for the type of planning, in case of establishing the general plan.
h) Listing the catalog of drawings, explanations, and appendices; quantity and specifications of the general planning dossier products; budget estimate; planning schedule and progress for establishing the general plan; determining requirements for content, form, subjects, and plans to solicit opinions on the general plan.
2. Petition requesting approval of the general planning task and draft Decision of the competent authority approving the general planning task.
3. Related documents and materials:
a) Decision approving the previous general plan (if any); Decisions approving other plans and projects currently underway affecting the planning area.
b) Directives and operational documents of the competent authority regarding the organization of the general plan.
c) Other related documents.
4. Drawings:
a) Diagram showing the position and relationship within the overall urban and rural system planning at the national level, regional level, and provincial level consistent with the role of the planning area for the country, region, and province.
b) Map of boundaries and scope of the general plan.
c) Drawings of the general planning task dossier displayed according to appropriate scales on the map guiding the development of the national urban and rural system; map of development direction for the urban and rural system; map of planning scheme for the urban and rural system.
5. In addition to the above requirements, the general planning task dossier must also meet the following requirements:
a) For expanded cities and new cities, sufficient grounds and bases must be provided to choose the direction of city development and determine the planning area and scale.
b) For communes, requirements for collecting information, documents, and statistics about the current status and projected development of agricultural activities, food security requirements within the commune; identifying areas that have developed according to urban standards or have been planned according to urban standards.
c) For economic zones, requirements for collecting information, documents, and statistics about the current status and forecasted development of industry, agriculture, trade, services, logistics in related provinces and regions impacting the economic zone's development objectives.
d) For national tourist areas, requirements for collecting information, documents, and statistics about the current status and forecasted development based on tourism potential and demand from the country, region, and province impacting the tourist area's development objectives.
Article 5. Regarding the district planning
1. Explanation:
a) Reasons, necessity, basis for establishing the district planning; determining location; arguments for the scope of planning, scale of area to be planned;
b) Overview of natural characteristics and current status of the area to be planned;
c) Stating development orientations in provincial planning or higher-level planning or other technical specialized planning that affect the district planning; preliminarily identifying key issues to be resolved and requirements for detailing the approved higher-level planning;
d) Determining population and labor force size, land use needs, and infrastructure requirements for the area to be planned;
đ) Determining requirements for investigation, survey, data collection, analysis, and evaluation of the current status to ensure all contents of the planning as stipulated in Chapter III of this Circular; requirements for current status database;
e) Requirements for the contents of the district planning;
g) Determining the list of drawings, descriptions, and appendices; quantity and specifications of planning dossier products; budget estimate; schedule and progress for establishing the district planning;
h) Determining requirements for content, form, target audience, and plan for soliciting opinions on the district planning.
2. The proposal for approval of the planning task and draft Decision of the competent authority to approve the planning task for the district planning.
3. Related documents and materials:
a) Decision approving the previous district planning (if any); Decision approving the provincial planning or higher-level planning or other technical specialized planning and ongoing projects affecting the planning area;
b) Directives and management documents of the competent authority regarding the organization of the district planning;
c) Other related documents.
4. Drawings:
a) Location diagram of the planning area according to the provincial planning or master planning or other technical specialized planning;
b) Map defining the scope of planning, scale of area to be planned;
c) Drawings of the planning task dossier displayed at appropriate scales on the current topographic map combined with the spatial development orientation map or the land use planning map;
5. For functional district planning based on provincial planning or regional planning or other technical specialized planning, in addition to the above requirements, it must also meet the following requirements:
a) Arguments for determining the location and boundaries of planning when the provincial planning or regional planning or other technical specialized planning does not specify these contents;
b) Determining specific development forecasts based on the nature, development potential, and needs of the country, region, province related to the functional area's development goals. At the same time, identify emerging economic, social, technical, and environmental issues arising from the formation of the functional area according to the provincial planning or regional planning or other technical specialized planning.
Article 6. Regarding detailed planning
1. Explanation:
a) Reasons, necessity, basis for establishing detailed planning; location, boundary, area, function of the planning area; preliminary development orientations in the master planning and content of the approved district planning affecting the detailed planning area; stating management and investment development needs for the detailed planning area. Detailed planning must be consistent and synchronized to detail the approved master planning or district planning;
b) Evaluating natural characteristics and current status; identifying key issues and contents to be resolved in the detailed planning and requirements for detailing the approved district planning;
c) Projecting population and labor force size; basic indicators applied to land use needs, social infrastructure, and technical infrastructure based on the provisions of the approved district planning and master planning;
d) Specific requirements for investigation, survey, data collection, and current status assessment; requirements for current status database;
đ) Requirements for the contents of detailed planning, requirements for prioritizing construction projects within the planning area; determining requirements for researching spatial organization, architectural landscape, land use, technical infrastructure connections, and other requirements;
e) Determining the list of drawings, descriptions, and appendices; quantity and specifications of detailed planning dossier products; budget estimate; schedule and progress for establishing detailed planning;
g) Determining requirements for content, form, target audience, and plan for soliciting opinions on detailed planning.
2. Proposal for approval of the detailed planning task and draft Decision of the competent authority to approve the detailed planning task.
3. Related documents and materials:
a) Decisions approving related plans; decisions approving previous master planning, district planning, and detailed planning (if any);
b) Directives and management documents of the competent authority regarding the organization of detailed planning;
c) Other related documents.
4. Drawings:
a) Location diagram of the detailed planning area extracted from the approved district planning or master planning;
b) Map of research scope and boundaries of the detailed planning area;
c) Drawings of the detailed planning task dossier displayed at appropriate scales on the current topographic map combined with the overall land use layout map or spatial organization and architectural landscape diagram of the approved district planning.
Article 7. Regarding individual urban design
1. Explanation:
a) The necessity, basis, and grounds for establishing individual urban design;
b) Determining the scope of research and boundaries for establishing individual urban design; objectives, principles for establishing urban design, and provisions regarding the contents that need to be achieved for individual urban design;
c) Stating the requirements and contents that need to be researched on spatial organization, architectural landscape, layout of facilities; requirements for researching regulations on urban conservation for old cities, old towns... (if applicable); requirements for infrastructure systems and environment.
2. The proposal for approving the task of individual urban design and the draft Decision of the competent authority to approve the task of individual urban design.
3. Related documents and materials:
a) The decision on general planning, zoning planning (if any);
b) Directives and management documents of the competent authority on organizing the preparation of individual urban design planning;
c) Other related documents.
4. Drawings:
a) Location map, boundary map for individual urban design extracted from the general planning or zoning planning or detailed planning;
b) Drawings of the task dossier of individual urban design presented at an appropriate scale based on the current topographic map combined with the land use master plan map or spatial organization and architectural landscape diagram of the approved zoning planning.
Article 8. Regarding underground space planning for centrally-administered cities
1. Explanation:
a) Reasons, necessity, and grounds for establishing underground space planning; location, scope, scale of establishing underground space planning. Preliminary directions for development in the general urban planning and content of the approved zoning planning affecting the scope of establishing underground space planning. Stating the management and investment development needs for the area of establishing planning. Underground space planning must be consistent and synchronized with specialized technical infrastructure planning and concretize the approved general planning.
b) General assessment of natural characteristics and current status, preliminary determination of key issues and basic contents to be resolved in underground space planning and requirements for concretizing the approved general planning;
c) Forecasting the demand for underground space usage; basic criteria applied to land use, space, and infrastructure system based on the provisions of the approved general planning and development requirements;
d) Specific requirements for investigation, survey, data collection, and current status assessment; requirements for current status database;
d) Requirements for the main content of underground space planning; forecasting the construction projects to be invested in; determining the requirements for researching spatial organization, architecture, landscape, land use, technical infrastructure connection, and other requirements;
e) Determining the list of drawings, descriptions, and appendices attached; quantity and specifications of planning dossier products; budget estimate; planning and progress schedule for preparing the planning; determining the requirements for content, form, and subjects to provide opinions on the planning.
2. The proposal for approving the task of underground space planning and the draft Decision of the competent authority to approve the task of underground space planning.
3. Related documents and materials:
a) Decisions approving related plans; decisions approving general planning, zoning planning, detailed planning (if any);
b) Directives and management documents of the competent authority on organizing the preparation of underground space planning;
c) Other related documents.
4. Drawings:
a) Location map, area map for underground space planning based on the approved general planning;
b) Drawings of the task dossier of underground space planning presented at an appropriate scale based on the current topographic map combined with the land use map of the approved general planning.
Article 9. Regarding the specialized planning for technical infrastructure for centrally-administered cities
1. Explanation:
a) Reasons, necessity, basis for establishing specialized technical infrastructure planning; location, scope, scale of specialized technical infrastructure planning. Preliminary development directions in the general urban planning and content of approved zoning plans that affect the scope of specialized technical infrastructure planning. State management and investment development needs for the planning area. Specialized technical infrastructure planning must be consistent and synchronized with underground space planning and concretize the approved general planning.
b) General assessment of natural characteristics and current status, preliminary determination of key issues and basic contents to be addressed in specialized technical infrastructure planning and requirements for concretizing the approved general planning;
c) Anticipated demand for technical infrastructure usage; basic criteria applied in land use, space, and infrastructure systems based on the provisions of the approved general planning and development requirements;
d) Specific requirements for investigation, survey, data collection, and current status assessment; requirements for current status database;
d) Requirements for the main content of specialized technical infrastructure planning; anticipated construction projects for technical infrastructure investment; determination of requirements for research on organization, spatial connection, technical infrastructure, and other requirements;
e) Determination of the list of drawings, descriptions, and appendices; quantity and specifications of planning dossier products; anticipated budget; planning schedule and progress; determination of requirements for content, form, and subjects to provide feedback on specialized technical infrastructure planning.
2. The proposal for approval of the planning task for specialized technical infrastructure and the draft Decision of the competent authority to approve the planning task for specialized technical infrastructure.
3. Related documents and materials:
a) Decisions approving related plans; decisions approving general planning, zoning planning, detailed planning (if any);
b) Directives and operational documents of the competent authority regarding the organization of specialized technical infrastructure planning;
c) Other related documents.
4. Drawings:
a) Location diagram, map of the area for specialized technical infrastructure planning based on the approved general planning;
b) Drawings of the planning task dossier for specialized technical infrastructure planning presented at an appropriate scale on the current topographic map combined with the land use planning map of the approved general planning.
Chapter III
URBAN AND RURAL PLANNING DOSSIER
Section 1
GENERAL URBAN AND RURAL PLANNING DOSSIER
Article 10. Regarding centrally-administered cities
1. Explanation:
a) Reasons, necessity, basis for establishing the general planning for centrally-administered cities;
b) Analysis of location, evaluation of natural conditions; current economic development status; current status of urban and functional area systems; current population and urban and rural residential distribution; current land use status in urban and rural areas throughout the city (including urban areas, rural areas, functional areas, agricultural production areas, forestry areas, and other areas according to the city's characteristics); current land use status in urban areas with a population equivalent to Class I cities; current status of architectural zoning and landscape; current status of social infrastructure, housing, technical infrastructure, and environment.
c) Evaluation of management work and implementation according to the approved planning regarding spatial development, land use, and technical infrastructure. Evaluation of the current status of investment and construction programs and development projects being implemented within the city. Identification of key issues to be resolved. Data must be compiled and presented through diagrams and tables accompanied by concise and clear explanations;
d) Determination of requirements and content according to the approved national planning, regional planning, and provincial planning for the city's development orientation;
đ) Determination of viewpoints, goals, nature, and preconditions for city development;
e) Forecasting population size, labor force, land scale; determining and selecting technical infrastructure, social infrastructure, and environmental indicators for urban and rural areas within the city;
g) Determination of principles and criteria for selecting urban development structure options;
h) Determination of overall urban and rural system model and structure; boundary range and spatial development orientation for urban and rural areas consistent with the urban system development plan in provincial planning;
i) Orientation for organizing functional zones; central development areas; areas of significant national importance in politics, culture, history, security, defense (if applicable); administrative center system, training, healthcare, cultural, sports, and other specialized centers at the national, regional, and city levels;
k) Orientation for organizing architectural and landscape zoning; green space and water body space, gateway areas, main spatial axes, city focal points; conservation of natural landscapes and cultural heritage;
l) Orientation for land use throughout the city by stages, including determination of areas for urban development, rural development, functional zone development, agricultural production, forestry, security, defense, and other areas according to management requirements. Determination of land use needs for housing development, social housing. For urban areas with a population equivalent to Class I cities within the city, determine the scale for various land use functions as stipulated in Appendix I of this Circular.
m) Guidelines for the development of underground space and technical infrastructure including: Guidelines for the development of underground space and technical infrastructure planning throughout the city: Determining the network of external transportation routes including roads, railways, waterways, and airports; the location and scale of airports, seaports, river ports, railway stations; road and urban railway lines (above ground, at ground level, underwater, and underground); determining the location and scale of international bus terminals; determining the volume, demand, and supply sources of water and energy; total amount of wastewater and waste; the location, scale, and capacity of key facilities and transmission and distribution networks of water supply, energy, lighting, communication, and drainage systems; the location, scale, and capacity of solid waste treatment areas, cemeteries, and other facilities for cities and functional zones within the city; Guidelines for the development of underground space and technical infrastructure planning for Class I cities within the city: Determining drainage basins, the network of stormwater drainage, and construction levels for each area; determining the main urban traffic network, urban railway lines and stations (above ground, at ground level, and underground); organizing public transportation systems and parking lots (above ground, at ground level, and underground); determining the red-line boundaries of main urban axes and technical moats; determining the location, scale, and capacity of key facilities and main distribution networks of water supply, energy, lighting, communication, and drainage systems;
n) Proposals for environmental protection measures within the scope of the planning: Establishing protected and restored environmental zones due to the impact of construction activities; requirements for waste management and pollution control during the construction process according to the planning;
o) Arguments and determination of priority programs and projects for investment according to the phases of the planning, ensuring feasibility in implementation;
2. The proposal for approval of the general planning and draft Decision of the competent authority to approve the general planning;
3. Related documents and materials:
a) Decision approving the task of the general planning; guiding and directing documents of the competent authority on organizing the general planning;
b) Decisions approving related plans; decision approving the previous general plan (if any);
c) Other related documents.
4. Drawings:
a) Diagram of location and regional relationships including: Location, scale, boundary of the planning; natural, economic-social, urban spatial development, technical infrastructure, and environmental relationships within the national planning, regional planning affecting the city being planned. Map representation at an appropriate scale based on the national urban and rural development system map; map of the direction of development of the urban and rural system;
b) Diagram of current urban and technical infrastructure development throughout the city: Location, scope of cities, functional zones; scale of urban areas, rural areas, functional zones, agricultural production areas, forestry areas, and other areas; social infrastructure, national-level, regional-level, and city-level technical infrastructure. Map representation on a topographic map at a scale of 1/25,000 or 1/50,000;
c) Current urban map with a population equivalent to a Class I city: Current status of functional zones as stipulated in the Appendix of this Circular; architectural landscape, social infrastructure system (education, healthcare, culture, commerce, green spaces, housing, etc.); technical infrastructure system (transportation, urban power supply and lighting, communication, water supply, ground elevation and stormwater drainage, sewage drainage; solid waste management, cemeteries, and environment). Map representation on a topographic map at a scale of 1/10,000 or 1/25,000;
d) Comprehensive evaluation map of construction land based on determining appropriate criteria for evaluation regarding topography, current conditions, hydrogeology; land use (determining favorable, less favorable, and unfavorable areas for urban functions development); determining restricted and prohibited development areas. Map representation on a topographic map at a scale of 1/10,000, 1/25,000, or 1/50,000;
đ) Diagram of overall urban spatial development orientation: Determining the scope of urban, rural, functional zones, central development areas, areas of national significance in politics, culture, history, security, defense (if applicable); administrative, educational, healthcare, cultural, sports, and other national specialized centers. Determining urban spatial axes and development corridors. Map representation on a topographic map at an appropriate scale;
e) Diagram of overall urban technical infrastructure development orientation fully reflecting the contents prescribed in point m clause 1 Article of this Law. Map representation on a topographic map at an appropriate scale;
g) Diagram of urban spatial development orientation for a city with a population equivalent to Class I: Urban development structure (including current status analysis diagrams and proposed options, accompanied by explanations on criteria for considering and selecting options) determining the framework of the main transportation system, connections between major functional zones, central areas, and directions for urban expansion. Determining the scope and scale of functional zones; zones for functional conversion; existing limited development zones, renovation and upgrading zones, conservation and restoration zones; new development zones (including the scope and scale of residential areas; national, regional, and city-level functional zones); conservation and restoration zones; no-construction zones; development reserve zones; security and defense zones. Determining the location and scale of central areas: Administrative, commercial-service, cultural, sports, green space, and open urban space centers; national, regional, and city-level specialized research, education, healthcare centers, etc. Determining the areas expected to construct underground works. Map representation on a topographic map at a scale of 1/10,000.
h) Diagram outlining the land use orientation for the entire city: Location and scale of areas for urban development, rural development, functional area development, agricultural production; forestry; national defense, security, and other areas as required by management. The drawing is based on a topographic map at a scale of 1/25,000 or 1/50,000.
i) Land use planning map for urban areas with a population equivalent to Type I: Location and scale of land use for each functional area as stipulated in Appendix I of this Circular; determination of population size, density criteria, and land use standards for each urban functional area during different development stages. The drawing is based on a topographic map at a scale of 1/10,000;
k) Maps outlining the orientation for developing technical infrastructure systems in central urban areas at scales of 1/10,000 or 1/25,000, fully reflecting the contents specified in point m, Clause 1, Article 1 of this Law;
l) Urban design drawings: Fully reflecting the contents required in point k, Clause 1, Article 1 of this Law at appropriate scales. Overall perspective drawings and main views simulating architectural space to clearly illustrate research contents.
Article 11. For cities, urban development-oriented areas, and special economic zones within the urban system
1. Explanation:
a) Reasons, necessity, basis, and grounds for establishing the overall plan; arguments and determination of the scope of planning and the scale and area of planning;
b) Analysis of location, evaluation of natural conditions; current population status, land use, architectural landscape, social infrastructure, technical infrastructure, and environment. a) Justification, determination of the scope of planning, area for planning; analysis and evaluation of the current status regarding natural conditions, social conditions, population, labor (if applicable) and land use functions as stipulated in the Appendix of this Circular; current architectural landscape, social infrastructure, technical infrastructure, and environment; evaluation of ongoing investment construction projects (if applicable). Article 19. For urban areas, rural areas, and functional zones
1. Explanation:
a) Justification for determining the scope of planning, scale of area to be planned; analysis and assessment of current conditions regarding natural conditions, population, land use, architectural landscape, social infrastructure, technical infrastructure, and environment; evaluation of ongoing investment development projects. Identify basic issues that need to be resolved;
b) Determine the objectives of the planning; evaluate the compatibility with existing urban development programs and plans; state the main requirements and orientations in the general planning and solutions in the detailed area planning (if any) already approved along with relevant management regulations concerning the planning scope;

Article 20. For individual urban design
1. Explanation:
a) Justification, determination of the scope and area for preparing the individual urban design, the planning area; analysis and evaluation of the current status regarding natural conditions, population, land use, architectural landscape, and technical infrastructure; stating the current investment development projects being implemented. Determination of basic issues that need to be resolved.
b) Determination of building density, height of buildings, setback distances from buildings on street blocks; controlling maximum and minimum heights of buildings for street blocks and plots; proposing content and design solutions for setbacks that do not disrupt the traditional structure of the area, meet the utility of the buildings, and harmonize with the overall landscape; specifying specific limits for the height of the first floor (or ground floor), dimensions, and elevation levels of balconies, terraces, and roofs;
c) Architectural shaping: Prominent buildings, dominant architectural styles, layout and distribution of buildings by function, architectural form of each type of building; architectural forms, solutions for organizing core spaces within street blocks and plots: public spaces, internal traffic, pedestrian zones, entertainment, sports, greenery, water bodies; design solutions must inherit and ensure harmony between distinctive traditional architectural forms and modern architecture; proposing small-scale architectural designs with symbolic, sculptural, and decorative elements that integrate with the overall shape language of the area. For advertising signs, proposals should include size, color, and proportion; the use of colors and materials for architectural works must be consistent with local traditions and customs, and harmonize with the overall natural landscape of the city.
d) For the green space and landscape system: Design solutions combining greenery with water bodies and the natural landscape of the area. Selection of locally available tree species suitable in size and color for the design plan.
đ) Solutions for conservation, restoration, and protected zones for cultural and historical heritage sites under the Law on Heritage; regulations on managing construction around these sites.

1. Explanation:
a) Reasons and necessity for establishing the planning; basis and grounds for establishing the land level and drainage planning;
b) Assessment of current topography, construction geological conditions, hydrogeological conditions, areas with environmental incidents (subsidence, collapse, geological erosion, landslides...);
c) Comprehensive assessment of urban construction land for each urban area including identification of favorable, unfavorable, restricted, and prohibited construction zones;
d) Assessment of current river basins, ponds, lakes; current land levels and embankments. Comprehensive assessment of urban drainage and flooding situations: frequency, area extent, depth, current drainage system status, location, scale of pumping stations;
đ) Determination of orientation contents in the general planning, basic criteria and parameters, drainage basins; drainage network and surface water reception sources; location and scale of main drainage works; determination of sewage drainage network; location and scale of wastewater treatment facilities; disaster prevention measures;
e) Determination of controlled construction elevations for specific construction areas and major city streets;
g) Preliminary determination of excavation and filling volumes for various areas;
h) Determination of priority investment programs and projects, estimated funding sources and implementation plans;
i) Environmental protection content: Establishment of protected and restored areas due to the impact of underground construction activities; requirements for waste management and pollution control during construction according to the land level and drainage planning;

Article 26. For specialized planning on solid waste management and cemeteries
1. Explanation:
a) Reasons and necessity for establishing the planning; basis and grounds for establishing the solid waste management and cemetery planning;
b) Assessment of current waste emission sources, types, characteristics, and quantities of solid waste; assessment of source sorting capacity and recyclability of solid waste;
c) Assessment of current cemetery situation including distribution, scale, operation, and usage (currently operating, planned closure, relocation, renovation...), crematoriums, and environmental impacts; assessment of funeral service locations and facilities;
d) Determination of criteria, forecasting sources and total quantity of generated solid waste; forecasting burial needs, land use requirements for solid waste management and cemeteries;
đ) Determination of locations and scales of solid waste collection points, transfer stations, treatment areas; crematoriums, funeral homes;
e) Proposing suitable treatment technologies;
g) Development of priority investment programs and projects; estimated funding sources and implementation plans;
h) Environmental protection content: Establishment of protected and restored areas due to the impact of underground construction activities; requirements for waste management and pollution control during construction and operation according to the solid waste management and cemetery planning;
2. Proposal for approval of the land level and drainage planning and draft Decision of the competent authority approving the land level and drainage planning;

REVIEW FILES, PLANNING ADJUSTMENT FILES AND RURAL AREAS
Article 27. Content of the review dossier for urban and rural planning
1. Reviewing urban and rural planning aims to control and assess the implementation situation according to approved plans and serves as a basis for deciding on plan adjustments.
2. The content of the report on reviewing urban and rural planning includes:
a) Reviewing the situation of establishing and implementing related plans, investment projects according to approved urban and rural planning and the general planning implementation plan;
b) Evaluating the achieved objectives, impacts, and effectiveness of implementation according to approved plans;
c) Analyzing new factors during the implementation of urban and rural planning and economic-social development in the planning area;
d) Recommendations and proposals;
đ) The dossier for reporting on reviewing urban and rural planning includes: Report documents, colored drawings at appropriate scales, and relevant legal documents.
Article 28. Components and content of the dossier for adjusting urban and rural planning
1. For overall adjustment of urban and rural planning: Components and content of the dossier for tasks and project designs for overall planning adjustments as stipulated in Chapter II and Chapter III of this Circular.
2. For partial adjustment of urban and rural planning, the components and content of the dossier include:
a) Report from the agency organizing the planning sent to the competent authority for approval of urban and rural planning, including: Reasons and necessity for partial adjustment of urban and rural planning; assessment of the current status of the adjustment area; content of partial adjustment of planning; analysis and clarification of the continuity and synchronization of the entire urban and rural planning and the socio-economic effects of partial adjustment; determination of economic-technical indicators achieved after partial adjustment, with comparison to previously approved indicators; assessment of the impact of partial adjustment on the implementation of already approved planning; proposal of measures to address new issues arising from partial adjustment; schedule and progress for implementation according to partial planning adjustment after decision by the competent authority. The report must be accompanied by relevant legal documents and materials;
b) Drawings showing contents including: Location, boundary range, and scale of the partial adjustment area; content of partial adjustment; determination of economic-technical indicators achieved after planning adjustment, with comparison to previously approved indicators;
c) Relevant legal documents; Summary report, explanation, and incorporation of opinions from agencies, organizations, individuals, and community residents regarding partial adjustment of urban and rural planning;
d) Draft Decision of the competent authority approving partial adjustment of urban and rural planning.
Chapter IV
ESTABLISHING THE DETERMINATION MARK DOSSIER, ORGANIZING DETERMINATION MARKS AND MANAGING MARKS ACCORDING TO URBAN AND RURAL PLANNING
Section 1
ESTABLISHING THE DETERMINATION MARK DOSSIER
Article 29. Requirements, principles for establishing, examining, and approving the determination mark dossier.
1. The determination mark dossier must be established and approved within 30 days from the date of approval of urban and rural planning for field marking or application of information technology.
2. Responsibilities for establishing and approval authority for the determination mark dossier are implemented according to Clause 2, Clause 3 of Article 52 of the Urban and Rural Planning Law. For planning under the approval authority of
3. The planning examination agency examines and submits for approval the determination mark dossier. Examination content includes:
a) Compliance with the approved urban and rural planning dossier and management requirements;
b) Types of marks, number of marks; technical specifications of marks as stipulated in Section 2 of this Chapter;
c) Budget estimate for implementing determination marks.
4. Application of information technology in determining marks:
a) For general planning, field marking is not carried out but only the determination mark dossier and boundary management are established and approved through suitable applications for planning establishment, examination, approval, and management work.
b) For areas prohibited from construction, conservation zones, historical and cultural relic restoration areas, and other areas requiring protection that have been marked according to specialized regulations, there is no need to establish, examine, and approve the determination mark dossier, but information on existing marks must be transferred and updated through suitable applications for planning establishment, examination, approval, and management work.
c) For traffic routes determined to maintain their current scale or land occupation scope according to the current status in approved urban and rural planning by the competent authority or internal roads in areas legally assigned to a unit for stable and appropriate management and use according to planning, there is no need to establish, examine, and approve the determination mark dossier and implement marking according to urban and rural planning.
5. Based on management requirements and the local urban and rural planning database system, People's Committees at all levels decide on the map scale for establishing the determination mark dossier within their approval authority according to Articles 34, 35, and 36 of this Circular.
Article 30. Survey Mark Setting Documentation According to Urban and Rural Planning
1. Components of survey mark setting documentation according to urban and rural planning include the explanatory note, drawings, budget estimate for implementing survey mark setting, relevant legal documents, and legal entity files of the specialized units responsible for surveying and mapping selected to prepare the documentation and implement survey mark setting; Petition and draft decision on approving the survey mark setting documentation.
2. Explanatory note of survey mark setting documentation:
a) Basis for preparing the documentation; current status of the area where survey marks will be set;
b) Content of survey mark setting including types of marks to be set; number of marks to be set; positioning plan for marks; distance between marks; reference marks (if any);
c) Implementation organization and mark setting schedule.
3. Drawings of survey mark setting documentation:
a) Diagram showing location and boundary of the area for setting survey marks extracted from approved urban and rural planning at an appropriate scale.
b) Drawing of survey mark setting showing the position, coordinates, and elevation of marks to be set based on a topographic map with an appropriate scale.
4. Requirements for survey mark setting documentation and regulations on maps serving the preparation of survey mark setting documentation according to urban and rural planning:
a) The documentation must be prepared on digital topographic maps confirmed by competent authorities; it must comply with and be consistent with approved urban and rural planning;
b) The survey area for preparing the documentation depends on management requirements and terrain conditions of the area; maps in the documentation must be prepared based on maps with an appropriate scale.
Article 31. Budget for Preparing Survey Mark Setting Documentation According to Urban and Rural Planning and Implementing Survey Marks in the Field
1. State budget funds are used to prepare survey mark setting documentation and implement survey marks in the field, supplement and restore marks for overall planning, district planning, and detailed planning not included in construction projects carried out under business models.
2. Funds of organizations and individuals are used to prepare survey mark setting documentation and implement survey marks in the field within project areas for planning included in construction projects carried out under business models.
3. Budget estimate for preparing and implementing survey mark setting shall follow the guidelines on methods for determining cost estimates for construction surveys as stipulated in the Circular of the Ministry of Construction guiding certain aspects of determining and managing construction investment costs.
Section 2
IMPLEMENTATION OF SURVEY MARK SETTING
Article 32. Types of Survey Marks
1. Specific types of survey marks according to urban and rural planning as determined in the survey mark setting documentation include:
a) Road centerline mark is a mark defining the coordinates and elevation positions of intersections and directional change points of the road centerline; marked with symbol TD;
b) Red-line boundary mark is a mark defining the boundary line separating land parcels designated for construction and land reserved for roads or infrastructure works; marked with symbol CGD;
c) Prohibited construction zone boundary mark is a mark defining the boundary line of prohibited construction zones; conservation areas, historical and cultural relic preservation areas, and other areas requiring protection; marked with symbol RG;
d) Reference mark to replace necessary marks in cases where the required mark's location does not meet setting conditions or setting the mark would affect existing structures; marked with symbol MTC.
2. Survey marks set in the field must ensure distances between marks of 30 meters or more depending on the terrain and morphology of the mark setting area and must meet management requirements regarding boundaries and elevations. If the distance between marks is less than 30 meters, it must be explained and justified in the survey mark setting documentation.
Article 33. Provisions on boundary markers
1. Boundary markers include the foundation for setting the marker, the base of the marker, and the body of the marker, which are produced from reinforced concrete, ensuring durability and easy identification.
2. The base of the marker has dimensions of 40x40x50 cm; the body of the marker has a length of 90 cm. The cross-sectional area of various types of marker bodies is specified as follows:
a) The centerline marker of roads has a circular cross-section with a diameter of 15 cm;
b) The red-line boundary marker of roads has a square cross-section with each side measuring 15 cm;
c) The boundary marker of areas has an equilateral triangular cross-section with each side measuring 15 cm;
d) The reference marker has a cross-section similar to that of the marker to be set; the reference marker displays all parameters necessary to refer to the marker to be set.
3. The face of the marker is attached with ceramic or iron centers engraved with the marker symbol and number.
Article 34. Setting up markers according to the general urban and rural planning using information technology
1. For centrally-administered cities, the markers include:
a) Centerline markers of main city streets planned for new construction or renovation within the city;
b) Red-line boundary markers of main city streets planned for new construction or renovation within the city;
c) Markers defining the boundaries of prohibited construction zones, conservation areas, historical and cultural heritage sites, and other areas requiring protection.
2. For urban development-oriented areas and functional zones, the markers set outside the actual site include:
a) Centerline markers of main streets and district roads planned for new construction or renovation within the urban area or functional zone;
b) Red-line boundary markers of main streets and district roads planned for new construction or renovation within the urban area or functional zone;
c) Markers defining the boundaries of prohibited construction zones, conservation areas, historical and cultural heritage sites, and other areas requiring protection.
3. For communes, the markers set outside the actual site include:
a) Centerline markers of main commune roads, inter-village roads, village main roads, and major internal agricultural roads planned for new construction or renovation within the commune;
b) Red-line boundary markers of main commune roads, inter-village roads, village main roads, and major internal agricultural roads connected to key infrastructure projects planned for new construction or renovation within the commune;
c) Markers defining the boundaries of prohibited construction zones, conservation areas, historical and cultural heritage sites, and other areas requiring protection.
Article 35. Setting up markers according to detailed urban and rural planning
1. The markers set outside the actual site for detailed planning include:
a) Centerline markers of roads planned for new construction or renovation within the planning area;
b) Red-line boundary markers of roads planned for new construction or renovation within the planning area;
c) Markers defining the boundaries of prohibited construction zones, including markers defining the boundary lines of prohibited construction zones, conservation areas, historical and cultural heritage sites, and other areas requiring protection within the planning area.
2. The competent authority approving urban and rural planning decides when approving the marker setting dossier whether to apply information technology (setting markers on digital files) instead of setting markers outside the actual site according to the marker setting dossier, but must organize public disclosure to affected agencies, organizations, and individuals and regularly inspect and supervise the actual site to ensure that development does not violate the approved urban and rural planning.
Article 36. Setting up markers according to detailed urban and rural planning
1. The markers set outside the actual site for detailed urban and rural planning include:
a) Centerline markers of roads and alleys planned for new construction or renovation within the planning area;
b) Red-line boundary markers of roads and alleys planned for new construction or renovation within the planning area. On the body of the red-line boundary marker, the prescribed parameters regarding building boundaries and construction levels must be clearly displayed;
c) Markers defining the boundaries of prohibited construction zones, including markers defining the boundary lines of prohibited construction zones, conservation areas, historical and cultural heritage sites, and other areas requiring protection within the planning area.
2. The competent authority approving urban and rural planning decides when approving the marker setting dossier whether to apply information technology (setting markers on digital files) instead of setting markers outside the actual site according to the marker setting dossier, but must organize public disclosure to affected agencies, organizations, and individuals and regularly inspect and supervise the actual site to ensure that development does not violate the approved urban and rural planning.
Section 3
COORDINATION IN IMPLEMENTATION OUTSIDE THE ACTUAL SITE, MANAGEMENT OF MARKERS, MAINTENANCE OF RECORDS AND PROVISION OF INFORMATION ON MARKERS
Article 37. Responsibility for coordinating the setting of boundary markers, acceptance, and handover of boundary markers on-site
1. The dossier for setting boundary markers must be sent by the agency or unit responsible for setting boundary markers on-site to the People's Committee at the grassroots level related to the area before implementing surveying, measurement, and on-site marker deployment activities.
2. The People's Committee at the grassroots level, based on the plan for surveying, measurement, and on-site marker deployment, shall have the responsibility to coordinate with the unit responsible for setting boundary markers.
3. In cases where the location of the on-site boundary markers differs from the approved boundary marker dossier, the unit responsible for setting boundary markers must report this specific content at the time of acceptance to the specialized management agencies regarding urban and rural planning to update it in the relevant planning dossier.
4. After completing the on-site boundary marker setting according to the boundary marker dossier, the agency responsible for organizing the on-site marker deployment shall organize the acceptance and handover to the related grassroots-level People's Committee for the organization of marker protection.
Article 38. Responsibilities for managing and protecting boundary markers
1. The People's Committee at the grassroots level is responsible for managing the planning boundary markers within the administrative boundaries under its jurisdiction. It shall annually organize inspections, promptly identify lost or deviated markers compared to the approved boundary marker dossier.
2. The People's Committee at the grassroots level has the responsibility to protect on-site boundary markers, organize propaganda and mobilize the people to participate in protecting and managing markers locally; in cases where markers are displaced or damaged, they must promptly report in writing to the provincial People's Committee and the specialized management agency to develop a recovery plan.
Article 39. Retaining the boundary marker dossier according to the planning
1. Planning management agencies, land management agencies at all levels have the responsibility to retain the boundary marker dossier within their approval authority and provide relevant materials and data about the markers to organizations, entities, and individuals requesting them in accordance with the law.
2. Agencies and units organizing tasks, dossiers for setting boundary markers, and organizing on-site marker deployment have the responsibility to hand over the approved boundary marker dossier to the relevant planning management agencies and land management agencies for retention, coordinated management, and on-site marker deployment, serving inspection, supervision, and management work according to urban and rural planning. The dossier includes: Decision approving along with explanatory notes; signed and stamped approved drawings, files storing all explanatory notes, drawings, and acceptance and handover records of on-site boundary markers.
3. The provincial People's Committee is responsible for making copies of the boundary marker dossier and handing them over to the related grassroots-level People's Committees for on-site marker management.
4. The boundary marker dossier according to urban and rural planning is a document for authorities at all levels to use in publicizing planning, managing planning; implementing investment projects, construction permits, land use rights certificates, land allocation (leasing) in accordance with regulations.
Article 40. Providing information about the boundary marker dossier to organizations and individuals upon request
1. Agencies entrusted with managing and retaining the boundary marker dossier as stipulated in Clause 4, Article 52 of the Urban and Rural Planning Law have the responsibility to organize the receipt and provision of the approved boundary marker dossier according to the requests of organizations and individuals.
2. Information-providing agencies may provide information in the following forms: written responses; providing copies of approved boundary marker drawings.
Chapter V
URBAN AND RURAL PLANNING GEOGRAPHICAL DATA DIGITAL DATABASE
Article 41. Principles for Building Geographic Database on Urban and Rural Planning
1. The geographic database on urban and rural planning must meet the following technical requirements:
a) The location, boundary range, and direction of geographic objects must be consistent with relevant legal bases as prescribed by law and comply with the provisions of law on protecting state secrets and related provisions.
b) In cases where there is insufficient legal basis to accurately determine the location, boundary range, and direction of geographic objects in planning, symbols indicating the proposed location, boundary range, and direction of geographic objects shall be shown in the geographic database, and will be detailed in subsequent planning steps or during the project investment construction phase.
2. The content of the geographic database on urban and rural planning must be consistent and synchronized with the legal database; it must correctly and fully reflect national territorial sovereignty, and be in accordance with international treaties to which the Socialist Republic of Vietnam is a member.
3. Determining the priority level of geographic objects in the geographic database must adhere to the following principle:
a) Geographic objects concerning the main content of the planning shall be prioritized in other contents;
b) The order of priority for geographic objects is as follows: point-type geographic objects, line-type geographic objects, and area-type geographic objects.
Article 42. Technical Requirements for Implementing Geographic Data on Urban and Rural Planning
1. Diagrams and maps of urban and rural planning shall be established within the reference system and national coordinate system according to Decision No. 83/2000/QĐ-TTg dated July 12, 2000.
2. The digital geographic database shall be packaged in a suitable GIS software format, including data groups; each thematic data group has data layers. Thematic data on urban and rural planning are organized based on the objects identified in the dossier: planning boundaries; spatial organization; urban design; land use; transportation; technical preparation; electricity supply; other energy systems; communication; water supply; wastewater discharge and environmental sanitation, urban and rural planning boundary markers.
3. Detailed regulations on the urban and rural planning database are stipulated in Appendix II attached to this Circular.
Article 43. Management of Digital Geographic Data on Urban and Rural Planning
The establishment, development, protection, management, processing, and use of digital data; products and services related to digital data; state management; rights, obligations, and responsibilities of agencies, organizations, and individuals related to activities involving digital geographic data on urban and rural planning shall be carried out in accordance with the Law on Data.
Chapter VI
IMPLEMENTATION
Article 44. Implementation Provisions
1. This Circular takes effect from July 1, 2025.
2. All of the following Circulars are hereby abolished:
a) Circular No. 04/2022/TT-BXD dated October 24, 2022 issued by the Minister of Construction stipulating the dossier and plan for inter-district, district-level urban and rural planning, urban planning, urban and rural functional area planning, and rural planning.
b) Circular No. 10/2016/TT-BXD dated March 15, 2016 issued by the Minister of Construction stipulating the setting up and management of planning boundary markers for urban and rural areas.
c) Circular No. 06/2013/TT-BXD dated May 13, 2013 issued by the Minister of Construction guiding the content of Urban Design and Circular No. 16/2013/TT-BXD dated October 16, 2013 amending and supplementing some articles of Circular No. 06/2013/TT-BXD dated May 13, 2013 issued by the Minister of Construction guiding the content of Urban Design.
Điều 45. Điều khoản chuyển tiếp
1. Trong quá trình rà soát, thực hiện điều chỉnh các quy hoạch đô thị, quy hoạch xây dựng đã phê duyệt, các thành phần, ký hiệu về hồ sơ quy hoạch được điều chỉnh theo các quy định tại Thông tư này.
2. Đối với các quy hoạch đô thị, quy hoạch xây dựng đã phê duyệt chưa xây dựng hoặc chưa đầy đủ các cơ sở dữ liệu của hồ sơ điện tử, Ủy ban nhân dân cấp tỉnh, thành phố trực thuộc Trung ương cần lập kế hoạch, bố trí kinh phí và xây dựng bổ sung hồ sơ điện tử theo các quy định tại Thông tư này.
Điều 46. Trách nhiệm thực hiện
1. Tổ chức, cá nhân tham gia lập, thẩm định và phê duyệt quy hoạch đô thị và nông thôn có trách nhiệm thực hiện theo quy định tại Thông tư này về hồ sơ của nhiệm vụ quy hoạch và hồ sơ quy hoạch đô thị và nông thôn.
2. Vụ Quy hoạch - Kiến trúc, Cục Hạ tầng kỹ thuật thuộc Bộ Xây dựng; các cơ quan chuyên môn về quy hoạch đô thị và nông thôn cấp tỉnh có trách nhiệm hướng dẫn, kiểm tra việc thực hiện các quy định tại Thông tư này./.
