Based on Decree No. 221/2013/NĐ-CP dated December 30, 2013 of the Government stipulating the system of applying administrative handling measures for placement in compulsory drug rehabilitation facilities (hereinafter referred to as Decree No. 221/2013/NĐ-CP);

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Implementing Decision No. 2472/QĐ-TTg dated December 28, 2011 of the Prime Minister on providing some publications for ethnic minority areas and mountainous regions, particularly difficult areas during the period 2012-2015 (hereinafter referred to as Decision No. 2472/QĐ-TTg);

Considering the proposal of the Director of the Department of Administrative and Public Financial Affairs;

The Minister of Finance promulgates this Circular stipulating the management and use of funds to implement the policy of providing some publications for ethnic minority areas and mountainous regions, particularly difficult areas during the period 2012-2015.

Article 1. Scope of application:

This Circular applies to state administrative agencies, agencies assigned budgets to implement contracts for ordering publication and distribution of some publications; newspapers, magazines, distribution units, and agencies, units, and subjects receiving some publications as specified in Article 2 of Decision No. 2472/QĐ-TTg.

Article 2. Sources of funds and budget preparation for implementation

1. Funds for implementing the policy of providing (without charge) some publications for ethnic minority areas and mountainous regions, particularly difficult areas are guaranteed by the central government budget and allocated in the annual budget of the Committee for Ethnic Minorities.

2. The establishment, allocation, and assignment of the state budget for providing (without charge) some publications for ethnic minority areas and mountainous regions, particularly difficult areas shall be carried out in accordance with the Law on State Budget and guiding documents thereof.

3. Based on the number of agencies, units, and subjects receiving publications and the publishing and distribution costs announced by the Ministry of Finance, the Committee for Ethnic Minorities prepares the budget for implementing the provision (without charge) of some publications, which is included in the annual state budget expenditure plan of the Committee for Ethnic Minorities and submitted to the Ministry of Finance for consolidation and reporting to the Prime Minister for submission to the National Assembly for approval.

For the year 2012, the Committee for Ethnic Minorities prepares the budget for implementing the provision (without charge) of some publications and submits it to the Ministry of Finance for review to supplement the Committee for Ethnic Minorities' annual state budget expenditure plan.

4. Based on the approved budget, the Committee for Ethnic Minorities signs contracts for ordering publication and distribution of some publications for ethnic minorities, mountainous regions, and particularly difficult areas with newspapers, magazines, and the Central Press Distribution Company before January 20 each year.

Article 3. Ordering publication and distribution of annual publications

1. Basis for ordering:

- The authorized budget allocated to the Committee for Ethnic Minorities to implement the policy of providing some publications for ethnic minority areas and mountainous regions, particularly difficult areas annually as per Decision No. 2472/QĐ-TTg;

- The publishing and distribution costs for state-ordered publications (provided without charge) as announced by the Ministry of Finance;

- Names of newspapers and magazines participating in publication; names of agencies, units, and subjects receiving publications and the number of issues published according to Decision No. 2472/QĐ-TTg;

- The number of agencies, units, and subjects receiving publications and the number of publications published and distributed as announced by the Committee for Ethnic Minorities.

2. Content of contracts for ordering publication and distribution of publications shall be implemented in accordance with Decision No. 39/2008/QĐ-TTg dated March 14, 2008 of the Prime Minister on bidding, ordering, and assigning tasks for providing public services using state budget funds and Circular No. 105/2008/TT-BTC dated November 13, 2008 of the Ministry of Finance guiding certain provisions of Decision No. 39/2008/QĐ-TTg dated March 14, 2008 of the Prime Minister on bidding, ordering, and assigning tasks for providing public services using state budget funds.

3. Adjustment of contracts for ordering:

a) Contracts for ordering may be adjusted if they remain valid in terms of time.

b) Contracts may be adjusted in any of the following cases:

- Change in publishing and distribution costs for publications as notified by the competent authority;

- Change in the number of agencies, units, and subjects receiving publications; the number of issues and quantity of publications published and distributed as decided by the competent authority.

c) The total value of adjusted contracts must not exceed the annual budget for implementing the policy of providing some publications for ethnic minority areas and mountainous regions, particularly difficult areas already allocated to the Committee for Ethnic Minorities.

Article 4. Payment for Ordering Contracts for Publishing and Distributing Publications

1. On the basis of the budget estimate assigned by the competent authority; ordering contracts for publishing and distributing publications for ethnic minority regions, mountainous areas, and particularly difficult regions between the Committee for Ethnic Minorities and newspapers, magazines, and the Central Press Distribution Company; the Committee for Ethnic Minorities shall implement:

a) Withdraw the budget estimate at the State Treasury where transactions take place to make the first advance payment in the first quarter equal to 30% of the annual contract value for newspapers, magazines, and the Central Press Distribution Company;

b) Subsequent advance payments: The number of advance payments, time of advance payments, and amount of each advance payment shall be carried out according to the agreement in the contract based on the progress of implementing the contract.

2. Contract settlement.

a) Newspapers, magazines, and the Central Press Distribution Company shall compile the implementation status of the Contract before January 15th and send it to the Committee for Ethnic Minorities. Within seven working days from the date of receiving all documents from newspapers, magazines, and the Central Press Distribution Company, the Committee for Ethnic Minorities shall be responsible for organizing acceptance, settling the contract, and paying the remaining contract value (if any) to newspapers, magazines, and the Central Press Distribution Company.

b) Payment of the order contract for publishing publications shall be based on:

- The order contract and the amended order contract (if any);

- Printing contracts, printing contract settlements between newspapers, magazines, and printing units;

- Acceptance and settlement records of ordering contracts between the Committee for Ethnic Minorities and newspapers, magazines;

c) Payment of the order contract for distributing publications shall be based on:

- The order contract and the amended order contract (if any);

- Confirmation records regarding the quantity of publications transferred for distribution between the Central Press Distribution Company and newspapers, magazines;

- The acceptance and settlement contract for distributing publications between the Committee for Ethnic Minorities and the Central Press Distribution Company.

3. Specific expenditure vouchers directly implemented by newspapers, magazines, and the Central Press Distribution Company shall be retained in accordance with current regulations.

Article 5. Management, Use, and Final Settlement of Funds for Ordering Publications and Distributing Publications

1. Newspapers, magazines, and the Central Press Distribution Company must separately account for the state funds allocated for ordering publications and distributing publications for ethnic minority regions and mountainous areas, and particularly difficult regions according to the current accounting system, and fulfill financial obligations (if any) in accordance with relevant regulations.

2. The management, use, and final settlement of funds for ordering publications and distributing publications shall be carried out in accordance with the detailed provisions and guidance for implementing the Law on State Budget issued by Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government, and other guiding documents.

3. The Committee for Ethnic Minorities shall be responsible for reviewing and approving the final settlement of funds for implementing policies of providing (without charge) certain publications for ethnic minority regions and mountainous areas, and particularly difficult regions, which will be consolidated and submitted together with the regular expenditure final settlement of the Committee for Ethnic Minorities to the Ministry of Finance for review in accordance with the Law on State Budget and guiding documents.

4. Funds for ordering publications and distributing publications allocated in the budget of a given year shall be implemented and settled within that year's budget. At the end of the year, any surplus funds from contracts not yet accepted and settled, and any unused budget surplus (if any) shall be handled in accordance with current regulations on year-end budget processing.

Article 6. Effectiveness

1. This Circular takes effect from December 1, 2012, and applies from the 2012 fiscal year.

2. During the process of implementation, if there are any difficulties, organizations and individuals are requested to promptly report them to the Ministry of Finance for study and resolution./.
